In exercise of the powers conferred by subsection

4 of Section 56, read with Section 33, of the ßharathidasan

Univo risty Act, 1981 (Tamil Nado Act, 2 of 1982), the first Vice-

Chancellor of the Bharathidasan University, Tiruchirappalli,

hereby makes the following statures for consideration and

approval of the competent acthorities.

LAWS OF THE UNIVERSITY [P1 aiii PRELIMINARY

1. She,? Title and Commencement

(i) These laws shaiF be called "the Laws of tile Bharathidasan University'

(b) They shall come into force from the date of assent of the Chancellor.

2. Definitions

(a) The Laws of the University means the provisions and rules laid down in the Act, the Statutes, the Ordinances and the Regulations.

(b) 'The Act ' means the Sharathidasan University Act 1981 (Tamil NaduAct2 011982); Seclion'meansasection of the Act; Clause means a subdivision of the Statutes, the Ordinances or the Regulations.

(c) The Gazette means the Tamil Nadu Government Gazette.

(d) ' Clear days means the number of days to be reckoned exclusive of both the first and the last days.

(e) Resolution means substantive proposition originally moved or finally adopted

(f) Motion means anything moved either by way of resolution or amendment.

(g) Academic year' means a period of tweive months commencing from the first day oJune:



Provided that in the case of teachers who are granted extension of service till the end of the academic year the academic year shall mean the period of ten months from the first day of June

(h) ' Financial year means a period of twe've months commencing from the first day of Apnl every year.

(i) Department ' means a Bharattiidasan University Department of study and/or Research ora Department Íunctionng fora specific purpose maintained from out of the Bharathidasan University Fund.

(j) 'I-lead of Department means the officer in charge of a Department responsible for its administration including its day- to-day working.

(k) School of excellence means an institution, governed by a separate Board of Governors and registered under Societies Registration Act, sponsored by and affiliated to the University for Postgraduate Study and Research.

(t) ' University emp'oyee ' means every erson in the whole-time emptoyment of the University (other than a person so employed in the contingent or work establishment) and, paid for from the Bharathidasan University Fund.

(m) ' Officers '. ' authorities and servants ' mean respectively the offcers, authorities, and servants of the University.

All other words and expressions used but not defined in

these statutes shall have the meamngs respectively assigned to them in the Act.

Any notice, intimation, or information required to be given and any paper, minutes or proceedings required to be sent to

4. Addresses

Every officer of the Unrversìty and every member cf a

University authority or body appointed under the Laws, or any candidate for any examination for a course of study or for any Convocation shall furnish to the Registrar or any other oflcer so designated for that specific purpose, his postal address and subsequent changes if any, thereon to which communications intended to him from the Universily aleto be sent and despatch as stipulated in statute 3 shall be sufficient compliance with the requirements of the Laws asto notice.

5. Validity of acts done on the day following Dies non:

Where, by any Law, any act or proceeding is directed or allowed to be done or taken in the office of the University or in any statutory office on a certain day crwithìn a prescribed period. and the office is closed on that day or the last day of the prescribed period, the act or proceeding shalt be considered as done or taken in due time if it is done or taken on the day on which the office reopens.

6. Hours of Business

The office of the University and the University department of study and/or research shaR be open for transaction of business generally between 10-00 hours and 17-00 hours or as fixed by the Vice-Chancellor from time to trine by an executive order on

all days except Sundays and Gazetted holidays of the Government and such other holidays as may be declared by the Government. The office of the University and the University departments may be closed fora day or part ofaday on particular occasions at the discretion of the Vice-Chancellor, provided that arrangements are made for the transaction of any urgent business. In the case of teachers who have definite class work outside the prescribed hours the hours may be suitably modified ¡n each case with the approval of the Vice-Chancellor.



II

(a) THE VICE-CHANCELLOR

General

t The Vice-Chancellor shall be the academic and adminstrative head and chief executive officer of the University.

2. n addition to the powers and duties coiferred on the Vice-Chancellor by the Act, as provided in sub-section 8 of Section 13. ii shall be competent to the Vice-Chancellor to

(a) sanction the creation of alt technical and non- technical posts other than those specified in Section 9 of the Act subject to provision for the same in the budget;

(b) create and/or fill temporary posts of all categories (other than those specified in Section 9 of the Act) for a period not exceeding one year at a time subject to the provision of the same in the budget;

(C) abolish or retrench such posts which are considered superfluous in the University subject to the protection given lo the individuas in such posts.

3. He shall have power -

(a) to constitute ad-hoc committees forany specific purpose;

(b) to depute officers, teachers and other employees of the University on University work;

(c) to permit the teachers and officersto attend the meetings and conferences recogniseti by the University within and outside the State;

(d) to recommend and forward to the University Grants Commission and Union Ministry of Education, the

proposals made by the University teaching departments. constitutent and affiliated colleges and other recognised institutions for grant of financial assistance under various schemes.

4. He shall have power -

(a) to sanction casual leave to the officers and heads of departments of the University:

(b) lo sanction leave of all kinds otherthan casual, to the employees of the University;

(C) to sanction honorarium Io the subordinate staff.

5. He shall have power to authoiise the publication of results of the examinations

6. He shall have power to delegate the powers and duties of any officer of the University (in the interest of efficient working) to some other officer of the University whenever he deems fit, notwithstanding anything contained in the1 statutes, ordinance and regulations franied under the Act of the University.

7. The Vice-Chancellor may visit or cause ari inspection and ask for a report -

(i) on the general condition and teaching equipment of any institution or college maintained or recognised by or affiliated to the University or any hostel;

(ii) for the purpose of according t recognition ; and

(iii) for negotiating the terms and conditions for the 'aking over of any institution by the UnìversJty

8. The Vice-Chancellorshall becompetenitotransferany employee or post from one institution or department maintained

by the University lo another such institution or department maintained by the University.

9. The Vice-Chancellor shall make arrangements for the additional charge in all cave vacancies and such other temporary vacancies where appointment of substitutes are not required.

10. The Vice-Chancellor shall declare the satisfactory completion of the probation of the teachers and officers of the University provided the necessary formalities prescribed for each category are observed strictly.

11. The Vice-Chancellor shall have power to grant advance increments not exceeding five increments at a lime, on the basis of the recommendation of the Selection Committee constituted for the selection of candidates.

12. The Vice-Chancellor shall arrange to get the names of two persons nominated one each by the Senate and Syndicate as required in sub-section (2) of Section 12 of the Act and shall intimate the names lo the Chancellor three months prior to the expiry of his term of office.

13. Financial

The Vice-Chancellor shall have power-

(a) Io sanction grants to researchers and fellowships from the fund and funds placed at the disposal of the Universfty by the Government or by other agencies for the said purpose;

(b) Io sanction deputation of delegates to conferences and seminars etc., conducted in other parts of India

(c) to sanction the convening of seminars, conferences, committees, discussion groups etc., the expenditure on each part not exceeding Rs. 25000/-

(d) to sanction advances for the principal investigators of 6



schemes and projects which are financed by the outside agencies and report to the syndicate ¡n its next meeting;

(e) to accord administrative sanction for all works, original or repairs, up to a maximum estimate of Rs.1 00,000 provided the following conthtions are satisfied

(i) the work is one included in a scheme approved by the Syndicate;

(ii) funds have been provided in the University budget

(f) to accept tenders for work or tenders or quotations for supplies required up to an estimate of Rs500000 and to record the reasons if they are not the lowest of the tenders or quotations received

(g) to sanction any expenditure upto Rs. 20,C00 and reappropriation of funds upto Rs1,C0000 from one liajor head to another, provided that such sanction and the reappropriation do not involve a liability which extends beyond the financial year in question;

(h) to sanction loans and advances to employees of the University provided all conditions prescribed by the Syndicate ace satisfied

(i) to sanction reimbursement of amounts spent by the employees of the University (or the purpose of medical treatment according to the rules in force in the Government of Tamil Nadu

(j) to sanction permanent advances of the officers and heads of departments in University;

(k) to countersign the TA. bills of the Registrar, the Finance Officer, the Controllerof Examinations, Deans of Facullies and Heads of the Departments in the University

(I) to authorise opening of new Heads of Accounts foi projects financed by outside agencies and whei necessary to permit the opening of separate accounts in the scheduled banks for this purpose

(m) to open new Heads of Accounts, ¡1 there is an urgency and report to the Finance Committee;

(n) to effect purchase of patent equipment/machines. instruments and other such goods provided there is budgetary allocation and report to the appropriate bathes;

(o) to sanction refund of deposits of earnest moneys. securities etc., on the basis of the recommendation of Heads of Departments

(p) the Vice-Chancellor shall have such other financial powers as may be delegated by the Syndicate from time to time;

(q) the Vice-Chancellor shall have power to write off the irrecoverable value of shortage of stock or irrecoverable loss of money occasioned by fraud or neglect of duty by the University employee or otherwise upto a total amount of Rs. 1,000 in a year If the amount to be written off in

a year exceeds Rs 1,000 the Syndicate shall accord the necessary sanction for the purpose.

14. The Vice-Chancellor may delegate to an officer of the University or body or committee any of his administrative powers and functions, otherihan those to be exercised by himself under the Act and shall as and when report to the Syndicate for i n format ion

15. Representation of the University in other organisations

The Vice-Chancellor shall be the representative of the University on the Association of ndian Universities, Association ofCommonwealth Universities and othersimilarbodiesorother

associations in India or abroad. tn case he is unable to attend meetings be may depute a person/officer of the University to represent the University at such meetings with the concurrence of the Chancellor.

16. Deputation of Vice-Chance//or

The Vice-Chancellor may be deputed by the Syndicate on University business or at the request of the Government on Government business or in the public interest to any part of lnda or outside India. The period of deputation outside Sbarathidasan University area shall not exceed one month each time.

II shall be competent for the Syndicate to make the requisite arrangements for exercising the powers and performing the duUes of the Vice-Chancellor during the period of deputation, with the approval of the ChanceHor provided that the arrangements made shall be such as not to entail any additional expenditure to the University.

17. The Vice-Chancellor shall also exercise all such powers not expressly mentioned herein which are necessary for or incidental to the carrying on of the administration of the University and its affairs and report to the appropriate authorities of the action taken.

18. Leave

The Chancellor shall sanction all leave except casual leave lo the Vice-Chancellor.

(b) THE REGISTRAR

1. Appointment of Registrar:

The Registrar shall be appointed by the Syndicate on the recommendation of a selection committee consisting of the ViceChanceIlor as the Chairman, one Syndicate member, and one person nominated by the Chancellor from outside the University. His term of appointment shall be for a period of 3

years. He shall be eligible for reappointment for anotherterm of three years, bythe Syndicate, on a specific recommendation of the Vice-Chancellor.

2. 'The Registrar shall be paid a salary in the scale of pay applicable to the University Frofessorfrorn time to time.

3. The Registrar shall be governed as regards leave, provident fund, pension, insurance, retirement benefits and disciplinary proceedings by the statutes governing the conditions of service of the University Employees.

The Registrar shall be responsible to the Vice-Chancellor in the exercise of the powers and duties presented to him in the Act/Laws

5. The Registrar, subject to the immediate direction and control Of the Vice-Chancellor, shall carry out his orders and render such assistance as may be required by the Vice- Chancellor in the performance of his official duties.

6. 2 Subject to the immediate direction and control of the Vice-Chancellor, the Registrar shall be in overall chage of the administration of the University oíflce and 5hall have power to fix and define the functions and duties of the officers and employees cf the University, other than those working under the direct supervis ton of the Controller of Examinations and Finance Officer, or those working in the Vice-Chancellors Secretariat, with the

approval of the Vice-Chancellor.

7. Being the officer in overa charge of administration of the University office, he shall lake all steps for the efficient working of the University office, subject to the approval of the Vice- Chancellor.

8. He shall sanction the indent for stationery articles from the University Stores orto purchase them from the Government or Co-operative Stores.

9. He shall call foc quotations and tenders wherever necessary and prepare comparative statements, scrutinise the quotations and tenders in consultation wtth the Finance Officer and make recommendations to the Vice-Chancellor for accepting quotations/tenders.

'tO. He shall sign contracts and other agreements on behalf of the University under the direction of the Vice-Chancellor or Syndicate, as the case may be.

11. The Registrar shall not be eligible for nomination or election or for appointment as a member of any of the authorities of the University.

12. Resignation/Reversion: The Registrar may, by writing, iiìform the Vice-Chancellor his intention to resign or reveil back to his parent department alter giving three months notice and it shall be competent forthe Syndicate, on the recommendation of the Vice-Chancellor, to accept his resignation or reversion.

13. lt shall be in the power cf the Syndicate lo dispense with the services of the Registrar at anytime on payment to him of six months salary and it may at any time discharge him from its services without notice or compensation in the event of misconduct on his part or of a breach by him of any of the conditions on which he was engaged. In the case of Registrar appointed on deputation from other services the Syndicate is

competent to revert him to his original department when it deems fit to do so

14. The Registrar shall, on application previously made for the purpose of fixing a convenient houí, arrange thai any member of the Senate, of the Syndicate, of the Standing Committee on Academic Affairs, of a Faculty, shall have access to the proceedings of the Senate, Syndicate, Standing Committee on Academic Affairs, or Faculty, respectively, and to any documenis connected with such proceedings.

(G) THE FINANCE OFFICER

Appointment

(a) The Finance Officershall be a Whole-time salaried officer of the University appointed by the Syndicate for such period as may be specified by the Syndicate in this behalf.

(b) Every appointment of the Finance Officer shall be made by the Syndicate from out of the panel of three names recommended by the Government.

2. Powers and Functions

(a) The Finance Officer shall be responsible to the Vice- Chancellor in the exercise of the powers and duties prescribed to him in the Laws of the University and shall be subject to the general direction and control of the Vice-Chancellor.

(b) He shall make all arrlligements for the transaction of business for the meeting of the Finance Committee

(c) He shall be responsible for the proper maintenance of the Accounts of the University, to make arrangements for the Audit and payment of bills presented at the University Office.

(d) He shall arrange to settle objections raised by the Audit appointed by the Government and carry out such instructions as may be issued by the Vice-Chancetlor / Syndicate on that Audit Report.

(e) He shall make arrangements with the approval of the Vice-Chancellor forthe publication of the Audited Statement of Accounts so that it may be submitted to the Government and other appropriate authorities of the University within three months of such publication.

(f) The Finance Officer shall prepare the monthly

acóounts of the University and shall produce for audit, which is

concurrent, all the registers and accounts and records connected with financial transactions.

(g) He shall be responsible for the preparation of annual accounts, financial estimates and the budget of the University in

consultation with the Vice-Chancellor before presenting them to the Finance Committee and the Syndicate. In the matter of financial estimates, he shall consult the Registrar and shall obtain from him the estimates for the year from the departments and institutions of the University.

(h) He shall arrange for the annual stock verification. For this purpose, he shall submit to the Vice-Chancellor in November of each year, proposals for the appointment of stock verifiers for various departments, sections, etc. He shall ensure that the stock verification as on 31st March is conducted regularly before the end of June every year. The report of stock verification shall be placed before the Vice-Chancellor for orders.

(i) The Finance Officer shall -

(i) With approval of the Vice-Chancellor invest amount not exceeding Rs.L00000/- only at a time and shall report to the FInance Committee and the Syndicate immediately thereof;

(ii) Scrutin ise every item of new expenditure not provided for in the budget estimate of the University and shall suggest appropriate action to the Vice-Chancellor;

(iii) Realise and receive grants or other moneys due to the University from Central and State Government, University Grants Commision and other bodies, institutions and individuals;

(iv) Disburse all salary bil's including arrears of salary not exceeding one year, contingeit bills like electricity, water, land and municipal tax, phone ani other rental bills, recoup permanent advances, payment of .311 TA. Bills after ensuring that general sanction is received from the competent authorities;

(y) Make all authorised payments cut of the University funds;

(vi) The Finance Officer shall draw cheques oil his own signature, and the Assistant Finance Officer/Assistant Registrar authorised by the Finance Officer shall draw cheques of value not more than Rs.500/- (Rupees five hundred only) on prepassed bills, in addition to the Finance Officer;

(j) Heshall adopt, with the approvai ofthe Vice-Chancellor. method of accounting or forms or registers for the proper

accounting in the University office and in the departments and research centres maintained by the University.

(k) The Finance Officer shall exercise the power conferred on him under Section1 1 5(8)(h) of the Act on the approval of the Vice-Chancellor.

(I) lt shall be his duty to scrulinise the quotations and tenders rece ved countersign the comparative statement and make recommendations to the Vice-Chancellor for accepting the tenders, quotations or otherwise.

(m) (i)Tomeetthedaytodayrequirementsofthe Finance Section, he shall sanction petty claims of contigent expenditure upto Rs.2001- only at a time.

(ii) F-le shall, after obtaining necessary quotations, sanction purchases for the Finance Section not exceeding Rs.2,000/- only if such purchases are urgent and if budgetary provision is available

(iii) He shall, with the approval of the Vice-Chancellor, sanction payment of bills submitted by the Department of the Government and the co-operative bodies for supplies effected on the basis of orders placed by competent authorities of the University subject to budget allotment.

3. The Finance Officer shall not be eligible for election oc

nomination as a member to any of the authonties of the University.

(d) THE CONTROLLER OF EXAMINATIONS

1. Mode ofAppoThtment The Controller of Examinations shall be appointed by the Syndicate on the recommendation of a

Selection Committee consisting of the Vice-Chancellor as Chairman, one member of the Syndicate nd one nominee of the Chancellor from outside the University, fora period of three years. He shall be eligible for reappointment for another term of three years on the specific recommendation of Vice-Chancellor.

2. The holder of the post of the Controller of Examinations shall be an academician not lower in rank than that of a professor of an affiliated college.

3. The emoluments and other terms and conditions of service of the Controller of Examinations sha be such as may be prescribed by the ordinances:

Provided that the Controller of Examinations shall retire on attaining the age of 58 or on the expiry of the period specified by the Syndicate whichever is earlier.

4. When the office of the Controller of Examinations is

vacant, or when the Controller of Examinations is, by reasons of illness, absence or any other cause, unable to perform the duties of his office, the duties of the office of the Controller of Examinations shall be performed by such person as the Vice- Chancellor may appoint for the purpose.

5. Powers and Duties

The Controller of Examinations shall -

(a) be responsible for the conduct of all University Examinations as prescribed by the authorities of the University and it shall be his duty to arrange with prior approval of the Vice- Chancellor the Schedule for the preparation, for all University Examinations and aU other matters connected with University Examinations.

(b) He shall be responsible for the safe custody of all papers, documents, certificates and other confidential files connected with the conduct of all University Examinations.

(C) He shall keep the Minutes of Meeting of Boards of Examiners and all committees appointed by the said Boards.

(d) He shall countersign the Travelling Allowance Bill and remuneration bills of Examiners and paper-setters and all other bills relating to examinations.

6. Appointment of Examiner: The Examiners and Question paper-setters shall be appointed by the Controller of Examinations with the prior approval of the Vice-Chancellor, from a panel of names approved by the Syndicate.

7. l-le shall arrange to publish the results of all University Examinations with the approval of the Vice-Chancellor/the Syndicate.

8. The Controllerof Examinations shall, in the exercise of the powers and the duties of his office, be subject to the immediate direction and control of the Vice-Chancellor and shall carry Out his orders and render such assistance as may be required by the Vice-Chanceflorin the performance of his duties.

. Ine/igibility formembership of anyAuthority:The controller of Examinations shall not be eligible for nomination or election as a

mem ber of any of the University Authorities.

10. Resignation I Reversion : The Controller of Examinations may by writing nform the Vice-Chancellor his intention to resign or revert back to his parent department after giving three months notice and it shall be competent for the Syndiacate, on ihe recommendation of the Vice-Chancellor, to accept his resignation or reversion.

11. lt shall be in the power of the Syndicate to dispense with the services of the Controller of Examinations at any time on payment to him of six months salary and it may at any time

discharge him from its services without notice or compensation

in the event cf misçonducl on his part or of a breach by him of

any of the conditioñs on which he was engaged. In the case cf Controller of Examinations appointed on deputation from other

services, the Syndicate is competent to revert him to his original

department when it deems fit to do so.

CHAPTER III

AUTHORITIES OF THE UNIVERSITY

(a) THE SENATE

1. n addtion to the functions and duties of the Senate conferred by Section 21 of the Act, the Senate shall -

i Consider the Annual Report of the University.

2. Considerthe audited annual accounts othe University.

3. Consider ordinance made by the Syndicate.

4. Consider regulations made by the Standing Committee on

Academic Affairs.

5. Consider the report on affiliated Colleges/approved Colleges presented by the Syndicate at the end of every three years from the notified date.

If any resolution is passed by the Senate, the Syndicate shall take action as it deems fit whenever necessary.

The Syndicate may either accept or reject the proposal contained in such resolution.

Il. MEETING OF TF-E SENATE

6. Meetings convened by the Vice-Chancellor:

In addition to the ordinary meetings of the Senate as provided in Section 22(1) of the Act, the Vice-Chancellor may, whenever he thinks fit, convene meetings of the Senate

7. Meetings convened on Requisition by Members:

The Vice-Chancellor shall convene special meeting of 20



the Senate on a requisition in wntìng signed by not less than Fifty Percent of the total members of the Senate:

Provided that any requisition fora special meeting must be forwarded to the Registrar subject to the conditions stipulated in Section 22(3) of the Act with a copy of the resolution or resolutions intended to be moved at the meeting and also the name of the proposer of each resolution.

8 Notice of 1Meetings.

(a) not less than 2six weeks notice shall ordinarily be

given fora meeting of the Senate convened under Section 22(1) of the Act.

(b) not less than 15 clear days notice shalt be given for a

meeting of the Senate convened under Section 22(3) of the Act.

9. Business of Special Meeting:

Ataspecial meeting of the Senate convened by the Vice- Chancellor under Section 22(3) of the Act no business other than that brought forward by the Vice-Chancellor shall be transacted or the resolutions given notice by the requisitionists, as the case may be.

10. The Vice-Chancellor may at his discretion postpone the date fixed for an ordinary or a special meeting.

11. Chairman of the Meeting: The Vice-Chancellor, as Chairman cf the Senate, shall preside at all meetings of the Senate; but if the Vice-Chancellor be not present, the members present shall elect a Chairman among themselves.

12. I-fours ofthe Meeting: Unlessthe Senate otherwise resolve, t shall ordinarily meet at 10-00 Hrs. on the day fixed for the meeting and shall, if there is business, continue to sit till 16-00 Hrs. with an interval for lunch for an hour or as the Chairman

may propose.

13. Quorum: (a) One third of the total strength ofthe members of the Senate shaFt bethe quorum for a meeting of the Senate. If a quorum is not present withrn 15 minutes after the time appointed for a meeting, the meeting shall not be held and the Registrar shaH make a record of the fact:

Provided that such quorum shall not be required at a

convocation of the University or meeting of the Senate held for the purpose of conferring degrees, titles, diplomas or other academic distinctions.

(b) No Quorum: If at any time during the progress of a

meeting any member shall call attention to the number of members present. the Chairman shall within a reasonable time count the number of the members present, and if a quorum be

not present, he shalt declare the meeting dissolved and shaH

leave the chair. All such dissolutions shall be recorded by the Registrar and the reccrd shall be signed by the Chairman.

14. Forwarding Resolutions for Meetings:

(a) Any memberwho wishes to move a resolution on the subject item in the agenda atan ordinary meeting shall foEward

a copy of the resolution to the Registrar so as to reach him not less than 130 clear days before the date of meeting.

(b) Registrar shall place all such resolutions before the Vice-Chancellor who shall direct him to include such resolutions in the Agenda, provided that no resolutions shall be admissible which does not comply with the following conditions:

(1) lt shall be clearly and precisely expressed and

shall raise substantially one definite issue related

to the subject item on the agenda

(ii) lt shall not raise issues which do not fall under

the items of the agenda for the meeting and which do noi faN within the powers of the Senate.

(iii) It shalt not contain arguments, inferences ironical expressions or defamatory statements, nor shall it refer to the character or conduct, of persons in their official or public capacity and

(iv) lt shall noi refer to any matter which is under adjudication by a court of law.

15. Nature cf Resolutions: No resoluhon shall be moved at any

meeting of the Senate on a subject which is not primarily the concern of the Senate at that meeting. The Chairman shall be

the sole judge as towhetherasubject is primarily the concern of the Senate or not, and his decision thereon shall be final.

16. Admissibility of Resolution: The Vice-Chancellor shall cause each resolution of which notice has been given in accordance with Statute 14-of this chapterto be placed on the agenda paper of the meeting at which it is to be moved.

17. Identical Resolution: A motion substantially identical with one already moved and disposed of at a meeting shall not be

placed on the agenda paper at a subsequent meeting. Provided however, it shall be open to the Syndicate or the Vice-Chancellor to bring forward any subject ter reconsideration at a meeting if in

its or his opinion such reconsideration has been rendered necessary by fresh facts.

18. /ssue ofAgenda Papers: Notlessthan1 21 days before the date ofan ordinary meeting and not lessthan 10 daysbeforethe date of a special meeting, the Registrar shall issue to every member an agenda paper specifying the day and the hour of the meeting and the business to be brought before tIie meeting, but

the non-receipt of the agenda paper by any member shall not invalidate the proceedings of the meeting, provided that the Syndicate or the Vice-Chancellor may bring any business which s n its or his opinion urgent before any ordinary or special meeting with shorter notice or without placing the same on the agenda paper.

19. Notice of Amendment: Any member who wishes to move an amendment to a resolution on the agenda paper of any ordinary orspeacial meeting of the Senate shaU forward a copy ofthesametothe Registrarso asto reach him not iessthan 91

clear days before the day of the meeting at which the resolution is to be moved.

20. Final Agenda : The Registrar shall, on the receipt of amendments given in accordance with Statute 19 of this Chapter, prepare an amended agenda paper showing all the resolutions as in the origional agenda paper and all the admissible amendments together with the resolutions, if any, brought forward by the Syndicate or the Vice-Chancellor under the provisions of Statute 18 supra and after approval of the Vice-Chancellor, shall post a copy of it to each member of the Senate not less than2 5

clear days before the date of any meeting.

21. AdjournmentsandAdjoumedMeetings: The Chairman shall, if so desired, in a meeting at which a quorum is present adjourn the meeting from time Io time but subject Io the provisions of other laws, No business shall ba transacted at any adjourned meeting other than the business left unfinished at the meeting from which the adjournment took place.

22 Notice of Adjourned Meetings: When a meeting is adjourned for 15 days or more, not less than 10 days notice of the adjourned meeting and of the business to be transacted at it shall be given.

Save as aforesaid it shall not be necessary to give any no'ice of an adjourned meeting of the business to be transacted at an adjourned meeting.

23. Order of Business : At every meeting of the Senate, the following shall ordinariiy be the order of business, after the elecUon, if it be necessary, of the Chairman for the meeting:

(i) Business brought forward by the Chancellor.

(ii) Business brought forward by the Vice- Chancellor.

(iii) Business brought forward by the Syndicate.

(iv) Business brought forward by the members of the Senate.

Provided however that the Chairman at his discretion effect changes in the order of business as he deems fit.

24. Motions without Previous Notice: At any meeting of the Senate the following resolutions may be moved without previous notice, but shall not be made so as lo interrupt a speech:

(i) A resolution relating to business not included in

the agenda but brought forward by the Syndicate or the Vice-Chancellor as urgent at a meeting other than a special meeting.

(ii) Complimentary Motion: At any meeting of the Senate, motion of a complimentary character or

condolence nature may without previous notice, be moved from the chair or by any member with the previous permission of the chair.

25. Amendments to Resolutions at Short Notice: Any member may, with the previous permission of the Chair, move any amendment to any resolution brought forward by the Syndicate

or the Vice-Chancellor as urgent business.

26. Amendments without Notice: At any meeting of theSenate the following amendments may be moved without previous notice:

(i) Amendments of the purely verbal or formal kind which in the cpnion of the Chairman do not affect the sense or import of the rnotionto which they refer.

(ii) Amendments to any resolution or amendment on the agenda paper, which in the opinion of the Chairman have been rendered necessary by and are consequential upon any motion passed by the Senate at the same meeting.

27. Resolution or Amendment not on Agenda: Save otherwise permitted in Statute 14,19,24 and 25 of this chapter no resolution or amendment which is not placed on the agenda shall be moved at the meeting.

28. Motion Negatived : When any motion has been brought forward and has been negatived, no other motion of the same kind shall be again brought forward until afterthe lapse of what the chairman shall deem a reasonable time nor shall any discussion be allowed on such second or subsequent motion brought forward during a discussion on the same question.

29. Nature of Amendments : (a) amendment to a motion shall be -

(i) by leaving Out a word or words

(ii) by leaving outaword orwords, in order to insert some other word or words and

(iii) by adding or inserting a word or words.

(b) When the amendment is of the first kind, the form in

which it is proposed shall be - 'Thai the words (mentioning them) be left Out of the resolution".

When the amendment is of the second kind, the form shall be - "Thai the words (mentioning them) be left out of the resolution and that the words (mentioning them) be added or inserted and there shall then follow words specifying the place in which the words mentioned are to be added or inserted.

When the amendment is of the third kind, the form shall be "That the words (mentioning them) be added or inserted' and there shaH then follow words specifying the place in which the words mentioned are to be added or inserted.

30.Order of Amendments: The order in which amendments to a

resolution are io be brought forward shall be determined by the Cha irma n.

31 Scope of Amendments:

(a) Negative Amendments: No amendment shaH be proposed which would reduce the original resolution to its negative or opposite form.

(b) Relevancy of Amendment: Every amendment must be relevant to the resolution to which it refers and must be framed so as to form therewith an intelligible and consistent sentence.

(c) Amendment to Motion for Adjournment : No amendments shall be moved to a motion for adjournment of meeting or debate except one substituting a different day or hour.

32. Proposa/ofMotion:A mover, when permitted bythe Chair, may speak on his motion before he actually proposes it; but a

speech is only allowed on the distinct understanding that he

speaks to the question and that he concludes by proposing his motion formally.

33. Motion to be seconded: Every motion at a meeting must be seconded otherwise it shaU drop. Any member may second a

motion by saying, Isecond the motion'.Amemberwho seconds a substantive motion but not an amendment to a motion, may second the motion saying" second the motion and reserve my speech.

When a moton has been moved and seconded, it shall be stated from the Chair, unless it be ruled out of order by the Chairman.

34. No. of Resolution and Amendment at a time: Not more than one resolution and one amendment thereto shall be placed before a meeting at the same time.

35. Motions not moved: Any resolution or amendment standing in the name of a memberwho is absent from the meeting or who declines to move it, may be moved by any other member if permitted by the Chair.

36. Withdrawal of Motions: (a) No motion or amendment shaJi

be withdrawn from the decision of the meeting without its unanimous consent but this Consent shall be presumed if the mover States his wish to withdraw the motion and the Chairman after an interval during which no dissent is expressed announces that it is withdrawn.

(b) A motion cannot be withdrawn in the absence of the memberwho moved it. Where an amendment has been proposed to a resolution the original motion Cannot be withdrawn, until the amendment has been first disposed of.

37. Motions under Statute 21: No motion shall be moved or seconded by any member who during the discussion 9f any particular item of business, has already moved or seconded any one of such motions.

38. Duration of Speeches. No speech shall orthnarlly exceed 5

miniutes in duration provided that the Chairman may at his

discretion allow the mover of a resolution or oÍ an amendment when moving the same to speak for mûre than 5 minutes and

has powerto make him resume the seat.

39. Orderof Speeches: The memberwho first rises to speak at the conclusion of a speech shall normally be heard. in cases of more than one member rising to speak the Chairman shall decide the priority of speakers.

40. Rightto make speeches: No niernber can speak to a question more than once except where the mover has the right of reply as

provided for in Statute 42. A member who has spoken on a motion and resumed his seat cannot subsequentry rise to or second an

amendment to the same motion. A member who has moved or seconded an amendment cannot speak again on the origionaf motion after the amendment has been disposed cf.

A member who has moved or seconded an origional motion or spoken on it or moved or seconded an amendment thereto cannot subsequently move or second another amendment to the same motion, or move or second a motion during the debate on the same motion. He may however, speak on those new motions, when proposed by another member.

41. Speeches by Chairman : The Chairman has the right to

move or second or speak on a resolution or amendment but he shall vacate the chair while so engaged, and the Chair shall, during such time, be takenby a member nominated by the Chairman. Without leaving the chair, the Chairman may, however, at his discretion or at the request of any member, explain to the meeting the scope of any resolution or amendment.

42. Rightto reply: WhentheChairmanhasascertainedthatno other member entitled to address the meeting desires to speak. the mover of a substantive motion may reply upon the whole

debate. No member shall speak on a question after the mover has entered on his reply.

43 Personal explanations: Any member may rise to explain any misconception of expression used by him; but he shall confine himself strictly to such explananlion. Such personal explanation may be offered whilst another member s speaking, only if the meñTher who is speaking gives way by resuming his seat.

44. Power of Chairman:

(a) The Chairman shall call any member to order, and shall have power to take such action as may be necessary to enforce his decision.

(b) The Chairman may direct any member, whose conduct is, in his opinion grossly, to withdraw immediately from the Senate and any member so ordered to withdraw shall do so forthwith and absent hìr'nself during the remainder of the days meeting.

(r) Suspension of meeting : The Chairman may in the case of grave disorder arising in the Senate suspend any sitting for a time to be specified by him.

45. Putting motions to vote: When the mèeting on a motion is

concluded or if there be no meeting the Chairman shall put the motion to vote by saying, ' The motion is followed by the words of the motion, and the Senate shall then divide unless the Chairman ascertains that the motion s carried affirmatively, by

a unanimous vote.

If there be an amendment, he shall say, "It has been moved," (followed by the words of the resolution) then he shall say, "since it has been moved by way of amendment" (followed by the words of the amendment) and then, if the amendment be

one of the kind specified in sub-clause (i) of Statute 29 of this 30



chapter, he shafl put the question by saying 'shall the words or word proposed to be left out be left out?

If the amendment be of the kind specified ¡n sub-clause (ii) of the same Statute he shall put the question by saying 'shall the following word or words ................... be left out in order to

add or insert the following word or words .......................

lt the amendment be of the kind specified in sub-clause (iii) of the same Statute he shall put the question by saying, 'shall these words be there added or inserted?"

If an amendment be negatived, the original resolution shall be again stated from the Chair, and any other amendments, if any, thereto may then be moved.

If an amendment be carried, the resolution as amended shall be stated from the Chair and may then be debated as a

substantive resolution to which further amendments, if any. to the original resolution may be moved, and such further amendments shall be disposed of ii the same manner as the previous amendment.

46 Decision of resolution - Voting All resolutions considered at

a meeting of the Senate shall be decided by a majority of the votes of the members present unless a particular majority is required bythe Lawsofthe University. lfthe votesincluding that of the Chairman be equally divided, the Chairman shall have a

casting vote.

47. Minutes of the meeting The minutes of aH proceedings of each meeting of the Senate shall be signed by the Chairman of the meeting. The Reqistrarwithin three weeks of a meeting shall send a copy of the minutes of that meeting so signed by the Chairnianto each member of the Senate.

48. Procedure when exception is taken

(a) If no exception is taken by any member who was present at the meeting to the correctness of the minutes within 10 days otihe sending of the minutes they shafl be deemed to

be correct.

(b) If such excepticn be taken within the lime aforesaid by means of a tetter addressed lo the Registrar, definitely specifying the points which require correction in the minutes, and if the Syndicate is satisfied with the points of exception the minutes shall be brought forward by the Syndicate at the next meeting of the Senate for confirmation or correction by such of the members as were present when the business was transacted to which that minutes refer.

(b) THE STANDING COMMTTEE ON ACADEMIC AFFAIRS (SCAA)

1. The SCAA shaH be an authority of the University to co-

ordinate and exercise general supervision over the academic affairs of the University, subject to the provisions of the Act, the statutes and the ordinances.

2. Constituion

The SCAA shall in addition to the Vice-Chancellor as its

Ex-o fficìo member and Chairman consist cf the following persons namely

Class I - Ex-Qfficio Members

(1) The Director of CoHegiate Education (2) The Director of TechnicaL Educaton (3) The Director of Medical Education (4) The Chairmen of (each) Boards of Studies

(for both the Under-Graduate and Post-Graduate courses.)

Two members elected by the Pnncìpals of affiliated colleges from among themselves in the Senate.

POWERS AND FUNCTIONS

3. Subject to provisions cf the Act, the Statutes and

Ordinances the SCAA shall have the following powers, namely:

(a) to make Regulabons and amend or repeal the same;

(b) lo advise the Senate and Synthcate on all academic matters;

(c) to make proposals to the Syndicate for framing Oídinances for the conduct or standard of examinations or the conditions of residence of students;

(d) to make Regulations for the constitution and functions of the Faculties;

(e) to nominate a person wherever provided, from among the members of the Standing Commttee on Acadimic Affairs to be in the Selection Committee for making recommendations to the Syndicate for appointments to the posts of Professor, Assistant Professor, Reader and Lecturer in the Departments of Study and Research and Institutions maintained by the University.

2MEETING AND PROCEEDINGS

4. There shall be two ordinary meetings of the SCAA in a

year in February or March and in September orOctober on dates to be fixed by the Vice-Chancellor.

The Vice-Chancellor may also, whenever he thinks fit, convene a special meeting of the SCAA.

The Vice-Chancellor may, at his discretion, postpone the date fixed for an ordinary or special méeting of the SCAA.

5. Notice of Meetings

The Registrar shall, under the direction of the Vice-

Chancellor give not less than fourweek's notice of the date oían ordinary meeting.

6. Date for forwarding resolutions

Any member who wishes to move a resolution on the item of the agenda at an ordinary meeting shall forward a copy of the resolution to the Registrar so as to reach him not less than twenty clear days before the date of the meeting. A member who has forwarded a resolution may, by giving written notice which shall reach the Registrar not less than two clear days before the date fixed for the despatch of the agenda paper, withdraw the resolution.

7. Resolutions to be placed on Agenda Paper

The Registrar, under the direction of the Vice-Chanceflor, shall cause each resolution of which notice has been given and which has not since been withdrawn in accordance with Statute 6 of this Chapter and which is in conformity of admissibility to be placed on the agenda paper of the meeting at which it is lo be moved.

8. Agenda Paper

Not less than twelve clear days before the date of every meeting, the Registrar shall issue to every member an agenda paper specifying the day and the hour of the meeting and business to be brought before the meeting, but the non-receipt of the agenda paper by any member shall not invalidate the proceedings of the meeting: provided that the Vice-Chancellor may bring any business which, in his opinion, is urgent before any meeting with shorter notice or without placing the same on

the agenda paper.

9. Notice of amendments

Any member who wishes to move an amendment to a

resolution on the agenda paper of any meeting shall forward a

copy of the same to the Registrar so as to reach him not less than nine clear days before the day of the meeting at which the resolution is to be moved.

10. Amended Agenda Paper

The Registrar shall on the receTpt of amendments given n accordance with Statute 9 of this Chapter, prepare under the

direction of the Vice-Chancelloran amended paper showing all

the resolutions and amendments.

11. Despatch of amended Agenda Paper

The Registrar shall post a copy of the amended Agenda to each member of the SCAA not less than five clear days before the date of the meeting.

12. Quorum

Twenty oc one third of the members of the SCAA whtchever is less shall be the quorum for a meeting of the SCAA,

13. Chairman of Meeting

The Vice-Chancellor, if present, shall preside at alt

meetings of the SCAA but if the Vice-Chancellor be not present the members present shall elect a Chairman from among thems&ves.

BUSINESS OF MEETINGS

14. Order of business

At every meeting of the SCM the following shall be the order of business after the election, if it be necessary, of the Chairman

(i) Business brought forward by the Vice- Chancellor including business remitted by the Senate and the Syndicate.

(ii) Business brought forward by the Faculties.

(iii) Business brought forward by the Boards of Studies.

(iv) business brought forward by the members of the SCAA.

15. Procedure at Meetings

The procedure at meetings of the SCAA shall be

regulated generally by the procedure laid down for the Senate.

16. The Registrar shati be the Ex-Officio Secretary of the Standing Committee on Academic Affairs, but shall not be

deemed to be a member

(c) THE SYNDiCATE

I. The Syndicate shall be the executive authority of the University to regulate and determine all matters concerning the University n accordance with the Act, the Statules, the Ordinances and the Regulations.

2. Meetings of the Syndicate

(a) The Syndicate shah meet at such times and places as decided by the Vice-Chancellor:

Provided that the Syndicate shall meet at least once in

every three months.

3. Quorum for the meeting

One-third of the total strength of the members of the Syndicale shall be the quorum required for a meeting of the Syndicate.

4. Conduct of the Business of the Syndicate:

The conduct of the business of the Syndicate and the procedure for voting mutatis mutandis those prescribed for the conduct of the business of the Senate.

3. Assignmen to Faculties:

Every member of the S.CA.A., subject to the proportion to be maintained as per Section 29(2) of the Act, shall be assigned by the order of the Syndicale to one or more of the Faculties at

the meeting of the S.C.A.A.next after his becoming a memberof S.C.A.A.

4. Terms of Office:

(a) Members of the Faculties who are also members of the S.C.A.A. shall continue to be members of the Faculties as long as they are members of the S,CA.A

(b) Other members nominated shall ordinarily hold office for a period of three years from their date of appointment.

5. Deans of Faculties:

(a) Every Dean shall be appointed by the Vice-Chancellor from among the Professors in the Faculty for a period of three years and he shall be eligible for re-appointment.

Provided that a Dean on attaining the age of fifty-eight years shall cease to hold office as such:

Provided further that if at any time there is no Professor in a Faculty, the Vice-Chancellor shall exercise the powers of the Dean of the Faculty:

(b) When the office of the Dean is vacant or when the Dean is, by reason of illness, absence or any othercause, unable to perform the duties of his office, the duties of his offtce shaH be performed by such person as the Vice-Chancellor may appoint

for the purpose.

(c) The DeanshallbetheHeadoftheFacuJlyandshall be responsible for the conduct and maìntenence of the standards of teaching and research in the Faculty. The Dean shaH have such otherfunctionsas may be prescribed by the ordinances.

(d) The Dean shall have the right to be present and to speak at any meeting of the Boards of Studies or Committees of the Faculty, as the case may be, but shall not have the right to vote thereat unless he is a member thereof.

6. Powers of the Faculty:

A Faculty shall have power to (a) consider and report on any matter referred to it by

the SCAA., the Senate, the Syndicate orthe Vice- Chancellor;

(b) recommend draft regulations in regard to courses of study and examinations prescribed by the University and to lay such regulations for the consideration of the SCA.A;

(c) to remit any matter to a Board of Studies within the purview of the Faculty for consideration and report;

(d) to consideí any report or recommendation of any Board of Studies, if required to do so.

7. Meetings : Meetings of the Faculty shall be convened at such times as may be necessary by the Registrar as per the directions of the Vice-Chancellor.

All Rules framed for the conduct of the meeting of the Senate shall be applicable to the meetings of the Faculty.

8. Minutes of the Meeting:

The minutes of the meeting of the Faculty shall be

communicated by the Dean to the Registrar for action wherever

necessary.

(e) THE FINANCE COMMiTTEE

1) There shall be a Finance Committee as provided for in Sections 17 and 32 of the Act.

2) Constitution. i Vice-Chancellor (Chairman - Ex-Offscio). 2. The Secretary to Government in-charge of Finance. 3. The Secretary to Government in-charge of Education. 4. Three members nominated by the Syndicale as

provided in sub-section (1) (iv) of Section 32 of the Act.

3) Secretary:

The Finance Officer of the University shall be the Ex- Officio Secretary of the Finance Committee but he shall not be deemed to be a member of the Committee.

4) TennotOffice.'

The term of office of the members of the Finance Committee shall be as provided for in the sub-sechon (4) of the Section 32 of the Act.

5) Meetings:

The Finance Committee shall meet at leasttwice in every year

6) Powers and Duties:

The powers and duties of the Finance Committee shaU

RULESAND PROCEDURES FORTHECONDUCTOF ELECTION TO THE AUTHORIT1ES OF THE

BHARATHIDASAN UNIVERSITY

Rules for the Conduct of Elections underthe Act

1 Vice-Chancellor to direct the holding of elections:

Except as otherwise provided in the Laws of the University, the Vice-Chancellor shall direct the holding of ali elections, and shall have power-

(a) to fix the mode and date of elections;

(b) to determine the form of notice, nomination, letter of intimation, declaration paper, ballot paper etc. ¡n any election;

(c) to prescribe the method of deciding the validity or invalidity of each ballot paper or of each vote recorded;

(d) to declare the results of each election; and

(e) to delegate the power to the Returning Officer to decidethe validityoleach ballot paperorofeach vote recorded and to declare the results of each election. The decision of the Vce-ChancelIor or the Officers named in statute or the Returning Officer to whom the power has been delegated shall be, subject to the provisions in Section 50 of chapter X of the Bharathidasan University Act, be final:

Provided that It shall be competent for the Vice- Chancellor, when any emergency arises-

(i) to assume the powers of the Returning Officer and 48



function as such, either by himself or by deputing any other person, when, in the course of the conduct of any election, the Returning Officer cannot carry oui his duties; and

(ii) to postpone the date or dates fixed in the programme for transaction of business connected with the elections at any intermediate stage. The Vice-Chancellor shall record his reasons for such action taken

2. Election not in valid by reason of vacaneies in the electorate:

No election to an authority of the University shall be invalid by reason of any vacansy among the persons entitled to voie at

such election or by the loss during transmission of any notice or ballot paper

3. Dates from which elections take effect:

The results of all elections shall be published in Tamilnadu Govermeni Gazette.

Elections shall take effect, in the case of anticipatory elections, from the date of the occurrence of the vacancy and in other cases, from the date of declaration of the result of the election.

4. Dales from which member elected: In the case of elections held under the Amended Act, if any, taking into consideration the notification of the Goverment, all those elected shall be declared as members of the authorities from the date of the notification indica1ect

5. Objections to elections Objections to elections shall be made in writing and shall be foi'wardedtotie Vice-Chancellor so asto reach him within seven clear days after the declaration of the res tilts of the elections.

The ViceChancellor on receipt of the objections shall consider

the merit of the objections and issue his verdict within thirty days from the date of receipt of the objections.

6. Preservation of election papers: The ballot papers together with the other election documents of each etectioii shall be preserved in the office of the Registrar or the office of the Officer referred lo ¡n Statute 7 as the case may be tor a period of one month after the date of election or if any question arises as to the election, until it is disposed finally.

7. Elections conducted by Agencies other than the University:

In the case of elections enumerated below, the Vice- Chancellor shall direct the holding of the election within a date specified by him and the officers referred to shall thereupon hold the election in accordance with the rules framed and shall exercise the powers and perform the duties of the Vice-Chancellor and the Registrar in so far as the particular election is concerned underthe abovementioned Statutes and proviso indicated above.

The Returning officer may for sufficient reason with the previous consent of the ViceChancelIor, postpone the date or

dates fixed in the Programme for the publication of final list of valid nomination, for despatch of ballot papers for poll or for scrutiny and counting of votes, when at any intermediate stage of an election, any objection or any question is raised, which necessitates the postponement of the programme.

CONDUCT OF ELECTIONS BY THE UNIVERSITY

8. Registrar or any Authorised Officer to conduct Election: The

Vice-Chancellor may direct the Registrar or any other officer of the University to do all things necessary for the conduct of all eLections to the various University bodies

The Vice-Chancellor may al5o delegate in writing the powers connected with the conduct of elections of the University to the Registrar or any other authorised person.

9 Notification of Vacancy:lf any vacancy occurs or is about to occur by effiux of time, among the members of any University authority w;iich has to be filled up by an election conducted by the University, a notification of the fact shall be published in the Gazette.

10. Nature of Poll: The Registrar/Ofticer specified for the purpose shall notify the nature of polling.

Save as otherwise provided, in all elections under the Act, the method of postal voting with the option to deposit the envelopes in a ballot box on the day of the poll shall be adopted except in regard to the elections enumerated below

Such elections shall be conducted as follows:

(a) The threct polting shall take place by Secret ballot on the day of the meeting of the electing authority concerned, between the hours of meeting as fixed by the Vice-Chancellor on that day.

(b) A notice regarding the date on which the poll will be held and a final list of candidates validly nominated shall be sent to

every member of the electing aulbority concerned not less than ten cl dasbefore the date fixed for the poU.

(c) All members present at the meeting shall be entitled to

vote. No vote shalt be given by proxy or by post. Members present shall sign in the nominal/electoral IoU kept for the purpose as a

record of voting at the election.

(d) The Returning Officer thall ascertain that the person desiring to vote is a member who has not already voted and

shall enter his name upon the counterfoi! of ballot paper/or in a

register maintained for the purpose of the election and shall then handoverto the member the ballot paper corresponding to that counterfoil or number in the register after2 initialing the ballot

paper on the back thereof. Every ballot paper shall contain the names of all candidates for election arranged in alphabetical order There shall not be serial numbers or any other identifying mark on the ballot paper.

(e) When a member has received a ballot paper he shall proceed to the place arranged for marking the vote and shall mark theron by putting a cross mark thus 'X' against the name or names of persons the member intends to vote for. The number of nominees for whom each elector may vote may be less than equal to, but shall not be more than the number of vacancies to

be filled in the member shaH then fold the ballot paper and drop it in a ballot box placed in front of the Returning Officer.

(f) If a member inadvertently spoils a ballot paper he may return it to the Returning Officer who shall, if satisfied cf such inadvertence, give him another paper and retain the spoiled paper; and this spoiled paper shall be immediately cancelled and the fact of such cancellation shall be noted on the counterfoil / Register

(g) In the case of all elections at the close of the poll or when all the members present have voted, the Returning Officer shall, with the help of such members of the University 3taff as he may condiser necessary, proceed with the countin1 ot the votes obtained by each candidate and prepare the result sheet. In case of doubt about the validity of any ballot paper the matter shall be decided by the Returning Officer whose decision shall be final.

lt RecountofVotes: Anycandidateorhis agent can request a recount of the votes immediately after the counting is completed, the Returning Officer, at his discretion, may order a recount of the votes and the decision of the Returning Officer regarding recounting shall be final. While requesting recount of votes, the candidates or the agents apart from furnishing reasons for the request should pay a sum of Rs. 100 towards recounting fee for

which an official receipt will be issued by the Returning OffLcer. A candidate or hslher agent may request recounting of votes only once ii a particular election.

12. A ballot paper sha// be invalid if -

(a) it does not bearthe Registra r's/Retuming Ofticer's Initials or

(b) a Voter signs his/her name or writes any word or makes any mark on it, by which it becomes recognizable; or

(c) no vote ¿s recorded thereon; or (d)the number of votes recorJed thereon exceeds the

number of vacancies to be filled; or (e) lt is voici f or uncertainty.

Provided that where more than one vote can be given on

the same ballot paper ¡f one of the marks is so placed as to render it doubtful to which candidate ¡t is intend ed to apply, the vote concerned but not whole ballot paper shall be invalid on

that count.

13. Wherever applicable the Tellers/Officials entrusted with the counting of ballots shall after preparing the result sheet deliver it to the Returning Officer, who shall declare the result of the elections as stated in Statute 14.

14. The Candidate or Candidates equal in number to the number of vacancies, receiving the largest number of votes shall be declared duly elected. When two or more candidates receive an

equal number of votes and if they cannot ali be declared elected; the final election shall be made by drawing lots in such manner as the Returning Officer may determine.

15. After election process is over, all ballot papers shall be put in a cover, sealed and deposited in the custody of the Registra rl officer nominated for the purpose for a period of three months, after which these can be destroyed.

16. Eligibility of Acting Persons to take part in Elections: When persons holdrng office as Principals of Colleges, Teachers in

Colleges, or Headmasters of Higher Secondary Schools are

entitled to take part ¡flan election the persons for the time being acting such as Principals, Teachers or Headmasters and performing the duties of each such office shall have all the rights and powers vested in them by the Act and by these Laws.

17, (a) Teachers of affliated Colleges for the purpose of Section 20 (a) - class Il - other members - sub-section (1), Section 24 (b)

- class I! - other members - sub-section (2), of the Act means teachers in Colleges as defined in Section 2(n) ofthe Act including Directors of Physical Education in Colleges but excluding Tutors, Demonstrators and Physical Instructors.

(b) 'H eadmasters of Higher Secondary Schools' means Headmasters of complete Higher Secondary Schools within the terrrtorial Jurisdiction of the University recognised by the Local Govern nient.

18. Nominations: Each elector shall be at liberty to nominate a

qualified person to fill the vacancy. Every nomination shall be in

the prescribed form and shall be made by an elector in writing and shall be seconded in writing by another elector. Every such nomination shall be accompanied by a statement signed by the nominee agreeing to serve on the authority, if elected and declaring that he/she is not already a member of the authority, to

which he/she seeks election, or if he/she is already a member, that his/her term of office as such would expire before the membership for which he/she is seeking election, takes effect, and nomination paper must reach the Registrar/Returning officer within the date and hour fixed vhich shall be, in the case of the election of members of the Senate by Registered Graduates, not later than fourteen clear days and, in the case of all other elections, not later than ten clear days after the publication of the notification in the Tamil Nadu Government Gazette.

superscribed as specified and sent by registered post or are not delivered in person or by messenger as required above shall be

declared invalid.

(d) Subject to the proviso hereunder, no person who is a

member of an authority through a particular electorate shall be

eligible for election to the same authority through another electorate without his having previously resigned his membership.

lt shall be competent, however, in the case of an anticipatory vacancy, for a person who is already a member of the authority, elected by a particular electorate to stand as a candidate in such anticipatory vacancy provided the date of membership in that vacancy shall be posteriorlo (he date on which he ceases to be

a member of that authority.

19. Scrutiny of Nomination Papers: (a) AH nomination papers shall be scrutinized by the Returning Officer or other officer authorized by him in his behalf on the date and hour and al the place appointed and notified n the notice of vacancy. Candidates and representative of each candidate appointed in writing by him may be present at the time of scrutiny.

(b) If, afterthe scrutiny of nomination papers the number of

candidates validly nominated is equal to or less than the number of vacancies to be filled, the candidates so validly nominated shall be declared duly elected.

(c) If the number of such candidates declared elected s

less than the number of vacancies the constituency shall be called upon to elect a person or persons as the case may be, to fill the remaining vacancies.

(d) If, after scrutiny, the number of canthdates validly nominated isgreaterthantlie numberofvacancies,thefinal list of candidates for the election published by affixing the same on

the notice board in the Office of the Returning Officer on the same day and a copy of the same shall be forwarded to each of the candidates nominated for election.

20. Withdrawal of Nominations Any candidate may withdraw his candidature by notice in writing sent by Registered Post so

as to reach the Returning Officer or delivered to the Returning Office r or other person authorised by him not later than Three O'Clock in the A.N of the day fixed for wíhtdrawal, which, shall be five clear days after the last date for receipt of nomuiation. A

candidate who Iiaswithdrawn his candidature shall not be allowed to cancel the withdrawal or to be renominated as a candidate for the same election.

21. Publication of Valid Nominations: The Returning Officer or

other person authorized by him shall publish on the same day

after the time forwithdrawal of nominations has expired a final list of candidates validy nominated.

22. Members who have filed nominations for a particular election shall not be engaged foranyworkiegardingtlie conductoithat election.

23. Declaration of Election of Validly Nominated Candidates: (a) If the number of candidates who are validly nominated

and who have not withdrawn their candidature in the manner and within the time specified does not exceed or is less than the number of vacancies to be filled, all such candidates shall be

declaredto bedutyelected and ìíthe numberofsuch candidates declared elected is less than the number of vacancies, the constituency shall be called upon to elect a person or persons, as the case may be, to fill the remaining vacancies.

(b) If the number of candidateswho are validly nominated and who have not withdrawn their candidature in the manner prescribed and within the time specified is greater than the numberofvacanciesto be filled, the election shall be proceeded in the manner prescibed.

24. Despatchof Ballot Paper: The Registrar/Returning Officer shall forward to each elector (through the post wherever necessary) a numbered declaration paper, a ballot paper on which the names of the candidates with their addresses arranged ¡n

alphabetical order and which shall bear on il the Registrars/ Returning Officerts intiais and the last date of posting, a ballot paper cover, and an envelope addressed to the Registran Returning Officer together with a letter of intimation stating the number of vacancies, the date and hours fixed for the poll, and the day and the hour fixed for scrutinity and counting of votes. The papers shall be forwarded to the address entered against the name of the elector in the electoral roll, or if the elector has since the publication or preparation of the roll changed his address

and intimated the fact in writing to the Registrar at least 14 days before the first date of despaich of ballot papers, to the address so given.

The date fixed for the poll shall be, for the elections of members of the Senate by Registered Graduates, not less than fourteen clear days from the last date of posting the ballot papers, and for other elections, not less than ten clear days after the date of posting of the ballot papers.

25. Voting: The elector shall, after filling up the declaration and the ballot paper in accordance with the directions given in the letter of intimation, enclose the ballot paper in the ballot paper cover and the declaration paper ¡n the envelope addressed to the Registrar and send the envelope by registered post so as to reach the Registrar not later than the day and the latest hour fixed forthe poll.

Provided thai, at his option the elector may, either in person or by an agent, depo5it the envelope addressed to the Registrar in the ballot box on the day and during the hours fixed for the poll.

26. Recording of Votes of Electors - Physically Incapacitated: f an elector is incapacitated from blindness or other physical cause from voting in the manner prescribed, t shall be competent for him to record his vote by the hand of any of the persons enumerated below and such person shall, on the dectarahon paper, certify the incapacity and attest the fact of his having been requested by the elector to mark the ballot paper for him and of its having been so marked by him in the presence of the elector.

The rollowing persons are empowered to attest votes of incapacitated electors:

I. Silpendiary Magistrales 2. A Gazetted Officer. 3. Principals of affiliated or approved Colleges. 4. Headmasters of Recognised Higher Secondary Schools 5. Members of the Senate or Syndicate.

27. Procedure when voting papers are lost or spoilt:

An elector who has not received his ballot and other connected papers sent by post, orwho has lost them orwhose paper, before their despatch back to the Registrar/Retuining Officer have inadvertently been spoilt, may transmit a declaration

to that effect signed by himself and requesi the Registrarto send him new papers in place of those not received lost orspoilt; and f the papers have been spoilt, the spoilt papers shall be returned

to the Registrar/Returning Officer who shalt cancel them on

receipt. In every case when new papers are issued, a mark shall be placed against the number of electors name in the Register (electoral roll) to denote that new papers have been issued in

place of those not received, lost or spoilt.

2. Procedure on counting

Ön the day at the hour appointed for The scrutiny and counting of votes, envelopes received from the electors by the Registrar/ Returning officer except those which have not either been sent by registered posi so as to reach the Registrar not later than the day and the latest hour fixed for the poil or deposited in the ballot box provided on the day during the hours fixed for the poll, shall be arranged and counted. Groups of election papers and covers sent in a single cover by registered post to the Registrar/Returning Officer shall be rejected. They shall then be opened and the declaration papers and the ballot paper covers exanlinerL

29. Ballot paper Cover when rejected:

A ballot paper cover shall be rejected, if-

(i) it is not the cover sent by the Registrar/Returning officer; or

(ii) the envelope contains no declaration paper outside the ballot paper cover; or

(iii) the declaration paper is flot the one sent by the Registrar / Returning officer; or

(iv) the declaration or attestation is not in accordance with the rules; or

(y) the ballot paper is placed outside the ballot paper cover; or

(vi) more than one declaration paper or cover containing ballot paper have been enclosed in one and the same envelope ; or

(vi)1he declaration paper is not duly signed. In each case of rejection; the word 'rejected" shal{ be

endorsed on the ballot paper cover orthe declaration paper.

30. Persons who may be present at Scrutiny and Counting of Votes:

No person other than the Vice-Chancellor, the Registrar / Returning officer and such persons as the Vice-Chancellor may appoint to assist the Registrar / Returning officer the candidates and or not more than one representative of each candìde appointed in writing by him shall be present at the scrutiny and counting of votes.

31 Election as per Section 20(a) Class II - other members Sub- Section (1) of the Act:-

The election of one member to the Senate by the teachers of each affiliated College otl,r ;an the Principal shall be governed by the following

(a) The election shall be held by s ret ballot, on the day fixed by the UniVersity among the teache of the College.

(Teachers of the College for the purpose of this rule means as defined in St. 17 of this Chapter)

(b) not less than seven clear days before the date of election notice of election shall be issued by the Returning Officer

furnishing information regarding:

i) The number of vacancies tobe filled ii) Last date and hour for filing the nominations.

iii) Date and hourfor the scrutiny of nominations. iv) Date and hour for the publication of valid hsl of

nom nations. V) Last dale and boul for withdrawal of candidature. vi) The place, date and time of issue of ballot paper, polling,

scrutiny and vii) Counting of voles.

(c) a copy of notice as issued above shalt be published in the College notice board.

(d) The Principal shall be Returning Officer for the election. In the absence of the Principal the teacher holding charge of the Principal shall be returning officeer. In such cases the fact may be informed to the Registrar in advance.

(e) Provided that, if after the scrutiny of nominations and after the time for withdrawal of candidature is over, the Returning Officer finds that the number of candidates validly nominated is less than or equal to the number of vacancies to be tilled, he shall declare such candidates or candidates to be duly elected and if the number of valid nominations exceed the number of vacancies to be filled furthur process for the election shall be

proceeded with, as per the notice issued earlier in this regard.

Other rutes for the conduct of election shall generally conform to the rules prescribed for University elections.

32. Elections without Pro portional Representation:

n the elections enumerated below, the procedure prescribed in the preceding statutes and below shall be followed:

(a) E'ection of one member to the Senate by the Teachers of such affiliated College.

(b) Electipn of one member to the Senate by the Secretaries of the College Committees from among themselves of the private Colleges within the University area, as defined ri

the Taritil Nadu Private Colleges (Regulation) Act, 1976

(Presidents Act 19 of 1976)

(C) Election of one member to the Senate by the Headmasters of Higher Secondary Schools in each revenue

district within the University area.

(d) Election of two members to the Senate by the Registered Garduates in each revenue dìstncl within the University area from among themselves.

(e) Election of two members to the Senate by the Members of the Tamil Nadu Legislative Assembly from among themselves.

(f) Election of 2 one member Io the Senate by the Members of Tamil Nadu Legislative Council troni among themselves.

(g) Election of one member to the Syndicate by the

members of the Senate from among themselves.

33. Ballot papers when invalid:

A ballot paper shall be invalid if-

(a) it does not bear the Registrars/Returning Officrs initials: or

(b) a voter signs his name or writes any word or makes any mark on it, by which it becomes recognizable; or

(c) no vote is recorded thereon; or

(d) the number of votes recorded thereon exceeds the number of vacancies to be filled; oc

(e) it is void for uncertainty.

Provided that where more than one vote can be given on the same ballot paper if one of the marks is so placed as to render it doubtful to which candidate it is intended to apply, the vote concerned but noi the whole ballot paper shall be invalid on

that account.

34. Declaration of Results:

The nominee or the nominees receiving the highest number of votes shall be daclared to be duly elected. When Iwo or more nominees receive an equal number of votes and they cannot all be declared elected, the final election shall be made by drawing lots.

The Vice-Chancellororthe Officerauthonsed byhim on

this behalf shall then declare the names cf the candidates who have been duly elected.

35. Elections with Proportional Representalion:

In the elections enumerated below, the procedure prescribed in the following statutes shall be followed, the elections being held with the system nf proportional representation by

means of the single transferable vote

(a) Election of two members to the Syndicate by the Principals of affiliated Colleges from among themselves.

(b) Elertion of twornemberstothe Syndicate bythe teachers of affiliated Colleges. otherthan Fiincipals from among themselves

36. Voting: Allvotersshallbeentttledtovote. Eachvotershall have only one vote.

37. Invalid Ballot Papers: The ballot paper covers other than those rejected under Statute 28, shail be opened and the baliot papers taken out and mixed together in the Vice-Chancellor's presence. The Vice-Chancellor shall then proceed to counting the votes, rejecting as mvalid any ballot paper,

(a) Which does not bear the Registrar's initials; or (b) On which a voter signs his name orwrites any word,

or makes any mark, by which it becomes recognizable; or

(c) On which the figure 1 ¡s not marked; or (d) On which the figure 1 is set opposite the names of

more than one candidate; or (e) Onwflichthefigurel andsomeotherfigureareset

opposite the names of the same candidate; or (t) Which is void for uncertainty.

On every paper so rejected, the Vice-Chancellor shall endorse the word 'invalid' and such papers shall be kept in a

seperate bundle.

38. Definition of Terms: In the following statutes:

(i) 'Continuing Candidates" means candidates not elected or

not excluded from the poll at any given time.

(ii) Exhausted Papers" - means ballot papers on which no

furthur preference is recorded for a continuing candidate; provided that a paper shall also be deemed to be exhausted ¡n any case

¡n which -

(a) the names of two or more candidates, whether continuing or not, are marked with the same figure and are next in order of preference; or

(b) the name of the candidate next in order of preference, whether continuing or not is marked

(b-i) by a figure not following consecutively after some other figure on the ballot paper

(b-ii) by two or more figures

(iii) 'First Preference' means, the figure t set opposite the name of any candidate; Second Preference' similarly means, the figure 2, 'Third Preference"the figure 3, and so on

(iv) 'Original Vote" in regard to any candidate means, the votes derived from ballot papers on which a first preference is recorded for such candidate.

(V) 'SLlrplus"-meansthenumberbywhìchthevotesofany candidate, original and transferred exceeds the quota as defined in Statute-41

(vi) "transferred votes" in regard to any candidate means votes credited to such candidate which are derived from ballot papers on which a second or subsequent preference is recorded for such candidate.

(vii) "unexhausted paper" means, ballot papers on which a

furthur preference is recorded for a continuing candidate.

39. Procedure for elections with proportional representation:

In carrying Out the operations prescribed in the statutes hereinafter contained

(i) aH fractions shall be disregarded; and (ii) all preferences renorded for candidates already elected

orexcFuded for the poll shall be ignored.

40. Division into parcels according to first preferences:

After the invalid ballot papers, if any, have been rejected, the remaining papers shall be divided into parcels accorthng to the first preferences recorded for each candidate and the number of papers in each parc& noted.

41. Quota: The number of the papers in all the parcels shal then be added together and the total divided by a number exceeding by one the number of vacancies to be filled, and the

result increased by one shall be the number sufficient to secure the return of a candidate (hereinafter called the quota).

ifalanytime anumberofcandidatesequaltothe number of persons to be elected has obtained the quota, such candidate shall be treated as elected and no further steps shall be taken.

42. Candidate when elected: Any candidate, in whose parcel the number of votes on the first preferences being counted is

equal to or greater than the quota. shall be deemed declared

43. Transfer of Surplus Papers; If the number of the papers in

any such parcel is equal to the quota, the papers shall be set

aside as finally dealt with.

Ifthe numberofthe papersin anysuch parcel isgreater than thequota, the surplus shall be transferred to the continuing cadidates indicated on the ballot papers as next in the order of the Voter's preference, in the manner prescribed in the following statutes.

44. Surplus how dealt with:(a) lfandwheneverastheresultof any operation prescribed by these statutes a candidate has a

surplus, that surplus shall be transferred in accordance with the provisions of this statute

(b) If, in ascertaining the number of papers to be

transferred from a sub-parcel, fractional parts are found to exist and if, owing to the existence of such fractional parts the number of papers to be tra nsfered is less than surplus, as many of these fractional parts taken in the order of their magnitude, beginning with the largest, as are necessary to make the total number of papers to be transferred equal to the surplus, shall be reckoned as the value of units, and the remaining fractional parts shall be

ignored. If two or more fractional parts are of equal magnitude, that fractional part shall be deemed to be the larger which arises from the larger sub-parcel, and iíthe sub-parcels in question are equal in size, preference shall be given to the candidate who obtained the larger number of original votes.

(o) If more than one candidate has a surplus, the largest surplus shall be dealt with first and the others in order of magnitude; provided that every surplus arising on the first count of votes, shall be dealt with before those arising on the second count, and so on.

(d) where two or more surpluses are equal, the Vice-

Chancellor shall decide, which shall be dealt with first.

(e) (i) if the surplus of any candidate to be transferred arises from original votes only, all the papes in the parcel belonging to the candidate whose surplus ¡s to be transferred shall be examined and the unexhausted papers divided into sub- parcels according to the next preferences recorded thereon. A separate sub-parcel shall also be made of the exhausted papers.

(ii) The number of papersm each sub-parcel and the total of all unexhausted papers shall then be ascertained.

(iii) If the total number of the une'hausted papers is equal or less than the surplus, all the sub parcels shall be transferred to the continuing candidates.

(iv) If the total number of the un exhausted papers is greater 68



than the surplus, they shall be transferred from each sub- parcel the number of papers which bears the same proportion to the number of papers in the sub-parcel as the surplus bears to the total number of unexhausted papers in

the order in which such papers have been transferred.

(O 1f the surplu5 of any canthdate to be transferred arises

from transferred as well as original votes, all the papers in the sub-parcel last transferred to the candidate shall be re-examined and the unexhausted papers divided into sub-parcels according to the next preference recorded thereon. The sub-parcels shall be dealt with in the same manner as is provided in the case of the sub-parcels referred to in Clause (e).

(g) The papers transferred to each candidate shall be added in the forni of a sub-parcel lo the papers already belonging lo such candidate.

(h) All papers in the parcel or sub-parcel of an elected candidate not lransf erred under this statute shall be set aside as

finally dealt with.

45. Exclusion of Candidate lowest on the po11:

(i) If after all the surpluses have been transferred as

herein-before directed less than the number of candidates required has been elected the candidate lowest in trie poll shall be excluded from the poll and his unexhausted papers distributed among the continuing candidates according to the next preferences recorded thereon Any exhausted papers shall be

set aside as finally dealt with.

(ii) The papers containing original votes of an excluded candidate shall first be transferred.

(iii) The papers containing transferred votes of an

excluded candidate shall then be transferred in the order of the

transfer in which he obtained them

(iv) Each of such transfers shari be deemed to be a

separate transfer.

(y) If the total of the votes of the two or more candidates lowest on the poll, together with any surplus votes not transferred is less than the votes credited to the next highest candidate, those candidates may, in one operation, be excluded from the pou and their votes transferred in accordance with the direction given in Clauses (i) to (iv) above.

(vi) The process directed by this statute shall be repeated on the successive exclusions of the candidates lowest on the poil until the last vacancy is filled either by the election of a

candidate with the quota, oras hereinafter provided.

46. if as a result of a transfer of papers tinderthese statutes, the number of votes obtained by a candidate is equal to or greater than the quota, the transfer then proceeding shall be completed but no further papers shari be transferred to him.

47. (a) If after the completion of any transfer under these statutes the number of the votes of any candidate shall be equal to or greater than the quota, he shall be deemed elected.

(b) If the number of the votes of any such candidate shall be equal to the quote, the whole of the papers on which such votes are recorded shaF! he set aside as finally dealtwith.

(o) Distribution of Surplus If the number of the votes of any such candidate shall be greaterthan the quota, his surplus shall thereupon be distributed in the manner hereinhefore provided, before the exclusion of any other candidate.

48 (a) When the number of continuing candidates is reduced to the number of vacancies remaining unfilled, the remaining

candidates shall be deemed elected.

(b) When only one vacancy remains unfilled and the number of the votes of some one continuing candidate exceeds the total ofall the votes of theothercontinuing candidates, togetherwith any surplus not transferred that candidate shall be deemed elected.

(c) When only one vacancy remarns unfilled and there are

only two continuing candidates, and those two candidates have each the same number of votes and no surplus remains capable of transfer, one candidate shall be excluded under the next succeeding statute, and the other deemed elected.

49. Equal surpluses - Two or more candidates lower on the poll

If when there is more than one surplus to be distrtbuted, two or more surpluses are equal or if at any time it becomes necessary to exclude a candidate and two or more candidates have the same number of votes and are lowest on the poll regard shall be had to the original votes of each candidates and the candidates for whom fewest original votes are recorded shall have his surplus first distributed, or shall be first excluded, as

the case may be. If the number of their original votes isthe same, the Vice-Chancellor shall decide by lot which candidate shall have his surplus distributed or be excluded

50. Recounting of Ballot Papers : Any candidate or his agent may. at any time during the counting of the votes, either before the comencement or after the cornpleticn of tr3nsfer of votes (whether surplus or otherwise) request the Vice-Chancellor to

re-examine and re-count the papers of all candidates or of any

candidate (not being papers set aside at any previous transfer as finally dealt with) and the Vice-Chancellor shall, if satisfied of the reasons given forthe request, forthwith arrange to re-examine and re-count the same. The Vice-Chancellor may also at his

discretion arrange to re-count votes, either once or more often

in any case, ¡ri which he is not satisfied as to the accuracy of any previous count, provided thai nothing herein shall make obligatory on the Vce-ChancelIor to re-count the same votes more than once

51. Declaration of Resu/ts The Vice-Chancellor shall then declare the names of the candidates who have been duly elected.

54. Conditions of Registration:

(i) A graduale seeking enrolment should be ordinarily resident within the University area for a period of three years precethng registration.

(ii) He shall apply ¡n the prescribed forni to the Registrar for enrolment with a fee of Rs.1O/-.

(iii) He shall with application produce evidence -

(a) o! his having qualified fora Degree from a statutory University in the territory of India, and

(b) ot being ordinarily resident within the Bhaathidasan University area forthe period asprescibed above. 1The evidence of residence shall be ¡n the form of a certificate from ari A or B

G rade officer of the Goverment or from the Head of the institution where he is employed, provided such institution ¡s recognised by the Goverment.

55. Scrutiny of Applications and Registration:

All applications for registration shall be made to the Registrar ìn the form prescribed together with the proofs of qualification. and of residence as stated above The Registrar on receipt of the applicaflon shall make such enquities as he deems fit and

enrol the graduates in the Registraron satisfactory fulfilment ot the conditions, for a period of five years. Such registration shalr

ordinarily take effect from the i st April or the i st Odoberfollowingand the period of five years shall be reckoned from such date.

56. Change of Address - Notification : A graduate who has registered shall notify the Registrar any change of address of his residence immedìatety

A registered graduate who changes his residence to a place outside the University area shall have his name deleted from the Register of Graduates and any graduate shall be entitled to have his name retained in the Register only so tong as he is ordinarily resident within the University area.

57. Eligibility for Election : Graduates who are enrolled at least 3

months prior to the date of election shall only be eligible lo participate in an election; provided that on the occasion of the

first election afterthe notification, all those who registered before such date as may be fixed in the notification for registration of graduates shall be eligible to participate in the election.

5. Renewal of Registration: Altheexpiryofthefiveyearpenod, the names of the Registered Graduates who do not apply for continuance thereon together with the fee prescribed for renewat, if any, shall be deleted from the Register. Applications for renewal shall be made in the prescribed form and fee, if any, and shalt be

forwarded to the Registrar with a cetificate of continued residence n the University area as prescribed above, and shall be sent by

Registered Post, Acknowledgement Due in an envelope franked 'Application for Renewal of Registration' on the left hand top corner. Any application not sent in a cover franked as stated above by Registered Post, Acknowledgement due or not delivered in person will not be accepteft Graduates who have so renewed shall be eligible to participate in the elections from the dale of renewal.

59. Annual Revision: The Registerof Graduates shall be revised every year on the Ist October. Graduates may notify before 31st March preceding, anychange intheiraddressorany information relating to any change of residence ordemise of any Registered Graduate.

60. Supply of Copy of Register of Graduates . Any Registered Graduate shall be entitled to peruse the list of Registered Graduates in the office by previous appointment with the Registrar. He shall also be entitled to receive a copy of the hst

The list of Registered Graduates shall be maintained district-wise, arranged in the alphabetical order in respect of each district.

Register of Headmasters of Recognised Higher Secondary Schools

61. Register of Headmasters The Regrstrar shall maintain for each revenue district in the University area, a Register showing the names and addresses of Headmasters of complete Higher Secondary Schools recognised by the Local Government.

CHAPTER V

HONORARY AND AD EUNDEM DEGREES

The Syndicate may, on the recommendation of not less

than two-thirds of the members of the Synthcate, confer any of the following honorary degrees upon a person on

the ground that he is, by reason of eminent position and attainments or by virtue of his contribution to learning or eminent services to the cause of education, a fit and

proper person to receive such degree:

Doctor of Laws (LLD.) Doctor of Letters (D.Litt.) Doctor of Science (D.Sc.)

2. All proposals for the conferment of honorary degrees shalt be made to the Syndicate and the decisions shall be placed before the Chancellor for his assent Afterthe Chancellor assents to the proposal, the Syndicate shalt arrange for the conferment.

3. Every proposal for the conferment of honorary degrees shall be subject to the confirmation of the Chancellor.

4. Honorary Degrees shall be conferred only at a

Convocation and may be taken in person or in absentia.

5. The presentation of persons at the Convocation on whom

Honorary Degrees are to be conferred shall be made by

the Vice-Chancellor or in the absence of the Vice- chancellor by a person nominated by the Syndicate.

6. The Diploma or Certificate of an Honorary Degree shall be signed by the Vice-Chance!lorand the Chancellor.

8. The ad eundem degree shalt be granted by a diploma or certificate signed by the Vice-Chancellor.

(b) LEGALADVISERAND STANDING COUNSEL

lt shall be competent forthe Syndicate to appointa Legal

Adviser/Standing Counsel for the University for such period on such terms as it may decide to perform suchduties as it may fix from time to time.

The Legal Adviser/Standing Counsel so appointed shaU

not be a member of any of the authorities of the University.

BOARD OF STUDIES (Ordinances)

1. There may be separate Boards of Studies in such branches

of knowledge as the Syndicate may decide to deal with matters

relating to subjects of study.

2. Constitution of Boards: (a) Each Board shall ordinarily consist

of no fewer than three nor more than twelve members who are

experts/teachers in the relevant field.

(b) There shall be a 'Chairman' nominated by the Vice-

Chancellor, from among the members of the Board.

(c) The members of the Board shall be appointed by the

Syndicate on the recommendations of the Vice-Chancellor.

3. Term of Office: Members of the Boards of Studies shall

normally hold office for a period of three years or such period as

may be fixed at the time of the appointment; provided that the

Vice-Chancellor may declare any member of a Board to have

vacated his membership if he leaves India or for other valid

reasons.

Provided also that it shall be competent for the Syndicate

to appoint as a member of a Board any person in his official

capacity.

4. Chairman: The Chairman shall be nominated by Vice-

Chancellor from among the member of the Board.

In the event of a vacancy in the office of the Chairman

the Vice-Chancellor shall appoint a member of the Board to act

as Chairman until a permanent arrangement is made.

5. Functions: It shall be the duty of each Board of Studies to

consider and report on any matter referred to it in accordance

with the Laws of this University, by the Vice-Chancellor, or the Syndicate or by the Standing Committee on Academic Affairs or the Faculty or the Dean of the Faculty concerned with the subject with which it deals.

6. Powers: Each Board shall (a) recommend to the Syndicate persons suitable for appointment as Examiners in the subject with which it deals;

(b) recommend textbooks whenever necessay;

(c) make recommendations in regard Io courses of study and examinations in the subject with which it deals.

7. Meetings: Meetings of Board of Studies shall be convened by the Registrar under directions of the Vice-Chancellor at such times and places as may be necessary. Where, in the lemporary absence of a Chairman, a meeting of a Board of Studies is

required to be convened for the purpose of urgently dealing with any University business, the Vice-Chancellor may direct the Registrar or any other officer of the University to act as Convener.

8. Quorum: Three members shall form a quorum (or any meeting of the Borads of Studies. In case there s no quorum the agenda for the meeting shall be discussed by the members present and the minutes oflhe discussion shall be circulated among members of the Board, with agenda, for approval.

9. Minutes of the Meeting:The final Minutes of every meeting shall be prepared by the Chairman, signature obtained from the members and shall forward the same lo the Registrarwithin one week from the date of the meeting hetd.

1O.Opinion by Circulation. lt shall be open to the Vice-chnacellor, ri urgent cases, to obtain the opinion of any Board of Studies by

circulation Such opinton together with the action taken thereon shall be reported to the Board as and when necessary.



11 Decisions of the Board only Recommendatory in nature All

decisions and opinions of the Board of Studies are only

recommendatory in nature and it is upt the Vice-Chancellor and

other appropriate authorities of the University to take action on

the recommendations of the Board.

CHAPTER V

SERVICE CONDITIONS OF THE ESTABLISHMENT OF THE BHARATHIDASAN UNIVERSITY

STATUTES

GENERAL:

1. These statutes shall be known as Service Title Statutes of the Establishment under th.

Bharathiaasan University.

2. These Statutes shall be applicable to all staff of the University not regulated by separate laws framed in accordance with the orovisons of the

Application Act and Statutes. For academic staff and others governed by separate laws, these statutes shall apply as far as they are not inconsistent with the said separate laws.

in the case of those on foreign service from Goverrnent Department, Local Bodies, or any other Universities, or public Sector Undertakings, these statutes will be subject to specific terms, if any, on which the persons are lent on foreign service to the University.

In respect of contractual appointment, the contract conditions will prevail over these statutes. In regard to matters not specifically dealt with in the contract agreement, the provisions in these Statutes will apply.

3. The Syndicate may relax any of the provions of these Statutes in exceptional cases in favour of

Relaxation an individual oi. a group of individuals as the Syndicate may deem fit.

II. DEFNIT1ONS

In these Statutes, unless the context otherwise requires:

(i) 'Act means the Bharathidasan Universty Act, 1981 as amended from time to time.

(ii) 'Senate' means the Senate of the Bharathidasan University.

(iii) Syndicate' means the Syndicale of the Bharathidasan University.

(iv) 'Vice-Chancellor' means the Vice- Definition. Chancellor of the Bharathidasan University.

(y) 'Appointing Authority' in respect of posts ¡n the University means the authority empowered to make appointments under the Act and Statutes.

(vi) 'Employee' means an employee of the Bharathidasan University.

(vii) 'Department' means the University Department of Teaching and Research.

lV RECRUITMENT:

i Recruitment to the various posts shall be made by any one of the following methods:

(3) by promotion by selection from the lower category;

(4) on foreign service from Central or State Government or other Universities or from Public Sector Undertakings or from Loca! Bodies;

appointee is replaced by a regularly selected candidate whichever is earlier, pending such promotion or appouitment in accordance with the Statutes, subject to the fact that such temporary appointees shall have all qualifications prescribed for that post. Such appointments / promotions shall be reported to the Syndicate in the next meeting.

V PROBATION:

1. Every directly recruited employee of the Period of University unless specifically exempted, shall be

Probation on probation for a period of two years within a

continuous period of three years from the date of joining duty in the 1inìversity

Provided that in the case of Group 'D' employees, the probation shall be for a period of one year from the date of joining duty.

2(a). On completion o! the period of probation, an

assessment of the work of the probationers shall be made and on the basis of such an

An order either declanng completion of probation or terminating probation shall be issued within six months from the completion of normal period of probation. If no such orders are issued within the period stipulated, he shall be deemed lo have completed his probation satisfactocily

2(b). A committee presided over by the Vice- Mode of Chancellor and consisting of the Head of the Assessment Department concerned, and a Senoir Faculty of academics next in Rank in the concerned Department shall

evaluate the work of the probationer and make recommendations whether he can be declared as having completed his probation satisfactorily or otherwise.

VI. FURNISHING OF SECURITY AND AGREEMENT

1. Any person appointed to the categories for which security is considered necessary by the

Security Syndicate shall furnish the security n cash or in

Deposit any other manner as prescribed by the Syndicate from time to time. The Vice-Chancellor may permit any part of the security to be

collected from the pay of the individuals in

instalments.

2. All employees appointed on probaton or on

Agreement for contract other than the persons appointed on

Probationersi foreign service terms shall execute an

IX. COMFULSORY/VOULNTARY RETIREMENT - NOTICE ISSUANCE

i (a). Notwithstanding anything contained in these statutes, the Syndicate on the basis of recommendations made by a committee

Procedure constituted by it every year for this purpose of for compulsory review, shall, if il is of the opinion that it is in the

Explanation No-II When an University employee under suspension or against whom disciplinary action is pending seeks to retire volunlari!y underthis statute, the Syndicate may withhold the permission sought for.

3. Any employee compulsorily retired either under Review statute (1) or statute (2).above may, if he

Petition chooses, file a review petition within two months to the Syndicate, from the date of receipt of orders of the Syndicate.

A 'Review Committee' which shall be specifically constituted every year for this purpose by the Syndicate shall consider and make its recommendations to the Syndicate. The decision of the syndicate thereon shall be final.

X. SCALE OF PAY AND ALLOWANCES

XII. LEAVE

1. The folowing are the various kinds of leave Kinds of admissible to the employees (Teaching and Leave Non-Teaching) of the University:

L Earned Leave. II. Maternity Leave.

Iii. Unearned leave on medical certificate. IV. Unearned leave on private affairs. V. Study Ieave

VI. Sabbatical leave; (applicable to Teaching staff only)

VII. Casual leave including Special Casual leave.

VIII Other Types of Leave as provided in the Tam il Nadu Leave Rules.

1. (a) Special Rules regard ing Tea chinci Staff:

Holiday i. The Academic year commences on July Ist

& Vacation and ends on June 30th.

Full-time teachers of the University shall be

entitled to a summer vacation of two months from the ist May to 30th June (both days inclusive) and all gazetted holidays in addition to those fixed by the Syridirate.

iii. In addition, they are entitled to 10 days of terminal holidays in the month of December.

iv. A full time teacher of University shall be eligible for 15 days of earned leave per year.

2. In respect of the grani of the following kinds of Leave the provisions of the Tamil Nadu Leave

Rules will be applicable to the University employees (Teaching and Non-Teaching) as

amended from time to time, so far as they are not inconsistent with the provisions of these statutes.

1. Earned Leave 2. Maternity Leave 3. Unearned Leave on Medical Certificate 4. Unearned Leave on private affairs 5. Study Leave 6. Casual Leave including special Casual Leave 7. Other types of Leave as provided in Tamil

Nadu Leave Rules.

3. Sabbatical Leave:

Eligibility : The professors of the University shall he entitled for grant of Sabbatical Leave for a period of one year at the end of every six years of continuous service in the Professor's grade in the University, for study, research and writing purposes within the country or abroad.

2. Service In reckoning (he service in the Professors grade for this purpose, six years service rendered in this University without any

break will be taken into account, i.e. it should not be intervened by any absence for a period exceeding three months of the University session (exculding vacation). For any absence for a period exceeding three months, service for an additional period of equal duration will have to be rendered for the completion of six years service, for the purpose of Sabbatical Leave.

3. Duration:

(i) Sabbatical Leave shall be granted for a period of twelve months including vacations. Vacation or any other Leave will not be allowed to be prefixed or suffixed with Sabbatical Leave.

(ii) Sabbatical leave may be granted n two spells of one year each only during the entEre period of service of a Professor in the University, provided he has rendered approved service of not less than six years before each spell of Sabbatical Leave.

4. Service benefits: During the period of S?bbatical leave, the Professor shall be allowed to draw the increment on the due date and the period of leave shall also count as service for the purpose of pension/retirement benefits, provided that the Professor rejoins the UnivQrsity on the expiry of his leave.

5. Salary During the period of Sabbatical leave, the professor shall be paid full pay and allowance as otherwise admissible at the rates applicable to him immediately prior to his proceeding on Sabbatical Leave and increased rates by way of accrual of increment under Rule 4 above. The University shall not, however, fill up his post. The teaching and academic work in the Department shall be shared amongst the existing teachers in thè Department during the absence of the Professor on Sabbatical Leave.

6. Restrictions:

(i) A Professor on Sabbatical Leave shall not take 96



updurLng the period of that leave, any regular appointment under another organisation in India or abroad.

(u) The Professor shall submit the proposed programme to be followed during the Sabbatical Leave to the University for approval along with the application forgrant of ieave. On return from the leave, a report on the nature of study, research or writing undertaken during the period of leave shall be submitted to the University.

4(a) The Casual leave unless otherwise empowered shall be sanctioned by the vice-

Grant of Chancellor for the Heads of Departments, Deans Casual of Faculties, Registrar, Controller of Leave Examinations and Finance Officer, the Heads

of Departments may sanction Casual leave for the teaching and non-teaching staff of their departments and notify the Registrar through the concerned Dean. The Deans may sanction casual leave for the administrative personnel under their control and notify the Registrar.

(b) The Vice-Chancellor or the Registrar under Grant of delegation from the Vice-Chancellor shall leave other sanction leave other than the casual leave to aU

than Casual categories of University employees. Leave

5. Leave cannot be claimed as a matter of right: Recai/to and when the exigencies of the service demand, Duty discretion to refuse or revoke leave of any

description is vested with the authority empowered to grant it, viz. the Syndicate, Vice- Chancellor, Dean and I-leads of the Departments and such other authorities empowered.

The University employees will be eligible for Special P.F Special Provident Fund-cum-Gratiuty Scheme on

-cum-Gratuity the same terms as applicable to the employees Scheme of the Tamil Nadu Government.

9. The employees of the University come under the Group Insurance Scheme of the LIC.

Group According to the Scheme, in the event of death Insurance of an employee during the period of service, a

sum of Rs.20,000/-(Rupees twenty thousand) will be provided as relief to the nominee of the employee. A subscription of Rs 3/- pm will be

deducted from the salary of the employees. The nomination as prescribed by the rules of the scheme shall be executed by every employee.

XIII. DISCIPLiNE AND CONTROL

1. For good and sufficient reason, including any breach of any of the statutes and laws of the

Causes for University or negligence, inefficiency, imposing insubordination or failure to show due diligence penalties and attention in the discharge of his duties or

failure to conform to the instructions of his superiors or any irregularities in the discharge of his duties or any criminal offence involving

moral turpitude, an employee of the University shall make himself liable to the following penaUties.

3. Recovery of Losses:

Recovery may be ordered by the competent authority of the loss, if any, caused to the University by any act of commission/omission, in addition to any oflhe punishments mentioned under items (1) and (2) above.

2. PROCEDURE:

(1) The authorities competent to impose penalties and punishments and the appellate authorities

appeal upto fifteen days may be condoned by

the appellate authorities. Any appeal to the Syndicate shou!d be addressed to the Registrar who is the ax-officio Secretary of the Syndicate.

(2) The Vice-Chancellor in the case of any teaching staff and Non-teaching employee of group A cf

Power to the University and the Registrar in the case of suspend Non-teaching staff of B, C and D Group are

employees empowered to place them under suspension, pending enquiry if, in their opinion, the continuance of the employee in service will be

detrimental either to the p reposed enquiry or interest or reputation of the University.

Notwithstanding anything contained in the above clauses, the Vice-Chancellor may, when he deems necessary, suspend any employee pending enquiry.

(3) Period of suspension should not normally exceed three months. Unless the period is

said three months, with the approval of the appellate authority, the suspension order shall be deemed to have been revoked.

(4) During such period he shall receive a

Notwithstanding anything contained in the above clause the Vice- Chancellor may when he deemed necessary suspend any employee pending enquiry. Provided furthur that the circumstances leading to the suspension of the employee shall be reported forthwith to the lending authority. The procedure prescribed in (3) to (7) of para Xlii above will apply in full in respect of employees who are appointed on foreign service terms in

the University.

Provided that in a case where it is considered that the punishment of compulsory retirement, removal or dismissal should be imposed the Vice-Chancellor/Registrar should complete the enquiry and revert the person concerned to the lending authority along with the above records and recommendation for such action as that authority may consider necessary. Provided furthur that in a case where it is considered that minor punishments such as censure, stoppage of increment without cumulative effect should be imposed, the Vice-Chancellor/Registrar should complete these enquiry and consult the lending authority before imposing the penalty or leave it to the lending authority as per foreign service terms.



XIV. CONDUCT AND DISCIPLINE

1. No Umversity employee shall take part in any

act or movement which is calculated in the

judgernent of the Syndicate to bring the

University into disrepute. It shall be the duty of

everyone of the employee to honour the

cnfidence reposed in him by the University and

not to divulge any information obtained by him

in the course of his official duties to outsiders or

to make any use of which would be improper.

2. No University employee shall indulge in any

cnticism of the University administration in such

manner as savours of defiance and

insubordination or causes or is likely to cause

embarrassment to the administration.

3. No University employee shall associate himself

with or take active part in politics. The

Syndicates decision on this aspect of an

employees conduct shall be final.

4. Employees shall not submit applications directly

for appointment to higher posts in the University

or for advance increments or for other kinds of

preferment. But they may submit their claims to

higher posts through the Officers under whom

they work if they have any special

representations to make.

5. A whole-time University employee may be

entrusteL with any work connected with the

Universty, academic or administrative, as

required by the proper authority without any

liability to meet the claim for additional remuneration. He shall not accept while in



University service additional employment or any employment on part-time basis with or without emoluments or honorary work without the previous sanction of the Vice-Chancellor or any

other competent authority ri writing.

6. Persons on appointment and employees on

transfer to posts dealing with cash. stores and

other valuables including book shall at the discretion of the Syndicate furnish security to

the University for such amount and of such character as may be determined by the Syndicate. This shall be a condition attached to

the post and shall not entitle the employee concerned, who fills the post to claim any additional remuneration or compensation or privilege on this account.

7. The Syndicate reserves the right to frame suitable rules arid amend or add to them.

8. The conduct and functioning of all those paid Out of University funds shall be brought under the purview of the Director of Vigilance and Anti- Corruption constituted by the Goverment of Tamil Nadu. The Registrar/Vice-Ctiancellorwill be the authority to make the requisition for a

preliminary enquiry and order a detailed enquiry by the Director of Vigilance and Anti-Corruption in respect of C and D groups and A/B groups respectively. In the case of the Vice-Chancellor, no preliminary enquiry shall be made by the

Director of Vigilance and Anti-Corruption without a specific order of the Chancellor.



XV. PENSION CUM GRATUITY:

i All members whethertemporary or permanent Eligibility are eligible for pensionary benefits subject to the and benefits conditions prescribed.

The pensionaly benefits are:- i. Pension or Service Gratuity

ii. Death-cum-Retirement Gratuity Family Pension

2. The main conditions for the grant of penisonary Conditions benefits are (i) the service should be under the for grant of University and (ii) the service should be paid for pension by the University.

3. (a) To compute these pensionary benefits for Maintenance an employee, the following three items have to of service be verified/computed with reference to the book service book of the employee.

i. Qualifying Service. ii. Average emoluments. iii. Last emoluments drawn.

(b) The Unrversity shall maintain a service book for every employee in complete and upto date shape with the entries therein duly verified and authenticated by the competent authority. The concerned employee will be

required to peruse and attest the same once in 5 years.

The record of verification of service with reference to pay bills and acquittances should be made periodicatly/annualy in the service book

under proper attestation. The date of birth should be correctly noted and attested.



4. Qualifying service sto be computed, taking into

Qualifying account the total service of the employee from

Service for the date of his entering service; which will be

Pension termed as Gross Qualifying Service. The broken

period of a month is to be calculated separately

taking thirty days as a month.

(a) From the gross qualifying service, the following

service are to be deducted to arrive at the net

qualifying service.

Gross qualifying service: Year, Month, Date.

Deduct the following service from the gross

qualifying service:

1. Boy Service (service prior to his completion

of eighteen years)

2. Extraordinary leave without medical certificate.

3. Suspension treated as a penalty.

4. Overstayal of joining time, not regularised.

The balance will be the net qualifuing service

which is to be expressed in terms of Completed

half-year, without any rounding off to the next

(b) Overstayal of joining time, if not regularised by

extension of joining time or by grant of leave,

will be treated as "Overstayal of joining time'.

This period will not count for pension.

(c) The period of suspension should be decided at

the time of finalising the proceeding against an



University employee. If this period of suspension is partly treated as duty and partly as punishment, then the punishment period will not be treated as duty and so it will not count for pension. lithe entire period is not treated as duty, then that entire period will not count for pension.

5. Average Emoluments:

(a) Emoluments' mean (i) Pay (ii) Special pay (iii) Personal pay (iv) Dearness pay.

(b) 'Average Emoluments mean the average of monthly emoluments actually drawn during the last 10 months of the service of the member before his retirement. If during this period, a

member was on extraordinary leave or on

suspension treated as such, then the period of calculation of 10 months is to be prepositioned to arrive at a total period of 10 months.

(C) liwill, therefore, be seen that only actually drawn amounts during the last 10 months have to be

taken into account and not any amount which has not actually been drawn. But, there are some exceptions as noted below;-

(i) Instead of the actual leave salary drawn during earned leave or half-pay leave etc., the duty pay which he would have drawn but for going on leave, will count.

(ii) The increment which accrued during the earned leave f the total earned leave taken at a time exceeded one hundred and twenty Gays, though not actually drawn, will be

in the calculation of average emoluments.

(d) Pay drawn on foreign service cannot be

considered as 'Emoluments' for the purpose of

calculation of pensionary benefits. Only, the pay

for going on foreign service will count.

6. Pension which is monthly payment after retirement calculated as per rules, will be

7. (i) In the case of the members who have completed thirty three years of qualifying service and above,

the pension (monthly payment) ¡s calculated at

the following rate:

(ii) In cases where the qualifying service is 10

years or 20 half years and more but is less than 33 years or 66 half years, the pension will be

proportionate to that calculated as in item(i) above in the same ratio as the actual number of completed half-year service bears to 66 halt years.

(iii) The Pensioner ¡s entitled to draw along with

pension, D.A and such other concessions as

may be santioned by the Government of Tamil Nadu from time to time and accepted by the

University.

8. Death - Cum - Retirement Gratuity: (a) This is calculated on the last emolumerit drawn

by the University servant before his retirement

at the rates indicated below for each completed

Retirement half year of qualifying service in the case of

Gratuity retirement, provided he has completed at least

5 years of qualifying service at the time of his

retirement.

(b) Fri the case of retirement, the Death-cum- Retirement gratuity is calculated at 1/4th of the last emolument drawn for each completed half year of service, subject to a miximum of 161/2

(c) In the case of death in service, while calculating Death-cum-Retirement Gratuity, as per formula indicated above, the minimum death-cum- Retirement Gratuity payable is as follows: i. In the case of less than 2 times Fast emolument

9. Family Pension:

(a) i. This is also calculated with reference to last emolument drawn and the rate prescribed for

Rate of different pay slabs (as indicated below) Family Pension ii. The Family Pension is to be calculated at the

uniform rate of 3O% subject to a minimum as fixed by the Goverment from time to time.

(b) In the case of deatt in harness, if the deceased member has put in t least 7 years of qualifying service at the time of his death, then the family is eligible for enhanced rate of Family Pension as indicated below for a limited period of 7 years

from the date of death or the date of superannuation if he had remained alive, which ever is less and thereafter at the normai rate of Family Pension.

10. The classification of the other kinds of pensions are: 1. Retiring Pension (Voluntary and compulsory) 2. Invalid Pension 3. Compensation Pension.

1. Retiring Pension:

(a) Voluntary Retirement:

After completing twenty five years of qualifying service or fifty years of age a member may retire voluntarily after giving to the appointing authority, a notice in writing at least 3 months before the date on which he wishes to retire. However, he cannot withdraw such notice subsequently excepi with the specific approval of that authority and the withdrawal should be before the date from which he originally wanted to retire.

ii. The three months notice period is to be reckoned from the date of its receipt in the office of the immediate superior if he has to address the appointing authority through proper channel on the date of receipt in the office of the appointing authority.



(b) Compulsoty Retirement:

Similarly, the appointing authority can order compulsory Retirement of a member in public interest after giving three months notice or three months pay in lieu of such notice at any time after the University servant has completed twenty five years of qualifying service or fifty years of age.

In such cases, when the member has been compulsorily retired from service as a penalty he may be granted by the authority competent to impose such penalty pension or gratuity or both, at a rate not less than 2/3rd of normal pensionary benefits which will be due to him if he retires normally on the date of compulsoty retirement.

2. Invalid pension:

This is granted to a person who by physical or mental infirmity ¡s permanently incapacitated for the University service.

The date of effect of retirement will be the date cf Medical Certificate, if the member was on duty or the date on which he will return to duty, if he

was on leave during the period when medical cerificate was granted.

If the infirmity is curable and the member refuses to get cured by operation or otherwise, no

pension or gratuity need be admitted if the competent authority decides so on merits.

If the medical authority recommends a less



laborious work than the one which he is presently

involved then the member may be appointed to

that less laborious work on a lower pay or

otherwise. If he does not accept that post, he

can be granted pension.

3. Compensation Pension:

This is granted after giving three months notice

to a person who is discharged from service

owing to the abolition of a permanent post, if the

employee refuses to accept another appointment on such pay as may be offered as

stipulated in Rule 39 of Tamil Nadu Pension

Rules.

No compensation pension is payable for the

period in respect of which he receives pay and

allowances in lieu of notice.

11. a. General Instructions: i. For the calculation of pension, the date of birth

12. Encashment of earned leave at the credit of the

(3) Commutation when sanctioned shall take effect

from the date of the order. Payment of commuted

of commuted specified and the sum payable on commutation

portion shall be paid with reference to the date so

specified.

(4) Commutation once given effect to cannot be

XVI. TRAVELLING ALLOWANCE AND TRANSFER TRAVELLING ALLOWANCE:

(1) The Tanìii Nadu Travelling Allowance Rules Goverment are applicable to the University employees, The and special rates of Travelling Allowance and Daily Rules Allowance shall be adopted as in the case of

Government Servants for all University employees, and special rates as shown in the annexure Ill shall be adopted for particular group of officers of the University and members of the various authorities and committees.

(2) Provided that the Vice-Chancellor may, in

Rules for exceptional cases, allow Travelling Allowance exceptional at the rates higher than that admissible as per cases para (1) of Section XVI above.

(3) Transfer Travelling Allowance as per Tarnil Nadu

Government Rules.

XVII. PROVIDENT FUND: PROVIDENT FUND CUM INSURANCE SCHEME FOR



THE EMPLOYEES OF THE BRARATHIDASAN UN IVERSITh' 1. General

(1) These statutes shall be called "Provident Fund Title cum Insurance Scheme Statutes' for the

employees of the Sharathidasan University.

(2) These statutes shall apply to all the University Application Teaching and Non-Teaching employees.

(3) In these statutes, unless there is anything repugant to the subject or context:-

(i) Fund' shall mean the provident fund established and maintained under these statutes.

(ii) 'Employees shall mean Teaching arid Non-Teaching employees of the Bharathidasan University.

(iii) University' shall mean the Bharathidasan University.

(iv) 'Syndicate shalt mean the Syndicate of

the Bharathidasan University.

(y) 'Teachers shalt mean the teaching stai

as mentioned in the statutes.

(vi) 'Non-leaching Employees' shall mean the Administrative and establishment personnel.

(vii) 'Pay' includes, pay, substantive and officiating, special pay, personal pay,



leave salary, all dearness allowances.

(viii) 'Subscriber' shall mean a person eligible to

subscribe to the fund under these statutes and subscribing thereto.

(ix) 'Subscription' shall mean the sum remitted to the fund by a subscriber under these statutes.

2. The statutes shall come into force from such date Date of as notified, subject to the provision of these coming statutes, subscription to the fund shall be into force compulsory for all employees.

(ii) Voluntary increase over and above the rate

(iii) An employee who is continuously in service

7.Accounts: The account of the subsciber shall show-

1. The amount of his subscriptions with interest thereon.

2. Forfeiture, if any, under these statutes. 3. Moneys, if any, debited against such

accounts.

8. Interest on subscriptions:

i. Compound interest at the rate allowed every Rate of year to Government servants of Tamil Nadu interest under General Provident Fund shall be allowed

on the subscriptions less the amount of advance, if any, remaining unpaid.

ii. In the event of resignation or retirement of subscriber proceeding on leave preparatory to retirement he desires to close his provident fund account, interest shall be payable only upto the date of application for such closing of account.

9. Rights ¡n respect of subscriptions and intere st

In the event of a subsciber ceasing to be the

10. (i) Every subscriber shall on admission to this

fund sign in the presence of two witnesses and

Nominee deliver the "Form of Nomination" appended in the

appendd prescribed form. A subscriber shall ordinarily

nominate his wife and or his children natural or

adopted. In the case of unmarried employee he

shall ordinarily nominate his parent, brother or

sister. If there are no such persons mentioned

above he can nominate any person/persons

or a body of individuals incorporated or not.

(ii) He shall be at liberty to deliver revised nominations, from time to time. This nomination

shall be kept in the personal custody of the

Finance Officer of the University. An

acknowledgement shall be sent for every nomination received and when a revised



nomination is delivered. the previous nominalion shall be returned to the subscriber along with the acknowledgement for the revised nomination.

The persons appearing in the latest nomination shall be recognised by the fund and the receipt of such person or persons shall be complete discharge of all liabilities in respect of the fund. A register shall be maintained in the Finance Section in which the names of all nominees shall be entered.

(iii) The subscriber may nominate one person or any number of persons as his nominee or

Rights nominees and if he nominates more than one to refuse person he must enter in the "Form of or accept Nomination" the proportion in which the amount Nomination payable shall be distributed among them. The

nomination shall normally be accepted by the Vice-Chancellor of the University. The Syndicate shalt have the right to refuse to acGept the nomination of any person for valid reasons and the subscriber shall thereupon register some other person approved by the Syndicate.

11. (i) The University will not be bound by nor will Liability it recognise the assignment or encumbrance Non-Liability executed or attempted to be created which of forfeiture affects the disposal of the amount standing to of the Fund. the credit of a subscnber who dies before

retirement.

(ii) The subscriptions and interest thereon of a subscriber are not liable to forfeiture on dismissal or on conviction by a criminal court, except for an offence for which the penalty of forfeiture of



the offender's property is ordered by a

competent court of law.

12. The account of each subscriber shall be closed:-

(i) When he is dismissed or removed or

or inefficiency or when he resigns

OR

(ii) When he retires from service or when his

services are dispensed with owing to a reduction

of establishment OR

(iii) When he dies. Provided that when a subscriber is dismissed,

removed or discharged from service the amount

standing.to his credit in the fund shall not be

paid to him until the appeal time allowed, if any,

is over to unless he states in writing that he will

not prefer an appeal.

(iv) When a subscriber proceeds on leave preparatory to retirement, at any time between

the date of commencement of such leave and

the date of retirement.

(y) When the account of a subscriber is c'3sed

the amount payable to him under these rules

shall be audited by the University before

payment.

13. (1) The Vice-Chancellor may, at his discretion grani



to a subscriber an advance of a sum which does not exceed 75% of the amount of the subscriptions and interest thereon standing lo his credit at the time of making such advance for any of the following purposes:-

(a) to pay the expenses incurred in connection with the illness of himself or a member or members of his family dependant upon him;

(b) to pay the expenses in connection with the marriage, funerals or ceremonies which by the religion of the subscriber it is incumbent upon him to perform and in connection with which it is obligatory that expenditure should be incurred;

(C) for such other purposes as the construction of a house, purchase of a site or a house and for the expenses in connection with the Higher Education of Children as the authority may consider reasonable.

(2) An advance shall be recovered in thirty monthly instalments (unless the subscriber elects earlier repayment of the sum) deducted fi-orn the subscriber's pay commencing from the first payment of a full month's pay after the advance is granted.

(3) No interest need be recovered from the subscriber for the temporary withdrawals granted to him.

(4) (a) A subscriber may be granted a

regulated under sub-clause (2) above.

14(1) Part-final withdrawals may be sanctioned by the

Vice-Chancellor for the reasons mentioned

Part-final under statute 13 at anytime after the completion

withdrawal of fifteen years of service (including broken

period of service, f any) of a subscriber or within

ten years before the date of his retirement on

superannuation, whichever is earlier, from the

amount standìng to his credit in the fund. Only

one withdrawal can be allowed for one and the

same reason.

(2) Conversion of a t empora,y withdrawal ¡rito a

part-final withdrawal: A subscriber who has

already drawn or may draw in future a temporary

withdrawal under statute 13 for any of the

purposes specified therein may convert, at his

discretion, by written request addressed to the

Vice-Chancellor, the balance outstanding

against him into a part-final withdrawal subject

to the eligibility of service included ¡n Statute

14(1). In cases where all the advances

the entire outstanding balance shall be allowed

to be converted into a part-final withdrawal.

(3) (a) There shall be an interval of twelve months

between one part-final withdrawal and another.

The same duration is applicable between one

conversion of part-final withdrawal and the next

part-final withdrawal.

(b) There shall be an interval of six months

between the sanction of one part-final withdrawal

and one temporary withdrawal and viceversa.

15(1) The account of every subscriber shall be made

(2) Each subscriber shall, at the close of the year,

be furnished with a statement of his account

Account showing the amount of his subscription and

Slip interest thereon and the amount of advances outstanding, ¡f any.

16. Every member of the academic and non- Group academic staff of the University shall subscribe

Insurance to the Group Insurance Scheme instituted by the

University.

17. The following Account Books/Forms shall be

of Account Section in the forms prescribed: Books

(a) Account Books:- i. Register of subscribers

ii. Cash book

iii. Abstract of Provident Fund Institution



iv. Provident Fund Ledger

(b) i. Nomination form

Annual Account slips

iii. Application for temporary withdrawal

iv. Application for part-final withdrawal

y. Refund voucher.

18. Save as otherwise provided for in Statute XiX

Statutes these statutes and any amendments thereto

binding on shall be binding on every subscriber and every

subscribers person deriving title from him.

1 9. The power of interpreting these statutes and of

Interpretation deciding cases of dispute or doubt is vested in

the Syndicate and its decision shall be final.

20. The Syndicate may, from time to time, issue

Management general or special instructions as may be

necessry consistent with the statutes for the time

being n force as to:

(a) Conduct of the business of the fund.

(b) Any other matter relating to the fund.

21. The power of amending or adding to or repealing

Alterations these statutes or.any of them shall, vest in the

¡ri the Syndicate. The subscibers in services sha' on

Statutes the introduction of such changes be bound by

such amendments.

XVIII. PENSION FUND ACCOUNT:

1. A pension Fund shall be constituted by the



University into which contributions at the rate of

10% of the maximum of the time scale of pay of

each employee shall be credited monthly. The

pensionery commitments of the University shall

be met out of this fund.

2. In respect of employees of the Madras University

who have become employees of the Bharathidasan Unìverstiy consequent on the

formation of this University or on account of

transfer to this University, the pensionery contribution due from the Madras University, ¡ri

respect of their erstwhile service under the Madras University shall be got transferred and

credited to this fund.

3. The proceeds of the fund shall be invested in

such manner as may be decided by the Vice- Chancellor with a view to earn advantageous rates of interest.

4(a) In respect of teachers who get themselves appointed in this University, having served in

Transfer of some other University I Institution shall have the

pension pension funds accumulated in other Universities

equivalent or Institutions for the period of their service forteachers transferred to this University. In case the

Institution or University from where the teachers

come to this University does not have pension

scheme, the pensioner may himself pay such

amount that would have accumulated ¡n the

pension fund if the Institution ¡ University where

he was previously serving has pension scheme

and has maintained pension fund.



4(b) In respect of these teachers who have their

pension fund accumulation in their previous

Institution transfered to this University or pay

themselves the pension contributions that could

have accumulated till they left the Institution or

the University wherein they served previously,

the period of pensionable service shall be

calculated taking into consideration the previous

service also. Provided that they contribute to the

pension Fund an equivalent to 10% p.m. of the

maximum of the scale of pay of the posts they

were holding within India prior to joining this

University; or. in case their previous employment

was outside India, they shall contribute to the

'Pension Fund' a sum equal to 10% p.m. of the

initial pay at which they are employed in this

University.

4(c) In case of teaching staff, who get themselves

appointed in other University I Institutions to

better their prospects or for other reasons, the

University shall calculate the pension fund

accumulation in their accounts on the date of

leaving the service of the University and transfer

them to the University / Institution wherein they

take up employment provided there are such

pension schemes in vogtie in the University I

Institution where such persons are transferred.

XIX. POWER TO ADD OR TO AMEND:

Act. Sec.31 The Syndicate shall be competent to alter or to

XX. iNTERPRETA TION:

On all question of interpretation of these statutes, the decision of the Syndicate of the University shall be final. On matters not specifically covered in the service statutes of the University Employees, such rules governing the servants of Tamil Nadu Government shall apply unless otherwise decided by the Syndicate.

XXI. SAVING:

Such other rules as are considered necessary to carry out the functions of the University will be framed by the Syndicate as and when necessary under the respective headings.

CHAPTER Vii

THE UNIVERSITY

The Chancellor, Pro-chancellor and Vice-Chancellor of the University and the members of the Senate, the Syndicate and the Standing Committee on Academic Affairs are a body corporate by the naine of the Bharathidasan University.

CHAPTER VIII

UNIVERSITY DEPARTMENTS! SCHOOLS! CENTRES

1. A University Department of Study and Research/School! Centre is one established by Statute and under the direct control of the University.

2. There shall be University Departments of Study and Research and or Teaching/Schools/Centres in the following branches of knowledge:

Mathematics. 2. Physics. 3. Chemistry. 4. Botany. 5. Earth Sciences. 6. Computer Science. 7. Economics. 8. English. 9. Social Sciences. IO, Tamil, 11. Bio-Technology. 12. Educational Technology.

lt shall be competent for the Syndicate to establish new departments, as found necessary.

A department of Teaching/School/Centre is one which

deals with a branch(es) of knowledge pursued in the

University and which is comprised within a Faculty of

the University.



CHAPTER - IX

UNIVERSITY PROFESSORSHIPS, EMERITUS PROFESSORSHIPS, READERSHIPS AND

LECTURERSHIPS

Power to institute Pro fessorships etc.

The syndicate shall have power to determine from time to time, in consultation with the Standing Committee on Academic Affairs, wherever it deems necessary, and on the recommendation of the Vice-Chancellor, the subject Iorwhich the Prolessorships, Readerships, Lecturerships, 1(including those in the Selection Grade and in the Senior Scale) or other teaching posts should be instituted and the several terms and conditions subject to which such Professorships, Readerships, Lecturerships or other teaching posts should be instituted.

Suspension or Abolition of Professorship, etc.

2. The Syndicate shall have powers to abolish or suspend any Professorships, Readerships, Lecturerships or other teaching posts on report from the Vice-Chancellor thereon.

Classification of Teachers:

3. The teachers of the University shall be classified as Professors, Readers, 2Lecturers in the Selection Grade, Lecturers (Senior Scale) and Lecturers. The duties of the Readers and Lecturers are to teach and to engage in research and extension activities. The duties of Professors shall include in addition to teaching and research and extension the guidance

and co-ordination of studies ¡ri therr subjects in

consultation with the colleges.

Emeritus Professors:

4. Notwithstanding anything contained ¡n the Statutes, ¡t

shall be competent for the Syndicate to appoint

distinguished Professors of repute who have retired from

service of this or any other University or an affiliated

college of this or any other University as Emeritus

Professors on such terms as may be dec'cd upon by

the Syndicate.

Honorary Teachers:

5. lt shall be open to the Syndicate to appoint teachers in

this University without salary to take part in the work of

the University in their respective subjects.

Part-time Teachers:

6. Part-time teachers of the University may be appointed

for special reasons and shall ordinarily be chosen from

amongst the members of the staff of the affiliated colleges

and shall perform such duties as may be assigned to

them. They shall be appointed forsuch period and paid

such salaríes as may be fixed in each case, regard being

had to the grade of the teachers and to the amount of

time they are to devote to the work of the University.

They shall be entitled for vacation and other holidays.

Duties of Professors:

7. lt shall be the duty of the University Professors, as the

Syndicate may direct-

to deliver lectures, conduct classes. engage in

research and any other academic work related to the Department;

to direct and supervise the work of research students in brarches of knowledge related to the subject of their specialisation concerned;

and to advise the Standing Committee on Academic Affairs and the Syndicate, if required, with regard to any course of study or examination of the Univesity or on other matters relating to the subject connected with the respective areas of their specialisation.

Head of the Department:

A University Professor J Reader / Lecturer appointed by the Vice-Chancellor as the Head of the Department shall discharge the functions, and duties as prescribed in the Ordinance.

9. (i) In a Department n which there are more than one Professor, the Head shall be appointed in ROTATION once ¡n three years among the Professors, and all other faculty members in the department shall work under the direction and supervision of the professor appointed as the Head of the Department.

(ii) In a Department in which there is only one Professor, the Head shall be appointed in ROTATION once in three years among the Professor and Readers who have put in not less than 10 years of teaching and research experience, and all other faculty members in the department shall work under the direction and supervision of the Professor or Reader appointed as the Head of the Department.

(iii) In a Department in which there is no Professor, the Head shall be appointed in ROTATION once in three years among the Readers, and all other faculty members in

the department shall work under the direction and supervision of the Reader appointed as the Head of the Department.

(iv) n a Department in which there s no Professor and there ¡s oniy one Reader, the Head shall be appointed in ROTATION once in three years among the Reader and the Lecturers (SeLection Grade) who have put in not less than 8 years of teaching and research experience, and all other faculty members in the department shall work under the direction and supervision of the Reader or the Lecturer (Selection Grade) appointed as the Head ol the Department.

(y) In a Department in which there is no Professor or Reader, the Head shall be appointed in ROTATION once in three years among the Lecturers (Selection Grade), and all other faculty members in the department shall work under the direction and supervision of the Lecturer (Selection Grade) appointed as the Head of the Department.

(vi) In a Department in which there is no Professor or Reader and there is only one Lecturer (Selection Grade), the Head shall be appointed in ROTATiON once in three years among the Lecturer (Selection Grade) and the Lecturers (Senior Scale) who have put in not less than 5 years of teaching and research experience, and all other faculty members in the department shall work under the direcJon and supervision of the Lecturer (selection Grade) or the Lecturer (Senior Scale) appointed as the Heäd of the Department.

(vii) In a Department ¡n which there is no Professor, Reader or Lecturer (Selection Grade), the Head shall be appointed in ROTATION once in three years among the Lecturers (Senior Scale), and all other faculty members in the department shall work under the direction and supervision of the Lecturer (Senior Scale) appointed as the Head of the Department.



(viii) In a Department in which there is no Professor - Reader or Lecturer (Selecton Grade) and there is only one Lecturer (Senior Scale). the Head shall be appointed ¡n ROTATION once in three years among the Lecturer (Senior Scale) and the Lecturers who have put in riot less than 2 years of teaching and research experience, and all other faculty members in the department shall work under the direction and supervision of the Lecturer (Senior Scale) or the Lecturer appointed as the Head cf the Department.

(ix) In a Department in which there is no Professor, Reader, Lecturer (Selection Grade) or Lecturer (Senior Scale), all other Lecturers shall work under the direction and supervision of the Lecturer appointed as the Head of the Department.

Duties of Readers and Lecturers.

10. The duties of the Readers and Lecturers (including Lecturers n the Selection Grade and Lecturers in the senior Scale) are to teach and to engage in research and extension work. They are also to guide and supervise the work of research students in branches of knowledge related to the subject of the Department.

li. Nothing contained in the Statutes shall preclude the proper authority from entrusting any work connected with the University, academic or administrative, from time to time, to any member of the University.

Qua!ifica tian of the Teachers in the University Departments:

12. The qualification of the University teachers shall be prescribed by the Syndicate, ordinarily on the basis of the University Grants Commission guidelines.

CHAPTER - X

CONVOCATIONS

CONVOCATION:

Convocations for the purpose of conferring degrees shall

ordinarily be held once a year in th month of September and at

such other times as the Chancellor may direct.

2. DATE OFAPPLICATION:

All the candicates who are declared to have passed the

respective Examinations by the duly constituted Examiners and

as approved by the Syndicate, shall be admitted to their several

degrees at the convocation that follows, and the Diplomas issued

as and when the candidates submit to the University their

applications in the prescribed form along with the prescribed fees.

3. DEGREE IN-ABSENTIA':

A candidate for a degree may on payment of the

prescribed fee be admitted ¡n-absentia to that degree.

4. NON-ADMISSION TO A CONVOC4TIONA SECOND

TIME FOR THE SAME DEGREE:

No candidate who has already proceeded to a Degree

arid has been awarded the Diploma shall be admitted to the same

Degree, a second time at a convocation. not withstanding the

fact that the person may have qualified in an additional language.

5. SEAL OF THE UNIVERSITY:

The diplomas of the University shall be valid only if they

bear the seal of the University and are signed by the Vice-

Chancellor and Reg!strar



6. CON VO CA TION ADDRESS

The Cliancellor/ Vice-Chancellor may invite an eminen person to address the candidates.

7. ASSEMBLY OF SYNDICATE:

The Chancellor, Pro-Chancellor, Vice-Chancellor and Members of the Sydicate shall wear the academic robes prescribed and assemble in the Syndicate Ro-orn atihe appoinied hour.

In the absence of the Chancellor, the Pro-Chancellor shall preside: in his absence the Vice-Chancellor shall preside in their absence a member of the Syndicate nominated by the Syndicate for this purpose shall preside.

8. APPROVAL OF THE SYNDICATE FOR THE ADMISSION OF CANDIDATES:

The approval of the Syndicate, for admission for the several degrees will be supplicated on behalf of the candidates by a member for each Faculty in the following order in a special meeting of the Syndicate convened for this purpose.

Law; Medicine; Engineering and Technology; Science; Commerce; t Education; Arts; Oriental Learning; Fine Arts and 2Management.

9. PROCEDURE FOR APPROVAL OF VARIOUS FACULTIES

The Member of the Syndicate shall say, "Mr.Chancellor, I request that the Syndicate may be pleased to admit those persons, whom the Vice-Chancellor on the reports of the Examiners has certified to be quaLified for the Degree/Diploma of ................ to the Degree/Diploma.

Whereupon the Chancellor shall put the question Does it please you that this request be granted?" and the Syndicate assenting, the Chancellor shall say, The Request is granted".

10. PROCESSION:

When the approval for various Faculties has been granted, the Chancellor, Pro-Chancellor, Vice-Chancellor, the Chief Guest, recipient(s) of Honoraray Degree(s), Members of the Syndicate. and Members of the Senate, and Standing Committee on Academic Affairs shall proceed in a procession to ihe hall in which the degrees are to be conferred.

The order of the procession is as follows:

i) Registrar. ii) Members of the Standing Committee on Academic

Affairs. iii) Members of the Senate. iv) Members of the Syndicate. V) Vice-Chancellor.

.vi) Honorary Degree Awardee (s), if any. vii) Chief Guest.

viii) Pro-Chancellor. ix) Chancellor.

11. ARRANGEMENT OF SEATS:

The seating in the hail be so arranged that the Chancellor's chair may be somewhat in advance the chairs



assignea Pro-Chancellor, Vice-Chancellor. the Chief Guest, Registrar and Members of the Syndicate being so arranged as

to leave sufficient space for the presentation of the candidates. Special seats shall be provided in the hail for the Members of the

Senate and Standing Committee on Academic Affairs.

12. SEAT/NG OF CANDiDATES:

The candidates shall be seated in front of the Chancellor wearing the gowns and hoods pertaining to their respective degrees -

13. On the procession entering the hall, the candidates shall rise and remain standing until the Chancellor. Pro-Chancellor, Vce-Chancellor, Honorary Degree Awardee(s), the Chief Guest, Registrar and Members of the Synidicate, Senate, and Standing Cornmïttee on Academic Affairs have taken their seats.

14, INVOCATION:

The Chancellor, Pro-Chancellor, Vice-Chancellor, Honorary Degree Awardee(s), the Chief Guest, Registrar and

Members of the Synidicate, Senate, and Standing Committee on Academic Affairs having taken their seats, the Chancellor shall call for the invocation, 'Thamizh Thai Vazhthu'.

15. WELCOME ADDRESS AND REPORT Y THE VICE- CHANCELLOR.'

Immediately following the'lnvocation, and at the request of the Chancellor, the Vice-Chancellor will deirver the welcome address and present a report on the academic achievemenis of the University during the year.

16. DECLARING THE CONVOCA TION OPEN:

The Chancellor shall say. 'This convocation of the



Bharathidasan University has been called to confer (upon persons

on whom the Syndicate has decided to confer honorary degrees)

..... degree / diploma upon the candidates who,

in the examinations recently held for the purpose have been

certified to be worthy of the same".

17. PRESENTATION OF CANDIDATE(S) FOR HONORARY DEGREE (S):

The Chancellor shall say, 'I invite the Vice-Chancellor to read the citation and present Mr.X for the candidature of the

honorary degree of Doctor of Science/Doctor of LiteraturelDoctor

of Laws.

The Vice-Chancellor wilt read the citations and prtsent Mr.X forthe award of the honorary degree of Doctor of Science!

Doctor of Literature/Doctor of Laws".

Mr.X will receive the degree certificate from the Chancellor.

18. CON VO CA TION ADDRESS:

The Chancellor shall say; '1 invite the Chief Guest to

address the candidates".

The Chief Guest will deliver the Convocation Address.

19. PRESENTA TION OF CANDIDATES ANDAWARD OF

CERTIFICATES, MEDALS AND PRIZES:

The Chancellor shall say; Let the candidates be now

presented'.

Then the candidates for the award of Degrees/Diplomas

will be presented by the Members of the Syndicate. as decided,

in the order of Faculties as given in Statute eight above.

The procedure for presenting the candidates for the Prizes/Medals and Degrees shall be as follows:

20. ADMINISTERING THE PLEDGE.

All the candidates having been presented, the Chancellor wrll administer the pledge. All the candidates standing, the Chancellor will read out the following pledge and the candidales shall repeat the same. "We shall, in thought, word and deed ever endeavour to be scrupulously honest in the discharge of our profession and shall uphold the dignity and integrity of our profession and the honour of our University. We shall uphold and advance social order and the well being of oui fellow members and shall devote all our energy to promote the unity and integrity and the secular ideals of our country".

21. CONFERMENTOF THE DEGREES;

After administering the pledge to the candidates, the Chancellor shall say: "By virtue of the authority vested in me as

Registrar shall lay the Record of the Degrees that have been

conferred, known as the Register of Graduates, before the

Chancellor, who shall sign the same.

23. DISSOLUTION OF CONVOCATION:

At the conclusion of the proceedings, the Chancellor,

Pro-Chancellor, Vice-Chancellor, the Chief Guest, Recipient(s)

of Honorary Degree(s), Registrar and Members of the Syndicate

shall rise and then the Chancellor shall say: 'I dissolve this

Convocation".

24. NATIONAL ANTHEM:

Then the National Anthem will be played.

25. PROCESSION BACK TO THE ROBING ROOM:

The Chancellor, Pro-Chancellor, Vice-Chancellor, Chief

Guest, recipient(s) of Honorary Degree(s), the Members of the

Syndicate, Members of the Senate and Standing Committee on

Academic Affairs, Registrar, shall retire in procession to the robing

room, the graduates standing.

26. PROCEDURE FOR HONORARY DEGREE(S):

Nothing n the foregoing statutues, except statutes 7, lo, 11, 12, 14. 15. 16, 17, 21,22,23,24 and 25 of this Chapter, in so far as they are applicable, shall apply in the case of Honorary D eg ree (s).

27. A full-scale rehearsal cf the Convocation Ceremony shall be conducted.

28. "Not withstanding the above Statutes, pending the conduct of Convocation, the Chancellor may authorize the Vice- Chancellor to issue Degree Certificates to such of those candidates who are genuinely in urgent need of the Degree Certificate, if the Syndicate had approved the same; provided that such candidates who receive their degrees before the conduct of convocation shall also be listed in the Registry of Uraduates to be presented to the presiding authority for his signature at the time of the Convocation.

CHAPTER - XII

AFFILIATION, RECOGNITION AND APPROVAL OF

COLLEGES/INSTITUTIONS

Definifion 1. (a) 'Affiliated colleges means any

college situated within the University area and

affiliated to the University and providing courses

of study for admission to the examinations for

degrees of the University and includes a college

deemed to be affiliated to the University under

this Act;

(b) 'Approved college means any college

situated within the University area and approved

by the University and providing courses of study

for admission to the examinations for titles and

diplomas of the University and includes a college

deemed to be approved by the University under

this Act;

(c) 'Autonomus college means any college

designated as an autonomous college by

Statutes.

2. The Syndicate shall have the power to

Powerto affiliate any college within the area of the

grant University and to recognise any college!

affiliation! institution within the territorial jurisdiction of the

recognition! University as an approved college/instituion

approval providing courses of study for admission to the

examinations for degrees, diplomas and titles.

3. The Syndicate shall have the power, at

Withdrawalof any time after due enquiry to withdraw or

Affiliation! suspend for a definite period the affliation or Recognition! recongnition granted to a college/nstution as a

Approval to whole or in any particular subject or branch of Colloges study provided that before taking such action,

the Syndicate shall inform the management of

the college concerned, of its findings after the enquiry and shall allow it an opportunity of making such representation as it may deem fit. Provided further that in the event of affiliation or

approval being granted temporanly subject to fuIfiment

of certain conditions, it shall be open to Syndicate

in the event of management not fulfilling any or all of the conditions in such manner and within such period as may be specified to withdraw such affiliation/recognition or approval without further enquiry. Such decision of the Syndicate shall be final and binding on the management. and shall not be subject to review by anybody or authority.

4. Any action taken regarding temporary Temporary suspension of instruction or closure of courses Suspension as perthe Private Colleges Act must be intimated

to the University before the corn mencement of the Academic year.

CONDITIONS TO BE SATISF1ED BY AFFILIATED AND

APPROVED COLLEGES

5(a) Every College shall be managed by a

Managing regularly constituted Managing Body/College Body Committee on whic'ì the teaching staff shall be

represented by Principal and two senior teachers. However, in the case of Government



Colleges the Syndicate may waive these

conditions

(b) The constitution of the Managing Body!

College Committee of the College shall also

provide for one representative of the University

to serve on the Managing Body/College

Committee.

(C) Any change in the Constitution of the

Managing Body/College Committee shall be -

reported forthwith to the Syndicate.

6(a) Every college shall have a duly

constituted College Council with a proper

College representation of the teaching staff, to advise

Council the Principal in the internal affairs of the college.

A record of proceedings of the College Council

shall be maintained by the Principal.

(b) The College Council shall consist a

minimum of- (i) The Principal . . . . Chairman

(ii) Alt Heads of Departments

(In the absence of the HOD, the senior staff

of the department) (iii) Physical Director

(iv) Librarian

7. Every college shall satisfy the Syndicate

Financial that adequate financial provision is available for

pro iision, its continued and efficient maintenance, in the

Land form of an endowment and / or revenue earning

assets. Atleast 50% must be cash endowment,

as prescribed, and also adequate land as

prescribeu in statutes and ordinances.



8. Every College shall satisfy the Conditions Syndicate on the following aspects: of Affiliation, Approval or (i) the suitability and adequacy of ils Recognition accornodation and equipment for teaching:

(ii) the competence and qualification, and adequacy of its teaching staff and the conditions of their service;

(iii) the residence, physical welfare, discipline and supervision of its students:

(iv) no College shall do anything which would endanger national integration and social, communal and/or and religious harmony:

(y) such other matters as are considered by

the Syndicate to be essential for the maintenance of the tone and standard cf University education.

In regard to matters referred to above, the

Syndicate shall be guided by the inspection reports and by any rule which may be

prescribed. The Syndicate may consider the past record of the institution, the suitability and

social relevance and need, before granting affiliation, approval or recognition of a course.

9. Every College shall furnish such returns Returns and other information as the Syndicate may from require to enable it to judge the efficiency of the Colleges College and shall take such action as it may

consider necessary to maintain its effictency.



In particular, the College shall submit:

(i) a return of staff as on the Ist August and

ist January before the 15th August and 15th

January of each year, respectively and a return

of change of staff immediately, if any change

takes place;

(ii) a statement indicating the strength of

students, class-wise and subject-wise and also

showing the number of sections arranged for theoretical and practical instruction with the

sanctioned strength in the parallel columns:

(iii) hostel returns showing the r lents in

hostels and approved lodgings t.J those residing with their parents and also the provision of Wardens/Deputy Wardens and Proctors! Tutors;

20. In repect of Inspections prescribed in the Action by Statutes/Act, the University shall communicate College on to the Educational Agency its views with Inspection reference to the findings of such inspection, and Reports every Educational Agency shall take within such

period as may be fixed, such action as the Syndicate may specify and communicate the action taken to the University within the prescribed time.

21. The following registers and records in the form Registers & that may be prescribed by the Syndicate /

Records to be Government shall be maintained by each college rnaintainedby exclusively for the college: colleges

(a) A register of admission and withdrawals (b) A register of attendance (C) A register of attendance at physical

(e) A register of members of the statt, showing their qualifications, previous experence, salaries, number of hours of work, and classes and the subjects being taught by them

(f) A register of fees paid showing date of

payments

concessions (i) A counterfoil book of transfer certificates

student at the College/University examinations.

maintain records of internal and Annual

22. Every college shall conform to and be

bound by the Laws of the University.

23. a) PROCEDURE TO BE ADOPTED IN THE

GRANT OF AFFiLIA TION. RECOGNITION OR

APPRO VA L

Application for a new college shall be sent to

the Registrar.6 months in advance of the academic year

in which the new college is to be started. The application

shall be accompanied by project report giving details

of the types of courses and how they are to be

implemented (including what physical facilities will be

available).

Information regarding the following matters will

also be included in the application:

(i) Constitution and personnel of the

Managing body.

(ii) Subjects and courses to which affiliation

or approval is sought.



(iii) Previous applications, if any, for affiliation

or approval/recognition ¡n the same subject

and their disposal.

(iv) Accomodation, equipment, the strength of

the college and the number of students for

whom provision has been made. The

information relating to accomodation should be accompanied by prooer drawings of the buildings.

(y) Qualification, Salaries and work of the

teachers together with a time tab'e of their

work.

(vi) Hostels/lodgings, playgrounds and also

residences for the Principal and other

members of the staff.

(vii) Fees proposed to be levied and the

financial provision made for capital expenditure on buildings and equipments

and for the continued maintenance of the

college. (viii) In the case of colleges for Men, whether it

is decided to admit Womer students and.

if so, the arrangements proposed for their

convenience.

In addition, the following assurance shall he

given that no student or staff of the college will be

compelled to attend, the classes or discourses

in religious or participate in other religious

activities c iducted by the college, nor will they

be forced to contribute physically or financially

towards these activities.

Application for aftialiation togetherwith the

project report shall be examined by a Committee

set-up by the University, consisting of



Academics, Dean, College Development Council and the Director of College Education/Director of Technical Education!

Director of Legal studies or his nominee. The

membership should not Drdinarily exceed six.

The Committee while examining the

application for affiliation of a new college,

together with the project report shall keep in view

the following: i) What are the existing facilities/enrolment for

undergraduate and/or postgraduate education in the concerned region/area/city?

ii) Is the college going to serve some special

purpose related to the region, its manpower

needs, employment opportunities or

developmental deficiencies?

iii) What is the state of employment in the

region for the educated possessing the

type of education/courses which are

proposed to be taken up?

iv) Whether the need can be served by non-

formal/distance education channels, or by

strengthening/expanding the existing

institutions?

The report of the Committee should be

submitted within S months from the date of

application. After the management obtained the

permission of the State Government to start a

new college and submitted the copy of such an

order, the proposal in detail, including the inspection of the facilities of the colleges as

listed below shall be examined by the Vice-

Chancellor and the Syndicate.

i) ENDOWMENTFUND:

Every college should be registered as a

Society under the Societies Registration Act, 1860 (21 of 186G) or as a Trust with

Trustee being appointed and vested with

legal powers and duties and create a non-

transferable Endowment Fund in the name

of the Society or Trust as the case may

be. Endowment Fund for various courses

and the manner of investment of the

amount are given in Annexure-l.

ii) LAND.

Each college should have the extent of la rid

as given in Annexure-lI.

The number of lecture rooms, laboratories,

library, canteen/ cafeteria hostel

accommodation, etc. should be in accordance

with the norms prescribed by the University.

iii) CIVIC FACILITIES:

While designing the building, it may be

ensured that adequate facilities such as lighting,

ventilation and sanitation are provided, keeping

in view the norms laid down by the Indian

Standards Institution for the local authority.

iv) STUDENT HOSTEL

Adequate hostel facilities should be

provided according to the norms perscribed by

the University from time to time.

y) PRlNClPALS RESIDENCE:

Principal may be provided with residential

quarters at the close proximity to the coUege to

facilitate better administration.

vi) STAFF QUARTERS FOR TEACHERS:

Suitable residential accommodation for atleast 25% of trie teachers alonj with certain common community facilities may be provided.

If the college is to be extablished in an interior area, higher percentage of teachers may be

provided with residential accommodation in

order to facilitate their participation in

the corporate life of the college.

vii) ESSENTIAL SERVICES:

Adequate facihties for essential services

(water, electricity and sewerage facilities, etc.)

be provided in all the buildings.

viii) LABORATORY:

Laboratory should have adequate safety

arrangements in respect of gas supply and

electrical fittings. Regular supply of water,



&ectricity, etc, should be ensured. There should be separate aboratory facility - for each discipline and also for the U.G. and PG. courses.

ix) LiBRARY.'

To begin with the library should have ati east 200 books in each subject. It should be

increased to 300 within a period of three years. The library should have adequate number of reference books and journals. There should be a reading room to Seat atleast 10%

of the student stregth at any time. Suitable space should be made available for library staff with proper furniture. There should be provision for a recurring expenditure of not less than Rs.3,000/- per subject per annum for books apart from the grant received form the U.G.C. for books. Qualified and adequate staff should be provided as per the prescribed norms.

In every discipline, atleast two subject journals should be subscribed to by the library. The U.G.C. and the University journals, if any,

in the subjects concerned should also be

subscribed to.

For teachers to examine the class work of

students and to prepare for their own lectures, separate staff rooms for each Department should be provided with infrastructural facilities.

x) GENERAL:

accordance with the norms prescribed by the

University. Maintenance and running expenses

of the laboratory should also be in accordance

with the norms prescribed by the University.

xii) STAFF.

qualifications laid down by the U.G.C: from time

to time be appointed.

xiii) Physical facilities as given in Annexure-lll

b) A college applying for affilaton, recognition or

approval for a course or courses of study shaH

send a formal letter of applicaflon to the Registrar between ist July and 31st October preceding the academic year in which flic courses are proposed to be started arid shall

give furl information in the letter of application on matters referred to in item 23 (a) (i to viii).

24. The application shaH be made in the case Authority to of a Government College, by the Director of

informaUon which he may deem necessary Pro cedure on before proceeding with the application, or may receipt of advise the management that the application is

application premature and should be submitted in a

subsequent year, or may decline to proceed with the application, if tie is satisfied that the arrangements made or likely to be made before the beginning of the academic year in which the courses are to be started, for the conduct of courses, are not sufficient or suitable, or if the college has failed to observe the conditions laid down in respect of any previous afíiflation, approval or recognition.

28(1) If the Vice-Chancellor decides to proceed inspection with the application, he shall appoint an

Commission Inspection Commission with competent person(s).The Inspection Commission shall give report in the prescribed form.

(2) The report of the Inspection Commission Reply from shall be placed before the Syndicate for its

the college consideration. The Vice-Chancellor shall on the forward a copy of the resolution of the Syndicate fulfilment in this regard to the governing body of the institution

of conditions concerned, specifying the course or courses of instruction in which the affiliation or recognition proposed to be granted together with conditions and limitations that may be imposed. The institution shall duly report to the Vice- Chancellor within 15 days from the receipt of

such order, regarding the fulfilment of various conditions imposed.

(3) After considering the replies received from

Syndicate to the college and also after making any furthur decide on the enquiries deemed necessary the matter shall grant of be placed before the Syndicate which shall affihiation/ decide whether affiliation, approval or recognition recognition sought for should be granted or not.

(4) The Syndïcate shall also have the power Conditional to grant conditional affiliation, approval or Affiliation recognition subject to the fulfilment of certain or conditions and in the event of the conditions laid

manner specified, such affiliation, approval or recognition siall be withdrawn, if necessary.

(5) In the case of conditional affiliation, approval or recognition, the Vice-Chancellor may stipulate that some of the conditions shall be fulfilled before a specified date and that students may not be admitted nor applications invited for admission until the Syndicate is

satisfied that the conditions have been fulfilled. The Vice-Chancellor may, for this purpose, send

a second Inspection Commission and the travelling and other expenses of the Commission shall be met by the management of the college concerned.

(6) If the conditions are fulfilled, the Syndicate shall have the power to confirm the coriditiona! affiliation, approval or recognition, as the case

may be, at the end of the period.

29. An application for affiliation, approval or

Withdrawal recognition may be withdrawn by the cf management at any time before an order is

30. Affiliation, recognition or approval may be

shall be given specifically for each subject or

31 Where a college is affiliated, recognised

or approved in a number of optional subjects.

Combination the college shall be at liberty to provide

of Optional instruction in any combination within the time

Subjects provided it satisfies the University that the

accomodation and staff and other facilities are

adequate. Whenever fresh combination is

proposed to be introduced, a statement of all

combinations of subjects in which instruction is

provided shall be forwarded to the Vice-

Chancellor before the close of the academic

year preceeding the year ¡n which it is proposed

to be introduced.

32. In the case of any management of a college

Penal (i) not fulfilling any of the conditions prescribed

action for affiliation, recognition or approval or (ii) not

complying with any of the rules of the University

or (iii) not implementing any decision of the

Syndicate, it shall be competent loi the

Syndicate:

(1) to suspend the provisional affiliation, recognition or approval granted to the college



in any course or courses of studies:

(2) to reduce the sanctioned strength of ny course or courses of studies

(3) to decline to entertain any new application for additional affiliation orapproval or recognition of application for increase in strength ¡n courses of studies conducted in the college;

(4) to withdraw the permanent affiliation or

approval or recognition granted to the college in any or all the courses of studies in which instruction is offered in the college.

(5) to decFine to forward to the U.G.C. any application made by the management for sanction of any grant.

(6) to recommend to the Government to take over the management of the college temporarily or pemlanently and

(7) to recommend to the Government to transfer the management to any other body. which it feels is capable of running the college efficiently.

33. Affiliation, recognition or approval shall in

34. Affiliation, recognition or approval granted

Inter- on the basis that part of the instruction provided

existence of arrangements for such courses of

Inter-Collegiate or University Lectures.



ANNEXURE -

ENDO WMENTS.

For starting a new college/new course the following endowments shall be provided by the Management of the College:

(i) Endowment for starf in g a New College:

An endowment of Rs.1O lakhs shall be provided,out of which Rs.5 lakhs shall be shown in the form of fixed deposit receipts invested in a Nationalised Bank/Scheduled BanklCo- operative Bank in the joint names of the Registrar, Bharathidasan University, Tiruchirappalli and the Management of the college and the balance endowment of Rs.5 lakhs may be shown by the management of the college in the form of property. The property should be in the form of unencumbered asset fetching an annual income of about Rs.60.000. For this purpose half of the annual income from the assets shall be capitalised at 6% and such assets may be shown by way of endowment. The annual interest from the fixed deposits and annual income from the unencumbered assets should be spent only for the maintenance/improvement of the college.

The above endowment will cover five courses at Major level comprising two or three in Humanities and two or three in

Sciences and Commerce.

(i) For starting a new Law College with U.G course:

Bharathidasan University, Tiruchirappalli and the Management of the College and the balance endowment of Rs.25 lakhs may be shown by the management of the college in the form of unencumbered assets fetching an annual income of about Rs. 3DQ000. The annual interest from the Fixed Deposits and the annual income from the unencumbered assets should be spent only for the

maintenance/improvement of the college.

(ii) Endowment required for further courses.

d) COLLEGE OF EDUCATION:

(ñ For starting a new College of Education with U.G. (Bachelor) Degree course, an endowment of Rs.6 lakhs shall be provided, out of which Rs.3 lakhs invested in a Nationalised Bank/Scheduled Bank! Co-operative Bank in the joint names of the Registrar, Bharathidasan University, Tiruchirappalli and the Management of the College and the balance may be shown in the form of a property. This property shall be in the form of unencumbered assets fetching an annual income of about Rs.36,000. The annual interest from the Fixed Deposits and the income from the unencumbered assets should be spent only for the maintenance! improvement of the college.

(ii) The endowment required for Mastor pree course is Rs.2 ¡akhs.



(e) APPRO VED OR RECOGNISED COLLEGE/INSTITUTION:

(i) For starting a new approved or recognised collegef institute, an endowment of Rs2 lakhs shall be

provided for a maximum of 3 courses. The endowment shall be in the form of Fixed Deposit receipts invested ir NlationaIised BanklScheduled BanklCo-operative Bank in the joint names of the Registrar, Bharathidasan University, Tiruchirappalli and the Management of the College and the balance may be shown in the form of a property. The property shall be in the form of unencumbered assets fetching an annual income of about Rs.24,ODO. The annual interest from the Fixed Deposits and the income from the unencumbered assets should be spent only for the maintenance! improvement of the college.

(ii) For starting of every additional course an endowment of Rs.25000I- should be provided.



ANNEXURE - Il

LAND REQUIREMENT FOR THE CAMPUS OF A NEW COLLEGE

The following shall be the land requirements for the campus of a

new college:

(a) Arts and Science College: The campus for a college situated in an urban area recognised as such by the University shall have a total of 20 acres for Mens college and 15 acres for Women's college, and the Campus for a college situated in the rural area, recognised as such by the University, shall have a

total of 30 acres for Mens college and 20 acres for Women's college.

(b) Engineering College: The in

recognised as such by the University, shall have a total of 100 acres of land and the campus for a college situated in a rural area, recognised as such by the University, shall

have a total of 150 acres of land.

(c) Law college.' The campus for a college situated ¡ri an urban area, recognised as such by the University, shall have 20 acres of land and campus for college situated in a rural area, recognised as such by the University shall have a total of 30 acres of land.

(d) College of Physical Education: The campus for a College of Physical Education situated in

an urban area, recognised as such by the University, Iiall

have a total of 80 acres of land and the campus for a



college situated ¡n a rural area, recognised as such by

the University, shall have a total of 125 acres of land.

(e) College of Education:

The campus for a college situated in an urban area,

recognised as such by the University, shall have a total

of 15 acres of land and the campus for a college situated

¡n a rural area, recognised as such by the University, shall

have a total of 20 acres of land.



ANNEXURE - Ill NORMS FOR LABORATORY, LECTURE ROOM

AND LIBRARY

I. LABORATORY: Average laboratory area per undergraduate student:

40 Sq.ft. for subsidiary/Minor, 60 Sq,ft. for main subjects. In determining the areas of undergraduate laboratories, the basis of calculation will respectively be as follows :-

a) Number of undergraduates doing practical work at a time. The plinth area of laboratory buildings in the Universities may be determined generally as carpet area of the laboratory plus 50% thereof. This will provide sufficient accommodation for varandahs, laboratory blocks, stair case etc.

Il. Lecture room area per student: 12 Sq. ft. per student provided no lecture room has an

area less than 400 Sq.ft. Some of the lecture rooms for Science classes should be provided with preparation rooms with an area of about 300 Sq.ft.

Ill. Average space for store-room: 1000 to 2000 Sq. ft. per 100 to 150 students.

IV. Museums for Botany and Zoology: A minimum space of about 1000 Sq.ft. for each of these

departments.

V. Library: 1. Location : The Library should be centraJly located with

Rooms to be provided are as follows:

Size of Rooms:

Reading Room - The average area per reader in

the reading room should be 233m minimum.

NOTE:

The size of the reading table is 2.4 X 06m. The centre to

centre distance between two consecutive rows of reading room

tables is i 8m with seating arrangement on one side of the table

only.



CHAPTER - XIII EVENING SECTION.

1. STARTING AN EVENING SECT/ON/ COL/RSE:

Evening section shall be started only ¡ri as existing college and shall ordinarily be recognised only for courses in which the college is already affiliated to both UG & PG.

2. The Evening section classes shall ordinarily be conducted onlyin+.pemises of the college.

3. PROCEDURE FOR GRANT OF AFFILIATION:

For affiliation of courses in the Evening section, the University shall send an Inspection Commission as usual and the usual conditions and procedures for affiliation shall be followed.

4. SYLLABUS:

The syllabus, the Scheme of Examinations and conduct of Examinatins for Evening section students shall be the same as for Day section students and the degree given to them shall also be the same as for Day section students.

5. HOURS OF WORK

Evening section classes shall be conducted for a

minimum of 3hours each day between 2 p.m. and 9 p.m. on all the five days in a week, and full day classes on Saturdays ard Sundays wherever necessary. The day college and Evening section classes shall not be conduc ed jointly.

6. WORK!NG DA YS:

An Evening section shall work for a minimum of 25 hours



per week, 450 hours per semester.

7. PRINCIPAL:

An Evening section shall function under the overall

supervision 01 the Principal of the college.

8. TEACHER IN CHARGE:

A senior member of the Teaching Staff may, if necessary,

be put in charge of the Evening section under the overall

supervision of the Principal of the college.

9. QUALIFICATION OF TEACHERS:

Qualification of teaching staff working in Evening section

should be subject to the approval by the University as per the

prescribed norms.

10. WORKLOAD:

The workload of full-time Evening section teachers shall

not exceed that prescribed for the Day section. Separate staff

for administrative purpose shall be employçd for the Evening

section as may be found necessary.

11. FACILITIES:

All the academic facilities available ¡n the college like

library, laboratory, etc., shall also be made available to the

students and teachers of the Evening section and necessary

supporting staff for the purpose should be appointed.

Admission: Preference may be given to employees of the

Government and Quasi Government.

CHAPTER - XIV SELF-FINANCING COLLEGES

(a) In addition to what is contained in the Statutes under Chapter XII and Xlll, the followng conditions are to be satisfied for starting a self financing college:

CHAPTER XV

ESTABLISHMENT OF HOSTELS AND HALLS OF RESIDENCE

A. GENERAL

Syndicate to 1. The Syndicate shall prescribe from time to prescribe time such general or special norms as it may conditions deem necessary for recongnition of hostels and

shall have powers to grant or to withhold or withdraw recognition to any hostel.

Students to 2. Students who do not live with their parents, live in hostel or with guardians as approved by the Principal,

shall reside in a hostel. In case adequate hostel accommodation is not available, they may be permitted to stay in lodges inspected and a ppreoved by the respective college authorities. Every college shall maintain a Register of Approved Lodging.

Approved Lodging means lodging houses periodically inspected by the college and included in a Register of Approved Lodging maintained by the college and also appreoved by the University.

Procedure for 3. Any person ora body of persons who desired the recognition that a hostel maintained or managed by them of hostels should be recognised by the college and

approved by the University. For such recognition of any hostel or approved lodging the following information should be furnished to the college and the University.The University reserve the

(a) Suitablity of buildings; (b) Adequacy of accommodation; (a) SuitabIity of the neighbourhood; (d) Educational supervision; (e) Sanitary condiIon; (f) Medical help;

(g) Provision of games etc.

Managment 4. Hostels which are not managed by the Univeristy or colleges shall be managed by a

regularly constituted governing body appointed

by the persons or body maintaining the hostel,

the constitution of which shall be periodically reported to and approved by the University.

Appointment of 5. Appointment of the superintending staff of

superintending every such hostel shall be made by the staff governing body or by any authority to whom the

body may have delegated the power.

Withdrawalof 6. The University shaU have power to suspend

recogniseion or withdraw the recognition of any hostel

temporarily or permanently when ¡t is not

conducted in accordance with the conditions

stipulated by the University from time to time.

Provided that no such action shall be

taken without affording the management of such

hostels, an opportunity of making representation.

Inspection 7. The Vice-Chancellor shall arrange for periodically inspections of all hostels and



approved lodgings and may order a speciat inspection of any hostel or approved lodging to

be made whenever he considers it desirahe to

do so and shall take such action on the report as he deems fit.

Registered 8. The Registrar shall maintain a Register of

hostel approved lodgings and recognised hostels, in

which alone the students cati reside.

Ciscïplinary 9. Students living in hostel shall be under the

boarding and lodging of all categories of persons

shall be responsible to the Vice-Chancellor. The

detailed rules for the upkeep. maintenance and

running of the hostels shall be framed separately.
