INTROOUCfiON 1. The Australian Ai' Force cadets (AAFC) consists of vok.mteers committed to youth development across Austraia. The statutory prov!lions governing the legal status of the AAFC!; covered by the Defence Act 1903 (s62). AAFC members are not members of the Australan Defence Force (ADF) or the Royal Australan Ai' Force (Air Force), but the AAFC s closely ailed with the Ai' Force and the local communty.

POIJCY PRINCIPLES 5. The prilciples of this chapter are as folows:

a. Prindple One: Acceptance to volunteer with the AAFC does not create any kind of civil contract the Ouwn or the Commonwealth.

b. Principle Two: In accordance with the Defence Act 1903, a person accepted into the AAFC as an Offcer of cadets (OOQ or an Instructor of cadets (IOQ or a cadet is not by virtue of that acceptance a member of the Air Force or the ADF.

d. Principle Three: Offcers of cadets (OOC), Instructors of cadets(rOC) and cadets are members of the AAFC.

e. Principle Five: Defence Approved Helpers including Crvirlan Instructor Volunteers (CIV), ADF Support Instructors, contractors and others, while supporting the AAFC are not, by virtue of their association, members of the AAFC, ADF or Air Force.

c. Prindple Four: All personnel are considered to be a 'worker' for the purposes of the Work Health and Safety Act 2011 while participating in approved AAFC activities.

AAFC MEMBERS IOCJOOC 6. OOC and roc are part-time adult volunteers who come from a wide range of occupations within the local community. OOC and IOC are trained to manage and conduct the activities of AAFC cadet units established throughout Australia. An OOC or IOC is not a member of the ADF and no civil contract of employment exists between the member and the Commonwealth. Conditions of service forOOC and IOC are outlined in Vol2, Pt 1, CH01 -Conditions of Service -Officers and Instructors.

7. While OOC/IOC are not members of the ADF or Air Force for the purposes of the Workplace Health and Safety (WHS) and the Privacy Acts, IOC and OOC are deemed to be workers of the Commonwealth and are subject to the restrictions and protection of these Acts. The Military Rehabilitation and Compensation Act 2004 makes provision for the rehablitation and compensation for OOC/IOC who are injured while participating in or travelling to and from an approved AAFC activity. See the AAFC Safety Manual - Chapter 22 - Rehabirtation and Compensation. Under the Privacy Act 1988, Defence and/or the AAFC member may be held responsible where an ooq roc, acting in the course of their duties, acts contrary to the Act (see Vall Pt 1 CHOS - Privacy).

8. While on approved activities, OOC and roc wear Air Force approved uniforms supplied by Defence and the rank structure and organisation of the AAFC is similar to that of the Air Force. OOC and IOC hold AAFC rank and status comparable with their Air Force counterparts for the purposes of AAFC command and supervision. OOC and IOC hold rank, precedence and authority only within the AAFC. Irrespective of rank or position, OOC and IOC do not hold command status over members of the ADF except where the ADF member is paradilg in an allocated subordinate AAFC role within the unit or activity as a Defence Approved Helper. Normal service compnments are to be paid to ADF members by all OOC and IOC.

Cadets 9. cadets are young people between the ages of 12.5 and 20 who volunteer for and are accepted to be an AAFC member to undertake the youth development activities of the AAFC. A cadet is not a member of the ADF and no civil contract of employment exists between the cadet and the Commonwealth. Conditions of service for cadets are outlned in Vol 2, Pt 1, CH02 - Conditions of Service - cadets.

10. cadets are not members of the ADF but while on approved activities, wear Air Force approved uniforms suppled by Defence and have a rank structure and organisation similar to that of the Air Force. cadets hold rank, precedence and authority only while on approved AAFC activities and have no AAFC status or authority outside AAFC activities.

7. DEFENCE APPROVED HELPERS ADFMembers 12. ADF Support Instructor. Members of the ADF (permanent and reserve) may volunteer for acceptance and

registration as an ADF Support Instructor. ADF Support Instructors, when undertaking AAFC activities, ADF Support Instructors are to comply with lawful instructions and be responsive to the AAFC chain of command for their period of AAFC duty. The conditions of service for ADF Support Instructors are detailed in Vol 2, Part 1, CH03 -Conditions of Service - ADF Support Instructors.

13. Compliments. ADF members are not obrged to pay mnitary compliments (sak.lting, addressing as Sir, etc.) to AAFC personnel. However, ADF members will be respectful of the position held by the more senior OOC or roc and are encouraged to pay normal compliments in accordance with service customs when attending AAFC activities.

14. ADF Support Instructors remain members of the ADF and are covered under the provision of the Military Rehabilitation and Compensation Act 2004 for any injuries and illnesses incurred in connection with their AAFC duties. See the AAFC Safety Manual - Chapter 22 - Rehabilitation and Compensation

CMlian Instructor Volunteers (CIV) 15. Adult members of the community may volunteers for acceptance and registered as Crvilian Instructor Vok.lnteers (OV). Alongside AAFC members, av also contribute to the supervision and conduct of AAFC activities. av are not members of the ADF or the AAFC, and have no formal command or direction roles within the AAFC, nor may they be issued with, or wear AAFC uniform. The conditions of service for av are outlined in Vol 2, Pt 1CH04 -Conditions of Service - CivDian Instructor Vok.lnteers.

16. C'N are covered by the Government Insurer, Comcare for the provision of medical rehabirltation and compensation i1 the event of injury or acck:lent while on an approved AAFC activity. See the AAFC Safety Manual­Chapter 22- Rehabilitation and Compensation.

ALL PERSONNEL 17. AAFC Members must not represent themselves as members of the Air Force or the ADF or wear AAFC uniform when not on an approved activity. Personnel must not spend or commit Commonwealth funds. see Volume 2, Part 3, CH01 -Financial Management).

18. All personnel are subject to AAFC and relevant Defence rules and regulations while on AAFC activities or representing the AAFC. These are articulated in the AAFC Manual of Management and subordinate Orders Instructions and Publications (OIP).

NON-MFC PERSONNEL Unit support Committee members 19. Unit support committee (USQ members are not part of the ADF, nor are they are they defined within AAFC personnel. USC exist to support their local unit with resources that cannot be suppred by the Commonwealth. Unless otherwise registered as an ADF Support Instructor or C'N, people involved in the USC have no power to infk.lence the running of an AAFC unit or the AAFC. For AAFC Policy regarding USC personnel see Vol 1, Pt 2, CH03 - Governance and Support Committees.

Contractors 20. Contractors are service providers engaged to support AAFC Activities (e.g. Adventure training instructors, flying instructors etc.). Contractors are not defined within all personnel and have no authority over the AAFC or its members except when executing their contracted service (e.g. giving di'ections during adventure training, flying instruction etc.). Conditions of employment of contractors are to be outlined in the contractual agreement.
