    EXECUTIVE SUMMARY

    The American Lung Associaon State of Tobacco Control 2014 report tracks progress on key tobaccocontrol policies at the state and federal levels. The report assigns grades to every state in four key areas:tobacco prevenon and control spending, smokefree air, cigaree tax and cessaon coverage. The gradesare based on tobacco control laws and regulaons in eect as of January 2, 2014.

    While other states have taken steps forward, progress in California, which was once on the forefront oftobacco control eorts, has stagnated. Our state has made lile to no headway in increasing its tobaccoprevenon and control funding, protecng its workers from loopholes in the smokefree workplace law,raising its cigaree tax or increasing cessaon coverage. California once again received F grades for

    Tobacco Prevenon and Control Program Funding and Cessaon Coverage and a D for its Cigaree Tax,which, at $0.87, ranks 33rd in the naon. While California receives an A for its Smokefree Air, our state hasfailed to close any of the loopholes that sll leave approximately 1.5 million workers at risk of exposure tosecondhand smoke in their place of employment.

    In conjuncon with the naonal report, the American Lung Associaon in California releases its Stateof Tobacco Control 2014 California Local Gradesreport to track how well California cies and counesprotect their cizens from the burden of tobacco. The State of Tobacco Control 2014 California LocalGradesreport is based on a review of county and municipal codes in three key areas smokefree outdoor

    air, smokefree mul-unit housing and reducing tobacco sales; and averaged for one Overall Tobacco Controlgrade. The 2014 report includes grades for every city and county in California -- all 58 counes (which coverthe unincorporated areas of the county) and all 482 of the incorporated cies and towns in the state.

    While the naonal grades reect important issues that the state of California should address, thereis more that can be done locally. Millions of people in California are sll aected by tobacco, tens ofthousands of youth in California become smokers each year and untold numbers of Californians areimpacted by secondhand smoke. Leadership and soluons to these problems can come from everylevel of government. Local elected ocials can, and should, take steps to protect the residents of their

    communies from tobacco and secondhand smoke by passing policies to restrict smoking in parks andother outdoor areas, require mul-unit housing buildings to be nonsmoking and prevent illegal sales oftobacco products to youth.

    HIGHLIGHTS OF THE REPORT

    40 CITIES AND COUNTIES RAISED THEIR GRADES IN 2013In 2013, 40 municipalies adopted local ordinances in at least one of the three categories included in theState of Tobacco Control 2014 California Local Gradesreport. Elected ocials in these cies and counesdemonstrated strong leadership in adopng policies to protect their residents and improve the health of theircommunies. Policies passed in 2013 include 14 ordinances to prohibit smoking in mul-unit housing, 30ordinances to restrict smoking in outdoor areas and seven ordinances to require tobacco retailers to obtaina license to sell tobacco products. See the Cies and Counes on the Rise secon of the report (page 9) forthe full list of municipalies that passed policies in 2013.

    SEVEN CITIES IMPROVED THEIR GRADE FROM AN F TO AN A IN AT LEAST ONE POLICY CATEGORYThe cies of Carmel-By-The-Sea, Carpinteria, Hillsborough, Lafayee, and Oroville improved their grade froman F to an A in at least one category. Two addional cies, Daly City and Walnut Creek, improved from an F toan A in two categories, Smokefree Outdoor Air and Smokefree Housing, resulng in overall B grades. Thesecies have demonstrated strong leadership by passing strong tobacco control ordinances.

    ONE CITY IMPROVED ITS OVERALL GRADE TO AN A

    Berkeley is the only city this year to be added to the list of cies and counes that receive an overall Agrade. There are now 18 communies in California that receive an Overall Tobacco Control grade of A. These

    municipalies represent a diverse mix of communies in terms of income, size, and racial diversity. These 15cies and three counes have demonstrated that there is public support and polical will for strong tobaccocontrol policies in all types of communies and have set a high bar for others to follow. See the Top of theClass secon of the report (page 6) for more informaon on these cies and counes.

    FOUR CITIES RAISED THEIR OVERALL GRADE TO A B

    This year, four cies passed policies to raise their overall grade to B. Carpinteria, Daly City, Petaluma andWalnut Creek all passed policies that protect the cizens in their communies. Although these cies sll havethe opportunity to further improve the health of their residents, they have taken bold steps to ensure that the

    laws they have implemented are as strong as possible.

    TOP TEN CALIFORNIA CITIES BY POPULATION

    The ten most populous cites in California account for 25 percent of the states populaon. Strong tobaccocontrol laws in these cies can make a big dierence in protecng more than a quarter of Californias residentsfrom secondhand smoke and other dangers of tobacco. In 2013, two of the most populous cies in California-- San Diego and San Francisco -- passed tobacco control policies. Both cies passed policies in the areas ofSmokefree Outdoor Air and Smokefree Housing. San Diego increased their points in those categories, but didnot increase its grade. San Francisco improved its grade in the area of Smokefree Housing. Below is a tableshowing the grades for the ten most populous cies in California.

    TOP OF THE CLASS

    This year, there are 18 cies or counes that received an Overall Grade of A. These areas throughout Californiaare a diverse mix in many aspects, demonstrang that support for tobacco control policies exists in all types ofcommunies.

    These jurisdicons are of every size and are spread geographically throughout the state. They havepopulaons as low as 18,000 (Albany) and as high as 194,000 (Glendale). Nine jurisdicons are located inthe south (Baldwin Park, Calabasas, Compton, Glendale, Hunngton Park, Pasadena, Santa Monica, SouthPasadena, and Temecula) and nine are located in the north (Albany, Berkeley, Contra Costa County, Dublin,Richmond, Marin County, Santa Clara County, San Rafael, and Union City). In addion, these cies and

    counes have varying levels of income and ethnic diversity. The cies and counes range from predominantlywhite, to predominately Hispanic. The graphs below show a comparison of all 18 municipalies in the areas ofEthnicity, Lano Origin, Median Income, and Populaon.

    ETHNICITY:

    The graph below shows the ethnic breakdown of each of the 18 jurisdicons. Each municipality varies inits ethnic breakdown, from Union City, with a reported 50.9% Asian populaon, to Compton, with a 32.9%African American populaon. Diverse communies across the state support tobacco control policies. Forinformaon on Lano Origin, see page 7.

    LATINO ORIGIN:

    Because of the way in which the census is conducted, informaon on Lano Origin is collected seperatly from

    other racial demographics. The graph below depicts the Lano Origin of the residents of cies and couneswith an A grade. These municipalies range from predominantly Lano communies, such as Hunngton Parkwith a populaon of 97.1% of Lano Origin, to communies with very low numbers of residents with LanoOrigin, such as Calabasas (6.4%). Lano Origin, much like ethnicity, varies among the highest graded cies,demonstrang support from a diverse group of constuents.

    The graph below shows the median income for the 18 municipalies with overall A grades. These jurisdicons fall

    at all levels of the income scale, from wealthier communies such as Calabasas ($118,182) and Dublin ($111,481)to less auent communies such as Compton ($43,311) and Hunngton Park ($36,788). There is no correlaonbetween a communitys median income and its ability to pass and implement tobacco control policies.

It isclear from the graph that jurisdicons with populaons of all sizes have implemented tobacco control policies.Glendale, with a populaon of 193,652, has the largest populaon of this group, while the city of Albany,

    with a populaon of 18,430, has the smallest. The dierence in populaon has not aected the ability toimplement strong tobacco control policies.

    CITIES AND COUNTIES ON THE RISE

    Cies and counes that have taken acon during 2013 toward raising their grades deserve specialrecognion. These 40 Cies and Counes on the Rise passed an ordinance in at least one of the threepolicy categories this past year. In most cases, their acons improved their grade, but in some, theordinance(s) only contributed to increasing the points in the parcular grade category. Either way, thesepolicies are noteworthy and deserve acknowledgement.

    State Law There is no statewide declaraon that specically declares secondhand smoke a nuisance.However, California law does declare anything that is injurious to health or obstructs the free use of property, soas to interfere with the comfortable enjoyment of life or property, a nuisance. Under this denion it is possibleto prove involuntary secondhand smoke as a nuisance, but specically declaring that exposure as a nuisancelowers the burden of proof and makes it easier to stop that exposure.

    REDUCING SALES OF TOBACCO PRODUCTS

    Descripon An important aspect of reducing smoking prevalence rates in California is to reduce the availabilityand sales of tobacco products. This reducon in access to tobacco products can be done through requiringlocaons that sell tobacco products to meet certain requirements, through liming where tobacco products canbe sold, or through regulang the sampling of tobacco products.

    State Law It is illegal in the state to sell or give tobacco products to anyone under the age of 18. There are lawsin California to punish the business owner or the clerk when an illegal sale is made. Tobacco retailers are alsorequired to obtain a state tobacco retailer license, which has generally been used to combat black market salesand tax evasion.

    Criteria In order for a local licensing ordinance to eecvely reduce illegal sales to minors, it must containfour provisions: (1) requiring tobacco retailers to pay an annual fee that suciently covers administraonand enforcement eorts, including compliance checks; (2) requirement that all retailers obtain a license tosell tobacco and renew it annually; (3) provision that any violaon of a local, state or federal tobacco law is

    considered a violaon of the license; and (4) nancial deterrent through nes and penales for violaons thatincludes suspension and revocaon of the license. Of these four provisions, it is essenal that the licensingordinance requires a sucient fee that will cover the administraon and enforcement of the license to ensurethat these acvies occur. A city/county can get credit for meeng the annual fee requirement if it uses othersustainable funding sources (such as funds from the Master Selement Agreement) that are dedicated foradministraon and enforcement of the retailer license.     Sale of Tobacco Products Near Schools and ParksDescripon Cies and counes can restrict where tobacco retailers are located and can prohibit them frombeing located within a certain distance, such as within 1,000 feet, of schools and parks. This type of policycan be enacted in several ways including through condional use permits, other zoning restricons and local

    tobacco retailer licensing ordinances. By reducing the presence of tobacco retailers in locaons where youthcongregate, this type of policy can reduce sales of tobacco products to youth and assist with eorts to reduceyouth smoking.
