2. Civility Statement In accordance with the Open Meeting Law, the Board has a civility policy that prohibits any type of

disorderly conduct that disrupts the Board from carrying out its business. Those violating this policy will

be asked to modify their behavior and act civilly. If the disorderly conduct continues, the person may be

(The Board may go into executive session on any of the following items under A.R.S. §38-

431.03(A)(2) for discussion of any information made confidential by law.) (1) Michael Allen - Formal Hearing on Denial of Application for Reinstatement.

Ms. Jennifer Perkins; Assistant Attorney General, was present representing the Board. Mr.

Allen was present along with Council Ms. Kent. Ms. Kent made opening statements to the Board. Ms. Campbell made opening Statements to the Board. Dr. Sheldon Deal was present, sworn in, and answered Attorney and Board

questions. Mr. Allen was sworn in, and answered Attorney and Board questions. Ms. Kent presented exhibits to the

Board and requested the Board consider the possibility of reinstatement of licensure without the ability to write prescriptions. The Board discussed the possibility of drafting a consent agreement to reinstate Mr. Allen's license

without the ability to prescribe legend drugs. Dr. Sheldon Deal was present, sworn in, and answered Attorney and

Board questions. Mr. Allen was sworn in, and answered Attorney and Board questions. Dr. Marchese made a

motion to allow the Attorneys, and Board Staff to draft a consent agreement and bring it back to the Board for approval or denial. Seconded by Dr. Terlisner. Motion Carried

The Board took a 5 minute break and entered back into regular session at 2:05pm.

(2) Dr. Melenie Dunn - Case No. 15-019, Investigative Interview. Dr. Dunn was present. The patient she is unhappy with the results of the elective procedure

performed by Respondent; (Lipodissovle), and wanted her money back. As evidenced by source documents in

which the patient initialed and signed, she had been advised and understood there could be can no guarantee of results. The complaints further alleges the treatment caused painful health impairments, however failed to supply

evidence to support her allegations. Dr. Sadilek made a motion to dismiss the case, Seconded by Dr. Eldridge.

Motion carried 6 Ayes, 1 Absent.

(3) Dr. Herbert Schuck - Case No. 15-010, Investigative Interview.

Dr. Schuck was present. According to the Arizona Department of Health Services,

from January 1, 2014 through June 30, 2014, Respondent approved certifications for Medical Marijuana.

By initialing each certification, Respondent attested he had queried and reviewed each patient prior to

certifying them for Medical Marijuana. According to source documents, Respondent only accessed the

database and queried .7% of the patients he certified during that time period. After review of Respondent's

records by the Board, it appears he may not have kept adequate medical records as defined by A.R.S. 32-

1501(3). Further it is alleged by the Board, Respondent may not have provided appropriate standard of

care, by failing to conduct a physical examination appropriate to the qualifying patient's presenting

symptoms and debilitating medical condition, and by relying on medical records from a Chiropractor. Ms.

Bennett made a motion to move the case forward to a Formal Interview. Seconded by Dr. Sadilek. Motion

Carried 6 Ayes, 1 Absent.

(4) Dr. George Miles - Case No. 15-035, Investigative Interview.

Dr. Miles was present. According to the Arizona Department of Health Services, from

January 1, 2014 through June 30, 2015, Respondent approved certifications for Medical Marijuana. By

initialing each certification, Respondent attested he had queried and reviewed each patient prior to

certifying them for Medical Marijuana. According to source documents, Respondent only accessed the

database and queried .17% of the patients he certified during that time period. After review of

Respondent's records by the Board, it appears he may not have kept adequate medical records as defined

by A.R.S. 32-1501 (3). Further the Board alleges, Respondent may not have provided appropriate

standard of care by failing to conduct a physical examination appropriate to the qualifying patient's

presenting symptoms and debilitating medical condition. Dr. Marchese made a motion to move the case

forward to a Formal Interview. Seconded by Mr. Logan. Motion Carried, 6 Ayes, 1 Absent.

(5) Dr. Ubong Attah Prince - Case No. 15-026, Investigative Interview.

Dr. Prince was present along with Council Mr. Steve Perlmutter. The Board received

a notice from DHS regarding a discrepancy in the number of certifications written by Dr. Attah Prince

during the time period of Jul 1, 2014 - June 30, 2015; However, after a re-run by the Pharmacy Board, the

number of queries performed were above the number of certificates issued by Respondent. Board Staff

presented to Respondent's office for the purpose of records inspection, related to the case. Charts were

pulled randomly by Board Staff. All charts inspected were found to fall within the statute requirements of

the Arizona Medical Marijuana Act and the Arizona Naturopathic Statutes. Dr. Sadilek made a motion to

dismiss the case. Seconded by Dr. Eldridge. Motion Carried, 6 Ayes, 1 Absent.

(6) Dr. Rebecca Whelchel - Case No. 15-021, Investigative Interview.

Dr. Whelchel was present. The case was opened based on a self-reported DUI, which took

place in 20015. Source documents indicate completion of all court ordered fines, education and screening. Dr. Eldridge requested confirmation from Dr. Whelchel that she has a current support system and affirmation she

believes she does not have a drinking problem. Dr. Whelchel affirmed both. Dr. Sadilek made a motion to dismiss

(3) Leigh Lewis, Application for License by Endorsement.

The Applicant was present. In review of the application, is was noted all requirements had been met with the exception of passing of the NPLEX acupuncture examination. It was further noted Applicant

holds an LAC license in another state and is in the process of transferring that license to Arizona. Dr. Marchese

requested confirmation from the Applicant she understood if approved by the Board, her Arizona Naturopathic

Medical License would not include the ability to perform acupuncture under her naturopathic license. That in the event she did perform acupuncture procedures, it would be under an Arizona LAc license. Applicant confirmed she

understood. Dr. Sadilek made a motion to approve the application for licensure by endorsement which would

include the issuance of a reduced scope license. Seconded by Ms. Bennett. Motion Carried 6 Ayes, 1 Absent.
