COMMENTS: The subject site is located south of University Drive and west of Mill Avenue. The proposal is to combine two (2) lots into one (1) lot that will consist of lot 1 (.4343 acres). The resulting lot will be utilized for condominiums consisting of four (4) units. Staff recommends approval of this request with conditions. REASON(S) FOR APPROVAL: 1. The site has access to a public street and meets the technical standards of the Tempe City Code, Chapter 30, Subdivisions.
CONDITION(S) OF APPROVAL: 1. The owner(s) shall provide a continuing care condition, covenant and restriction for all of the project's landscaping, required by
Ordinance or located in any common area on site. The CC&R's shall be reviewed and in a form satisfactory to the Development Services Manager and City Attorney, prior to recordation of Condominium Plat.
2. The Condominium Plat shall be put into proper engineered format with appropriate signature blanks and recorded with the
Maricopa County Recorder’s Office through the City of Tempe’s Development Services Department on or before July 17, 2009. Failure to record the plan within one year of Council approval shall make the plan null and void.
3. The applicant shall complete a full “reserve study” for the site, identifying all common elements life expectancy and future
replacement cost, which shall be disclosed to future buyers of the units. Acknowledgement of the reserve study shall be included in the CC&Rs. This study shall be provided to staff for verification, prior to recordation of Condominium Plat.

Re: 10th and Ash Minor Land Division
On behalf of myself I submit the following request for a minor land division of the property at 11S/117 and 121/123 W lOth Street.
My wife and I bought this property in 1999. The property had property line problems at the time. The existing two lots face Ash but the two duplexes face Tenth Street. Thus the property line goes through the middle of each building. The front of each building is on one plot while the backs are on the other plot.
An additional complication for this property is that there are few other duplexes in this neighborhood so there is no way to obtain comparable values which are needed for financing.
To cure these two problems I have hired Miller Surveying to do a condo survey for the property with the intention of converting the units to condominiums. The submitted survey plan shows the requested lot division. Eliminating the lot line that goes through the two buildings will change the two lots into one lot. This will resolve the property line issue and bring the property more in line with the neighborhood which does have existing condos.
