PROCLAMATION FORSUICIDE PREVENTIONAWARENESSMONTH

WHEREAS,suicideis oneof themostdisruptiveandtragiceventsafamily and communitycanexperience,with

more than 950 lives lost in Tennesseeeachyearandan estimated8-25 attemptedsuicidesfor eachsuicidedeath;

and

WHEREAS, suicideis the10

th leadingcauseofall deathsin Tennesseeandthesecondleadingcauseof deathamongpeoplefrom theageof 15 to 24 (source;TennesseeDepartmentofHealth);and

WI-JEREAS,Tennesseeveterans,active-dutymilitary personnel,andNationalGuardsmenfaceadisproportionaterisk ascomparedto thegeneralpopulationof Tennessee,with moredyingfrom suicidethancombat;and

W}-IEREAS,public awarenessofthis terri~ingproblemis thekeyto preventingfurthersufferingandloss of life;andthe risk for humanself-destructioncanbe reducedthroughawareness,educationandtreatment;andasthehighestrisk for suicideis amongthesurvivorsofthosewho diedby suicideor thosewho haveattemptedsuicide;and

WHEREAS,Tennesseeis anationalleaderin theeffort to preventsuicide,beingoneofthefirst statesto developasuicide preventionandevaluationplan coveringthelifespan;and

Wl-IEREA5, theGovernorof TennesseehasappointedaSuicidePreventionNetworkAdvisory Council tocoordinatetheimplementationoftheTennesseeStrategyfor SuicidePrevention;and

WHEREAS,theTennesseeSuicidePreventionNetwork is agrassrootscollaborationof Tennesseansandorganizationsworking to eliminatethestigmaof suicide,educatethe communityaboutthewarning signsofsuicide,andultimately reducetherateof suicidein ourstate;and

WHEREAS,theTennesseeSuicidePreventionNetwork(tspn.org) is alsocommittedto excellencein suicideprevention,intervention,andpostvention;now

WHEREAS,everydayin America,29 peopledie asaresultofdrunkdriving andcrashes;and

WHEREAS,ourcommunitywasgreatlyaffectedby suchatragedyon July 30, 1993,whenfive studentsat South Greene High Schoollost theirlivesto adrunkdriver in Sevierville,Tennessee;and

WHEREAS,in thewakeofthis tragedy,a local chapterofMothersAgainstDrunkDriving (MADD) wasformedin 1994,andtheycontinueto workdiligently for positive resultsin ourcommunity;and

WHEREAS, in theUnitedStates,thenumberofdrunkdriving deathshasbeencutin halfsinceMADE) wasformedin 1980;and

NOW THEREFORELET IT BE RESOLVED,thaton this25th anniversaryoftheirdeaths,werememberandcelebratethe livesofKevin Adams,NatishaL. Goins,ToushawaNicholeDavis,ChristopherLynn McGee,and RalphRiekerJr.,andwerecognizeMothersAgainstDrunk Driving for theirtirelessefforts in improvingthesafetyof ourcommunity.

WHEREAS, the Circuit Court has applied for a grant to design and install a video arraignmentsystem to help alleviate the OT incurred to transports, search, and monitor the inmatesawaiting arraignment each day and;

WHEREAS, the estimated cost of the project is $15,715 and contains a 10% matching provisionfrom the recipient and;

WHEREAS, this project has been determined to be in the best interest of the citizens of GreeneCounty and supported by the Sessions Court Judge, Circuit Court Clerk, and Supervisor ofCourtroom Security and.

NOW, THEREFORE; be it resolved by the Greene County Legislative Body meeting in regularsession this

Section I — The purpose of this grant is to improve courtroom security and to “provide safe and securefacilities” to “conduct the business and duties of the court.” Tenn. Code Ann. 16-2-505(d)(1) — (2).Monetary award preference will be given to counties with courtrooms that do not currently meet thepresent minimum courtroom security standards and/or counties that have experienced a courtroomsecurity breach during the 24-month period of July 1,2016—June 30, 2018. The present minimum courtsecurity standards adopted by the Tennessee Judicial Conference are listed below. This is areimbursement grant that will be paid upon approval by the AOC and purchased by the county. All grantsrequire a 10 percent match. Please include a specific cost amount for each item requested.

MINIMUM COURTROOM SECURITY STANDARDS INCLUDE:

(1) Silent bench and court clerk’s public transaction counter panic button connected directly to the

sheriff’s departmentor police department.

(2) A bullet-proof bench and court clerk work area incourtrooms.

(3) Availability of armed, uniformed guard (court officer) in each courtroom during court sessions.

(4) Court security training for court officers. Court security briefing on annual basis for judicial staff

and courthouse personnel.

(5) Hand-held detectors (minimum of 2) and/or magnetometers in each county to assure the safety

in each courthouse or courtroom.

(6) Each court building shall have signage posted at each court access entrance stating that allpersons are subject to search by security personnel. Prohibited items are subject to seizure andforfeiture. Prohibited items include, but are not limited to, the following: firearms; other formsof weaponry; and any item(s) that can be transformed into a weapon.

(7) Hand held inspection security mirror to be used to view under courtroom seating and otherareas for safety in the courthouse and/or courtroom(s).

SectionIl — Prioritize the security needs for your courtroom(s). List items you would like purchased for

your courtroom(s), including but not limited to: silent bench panic button with connectivity directly to

local law enforcement, bullet-proof bench, hand-held metal detectors, walk-through magnetometers, x-ray machines, video arraignment equipment, or other security needs. Please provide a cost estimate for

each item requested. If you have a detailed estimate, please attach it to the grant application.

Section III — Please provide a brief summary of your request and how it will improve security in yourcourthouse. Please note whether your county presently meets the minimum courtroom security

standards. Please include any other helpful information.

At the present time our county meets the minimum court room security standards. With that being

said, there is still much we need to accomplish that would make our court house and court rooms a

safer place for everyone. In Greene County Sessions Court, we usually average between 25 and 35inmates on any given Monday, Wednesday, or Friday for arraignment. A video arraignment system

would greatly improve the safety of court personnel and patrons to the court house. Our courtroom is

laidout in a manner that puts inmates in close proximity to the public. Also, with such a heavy docket,court runs past the normal business hour closing time of 4:30, which requires overtime pay for

employees. With the number of inmates being transferred to and from court, it puts a burden on jailadministration and court security officers to find the personnel to manage that many inmates at once.

At any time during transport, there are two guards for up to twenty inmates. During court, there are

only two guards managing up to forty inmates during arraignments. Avideo arraignment system would

greatly reduce the number of inmates coming up to court and would allow for faster docketmanagement by our Judges, and reduce the inmate to guard ratio duringtransport.

Another situation we are starting to experience more and more are inmates in wheelchairs or on

crutches. At the present time, our only solution to this is pushing the inmate up a steep hill,

approximately 80 yards to the courthouse, then back down after court. There are steps to navigate inthe courthouse, and having to take the inmate outside up the hill is the only option. Obviously, theweather conditions outside do not matter, inmates must be arraigned. A video arraignment system

would be the obvious solution to this problem. Having an inmate outside at any time is a securityconcern. Especially in the arraignment phase of their situation. This also poses the problem of having

to pull at least two guards off their normal duties to transport the inmate to court and back.

Section VIII — Please provide any detailed examples or occurrences of security issues your countycourtroom(s) has experienced.

There have been occasions where a member of the public has passed contraband to an inmate. Itemssuch as drugs, cell phones, cigarettes, notes, and drug paraphernalia. These are just some of the typesof items that have been Intercepted. Surely there have been times that things were passed that werenot seen. Ourcourt room officers are diligent in their job to keep everyone safe andstop inmate/publicinteraction, but theycannot see everything. Especially whenthere are 30 plus inmates to control. Videoarraignment equipment would be beneficial in that the number of inmates coming up to court wouldbe greatly reduced, and the court officers would have fewer people to manage.

Section IV — Please provide a brief summary concerning how your county will provide the 10% match. In-

kind matches may also be considered. The 10% match will come from our County Government by way

of a resolution before thecommission. Alternately, thereare monies in a Court Security restricted fund

that the Sheriff has agreed to let us draw from if needed.

Section V - If your county has established a court security fund pursuant to Tenn. Code Ann. 67-4-601(b),please provide the current balance. $_12,000___________________ If your county has not established

COMMISSIONERS

WHEREAS, the Greene County Board of Commissioners has from time to time in the

past adopted certain rules of procedure to enable the Commissioners to conduct its business in

a more efficient and professional manner; and

WHEREAS, in order to address procedural issues and to publish rules of procedure for

the benefit of the members of the Greene County Board of Commissioners and the general

public it appears that it is necessary and proper for the Greene County Board of Commissioners

to formally adopt rules of procedure detailing the rights and responsibilities as well as the

process upon which members of the Commission, County Elected and Appointed Officials and

others who assist the County Commission should act and perform; and

BE IT FURTHER RESOLVED, if any of the Rules of Procedure are in conflict with state law or later

determined to be in conflict with state law then all remaining provisions of the rules and

procedures shall continue to be in full force and effect unless amended by the Commission.

GREENE COUNTY BOARD OF COMMISSIONERS

TheGreeneCountyBoardof Commissioners,hereafterreferredto asthe “Board,” shallmeetonthethird Mondayof eachmonthat the GreeneCounty Courthousein Greeneville,Tennessee,at6:00 p.m. in the monthsof January,March, May, July, SeptemberandNovemberand at 10:00a.m. in the monthsof February,April, June,August, October and December. 5A. WHO MAYADDRESSTHE BOARD: It is a commissioner’sright to addresstheChairmanand the Board at any appropriatetime after proper recognitionby the Chainnan. Non-commissionmembersmay addressthe Board by beingplaced on the agendaor by beingrecognizedby a memberat theappropriatetime. TheChairmanshall seta limit on thetimenon-commissionmembersmay beallowedto speak. Non-commissionmembersshall firststatetheir name,addressand issuethey will be discussingprior to their remarks. TheChairmanhasthe authorityto revoketheremainingtime ofa non-commissionmemberformakingderogatoryremarksofa personalnature,using foul/offensive languageor any otherbehaviordeemedinappropriate.

5B. GAINING THE FLOOR: In all cases,the commissionmemberwho shall first requesttospeakby using their keypadshall be entitled to speakfirst after being recognizedby theChairman. If the Board ceasesthe useof keypads,the Chairman shall determinetheappropriatemethodof gainingthe floor.

5C. SPEAKING: After gaining the floor for purposesof speakingin debate,discussionor todeliver any addresson any matterwhatsoeverto theBoard, thecommissionmembershallrise and respectfiulyaddressthe Chairmanand shall proceedwith the intendedremarks,confiningsuchremarksstrictly to thequestionunderdebateand avoidingall personalities.

RULE 8- ELECTIONS AND APPOINTMENTS

8A. ELECTIONSAND NOMINATIONSFROM THE FLOOR: When the Chairman is toreceivenominationsfrom thefloor, a commissionmembermaynominateonly oneperson.The floor will be kept open until every commissionmemberhas had an opportunity tomakenomninationsor until a mnotion hasbeenmadeand secondedthat nominationsceaseand a two-thirds majority of the Board, excluding vacancies,so vote. T.C.A. 5-S-Illprovidesadditionalguidanceon this issue.

SB. APPOINTMENTSAND CONFIRMATiONS: When the Board is called upon to appointsomeonefrom a list of nominees(suchas a vacantseaton the Board) or to confirm anappointeeof the County Mayor (suchasa departmenthead)then the nameor namesofthose being considetedfor the positionshall be readto the commissionmembershipanddiscussionofeachsuchappointeeshall follow.

SC. ELECTIONOR CONFIRMATION: All ballots for electionshall be castby voice voteasthe Clerk calls eachcommissionmember’sname. If the vote is on confirmationof anappointee,eachcommissionmemberwill vote either “yes” or “no” on the confirmation.Ballots on confirmations may be cast using either a manual roll call or an authorized

electronic voting systemthat utilizes the roll call method and records the vote of eachmember. A majority of the commission membershipof the full Board, excludingvacancies,is requiredfor electionor confinnation.

SD. SECONDBALLOT: If no one is electedon a given ballot, the nominee receiving thesmallestnumberof voteswill be dropped,andthevote will be takenagainuntil a nomineeis elected by the required majority of the comnmissionmembership. If two or mnorenomineestie for the smallestnumberof votes,a vote must be takenon the nomineesthattied for thesmallestnumberof votes. Thenomineewith the leastnumberof votes in thisroundof votingwill beeliminated,and theothernominee(s)will proceedto the next roundofvoting. (Examnple: Thereare21 commissionmembers. NomineeA receives9 votes.NomnineeB receives4 votes. NomineeC receives4 votes. NomineeD receives4 votes.No nomineereceiveda majortyof the21 mnemberBoard,excludingvacancies,and threenomineestied for thesmallestnumberofvotes. Therefore,commissionmembersmustvotebetweenNomineeB, NomineeC andNomineeD. Thenomineewith thesmallestnumberof votes in this round will be eliminated. RULE 9- COMMITTEE MEMBERSHIP -

According to TennesseeCode Annotated,the authority to appoint committee mnembers isdelegatedto the County Mayor, unlessprovidedotherwiseby a higherauthority. T.C.A. 5-6-1O6(c~states,“Exceptasotherwiseprovidedby generallaw, or specialorprivate act,thecountymayorshallappoint inemnbersof county boardsand commissionsand countydepartmnentheads.Suchappointeesshall be subjectto confirmationby thecountylegislativebody, andin so doing,the legislative body may express its views fully and freely and shall vote for or againstconfirmation. Thelegislativebody shallnot seekor interview suchprospectiveemployeespriorto theirappointmentby thecountymayor.Such appointmentand confirmationarenot applicableto eniployeesappointedby otherelectedcountyofficials.”

RULE 10- APPROPRIATION REQUESTS

REQUESTSFORAPPROPRIATION:Requestsfor appropriationsin additionto thosewithin theannualbudgetshallbe submittedin thefollowing manner.

1 OA. The requestshall be submitted in writing to the appropriatecomnmitteeof the Board andshall reflect theestimatedcost, which shall be attachedto theproposedresolution.

lOB. All requestsfor appropriationsfalling in this areashall be sunmmarizedand submnitted inwriting to eachcommissionmemberof the Board at leastten daysprior to theregularorcalledmeetingsuchrequestis to be submitted

RULE 11- SUSPENDINGTHE-RULES

Any rule orrulesmay be suspendedby a two-thirdsmajorityvoteof theentireBoard, excludingvacancies.

RULE 12- ROBERT’S RULES OF ORDER

All matters not covered herein shall be governed by Robert’s Rules of Order Revised,ascontainedin the latestcopyrightededition.

RULE 13 - THE CHAIRMAN

13A. ELECTION: Annually, at its Septemberregular meeting, the Board shall elect aChairmanandaChairmanProTempore.The Chairmanmaybeoneof themembershipoftheBoard or the County Mayor. If the Board electsas its Chainnanthe County Mayorand he/sheacceptsthe position, then the County Mayor shall relinquish his/her vetopower. A commissionmemberwho is a candidatefor eitheroftheseofficesshallnotvotein theelectionin which they area candidate. A commissionmembermayvote if he/shehasbeen eliminatedin a prior roundofvoting. Proceduresfor electingtheChairmanandChairmanProTemnporeshallfollow RuleS.

l3B. VOTING BY THE ~JHAIRMA1V:The CountyMayorChainnanmay voteonly in thecaseofa tie. A commissionmemberChairmanmayvoteon all issuescoining beforethebody,just asany othercommissionmember. However,a commissionmnemnberchairmanshallnot be allowedto votea secondtime to breaka tie. Although a CountyMayorChairmanmay vote to breaka tie, it doesnot negatethefact that amajority oftheentiremembershipof the Board, excluding vacancies,is still necessaryto passany item that would haverequireda majority without the vote of the County Mayor Chairman. (Example: TheBoard is composedof 21 members,and no vacanciesexist. Threemembersare absent,and a vote is taken on a resolution. The outcomeis 9 yesvotes and 9 no votes. The

CountyMayor Chairmanmay vote to breakthe tie;,however,it will haveno effect sinceamajority voteofthe21 memberBoardrequiresa minimum of II votes.)

13C. GALL TO ORDER: The Board shall be called to orderby the Chairman. In the absenceof the chairman, the Chairman Pro Tempore shall preside. In the absenceof theChairmanPro Tempore,theBoardshall be called to orderby theCounty Clerk, amid shallelectoneof its commissionmembersto presideover thedeliberations.

13D. SPEAKiNG: Should theChairmandesireto speakupon anysubjecteitherin thenegativeor theaffirmative, he/shemay do so,provided he/shevacatesthe chair. WhereupontheChairman Pro Teinpore shall preside until the Board disposesof the matter underconsideration.However, the Chairmanmay answerquestions,provide infommation, andgive explanationsfrom thechair,theBoardnot objecting.

13E. PRESERVEORDER: - The Chairmanshall preserveorder and decorum. He/shemayspeakto points of orderin preferenceto othermemnbers,rising from his/herseatfor thatpurpose.TheChairmanshall decidequestionsoforder, subjectto an appealto theBoardofanycommissionmember.

13F. ORDEROFRECOGNITJON.~Beforea commissionmemberis allowedto speaktwice onthesamesubjectthe Chairmanshall inquire if thereis anothercommissionmemberwhohasnotspokenon that subjectand who wishesto speak. Ayt authorizedelectronicvotingsystemwith a feature that lists commissionmembers,in speakingorder, shall meet therequirementsof this section.

130. MOTIONS: Once a motion hasbeenmadeand duly seconded,the Chairmanshall statethemotionsO that debateon themotion mnaybegin.

131-I. GLARIEIcATION.~The Chairmanshall rise to stateor put a questionand shall clearlystate the questiomi before the Board before the vote on the question is takemi. Acommissionmemnbermay askfor clarification of the questionup until the resultof thevoteis annoimnced. -

131. AGENDA: The Chairmanshall forward to eachcommissionmneinberof the Board thetentativeagendaof thenextBoardmeetingnot lessthantendaysprior to meetingdate.

RULE 14- TIlE CLERK

14A. NOTIGE: The Clerk shall notifr eachcommissionmnemberof theBoardofany specialorcalled meetingsnot less than five days in advance thereof. Notification of regularmneetingsshallbe within thediscretionof theClerk andtheChaimman.

l4B. MINUTES: The Clerk shall reducethe minutes of eachBoard meetingto ‘writing andattach a copy of eachresolutionconsideredand the vote thereon. The minutesshall bepreparedwithin five daysafter said meetingand placed in a well-bound book for public

inspectiomi. A copy of the minutes of the last meetingshall be forwardedto eachBoardmemberwith thepreparedagendaor mneetingnotice.

14C. RESOLUTIONS:A copy of all resolutionsapprovedby the Board shall be submittedtothe County Mayor, within five daysafter suchapproval,for his/her considerationandsignature.

14D. ROLL GALL: In all instancesinvolving authorizationto expendpublic funds, the Clerkshall call theroll for “yes” and“no” votes. Theroll call maybeperformedmanuallyor byusingan authorizedelectronicvoting systemthat utilizes theroll call methodand recordsthe vote of eachcommissionmember. In all instanceswhere the roll is called for anyvote, theClerk shall makesuchroll call and the vote ofeachcomnmissionmembera partoftherecordofthe meetingandinclude it in theofficial minutes.

I 4E. cHANGE OF VOTE: Any commissionmembermnay changehis/her vote before theresultsof avote are “madeknown.” Resultsofa voteare“made known” whentheresultsare visually displayed,announcedby the Clerk or manifestedby meansof any officialmnethod. It shall be the duty of the Clerk, at theend ofeachroll call, whetherperformedmanually or electronically, to inquire of thosewho passedor were absemitwhenthe rollwascalled if they desireto vote; also, if anyonewho hasvoted wishesto changehis/hervotebeforetheresultsare “madeknown.” Then, theClerk shall announcetheresults.

RULE 15— SHERIFF -

The Sheriff or a designateddeputy shall attendeachsessionof the Board. That officer shallpreserveorder and carry out ordersof the presidingofficer of theBoard. Theattendingofficershall be paid for theseservices,unless suchofficer is performing this duty during regularworkinghours,paid by thecounty,and is not workingovertime.

RULE 16- COUNTY ATTORNEY

TheCountyAttorneyshall, as legal consultant,attendall meetingsof theBoard. It shall be thedtmty of the County Attorney to voice his/hernegativeopinion when, in his/heropinion, theBoard is in the processof taking action outsideof its jurisdiction, or in any mannerproceedingillegally, and to give his/herlegal opinion on any subjectwheresuchguidanceis requestedbytheChairmanor anycommissionmemberof theBoard.

RULE 17- COMMITTEES

l7A. All comnmittees,standingand temporary,shall meet and elect from their membershipaChainnanand Vice~Chairrnan.The election of a Secretaryshall be optional in theabsemiceofa specific mandateoftheBoard.

l7B. Standingcommitteeclmairnienshall reportto and conferwith theChairmanon all pertinentmattersto be presentedat thenextmneetingoftheBoard.

17C. All committeechairmen shall contact the County Attorney on matters appearingtowarrantlegal evaluationprior to presentationto theBoard.

liD. Should questionsarise as to jurisdiction of any committee it shall be referred to the- Chairmanand/orto tlìe County Attorney for determination,subjectto an appeal to the

Boardat its nextregularmeeting.

17E. Thefollowing procedureshall be followed pertinentto committeereportsandrelatedaction: -

2. Uponcompletionof a reportthespeakershallyield to questions.

lip. If for any reasonthe chairmanof a committee fails or refusesto call a meeting, theChairmanof theBoard,or a majorityofthecoimnitteememnbershipmaydo so.

RULE 18- CONFLICT WITH LAW

In theeventany of theforegoingrulesaredeterminedto be in conflict with statutoryprovisions,thenthat partin conflict shallbe null andvoid.

RULE 19- AMENI~MENTOF RULES

Theserules may be altered,amended,or repealedand newrules may be adoptedby the Boardonly alter the suggestedchangeor modification is presentedin writing to a regularmeetingoftheBoardfor considerationat a regularlyscheduledmeetingof theBoard, at which time it shallbe voted upon and a two-thirds mnajority of commissionmembers,excluding vacancies,isrequiredfor approvalof suchchangeor modification. Nothing hereinshall be construedto inany way affect the right of theBoard in sessionto suspendthe rulesupona two-thirdsvoteof theentirecommissionmembership,excludingvacancies.

RESOLUTION TO AMEND THE RULES OF PROCEDURE FOR THE BOARD OF COUNTYCOMMISSIONERS THAT WAS PREVIOUSLY ADOPTED ON SEPTEMBER 19, 2011

WHEREAS, the Greene County Board of Commissioners adopted certain Rules of

Procedure on September 19, 2011, to enable the Board (Commission) to conduct its business

in a more efficient and professional manner; detailing the rights and responsibilities as well as

the process upon which members of the Commission, County Elected and Appointed Officials

and others who assist the County Commission should actand perform.

WHEREAS, in order to clarify certain procedural issues, Rule 17— Committeesneeds to

be amended by adding Rule 176. as follows:

7G. For committees, a quorum for the transaction of business shall be a majority of thecommittee members. The Chairman or committee member acting as Chairman shall havethe same rights as other committee members, including the right to vote; however, theChairman or committee member acting as Chairman may not vote twice in order to breaka tie vote. Rule 8—Elections and Appointments shall be followed during this process. Amajority of the committee members voting shall be necessary to pass motions, electofficers, etc. Committee members who abstain or “pass” shall not be counted as votingfor determining a majority vote.; and

WHEREAS, it would appear that the efficiency and effectiveness of the Board of

Call to Order:Mayor Crum called meeting to order at 8:34 am in the conference room at the Greene County Annex.

Minutes:Motion was made by Commissioner Waddle to approve minutes from the July 24, 2018 meeting and wasseconded by Commissioner Peters. Motion was then approved with no opposition.

Reports:Danny presented the July 2018 financials for Funds 121 and 264. Motion to approve the reports was madeby Commissioner Tucker and was seconded by Commissioner Waddle. Motion was then approved with noopposition.

Discussion:Mayor Crum commended the Insurance Committee on working hard this past four years with no increase inpremiums.Contract to be signed this week on the transfer of the EMS building and sleep center building at Takoma tothe county.Under workman compensation employees are required to file a claim within 14 days but there areexceptions, that can file up to a year for injury or illness. Erin and Roger will be getting monthly reports onclaims.Johns Mclnturff informed the committee of the cyber policy renewals for the BOE $5,315 to 5,323 and thecounty $4,615 to 4,621 both with one million aggregate and $10,000 retention each.Chris Poynter informed the committee that Ballad Health has to continue contracts with insurance carriers.Patti Roberts informed the committee that Industrial Care will remain open and Occupational Medicine willbe moving back to the Takoma building. Clinic saw 272 patients in the month of July. Staff has been trained

and certified on flu testing. Heather has been in continuing education Ted Fox, Marsha Montemarano andDaniel Lewis has been filling in.Motion was made by Roger Woolsey and was seconded by Commissioner Peters to allow Elected Officialsthat are not returning to office to be able to stay on the health insurance for six months, with the countypaying half of the single rate as they do with retirees with thirty years of service and not age 65. Motion wasapproved with no opposition.

Meeting broke to go into Closed Session.Reconvened for claims.

WINDOWS. HE ALSO SUGGESTED SPRAY PAINTING PARKING SPOTS AT ADM BUILDING AND SOME TYPE

OF CLOSURE FOR BRIDGE AND OLD ACCESS ROAD. WHITEHEAD ADVISED THAT TWRA FALL HUNTING

The Chairman called the meeting to order, and asked if members had received the draft minutes of the June12, 2018 meeting. A motion was made by Edwin Remine, seconded by Frank Waddell, to approve theminutes as written. The motion carried unanimously.

Renlat HoweII/Baehr Property. Robert Howell represented the proposal. The Planning Commissionconsidered a request to grant preliminary and final approval to the Replat Howell/Baehr PropertySubdivision for two lots containing 1.46 acres, located adjacent to Horse Creek Park Road in the ~ civildistrict. The proposal of the division of lots 1R and 1R was to be provide enough area for lot 1R for fieldlines and duplication area. Staff reported that all applicable signatures had been obtained. Staff informedthe commission that the certificate of completion for the existing septic systems for lot 1R and 2R had beenlocated in the TDEC office. A motion was made by Phillip Ottinger, seconded by Frank Waddell, to grantpreliminary and final approval to the plat for reasons stated. The motion carried unanimously.

Administrative Minor Subdivision Plats. Staff informed the Planning Commission that the followingplats had received administrative approval:

• Branfor Inc and Frank Holzschuh etux, 1 lot of 0.78 acres, located adjacent to Arnold Palmer Drive(Private Street) in the 9th civil district.

• Doris Bowman, 1 lot of 0.75 acre, located adjacent to Kingsport Highway in the 20th civil district.• Replat of Corby 5.96 acres, located adjacent to Clear Springs Road in the 15th civil district.

A motion was made by Phillip Ottinger, seconded by Edwin Remine, to accept the list. The motion tarriedunanimously.

Monthly Activity Report for the Building and Zoning Office. The Planning Commission received copiesof the monthly activity report for Greene County Building/Planning/Zoning. A motion was made by GwenLilley, seconded by Phillip Ottinger, to accept the monthly report. The motion carried unanimously.

OtherBusiness.Education- New Developments - USPS Mail Delivery Service.Staff presented and discussed the Developers Guide and how new addresses have a major impact on ourmail delivery network. Staff stated that we need to get the word out to ensure that developers are informedthat new developments mode of delivery will be centralized delivery.

There being no further business a motion was made by Edwin Remine, seconded by Prank Waddell, toadjourn the meeting. The motion passed unanimously. The meeting adjourned at 2:15 p.m.

The Chairman called the meeting to order, and asked ifmembers had received the draft minutes of the May8, 2018 meeting. A motion was made by Edwin Remine, seconded by Frank Waddell, to approve theminutes as written. The motion carried unanimously.

Alfred Franklin Replat. Michael Grigsby represented the proposal. The Planning Commission considereda request to grant preliminary and final approval to the Alfred Franklin Replat Subdivision for three lotscontaining 1.35 acres, located adjacent to Retriever Lane in the 23’~”civil district. The proposal of thedivision of lots 3R and 1R was to be combined with adjoining property. Staff reported that lot 2R was abuildable lot and that all applicable signatures had been obtained. A motion was made by Gary Rector,seconded by Edwin Remine, to grant preliminary and final approval to the plat for reasons stated. Themotion carried unanimously.

Faye lohnson. Tony Bowman represented the proposal. The Planning Commission considered a requestto grant preliminary and final approval to the Faye Johnson Subdivision for one lot containing 0.94 acre,located adjacent to North Water Fork Road in the 22~civil district The proposal was to divide 0.94 acrefrom a 21 acre parcel. The remainder of the property was over five acres and met the required public streetroad frontage requirements of the applicable zoning regulations. Staff informed the commission that allapplicable signatures had been obtained. A motion was made by Phillip Ottinger, seconded by Gary Rector,to grant preliminary and final approval to the plat for reasons stated. The motion carried unanimously

Robert and Donna Carpenter Pronerty IPermanent Easement). Daniel Coffey represensed theproposal. The Planning Commission considered a request to approve a performance bond and finalapproval for a permanent easement (private street) to be constructed on the Robert and Donna CarpenterProperty (tax map 070, parcel 050.01), located off Forrest View Lane in the 6th civil district. Staff reportedthat they had met with the Engineer Daniel Coffey at his office on June 8, 2018. Staff discussed with Mr.Coffey that the following items were still needed on the permanent easement. Staff requestedconstructions plans, contours, street grade, and temporary turnaround, Engineer certification of street,property owner’s association agreement and maintenance agreement for the permanent easement,drainage certification, utilities, security of performance bond and 911. Mr. Coffey submitted at the meetinga permanent easement to Robert and Donna Carpenter Property. The plan showed the typical street

section, proposed temporary turnaround, contours, street grade, and letter from the highway departmentrecommending the bond to be set at $7500.00 for construction of the permanent easement. Contours wassatisfied by the crowning of the street directing water to the ditch line. Mr. Coffey reported that the utilitieshad already been installed to the end of the street and the developer was installing water utilities into theproperty. Staffaddressed the Commission regarding the issuance of a building permit to start construction.It was suggested that only one building permit be issued until the road is completed. The commissionunanimously agreed for reasons stated. Staff informed the commission that in the past a 12 month bondwould sometimes lapsed due to the construction of the road not being completed. Therefore, it wassuggested to grant a variance to extend the bond to 18 months. The Planning Commission was advisedthat they could extend the time if they found that the public interest would not be adversely affected bysuch extension. The commission unanimously agreed for reasons stated. Director of 911, Jerry Bird wascontacted by phone in regards to the name of the street. Mr. Bird requested if the street name could be thesame. Staff discussed with the commission that if the street name was the sam~.that the developer wouldneed to install an end of county maintenance sign and a private street sign with the road name ForrestView Lane (Private Street). The commission unanimously agreed for reasons stated. A motion was madeby Gwen Lilley, seconded by Phillip Ottinger, to approve the performance bond of $7,500.00 and finalapproval for the permanent easement subject to the engineer certifying the street and drainage, a propertyowner’s association agreement and maintenance agreement for the permanent easement being recordedin the office of Register Deeds and a variance to extend the bond to 18 months. The commissionunanimously agreed for all reasons stated.

Administrative Minor Subdivision Plats. Staff informed the Planning Commission that the followingplats had received administrative approval:

• Jack Southerland, 1 lot of 4.50 acres being added to map 088, parcel 048.00, located on Six OaksLane in the 14th civil district.

• Cooter and Weems, 1 lot of 0.07 acre being added to map 044, parcel 010.00, located on OldBaileyton Road in the 21st civil district.

• Matt Smith, 1 lot of 1.80 acres, located adjacent to Poplar Springs Road in the 3rd civil district.• Shipley Property, 1 lot of 1.38 acres, located adjacent to Tunnell Road in the 23~~dcivil district.• Proposed Brian Neas Property, 1 lot of 2.50 acres, located adjacent to West Aliens Bridge Road in

the 3rd civil district.• Replat of lots 15 and 16 of Brackens Property, 1 lot of 1.30 acres, located adjacent to Brown

Springs Road in the 23rd civil district.

• Replat of lotS of the O.K. Southerland Subdivision, 1 lot of 2.06 acres being added to map 028,parcel 067.02, located on Sugar Bowl Road in the 16th civil district.

A motion was made by Gary Rector, seconded by Edwin Remine, to accept the list. The motion carriedunanimously.

Monthly Activity Report for the Building and Zoning Office. The Planning Commission received copiesof the monthly activity report for Greene County Building/Planning/Zoning. A motion was made by GaryRector, seconded by Edwin Remine, to accept the monthly report. The motion carried unanimously.

Other Business.Larry Caner discussion:

Larry Carter at 6550 Whitehouse Road addressed the commission regarding the approval of thecampground, Just Jump Inc. at the airport. Mr. Carter stated in his opinion, that the commission made amistake by changing the requirements of combining the acres across the road. Mr. Carter stated that theowners should have known what the rules were before the decided on a business of this nature. Mr. Carterinformed the commission that a road is a natural barrier between properties. Mr. Carter posed a questionto the commission on whether or not they would allow residential use to join property across the road. Mr.Carter inforthed the commission that the septic tank should have been looked at. Building Official, TimTweed spoke and stated that TDEC had approved the lots for septic. Mr. Tweed spoke that the septic, waterand site plan had been previously approved by the commission. Mr. Tweed spoke that the platof propertyhad went before the Town of Greeneville Planning Commission due to the subject property being in theTown’s planning region. Mr. Tweed stated that the plat had been approved and recorded. PlanningCommission member, Gwen Lilleyspoke and questioned Mr. Carter on why he didn’t come to the previousmeetings when the campground of Just Jump Inc. was discussed. Mr. Carter re~liedthat he didn’t knowabout it. Mr. Carter stated that he had 33 acres that was close to the campground. Mr. Carter implied thatthe Planning Commission was doing favors. Mr. Tweed spoke that when the campground zoning violationwas spotted that his department give the owners 10 days to move the campers off the property until thezoning requirements were met. Mr. Tweed spoke that the owner’s complied with his request. Gwen Lilleyspoke that Greene belt thru the Assessor of Property Office allows combination of land that crosses a road.Mr. Carter spoke of Greene County allowing a lease of land to allow a land field and look how that turnedout. Mr. Carter spoke of enforcement needed on Babbs Mill Road and Whitehouse Road where no trucksare permitted. Mr. Carter’s last words were that the commission should not allow owners to join propertyacross the road.

The Planning Commission considered a request to grant preliminary and finalapproval to the Faye Johnson Subdivision for one lot containing 0.94 acre, located adjacent to North WaterFork Road in the 22nd civil district. Doris Bowman Property Subdivision. The Planning Commission considered a request to grantpreliminaryand final approval to the Doris Bowman Property Subdivision for one lot containing 0.75 acre,located adjacent to Kingsport Highway in the 20th civil district. Staff stated that the fee had not been paid,and the plat had not been received prior to the meeting, as required by policy. A motion was made byEdwin Remine, seconded by Lyle Parton, to deny approval, as the plat had not been submitted as requiredand the fee had not been paid. The motion carried unanimously

Frank Fillers Estate Subdivision. The Planning Commission considered a request to grant preliminaryand final approval to the Frank Fillers Estate Subdivision for eleven lots containing 22.58 acres, locatedadjacent to Pigeon Creek Road in the 25th civil district. Staff stated that on December 12, 2017, the PlanningCommission denied approval for a proposal to subdivide this property into two lots. Following this.action,the Greene County Chancery Court heard a dispute between the heirs as to how the property should bedivided. The Count determined that Walnut Grove Auction and Realty and Azimuth Engineering woulddivide the property to maximize profit. Staff stated that the plat had all signatures, except the propertyowners block had been signed by Larry Jones, auctioneer, and not the heirs. Staff recommended approvalof the plat, subject to addition of property owner signatures. Roger Woolsey stated that the PlanningCommission could request that an order be made by the court to permit Larry Jones to sign as propertyowner.

A motion was made by Lyle Parton, seconded by Kristin Girton, to grant approval as requested. The motioncarried unanimously.

Robert and Donna Carpenter Property. The Planning Commission considered a request to approve a

proposal for a permanent easement (private street) to be constructed on the Robert and Donna CarpenterProperty (tax map 070, parcel 050.01), located off Forrest View Lane in the 6th civil district. Staff statedthe proposal would create a 150 foot long permanent easement extending Forest View Lane, ending in a“T” turn-around. Staff stated that permanent easements were permitted under the Greene CountySubdivisionRegulationsprovided they met certain requirements, such as being built to public streetstandards, having a minimum easement width of 40 feet, and creation of a property owners’ agreement formaintenance. The Planning Commission was informed that the required pavement width of permanenteasements depended upon the number of units/lots or the length of the proposed private street. Theycould be no longer than 600 feet; have no more than 15 dwelling units/lots, and could be constructed to areduced pavement width of 20 feet. Streets not meeting this standard were required to have a minimum24’ pavement width. Staff provided a history of the original Forest View Development. Phase I wasapproved in 2004, and Phase 2 in 2007, for a street length exceeding 600 feet in length (approximately1,345 feet built and accepted as a county road). The approvals were for a total of 14 lots, with “temporary”turn-around’s that indicated the Commission’s tacit agreement that the road would be extended to serveadditional lots in the future. Forest View Lane was approved for a 20 foot width, all that was required forthe phased development approved at these times, but that did not meet the requirements for a street longerthan 600 feet, or serving more than 15 units. Staffstated that any additional development of more than 15dwelling units/lots would require the Planning Commission to grant a variance request to continue thestreet at a 20 foot width. A motion was made by Kristin Girtin, seconded by Lyle Parton, to approve thepermanent easement, as it would permit development of a 69 acre tract for more than one residence, andGreene County would not be responsible for maintenance to or improvement of the permanent easement(private street). The motion carried unanimously.

Just lump TN LLC Camuground Site Plan. The Planning Commission considered a request to approvethe Just Jump TN LLC Campground site plan, for a site located adjacent to Whitehouse Road and Old WilsonHill Road (tax map 075, parcels 055.00, 055.01 and part of 049.00). Staff stated the GreeneCountyZoningResolutionpermitted campgrounds in the A-i General Agriculture District, provided they contained at leastfive (5) acres, the Planning Commission approved a site plan for the project, and buffers were provided alongexterior lot lines. Section 601.1 Ii of the Resolution provided additional requirements. Staff stated thePlanning Commission had previously determined that the acreage of entire site, which was fragmented andseparated by Whitehouse Road and Old Wilson Hill Road, could be combined to meet the five acre sizerequirements. For this reason the parcels could not be sold separately once the campground wasdeveloped. Staff recommend granting concept approval to the site plan. Roger Woolsey, Greene CountyAttorney, recommended that the site plan be recorded with the deed. A motion was made by Lyle Parton,seconded by Frank Waddell, to grant concept approval to the site plan, with the understanding that taxparcels 075-055.00, 075-055.01 and the portion of 075-049.00 shown on the site plan, were con,sideredone tract for the purposes of development of the campground, the property owners had requested that theparcels be considered as one tract in order to get approval for the campground, and any proposal to dividethe ‘tract” must be submitted to and approved by the Planning Commission. The motion carriedunanimously.

Administrative Minor Subdivision Plats. Staff informed the Planning Commission that the followingplats had received administrative approval:

• Tipton and Bitner, for 2 lots containing 0.58 acre being added to existing parcels, map 45, parcels71.00 and 072.00, map 055, parcel 050.03, located on Maupin Road and Snapps Ferry Road in the20th civil district.

• Replatofthe Hensley Air Park, PUD Phase 2A, Lots land 2 for Legrande Boyer, for 2 lots containing2.74 acres, located adjacent to Steven Drive (private) in the Pt civil district.

• Combination plat of the Bowman Property Lots 1-2, fort lot containing 1.27 acres, located adjacentto Quaker Knob Road in the 14t~1civil district.

• Survey of a portion of tracts 4 and 5 of the Greene Farm, for 1 lots containing 1.53 acres, locatedadjacent to Lauderdale Road in the 25th civil district.

• Corby 5.96 acre property partition, for 2 lots containing 5.96 acres, lot 2 being added to map 057,parcel 023.01, located on Clear Springs Road in the 15t~~civil district.

40 Six Oaks Lane/Highway liE Rezoning Request. The Planning Commission considered a request torezone 40 Six Oaks Lane (tax parcels 088-D-C-005.00, 006.00, and 007.00), located at the intersection ofSix Oaks Lane and Highway liE, from R-1, Low Density Residential District, to B-3, Arterial Business

District, to permit construction of a restaurant. The property owner, Mr. Anthony Marrone, stated that theproperty was: located on the bypass; surrounded by businesses; conductive to some kind of commercialuse; would create a small number of jobs; and would add to the tax base. If approved, the existing housewould be removed and replaced with a retail or restaurant use. Tim Tweed, Building Commissioner,informed the Commission that alcohol couldn’t be served, as the property was located within 2000 feet ofa church. Also, buffer strips would be required, and access could not be provided from Spring View Drive,which fronted the property to the rear. After discussion, a motion was made by Gwen Lilley, seconded byKristin Girton, to recommend approval based upon the surrounding commercial and industrial zoning, andthe ability of area to support the proposed commercial use. The motion carried unanimously.

606 ldell Road Rezoning Reouest. The Planning Commission considered a request to rezone 606 IdellRoad (tax parcel 070—015.02), located at 606 Idell Road, and owned by Chasta Hamilton from M-i,Industrial District, to A-i, General Agricultural District. Cheryl Bueck, who represented the propertyowner, stated the property had been zoned to M-1 several years ago when an industrial use was proposedto be located on the property. The use never materialized, and while there had been no newmanufacturing/industrial interest in the property, someone was interested in purchasing the property forresidential use, using the existing residence. A motion was made by Lyle Parton, seconded by EdwinRemine, to recommend approval of the request. The motion carried unanimously.

Vonda Robinette Pronerty Subdivision. Michael Grigsby represented the proposal. The PlanningCommission considered granting preliminary and final approval to the Vonda Robinette PropertySubdivision, for one lot containing 1.00 acres, located adjacent to Gap Creek Road in the 7th civil district.Staff stated there was an existing Certificate of Completion for the property, all applicable signatures hadbeen obtained, and applicable fees paid. A motion was made by Lyle Parton, seconded by Phillip Ottinger,to grant approval. The motion carried unanimously.

Lurline Bible Estate Section 1 Subdivision. Todd Shelton represented the proposal. The PlanningCommission considered granting preliminary and final approval to the Lurline Bible Estate Section 1Subdivision, for 29 lots containing 26.25 acres, located adjacent to Raders Sidetrack Road and BaughardHill Road in the 8t~1civil district. Staff stated that sanitary sewer service was provided by the City ofMosheim, all applicable signatures had been obtained, and all applicable fees paid. A motion was made byGwen Lilley, seconded by Frank Waddell, to grant approval. The motion carried unanimously.

East Tennessee Forest Products. Inc Subdiyision. Daniel Coffey represented the proposal. The PlanningCommission was asked to confirm preliminary and final approval to the East Tennessee Forest Products,Inc Subdivision, for one lot containing 0.835 acres, located adjacent to Gravel Woods Road in the 19th civil

district. Staff stated that the plat had originally been approved in 2015, and that all signatures, exceptingthe Secretary of the Planning Commission, had been obtained. Because the plat, which was recentlysubmitted for the secretary’s signature, had been damaged and was in poor condition, the Commission wasasked to confirm this approval, and state their recommendation for recording. Daniel Coffey, with AzimuthEngineering, the original design professionals, offered to take the best plat, make two additional copies,and have those signed and recorded. Staff stated there was an existing Certificate of Completion for theproperty, all applicable signatures had been obtained, and applicable fees paid. A motion was made byGwen Lilley, seconded by Kristin Girton, to grant approval, with the Secretary to sign the best original andtwo new copies. The motion carried unanimously.

Administrative Minor Subdivision Plats. Staff informed the Planning Commission that the followingplats had received administrative approval:

• Redivision of Lot 13 of the Peters Property, for two lots containing 2.55 acres, located adjacent toPeters Lane in the 20th civil district.

• Replat of Lots 2 and 3 of the Ronnie Ricker Property, for two lots containing 2.89 acres, locatedadjacent to Little Chuckey Road in the 19th civil district.

• Replat of Lots 12 and 13 of the Brackens Property, for one lot containing 0.975 acres, ~ocatedadjacent to Brown Springs Road and Lonesome Pine Trail in the 23th civil district.

Other Business.

Signature Block for Septic System Aporoval on Subdivision Piats. The Commission was informed that theTennessee Department of Environment and Conservation, Division of Water Pollution Control, was in theprocess of scanning septic system/plat approvals, to make them available on-line. Because the permitswould no longer be available in the local TDEC/Planning office, the TDEC block on subdivision plats wouldhave to be revised. Staffproposed to submit new wording to be considered at the next meeting.

Renovation of Older Mobile Homes and Building Codes. The Commission was informed there appeared tobe an increase in the number of mobile homes in Greene County that were in extremely poor condition.These homes, if moved to a new site, often disintegrated in the process. For those that survived the move,they often could not be renovated to meet the building code. Staffstated that regulations to address safetyconcerns would be needed in the near future.

There being no further business a motion was made by Edwin Remine, seconded by Lyle Parton, to adjournthe meeting. The motion passed unanimously. The meeting adjourned at 1:50 p.m.

Greene County Increases a Record 5.3%

Gov. Haslam, TDTDCommissioner Kevin Triplett and Musician’s Hall of Fame DirectorJoe Chambers gathered to celebrate the continued success of the Tennesseetourism industry by announcing the 2017 economic impact numbers at pressconference at Musician’s Hall of Fame and Museum.For the 12th consecutive year, tourism topped $1 billion in state and local sates taxrevenue, reaching $1.8 billion. That marks a 7.6 percent increase over 2016, higherthan the national growth of travel-related state tax revenues of 4.6 percent.“Counties, cities and rural communities work hard to make our state a premierdestination, welcoming visitors from around the world,” Haslam said. “Our state’ssecond biggest industry continues to see outstanding growth, break visitationrecords, boost Tennessee’s economy and create new jobs. The TennesseeDepartment of Tourist Development and Tennessee Tourism Committee continue toproduce record results that fuel our state’s economy.”All 95 counties had an increase in tourism expenditures. Each county saw more than$1 million in direct travel expenditures in the economic impact of tourism.

A record 113.6 million person stays also were recorded in 2017, according to U.S.Travel. Those numbers place Tennessee among the Top 10 travel destinations in thenation for the fourth consecutive year. Tennessee is also considered a top retirementdestination.

This year Greene County was accepted into the Retail Academy, a programdeveloped by a leading national retail advisory firm, Retail Strategies and theTennessee Department of Economic and Community Development. Our firstmeeting is taking place September 12 and 13. The program will assist our communityin strengthening our retail landscape. The course consists of a training program thateducates 2-3 participants from our community on strategies of retail recruitment and

spentwith Jenkins.Wheelersaid therewasnoorderfor Jenkinstorecusehimself fromthecase,andthatJenkinshimselfissuedtheorderforrecusal.“He did thatbecauseof aconflict of interest.Hehadaninterestin thelawsuit,”Wheelersaid.Discussingcasestatusandstrategywith Jenkinswasnotwrong,Wheelersaid.“It’s hiscourt, it’s hisclerkandmaster(and)he wasnot involved inthelawsuit. Grossman,who practicesina Knoxville law fi rm,broughtotherareasofexpertiseto thelegalteam,includingmunicipalandgovernmentrelationsandothercomplexlitigation,accordingto Wheeler.The countylawyersfiled anexceptionto the$240,000 billed by Armstrong’slawyersto thecourtanda hearingwasheldinAugust.Rambohasnotyetruledon whetherornotthecountywill beliable forArmstrong’sattorneyfees.ARMSTRONGCOMMISSIONS,SUNSHINELAWElsewherein his letter,Peterssaysthe clerkandmasterin eachTennesseecountyreceivesa “paidcommission”whendelinquentpropertiesaresoldatauction,andthatmanyclerksreturnthemoneytotheircounty’srespectivegeneralfund.Not sofor Armstrong,wrotePeters,who claimedthatbetweenthebudgetyearsof 2007 and2016,shereceivednearly$90,000“in commissionfordelinquenttax sales”in additionto herregularsalary.Peterssuggestedthatreturningthemoneyto thecountywould havebeen“a showof goodfaith onherpart,especiallysinceherstaU that is fundedbythetaxpayersallowshertocollectthesenicecommissions.”WheelersaidFriday thatthecommissionsaren’tfromdelinquentpropertytax sales.Thosecommissionshavebeenfrom timeswhenajudge hasputArmstrongin chargeof sellingpropertyto settleprobatematters— notdelinquentpropertytax matters.InArmstrong’scase,shesoldthepropertieson behalf

of privatepartiesandgavethosefundsbacktothoseparties,minusacommissionpaidherby the courtfrom thesales.Wheelersaidif Armstronghadnotbeentaskedwith sellingthoseproperties,someotherattorneywould haveandwould alsohavebeenpaida commission.“That is not taxpayermoney,” Wheelersaid.Peterswrotethat theonly“winners” in thecasearethelawyers.Mostareethicalin thepracticeoflaw,hesaid.“But asin all aspectsofsociety,thereare a ‘fewbadapplesthatspoilthewholebunch,’ andI believetheactionsof Mrs. Annstrong’sattorneysthroughoutthisordealhavebeenbothquestionableandobjectionable.”Peterswrotethelawyersgetnothingif if sheloses,andArmstrong’sfeesarepaidby taxpayersif shewins,“so (she)hasnothingto losefi nanciallyby filingsuit,andshehasnothingtolosepolitically sincehersisnotan electedposition.”Petersinferredthat iswhy WheelerandGrossmanare“actively campaigning”againstappealof the lawsuitto thestateCourtof Appeals.Wheelersaidthoseallegationsarefalse.“Our onlyreactionwastrying to respondto thosebush-leaguetactics.Thecourttriedto takecareofthis (by Rambo’sruling),”Wheelersaid. “That’s whyit got sougly.”Wheelercharacterizedthetacticsof thecounty’slawyersas“scorched-earthlitigation.”WheelersaidthatArmstrongwouldhave“settledfor less”staU nghelpthanRamboprovidedin his

ruling if thecountyhadsettledthecaselastyear.PeterswrotethatArmstrong’slawyers“havetriedto bully theGreeneCountyCommissioninto droppingour appealby threateningto fi le a SunshineLawviolation againstusandthey’redoing it againbystatingfalseinformationinTheGreenevilleSun.”“Therewasneveranythreatmadetothecountycommission,”Wheelersaid.“Therewasonlyarequesttofollow caselawon theSunshineLaw.”A depositiongivenbyDavid CrumhadgivenArmstrong’slawyerscauseto questionwhetherthecountycommissionmadedecisionsaboutthecasein executivesession,aviolationof the stateOpenMeetingsAct, Wheelersaid.Peterswrotethereisno legalprecedentfor thecountybeingliable for allattorneyfeesif theappealscourtrulesin favorofArmstrong.Rambohasyet to rendera decisiononthatmatterafteranAugusthearing.“We standby oureU ortsto try andsettlethis,”Wheelersaid. “We reallyappreciatethemayortakinga closelookat this andtryingto get thisoverwithandgetit settled.”

RESPONSE

Mayor Morrisonmadea requestfor theconsiderationto suspensionofrulesto consider

two things. An emergencyrepairreplacementof equipmentin theelevatorat thejail. The

elevatoratthejail hasgone‘kaput’, it hasworkedfor usfor 31 years. Hesaidthat oneworkers

compensationcasehasalreadybeenfiled sincethe elevator’susehasbeensuspended.The

GreeneCountyPurchasingDepartmenthasreceivedaquotefrom Thyssenkruppto perform

therequiredrepairssubjectto reviewofthecontractfor thoserepairs.

Theotherreasonfor suspendingtheruleswould be that on or aboutthe l8~or19

th of

September2018,theClerk andMasterasaresultof not enteringinto anagreementwith Greene

County on salaries.ThepreviousCommissionpassedthebudgeton August20th, asof 30 days

thedepartmentheadsall but the Clerk andMasterhadsignedan asalaryagreementsfunding

theirdepartments.TheClerk andMasterdid not signtheagreeto salaryagreement,fundingthat

thedepartmentat thesamelevel asofpreviousfiscal years.Clerk andMasterdid file a second

lawsuitagainstGreeneCountyfor theappropriationoffunds aswaslaid out in thefirst lawsuit

accordingto theJudge’sruling. MayorMorrisonstatedto theCommission,“you asthe

LegislativeBody would be askedto retainan attorneyto file aresponseto this lawsuit.” We

will needan answerto file aresponseto that secondlawsuit. He saidtheduedateto file an

answerwould be October3, 2018.

thefuture. SheriffHolt saidthatsincethebuilding is so old thattheconstructionexpertshave

saidthebuilding is not structurallysoundenoughto install anew,modernelevatoranchoredto

theceilingof thebuilding.

CommissionerWhite saidthatthecurrentelevatorwasinstalledthreedecadesago, and

thatit wasdonerightbecauseit haslastedso long andthis shouldgiveusanother30 years.

CountyAttorneyRogerWoolseysaidthatsincean emergencyrequestto the

Commission,he will look atthecontractsproposedby contractorsandthenthecasewill be

addressedatthenextmonth’s Commissionmeeting.
