SECTION 1: REQUEST FOR PROPOSAL

1. SUBMISSION OF PROPOSALS:

1.1. Online proposals for providing a study of the Wyoming Educational Program and Recalibration and Reevaluation of the Wyoming Education Resource Block Grant Funding Model ("Funding Model"), including the Funding Model’s various components and the assumptions underlying those components, for the WYOMING LEGISLATIVE SERVICE OFFICE (hereinafter referred to as "LSO" or "Agency"), acting on behalf of the WYOMING LEGISLATURE’S MANAGEMENT COUNCIL, will be received through the Public Purchase online bidding system until June 7, 2017, 2:00 P.M. (Mountain Daylight Time “MDT”).

1.2. No proposal will be considered which is not signed by the proper official of the firm.

1.3. Proposals must be submitted through the Public Purchase online bidding system on or before the time and date specified. Proposals received after the time specified will not be considered. Proposals will not be accepted by FAX or email.

1.4. Proposal information is restricted and not publicly available until after the award of a Contract or Contracts by the Procurement Section of the Wyoming Department of Administration and Information ("Procurement Section"). Once all Contracts have been fully signed and submitted to the Procurement Section the award process will be complete.

2. MODIFICATIONS OR WITHDRAWAL OF PROPOSALS:

2.1. A proposal may be altered through the Public Purchase online bidding system prior to the specified date and time of the opening contained in the proposal documents.

2.2. A proposal that is in the possession of the Procurement Section may be withdrawn by the proposer up to the time of the opening. Failure of the successful proposer to furnish the service awarded as a result of this advertisement shall eliminate the proposer from the active proposers list for a period of time as determined by the Procurement Section.

3. PREPARATION OF PROPOSALS:

3.1. No proposal will be considered which modifies, in any manner, any of the provisions, specifications, or minimum requirements of the Request for Proposal (“RFP”).

3.2. In case of error in the extension of prices in the proposal, unit prices will govern.

3.3. Proposers are expected to examine the entirety of this RFP. Failure to do so will be at the proposer’s risk.

4. AWARD AND CONTRACT INFORMATION:

4.1. The Agency hereby notifies all proposers that it will affirmatively insure that minority business enterprises will be afforded full opportunity to submit proposals in response to this invitation and will not be discriminated against on the grounds of age, race, color, sex, creed, national origin, or disability.

4.2. The proposer agrees, should this firm be awarded a Contract, the firm will not discriminate against any person who performs work there under because of age, race, color, sex, creed, national origin, or disability.

4.3. The proposer expressly warrants to the Agency it has the ability and expertise to perform its responsibilities hereunder and in doing so shall use the highest standards of professional workmanship.

4.4. The Agency reserves the right to reject any or all proposals, to waive any informality or technical defect in the proposals, or to award Contracts whole or in part, if deemed to be in the best interest of the Agency to do so. The Procurement Section will award this Contract to the firm or firms, determined by the Agency, the most responsive and responsible offer based on criteria specified herein.

4.5. This RFP shall become part of the Contract and will be in effect for the duration of the Contract period.

4.6. The successful proposer or proposers will be required to enter into and sign a formal Contract with the LSO with reasonable adjustments acceptable to the LSO. The agreement will become a part of the Contract and will be in effect for the duration of the Contract period. The Contract language will control over any language contained within this RFP conflicting with the signed and fully executed Contract.

4.7. Successful proposer(s) shall comply with the Americans with Disabilities Act and Wyoming Fair Employment Practices Act. (Wyoming Statute 27-9-105 et. seq.).

SECTION 2: GENERAL PROVISIONS

1. INDEPENDENT CONTRACTOR:

1.1. The Contractor shall function as an independent Contractor for the purposes of the Contract and shall not be considered an employee of the State of Wyoming for any purpose. The Contractor shall assume sole responsibility for any debts or liabilities that may be incurred by the Contractor in fulfilling the terms of the Contract and shall be solely responsible for the payment of all federal, state, and local taxes which may accrue because of the Contract. Nothing in the Contract shall be interpreted as authorizing the Contractor or its agents and/or employees to act as an agent or representative for or on behalf of the State of Wyoming or the Agency, or to incur any obligation of any kind on the behalf of the State of Wyoming or the Agency. The Contractor agrees that no health/hospitalization benefits, workers’ compensation and/or similar benefits available to State of Wyoming employees will inure to the benefit of the Contractor or the Contractor’s agents and/or employees as a result of the Contract.

2. INSURANCE:

2.1. All insurance policies required by the Contract, except workers’ compensation and unemployment compensation policies, shall contain a waiver of subrogation against the Agency and the State, its agents and employees. The Contractor agrees it will carry the insurance which is applicable to this RFP. The Contractor shall provide a copy of an endorsement providing this coverage.

3. LAWS TO BE OBSERVED:

3.1. The Contractor shall keep fully informed of all federal and state laws, all local bylaws, regulations and all orders and decrees of bodies or tribunals having any jurisdiction or authority which in any manner affect those engaged or employed on the work or which in any way affect the conduct of the work. The Contractor shall at all times observe and comply with all such laws, bylaws, ordinances, regulations, orders and decrees in force at the time of award. The Contractor shall protect and indemnify the State of Wyoming and its representatives against any claim or liability arising from or based on the violation of any such law, bylaw, ordinance, regulation, order, or decree whether by himself or his/their employees. No extension of time or additional payment will be made for loss of time or disruption of work caused by any actions against the provider for any of the above reasons.

4. TAXES:

4.1. The Contractor shall pay all taxes and other such amounts required by federal, state, and local law, including, but not limited to, federal and Social Security taxes, workers’ compensation, unemployment insurance, and sales taxes.

5. ASSIGNMENT/CONTRACTOR:

5.1. The Contract shall not be assigned by the Contractor. Third party participation is authorized only as a joint venture which must be clearly stated with details on the original proposal, signed by all parties participating. Any alterations, variations, modifications, or waivers of the provisions of the Contract shall be valid only if they have been reduced to writing, duly signed by the parties hereto, and attached to the original Contract agreement.

5.2. The Contractor shall not enter into any subcontracts for any of the work contemplated under the Contract without prior written authorization of the Agency.

5.3. Claims for money due, or to become due to Contractor from the Agency under the Contract may, be assigned to a bank, trust company, or other financial institution, or to a trustee in bankruptcy, without approval by the Agency. Notice of any assignment or transfer shall be furnished to the Agency.

5.4. The Contractor shall not use the Contract, or any portion thereof, for collateral for any financial obligation without the prior written permission of the Agency.

6. TERMINATION OF CONTRACT:

6.1. Termination of the Contract may be made by any party at any time with or without cause, upon no less than thirty (30) days written notice to the other parties. The Contract shall remain in full force and effect until terminated as provided herein.

6.2. Should the Contractor fail to comply with the provisions of the Contract, payment for portions of the Contract will be withheld until such time as the Contract terms have been satisfactorily implemented. Administrative, Contractual, and/or legal remedies as determined by the Wyoming Attorney General will be implemented if it appears the Contractor has breached or defaulted on the Contract.

7. ACCOUNT REPRESENTATIVE:

7.1. The successful proposer(s) shall appoint, by name, a company representative who shall be responsible for servicing this account. The appointed representative shall be responsible to provide the services required to insure that the account will be administered in an organized systematic manner.

8. RESPONSIVENESS:

8.1. Proposers are expected to examine specifications, schedules, and instructions included in this package. Failure to do so will be at the proposer's risk.

9. COMPLIANCE WITH LAWS:

9.1. In performing the Contract, both parties agree to comply with all applicable state, federal and local laws, rules, and regulations.

10. AUDIT:

10.1. The Agency and any of its representatives shall have access to any books, documents, papers and records of the Contractor which are pertinent to the Contract. The Contractor shall, immediately upon receiving written instruction from the Agency, provide to the Agency all books, documents, papers and records of the Contractor which are pertinent to the Contract including any records relating to any payment or request for payment under the Contract. The Contractor shall cooperate fully with any audit by or on behalf of the Agency. The Agency may perform one (1) or more audits any time after the effective date of the Contract, at the place of business of the Contractor, and before one (1) year after the date of final payment under the Contract. If an audit is performed at a location other than the Contractor's place of business, the Contractor shall be reimbursed by the Agency for associated expenses.

11. CONFLICT OF INTEREST:

11.1. Contractor shall not engage in providing consultation or representation of clients, agencies, or firms which may constitute a conflict of interest which results in a disadvantage to the Agency or a disclosure which would adversely affect the interests of the Agency. Contractor shall notify the Agency of any potential or actual conflicts of interest arising during the course of the Contractor's performance under the Contract. The Contract may be terminated in the event a conflict of interest arises. Termination of the Contract will be subject to a mutual settlement of accounts. In the event the Contract is terminated under this provision, the Contractor shall take steps to insure that the file, evidence, evaluation and data are provided to the Agency or its designee. This does not prohibit or affect the Contractor's ability to engage in consultations, evaluations or representation under agreement with other agencies, firms, facilities, or attorneys so long as no conflict exists.

12. NO FINDERS FEE:

12.1. No finder's fee, employment agency fee, or other such fee related to the procurement of the Contract shall be paid by either party.

13. OWNERSHIP OF DOCUMENTS/WORK PRODUCT:

13.1. It is agreed that all finished or unfinished documents, data, or reports, prepared by Contractor under the Contract shall be considered the property of the Agency, and upon completion of the services to be performed, or upon termination of the

Contract for cause, or for the convenience of the Agency, will be turned over to the Agency.

14. CONFIDENTIALITY OF INFORMATION:

14.1. All documents, data compilations, reports, computer programs, photographs, and any other work provided to or produced by the Contractor in the performance of the Contract shall be kept confidential by the Contractor unless written permission is granted by the Agency for its release.

15. INDEMNIFICATION:

15.1. The Contractor shall release, indemnify and hold harmless the State, the Agency, and their officers, agents, employees, successors, and assignees from any and all claims, lawsuits, losses, and liability arising out of Contractor’s failure to perform any of Contractor’s duties and obligations hereunder or in connection with the negligent performance of Contractor’s duties or obligations, including but not limited to any claims, lawsuits, losses, or liability arising out of Contractor’s malpractice or malfeasance.

16. APPLICABLE LAW/VENUE:

16.1. The construction, interpretation and enforcement of the Contract shall be governed by the laws of the State of Wyoming. The Courts of the State of Wyoming shall have jurisdiction over the Contract and the parties, and the venue shall be the First Judicial District, Laramie County, Wyoming. The parties intend and agree that the State of Wyoming and the Agency do not waive sovereign immunity by entering into the Contract, and specifically retain immunity and all defenses available to them as sovereigns pursuant to Wyoming Statute 1-39-104(a) and all other state laws.

17. KICKBACKS:

17.1. The Contractor certifies and warrants that no gratuities, kickbacks or contingency fees were paid in connection with this Contract, nor were any fees, commissions, gifts or other considerations made contingent upon the award of this Contract. If the Contractor breaches or violates this warranty, the Agency may, at its discretion, terminate this Contract without liability to the Agency, or deduct from the Contract price or consideration or otherwise recover the full amount of any commission, percentage, brokerage or contingency fee.

18. AWARD OF RELATED CONTRACTS:

18.1. The Agency may undertake or award supplemental or successor Contracts for work related to the Contract. The Contractor shall cooperate fully with other Contractors and the Agency in all such cases.

19. NOTICES:

19.1. All notices arising out of or from the provisions of the Contract shall be in writing and given to the parties at the address provided under the Contract, either by regular mail, facsimile or delivery in person.

20. PATENT OR COPYRIGHT PROTECTION:

20.1. The Contractor recognizes that certain proprietary matters or techniques may be subject to patent, trademark, copyright, license or other similar restrictions, and warrants that no work performed by the Contractor or its subcontractors will violate any such restriction. The Contractor shall defend and indemnify the Agency for any violation or alleged violation of such patent, trademark, copyright, license or other restrictions.

21. PUBLICITY: 

21.1. Any publicity given to the services provided pursuant to the Contract, including but not limited to notices, information, pamphlets, press releases, research, reports and similar public notices prepared by or for the Contractor, shall not be released without prior written approval from the Agency.

SECTION 3: SPECIAL PROVISIONS

PROPOSALS MUST BE SUBMITTED THROUGH THE PUBLIC PURCHASE ONLINE BIDDING SYSTEM BY 2:00 P.M. (MDT) ON. JUNE 7, 2017.

PROPOSALS RECEIVED AFTER THE TIME AND DATE SPECIFIED WILL NOT BE CONSIDERED.

It is the responsibility of the proposer to clearly identify all information that is considered confidential in accordance with the Wyoming Public Records Act, Wyoming Statute 16-4-201 through 16-4-205. Please identify each confidential page with the word “CONFIDENTIAL” in capital, bold letters centered at the bottom of each page. Information not clearly marked may be considered public.

1. PARTIES

1.1. The RFP is issued by the Procurement Section for the Wyoming Legislature. Throughout this document and others in connection with this project, various references are made, or will be made to the "Agency". The term "Agency" means the Legislative Service Office (LSO), acting on behalf of the Wyoming Legislature and under the direction of the Wyoming Legislature’s Management Council, and the Select Committee on School Finance Recalibration established under 2017 Wyoming Session Laws, Chapter 205, Section 8.

1.2. It should be understood that the Director of the Agency is empowered to be the signatory on all Contracts, agreements, or modifications pertaining to this project. Such agreements, etc., not bearing this signature or that of a designee are invalid insofar as Contractual relations between the Agency and Contractor are concerned.

2. CONTENT AND PROCUREMENT POINTS OF CONTACT:

2.1. The Procurement Section is the primary point of contact from the date of release of the RFP until the Contract is fully executed and signed. Any attempt to contact any State of Wyoming employees, other than those named in this RFP, regarding this procurement may cause rejection of any proposal submitted by that party.

2.2. Questions must be submitted through the Public Purchase online bidding system until 2:00 P.M. (MDT) on May 30, 2017.

2.3. Written questions regarding RFP material or the procurement process shall be submitted through the Public Purchase online bidding system. No telephone calls, emails, or faxes will be accepted.

2.4. Written responses will be available under each question through the Public Purchase bidding system. Responses will not identify the firm that submitted the question. All parties should clearly understand that only the written answers issued by the Agency are the official position on an issue, and these answers shall become part of the RFP and, by incorporation, any subsequent Contract.

3. RESTRICTIONS ON COMMUNICATIONS WITH STATE STAFF:

3.1. From the issuance date of this RFP until an individual proposer or multiple proposers are selected and the selection or selections are announced, proposers are not allowed to communicate with State of Wyoming employees except:

3.1.1. Through channels established by existing contractual relationships;

3.1.2. Procurement Section;

3.1.3. Agency Representative during Oral Presentations (if requested by the Agency) or in response to questions during the selection process;

3.1.4. Via written questions through the Public Purchase online bidding system.

3.1.5. For violation of this provision, the Agency reserves the right to reject the proposal.

4. PRE-PROPOSAL CONFERENCE:

4.1. A Pre-Proposal conference will not be held in connection with this RFP.

5. ORAL PRESENTATIONS:

5.1. Proposers may be requested to make an oral presentation to clarify or demonstrate any aspect of their proposal or to discuss any changes to their proposal that might be advantageous to the Agency. If requested, proposers will have the option of an in-person presentation, video conference presentation, or teleconference presentation. An oral presentation in-person is preferred. Notification of a requested oral presentation will be provided by 2:00 P.M. (MDT) June 9, 2017. See Section 4: Schedule of Events. The interview committee will address questions to the proposers pertaining to their ability to complete this project. The proposer is responsible for the payment of all costs involved in any oral presentations and shall not be reimbursed by the Agency for these costs. All oral presentations will be considered a part of the cost proposal, unless specifically stated otherwise.

6. ADVERTISING AWARD CONDITIONS:

6.1. A fully executed Contract must be made and written approval given by the Agency before the successful proposer may advertise the award of the Contract or the services being provided after the Contract begins. The proposer must agree not to refer to awards in commercial advertising in such a manner as to state or imply that the firm or its services are endorsed or preferred by the State of Wyoming.

7. CONTRACT NEGOTIATIONS:

7.1. The successful Contractor or Contractors will be required to enter into and sign a formal Contract with the Agency.

7.2. This RFP, the proposal, oral presentation (if requested) and any agreements entered into as part of any Contract award will become a part of the Contract and will be in effect for the duration of the Contract period. The Contract language will take precedence over any language contained within this RFP that may conflict with the signed and fully executed Contract.

8. BEGINNING WORK:

8.1. The successful proposer or proposers must not commence any work that could be billed until a valid Contract has been executed. The Agency will not pay for any work by the proposer prior to execution of the Contract.

9. COST OF PERPARING PROPOSALS:

9.1. All costs incurred for the preparation of this proposal and for other procurement related activities are solely the responsibility of the proposer. The Agency will not provide reimbursement for such costs.

10. PATENT OR COPYRIGHT PROTECTIONS:

10.1. The proposer recognizes that certain proprietary matters or techniques may be subject to patent, trademark, copyright, license or other similar restrictions, and warrants that no work performed by the Contractor or its subcontractors will violate any such restriction. The Contractor shall defend and indemnify the Agency for any violation or alleged violation of such patent, trademark, copyright, license or other restrictions.

11. CONTRACT PERIOD:

11.1. The proposed start date is July 3, 2017. A final report is due not later than January 12, 2018. Following submission of a final report, the Contractor or Contractors will be available through June 30, 2018, to assist the Agency as necessary.

12. ADDENDUM TO THE RFP:

12.1. The Agency reserves the right to amend the RFP prior to the date for proposal submissions. Addendum will be uploaded through the Public Purchase online bidding system to the corresponding RFP.

13. PROPERTY DAMAGE AND LIABILITY INSURANCE:

13.1. The proposer may be required to furnish proof of property damage liability insurance in the amount deemed necessary by the Agency for the project, if applicable.

14. MISREPRESENTATION OF INFORMATION:

14.1. Misrepresentation of a proposer’s status, experience, or capability in the proposal may result in disqualification of that proposer from the selection process. Discovery of litigation or investigations in a similar area of endeavor may, at the discretion of the State of Wyoming and after consultation with the Procurement Services Section, preclude the Contractor from the selection process.

15. DISPOSITION OF PROPOSALS:

15.1. All material submitted becomes the property of the State of Wyoming, which is under no obligation to return any of the material submitted in response to the RFP. The successful proposal shall be incorporated into the Contract.

SECTION 4: SCHEDULE OF EVENTS

1. KEY DATES:

Work in furtherance of this RFP will be conducted during July 2017 through June 2018. Findings and recommendations are anticipated to be considered during the next session of the Wyoming Legislature. Changes to Wyoming’s approach to education and method of funding, if enacted into law, are anticipated to be in operation by school year 2018-2019. The schedule for selection of Contractor(s) is provided below, as well as anticipated key dates. It is anticipated that work would commence July 2017 and conclude June 2018. The Agency will work with the successful Contractor(s) chosen to establish a timeline for the scope of work.

The Contractor(s) will be expected to work with the Select Committee on School Finance Recalibration and participate in a series of meetings around the state designed to engage stakeholders and the general public in this study from July 2017 through January 2018. Additional work may be necessary after January, 2018. Prior to submission of the final report, the Contractor(s) will be expected to submit preliminary reports, as necessary, clearly describing their work, including, as applicable, the review of the educational program, Funding Model methodologies and recommendations, and identifying derivations of cost-based Funding Model components and adjustments. SECTON 5: ADMINISTRATIVE INFORMATION

1. RESOURCE WEBPAGE:

1.1. A history of school finance issues relevant to this work can be found on the Wyoming Legislative Service Office’s website at:http://legisweb.state.wy.us/LSOWEB/SchoolFinance/schoolfinance.aspx. The webpage will include previous studies and other information that may be helpful in preparing proposals.

2. OVERVIEW AND BACKGROUND:

2.1. In 1997 and in response to a 1995 decision by the Wyoming Supreme Court (Court), the Legislature adopted the cost-based Funding Model developed by Management Analysis and Planning, Inc. The Funding Model was designed to provide Wyoming’s local school districts with funding for the necessary instructional and operational resources to provide each Wyoming student with an equal opportunity to receive a proper education. The funding each district receives is a function of the components of the Funding Model and the characteristics of the district itself and the schools and students within a particular district. The Funding Model determines the amount available to each district, but it does not determine how the funding is expended.

The Court, in subsequent decisions, found the system under which the Funding Model was adopted to be capable of supporting a constitutional school finance system. However, the Court ruled a number of changes needed to be made to the Funding Model to provide a constitutionally adequate education for Wyoming’s children. Subsequently, the Court released jurisdiction of the school finance system in 2008 after the fourth major decision related to K-12 funding, primarily as a result of the work by the Legislature in a recalibration of the Funding Model enacted into law in 2006 using an evidence-based approach developed by Lawrence O. Picus Associates (now Picus Odden and Associates) as the basis for the Funding Model.

Since 2006, there have been two recalibration efforts as state law requires a recalibration be conducted not less than every five years. Picus Odden and Associates assisted the Legislature with recalibration efforts in 2010 and 2015, along with Dr. Christiana Stoddard providing specific reports on labor markets and Dr. Lori Taylor providing specific reports on regional and external cost adjustments.

Recent legislation passed by the Wyoming Legislature and subsequently enacted into Law, 2017 Wyoming Session Laws, Chapter 205, Section 8, directs the Wyoming Legislative Service Office through the Wyoming Legislature’s Management Council to Contract with consultant(s) to conduct a study and determine the cost of the Wyoming K-12 education program. The law provides that the Select Committee on School Finance Recalibration need not limit its study to a recalibration of the existing cost-based model. below:Section 8.

(a)  The reductions implemented by this act are intended to be temporary, pending a recalibration of the education resource block grant model. The select committee on school finance recalibration is created consisting of the following members:

(i)  Five (5) members of the Wyoming senate appointed by the president of the senate of which one (1) member shall be the chairman of the senate education committee;

(ii)  Five (5) members of the Wyoming house of representatives appointed by the speaker of the house of representatives, of which one (1) member shall be the chairman of the house education committee;

(iii)  Not more than four (4) members from each house shall be from the same political party;

(iv)  The cochairmen of the select committee shall be appointed by the president of the senate and the speaker of the house, respectively.

(b)  The select committee shall undertake a study to review the state educational program under W.S. 21-9-101 and to recalibrate the education resource block grant model as provided under W.S. 21-13-309(t) to determine if modifications are necessary to ensure the model remains effective and cost-based in light of changing conditions and modifications to law. If the committee determines an alternative to the education resource block grant model should be reviewed and developed to more efficiently meet the constitutional duties of the legislature in providing K-12 education funding the committee shall not limit its study to a recalibration of the existing cost-based model.

(c)  The select committee shall also study and recommend solutions to the projected budget shortfall for funding related to public education in the state of Wyoming. The select committee shall focus on four (4) major issues related to school funding as follows:

(i)  Options for use of existing unencumbered, unobligated revenues;

(ii)  Consideration of the use of diversions of existing revenue streams and investment income;

(iii)  Options to increase revenues;

(iv)  Options for budget and expenditure reductions.

(d)  The select committee shall be staffed by the legislative service office. The department of education, department of workforce services, school districts and the school finance data advisory committee established under W.S. 21-2-203 shall collect and provide the information requested by the select committee.

(e)  The select committee may, through management council, seek expert opinions and may hire consultants as necessary to complete the study and recommendations required under this section. The legislative service office is authorized, subject to the approval of management council, to Contract with consultants for the purposes of this section to complete recalibration of the education resource block grant model or to develop a new model.

(f)  The select committee shall report its recommendations and any associated proposed legislation to the legislature not later than January 31, 2018. The select committee may develop and sponsor legislation as necessary to effectuate the purposes of this section, provided that no legislation shall be sponsored by the committee unless it is approved by a majority of the members of the select committee from each house.

(g)  Appointments shall be made under this section not later than March 15, 2017. The select committee shall exist until March 31, 2018. Any vacancy occurring on the select committee shall be filled by the president of the senate or speaker of the house of representatives, as appropriate, immediately upon the vacancy occurring.

(h)  For the period beginning on the effective date of this section and ending June 30, 2018, there is appropriated from the school foundation program account to the legislative service office eighty thousand dollars ($80,000.00) to provide salary, per diem and mileage for members of the select committee and to fund other expenses of the select committee as necessary to carry out this section.

3. SCOPE OF WORK:

3.1. The study to review Wyoming’s educational program and to determine the cost of the educational program through a recalibration of the Funding Model or an

alternative Funding Model is intended to accomplish the following:

3.1.1. Examination of the educational program as defined in Wyoming Statute 21-9-101 and the Hathaway Scholarship Program’s success curriculum as defined in Wyoming Statute 21-16-1307;

3.1.2. Examination of all components of the Funding Model with respect to meeting the goal of providing an equal opportunity for a constitutionally proper education for all K-12 grade students in the state under a cost-based approach;

3.1.3. Examination of alternative funding approach(es) that meets the goal of providing an equal opportunity for a constitutionally proper education for all K-12 students in the state. Alternative approaches may include, but are not limited to: professional judgment panel, evidence-based approach, modified successful schools, production function, successful schools, cost function, any other model, or any combination thereof;

3.1.4. Determination of the adequate funding level and sustainability of cost escalators of the educational program as defined in Wyoming.

4. CONTRACTOR TASKS:

4.1. Identify which aspect(s) of Wyoming’s educational program, Funding Model, or other areas of expertise the Contractor is seeking to provide assistance to the Agency under this RFP. For each aspect identified, apply those parts of the following section which are applicable.

4.2. The Contractor(s), as applicable, shall perform the following tasks:

4.2.1 Perform an in-depth analysis of the existing education program as defined in Wyoming Statute 21-9-101. Upon the request of the Select Committee, provide recommended changes and adjustments to the education program.

4.2.2 In consultation with stakeholders, perform an in-depth analysis of the current Funding Model and its components and adjustments and all funding provided outside the Funding Model. See Appendix A. Develop a detailed understanding of how the Funding Model works and the effects of modifications to the Funding Model and the education program. Develop a detailed understanding of the funding implications to the local school districts and the state of each Funding Model component and adjustment.

4.2.3 Recommend necessary recalibrations to the Funding Model. Recommendations should ensure the Funding Model remains effective and cost-based in light of changing conditions and modifications to law. Specifically, provide recommendations for options to:

4.2.2.1. Recalibration the special education and transportation components;

4.2.2.2. Efficiencies to be obtained by incentivizing cross-district cooperation and shared services, including in the areas of special education, transportation, and gifted and talented funding; and

4.2.2.3. The efficiency and cost-effectiveness of consolidating select Wyoming school districts.

4.2.4 Review all recommendations for recalibration with the Select Committee on School Finance Recalibration and Wyoming school districts. Demonstrate in detailed calculations the impacts of the recommendations. Prepare such reports as necessary to clearly describe the recalibrations and specifically prepare a separate report detailing methodology for and derivations of cost-based model components and adjustments.

4.2.5 If an alternative funding model is proposed, determine the adequate funding level of the educational program to meet the constitutional requirements of the Legislature.

4.2.6 Identify constitutional, legislative, school district, and other stakeholder concerns on Funding Model methodology and operation. Conduct research as necessary and as may be directed by the Select Committee on School Finance Recalibration to identify and understand real and perceived issues with the current Funding Model.

4.2.7 Work with Agency’s other consultants, the Wyoming Department of Education and other designated state agencies to prepare data collection and reporting requirements necessary.

4.2.8 Prepare the final Funding Model and develop instructional materials, as necessary, for the implementation of the Funding Model.

4.2.9 Assist the LSO and Wyoming Department of Education staff, as appropriate.

4.2.10 Prepare additional analysis and reports as directed by the Agency and Legislature.

SECTION 6: REQUIREMENTS/SPECIFICATIONS

1. DESIRED QUALIFICATIONS:

1.1. The successful Contractors (s) shall have the following qualifications:

1.1.1. As applicable to each response, working knowledge and demonstrated capability in cost-based methodology and modeling, or in its field of expertise.

1.1.2. Experience as a nationally recognized authority in its field.

1.1.3. Not be employed by any entity receiving funds from the Wyoming school finance system, except for existing contractual relationships.

1.1.4. As applicable to each response, knowledge of educational delivery and school funding systems from other states.

1.1.5. As applicable to each response, extensive or demonstrated previous successful professional experience working with and developing school finance systems of the magnitude required by this RFP. The experience should include working with issues of equity in funding, funding adequacy, regional cost differences, labor market economics, legal aspects of educational finance reform, funding for excellence in education outcomes, and issues related to rural and small schools and districts.

1.1.6. As applicable to each response, technical ability to conduct analyses that are methodologically appropriate and to develop a Funding Model in Microsoft Excel or similar computer applications that provide transparency and modeling capabilities.

1.1.7. Demonstrated expertise in working with legislative bodies, executive agencies and with other states.

2. PROPOSAL REQUIREMENTS:

3. PROPOSAL EVALUATIONS, INTERVIEWS AND CONTRACT AWARD:

3.1. The Wyoming Legislature’s Management Council, or such delegees as designated by the Management Council, will be the sole judge with respect to evaluations of proposals.

3.2. All proposers must meet the minimum qualifications set forth in the Proposal Requirements and Review Process in order to be considered pursuant to the criteria set forth in this RFP proposal.

3.3. Proposers shall be available for interviews on June 13, 2017. Proposers may be requested to make an oral presentation to clarify or demonstrate any aspect of their proposal or to discuss any changes to their proposal that might be advantageous to the Agency. If requested, proposers will have the option of an in-person presentation, video conference presentation, or teleconference presentation. An oral presentation in-person is preferred. Notification of a requested oral presentation will be provided by 2:00 P.M. (MDT) June 9, 2017.

3.4. The Wyoming Legislature’s Management Council intends to make a tentative award of a Contract or Contracts by July 3, 2017. Final award of the Contract or Contracts shall be subject to the Wyoming Legislature’s Management Council approval.

Custodian Positions:Calculated on the basis of four factors: 1) number of model generated teachers; 2) school ADM; 3) number of classrooms as reported by the School Facilities Department (SFD); and 4) the lesser of actual educational gross square footage (GSF) or SFD allowable educational GSF adjusted up by 115%. These four factors are added together and divided by four to arrive at the preliminary FTE. The factor for each of these components is derived by finding the ratio of a school’s actual data to adequacy standards reported by Zureich (13 teachers standard; 325 ADM standard; 13 classrooms standard; and 18,000 GSF standard). This base FTE is further adjusted by an additional 0.5 FTE for secondary schools. Small schools do not generate custodial FTE positions. Custodian FTEs for non-educational buildings are based solely on the GSF factor, which is limited to 10% of a district’s total allowable educational GSF divided by the Zureich factor (18,000 GSF).

Maintenance Worker Positions:Calculated on the basis of four factors: 1) building; 2) the lesser of actual educational GSF or SFD allowable educational GSF adjusted up by 115%; 3) school ADM; and 4) FY 2006 GF operating expenditures. These four FTE factors are added together and divided by four to arrive at a base FTE. The factor for each of these components is derived by finding the ratio of a school’s actual data to adequacy standards reported by Zureich: 1.10 building factor; 60,000 GSF standard and a 1.20 factor; 1,000 ADM standard and 1.30 factor; $5 million standard and 1.20 factor). The base number is further adjusted for 1) school level (base FTE is multiplied by 0.80 for elementary schools, 1.0 for middle schools, and 2.0 for high schools); 2) building age where schools under 10 years old are multiplied by a factor of 0.95 and over 30 years old by a factor of 1.10; and 3) small district size where FTE are multiplied by a factor of 1.10 for under 1,000 ADM. Groundskeeper Positions:Determined at the site rather than building/program level. The number of FTEs for all sites, both educational and non-educational, is based on the number of acres of the site and the standard for the number of annual work hours per acre (93 hours). The FTE calculation assumes a 2,008 hour work year for groundskeepers. The initial FTE is adjusted for the primary school level or use of the site, with non-educational and elementary school sites received no additional adjustment, middle school sites receiving an adjustment factor of 1.5 and high school sites an adjustment factor of 2.5. Groundskeeper FTE calculations for acreage acquired by a district after July 1, 1997, are based upon the lesser of the actual site acreage on which the facility is situated or the SFD/SFC guidelines: elementary schools (four acres plus one acre for every 100 ADM); middle schools (10 acres plus one acre for every 100 ADM; high schools (20 acres plus one acre for every 100 ADM). In instances where districts acquired acreage after July 1, 1997 through an exchange of land with another government entity, and the acreages involved in the exchange were originally acquired by the district and the government entity on or before July 1, 1997, the acreage is not subject to the SFC guidelines. The entire acreage will be used in the calculation of groundskeeper FTEs. If a district has acquired a site after July 1, 1997, and the site is without a facility situated on it or has a facility under construction, groundskeeper FTEs will not be generated for the acreage.

Supplies and Materials:Funding for O&M supplies is calculated at a rate of $0.67 per GSF for both educational and non-educational space. For educational space, GSF is equal to the lesser of actual educational GSF or allowable educational GSF adjusted up by 115%. Funding for non-educational space is equal to 10% of a district’s total allowable educational GSF.

Utilities:Funding for utilities is based on actual FY 2009-10 district expenditures as reported by the WDE (expenditure functions 3410-3450 & 3490 Only; Objects 451-459 plus communications - object 340, excluding special education

For additional school buildings added (not replacement schools) to a school district’s building inventory after school year 2009-10, multiply the average GSF cost as adjusted by the ECA by the total GSF (lesser of actual or SFD allowable) for the new buildings to provide additional utility resources for the new GSF.

24. Central Office Personnel/ Non-Personnel Resources

Central Office Personnel:500 or fewer ADM: 3.0 administrative and 3.0 classified positions.

1,000 ADM: 4.0 administrative and 4.0 classified positions. Position counts prorated down linearly between 1,000 to 501 ADM.

3,500 ADM: 8.0 administrative and 10.0 classified positions. Position counts prorated down linearly between 3,500 to 1,000 ADM.

Position counts prorated up linearly above 3,500 ADM.

Non-Personnel Resources:Provide an amount equal to $365.86 per ADM for non-personnel resources.

25. Transportation For school year 2017-2018, reimburse 100% of the allowable expenditures from school year 2016-2017.

For school year 2018-2019 and each school year thereafter, provide an amount for operations funding equal to the average of the amounts reimbursed for school years 2014-2015, 2015-2016 and 2016-2017.

Capital outlay can only be purchased on an emergency basis as approved by the Department of Education. Capital outlay purchased prior to or after March 15, 2017, will be reimbursed under current law.

Health Insurance Compute a health insurance composite amount for each funding model generated FTE based upon prior year statewide average district weighted actual participation in district health insurance plans as to the proportion of employee only, split contract, employee plus spouse or children and family coverage for the State’s health insurance contribution amounts paid on behalf of State employees as of January 1 of the preceding school year. For FY 2017-18, the FTE amount is estimated at $15,104.07. See Wyoming Statute 21-13-309(m)(v)(F).

43. Combined Incentive Payments

Pursuant to Wyoming Statute 21-13-331, school districts that enter into agreements to provide special education and transportation programs cooperatively are allowed to be paid fifty percent (50%) of the reduced expenditures related to the agreement, not to exceed $50,000 for any one combined agreement.
