    I’ve been thinking about this right up until the time came for me to mark my ballot and I’ve decided to take a position on the two smok-

    ing questions which will undoubt-edly make the liberals happy and upset my libertarian friends—but hear me out.

    There are two anti-smoking questions on the ballot.

    The most restrictive is Question five which would ban smoking in most public places except casino floors.

    In order to combat Question five, the casino owners, slot route owners and other folks with interests in gam-ing, convenience stores and other places we throw away money came up with Question four which cuts off smoking in far fewer places.

    Whichever of these questions gets the most votes wins and will face the voters one more time.

    My first reaction—the libertar-ian in me—was to vote no on both of them.

    After all, we don’t need govern-ment telling businesses how to regu-late smoking, do we?

    And that was my attitude until a few weeks ago when I sat down at a video poker machine at a 7-11 and the lady next to me lit a cigarette and practically blew the smoke in my face.

    It then dawned on me that

    this really isn’t about freedom to smoke—which, by the way, is not part of the Bill of Rights.

    What I really wanted to do, was to feed that cigarette to the moron sitting next to me.

    And it dawned on me that our society has given this stupid woman the right to blow smoke in my face with the full support of the Nevada constabulary while any action on my part short of just getting up and leav-ing would be illegal.

    In short, if I offered to feed this bimbo her cigarette it would be assault and if I actually did feed her the cigarette it would be battery yet she could assault my airspace at will with the full support of the law and the 7-11 franchisee.

    And while 7-11’s management is wisely cutting their ties with Hugo Chavez’ Citgo Oil, telling United

    Coin that they are declaring their stores completely no-smoking in Nevada is going way too far.

    So this isn’t about limiting one poor, under-siege group’s freedom.

    It’s about leveling the playing field.

    While Question five probably cannot give me the right to feed this bimbo her cigarette, thus legalizing battery, it can force 7-11 to recog-nize the 75 per cent of us who do not wish to inhale smoke while we throw away a $20 bill.

    So, I’m going with Question five.

    Interestingly, I’m willing to bet that some of my friends in the gam-ing industry are secretly voting for Question five as well.

    The market dynamics of smok-ing have, quite simply, changed.

  • No matter whose statistics you take, it is generally acknowledged that something under 25 per cent of America smokes.

    And, unlike global warming, there is no junk science in the correlation between lung cancer and smoking.

    As if to put an exclamation point on that sentence, NASCAR commen-tator, former Winston Cup champ and Daytona 500 winner Benny Parsons has just gone through three months of chemo therapy for lung cancer.

    Parsons, in his driving days, was known for lighting his next cigarette with his last one.

    ABC News’ Peter Jennings died of lung cancer contracted from smok-ing because while people in my business are fond of lecturing our readers, listeners and viewers, many of us smoke.

    After a career of smoking Lucky straights, my favorite Uncle died at about my current age of lung cancer.

    None of that is junk science.What is open to question is the effect of second hand smoke.Empirically, what makes you cough and gag can’t be good for you.This is America where your right to swing your fist ends at my nose.If we pass Question five, you’ll no longer to have the right to blow

    smoke up my nose or any other part of my body.Will that hurt the gaming industry?Probably not. The suits in the suites will probably be secretly relieved

    because that will be one more problem solved where they won’t have to take a position which will offend their customers.

    Besides, where is the average slot player at a 7-11 going to go on a daily basis to play and smoke at the same time?

    And we’ll save a life or two.Not from lung cancer.From the occasional exploding oxygen bottle some stupid little old lady

    carries with her pack of cigarettes and lighter.

  • Don’t Be Ignored By Politicians

    Politicians ignore people who don’t vote. It’s that simple. And why shouldn’t they? If you don’t care enough to pick who manages your public business, why should they care what you have to say?

    People who make a campaign contribution have more influence than people who don’t. That, too, is obvious. Nonetheless, people who vote have more influence

    than people who do not. People who get out and get

    other people to vote have more influence than those who simply go to the polls and cast their bal-lot. Obvious? For sure, but often forgotten by people who are dis-satisfied with the political leader-ship that exists.

    My message is obvious – even if you are not a billionaire and give millions of dollars as cam-paign contributions, you can still matter in our political system. Time and again, one vote or a dozen votes or as happened in Florida in the 2000 Presidential election fewer than 400 votes

    determined the winner. Your vote matters may sound like a cliché

    This past Monday, I was in Texas campaigning on behalf of an independent candidate who is taking on the Austin political establishment. What impressed me is the Texas early voting sys-tem.

    Two weeks before the elec-tion, people can go into one of a dozen places in Austin and cast their ballot. Dozens of people were lined up at those early vot-ing places on Monday morning.

    It was inspiring to watch these people exercise their constitution-al right to pick who would repre-sent them in the seats of power.

    Several people were bringing other voters without transporta-tion to voting places. They par-

    ticularly impressed me for the extra effort they were giving to making our democracy work.

    Nevada also has an early vot-ing system. If allows people to vote when they have the time to do so. The State is to be con-gratulated for making voting con-venient. Most states do not.

    Ultimately, however, the responsibility of being a voter resides on you. The State of Nevada has done its part, giv-ing you two weeks to take a few minutes to go by the poll and cast your vote. Find the time.

    My exhortation to you is this: Don’t be ignored by the politi-cians.

    The Penny Press Tips Its Cap To:Navy Rear Adm. Gerald L. Talbot, who will take the reins at the Nevada Test Site next year, succeeding Kathy A. Carlson, who retired as its manager in May after 30 years of federal service.

    Community College of Southern Nevada President Richard Carpenter, who withdrew his candidacy Thursday from a position heading up the com-munity college system in his home state of Louisiana, saying he hadn’t completed his mission in Las Vegas. “I’m just too happy where I am right now,” Carpenter said. “Your home is where your heart is, and Louisiana is my home, but Las Vegas is my home now.” All of those searches cost us a lot of money and this one would really have been expensive.

  • Is Jim Gibbons a) more stupid than Lynette McDonald; b) less stupid than Lynette McDonald; c) as stupid as Lynette McDonald or d) just as dumb as a three pound can of rocks?

    As my regular readers know, Gibbons was not my first choice for the GOP gubernatorial nomination. In fact, at one point in the primary campaign I suggested that he resembled Dina Titus without breasts.

    Well, we who supported common sense for Governor lost on August 15 but, frankly, I wasn’t quite prepared to vote for Titus because, if she won, I would have to go to my grave knowing that I helped Nevada further down the road to socialism.

    On the other hand, I’m not sure I want Gibbons’ Delta House buddies in the Governor’s Mansion either.

    I have no question that last week’s “incident” at McCormick and Schmick’s between Gibbons and a local off duty cock-tail waitress was a pathetic attempt on someone’s part to highlight what lightweights Gibbons and his gang of politico-zanies are.

    And it worked.

    The reality is that any Republican voter who has lived in Las Vegas for more than six months knows that a) McCormick and Schmick’s is not where an available gentleman or lady goes to announce their availability. In other words, it’s a fish market, not a meat market; b) even Jim Gibbons wouldn’t be stupid enough to hit on a cocktail waitress three weeks in front of an election; c) Sheriff Young and his predecessors have always showered big shots with a special interpretation of “just the facts maam”(more about that later); and d) Sig Rogich, Gibbons’ political Delta House brother would never let Brother Gibbons get himself into such a situation.

    In short, it was almost the perfect storm.

    What Gibbons IS guilty of is industrial strength stupidity for even being there in the first place. If that means we get Titus as Governor, we’ll just have to deal with it over the next four years because I have no intention of saying nice things about Gibbons just because he might (maybe) be

    more conservative than Titus.

    Now to McDonald.

    She’s a bigger RINO (Republican In Name Only) than Nevada Governor Kenny Guinn and I have no intention of supporting her, either.

    It has come to light that her sleazy Arizona land deal not only came without the benefit of a down payment but with-out any payments until last August.

    A friend of mine reminded me that I have done real estate deals like that, too.

    The difference is that I wasn’t an elected public official who had just carried water for a real estate developer on the County Commission immediately prior to getting the deal. My friend also pointed out that the profit in the deal was “only” $22,000.

    Well, that’s reminiscent of the kind of cash which Lance Malone was passing out prior to being found guilty by a Federal jury.

    I really don’t care about the motivation of the problems McDonald now has.

    If the unions are responsible, God Bless them. And if their candidate wins, well the Republicans should have clothes-lined McDonald in the primary and then they would not be facing the loss of a seat on the County Commission.

    I’m far more of an independent than a Republican. Ross Perot and Pat Choate have had their effect on me.

    One final note:

    If you think that Sheriff Young did the right thing and that the policy of coddling lightweight airbag big shots should continue at Metro, vote for Doug Gillespie and it will.

    If you want a real Sheriff, vote for Jerry Airola who in addi-tion to not sucking up to big shots also won’t try and take your guns away from you. FRED WEINBERG

    Should Libertarians Ally With Conservatives?

    A few libertarians from far and wide showed up for Liberty Magazine’s 2006 Liberty Editors Conference held last week at the Frontier Hotel. The conference was to celebrate the life of the magazine’s founder R.W. Bradford. The conference was lightly attended compared to gatherings held when Bradford was alive. And, it’s hard to imagine why the Frontier was selected to host the conference. The place looks as if it’s barely been cleaned since the Elardi family was fighting the Culinary Union, with rest-rooms that remind you of those at the bus station.

    The panel “Should Libertarians Ally with Conservatives” left theory behind and focused on the nuts and bolts of trying to change the world given the (essentially) two party political apparatus that we are stuck with. As Seattle Times editorial columnist Bruce Ramsey pointed out, libertarians can have more influence being part of a bigger group than being just a tiny group by themselves.

    Thus, the question, should libertarians align with Republicans or Democrats? None of the panel could provide many examples of anyone who refers to themselves as Libertarian/Democrats, while there are plenty of examples of Libertarian/Republicans. One of which is Nevada Senator Bob Beers who attended the conference, spoke on two panels and worked as the sound technician.

    Liberty editor and author Stephen Cox made the point that for the most part conservatives and libertarians share the view that government shouldn’t run peoples’ lives. This common view makes them natural allies, while Democrats tend to be more authoritarian. Ramsey compared the platforms of the Washington state Democratic and Republican platforms to illustrate the point. The Republican platform talked about choice and freedom, while the Democratic platform talked about rights and providing government benefits for certain groups. Ramsey later made the point that alliances with conservatives on national issues are unlikely due to differences in how for-

    eign policy should be run. However, on the local and state levels, there are plenty of areas for libertarians and conservatives to work together on. It is much more likely that alliances can be formed on an issue-by-issue basis, economist David Friedman added.

    Comedian Tim Slagle even thinks Ann Coulter has libertarian leanings. “She’s for small government and lower taxes,” Slagle said, “but she doesn’t want heroin legalized if drug addicts can get welfare.”

    All of the panelists addressed the common frustration of libertarians that they just can’t seem to convince people that freedom and laissez faire are what should be embraced. It takes time to convince people, Cox pointed out, “changing from being a conservative to a libertarian is a life change, it doesn’t happen overnight.” David Friedman quoted his famous father Milton, “anyone you can convince in one argument is not worth convincing.” Friedman made the point that he had finally, after many years, convinced his father that drugs should be legalized.

    Friedman said both football teams and politics sell the pleasure of partisanship. There is tremendous entertainment value every four years when the big game is played out coast to coast allowing a person to not only cheer for their side, but even allowing voters to play in the game by pulling the lever in the voting booth.

    However, conservatives may not be as eager to hook up with libertarians. Panel moderator, Mark Skousen talked about previous Freedomfest confer-ences that he co-sponsored with the conservative Young Americans for Freedom organization and Intercollegiate Studies Institute. Next summer, Freedomfest will be held July 5-7, but Skousen is the only sponsor. “We just couldn’t agree on who the speakers should be,” Skousen told the Liberty crowd. Conservatives just do not want to have anything to do with a conference that might include speeches about drug legalization and the like. Especially when young people are attending.

    Of course, conservatives should lighten up, but as comedian Slagle pointed out, “conservatives are humorless, in addition to being…conserva-tive.” DOUG FRENCH

    Commentary: Albert ThomasThe Truth About Fund Of Funds

    First let’s understand what a fund of funds is as I seriously doubt your broker has ever told you about them. Why? Because it will take away from his commissions.

    A regular mutual fund is composed of stocks or bonds. An index funds such as the S&P500 is composed of 500 stocks while a sector fund might have only 20 or 30 stocks. Almost all mutual fund prices are figured at the close of the market which is the price the investor pays. Plus commission unless it is a no load fund. All smart investors only buy funds that do charge commission.

    No load funds are as good as funds that charge commission. Do not believe anything a broker might tell you otherwise.

    All funds have expenses that include commissions the fund must pay when they buy or sell stock. There are management fees. They have over-head as does any business such as rent, heat, light, salaries and etcetera. Be careful of the etc.

    Many mutual funds have recently added redemption fees. A redemption fee has a charge of as much as 2% if the investor sells before a certain time period such as 90 days to a year or more. This is one of the great rip-offs. They give you nonsense reasons for this charge, but the real reason is to keep you from selling their fund.

    Mutual fund expenses usually run about 1.5% of the total amount of the fund each year. As a fund gets larger the expense ratio should become smaller, but it rarely does. Fund managers just increase expenses most of which goes into their pockets.

    A fund of funds is a mutual fund that buys other mutual funds. Almost always they have a special arrangement so there is no commission or a reduced fee. Fund managers want all the money in their fund they can get as

    they are paid on the amount of money in the fund and not on performance. The average money manager makes about $300,000 whether he makes the investor money or not.

    The type of fund an investor wants to buy is one that goes up. Unfortunately many funds do not. A smart investor sells the weak fund and switches to the strong funds. He never gets married to any fund because there is no such thing as a “good” fund. Even those with a good reputation have loss periods when the investor should either be in another fund or in a money market to protect his capital.

    Brokers will tell their customers that funds of funds are no good because there are extra expenses the customer is paying for in each fund. They also talk about the extra hidden fees. Of course they are not going to tell the good points.

    The fund of funds gives immediate diversification and it makes it simple for the investor. It is especially attractive for those who do not know which funds to buy or someone who does not have time to do research. It allows the small investor to diversify among hundreds of stocks and many sec-tors.

    There are very few good fund of funds. Many investors like the concept of FUNDX which switches from poor performing funds to those going up. It is also a no loads fund which makes it doubly attractive so the investor won’t have to make changes from poor performing sectors to those becom-ing stronger. This is the only fund I know of that does this.

    Any smart investor will investigate the fund of funds before committing to a regular mutual fund.   • Getting Serious With God

    Is there anything in your life that you feel God wants you to change? Is there a relationship He has asked you to deal with or terminate all together? What about those tough issues like unforgiveness, bitterness, grief or anger? Do you struggle with those things? Have you been ignor-ing the gentle promptings of the Holy Spirit?

    I think it’s time for us—all of us—to get serious about the rela-tionship we have with God. Now is the time for us to stop putting things off—refusing to deal with those issues in our lives that we know we struggle with. It’s time for us to look at ourselves in the mirror and get serious about the things that hinder our relationship with God.

    I want to encourage you today to get serious with God and begin to address these things that have stood between you and a healthy relation-ship with God. You can conquer almost anything in your life if you are willing to get serious about it. When you finally get serious enough to do whatever it takes to make it right, you will see God intervening in your life to bring the answers you’ve been praying for.

    It’s like a man who wants to lose some weight. He knows he needs to improve his health and he wants to drop the pounds, but he’s unwilling to do what has to be done in order to lose weight. He buys an exercise machine and puts it in the corner of his bedroom but within a matter of weeks, he’s hanging his clothes on it and his wife is pleading with him to move it to the garage and get it out of the bedroom.

    He joins a health club but he can’t get into the routine of going so now the monthly fee is going to waste. He starts dieting but he can’t stay away from the fried foods. This man is clearly not very serious about

    losing weight. He’s taking his health issues with a grain of salt, maybe feeling that they will improve on their own. Sadly, it will probably take some very bad news before he’ll finally get serious about his need to change his lifestyle and lose some weight.

    Spiritually, the same thing is true. Many people have issues in their lives that they’ve struggled with for years. It’s easy to make half-hearted attempts to deal with things; but many times real success only comes when you are willing to get serious and meet the problems head on.

    In the Bible, there was a woman

    who was very sick. She endured a lot of attempted cures from several doctors before she finally decided she was going to get serious about getting well. She had to push her way through a mob of people just to get to Jesus. Her desire to get better compelled her to reach out and touch just the edge of his cloak.
