The project is located on US Route 3 and NH Route 25 in Meredith Village. The overall project consists of operational modifications to enhance existing infrastructure, including minor improvements in lane configuration and signals. Work in jurisdictional areas involves sliplining twin 36” concrete culverts that carry an intermittent stream under US 3 near Lake Street. The culverts outlet into Lake Winnipesaukee.

WETLANDS PERMIT APPLICATION – ATTACHMENT A MINOR AND MAJOR - 20 QUESTIONS

Env-Wt 302.04 Requirements for Application Evaluation - For any major or minor project, the applicant shall demonstrate by plan and example that the following factors have been considered in the project’s design in assessing the impact of the proposed project to areas and environments under the department’s jurisdiction. Respond with statements demonstrating:

1. The need for the proposed impact.

The existing twin 36" culverts that will be sliplined as part of this project are in poor condition with a history of sink holes developing in the roadway above them. The headwall will be reconstructed. Addressing these culverts is necessary in order to maintain the safety and integrity of the roadway.

2. That the alternative proposed by the applicant is the one with the least impact to wetlands or surface waters on site.

The only alternative that would have less impact to surface waters would be the no-build alternative, which would not address the deteriorating condition of the pipes and would lead to their eventual failure. Full replacement of these pipes was presented as the proposed alternative at the November 16, 2016 NHDOT Natural Resource Agency Coordination Meeting. Since that meeting, it was determined that lining the pipes with a thermoplastic Close Fit Liner would adequately address the deteriorating joints of the concrete pipe sections, extend the life span of the pipes, and eliminate impacts outside existing right-of-way.

3. The type and classification of the wetlands involved.

R4SB3J (Riverine, Intermittent, Streambed, Cobble-Gravel, Intermittently Flooded)

L2US3G (Lacustrine, Littoral, Unconsolidated Shore, Mud, Intermittently Exposed)

4. The relationship of the proposed wetlands to be impacted relative to nearby wetlands and surface waters.

The intermittent stream originates south of the project area and flows into Lake Winnipesaukee. The lake covers an area of approximately 70 square miles.

5. The rarity of the wetland, surface water, sand dunes, or tidal buffer zone area.

There are no unusual features, rare species, or exemplary natural communities within the project area. The intermittent stream type is common throughout the State and the small area of lake bed that will be disturbed by the culvert replacement work is within a developed area of the shoreline.

6. The surface area of the wetlands that will be impacted.

Permanent impacts to the channel of an intermittent stream: 132 sq ft

Permanent imapcts to the banks of an intermittent stream: 228 sq ft

Temporary impacts to the stream and lakebed: 203 sq ft

7. The impact on plants, fish and wildlife including, but not limited to:

a. Rare, special concern species;

b. State and federally listed threatened and endangered species;

c. Species at the extremities of their ranges;

d. Migratory fish and wildlife;

e. Exemplary natural communities identified by the DRED-NHB; and

f. Vernal pools.

The NH Natural Heritage Bureau has no records of sensitive species or natural communities of concern in the vicinity of the project. The USFWS Information, Planning, and Conservation System (IPaC) web tool was utilized to determine if federally listed species have the potential to occur in the project area. According to IPaC, the federally-threatened small whorled pogonia and northern long-eared bat are potential concerns in this region of New Hampshire. The project is located in a developed area with no forested habitat; therefore there is no suitable habitat within the project area for either of these species.

No vernal pools were identified in the project area.

The twin culverts carrying an intermittent stream are not perched and currently allow aquatic organism passage. The culverts are 135’ in length and at a slope of only 1%. The lining will not result in a perched condition. NH Fish and Game reviewed the proposed sliplining and had no concerns. Stream flow will be diverted through one culvert at a time during construction, which will minimize termporary impacts to the stream during construction.

8. The impact of the proposed project on public commerce, navigation and recreation.

The project will have no impact on public commerce or navigation. The culvert outlets are not located in an area of the lake that is used for recreation or navigation.

9. The extent to which a project interferes with the aesthetic interests of the general public. For example, where an applicant proposes the construction of a retaining wall on the bank of a lake, the applicant shall be required to indicate the type of material to be used and the effect of the construction of the wall on the view of other users of the lake.

The proposed culvert work will not impact the aesthetics of Meredith Village. The culvert outlets are visible from the boardwalk that extends from the Town Docks; however, the pipes are located along a developed, disturbed section of shoreline and the proposed work will not change the existing aesthetics in this area.

10. The extent to which a project interferes with or obstructs public rights of passage or access. For example, where the applicant proposes to construct a dock in a narrow channel, the applicant shall be required to document the extent to which the dock would block or interfere with the passage through this area.

Public rights of passage or access will not be obstructed following construction of this project.

11. The impact upon abutting owners pursuant to RSA 482-A:11, II. For example, if an applicant is proposing to rip-rap a stream, the applicant shall be required to document the effect of such work on upstream and downstream abutting properties.

Riprap will be placed at the inlet of the twin 36" culverts to stabilize the area of channel and banks that will be disturbed during construction. The area of riprap will be minimal, and impacts to the lake and stream from proposed culvert work will be minimal. The project will not impact abutters.

12. The benefit of a project to the health, safety, and well being of the general public.

The project will protect the safety and integrity of US Route 3/NH Route 25, which will benefit the safety and well-being of motorists.

13. The impact of a proposed project on quantity or quality of surface and groundwater. For example, where an applicant proposes to fill wetlands the applicant shall be required to document the impact of the proposed fill on the amount of drainage entering the site versus the amount of drainage exiting the site and the difference in the quality of water entering and exiting the site.

The project will not impact the quality or quantity of surface and groundwater. Runoff from the project area is not currently treated in any formalized treatment areas and is discharged directly into Lake Winnipesaukee. There are a number of environmental and engineering constraints and challenges associated with providing stormwater treatment in the project area. The project area is fully developed and the Town of Meredith has requested that any proposed work minimize impacts to businesses and utilities. The open space that does exist in the vicinity of the project consists of recreational sites that are protected under Section 4(f) and Section 6(f). Given these constraints, the only BMP that is feasible is deep sump catch basins, which will be provided where catch basins will be replaced within the project area.

The project will not change the existing roadway alignment, profile, or width. The overall area of impervious surface will be redcued by approximately 1,100 sq ft.

To protect water quality, all appropriate erosion and sediment control measures will be implemented during construction and all disturbed surfaces will be stabilized upon the completion of construction.

14. The potential of a proposed project to cause or increase flooding, erosion, or sedimentation.

The slip lining methodology that is proposed is called a Close Fit Liner (CFL) and will only reduce the diameter of the culverts a nominal amount. The CFL has a relatively thin wall and can fit immediately adjacent to the inside of the existing culvert. The liners are made from thermoplastic and have a lower Manning’s coefficient than the existing concrete pipe. The slight loss in hydraulic capacity due to the reduction in pipe diameter is offset by the increase in capacity due to the smoother surface. Therefore, hydraulic capacity will not be diminished. The culverts have no history of flooding and the completed project is not expected to cause or increase flooding, erosion, sedimentation. To prevent erosion and sedimentation, all appropriate erosion and sediment control measures will be implemented during construction, and all disturbed surfaces will be stabilized upon the completion of construction.

15. The extent to which a project that is located in surface waters reflects or redirects current or wave energy which might cause damage or hazards.

The project will maintain the existing stream alignment and will not change the shoreline of the lake; therefore, the project will not reflect or redirect currents.

16. The cumulative impact that would result if all parties owning or abutting a portion of the affected wetland or wetland complex were also permitted alterations to the wetland proportional to the extent of their property rights. For example, an applicant who owns only a portion of a wetland shall document the applicant’s percentage of ownership of that wetland and the percentage of that ownership that would be impacted.

All future proposed impacts would need to comply with applicable state and federal regulations.

L. Sommer asked if there are any mussels in the Big River. C. Perron replied that the Natural Heritage Bureau did not report any mussel populations in the vicinity of the project. L. Sommer asked if the bridge would be closed to traffic during construction. J. Lund replied that it would be closed and a temporary detour on existing roads would be implemented. Carol Henderson commented that Fish & Game would prefer that a portion of the channel be kept open at all times throughout construction. J. Magee commented that he would recommend the use of wildlife-friendly erosion control matting if matting will be needed. This project has not been previously discussed at a Monthly Natural Resource Agency

Coordination Meeting. Meredith 10430, STP-F-X-0241(014) Christine Perron introduced the project, which is located on US Route 3 and NH Route 25 in Meredith Village. The project begins at approximately the Meredith Fire Station and extends north on US 3 through the intersection of US 3 and NH 25 to a point approximately 750 feet north of the intersection with Main Street, and east on NH 25 to the intersection of Pleasant Street. The purpose of the project is to make improvements to the overall operation of the US Route 3/NH Route 25/Main Street intersection and its approaches, and to improve pedestrian safety within the project area. The project has been developed through coordination with a stakeholders group known as the Public Advisory Committee (PAC), formed in early 2006. The project as now proposed is the culmination of over nine years of input from the PAC, town officials, and the general public. The final result of this coordination was that, due to impacts to businesses and underground utilities, the Town did not support the alternatives that were developed during the study phase that sought to address congestion issues. The project has therefore been scaled back and now consists of operation modifications to enhance existing infrastructure, including minor improvements in lane configuration and signals. Brian Patinskas provided an overview of the proposed design. The project will entail milling and overlay of pavement with some minor changes to the pavement markings. The US 3 northbound approach geometry will be altered to remove one of the northbound through lanes. This will give more area for turning vehicles and merging without widening the road. New traffic signal and equipment will be installed at the US 3/NH 25/Main Street intersection, including mast arms, conduits, signal heads, pedestrian equipment, and emergency vehicle preemption. To maximize the number of vehicles that can pass through the intersection, an Adaptive Traffic Signal Control System will be used to optimize the operations of the intersection. A mid-block signalized Pedestrian Hybrid Beacon (PHB) will be installed between Dover Street and Lake Street. The old crosswalks at Dover Street and Lake Street will be removed. A remotely activated Emergency Hybrid Beacon at the Fire Station will be installed so that traffic can be stopped to allow fire trucks to exit the building to respond to calls.

The project will include improvements to the existing catch basins, sidewalks, curbing, and wheelchair ramps along US 3 and NH 25 as well as improvements to the entrance and exit of the Town Dock parking area. Pavement widths will not be changing. There is potential for some portions of sidewalk to be removed along NH 25.

The bridge that carries US 3 over the Lake Waukewan Outlet (Bridge 186/145) will be rehabilitated. Proposed work will consist of rehabilitation of the culvert top slab to include partial and full depth slab repairs, new membrane and pavement, concrete repairs to the sidewalks, and curb replacement. No work in the water will be necessary.

Culverts will be replaced at two locations: twin 36” concrete culverts that carry an unnamed stream under US 3 near Lake Street, and two 15” drainage pipes at the end of Lake Street. These culvert replacements are the only work that will require work in the water. Final design of this project is just getting underway. Permit applications will be submitted within the next few months and tentative advertising date for the project is July 2017. Construction would begin after Labor Day weekend to minimize traffic disruptions. C. Perron provided an overview of resources in the project area and proposed impacts. Wetlands are located in the project area but will not be impacted. The wetland associated with Hawkins Brook had been designated as a Prime Wetland; however, Gino Infascelli indicated that the town had removed this designation and the DES map had not yet been updated. The only impacts in jurisdictional areas will be the culvert replacements, which will impact an intermittent stream and the edge of the lake. In addition, the project will require a Shoreland Permit By Notification for earth disturbance within the Protected Shoreland of Lake Winnipesaukee. Surface waters in the project area are listed as impaired waters. The lake is impaired by cyanobacteria and hepatotoxic microcystins, and Hawkins Brook and Lake Waukewan Outlet are both impaired by dissolved oxygen saturation and pH. There are a number of constraints and challenges associated with providing stormwater treatment in the project area. The project area is fully developed and the Town of Meredith has requested that any proposed work avoid impacts to businesses and underground utilities. The open space that does exist in the project area consists of parks and recreational sites that are protected under Section 4(f) and Section 6(f). Given these constraints, the only BMP that is feasible is deep sump catch basins, which would be provided where catch basins will be replaced within the project area. The project will not increase the area of impervious surface and there may be small areas of sidewalk that are replaced with grass. The twin pipes that carry an intermittent stream have a drainage area of 0.15 square miles, making this a Tier 1 stream crossing. The pipes will be replaced in-kind. The replacement of these pipes and the 15” drainage pipes will result in 254 square feet and 47 linear feet of permanent impact to channel, banks, and lakebed, 241 square feet of temporary impact. There is no suitable habitat within the project for northern long-eared bat or small whorled pogonia. Section 106 consultation resulted in a finding that no historic properties would be affected by the project. No concerns were raised with the project as proposed.

This project has been previously discussed at the 5/21/1992, 6/15/1995, 4/16/1997, 5/18/2005,

9/17/2008, 1/21/2009, and 6/18/2014 Monthly Natural Resource Agency Coordination Meetings.

A Biological Assessment is required for construction projects (or other undertakings havingsimilar physical impacts) that are major Federal actions significantly affecting the quality of thehuman environment as defined in the National Environmental Policy Act (42 U.S.C. 4332(2)(c)). For projects other than major construction activities, the Service suggests that a biologicalevaluation similar to a Biological Assessment be prepared to determine whether the project mayaffect listed or proposed species and/or designated or proposed critical habitat. ACOE Appendix B Supplemental Narrative

1.1 Will any work occur within 1 mile upstream in the watershed of an impaired water? The NHDES draft 2014 List of All Impaired Waters (most recent available) identifies surface water impairments for Lake Winnipesaukee (Assessment Unit ID NHLAK700020110-02-19), Hawkins Brook (Assessment Unit ID NHRIV700020109-02), and Lake Waukewan Outlet (Assessment Unit ID NHRIV700020109-06) (see Figure 3). The lake is impaired for primary contact recreation by cyanobacteria and hepatotoxic microcystins. Both streams are impaired for aquatic life by dissolved oxygen saturation and pH. Runoff from the project area is not currently treated in any formalized treatment areas and is discharged directly into Lake Winnipesaukee. There are a number of environmental and engineering constraints and challenges associated with providing stormwater treatment in the project area. The project area is fully developed and the Town of Meredith has requested that any proposed work minimize impacts to businesses and utilities. The open space that does exist in the vicinity of the project consists of recreational sites that are protected under Section 4(f) and Section 6(f). Given these constraints, the only BMP that is feasible is deep sump catch basins, which will be provided where catch basins will be replaced within the project area.

The project will not change the existing roadway alignment, profile, or width. The overall area of

impervious surface will be redcued by approximately 1,100 sq ft.

3.1 Has the NHB determined that there are known occurrences of rare species, exemplary natural communities, Federal and State threatened and endangered species and habitat, in the vicinity of the proposed project?

The NH Natural Heritage Bureau has no records of sensitive species or natural communities of concern in the vicinity of the project. The USFWS Information, Planning, and Conservation System (IPaC) web tool was utilized to determine if federally listed species have the potential to occur in the project area. According to IPaC, the federally-threatened small whorled pogonia and northern long-eared bat are potential concerns in this region of New Hampshire. The project is located in a developed area with no forested habitat; therefore there is no suitable habitat within the project area for either of these species.
