**If the session is to be conducted further than 30kms from Logan (Crestmead), a travel fee will be payableplease enquire as we only travel certain distances for portrait sessions.

** A $100 deposit is required within 5 working days to secure your chosen date. The deposit is non-refundableif you cancel, however you may re-schedule for another mutually convenient date.

**A private online gallery will be available for you to view your edited images & make your selections (this willbe available approx. 2-3 weeks after your session)

** After a booking has been made we will email you a contract form with our terms & conditions which will equire a signature & to be returned prior to your session. A session will not commence until we have receivedthese signed forms

*All wedding packages include 2 photographers. If you would like extra reception coverage of your day it is an additional $250/hour or we can work out a special price for full day coverage. Also please note that package prices may vary depending on travel distance/time.

My fee includes travelling fee if the venues are within a 60km radius of Logan (Crestmead). Additional travelling fees will be charged if the wedding venues are not within this coverage area. Please contact me further for an exact travelling quote if your location is outside of this area. The client is responsible for their own travelling expenses & any charges associated with location costs. For weddings wherea great deal of travel (ie – interstate travel) is required, a minimum of 2 nights’ accommodation & return �ights for me & my husband (2nd photographer) is required to be paid by the client. By agreeing to a session with Special Memories Photography, you agree that copyright of your images is retained by Special Memories Photography unless otherwise agreed upon. All 'SPM' pricing is subject to change without prior noti�cation. Current pricing is locked in once a booking has been made along with the non-refundable booking fee.

The terms and conditions (which will be supplied prior to booking your session) are required to be signed, and returned prior to your session. Shooting will not commence until these forms are signed and returned.

A non-refundable $400 deposit is to be paid within 14 days of your booking/invoice. This will secure your booking with Special Memories Photography. The remainder funds will be required 14 days prior to the wedding date as cleared funds. Please note - when booking extra reception coverage 2 meals are to be provided for the photographers whilst they are there.

AGREEMENT Overview: This agreement contains the entire understanding between SM Photography and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement, which does not mean that any other provision is also waived. The party against whom a waiver is sought to be e�ective must have signed a waiver in writing.

COOPERATION: The parties agree to cheerful cooperation and communication for the best possible result within the de�nition of this assignment. SM Photography is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to SM Photography.

IMAGES and COPYRIGHTS: the photographs produced by SM Photography are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without SM Photography's explicitly written permission. Upon �nal payment by the client, the client has limited copyright ownership of the resulting images, which may be used only for personal use and may not be copied ,or reprinted without express permission of SM Photography. This permission is included with high resolution disks, with which the owner may make prints for personal use and sharing, as well as use for their personal blogs, sites, and social networks. The owner may not re distribute the disk in any manner. The Client must obtain written permission from, and compensate SM Photography prior to the CLIENT, or its friends/ relatives publishing or selling the images for pro�t. The ownership of the physical Images in the form delivered shall be the property of the Supplier. Sketches and any other materials created in the process of making the �nished Images shall remain the sole property of the Supplier. Storage media (such as computer disks and digital cards) that contain electronic copy of any or all of the Images shall be the sole property of the Supplier. All photographic materials, including but not limited to digital �les, negatives, transparencies, proofs, and previews, shall be the exclusive property of the Supplier. In the event that digital negatives are provided, the photographer still retains copyrights on the photographs. SM Photography will store several copies of the CLIENTS images for 12 months. It is strongly suggested that the CLIENT makes additional copies of the photos for backup purposes only.

MODEL RELEASE. The CLIENT & Subject hereby grant to SM Photography and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the CLIENT may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same; and to copyright the same. The CLIENT hereby releases SM Photography and its legal representatives and assigns from all claims and liability relating to the photographs.

Additonal Information

Additonal InformationLIABILITY: In the unlikely event that the photographer is injured or becomes too ill, or has an extreme emergency that prevents him from photographing the event, SM Photography will make every e�ort to reschedule the event. If for whatever reason this is not possible, responsibility and liability is limited to the return of all payments received for the package purchased. SM Photography takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that the photographs have been lost, stolen, or destroyed for reasons within or beyond SM Photography's control, SM Photography liability is limited to the return of all payments received for the portrait package. The Supplier and any of his agents or third party associates will not be liable in the unlikely event that a problem arises, whether due to lateness, no show, accident, neglect, human error, loss of materials, acts of god, equipment or other failures. The Supplier is not responsible for loss of, or interference with, the photography due to restrictions on the location, including but not limited to, interference from surrounding devices, access limitations, �ash restrictions, and the like. This limitation on liability shall also apply in the event that photographic materials are damaged in processing (digital), lost through camera malfunction, lost in the mail, �re or otherwise lost or damaged without fault on the part of the Photographer. Client understands the unpredictable and non-posed nature of photojournalism (assumption of risk) and waives any right to any civil action due to missed or lost photographs (including but not limited to unintentional in�iction of emotional distress and negligence). In the event the Supplier fails to perform for any other reason, the Supplier‘s liability is limited solely to the return of all payments received from the Client under this Agreement.

FINAL PHOTO PRODUCT: The Supplier makes no guarantee, either expressed or implied, in regard to the quality of the Images, because they are subjective and in addition, may be in�uenced by many factors beyond the control of the Supplier, especially during live or unstaged events such as weddings. It is also understood that the Client is hiring the Supplier for his technical and artistic expertise and, therefore, the Supplier reserves the right to edit the Images as he sees �t. The Supplier does not guarantee that everyone involved in the event will be photographed or will be included in the �nal Images. Client is aware that color dyes in photography may fade or discolour over time due to the inherent qualities of dyes, and Client releases Supplier from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities. It is recommended to place the photo and album in a dry, cool, shade area and never in direct sunlight in order to maximize the archive life. Client is aware that digital �les may be corrupted due to inherent media de�ciencies and random interference.

PHOTOGRAPHER SUBSTITUTION: The Supplier may substitute another photographer to take the photographs in the event of Supplier's illness or of scheduling con�icts. In the event of such substitution, Supplier warrants that the photographer taking the photographs shall be a competent professional. All Wedding packages include 1 main photographer along with an assistant photographer but this is subject to change if the assistant photographer is unable to attend the event. If only one photographer is able to attend the event it will not reduce the package price. There will be no price reductions or refunds if only one photographer is able to photograph the event.

WARRANTY AND INDEMNITY: The Supplier warrants and represents that he or she is the sole creator of the Images and owns all rights granted under this Agreement, that the Images are an original creation (except for materials obtained with the written permission of others or materials from the public domain), that the Images do not infringe any other person’s copyrights or rights of literary property, nor do they violate the rights of privacy of, or libel, other persons. The Client agrees to indemnify and hold harmless the Supplier against any claims, judgments, court costs, attorney’s fees, and other expenses arising from any alleged or actual breach of this warranty.

WEDDING COORDINATOR/PLANNER: Due to the nature of typical wedding day and varieties of events taking place in several locations, the photographer will frequently move, change and secure his/her equipment throughout the day. It is likely that the photographer is not in the proximity as the couple, therefore, is not aware what is about to be taken place. It is the responsible of the wedding coordinator/planner to inform the photographer when the next major event is about to take place. For example, starting of ceremony, �rst dance, cake cutting, toss of bouquet…etc. In addition, designated person shall be responsible in organizing and tracking all posed photos that are required. The photographer is there to take photos of all groups in front of him but cannot be responsible in organizing and tracking all the groups.

REIMBURSEMENT: The Client shall reimburse Photographer for any additional costs the Photographer may incur for travel, meals, parking, and other reasonable costs necessary to the performance of these services.

COMPLETION SCHEDULE: Images are expected to be prepared for proo�ng within 4-6 weeks (approx. 3 weeks for portrait sessions) of the event date. CD/DVD creation & printed items is expected within 6-8 weeks.

ALBUMS: Once designed, the design may be viewed by CLIENT for �nal approval. Minimal changes may be made at that time, but no changes may be made after �nal album approval. Changes in more than 10% of pages may incur additional charges. Production and delivery time will be approximately 4-6 weeks from �nal approval date.

RETAINER & PAYMENT SCHEDULE: $400 deposit is due at time of signing this agreement. This is a NON-REFUNDABLE RETAINER. In the event of cancellation, the retainer paid is non-refundable. It shall be liquidated for damages to SM Photography in the event of a cancelation, or breach of contract by the CLIENT. The CLIENT shall also be responsible for payment of any SM Photography materials/charges incurred up to time of cancellation. The remaining charges are payable in full 14 days prior to your wedding date (or on the day of your sessions for portrait sessions)

Photographic Products

Important information: To guarantee quality and correctly coloured & cropped prints we recommend you order your prints through us at Special Memories Photography. However if this is not an option for you right now we recommend that you take note of these few things. Many printing outlets have a built in auto correction so we recommend that depending on the outlet, you select the “no auto correction” option or advise the sales assistant that you want the auto correction taken o�. When ordering online you may need to speak to someone or make mention it in the notes/additional information.

You will �nd a di�erence in quality & colours depending on which photo centre you get your photos printed and your photos may also look di�erent on your monitor to what gets printed or what they look like on our correctly calibrated monitors. We cannot guarantee quality & correct colours if you choose to print the photos yourself. Special Memories Photography will not be held responsible for poor quality prints that are printed by the client.

Please also note that when selecting di�erent sized prints such as a cropped 8x10” & 11x14” there will be a great amount of the photo that will be cropped out so we recommend that you don’t choose tightly cropped photos for these sizes otherwise you may crop out important details from the photo/s.
