RE: Proposed Zoning By-law Amendment Preconsultation Environmental Impact Study Dated December 2011 Lot 60, Concession A, RP 3R 641 Part 2 941 Lake Range Drive Geographic Township of Huron Municipality of Huron-Kinloss (Edward Dobrowolski)

The Saugeen Valley Conservation Authority (SVCA) is reviewing the proposed and the supplemental Environmental Impact Study (EIS) dated December 2011, prepared by Beacon Environmental. Authority staff conducted a site review of the property on August 26,2011. Based on the SVCA's review of the information provided. the SVCA makes the following points and asks for the following clarification and revisions. The EIS is generally acceptable pending responses to the following.

I. The dry and fresh poplar deciduous forest - FOD3-] appears to be the most suitable area for the proposed building envelope given the existing disturbance, elevation, and vegetation data. It appears as though the proposed building envelope is partially within this area, and also extends from this area to the south of this community. Please adjust the proposed building layout so that no portion of the proposed dwelling is outside of this vegetation community. The proposed sewage disposal system should be as close to this community as possible while avoiding the 15 metre well setback.

2. The dry and fresh mineral cultural thicket - CUT1 appears to be a more appropriate location for the sewage disposal system compared to fresh and moist ash lowland deciduous forest FOD7-2 cUlTently being the location proposed for the sewage disposal system. Please discuss the viability of this alternate location for the sewage disposal system given the SVCA's observations, the desire to maintain as much woodland connectivity as possible, required setbacks from property lines, setbacks from private wells, and the recommended setback from the wetland.

3. Tree removal should be limited to the dry and fresh poplar deciduous forest - FOD3-1 which likely reduces the recommended

15 metre cut area to the south of the proposed building. Tree removal in the dry and fresh mineral cultural thicket - CUTI could be considered also depending on the most appropriate location for the sewage disposal system.

Natural Hazard

The EIS has referenced a number of natural hazard related policies, Regulations, and has made some conclusions on natural hazard issues. While the SVCA recognises that significant natural heritage is the focus of the repoli, natural hazard issues are the mandate of the SVCA and the report does not need to address natural hazards, or the related policies. For instance the 100 year flood event is referenced in the report, as are "Fill Areas" by the report. The Hurricane Hazel flood event standard is the appropriate Regulatory Flood to reference and there are no "Fill Areas" on the subject lands. The SVCA does not require amendment (0 the repOli or plan related to the natural hazard references in the report. Please note that the report does not impact the SVCA's review of natural hazards for tilture reference

Conclusion

Once the SVCA has been provided with responses to the above noted comments, and the recommended revisions and clarifications are provided, the SVCA will continue with our review ofthe proposal. Once the building envelope is finalized the SVCA will complete a site inspection to verify grades in the specific locations to be altered. No vegetation remove should occur, or site alterations take place, without municipal and SVCA approvals in place.

Following up on Ed's discussion summary of April 11, 2012 the SVCA is not prepared to approve the rezoning as proposed by the EIS which includes all of the property's frontage on Lake Range Drive. It was agreeable to the proponent for the SVCA to produce a map with an agreeable EP limit from the SVCA's perspective for the consideration of owner, Township, and County as the SVCA did indicate a portion of the frontage is looking favorable for a rezoning from EP to allow a single detached dwelling to be constructed on site.

While I have not yet produced this map, upon reviewing the February Revision to the EIS, in Figure 8, there is a representation of the agreeable EP limit from the SVCA's perspective. The "Limit of Tree Removals" is the appropriate EP boundary in the opinion of the SVCA given the information available at this time associated with Natural Heritage and Natural Hazards on site.

If further revisions are required to this recommended EP boundary, the SVCA would request opportunity to review those changes before the circulation of the formal rezoning occurs.

SVCA is in agreement with the EIS Report, however the area to be rezoned from EP to Residential should be reduced to a smaller footprint from the recommended area in the E1S. Some of the area south of the proposed dwelling should remain zoned EP. From a natural heritage perspective all of the proposed area for rezoning is acceptable to SVCA, however from a flooding hazard perspective there is not enough hydrology information ( flood mapping) to establish that the southern pOltion would be above the flood plain.

In the future if the owner undertakes a hydrology study and the study indicates that the lands are above the flood plain then SVCA will consider this additional infonnation.

Erik will mark-up the site plan to indicate the reduced area for rezoning and will forward this drawing to Heather James and Ed Dobrowolski within the next day or two.

Eric will also provide conespondence to the Bmce County on the EIS and SVCA recommendations. This letter will be issued by Eric before the end of the week.

Phone call between Heather James and Ed Dobrowolski

Ed updated Heather on the discussion with Eric. Once Heather receives the correspondence from Eric she will circulate the entire application

to the agencies for comments. The agencies have 20 days to respond. A meeting will be set up for the ( I believe) fourth Thursday in May with the Huron Kinloss

Council. A meeting will be set up with the County folks in June. The final meeting will be with the County Planning folks the first week of July. Once the County makes their decision there is a 20 day appeal period.

Meeting with Matt Farrell - preliminary design review of building plans

Ed Dobrowolski, Kyle Dobrowolski met with the Chief Building Official of Huron-Kinloss , Matt Fanell on March 23rd, to present the preliminary design package for the building.

The meeting went very well and a final set of design plans is being worked on. We broached the subject of getting a bit of an early start on the project due to the timeline for

processing the rezoning application, Matt indicated that he would likely permit some site preparation ( no new constmction ) during the appeal period in July.

Folks, based on the above info1111ation, I am hoping that we expedite the application and that by the first week of July we have all of the necessary approvals ( not counting the appeal period ), Please let me know if there is anything I can do to help the process,

The Saugeen Valley Conservation Authority (SVCA) has reviewed these proposed amendments in accordance with the SVCA's mandate and policies and the Memorandum of Agreement between the Authority and the County of Bruce relating to Plan Review. The SVCA has no objection to the rezoning of a portion of the property, and the associated redesignation as necessary, southwest of the existing residential lots, that will allow the development of a single detached dwelling on the subject lands in accordance with the approved reports and plans. The SVCA offers the following comments.

On site August 26, 2011 the SVCA noted existing frontage on Lake Range Drive for the proposed development location. Should Lake Range Drive not be adequate for access to the site then the SVCA would ask to revise these comments.

The SVCA notes that during the creation of the existing residential lots at the corner of Concession 12 and Lake Range Drive, from this lot, restrictions where established for the subject propelty which do not allow for development to occur on this property. This was agreed to by the owner so as to allow the lot creation. Now development is proposed contrary to prior planning agreements and established restrictions for the subject lands. The SVCA can consider this proposal based on recent site investigations, the proposed area to be developed, and the submitted reports which indicate a single detached dwelling could be located on the subject lands.

Site Description

The Stewart Wetland is located on the majority of the subject property. The Stewart Drain also 1l0ws through the subject property. Residential development borders the propelty to the northwest.

Natural Heritage Features and Areas

The natural heritage features on the subject property are significant woodlands, fish habitat, and wetlands.

The woodlands on the property are in excess of 40 hectares in size and form part of connecting corridors and linkages for wildlife in the area. The wooded area on the subject property is part ofa forest corridor extending to the south, east and north of the property.

The SVCA considers this extent offorest cover to be significant woodland as the geographic Township of Huron has a forest cover percentage below 30%. Woodlands boundaries are not considered broken by standard roadways or property boundaries.

Fish Habitat and wetlands are also located on the subject property but will not be impacted by the proposed and will be protected via the continuation of the EP zone and review by the SVCA associated with our Regulation.

Bruce County Official Plan

The entirety of the property is designated 'Hazard', The SVCA would not be opposed to an adjustment to the hazard designation in accordance with section 5.8.7 of the OP to accommodate one single detached dwelling and sewage disposal system immediately adjacent to the neighboring lots. This hazard line adjustment should be in accordance with the approved Environmental Impact Study (EIS). The Hazard designation recognizes the wetland, and tlood hazard associated with the wetland to the east, the Municipal Drain, associated flooding, and a distance back from these natural hazards.

The SVCA notes the following policies of the Bruce County Official Plan associated with significant natural heritage that need to be addressed by the proposed.

A) Section 4.3.8 (Significant Woodlands) states in part:

For Townships with less than 30%forest cover. wood lots of 40 hectares or greater are considered significant. Prior to development heing permitted in these areas the proponent of the development shall be required to undertake an Environmental Impact Study. Where it cannot be demonstrated through the preparation of an Environmental Impact Study that

the proposed development will not impact on the habitat/resource function of the wood lot, the development shall be refused.

An appropriate Environmental Impact Study (EIS) has been submitted outlining how the proposal will avoid and address significant natural heritage. Fish habitat and wetlands were also reviewed by the EIS and will be appropriately addressed.

Huron-Kinloss Official Plan

The Huron-Kinloss Official Plan indicates that the property is subject to significant natural heritage policies and natural hazard policies. Site conditions and the submitted EIS have satisfied the Huron-Kinloss Official Plan's natural hazards and natural heritage policies in the opinion of the SVCA.

Section 3.10.3 of the plan indicates that the Natural Hazard Boundaries may change without amendment to the plan where the SVCA and the Township are not opposed to such a change. The SVCA is not opposed to the Hazard designation being slightly adjusted to avoid the proposed building site, as recommended by the SVCA and the ElS in previous review.

Township of Huron-Kinloss Zoning By-Law 2001-157 as amended

The Township of Huron-Kinloss Zoning By-Law 2001-87 as amended zones the subject property as Environmental Protection (EP). This EP zone recognizes the wetland, and flood hazard associated with the wetland to the east, the Municipal Drain, associated flooding, and a distance back from these natural hazards.

Based on field inspections and analysis conducted by SVCA staff the Authority is not opposed to the rezoning ofa portion of the EP zone. The represented area to be rezoned on the circulation appears to be larger than the approved EIS's recommended building envelope. The frontage of the area to be removed from the EP zone should be reduced 10-15 metres along its southern proposed lim it the SVCA recommends.

The EP zone shall remain on the remainder of the lot as the SVCA is not willing to consider any additional lots, or additional EP reductions, given the information available at this time associated with the wetland feature, flood prone areas, and site conditions.

SVCA Regulation

All of the subject property is subject to the SVCA's Development, Interference with Wetlands and Alterations to Shorelines and Watercourses Regulation (Ontario Regulation 169/06). This Regulation applies to the work or development activity within a Regulated Area and where a permit from the SVCA may be required. To locate the approximate Regulated Area,

the existing EP zone plus a 50 metre offset distance from the zone boundary should be used. This screening method is intended to indicate the approximate area within which the Regulation could apply. If development is proposed in or near this area, the SVCA should be contacted, as permission may be required.

A permit from the SVCA will be required for the proposed development. Design requirements of that approval may include minimum exterior opening elevations, sewage disposal system location requirements, site layout restrictions. driveway entrance restrictions, etc ..

Should buildings or structures or site alterations be proposed in the future on the subject lands the SVCA should be contacted as permission may be required for that proposal regardless of any dccisions or activities associated with this proposal.

Conclusion

The SVCA has reviewed the plan review issues specific to the SVCA's mandate and interests associated with the proposed development. The SVCA is not opposed to the Zoning By-law and OP amendments provided the significant natural heritage features are addressed in accordance with the Bruce County Official Plan and Natural Hazards are addressed via appropriate zoning boundaries on the subject lands as recommended above.

The SVCA has also reviewed the proposal from an SVCA review and approval perspective associated with our Regulation. Upon the resolution of existing Zoning and OP issues SVCA staff would not be opposed to the approval of an SVCA permit on the subject lands for a single detached dwelling and sewage disposal system provided specific design criteria are incorporated into the design of that proposal as discussed in the EIS.

Thank you for providing comments on the Environmental Impact Study (EIS) for 941 Lake Range Road that was submitted to your office by Beacon Environmental in December 2011. In response to the comments in your letter of February 10, 2012, I have made the following revisions to the EIS report and rnapping.

1. The building envelope has been limited to low constraint vegetation units 2 (FOD3-1) and 3 (CUTl). This rnodification avoids encroachrnent into unit 1 (FOD7·2) and the 15.0 rn wetland buffer. The proposed septic systern is situated at the rear of the house and is greater than 15.0 m from the existing well.

2. The proposed septic systern has been re-Iocated to correspond with vegetation unit 3 (Cun), thereby avoiding encroachrnent into vegetation units 1 and 4 (FOD7-2).

3. Tree clearing will be limited to vegetation units 2 and 3 which significantly reduces the footprint of the proposal and also maximizes the extent of contiguous woodland cover on the site,
