Special Use Permit/Site Plan Application Provisioning Center
1100 E. Grand River Ave.
SUBJECT An application for Special Use Permit and Site Plan approval from DNVK 1, LLC to remodel the existing building for a medical marihuana provisioning center at 1100 East Grand River Avenue. The property is zoned EV, East Village. EXISTING CONDITIONS The subject property is slightly under one-quarter acre, located on the south side of East Grand River at the southeast corner of Grand River Avenue and River Street, and currently occupied by Subway sandwich shop. Properties on the north side of East Grand River are zoned B-2, Retail Sales Business, and are generally commercial in nature, including dining and convenience shopping. The property to the east of the subject site was formerly occupied by the Big Ten party store. The property to the west of the subject site across River Street is occupied by Valvoline Instant Oil Change. The properties to the south are generally multiple-family student housing. All of the properties south of Grand River in the vicinity are zoned EV, East Village. PROPOSED DEVELOPMENT The applicant is proposing to remodel the 1,645 square foot single-story building to use as a provisioning center. A total of 9 parking spaces and 1-bicycle parking rack are proposed to accommodate staff and clients. The applicant is not proposing to make any additions to the structure or changes to the existing parking lot, with the exception of exterior architectural alterations and the addition of a new trash enclosure in the parking area. DNVK 1, Inc. received prequalification status from the Michigan Medical Marihuana Licensing Board on October 18, 2018. STAFF REVIEW – Site Plan A site plan application must meet the specific use and dimensional standards of the zoning district in which it is to be located and a number of other required conditions for development specified in the Zoning Code. A site plan application must substantially

A site plan must also comply with other applicable local ordinances and state and federal statutes, and be consistent with the objectives of the City’s master plan. A site plan may be approved subject to certain conditions or modifications necessary to bring the plan into conformance with these requirements, including the approval of any variance that may be granted by the zoning board of appeals. A. Zoning District Standards The EV district generally permits a wide range of commercial uses, including retail/medical. The maximum building height permitted by right is eight stories or 112 feet. The City Council may permit an additional two stories up to 140 feet, subject to a Special Use Permit. As indicated on the attached Zoning Analysis form, the application meets the applicable required conditions of the EV district. Pursuant to Section 50-795, nonconforming structures in the EV district may continue as constructed provided they are not enlarged or extended. Since the building is not proposed to be extended or enlarged, the development standards relative to the structure do not apply. However, staff feels that the facade standards in Section 50-793B(3) relative to fenestration, and Section 50-793C(1) relative to façade materials. The applicant will need to provide an analysis that demonstrates compliance with these sections. B. General Standards of Review for Site Plan Approval (For a detailed list of the standards, please see Sec. 50-38 of the Code) 1) General site conditions. The site shall be designed and developed to provide a
logical relationship between functional elements, to effectively serve the purposes for which it is to be developed, and to be reasonably compatible with surrounding properties.
The building is proposed for use as a medical marihuana provisioning center. The design is compatible with surrounding developments. The proposed landscaping provides screening and improves the appearance of the site.
(2) Natural features. The site shall be designed and developed to minimize the disruption or loss of its desirable natural qualities and to enhance its overall appearance. There shall be no net loss in either wetland area or wetland benefits due to development of the site. As the site is developed, there are no remaining natural features on the site.
(3) Traffic Access. The site shall be designed and developed to provide safe and efficient access for all forms of travel and to minimize impacts on adjacent public facilities.

Based on the trip generation comparison provided by ROWE Professional Services Company, additional traffic study does not appear to be required for the proposed use.
(4) Utilities and public services. The site shall be designed and developed to facilitate the efficient provision and maintenance of adequate public services.
There are no proposed changes to utilities serving the site.
(5) Environmental protection. The site shall be designed and developed to minimize
any risk of pollution of natural resources and to protect the public health, safety and welfare.
There are no anticipated risk of pollution with the proposed use.
C. Other Applicable Local Ordinances and State and Federal Regulations Prior to the approval of final plans and the issuance of any construction permits, in addition to complying with all applicable local construction standards and specifications, the applicant will need to provide the following to the Planning Division:
1. 2 – Copies of the final Site Plan 2. 2 – Copies of the final Landscape Plan, including cost estimate and landscape
bond 3. Valid State of Michigan Medical Marihuana License
D. Objectives of the Master Plan This site is designated for M4 in the City’s Master Plan which allows for a wide mix of uses such as light manufacturing, warehouse, hospital, extended care/nursing, health club, hotel, assembly, museum place of worship, office, retail establishments, place of assembly and service. It allows for buildings up to 8-stories in height, with bonus height available. STAFF REVIEW – Special Use Permit A Special Use Permit application may be approved if it meets the requirements for Site Plan approval reviewed above and if the applicant makes an affirmative showing and the City finds that the application meets the following additional standards of review specified in Sec. 50-94 of the Code. A Special Use Permit may also be approved subject to reasonable conditions or certain modifications necessary to ensure that the use conforms to all applicable requirements. A. All uses. Except as may be provided elsewhere in the Zoning Code, each Special
Use Permit application shall meet each of the following standards:

it is located and the purpose and provisions of this division. The overlay district created by Ordinance 1416a establishes medical marihuana provisioning center as an allowed special use on the subject property.
(2) The site plan for the property shall be approved in accordance with the provisions of section 50-36 of this chapter.
The proposal is being reviewed in accordance with the provisions of section 50-
36.
(3) The proposed size, height, architectural character and placement of new or expanded structures on the site shall be reasonably compatible with the existing or anticipated buildings on adjacent properties. The architecture and height of the building are compatible with the surrounding properties.
(4) Streets and access facilities serving the site shall be able to safely accommodate the expected traffic generated by the proposed use; the use shall not cause excessive traffic congestion or delays, obstruct access to adjacent properties, or imperil the safety of motorists, pedestrians or bicyclists.
The anticipated traffic generated by the proposed provisioning center is
significantly less than the existing use (Subway) to the extent that additional study is not warranted.
(5) The proposed use shall not adversely affect the use and enjoyment of adjacent properties by generating excessive noise, vibration, light, glare, odors or any other form of pollution or nuisances. There is no evidence to demonstrate there will be excessive noise, vibration, light or glare with the proposed use. The applicant is proposing an odor control system integrated with their HVAC system.
(6) The proposed use shall not materially diminish the economic value of adjacent properties or the city as a whole.
The proposal has taken safety and appearance into consideration when designing
the development so is not expected to materially diminish the economic value of adjacent properties or the city as a whole.
(7) The proposed use shall not materially diminish the privacy, safety, security or

enjoyment of any residential dwelling or residential neighborhood within the vicinity of the site.
The proposal has taken safety and appearance into consideration when designing
the development.
(8) The proposed use shall be located with direct access to and frontage on a major street as designated in the major street plan, or within an area designated for adaptive reuse in the city center element of the comprehensive plan.
Grand River Avenue is a major street.
B. Specific uses. In addition to the standards above, to address their unique
characteristics, certain uses shall also meet the applicable standards below.
Additional specific special use standards for medical marihuana provisioning center facilities. In addition to the standards set forth in this section and section 50-94a(a) of this code, to address their unique characteristics, medical marihuana provisioning center facilities shall also meet the applicable standards below except to the extent the standard or standards would interfere with or conflict with statutory regulations for the licensing of marihuana facilities under the Michigan Medical Marihuana Facilities Licensing Act.
(1) The establishment shall not cause or continue an undue concentration of
similar uses in the neighborhood such that medical marihuana provisioning center facilities and paraphernalia trade become a dominant influence or feature of the district or neighborhood. There are currently four provisioning center applications pending in the Grand River overlay, two at 1054 East Grand River Avenue, one at 1108 East Grand River Avenue, and one at the subject site. Pursuant to Section 50-94a(b)(6) only one is permitted within each overlay zone.
(2) Hours of operation must be set between 8 a.m. and 9 p.m.
Hours of operation are proposed from 8 a.m. till 9 p.m. daily. (3) No marihuana or marihuana-infused products shall be visible from the
exterior of the facility.
All windows visible from the ground view are tinted and does not allow large areas of vision into the building.
(4) All marihuana and marihuana-infused products shall be contained within
locked containers or locked display cases unless being displayed to a

patient on the premises by a caregiver. The floor plan proposes a vault to store the product in.
(5) The operators of the medical marihuana provisioning center facility shall
provide an annual donation in the amount of 1% of net profits from its operations or $5,000.00, whichever amount is greater, to an organization qualifying for exemption from taxation pursuant to 26 USC 501(c)(3) largely benefitting the residents of East Lansing and organized and operated exclusively for purposes of improving the lives of people with low to moderate income, conserving or improving natural resources, or preventing cruelty to children or animals, and with the use of the funds being in accordance with MCL 125.3504.
This will be included as a standard condition of approval. The applicant has indicated that they are working on agreements with area charities.
(6) No medical marihuana provisioning center facility shall be permitted to locate within 1,000 feet of the lot lines of another medical marihuana provisioning center facility or of a retail establishment whose exclusive or primary business is the sale of alcoholic liquor for off premises consumption.
See comments under #1 above. The nearest business selling alcoholic liquor as a primary business is the Ode’s Big Ten Party Store at 1108 East Grand River Avenue immediately adjacent to the property to the east. The store is currently closed and has a pending application for a medical marihuana provisioning center. Staff has received correspondence from the law firm Carlin Edwards Brown PLLC indicating that a transfer of the liquor licenses on the property, initiated on October 17, 2018, are currently pending and that, as such, the medical marihuana provisioning center applications at 1100 and 1054 East Grand River Avenue should be denied.
Questions from Commissioners – January 9, 2018
1. Confirm whether the parking requirement would change given the proposed use (general business/retail) compared to the existing use (restaurant). Attached is a copy of the staff report for the Subway from 1992, which details the parking requirements for the restaurant (Subway) proposed at that time. The parking calculations were based on the standard for a restaurant, including take out, which requires one parking space for every four seats provided and one space for every 20 square feet of waiting space provided. The staff report indicated that 22 seats and 70 square feet of waiting area were being proposed at the time, which would require nine parking spaces. Although this is more than the six spaces required for the current use, it is still below the total provided at 11. So there

appears to be a reduction of three spaces from what was required of Subway in 1992 as compared to the proposed retail use.
STAFF RECOMMENDATION The proposed use complies with both the Master Plan and the Zoning Ordinance and represents a use permitted by the Grand River medical marihuana overlay district. In the matter of the request from DNVK 1, LLC for a Special Use Permit approval for a medical marihuana provisioning center at 1100 East Grand River Avenue, motion to recommend approval to the City Council for the following reasons…
(Insert specific Planning Commission reasons here) Subject to the following conditions… 1. Final grading, soil erosion control, paving and utility plans for the site shall be
approved by the City Engineer in accordance with all applicable local requirements.
2. Final landscaping and screening details shall be designed in accordance with
section 50-840 of the City Code. A final landscape plan shall be approved by the Planning and Zoning Administrator and signed-off on prior to installation.
3. Bike racks shall be installed sufficient to accommodate at least one bicycles.
4. Site lighting shall be installed in accordance with the requirements of section 50-
155 of the City Code.
5. The trash containers shall be constructed and screened in accordance with the requirements of section 50-147 of the City Code.
6. Recycling containers shall be provided in accordance with section 36-86 of the City
Code.
7. The required permit(s) shall be obtained from the Department of Planning, Building, and Development for all exterior signs, in accordance with Chapter 32 – Signs of the City Code.
8. The project shall be designed and developed in accordance with all applicable
State and local statutes, codes and regulations. 9. A Memorandum of Special Use Permit shall be filed with the County Register of
Deeds per section 50-96 of the City Code.

Design Guidelines”. 11. The facility shall comply at all times and in all circumstances with the Michigan
Medical Marihuana Facilities Licensing Act, the Michigan Medical Marihuana Act and the rules of the Michigan Department of Community Health and the Department of Licensing and Regulatory Affairs. This special use permit is valid only if the permit holder also holds a valid current state operating license and a copy of the valid current State license has been provided to the City Clerk by the holder.
12. They may not be operated out of a residence or residential structure. 13. The consumption of alcohol, medical marihuana or tobacco products on the
premises is prohibited. 14. The facility shall be operated and maintained at all times so that any by-products
or waste of any kind shall be properly and lawfully kept and disposed of so as to preclude any risk of harm to the public health, safety or welfare.
15. All transfers and deliveries of medical marihuana, marihuana infused products,
marihuana seeds, and marihuana plants to facilities on different properties must be to a processor, a provisioning center, or safety compliance facility and only by means of a secure transporter and must occur within the structure out of public view except as allowed by the Medical Marihuana Facilities Licensing Act or rules or regulations promulgated thereunder. Licensed grower, processors, provisioning centers, and safety compliance facilities that have stacked license or are located on the same property are allowed to transfer medical marihuana, marihuana infused products, marihuana seeds, and marihuana plants without the use of a secure transporter.
16. The facility may not concurrently act as a primary caregiver or dispensary out of or
in conjunction with a processor, a safety compliance facility, a secure transporter facility, or a growing facility.
17. Except when in the process of being transferred, being processed, or during the
process of testing all marihuana and marihuana infused product shall be contained within an enclosed, locked facility, inaccessible on all sides and equipped with locks that permit access only by the licensed growers or their employees, as reviewed and approved by the building official and the police department.

responsible business practices so that there shall be no excessive demands placed upon public safety services, nor any excessive risk of harm to the public health, safety, or sanitation, or environmental quality, interference with vehicular or pedestrian traffic or parking, or the continuance or maintenance of any conduct unlawful under state or local law, public nuisance, or disorderly conduct either within the establishment or on or about the adjacent businesses and public streets, alleys, parks, parking facilities, or other areas open to the public. The establishment shall make reasonable effort to report to authorities any conduct unlawful under state or local law that is observed from the premises.
19. The licensee must pay an annual, nonrefundable fee of $5,000.00 to the city. 20. The establishment shall not cause or continue an undue concentration of similar
uses in the neighborhood such that medical marihuana provisioning center facilities and paraphernalia trade become a dominant influence or feature of the district or neighborhood.

25. By 30 days after the end of each State fiscal year, permittee shall transmit to the
Planning and Zoning Administrator financial statements of the licensee’s total operations pursuant to Section 701 of the Michigan Medical Marihuana Facilities Licensing Act.
