TIMETABLE FOR ACTION ON THE PROPOSED RULE: The public comment period endson Monday, August 21, 2017. A public hearing will be held on Thursday, August 3, 2017.

SUMMARY OF PROPOSED RULE: The RIDOH is proposing rulemaking to adopt theamendments to repeal the current lead poisoning prevention regulations in their entirety andreplace them with new regulations to better align with federal rules and standards, eliminateconfusion, makes changes to current fees and fee categories, and add a penalty matrix.Recodification in accordance with state Administrative Procedures Act (APA) requirements is alsoproposed.

SUPPLEMENTARY INFORMATION: RIDOH currently regulates the lead program underdelegated authority from the United States Environmental Protection Agency (EPA). If RIDOHwere not to regulate, Rhode Island would immediately be subject to EPA's regulatorystructure. Thus, the baseline for this regulation is the state of the world that would result if RIDOHabdicated its delegated authority to regulate in lieu of federal EPA requirements. The RIDOHproposed provisions closely mirror the EPA requirements. Were EPA to take over the RhodeIsland program, the proposed regulatory provisions that generate the bulk of the costs and benefitswould remain largely unchanged. Thus, the changes in the proposed rule do not generatesignificant economic impacts on the state when compared to the baseline condition of EPA controlin absence of the rule.

One category of cost on existing small business is unique to Rhode Island. The upgrade of theEnvironmental Lead Technician licenses (ELTs) to Environmental Lead Inspector licenses (ELIs)will impose additional costs on the 10 ELTs who are not municipal or state inspectors (RIDOHRegulation R23-24.6-PB §§16.2(b) & 16.7). The conservative estimate for the total additionalcost to this group is $43,500, calculated in the following manner:

1. The cost of the additional training for the ELI designation is $1,750.2. The additional training requirements for the ELI designation require an additional 65 hours

at approximately $40/hour (opportunity cost of time for the contractor set). Total: $2,6003. Assuming that all ELTs pursue an ELI license, the individual cost expands to

$4,350*10. Total = $43,500 for all ELTs.

AUTHORITY FOR THE RULEMAKING: Sections 23-24.6, 23-1-3(b), 23-1-17, and 23-1-54of the Rhode Island General Laws.

REGULATORY FINDINGS: In the development of the prosed amendment, consideration wasgiven to: 1) alternative approaches; 2) overlap or duplication with other statutory and regulatoryprovisions; and 3) significant economic impact on small business. No alternative approach,duplication, or overlap was identified based on available information.

THE PROPOSED AMENDMENT: The RIDOH proposes to amend 216-RICR-50-15-3 and216-RICR-10-5-2 as follows in the concise explanatory statements of proposed non-technicalamendments.

§ 2.0 APPLICABILITY AND SCOPE

§ 2.1 Regulated Facilities moved to § 3.2.2. Any pre-1978 building or part ofa building being converted into a residential facility is moved from§14.1(c)(8). Distinction is made between child care centers and childcare homes to align with DCYF licensing.

§ 2.2 Persons Subject to these Regulations moved to § 3.2.1 RegulatedPersons are delineated in more detail. Owners of target housing areadded because they are included in § 3.8 Lead Disclosure (formerly§9.0).

§ 2.3 Persons Exempt from these Regulations are delineated throughout §3.2.1.

§ 2.4(b) Applicability of LHC is moved to §§ 3.2.4, 3.16.1 & 3.17.1. Any pre-1978 building or part of a building being converted into a child carefacility is moved from §14.1(c)(8). Any window replacement, at aregulated facility or for compensation at target housing, must be doneby a licensed Lead Contractor or Lead Renovation Firm.

§ 3.0 CHILDHOOD LEAD POISONING SCREENING

§ 3.1(a)(1) § 3.1(a)(1) is moved to § 3.2.1(A)(1)(a). The requirement for parents ofchildren who are younger than six years of age and parents of childrenwho exhibit the mouthing behavior of toddlers because ofdevelopmental delays to ensure that all of those children receiveappropriate blood lead screening is added in § 3.2.1(A)(1)(b).

§ 3.1(a)(2) § 3.1(a)(2) is moved to § 3.2.1(A)(2)(a). The requirement for primarycare physicians, pediatricians, or other health care providers of childrenresiding in Rhode Island to ensure that all of those patients receiveappropriate blood lead screening is added in § 3.2.1(A)(2)(b).

§ 3.1(a)(3) § 3.1(a)(3) is moved to §§ 3.2.1(A)(2)(c) & (d).

CHAPTER 10 – PUBLIC HEALTH ADMINISTRATION

SUBCHAPTER 5 - PRACTICES AND PROCEDURES

PART 2 – FEE STRUCTURE FOR LICENSING, LABORATORY ANDADMINISTRATIVE SERVICES PROVIDED BY THE DEPARTMENT OF HEALTH

2.1 Authority

These Regulations are promulgated pursuant to the authority set forth in R.I.Gen. Laws §§ 23-1-3(b), 23-1-17, and 23-1-54, and are for the purpose ofestablishing the specific licensing, laboratory or administrative fees contained inthe individual statute(s) cited in these Regulations.

2.2 Definitions

Wherever used in this Part, the following terms shall be construed as follows:

1. "Department" means the Rhode Island Department of Health.

2. "Director" means the Director of the Rhode Island Department of Health.

3. "License" means an authorization granted by the Department to engage ina business or occupation that is subject to regulations by the Department.For the purpose of this Part, a registration, certification, permit or similarauthorization issued by the Department is also considered to be a license.

4. “Private Well Water Supply” means a source of well water used for humanconsumption and which is not a “Public Water System.”

5. “Public Water System” means a system for the provision to the public ofpiped water for human consumption, provided such system has at leastfifteen (15) service connections or regularly serves an average of at leasttwenty-five (25) individuals daily at least sixty (60) days out of the year,pursuant to Part 50-05-1 of this Title.

6. “R.I. Gen Laws” means the General Laws of Rhode Island, as amended.

7. “State Health Laboratories” means the State Health Laboratoriesmaintained by the Rhode Island Department of Health.

8. “These Regulations” or “this Part” means all of Rhode Island rules andregulations pertaining to the Fee Structure for Licensing, Laboratory and

Administrative Services Provided by the Department of Health [216-RICR10-5-2].

9. “Well Water” means water that is taken from below the ground throughpiping or similar installed devices utilizing external force or vacuum.

2.3 Applicability and Scope

A. This Part is promulgated to establish a consolidated fee schedule for licensing,laboratory and administrative services provided by the Department.

B. The provisions of this Part are in addition to, and not in substitution for, otherlicensing rules and regulations promulgated by the Director pursuant to authorityconferred by applicable R.I. Gen Laws statutes.

1. Nothing in this Part shall be construed as requiring the use of the StateHealth Laboratories where other clinical laboratories, licensed by theDepartment pursuant to R.I. Gen Laws §§ 23-16.2-4(a), are available toperform the requested laboratory services.

2. Nothing in this Part shall be construed as requiring the use of the StateHealth Laboratories where other analytical laboratories, licensed by theDepartment pursuant to R.I. Gen Laws § 23-16.2-4.1, are available toperform the requested laboratory services.

2.4 Designation of Certain Clinical Tests as a Covered Benefit

Pursuant to the authority conferred by R.I. Gen. Laws § 23-1-3(c), the clinicaltests listed in § 2.15 of this Part have been designated by the Director as acovered benefit and shall be reimbursable by all health insurers, as defined inR.I. Gen. Laws § 27-38.2-2(1), providing health insurance coverage for specificdiseases, hospital indemnity Medicare supplements, or other supplementalpolicies. The charges for those testing programs shall be borne by the hospitalsor other licensed health care providers and facilities in the absence of a thirdpartypayor.

2.5 Fees for Lead Poisoning Screening

The fee for any lead poisoning screening or lead screening-related servicesprovided by the State Health Laboratories shall be determined on the basis ofrates paid by the health care insurers to private laboratories for blood leadanalysis.

2.6 Licensing, Laboratory and Administrative Services Fees

A. The fees for licensing, laboratory and administrative services performed by theDepartment are contained in §§ 2.9 through 2.18 of this Part as follows:

2.7 Payment of Fees

A. Unless otherwise specified in this Part, payment for all licensing, laboratory andadministrative services performed by the Department shall be non-returnable andnonrefundable and shall be in the form of a check or money order made payableto the General Treasurer, State of Rhode Island.

B. Payment for all clinical laboratory services, including all screening for leadpoisoning and lead screening-related services, performed by the State HealthLaboratories shall be submitted to the Department within thirty (30) days ofreceipt of the invoice or other period of time agreed to by the Department.

C. Payment for all testing of private well water supplies performed by the StateHealth Laboratories shall be prepaid. The testing fee(s) shall be submitted at thetime the sample is forwarded to the State Health Laboratories.

D. The application/initial licensure fee established in this Part shall be submitted inaccordance with the requirements specified in the regulations governing theprofession and/or activity for which the license application is being submitted.

E. All license and renewal fees in this Part are specified on a license cycle basis.Consequently, license categories common to more than one profession [e.g.,Controlled Substances Registration (CSR)] will be assessed on an annualizedfee basis x the number of years in the license cycle.

F. The applicable renewal fee established in this Part shall be submitted prior to theexpiration date of the current license. Failure to submit the applicable renewalfee prior to the expiration date of the current license may subject the licensee toassessment of a late fee, as established by this Part, as well as additionaladministrative sanctions specified in the regulations governing the professionand/or activity for which the license was issued.

G. When online renewal is available for a license, payment shall be made in any ofthe forms designated on the renewal website.

2.8 Compliance and Severability

A. All hearings and reviews required under this Part shall be held in accordancewith the provisions of Part 4 of this Subchapter.

B. If any provision of this Part or the application thereof to any person orcircumstances shall be held invalid, such invalidity shall not affect the provisionsor applications of this Part which can be given effect, and to this end of theprovisions of this Part is declared to be severable.
