Newsletter 2014-36 September 5, 2014 SPACE FOR FIVE MORE ATTENDEES FOR THE CAWV & BRICKSTREET OSHA 10 HOUR COURSE HAS JUST ADDED The second CAWV / BrickStreet Insurance OSHA 10-Hour course for association members that participate in the CAWV / BrickStreet Workers Compensation program has just added space for five additional attendees. The training will be held at the Holiday Inn and Suites in South Charleston on September 11 from 8:00 a.m. to 5:00 p.m. and on September 12 from 8:00 a.m. to 12:00 p.m. The cost is $60.00 per attendee and includes continental breakfast both days and lunch on the first day. Please contact Pat McDonald immediately at 304-342-1166 to register for the remaining space in the course. Senate Bill 376 was passed into law during the 2014 legislative session and went effect on July 1, 2014. It requires all construction workers on a publicly financed project over $50,000 to complete the OSHA 10-Hour Course. CAWV members also have access to the online training site ‘ClickSafety’ which offers an OSHA approved 10-Hour training class online for $80.00. Members can take the class over several days by logging into their account and continuing the class from the point they stopped. Also the CAWV will be adding additional OSHA 10-Hour training courses so students that get left out of this class will be notified and placed into the next class. The CAWV will be scheduling additional OSHA 10- Hour courses that will be open to all members of the association. Members that have employees that needs the OSHA 10-Hour course are encouraged to contact Pat McDonald at [email protected] or at (304)342-1166 to be put on the attendee list for the next course. TAKE ACTION: TELL CONGRESS TO HALT EPA AND THE CORPS' OVERREACHING CLEAN WATER ACT REGULATION Next week, the U.S. House is expected to vote on H.R. 5078, the Waters of the United States Regulatory Overreach Protection Act. This bill would halt the U.S. Environmental Protection Agency (EPA) and U.S. Army Corps of Engineers’ (Corps) proposed rulemaking that redefines “waters of the U.S.” under the Clean Water Act (CWA) by preventing the agencies from developing guidance or interpretative rules based on it. The bill also requires the agencies to engage in a federalism consultation with state and local governments to form recommendations for a consensus regulatory proposal. Tell your Representative to vote in support of this important legislation. The EPA and Corps rule expansively defines waters – claiming traditionally navigable waters, tributaries (including ditches), impoundments, adjacent waters (including waters in the floodplain or riparian areas), and “other waters” all as federally jurisdictional. More projects will have to obtain Section 404 permits, increasing the time and cost of performing construction services. In addition to the Section 404 impacts, many other federal permits will be required. Under the proposal, many other parts of the CWA are affected by the definition of “waters of the U.S.,” such as Section 311 Oil Spill Prevention Control and Countermeasures or Section 402 National Pollutant Discharge Elimination System (NPDES) discharge permits, which are triggered by many types of construction activities across the nation and will therefore have a direct and significant impact on construction operations. EPA also chose to not wait for a final peer review of their Connectivity Report, touted as the basis of the proposed rule, by the EPA’s own Science Advisory Board. The economic analysis that EPA has undertaken seriously underestimates impacted acreage and also completely ignores impacts to non-404 programs. Recognizing that state and local governments are currently managing water resources that are not under federal control, it is unclear why the agencies rushed through these important procedural steps designed to ensure that construction companies are protected. These state and local governments were also not consulted prior to the rulemaking. Reprinted from AGC’s September 4 Construction Legislative Week in Review. EMPLOYERS ADVISED OF POTENTIAL SCAM WorkForce West Virginia is alerting employers in West Virginia to a potential scam from individuals purporting to be from the agency and asking for financial data. On Thursday, September 4, someone who claimed to be an employee of WorkForce West Virginia contacted an employer by email asking for cancelled checks for unemployment tax contributions. The email was sent from a personal email address and did not come from a WorkForce West Virginia employee. Electronic correspondence from WorkForce West Virginia is sent only from wv.gov addresses. Any employer who receives a suspicious email is asked to contact WorkForce West Virginia at 1-800-252-5627 or via email at [email protected]. The potential scam has been referred to the state Attorney General’s office.

WV DESIGN BUILD BOARD APPROVES PUBLIC SERVICE COMMISSION BUILDING FIX AS DESIGN-BUILD PROJECT The WV Design-Build Board has given approval to the WV Public Service Commission to use the design-build method of construction to fix the serious problems with the brick exterior of their Charleston headquarters. Much of the 30-year-old building’s brick façade has fallen, or could fall at any time. A separate contract last year removed much of the brick and it was discovered the required enforcement to secure the brick of cast stone to the building was often missing completely or inadequately spaced, according to a May 2013 report on the building. Repairing the existing brick was not seen as an option. Instead, the report says all brick covering the three-story building should be removed or the brick from the top two floors should be removed and replaced with a glass wall. More details when the requests for qualifications are released. THE GREENBRIER TO BUILD TENNIS STADIUM The Greenbrier resort is building a 2,500-seat tennis stadium which, in 2015, will become the home for The Greenbrier Champions Tennis Classic, the resort’s showcase of retired tennis legends. The new stadium, dubbed Center Court at Creekside, will feature a U-shaped design, with the open side facing Howard’s Creek and offering views of the resort’s marquee Old White golf course. The resort has already broken ground on the arena and expects to complete it by June of next year. The 46,000-square foot facility was designed by Detroit-based ROSSETTI architects, a news release from the resort said. This is the second major project that The Greenbrier has announced this year. The resort hosted training camp for the New Orleans Saints after building three new football fields and new facilities for the NFL team. SEPTEMBER IS NATIONAL PREPAREDNESS MONTH

An emergency can happen anytime, anywhere. September is National Preparedness Month and

we would like to share some important information about business preparation in a potential

emergency situation. The Centers for Disease Control and Prevention, along with sponsorship

from the Federal Emergency Management Agency, have developed an extensive library with

emergency preparedness tips for the workplace, as well as at home and school. This

information highlights four easy steps to being prepared in any situation. They are:

Get a kit

Make a plan

Be informed

Get involved

An emergency kit contains basic items, and should be equipped to last for at least 24 hours at

the workplace. Some basic items to include in this kit are:

Several gallons of water

Non-perishable food items

First-aid kit

Flashlight and batteries

Medications

Step two, making a plan, is equally as important as creating a kit. Details to include can be as

simple as where employees should go and how to be accounted for. A preparedness policy also

should be written and distributed so information is thoroughly communicated to all employees.

HIGHWAY TRUST FUND WILL NEED AT LEAST $7 BILLION FOR FY 2015

The Congressional Budget Office (CBO)—the federal government’s official score keeper when it comes to budgets and program expenditures—released August 27 projections showing the Highway Trust Fund (HTF) will be require at least $7 billion in additional resources to support existing levels of highway and public transportation investment from June 1, 2015, through September 30, 2015. According to CBO, the Highway Account of the HTF will be $2 billion short to get through FY 2015 and the Transit Account will need an amount less than $500 million. The U.S. Department of Transportation claims surpluses of $4 billion in the Highway Account and $1 billion in the Transit Account are necessary for cash flow purposes. Overcoming the trust fund’s projected revenue deficit and meeting the department’s liquidity requirement pushes the next round of HTF supplementary needs to $7 billion or more.

Congress approved legislation at the end of July that transferred $10.8 billion into the HTF to avert a revenue shortfall and preserve surface transportation investments through May 31, 2015. Roughly $3 billion of that $10.8 billion was needed to maintain trust fund continuity in August and September. The remaining $7.8 billion—when combined with incoming motor fuel taxes and other highway user fees—will support highway and transit spending for the first eight months of FY 2015.

While the latest CBO projection simply quantifies what was already anticipated—as the July congressional action was always represented as a temporary patch, it reinforces the need for ARTBA and our members to continue to push Congress to enact a long-term HTF revenue plan by the end of this year. Absent such action, the next HTF revenue crisis looms just as the 2015 construction season would otherwise be kicking into high gear.
