SomeraSilva has recovered tens of millions of dollars for clients for medical malpractice, personal injury, and wrongful death cases.
The Somera Silva Building is an appropriate metaphor for South Florida: an invigorating blend of old and new.
Blending time - honored legal traditions with technological innovations, SomeraSilva is proud to practice this noble profession by winning tens of millions of dollars for our clients.
Our practice is limited to medical malpractice, personal injury, and wrongful death.
As part of SomeraSilva’s commitment to giving back to the community, SomeraSilva proudly is a Grand Benefactor to the American Alzheimer’s Association.
Success means winning cases.
All glory comes from daring to begin. -Eugene F. Ware
Peter J. Somera Jr. and Paul M. Silva M.D., J.D. are two of the most
experienced medical malpractice attorneys in the United States. Medical
malpractice is the second leading cause of death in the United States. A
study by the Institute of Medicine estimates more than 100,000 people a
year die from medical malpractice.
Medical malpractice is the failure of a doctor or other licensed medical
professional to provide a patient with treatment equal to the customary
standard of care that results in a permanent injury or death. SomeraSilva
is in a unique position to review and litigate medical malpractice cases as a
result of our experience in medicine and law.
SomeraSilva handles wrongful death cases with damages in excess of
30 million dollars. A “wrongful death” claim is a statutory cause of action
that may be brought on behalf of a surviving spouse, children, and parents
of a decedent to compensate them for the losses they sustained as a result
of the wrongful death of their family member. The “wrongful” act that
resulted in death may have been intentional, reckless, or negligent as long
as it is of the character that would have permitted the decedent to maintain
an action for injuries had death not resulted.
Serious car and other motor vehicle accidents require the guidance of an
experienced attorney. These cases arise out of injuries that occur on the
road, whether the injured party was in a car, on a bicycle, or a pedestrian.
Sometimes these cases arise when the person who caused the injury does
not have adequate insurance. In such cases, the injured person may be able
to make a claim against their own uninsured motorist or under-insured
motorist insurance coverage.
SomeraSilva works with physicians and other healthcare providers to assess
and review all aspects of your injuries and the long term impact they will
have on you. Our lengthy experience with both medicine and Florida’s
automobile, insurance and liability laws means we understand how to prove
the full extent of your injuries and find all possible sources of recovery
available to compensate you for the damages you have suffered and will
continue to suffer in the future.
A dangerous condition on property may lead to an injury. The dangerous
condition may be the result of a natural condition of the property or an
artificial one created on the property by the owner, lessor, or occupant.
Liability for dangerous property is known as “premises liability.” The
property may be a residential home, construction site, public area,
commercial premises, or any other type of property. The dangerous
condition is one that poses an unreasonable risk of harm to individuals
that are on the premises, and may involve structural design flaws, unsafe
conditions, environmental hazards, improper traffic patterns and a wide
range of other issues.
