Envisaged Benefits for non-EU States resulted by SES

Improvement of ANS efficiency, routes optimization and increased ATM capacityUniformity within the pan-European Air Transport Network:

Specific issues of SES Implementation for non-EU States

SES as an EU initiative may result differences between the SES and non-SES States

Lack of efficient involvement of non – EU States into all kinds of activities (SSC/rulemaking, SESAR/SJU, NCP, etc.)

Need for the Comprehensive Aviation Agreements with EU (ECAA)

EU legislation does not directly applicable and not binding

Harmonization of legislation is necessary

EUROCONTROL plays a vital role in this process though EUROCONTROL / EU relationship is not yet formalized

Role of EUROCONTROL

Adopt SES related legislation, procedures, operational & technical specifications

Develop recommendations on State’s specific problems related to the SES Implementation

Assist non-EU MS in SES Implementation processes (to establish State Office for Pan-European SES Implementation)

Establish target performance scheme (transition targets) for non-EU MS

Perform a Gap Analysis for individual non-EU MS

Allocate required resources in the Agency BP & Budget

High Level Agreement (HLA) between EU and EUROCONTROLHLA should establish legal basis for complementary mutual

cooperation and specify its scope EUROCONTROL should support EU in SES implementation

within and beyond the EU

EUROCONTROL’s new organizational structure and functions to be further adapted to implement SES strategy

HLA should not become a revision of the EUROCONTROL Convention as it may affect non-EU States’rights

HLA to be implemented in transparent manner

Pan-European performance targets Participation of all SES and non-SES States is important to

achieve a genuine efficient Pan-European network

EUROCONTROL - to develop Guidance Material by mid-2013 for RP2 (including specific elements for non-EU States)

EUROCONTROL - to review the Pan-European performance targets taking into account latest data (forecasts) for particular non-EU Member State

Non-EU States - use RP1 as a transitional training and learning period focusing on the monitoring of the defined PIs with the intention of target setting in RP2

Safety Oversight & Standardisation

Non-EU States concluded Working Arrangements with EASA:

Current WA reflect post JAA situation

Serve implementing EU Regulations and Standardization : part of transition phase after conclusion of ECAA Agreement

Flexible approach is necessary in the ATM/ANS safety area to proceed with WA amendments

Outstanding issues between EUROCONTROL and EASA to be formally resolved

Synergy of ESIMS and EASA standardization

Further recognition EUROCONTROL expertise, and granting the equal rights to non-EU EUROCONTROL MS within EASA ATM regulatory activities

Conclusions:

EUROCONTROL continues supporting Non-EU Members within the development of Pan- European Network

Maintain EUROCONTROL’s regulatory function as appropriate for non- ECAA EUROCONTROL MS

Retain EUROCONTROL as Intergovernmental OrganizationAllocate required resources in the Agency BP & BudgetSmooth and gradual integration into the SES to be reflected in

HLA to ensure the Pan-European dimension and protect the interests of Non-EU States

Non-EU countries should seek an active involvement in FABs, at least by having direct bilateral relations

EU to continue practice of targeted support and grant non-EU MS States access to SES governance structures (SSC, NMB) and advisory forums ( e.g. NSA coordination platform)

Conclusions:

EASA and non-EU MS to finalize the WA amendments to allow a smooth transition of the new ATM/ANS inspection system at a pan-European level

An ECAA or comparable agreement is an important instrument to formalize the links with SES

States that experience difficulties related to the existence of double / multiple regulations may apply to those norms which allow them to ensure the required level of safety and performance
