B. PRESERVATION OF PROPERTY RIGHTS OF OTHER PROPERTIES IN THESAME VICINITY.
1) APNs 003-502-002, 003-502-003, 003-502-004. 003-502-011 &003-502-012 (Lots I through 8 of Block “D”) are currently accessed byunimproved roads crossing private property on the easterly side of Block“D”. Legal access for these parcels will remath from the southerly portion ofthe alley in Block “D” via I Street. JSt Street along Block “D” and all of thealley in Block “D” are currently undeveloped.
2) Landscape improvements (yard, trees and fencing), from aerial photography appearto exist within the Right-or-Way of the Block “D” alley way. There are currentlyno parcels using said alley way for access.
3) The parcels in the easterly ¼ of Block “E” of the Town of Gold Circle (Midas) arecurrently accessed from the alley that bisects said Block “E” and do not appear touse East Street for access.
C. PRESERVATION OF EASEMENTS OF UTILITY AND VIDEO SERVICEPROVIDERS. Utilities Companies have been notified in writing and a response isforthcoming.
6. ADJACENT PROPERTIES:
A. HOW VACATION AFFECTS ADJACENT PROPERTIES: Though the proposedvacation as depicted above wiJI continue to allow legal access to all surroundingproperties and does not alter the existing access staff has the following concerns.
1) There is a drainage ditch that runs through a portions of Blocks “D” and “E”that appears to carry water seasonally for spring runoff.
2) The topography of 1st street from the middle of Block “E” running to the eastclimbs rapidly makthg an all season improvement in that portion of 1 streetdifficult and possibly very expensive due to extensive earthworks.
7. N.R.S. 278.480 (7). . . .Title to the street or easement reverts to the abutting property ownersin the approximate proportion that the property was dedicated by the abutting property ownersor their predecessors in interest...

B) In accordance with NRS Chapter 278 the 30 closest property owners were notified at least10 days prior to this public hearing. The list, (Exhibit “A”). is attached to the end of this report.
9. STAFF RECOMMENDATIONS, FINDJNGS AND CONDITIONS; Based upon theabove stated analysis and findings, staff recommends Disapproval. If approved staff’recommends the following conditions and restrictions:
A. Title to the street or easement will revert to the abutting property owners in theapproximate proportion that the property was dedicated by the abutting property ownersor their predecessors in interest.
8. Within six (6) months of approval by the Elko County Board of Commissioners, theapplicant shall have a land survey conducted, including the preparation of a Record ofSurvey and Legal Descriptions prepared by a Professional Land Surveyor licensed inthe State of Nevada at the applicant’s expense. Said Record of Survey and LegalDescriptions are to be delivered to the Elko County Planning & Zoning Division forreview and presentation to the Ellco County District Attorney for final deed draft.
C. Applicant shall comply with all provisions of NRS 278.480 and any otherapplicable states statutes and local ordinances inclusive in reference toabandonment of a public right of way.
D. Elko County Reserves an easement for access and maintenance of any and all publicutilities should they exist within this abandoned right of way.
