1.0 INTRODUCTION
This Statement of Environmental Effects (SEE) is submitted to Blacktown City Council in support of a section 4.55 (2) modification to amend an approved consent DA15-1457 located at 61-69 Orana Avenue, Seven Hills (Lot 11 to Lot 14 DP29826 and Lot 2 DP233799) involving the demolition of 5 dwellings and construction of 8 dwellings (Integrated Housing Development) on 8 Torrens title residential lots. The Section 4.55 (2) application seeks approval for:
Amendment to Internal layout changes which include alignment of the staircase, the relocation and size variation of kitchen, rooms, bathroom and laundry space;
Minor changes to lot size and building footprint; and
Changes to associated elevation plans; size and location of windows; and
Minor changes to finished floor level. This report describes the background of approved DA plans, the site, and proposed amendments. It provides an assessment of the environmental impacts and identifies the steps to be taken if there are any potential impacts on the environment.

2.0 BACKGROUND
Development consent DA15-1457 for the subject site was issued by Blacktown City Council on 16th August 2016 as follows:-
The approved plans provide for the demolition of 5 dwellings and construction of 8 x two-storey dwellings and concurrent Torrens title subdivision into 8 residential lots as shown in Figure 1, 2, and 3.
The plans provided for an integrated approval of dwelling designs on each proposed lot.

DA15-1457 references the drawings in Condition 2.1.1 as shown in Figure 2 below.

3.0 SITE DESCRIPTION
3.1 Site Location & Context
The subject site is located on Orana Avenue which connects to Prospect Highway in the northern side and Seven Hills Road on Eastern side. The site is bounded by existing residential development which is predominately low-density residential development. As shown in Figure 4, the site is located approximately 1 km from the Hills Shopping Centre and Seven Hills train station.

3.2 Existing Site & Vegetation
Currently, there are five dwellings situated on every five lots which are being previously approved to demolish as per DA-15-1457. The approved plan shows that some existing trees approved for removal (see Figure 5).

The total site area is approximately 2921sqm with a frontage of approximately 80metres to Orana Avenue and a depth of approximately 37metres. The lot is rectangular and regular in configuration, allowing direct equal frontages for the proposed lots to Orana Avenue.

4.0 STRATEGIC ASSESSMENT
The relevant environmental planning instruments and development controls plans for the subject site are:
Blacktown Local Environmental Plan 2015; and
Blacktown City Council Development Control Plan 2015.
4.1 Blacktown Local Environmental Plan 2015
Blacktown LEP 2015 commenced on 7 July 2015. Development Consent DA15-1457 was granted on 16th August 2016; which remains valid to 16th August 2021.

The site is zoned R2-Low density residential under Blacktown LEP 2015. The integrated housing is prohibited although the subject site enjoys the benefit of DA15-1457 consent; which remains valid to 16th August 2021.

4.2 Blacktown City Council Development Control Plan 2015
The proposed development as approved complied with the provisions of Blacktown DCP 2015. The proposed modifications do not alter any setbacks and no variations are sought to the DCP provisions that applied the approved development. The modifications as sought will still be compliant with the DCP provisions. Table 1 Compliance based on the proposed changes:
4.3 BASIX Certificates
BASIX certificate for each lot has been issued on 27th April 2020 and attached with the application.

5.0 Outline of Proposed Modifications This application seeks to modify the development consent DA15-1457 pursuant to Section 4.55 (2) of the Environmental Planning and Assessment Act 1979. The proposal is to amend the existing plans to achieve the following design outcomes:-
5.1 Internal Layout Changes
Minor changes are proposed to the layout for the ground and first floors in terms of location of the kitchen, living space, staircase, bathroom, and the associated number of windows.
Table 4 in section 5.6 summarises the proposed changes on ground floors and first floors.
Besides, the proposed level changes are shown on the modified architectural plans in Appendix A and Schedule of Amendments in Appendix B (Dwelling layout).
5.2 Lot Sizes
According to the approved plan, the lot size varies from 359.24m2 to 365.08m2. Hence, for a better outcome, minor changes are proposed to make the lot size 360.39m2 to 370.82m2.

5.3 Building Footprint
Minor changes to the footprint are proposed on the site in association with the proposed internal layouts modification and reconfiguration of the staircase.
Modified building footprints have been identified in Schedule of Amendment (Drawing No. 2 to 16).
5.4 Elevation changes
Minor changes are proposed to the elevations due to:
a) update the style of windows used b) modernise the porch and patio design c) Minor changes to roof plan of Lot 2 and Lot 6 (See Figure No 7 below)
These changes are listed in Appendix A (Architectural Plans) and Appendix B (Schedule of Amendment).

5.5 Floor Level Changes

Due to minor changes in floor levels, there are no significant environmental impacts identified to the adjoining properties as the proposed window locations, sizes and provision of screening, maintain the privacy level and reduce the prospect of overlooking. Following Figure 7 shows the comparison between approved and proposed elevation.

5.6 Summary of Changes
The proposed changes will have no effect on the scale or the layout of the proposed development that will take place with the fewest alteration to the design compared to the original approval. The modification overall is minor and seeks to change the approved lot sizes, internal dwelling layout, and upgrade the elevations as approved.

According to the level and type of alterations proposed, the development is classified substantially the same as that approved. The modification seeks an amendment to the drawing reference in Condition 2.1.1 to refer to the Architectural Plans as modified in Appendix A.

6.0 REVIEW OF PLANNING & ENVIRONMENTAL CONSIDERATIONS The proposed development, following the approval of the requested modification, will result in
substantially the same development to that to which consent has already been granted – no significant
change is proposed nor will occur as approval of this Section 4.55 (2) modification request.
6.1 Substantially the Same Development
Section 4.55 (2) - Modification of Consents Generally
Section 4.55 of the Environmental Planning and Assessment Act 1979 (the Act) provides that a consent
authority may, in certain circumstances, grant consent to an application that seeks to modify a
development consent. In this circumstance, the inferior nature of the amendment and the nominal
impacts that arise as a result, warrant the application being requested under Section 4.55 as follows:
The development, as proposed to be modified, is substantially the same development as approved since:
The proposal does not change the purpose for which development is being carried out (i.e.
integrated housing) and provisions sited in Blacktown Local Environmental Plan 2015;
The building envelope and massing remains essentially unchanged;
The total number of dwelling remains unchanged;
The built form of the development remains essentially the same as the approved development;
The proposed design changes comply with the regulations cited in the Blacktown Council
development control plan 2015.
The proposal does not result in any significant environmental impacts
As shown in the compliance table in section 4.2, the proposed changes to the buildings have no effect on
the scale of the proposed development that will take place with only nominal impact on the individual
building floor plans envisaged in the original approval, the modification seeks changes to:
a) Floor levels b) Elevations c) Internal layouts d) Windows

6.2 Section 4.15 - Evaluation - Statement of Environmental Effects
Section 4.15 of the Environmental Planning and Assessment Act 1979 contains matters that need to be
considered for any development application. Section 4.15 reads:
The development will continue to satisfy the consideration against Section 4.15 even after the
modification as:
There will be no change in any potential impacts arising as a result of the proposed development. If any occur, they are likely to be considered positive in the context of improving the amenity of the occupants.
The level of proposed modification in design aspect (Floor levels, elevations, windows and internal layouts) will not be having any environmental impact as the nature of medication is consistent with applied regulations on the site and maintain the privacy by using appropriate building materials.
The site will continue to be suitable for the approved use after the amendments are made. The public interest will not be diminished as a result of this modification request.

7.0 CONCLUSION
The proposal is generally consistent with the relevant environmental planning instruments applying to the site including Blacktown Local Environmental plan, 2015, and Blacktown City Council Development Control Plan 2015 and accordance with Section 4.15 of the Environmental Planning and Assessment Act 1979, the modification proposal is found suitable for the site. In light of the merits of the application, the proposed modifications are considered nominal in nature with the absence of any significant environmental impact arising in relation to how the site will function or potential impact on the locality. Having considered all the relevant matters, we respectfully recommend that the requested changes are insignificant and represent a sound development outcome, therefore the proposed modification is considered worthy of support.
