5.2 Energex, as an Advice Agency, has assessed the application as the landholding is identifiedas being located within 100 metres of an Energex substation, specifically lot 1 on RP92074.Energex has reviewed the proposal both relevant to its interests as a land owner and a

referral agency under the Sustainable Planning Regulation 2009 and offer no objection tothe proposal.

SCHEDULE 6 - ADVISORY NOTESAssessmentManagerThis approval has effect in accordance with the provisions of Division 5 Section 339 of theSustainable Planning Act 2009.

Relevant Period - Pursuant to Section 341 of the 'Act'the approval will lapse if the first change ofthe use under the approval does not start within the 'relevant period' - four (4) years starting theday the approval takes effect.

The Planning Act 2016 provides for a person to make a change to this development applicationoutside the applicant's appeal period, following the process outlined in chapter 3, part 5, subdivision2 of the Act.

Separate development approval is required for any building work and plumbing/drainageworknecessitatedby the conditions contained in this approval.

Dust pollution arising from the construction and maintenance of the works required by this approvalare the applicant's responsibility. The applicant must comply with any lawful instruction fromCouncli's Manager of Operations if in his opinion a dust nuisance exists.

A legible copy of this development approval package is to be available on the premises.

Pay to Council any outstanding rates or charges or expenses that are a charge over the landholdings and levied by Council; and/or levied but not fully paid over the land holdings.

Under section33 of the Transport infrastructureAct 1994, written approval is requiredfromthe Department of Transport and Main Roads to carry out road works on a state-controlledroad. Please contact the Departmentof Transport and Main Roads onNorth.Coast.lDAS@tmr.qld.gov.auto make an applicationfor road works approval.This approval must be obtainedprior to commencing any works on the state-controlledroad reserve. The approval processmay require the approval of engineering designs ofthe proposed works, certified by a Registered Professional Engineer of Queensland(RPEQ). 460 Evidence of local planning instruments or master plans(1) If a chiefexecutive officer of a local government is satisfied a

document is a true copy of a local planning instrument ormaster plan, or a part of the local planning instrument ormaster plan, in force for the local government at a time statedin the document, the chief executiveofficer may so certify thedocument.

(2) In a proceeding, a document certified under subsection (1) is

admissible in evidence as if it were the original local planninginstrument or masterplan, or part of the instrument or plan.

461 Appeals by applicants(1) An applicant for a developmentapplication may appeal to the

court against any of the following-(a) the refusal, or the refusal in part, of the development

manager's decision about any part of the applicatiorirequiring impact assessmentunder section 314; or

(b) · the part of the approval relating to the assessmentmanager'sdecision under section 327.

(2) To the extent an appeal may be made under subsection (1), theappeal may be against 1 or more of the following-(a) the giving of a developmentapproval;

-(i) a condition of, or lack of condition for, the

approval;or

(ii) the length of a period mentioned in section 341 forthe approval.

(3) However, a submittermay not appeal if the submitter-(a) withdraws the subniission before the application is

(b) has given the assessmentmanager a notice under section339(1)(b)(ii).
