1. This statement mad.a by me accurately sets out the evidence

which I would be prepared, if necessary, to give in court as a

witness. The statement is ... true to the best of my knowledge and

belief and I make it knowing that, if it is tendered in evidence,

I shall be liable to prose·cution if I have wilfully. stated

anything which I know to be false or do not believe to be true.

2; I am 37 years of age. I was born on the REDACTED

-3. I have lived at my current address since ·october 199·7. Prior

to that I lived at various locations in Queensland since

September, 1988. In May, 1989 I married my former wife l@d•MtJ• 1jJ1•'Ptlj£ w~ divorced at the beginning of .. this year. There are three

4. As a child I grew up in Sydney and lived with my parents

until I turned about 8 or 9 years old. At that time my dad left

us. I lived with my mother . and 3 brothers and 3 sisters at. REDACTED I remember when I was a child my mum had a

maJor stomach operation in St Vincents Hospital a_nd the surgeon

was Dr Fleming. I believe this operation took place very late in

1973 as mum wasn 1 t home for Christmas that year. Early the

following year my mum put me into the Bexley Boys Home on advice

from the Government Welfare people. My mum is Salvation Army and

thought it would be good for me to go to Bexley. I think I was 13

years of age at the time I went to the Bexley Boys Home.

5. I believe I stayed at the Home for about 14 months. During my

time at the Home I remember . the workers at the Home were Wendy the

Cook, Captain Wilson, IX15 l'. I can picture the f .ace of

the lady who did the laundry but . I can't rem~mber her name, .... 1x_1_2 __ _. who was around all the time he ·was like a . handy rnan, · there was a

husband and wife who looked after the very·· young children and

others but I can't remembe~ .their names . . Qbyiously there were many

children who stayed ·at the Home. durin«J ·the time r was t:here. I

remember ET whom we called · 'Head' · as a nickname, -

a bloke who had .. a-tattoe> who· ~gat--±nto--a· -1ot of trouble

because he used to steal cars, 1xs lwho was an Aboriginal boy,

6. I can remember some of my experiences at the Bexley Boys

Home, some were good and some were bad . I can remember the bad

incidents very vividly. I can remember the physical punislunent

which often left me with bruises on my body and near broken

fingers. I lost count of the number of times I was caned but you

would always get 6 cuts across the fingers. The caning was that

bad that my fingers would be bruised and I often couldn't write

for days. Captain Wilson was the person who used to cane me. He

used to leap off the floor and bring the cane down on your hands.

I was also hit many times from behind to th~ back of my head and

across the back and bo oted· up the rear -end by Capt ain Wilson. It

was always Wilson, IX15 I only ever raised his voice or

punished you in a non-physical way like taking your T. V. or

7. Apart from the physical abuse which I suffered at the hands

of Captain Wilson I also remember times when he took advantage of

me when r . was sick. The first time I remember happened within the

first few days I arrived at the Bexley Boys Home. Captain Wilson made ~e strip so that I was naked except for me socks for a so­

cal led medical examination. I think I was wearing shorts and a yellow T-shirt because it was sununer time. I think this was a

·saturday because I arrived at the Home on a Thursday or a Friday and I think tiie start.ea·· s c li6of.. abouta-Weelt Yater--:- -'rli"f s occurred in . -· . a room where boys went to when they were sick. I can't remember exactly where the room was I can remember the front of the Home

and the back of the Home but not the detail. If I was to go there now I would be able to walk straight to the room I am talking

about. I remember the room had a wooden floor with a rug on the

floor. There was one window which was frosted glass and two doors

whic;=h were dark brown v..arn~sh in colo.ur . One .do.or lead into th~ room from the hallway and one led into Wilson's office. There was

also a glass cabinet on one wall which contained medical instruments and bandages.

8. I remember he checked my hair for headlice with his fingers then he checked me ears using a torch like doctors use, looked

down me throat using a tongue depressor and the torch, rubbed his hands down both sides of my body, then fondled with my genitals

for a minute or two he seemed to be taking his time about it. He touched my genitals with his hand which was cupped and moved his

hand from my nuts up my dick in a cupping motion. He did this a number of times. I remember I was very frightened and scared at

the time. After this he told. me to bend over then I felt his fingers inside my arse. At time I had to bend over I balanced

myself by placing hands on a bench or table he had in that room. I can clearly remember there was a green sheet, like a hospital

Captain Wilson spoke to m.e duj:ing .the ex~mination but I can't

9. . After Captain Wilson was finished he tol<;l me to get dressed

and go out an_~ ~lay- ~ith th~ Ie~t o~ the boys. I ~ent outside but

I didn't play because I was· upset and didn't understand what had

)ust happened. I sat under a-·tre·e nea.r t ·be .. ova L Th-e o ther kids

were playing. soccer, footy,, chasings a~d 0therc games. I didn't . . .

talk to any of the other kids at that time becaµse I only just got

t~ere and I didn't ~now any of the other kids . I remember f 15 I IX 5 I walking over to me and saying words to the effect, 11 Come

over and join in with the other boys so you get to know them . 11 I

didn't accept his invitation. I sat there for half an hour or so,

wandered off and went to the toilet. After · I finished going to the I · "

t oilet I wiped myself with toi.let paper and noticed blood on the

paper. I was too scared to seek medical treatment again after what

had just happened to me. I also remember getting into trouble off

IX15 I becau.se I forgot· to ask his permission to go to

t h e toilet. He only verbally told me about the rules about going

t o t he t oilet.

10. I did not tell anyone about what Captain Wilson did to me

until much later. I think the first person I told about it was

IET I who was a good ·friend of mine at the Home. I told~ about 2 or 3 months later as we were walking to the schoolbu~ go to Kingsgrove High Schoo·l. We caught the bus from Bexley North

Railway Station . I got · ~he impression from IET I facial

expression a.t the time that it wasn't anything new to him and that

others must have told him similar things. Years later I told a

psychologist, whose name I ._can't. remember, at the Yagoona Child

Heal th Service about Captain Wilson touching my genitals. I

believe the psychologist made notes . The centre was Government run

and located on the Hume Highway ·across the road from Yagoona

Railway Station. The other person I told about the incident was my

psychologist in Brisbane named Mal McCloat of the Annerley

Counselling .Services, Logan Rd, . -Stones Corner.

11. About 3 to 4 weeks later I was walking by myself during a

play period in on~ of the corridors in the dormitory building . It

was afternoon but I can't remember the day. ·At the time I was

walking back to my locker to get something out of it. I reached a

point in the corridor where the locker room, laundry and showers

meet. Captain Wilson walked towards me and I thought I was in

trouble by the way he looked at me. I had permis~ion to get

something out of my locker from lX15 j. Captain Wilson

asked me what I was doing and I told him.. He said words to the

effect, 11 Do you like it here'?" I nodded. At this time we, were

standing facing each other about an arms length apart. He put one

hand, possibly the r i ght, around and placed it on the back of my

head, he then he pulled my head towards his face. He leant down

while he did this as he was taller than m~. At the time he pulled

my face towards his he opened his mouth up and placed it over my

nose and chin so that it was covering my mouth. It was in this

position for between 5 to 10 seconds. I was very frightened and packing shit, I was trying to get away. I clammed up and struggl ed

to get away. As soon as he let go I ran out onto the oval and told

.X15 11o·oked at me as if he thought something was wrong but he didn ' t ask anything. After this Captain Wilson walked out and

spoke to 1x1s I·· Once· they finished talking IX15 1x 15 I said," Go and· see Captain Wilson in his office .~''._I_w_a_s very scared b~'!; I_ w_~P..t .. t;6 ._hi~ ~ff~ce, I saw his secretary was there, so I was relieved. I can't remember who the secretary was as they changed.

12. Wilson was standing near his secretary when I arrived. He accuseq me of having some other boy's toys~ in my locker which was

not ·true. He- said, 11 . You are goi~g· to get 6, go around the

corridor." I walked around to the corridor which was near reception and the other door leading to Wilson's office. I was caned by. Captain Wilson 'fn the corridor. I got 3 c"uts to each

hand. (APPENDIX 1 IFR ! draws a floor plan of the area and puts an 'C' indic~a-t~in_g_w~~ he was caned and a 'K' for the

kissing incident). After I was caned I cried me eyes out and went into the T.V. room. I was very upset about how I had been unfairly treated.

13. About 2 months later I was sent home from School by Mr Yardley because I had the mumps . My throat was swollen and I felt

crook. At the time I arrived at the Home lX15 lwas on duty . I showed him the note fr.om school and he sent me up to my

room. He -came up later - with water, panadol or aspircin and extra blankets. He appeared to be genuinely concerned about my welfare

as he generally was with all of us. I layed in my bed and

sleep . I had pyjamas on with a draw string around the waist.

14. I remember being woken up and I was laying on my right side.

Another boy from the Home named, 1Xs jwho was an Aboriginal

boy, was laying behind me. I could feel his dick inside my arse. I' remember the pain and tha;~ .· is what woke me up . I also remember

1xs !had his left arm across my stomach holding me so I

couldn't move . I screamed as loud as I could and I heard • • · • who

was sick in the next room call out to

bo 1 ted from my room. I remember ... lx_s ___ _.I was at the Home when I

first got there and. was still there when I left. He was bigger and

older than me . I don't know his exact age but he was a few forms

ahead of me at.- -school and -he was physically larger than me. I did

get my own back on ldd'f"'d at a later stage with a baseball bat .

. 15 . After 1xs j left the rooml-;•M1rcame in and commented about how white I looked . - went downstairs to get IX15 I however Captain Wilson came to my room . Captain Wilson walked into

my room and said,'' You must be running a temperature." He said this while he touched my forehead with his hand. He said," I will

be back in a minute . " He went away and came back with the same bag I described earlier. Wilson and I were the only two in the room.

Wilson took out the tongue depressor and torch from his bag, he 'checked me throat and ears then he took out his stethoscope and

put it on my chest and back. He ~old me to lift my shirt up whilst

he did this . I said to Wilson words to the effect,"~8 r tuck something up me arse." I was very hesitant to tell Wilson about

what had happened because I was didn't trust him and was shit scared of him.

exposed. Wilson told me to roll over onto my stomach. I saw Wilson

take a rubber glove out of his bag and put it on one of his han~s,

he mi'ght have put two gloves on I Im. not su:re. I felt him use his

hands to pull . the. cheeks of my arse apart. I looked at the floor.

I .felt him put what felt like two fingers into my a.rse. He moved

his fi!l9~J'.S ~~C?Un~ insi_de ~y_ .- ars~. I told him to stop because it was very· painful·._ He K.ept moving his fingers inside me for what

seemed to be one to two minutes. He said to me," No-one has been

ther.e . . !!.... Then- he- t0il.d- me-.to roll back onto my left side . This is

very embarrassing, I- ended up with a raging 'fat' meaning my dick

was erect.

17. At this point Captain Wilson took off his gloves and tried to

masturbate me. He plac;:ed · one of his hands around my penis and

moved it up and down my penis. I was not pubescent at the time. I

noticed he had a very weird smile on his face. He moved his hand

up and down my penis for about a minute. I . protested the whole

time and forced myself to yell: Wilson stopped and put two

aspirins in a glass of water for me to take. I took the aspirin

and then vomited water up onto Wilson's shirt and trousers . He was

wearing a Salvation Army uniform at the time. I was surprised when

I didn '·t get into trouble for throwing up on him. He said," You

are sick I' 11 get some water sent up." He packed his bag and left.

I didn't see him again for two days. After that 1x1s took me under his wing and looked after me . ~~~~~~~~~~

the same school. We were in the same Tech Drawing class and we did
