TITLE IGENERAL PRINCIPLES

ART. 1NATURE AND PURPOSES

1. The Università Cattolica del Sacro Cuore (hereinafter Università Cattolica) was founded by the Giuseppe Toniolo Institute for Higher Education, recognised as the University’s founding body by Royal Decree n. 1044 of June 24, 1920. On December 25, 1920, upon the initiative of the Giuseppe Toniolo Institute, the Università Cattolica was canonically established by a Decree issued by the Sacred Organisation of Seminars and Universities of Studies and juridically recognised as a free University by Royal Decree n. 1661 of October 2, 1924. The Università Cattolica is a non-state University and a legal person in public law pursuant to the laws in force.

2. The Università Cattolica is an Academic Community that promotes study, scientific research and the education of young people for research, teaching, public office and liberal professions. The Università Cattolica carries out the above-mentioned tasks through appropriate higher education which is adherent to the principles of Christianity, with due regard for the autonomy proper to every form of knowledge, and according to a conception of science at the service of the human being and of civil co-existence, in line with the principles of the Catholic doctrine and with the universal nature of Catholicism and its high and specific needs of freedom;

3. In line with the spirit of its founders, the Università Cattolica specifically aims at assuring the presence of committed people in the academic and cultural world who are prepared to address and solve the problems of society and culture, enlightened by the Christian message and Christian moral principles.

4. In pursuit of its institutional purposes, the Università Cattolica avails itself of the autonomy acknowledged by Art. 33 of the Constitution, with due regard to the principles set forth in agreements between the Republic of Italy and the Holy See, and in current legislation.

5. In order to fulfil purposes consistent with its own institutional purposes, the Università Cattolica is endowed with the power of constituting or participating in other structures, institutions, societies, consortia and other organisations which should be governed by principles of transparency, equilibrium and economic and financial autonomy.

ART. 2GIUSEPPE TONIOLO INSTITUTE FOR HIGHER EDUCATION

1. The Giuseppe Toniolo Institute for Higher Education, the founding and promoting body of Università Cattolica, guarantees the achievement of the institutional purposes included in the present Statute.

ART. 3STRUCTURES AND VENUES

1. The Università Cattolica achieves its institutional purposes through its educative, research, High Specialisation and administrative structures, as well as through the A. Gemelli General Hospital (hereinafter, the General Hospital) and other healthcare assistance entities under specific agreements and conventions.

2. The Università Cattolica plans and organises the activities of its structures according to efficacy and efficiency criteria and based on the abilities of its teaching, administrative and technical staff, in keeping with their expertise and responsibilities

3. The Università Cattolica del Sacro Cuore’s headquarters are in Milan. Its other campuses are in Brescia, Piacenza and Rome, together with other campuses which may be identified by the Board of Directors, after consulting the Academic Senate, as part of the University’s development plans.

ART. 4QUALIFICATIONS AND CERTIFICATES

1. The Università Cattolica confers the following qualifications:a) Bachelor’s Degreesb) Master’s Degreesc) Specialisation Master Programmes

2. The Università Cattolica shall also issue specific certifications related to High Specialisation, Advanced Training Courses and other institutional activities.

3. The Università Cattolica facilitates students’ completion of its courses of study with the support of equivalency programmes, resulting in the awarding of corresponding qualifications pursuant to the regulations preceding the entry into force of the Decree of the Ministry of Universities and Scientific and Technological Research of November 3, 1999 n. 509.

ART. 5MASTER’S AND DOCTORAL PROGRAMMES

1. The Università Cattolica organises and offers Specialising Master and Doctoral programmes, awarding the corresponding qualifications. The Università Cattolica may enter in a consortium with other Universities and Institutions, in order to achieve the same purposes.

ART. 6FURTHER INSTITUTIONAL ACTIVITIES

1. The Università Cattolica organises and promotes orientation and tuition activities for its students, together with training and advanced training activities in the cultural, scientific, technical and professional fields based on specific contracts and conventions.

2. In particular, through specific decentralised structures the Università Cattolica is entitled to:a) organise meetings and orientation courses for students enrolling in university programmes and to

define study programmes; b) organise preparation courses for qualifying examinations to the professions; c) manage refresher training courses for the teaching staff at all levels; d) participate in initiatives of relevant scientific and cultural interest promoted by external Institutions

and Bodies; e) promote and organise training courses, re-training courses and lifelong training courses for its

administrative and technical staff; f) encourage cultural formation in collaboration with other Institutions;

g) promote continuous training initiatives. Toward this purpose, the Università Cattolica provides in-depth training pertaining to theoretical questions raised by such training.

3. The Università Cattolica provides its qualified contribution to the development of applied research and technological and organisational innovation. Toward this purpose, it may conclude contracts or enter into agreements in favour of third parties for research activities, vocational guidance activities or service activities.

4. The Università Cattolica works to ensure the preservation and promotion of its cultural heritage, spreading the knowledge of this heritage to the wider public.

ART. 7COOPERATION RELATIONSHIPS

1. The Università Cattolica collaborates in the definition and implementation of scientific cooperation and training programmes with other Italian and foreign Universities, especially with Catholic Universities, EU Universities, and with national, community and international organisations. The Università Cattolica has a special focus on collaboration and co-operation programmes with developing countries.

2. The Università Cattolica may contribute to the support of Institutions and Associations whose institutional

purposes are in line with the University’s purposes by entering into partnerships with them.

ART. 8RIGHT TO EDUCATION

1. The Università Cattolica, on topics related to its jurisdiction, seeks to ensure the full achievement of a Right to Education. The University can implement services or intervene in favour of this right under agreements and conventions with Regions and other territorial authorities, and also through its own direct activities.

2. Pursuant to the regulations in force, the Università Cattolica adopts measures necessary to make

effective the right of disabled students to participate in cultural, educational and research activities and to make use of the University’s services.

ART. 9THEOLOGY COURSES

1. In light of the Conciliar Decree Gravissimum Educationis, the Università Cattolica acknowledges the fundamental value of Theology courses in the context of its educational and cultural mission. It supports these courses according to the spirit and the letter of the Apostolic Constitution Ex Corde Ecclesiae.

2. Theology courses are offered to all students. The Università Cattolica promotes the theological and ethical education of its students, including on questions of professional ethics, additionally by means of other training initiatives.

3. In order to coordinate the activity of Theology Professors, to promote Theology courses, and to encourage an ever-growing and dynamic dialogue between theological reflection and the various fields of knowledge, a Theology Department has been established. Specific regulations govern the Department’s organisation, skills and operating modes.

ART. 10GENERAL PRINCIPLES OF CONDUCT

1. Università Cattolica is a community of Professors, administrative and technical staff and students inspired by respect for fundamental human rights and personal and collective freedoms, together with principles of solidarity.

2. Professors, administrative and technical staff and students shall contribute to maintaining and reinforcing

the Catholic unity and identity of the University, and to contribute to its functioning based on their individual competencies and responsibilities, following certain general principles of conduct:a) rigorous performance of academic duties and cooperation in organising education activities for the

purposes of a balanced distribution of education tasks; b) cooperation in scientific activities, with special attention to sharing of information, and to

understanding and taking advantage of relationships established with other Universities, Institutes and national or foreign Research Centres, including non-academic Research Centres;

c) a special commitment to assisting patients hospitalised at the A.Gemelli General Hospital, and at other healthcare assistance structures, based on specific agreements and conventions;

d) contribution to the most efficient development of resources and to the most effective offering of services provided by the Università Cattolica;

e) respect of the places, structures and goods generally intended by the University to be used for education and research activities and for general services, the functionality and decorum of which are to be preserved;

f) collaboration in the promotion and achievement of initiatives of shared interest and utility to the University, and of initiatives intended to spread the values of subsidiarity, responsibility and solidarity.

2.bis Professors, administrative and technical staff and students are expected to respect the principles and contents of the Code of Ethics of the Università Cattolica.

3. Professors and administrative and technical staff are also expected to comply with the principles and contents of the Code of Conduct for public administration employees as provided under the rules in force.

ART. 11SPIRITUAL CARE AND PASTORAL ACTION

1. In order to achieve its institutional purposes, and in harmony with the teachings of the Church, the Università Cattolica del Sacro Cuore establishes a Pastoral Centre.

2. Spiritual care and pastoral action within the Academic Community are coordinated by the General Ecclesiastical Assistant, appointed by the Italian Episcopal Conference. The General Ecclesiastical Assistant makes use of the collaboration of other Pastoral Assistants and the University’s Pastoral Council.

ART. 12CULTURAL AND SPORTING ACTIVITIES

1. The Università Cattolica promotes cultural, sporting and leisure activities for students and staff through adequate organisational structures, and through agreements with other Bodies or Associations whose aim is to practice and disseminate university sporting activities and to organise national and international

university sporting events. 2. Toward this purpose, the Università Cattolica institutes specific Committees, whose functions, structure

and management are governed in accordance with the University’s General Regulations. 3. In particular, the Università Cattolica establishes, by Rector’s Decree, a Committee for University sporting

activities to operate sporting facilities and develop programmes referring to such activities, composed of:a) the Rector, or a delegate, as President;b) two members, designated by the University’s legally recognised sporting associations, organising

student sporting activities at the national and international levels;c) two students, elected pursuant to the procedures set out in the University’s General Regulations;d) the Managing Director, or a delegate, who also acts in the role of Secretary.

4. Expenditures are covered through funds allocated by law, together with any other funds specifically made available by the Università Cattolica or other Institutions, including student financial contributions.

ART. 13RIGHT OF ACCESS AND ADMINISTRATIVE TRANSPARENCY

1. The Università Cattolica del Sacro Cuore guarantees, according to the laws in force, access to information and the transparency of management and administrative acts, as set forth in the University’s General Regulations.

ART. 14 ASSETS AND FINANCIAL RESOURCES

1. For its institutional activities, the Università Cattolica employs its own assets and assets provided by the Giuseppe Toniolo Institute for Higher Education, as well as assets provided by other Institutions and private bodies. The modalities according to which assets provided by the Giuseppe Toniolo Institute are to be used are governed by agreements concluded with the Institute.

2. The Università Cattolica del Sacro Cuore’s funding resources are derived from taxes, student economic

contributions, the proceeds of investments allowed by law and from other forms of funding, such as proceeds from activities, income, profits and agreements, and includes bequests, charitable contributions and voluntary contributions, especially from Italian Catholics.

3. Any surpluses resulting from the performance of institutional activities shall be employed in investments and activities aimed at achieving the institutional purposes established by the present Statute, and under no circumstances may they be distributed, even indirectly, to third parties.

TITLE IIGOVERNING BODIES

ART. 15GOVERNING BODIES

1. The University’s Governing Bodies are:a) the Board of Directorsb) the Steering Committeec) the Rectord) the Academic Senatee) the Council of Directorsf) the Board of Auditors

2. The meetings of the bodies listed in a), b), d) and e) of the previous Paragraph, if indicated in the notice of meeting, may take place via video conference, as set forth in the University’s General Regulations.

ART. 16BOARD OF DIRECTORS

1. The Board of Directors consists of eighteen members: a) the Rector, who chairs it; b) ten members appointed by the ethical body Giuseppe Toniolo Institute for Higher Education;c) one representative of the Holy See;d) one representative of the Italian Episcopal Conference;e) one representative of the Government;f) one representative of Italian Catholic Action;g) three members appointed from among Full Professors: one from the Milan Campus, appointed by

the Full and Associate Professors at the Milan Campus; one from the Full Professors of Brescia and Piacenza appointed by the Full and Associate Professors at the Piacenza and Brescia Campuses; one from the Rome Campus, appointed by the Full and Associate Professors from the Rome Campus. The corresponding voting methods are established by the University’s General Regulations.

2. Pro-Rectors may also be invited to take part in the meetings of the Board of Directors.

3. In the event of the Rector is prevented from attending or is absent, the Board of Directors shall be chaired by the Board member with the longest service at the University.

4. After its appointment, the Board of Directors shall be in existence for four years from the date of its

election. 5. In the event of a Board member’s early cessation of duties, his or her successor shall hold office to the

expiration of the period that their predecessor would have served. 6. The Board of Directors shall be validly constituted when the number of its members is not below ten.

7. For meetings to be valid, the presence of a majority of the Board members shall constitute a quorum. Unless otherwise stated in these Statute, resolutions shall be passed by a majority of votes by those present and in the event of a tie, the President’s vote shall prevail.

8. The Managing Director shall participate as an advisor to the meetings, being charged with the task of

writing the minutes.

ART. 17BOARD OF DIRECTORS’ POWERS

1. The Board of Directors is charged with the broadest powers, relating to both ordinary and extraordinary administration, as concerns the government of the Università Cattolica. In any event, the Board shall decide on the fundamental managerial acts of the Università Cattolica, in order to ensure and guarantee the achievement of its institutional purposes.

2. The Board of Directors shall decide upon:a) the Statute and any changes relating to them, upon a proposal of the integrated Academic Senate,

after consultation with the concerned Faculty Board regarding subjects relating to the educational system;

b) the University’s General Regulations and any changes relating to them, upon a proposal of the Academic Senate;

c) the University’s Regulations as concerns administration, finance and accounting;d) the Code of Ethics of the Università Cattolica and any changes related to it, upon the Academic

Senate’s proposal.

3. In particular the Board shall decide upon: a) the Rector’s appointment;b) development programmes;c) the budget and financial statements of the Università Cattolica;d) the establishment of student admission procedures;e) the appointment of the Managing Director;f) the opening of new campuses, the establishment and elimination of education structures and

related Bachelor’s Degree and Master’s Degree programmes;g) the establishment of or participation in other structures, Institutions, societies, groups and other

organisations, whose purposes are in harmony with the institutional purposes of the Università Cattolica;

h) the appointment of Campus Directors and other Administrative Directors;i) the appointment of the members of the Board of Auditors;l) appointment of Professors and academic research staff;m) taxes and contributions from students;n) the organisation of administrative structures.

ART. 18STEERING COMMITTEE

1. The Board of Directors appoints a Steering Committee from among its members. The Steering Committee consists of nine members: a) the Rector, who is its President;b) five members appointed by the Board of Directors from the Board members appointed by the

Giuseppe Toniolo Institute for Higher Education; c) the three Professors appointed pursuant to Article 16, Paragraph 1, letter g).

In the event that the Rector is prevented from attending or is absent, the Steering Committee shall be chaired by the member with the longest service at the University. The Managing Director shall

participate as an advisor to the meetings, being charged with the task of writing the minutes.

2. For meetings to be valid, the presence of a majority of the Steering Committee members shall constitute a quorum. Unless otherwise stated in this Statute, resolutions shall be passed by a majority of votes of those present and in the event of a tie, the President’s vote shall prevail.

3. During preliminary stages the Steering Committee shall decide upon:a) the expansion of or reduction in professorial and academic research staff;b) the analysis of the budget and financial statements of the Università Cattolica;c) fees and contributions from students;d) the analysis of proposals for changes to budgets and financial operations;e) the acquisition or sale of properties;f) the establishment and elimination of Degree Programmes, Schools, Departments and Institutes.

4. The Steering Committee shall decide upon the following, except for the Board of Directors’ right to call back:a) the assignment of instructors, including instructors for education activity collaborations, the

corresponding appointments and remuneration;b) the appointment of delegations for concluding collective work contracts for administrative and

technical staff and the authorisation conclude such contracts;c) the service allowance for the Rector and the Professors in charge of executive offices;d) the retaining and recruitment of administrative and technical staff, regulations concerning their legal

status and remuneration, and adoption of disciplinary proceedings;e) the acceptance of charitable contributions, legacies, bequests, inheritances and donations;f) the examination of litigation and consideration of related determinations;g) the establishment and elimination of Research and Inter-University Centres, of Advanced Training

Courses and of High Specialisation Courses and Doctorates;h) proposals under the University’s Regulations concerning administration, finance and accounting.

5. The Board of Directors may delegate to the Steering Committee the authority over the following functions:a) the allocation of ministerial contributions;b) evaluation of and awarding contracts for new construction, exceptional maintenance needs and

supplies;c) financial operations;d) extraordinary conventions;e) supplementary compensations;f) office venues and the reorganisation of office venues.

6. The Board of Directors may also delegate further functions to the Steering Committee in addition to those referred to in Paragraphs 3, 4 and 5 of this Article.

ART. 19THE RECTOR

1. The Rector is appointed by the Board of Directors from Full Professors with service of at least five years at the Università Cattolica, from a list of candidates including five names, the candidates to be decided by the Academic Senate based in part on designation of the candidates by the Faculty Board. Each Faculty designates no more than three candidates. The Faculty Board’s method for designating the

candidates shall be governed by the University’s General Regulations. 2. The Rector shall remain in office for four Academic Years and is eligible for re-appointment for no more

than two consecutive mandates. The Rector shall undertake his or her mandate on a full-time basis.

3. The Rector is responsible for:a) legally representing the Università Cattolica;b) performing general academic tasks within the matters under his jurisdiction as provided in the

present Statute;c) promoting the coordination of the activities of all the bodies of the Academic Community in order

to achieve this University purposes;d) convening and chairing the Board of Directors, the Academic Senate and the Council of Directors;e) promoting organisational criteria aimed at guaranteeing the optimal performance of the University,

managing its general functioning, and optimising the operational efficiency of its structures;f) adopting all acts relating to the Università Cattolica del Sacro Cuore’s relationships with other

entities, except for the delegation powers referred to in the next Paragraph, and unless otherwise stipulated by this Statute;

g) adopting, in cases of need or urgency, acts under the competence of the Board of Directors, the Steering Committee or the Academic Senate, with ratification pending the next meeting of these Bodies;

h) performing other functions permitted by law, by this Statute and by the University regulations.

4. The Rector may appoint one or more Pro-Rectors, one with vicarial functions. He or she can delegate to them the exercise of functions pertinent to each structure and venue of the Università Cattolica.

5. In case of early termination of office for any cause, rectoral functions, pending the fulfilment of the procedures as set forth in this Article and in the University’s General Regulations, shall be performed by the Pro-Rector with vicarial functions; otherwise, rectoral functions shall be performed by the Dean of the Academic Senate, appointed pursuant to guidelines set forth in the subsequent Article n. 20, Paragraph 5.

ART. 20ACADEMIC SENATE

1. The Academic Senate is composed of the Rector, who chairs it, and the Deans of the Faculties of the Università Cattolica. The Managing Director participates in the sessions of the Academic Senate. The role of Secretary shall be performed by an administrative officer appointed by the Rector, after consultation with the Managing Director.

2. The Academic Senate is responsible for all the functions arising from the Università Cattolica’s regulations and for the organisation and coordination of educational and research activities (unless these are conferred on other Governing Bodies or other educational and research structures of the University by this Statute). The Academic Senate may temporarily delegate its functions to other bodies if deemed necessary in order to guarantee better management of educational and research activities. The Academic Senate directly exercises the following non-delegable powers:

a) presenting the University’s Statute, General Regulations and Code of Ethics and their amendments, together with formulating the University’s Education Regulations and amendments after consulting the Board of Directors;

b) putting forward proposals and expressing opinions on development programmes;c) selecting, based in part on the Faculty Board’s designation, and in accordance with Paragraph 1 of

the previous Article (n. 19), candidates to recommend to the Board of Directors for the position of Rector;

d) performing its functions, as provided in this Statute, relating to:– opening venues;– founding faculties and establishing Bachelor’s Degrees and Master’s Degrees;– founding Specialisation Schools and Advanced Training Courses;– opening Departments, Institutes and Research Centres;– opening education, research and High Specialisation structures, other than those previously listed,

and formulating applicable rules;e) formulating organisational rules for professorial and academic research staff and exercising related

powers set forth in law;f) establishing the course of research activities;g) establishing guidelines concerning the Academic Assessment Team referred to in Art. 36 of this

Statute;h) expressing opinions on student admission procedures;i) expressing opinions regarding taxes and contributions provided by students;l) expressing opinions on the organisation of administrative structures and on the University’s

regulations as concerns administration, finance and accountability and related amendments, together with other regulations included in this Statute;

m) expressing opinions on any other issue which the other Governing Bodies of the University refer for evaluation, and making proposals regarding the better implementation of development programmes;

n) preparing consolidated reports concerning the scientific and educational activity performed at the University, based on reports prepared by the competent educational and research structures.

3. To facilitate the formulation of proposals to amend the Statute, the Academic Senate is integrated

with two Full Professors, two Associate Professors and two Academic Researchers, together with a representative of students and a representative of administrative and technical staff, all of whom are entitled to vote. These persons are appointed by the Council of Directors in accordance with the procedures provided in the University’s General Regulations.

4. With the exception of the Rector, no person may serve as a member of the Academic Senate and a

member of the Board of Directors. 5. In the event of the Rector being unable to attend or being absent from a session of the Academic

Senate, this body shall be chaired by the Dean with the longest service at the Università Cattolica, even if such service has not been continuous.

6. The Rector may invite Pro-Rectors to participate in the sessions of the Academic Senate.

ART. 21COUNCIL OF DIRECTORS

1. In order to promote broader participation of members of the Academic Community in the delineation of guidelines and general decisions concerning the Università Cattolica, the Council of Directors is established.

2. The Council of Directors is composed of fifty-eight members:

a) the Rector, or a delegate, who chairs it;b) the General Ecclesiastical Assistant;c) fifty-five members representing Full and Associate Professors, Academic Researchers, administrative

and technical staff and students. These are appointed following the procedures laid down in the University’s General Regulations, which shall guarantee that the choice of representatives takes into account the various scientific and other disciplines and the several campuses of the Università Cattolica del Sacro Cuore;

d) one member chosen by the A. Gemelli General Hospital Foundation (hereinafter, the Gemelli Foundation) from its staff.

The Council of Directors appoints a Vice-President from among its members.

3. The Council of Directors provides evaluation and recommendations with the goals of improving the organisational and development guidelines of the Università Cattolica and guaranteeing better management and functioning of the University. Upon the Rector’s request, it expresses opinions on any other general question relevant to the Academic Community.

4. No person may serve as both Dean of a Faculty and a member of the Council of Directors.

ART. 22BOARD OF AUDITORS

1. The Board of Auditors of the Università Cattolica is composed of three full members and two substitute members chosen from registered auditors.

2. The President and the members of the Board of Auditors are appointed by the Rector, following the decision of the Board of Directors, and serve for a term of four years.

3. The tasks and methods of operation of the Board of Auditors are governed by the University’s regulations concerning administration, finance and accounting. These regulations also establish the incompatibilities with the appointment.

TITLE IIIEDUCATION, RESEARCH, HIGH SPECIALISATIONAND HEALTHCARE ASSISTANCE STRUCTURES ART. 23TEACHING, RESEARCH, HIGH SPECIALISATIONAND HEALTHCARE ASSISTANCE STRUCTURES

1. Educational and research activities at the Università Cattolica are carried out in the following structures:1) Education a) Faculties; b) Specialisation Schools.2) Research a) Departments; b) Institutes; c) Research Centres.

2. The educational structures referenced in Paragraph 1 are identified in the University’s Education Regulations. The research structures referred to by Paragraph 1, number 2 a) and 2 b) are identified by the University’s General Regulations. The structures referred to in Paragraph 1, number 2 c) and Paragraph 1, number 3 a) are identified in Articles 34 and 28 bis, respectively, below. The structures referred to in Paragraph 1, number 4 are identified in Article 37 below, and upon the Board of Directors’ decision.

3. The Biotechnological Research Centre of the Cremona Campus is also a structure of the Università Cattolica; its organisation and management shall be established by the University’s General Regulations in harmony with the principles of the present Statute.

ART. 24FACULTIES AND RELATED BODIES

1. Faculties enjoy autonomy this Statute and their primary task is to promote and organise both education activities towards the granting of Bachelor’s Degrees, Master’s Degrees and Specialisation Diplomas, and other education activities as provided by law, the Statute and the University’s regulations. The Faculties also cooperate with Departments to organise Doctoral Programmes.

2. Faculties are composed of:

a) the Dean;b) the Faculty Board;c) Degree Programme Councils, Specialisation School Councils and Steering Councils.

3. The education regulations applicable to courses are established by the University’s General Regulations, in accordance with current legislation and regulatory provisions.

4. Faculties are designated as cost centres as provided by the University’s regulation concerning

administration, finance and accounting.

ART. 25THE DEAN

1. The Dean represents the Faculty, promotes and coordinates its activities, supervises its regular functioning and sees to the execution of the Faculty Board’s decisions. In particular the Dean:a) convenes and chairs the Faculty Board, setting the agenda;b) ensures that the relevant laws, this Statute and various University regulations are respected;c) supervises the proper performance of the Faculty’s educational activities, with the collaboration of

the Presidents of Degree Programme Councils, Specialisation School Councils and Steering Councils, when available;

d) is a member of the Academic Senate ex officio;e) exercises all other powers under his competence in accordance with legislation, this Statute and

University regulations.

2. The Dean is appointed from among Full Professors entitled to stand as candidates under current legislation, and is appointed by the Rector. The Dean’s term of office is four Academic Years and the Dean is eligible for re-appointment for no more than two subsequent terms. The Dean shall undertake his or her mandate on a full-time basis.

3. The Dean is appointed by Full and Associate Professors. The Committee for the Dean’s appointment

is chaired by the Senior Dean of Faculty. The remaining details of the procedure for appointment are established by the University’s General Regulations.

4. In accordance with the Faculty’s operating needs, the Dean may appoint a Vice-Dean from among the Full Professors, whose task is to assist the Dean and, when delegated to do so by the Dean, to attend sessions of the Faculty Board in the Dean’s place in the event the Dean is prevented from attending or is absent from these sessions.

ART. 26FACULTY BOARD

1. The Faculty Board is composed of tenured Full and Associate Professors. As set forth in the University’s General Regulations, the Faculty Board also includes:- representatives from among Academic Researchers;- representatives from among tenured Professors pursuant to Art. 44, Paragraph 2;- student representatives.

A representative from among the Theology Professors also attends the Faculty Board’s meetings, as set forth in the University’s General Regulations.

A person in charge of technical and administrative tasks within academic and educational services may also be invited to attend the Faculty Board’s meetings, regarding the agenda. The operational methods of each Faculty Board is established by the Faculty’s regulations, as approved by the Board with due regard for the provisions of the University’s General Regulations.

2. The Faculty Board’s tasks include:

a) the arrangement and approval of the Faculty’s development proposals, in order to organise and facilitate the University’s development programmes;

b) the arrangement and organisation of mandatory education activities for teachers, with due regard for the freedom to teach as described in Art. 44, Paragraph 3 below, and supervising the implementation of these activities, in accordance with decisions of the Board of Directors and the Academic Senate, and after consultation with Degree Programme Councils, Specialisation School Councils, Steering Councils, and other concerned structures, in accordance with the matters under their jurisdiction;

c) the designation of no more than three candidates for possible appointment as Rector’s appointment, pursuant to Art. 19, Paragraph 1 above.

d) expressing opinions on the contents of the University’s General Regulations as concerns subjects related to the Education Regulations, and making proposals in accordance with the Faculty Board’s area of competence applicable to the University’s Education Regulations;

e) making proposals on all acts related to the assignment of Teachers to active courses;f) making proposals concerning the maximum number of students to be admitted to courses and

related procedures related to admission to courses;g) making proposals to award Degrees Honoris Causa;h) participation in the organisation and implementation of Doctoral programmes;i) exercising all powers delegated to it by current legislation, this Statute and the University’s General

and Education Regulations.

3. The Faculty Board may also establish a decision-making Committee, in accordance with specific delegated authority and with the University’s General Regulations. The structure of the Committees must guarantee that every member of the Faculty Board is represented in relation to tasks assigned to the Committee.

4. The Faculty Board may establish an International Advisory Board, requesting that Italian or foreign

figures from the scientific, cultural or academic world outside the University, or from professional, institutional or business environments, take part. The International Advisory Board is responsible for promoting the Faculties’ contacts outside the University, in keeping with the relevant University services and organisations. The International Advisory Board is chaired by the Faculty Dean and its organisation is governed by the University’s General Regulations. The International Advisory Board’s members are appointed by the Rector, upon the decision of the Faculty Board.

ART. 27DEGREE PROGRAMME COUNCILS

1. In the Faculties that provide multiple Degree Programmes in multiple venues, Degree Programme Councils may be appointed by the Board of Directors, following a consultation with the Academic Senate, upon a proposal from the Faculty Board.

2. The Degree Programme Councils exercise their powers to promote, organise and manage educational activities as provided by this Statute, by the University’s Education Regulations and as delegated by the Faculty Board.

3. The Degree Programme Councils are comprised of Full and Associate Professors in charge of teaching the pertinent courses. As set forth in the University’s General Regulations, representatives of the Università Cattolica Academic Researchers, representatives of Contract Professors as described in Art. 44, Paragraph 2 below, in charge of teaching pertinent courses, and representatives of students are also members of the Degree Programme Councils. A person in charge of technical and administrative tasks within academic and education services may also be invited to attend the meetings of these Councils, in relation to the agenda.

4. The Presidents of the Degree Programme Councils are appointed from among the Full Professors and Associate Professors, as set forth in the University’s General Regulations. The Councils’ Presidents are appointed by the Rector, hold office for a term of four Academic Years and are eligible for re-appointment for no more than two subsequent terms. The Presidents convene and chair the Councils, supervise the educational activities of each course and monitor the implementation of the Councils’ decisions.

ART. 28SPECIALISATION SCHOOLS

1. The Specialisation Schools are founded to provide a higher level of preparation following the award of a Degree and to legitimate a student’s, qualifications as a Specialist in professional activities.

2. The organisation of the Specialisation Schools is governed by the University’s General Regulations.

Education regulations applicable to the Specialisation Schools are governed by the University’s Education Regulations, upon a proposal of the concerned Faculties.

3. The structure of the Schools includes the Directors and the Schools’ Council. The Director is the Head of the School, and is responsible for its management. The Director is appointed by the School’s Council from Full Professors, or, failing that, from Associate Professors who are members; the Director hold office for a term of four years, and is eligible for re-appointment for no more than two subsequent terms.

4. The School Councils are composed of all the Professors in charge of courses offered by the School, and

of a group of representatives of specialising students, as set forth in the University’s General Regulations.

5. The organisation and functioning of Specialisation Schools set out by applying specific legal regulations are governed by means of specific regulations decided by the Academic Senate, upon a proposal of the Faculties to which the Schools relate, approved by the Board of Directors. In the absence of legal rules, the affiliation to Faculties is identified by decision of the Academic Senate.

ART. 28 bisSCHOOLS OF ADVANCED STUDIES

1. The Schools of Advanced Studies may be founded to achieve a high-level specialised preparation and a scientific and professional formation of excellence, high specialisation structures.

2. The Schools of Advanced Studies are founded and ruled by Rector Decree or by decision of the Academic Senate, after consulting the Board of Directors, upon a proposal of the Faculties concerned, as set forth in the University’s General Regulations.

3. Schools of Advanced Studies may:a) arrange post-lauream advanced training courses awarding an appropriate certificate;b) propose to the pertinent education and research structures the establishment of Master’s Degree

Programmes, Specialising Master Programmes and Doctoral Programmes and they shall participate in or arrange for their implementation. The collaboration of the above-mentioned schools in the implementation of these courses is mentioned in the corresponding Degrees, if allowed by current rules;

c) carry out specialised research activities related to scientific and professional training paths, regularly taking advantage of the research structures of the Università Cattolica del Sacro Cuore.

ART. 29ADVANCED TRAINING COURSES

1. In order to meet the needs of cultural formation and training or re-training in specific sectors, post-lauream Advanced Training Courses may be established, and agreements for Advanced Training Courses may be entered into with other bodies and institutions.

2. The Courses referred to in this Article are to be established by Rector’s Decree, and by decision of the

Steering Committee in accordance with the Decree, upon consultation with the Academic Senate, following a proposal of the concerned Faculties. The Decree also establishes the Course organisation as set forth in the University’s Education Regulations.

ART. 30DEPARTMENTS AND INSTITUTES

1. The Departments and the Institutes shall promote and organise the research activities of the University.

2. The Departments are constituted by academic disciplines sharing either subjects of interest or methods. Each Department must have at least five Full or Associate Professors, two of whom must be Full Professors, as affiliated members.

3. The Institutes are based on single-issue scientific topics. At least two Full and Associate Professors must be affiliated members of each Institute, one of whom must be a Full Professor.

3.bis Full and Associate Professors, Academic Researchers of the University from any Faculty and Contract

Professors as described in Art. 44, Paragraph 2 below who are not a full member in a department or institute of another University, may be primarily affiliated to the Departments and Institutes. Full and Associate Professors, Academic Researchers and Contract Professors primarily related to another Department or Institute of the University or a department or institute of another University, may be secondarily affiliated to Departments and Institutes.

3.ter If the number of Professors related to a Department or Institute is lower than the minimum referred to in Paragraphs 2 and 3 above, the Institute or Department is merged into already-existing ones, by decision of the Board of Directors, after consulting the Academic Senate. If the merger is not possible, the Rector, by his own Decree, arranges the Department’s or Institute’s elimination, after consulting the Academic Senate and the Board of Directors. The Board of Directors, after consulting the Academic Senate, can authorise the preservation of Departments or Institutes not meeting such requirements for a specified period, not exceeding one Academic Year, in consideration of their scientific or research relevance.

4. The Departments and the Institutes promote and coordinate research activities whether commissioned by the University or by third parties, with due regard for the autonomy of each Professor and Academic Researcher and for their right to directly access research funding, as set forth in the University’s General Regulations.

5. The Departments participate in the organisation and financing of Doctorate Courses. 6. The structure of each Department or Institute includes:

a) a Director;b) the Board of each Department or Institute, and, if in existence, the Department or Institute Council.

7. With reference to the performance of their ordinary functions, the Departments and the Institutes have at their disposal a specific budget, established annually as part of the economic and financial planning of the University. These bodies may also use other resources made available through research contracts or agreements, or through donations, as set forth in the University’s regulations concerning administration, finance and accounting. Departments and Institutes are identified as cost centres for the purposes set forth in this regulation.

ART. 31DEPARTMENT OR INSTITUTE DIRECTORS

1. The Department or Institute Director is appointed by the Board of each Department or Institute from the University’s Full Professors who are primarily affiliated to the Department or Institute, as set forth in the University’s General Regulations, and is appointed by the Rector.

2. The Director shall hold office for a term of four Academic Years and is eligible for re-appointment for no more than two subsequent terms.

3. The Director:

a) proposes general research guidelines;b) chairs the Board and, if in existence, the Council, and supervises the implementation of the decisions

of these Bodies;c) supervises the functioning of the Department or Institute;d) ensures compliance with legislation, this Statute and regulatory provisions;e) maintains relations with Governing Bodies and other structures of the University.

4. The Director, in accordance with the financial needs of the Department or Institute, may appoint a Deputy Director from among tenured Professors, whose task is to assist the Director.

5. In the event of the Director is prevented from attending or is absent from meetings of the Board, the

Director’s position is assumed by the Full Professor with the longest service as a University Professor, who also chairs the Committee for the Director’s appointment. The provisions provided by current regulations in the event of the Director being prevented from attending or being absent shall remain valid.

ART. 32DEPARTMENT OR INSTITUTE BOARD

1. Department Boards are composed of:- Full and Associate Professors and Academic Researchers who are primarily affiliated to the

Department;- a group of representatives of Contract Professors, as described in Art. 44, Paragraph 2 below, who

are primarily affiliated to the Department, as set forth in the University’s General Regulations;- a representative of students enrolled in Doctoral Programmes, provided that the administration of

the Doctoral Programmes is located at the Università Cattolica del Sacro Cuore, affiliated to the Department. Student affiliations to each Department are established by the Doctorate Teaching Body.

Full and Associate Professors, Academic Researchers and Contract Professors secondarily affiliated to the Department may be invited by the Department Board to take part in meetings without voting.

A person in charge of technical and administrative tasks within academic and education services may also be invited to attend the meetings of the Department Board with regard to the agenda.

2. Institute Boards are composed of:

- Full and Associate Professors who are primarily affiliated to the Institute;- representatives of Contract Professors who are primarily affiliated to the Institute, as set forth in the

University’s General Regulations. Full and Associate Professors, Academic Researchers and Contract Professors secondarily affiliated to

the Institute may be invited by the Institute Board to take part in meetings without voting.

3. The Board plans the activities of the Department or Institute and exercises all other powers, as set forth

in the legislation, this Statute and regulations. 4. In accordance with the Department’s or Institute’s operating needs, the Board may also appoint a

Council, constituted in conformity with the University’s General Regulations.

ART. 33RESEARCH ACTIVITY COORDINATION

1. In agreement with the Academic Senate, the Rector periodically convenes a meeting, at least once a year, of Directors of Departments, Institutes and Research Centres to promote the coordination of research activity and the circulation of information relevant to research information.

ART. 34RESEARCH CENTRES AND INTER-UNIVERSITY CENTRES

1. The Research Centres are structures created to promote and perform activities directed to specific goals, in which Professors and Academic Researchers affiliated with several Departments and Institutes can take part.

2. The Research Centres may be established in collaboration with other Academic or non-Academic Institutions.

3. The establishment and organisation of the Research Centres and Inter-University Centres are provided

for in specific Statute decided on by the Steering Committee, in agreement with the Academic Senate, upon a proposal of the relevant Faculty Boards.

ART. 35LIBRARY AND DOCUMENT SYSTEM

1. The Central Library and the other library and documentary systems of the Università Cattolica represent a single system, by means of which the Università Cattolica promotes and develops, in an integrated and coordinated fashion, activities concerning the acquisition, use, conservation, production and transmission of bibliographical and documentary information in order to support educational and research activities.

2. The organisation and management of the University’s library and documentary system are provided for

by the University’s General Regulations.

ART. 36ACADEMIC ASSESSMENT TEAM

1. An Academic Assessment Team is established to assess the outcomes of the education and research activities of the Università Cattolica.

2. The Team’s composition and the specific aims of its activities, together with the corresponding

assessment parameters, are established by the University’s General Regulations.

3. The Academic Assessment Team shall perform its functions as provided by guidelines established by

the Board of Directors and the Academic Senate, and in agreement with the Faculty Deans and the Department, Institute and Research Centre Directors.

ART. 37A. GEMELLI GENERAL HOSPITAL

1. The General Hospital is organised and managed with due regard for current legislation, in accordance with principles of Catholic doctrine and consistent with the institutional purposes of the Università Cattolica. Under current legislation, the General Hospital, with its related structures, is a high specialisation hospital of national significance.

2. The General Hospital, a special management structure of the Università Cattolica, is the site of educational activities and biomedical and healthcare research activities, which are strictly connected to the activities of the A. Gemelli Faculty of Medicine and Surgery.

3. Performance of the General Hospital’s activities is conducted by the Gemelli Foundation, which carries out all research, training and healthcare assistance activities in its own name, operating by agreement with the Università Cattolica and, in particular, with the A. Gemelli Faculty of Medicine and Surgery, to promote scientific training and research in the biomedical and healthcare sectors.

4. In order to assess and ultimately achieve the consistency of the General Hospital’s activities and the principles of Catholic doctrine, and also the consistency of these activities with the institutional purposes, strategies and goals of the Università Cattolica, the Rector convenes meetings with the President of the Gemelli Foundation and with the administrative Heads of the Università Cattolica and of the General Hospital.

5. The relationship between the Università Cattolica and the Gemelli Foundation is subject to specific agreements.

1. The Università Cattolica relies on the Ethics Committee, created as an independent body of the Gemelli Foundation at the General Hospital, and the A. Gemelli Faculty of Medicine and Surgery to assess the following, as set forth in the University’s General Regulations:a) ethical standards governing clinical trial programmes concerning medicines or new diagnostic and

therapeutic methods tested on human patients, in order to protect the safety, integrity and human rights of the subjects involved in such programmes;

b) the compatibility of animal testing with research projects, except that specifically-appointed ad hoc Committees and Commissions are also consulted to assess animal testing.

TITLE IVPROFESSORS AND RESEARCHERS

ART. 44TEACHINGS

1. The Teachings are conducted by Full and Associate Professors from the Università Cattolica. Courses may also be taught by Aggregate Professors or Substitute Professors, in accordance with current regulations.

2. If it is impracticable to carry out teaching as provided in Paragraph 1 of this Article, teaching assignments

may be contracted through private law contracts to Professors from other Universities or to persons, Italian or foreign, with exemplary scientific or professional qualifications.

3. The freedom to teach protects Professors from any form of undue influence as concerns their choice

of the content of their educational activity, except for limitations imposed by consistency regarding education systems.

4. Teaching at the Università Cattolica implies a respect for the guiding principles of the University.

ART. 45APPRECIATION OF ECCLESIASTICAL AUTHORITY

1. From a religious point of view, the appointments of persons to teaching posts at the Università Cattolica are subject to a proper appreciation of the competent Ecclesiastical Authority, pursuant to Art. 10, n. 3

of the revised Agreement between the Italian Republic and the Holy See, signed on February 18, 1984 and ratified by the Law of March 25, 1985, n. 21.

2. In applying Art. 10, n. 3 of the revised Agreement between the Italian Republic and the Holy See,

the Università Cattolica, as set forth in the Additional Protocol to that Agreement, shall comply with Judgment n. 195/1972 of the Constitutional Court related to the same Article.

ART. 46REGULATIONS, REMUNERATION AND RETIREMENT PENSION

1. The legal status, remuneration and retirement pension of tenured Professors and Academic Researchers at the Università Cattolica are established by legislation, including the forecasts referred to in Art. 4 of the Law of July 29, 1991, n. 243, concerning tenured Professors and Academic Researchers from State Universities, except for any more favourable Agreements as provided for by the Board of Directors.

2. In exercising the disciplinary responsibilities within its jurisdiction, the Academic Senate is integrated

with a group of representatives of the category of persons to which the person accused of wrongdoing belongs, as set forth in the University’s General Regulations.

3. The remuneration to which Assistant, Substitute or Contract Professors are entitled is decided annually

by the Steering Committee. 4. The Steering Committee may also provide the Rector and the Professors in charge of executive offices

with a service allowance. ART. 47WORKFORCE

1. The Tenured Professor and Academic Research positions in each Faculty are identified in Table A annexed to this Statute. The positions referred to in Table A may be modified upon a proposal by the concerned Faculties, and upon consultation with the Academic Senate, by a decision of the Board of Directors.

TITLE VADMINISTRATIVE ORGANISATION

ART. 48MANAGING DIRECTOR

1. The Managing Director is appointed by the Board of Directors, upon a proposal by the Rector. 2. The Managing Director performs the following functions:

a) Heading the University’s offices and services, and managing and coordinating their activities;b) Providing general guidance to and coordination with Campus Directors and other Directors, and

guidance, direction and supervision of the administrative and technical staff;c) Establishing the organisational criteria of offices, in line with the Rector’s directives and with decisions

taken by the Board of Directors and the Steering Committee;

d) Advancing proposals to the Bodies of the Università Cattolica regarding the organisation of services and workforce;

e) Implementing the decisions of the Governing Bodies of the Università Cattolica;f) Participating in the collegial bodies’ meetings, as set forth in this Statute;g) Ensuring that legislative and regulatory provisions are respected.

ART. 49ADMINISTRATIVE STRUCTURES

1. The administrative organisation of the University is established by the Board of Directors. 2. The duties, functions, responsibilities and jurisdiction of the administrative structures and their directors

are established by the Board of Directors, which also determines their level of autonomy and domains of responsibility.

3. The administrative organisation of the University is based on its unity of government, following long-

standing tradition, and supports the national development of the Università Cattolica del Sacro Cuore, with special attention to the particular nature of each campus. The administrative organisation is, at the central University level, led by the Managing Director and, locally, by Campus Directors.

4. The University’s work relationship with its administrative and technical staff is governed by contracts

negotiated and entered into by the Steering Committee.

ART. 50CAMPUS DIRECTORS

1. Campus Directors are responsible for the management of their particular campuses and for achieving the goals of the local campuses, as assigned in accordance with the general guidelines and in coordination with the Managing Director, and as established by the Board of Directors.

2. Campus Directors are appointed by the Rector, by decision of the Board of Directors, upon a proposal

from the Managing Director. ART. 51ADMINISTRATIVE MANAGEMENT CONTROLS 1. Regarding the management of its staff, physical plant and financial resources, the Università Cattolica

adopts the methods of multi-annual programming and management controls, employing specific techniques to achieve the highest levels of efficiency.

2. The results of management controls and administrative activities must be assessed by the University’s

Governing Bodies, by means of the Academic Assessment Team, referred to in Article 36 above. 3. In order to achieve the goals referred to in the previous Paragraphs, the Università Cattolica employs

specific cost and performance indicators ensuring the accurate measurement of the efficiency, affordability and proper implementation of management activities.

4. The methods for the implementation of the procedures referred to in this Article are to be in keeping

with the University’s General Regulation.

TITLE VISTUDENTS

ART. 52PRINCIPLES OF CON DUCT

1. Students at the Università Cattolica are required to respect with conscious effort the cultural, scientific and educational goals of the University, together with its Catholic belonging, and, with due regard for respect of individual freedom, they are also required to promote these goals, in loyal and fruitful cooperation with all of the University’s components.

ART. 53PARTICIPATION IN AND COLLABORATION WITH ACADEMIC ACTIVITIES

1. Students participate in the organisation of activities at the Università Cattolica by means of their representatives in the Governing Bodies and the Boards of the educational structures, as set forth in this Statute and in the University’s General Regulations.

2. Without prejudice to the provisions of Art. 60 below, the Rector or his delegates consult with student

representatives from each campus serving in the Bodies referred to in the previous Paragraph concerning subjects of general interest for students and, in particular, those subjects referred to in Arts. 54, 56, 57 and 58 below.

3. The Università Cattolica is entitled to benefit from student participation in authorised activities, whether

or not those activities are conducted under an agreement or agreements with outside public or private bodies.

4. The provisions related to student participation in the University’s activities are included in the University’s

General Regulations. 5. The Università Cattolica supports the initiatives of recognised non-profit student unions which promote

activities contributing to the goals of the University, whether these activities are of a local, regional, national or international character.

6. Study, meeting and rest areas are available for students within university structures, together with

locations for student unions and associations, in accordance with the conditions set forth in the University’s General Regulations.

ART. 54TUTORING

1. Tutoring at the Università Cattolica is conducted as a responsibility of the Boards of the educational structures. Tutoring services are governed by provisions of the University’s General Regulations.

ART. 55STUDENT DISCIPLINE

1. The University’s Education Regulations identify violations of those regulations and related disciplinary penalties applicable to students, the Bodies with jurisdiction over alleged violations, and related procedures, in conformity with current principles and legal regulations.

ART. 56FEES AND CONTRIBUTIONS

1. The Board of Directors, upon consultation with the Academic Senate, makes an annual decision related to the fees and contributions to be made by students, not inferior to the one legally established for State Universities.

ART. 57ADMISSION PROCEDURES

1. The Board of Directors, considering the needs of the educational and scientific research structures of the Università Cattolica and its Faculties, if appropriate, annually establishes the maximum number of students to be admitted to first-year programmes in each Faculty, upon a proposal by the relevant Board, and upon consultation with the Academic Senate.

2. In addition, the Board of Directors, upon proposal by the Boards of the concerned Faculties, and upon

consultation with the Academic Senate, establishes admission procedures appropriate for assessing the attitudes and preparation of candidates.

3. Using the same procedures, the Board of Directors also decides annually the proper number of students

allowed to transfer from other Universities or to transfer from one Faculty in the University to another, and the procedures governing such transfers.

ART. 58PROMOTION OF EMPLOYMENT OPPORTUNITIESAND COLLABORATION WITH GRADUATES

1. The Università Cattolica implements services intended to promote the integration of graduating students or recent graduates, at all levels, into the labour market. To this end, activities meant to promote the broadest possible relationships between the Università Cattolica and representatives of the labour market are established. The Università Cattolica, with the cooperation of graduate student associations, develops collaboration and relationships between such associations and the University.

TITLE VIICOMMON, FINAL AND TRANSITORY NORMS

ART. 59 AMENDMENTS TO STATUTE

1. The modifications to the present Statute are decided by an absolute majority of the Board of Directors, upon a proposal of the integrated Academic Senate, upon consultation with the Boards of the concerned Faculties for matters within their competence.

ART. 60REGULATIONS OF THE UNIVERSITÀ CATTOLICA

1. Within one year from the entry into force of the present Statute and in accordance with them, the University’s General Regulations are decided by the Board of Directors, upon a proposal of the Academic Senate, and upon consultation with the Faculty Boards, and the representatives of student unions and staff trade union organisations for those portions of the Statute within their competence.

2. Within six months from the entry into force of the University’s General Regulations, the Academic Senate,

upon consultation with the Board of Directors, upon a proposal of each Faculty for those portions of the Education Regulations within their competence, and upon consultation with the representatives of student unions and staff trade union organisations for those portions within their competence, decides on the University’s Education Regulations.

3. Within the same six-month period referred to in the Paragraph, the Board of Directors decides on

the University’s Regulations regarding administration, finance and accounting, upon a proposal of the Steering Committee, and upon consultation with the Academic Senate for the portion of those Regulations within its competence.

4. Any modifications to the Regulations referred to in the aforementioned Paragraphs are adopted using

the procedures respectively established for their approval. 5. Faculty Regulations referred to in Art. 26, Paragraph 1 are also adopted, together with any other

Regulations relating to educational and research structures as set forth in the Regulations referred to in the first and second Paragraphs of this Article.

6. The Regulations referred to in this Article are issued by Rector’s Decree.

ART. 61PROVISIONS APPLIED AS TRANSITORY MEASURES 1. Until the entry into force of the Regulations referred to in Article 60, current norms, unless incompatible

with this Statute shall continue to be applied for relevant matters.

2. Decisions relating to the appointment and the term of office of the Rector, and of the Deans, the Presidents of Degree Programme Councils and the Directors of Departments and Institutes, shall apply with effect from the first re-appointment to office after the entry into force of this Statute.

3. The transitory measures laid down in the Constituent Act of Foundation of November 21, 2014, or any modification of or addition to that Act, are applied to the activities of the Gemelli Foundation as described in Art. 37 above.

ART. 62SPECIAL PURPOSE SCHOOLS

ART. 63ASSISTANTS WITH DEFINITE TENURE

1. The provisions regarding Academic Researchers shall also be applied to Academic Assistants with definite tenure.

ART. 64DEVOLUTION OF ASSETS

1. If the Università Cattolica were for any reason to cease legal existence or be deprived of its legal personality or its autonomy or character as the Università Cattolica, its assets shall devolve to the Giuseppe Toniolo Institute for Higher Education, or, if it should cease to exist, to another not-for-profit body performing similar institutional activities and with cultural and Catholic purposes as decided by the Holy See.

ART. 65ENTRY INTO FORCE

1. This Statute shall enter into force on the thirtieth day following its publication in the Official Gazette.
