Formal Procedure The person who believes he/she has a valid basis for complaint shall discuss the concern with the Local Title IX or 504 Coordinator, who shall in turn investigate the complaint and reply to the complainant in writing within two (2) days. If this reply is not acceptable to the complainant, he/she may initiate formal procedures according to the steps listed. Formal Grievance Procedure STEP 1: A written statement of the grievance shall be prepared by the complainant and signed. This grievance shall be presented to the Local Title IX or 504 Coordinator within five (5) business days of receipt of the written reply to the informal complaint. The Coordinator shall further investigate the matters of the grievance and reply in writing to the complainant within five (5) business days. STEP 2: If the complainant remains unsatisfied, he/she may appeal through a signed, written statement to the School Board within five (5) business days of his/her receipt of the Coordinator’s response in Step 1. In an attempt to resolve the grievance, the School Board shall meet with the concerned parties and their representatives within fifteen (15) days of the receipt of such an appeal. A copy of the Board’s disposition of the appeal shall be sent by the Board Clerk to each concerned party within ten (10) business days of this meeting. STEP 3: If, at this point, the grievance has not been satisfactorily settled, further appeal may be made to the Office for Civil Rights, U.S. Department of Education, Washington, D.C. 20201.

GENERAL INFORMATION Academic Awards Academic Award Assemblies are held during the first semester for students in the sophomore, junior, and senior classes; and during the second semester for students in the freshman, sophomore, and junior classes. Class of 2016, 2017: Students who achieve a grade point average (GPA) of 3.0 receive a certificate of merit. Students who achieve a 3.2 GPA for two (2) consecutive semesters earn an academic letter. Subsequent semesters of maintaining a 3.2 GPA result in the awarding of academic pins, and medals. Class of 2018 and 2019: Students who achieve a grade point average (GPA) of 3.0 receive a certificate of merit. Students who achieve a 3.5 GPA for two (2) consecutive semesters earn an academic letter. Subsequent semesters of maintaining a 3.5 GPA result in the awarding of academic pins, and medals. Students who raise their grade point .5 percentage points over a semester, or one (1) full point over a school year receive a certificate for special recognition. GPA for transfer students will be computed according to the grading system used at EAHS. Students who earn a 25 or higher on the ACT will be recognized. Advertising Outside Activities No announcements or posting of outside activities will be permitted without the approval of the principal or designee. A minimum of twenty­four (24) hours' notice is required to ensure the principal or designee has the opportunity to review the announcement or posting. The designated announcement area may be used for posting notices after receiving permission from the principal or designee. Busing

Students that live within a two­mile radius of the high school are not eligible for busing. Students that live outside of that radius can contact Durham School Services at 723­7667 for route information. Calculating Semester Grades Semester Grades are based on a student’s cumulative performance over the course of the entire semester. Every six weeks grades will be reported for progress monitoring. At the conclusion of the semester grading period, students will complete a semester examination that will be worth 20% of their grade. Calculating Student Grades All teacher grade books will be divided into two categories: Performance (Summative Assessments) Grades and Practice (Formative Assessments) Grades. Performance Grades will be 90% of a student’s grade and Practice Grades will count as 10%. Teachers are encouraged to measure student learning (summative) weekly. Performance (Summative) Grades: assessments designed to provide information to be used in making judgments about a student’s achievement at the end of a sequence of instruction Practice (Formative) Grades: assessments designed to provide information and feedback to direct instruction and improve student learning Class Rank: Classes of 2016, 2017, 2018, 2019 A student’s GPA (Grade Point Average) is calculated at the end of each grading period. A cumulative GPA is calculated by adding the numeric values of all semester grades only, and dividing by the total number of all semester grades. The student with the highest cumulative GPA is ranked first in their class, and so on. Class rank shall be maintained starting with the 9th grade and continuing through the 12th grade. Only students enrolled full time shall qualify for class rank status. Only credits approved by the Board, or its designee, shall be included in computing class rank. Course Guide Course Change/Drop Procedure Students will be given time to review their course selections and changes need to be made prior to the end of the previous school year. A principal or designee may consider extraordinary circumstances for the need for any student to drop a class. Daily Schedule The office is open from 6:30 am to 3:30 pm. Students should not be in the building before 7:00 am or after 3:15 pm unless supervised by a staff member. Directory Information Pursuant to the Family Education Right and Privacy Act and State Statute 118.125 (1)(d), any parent, guardian, or eligible student (18 years of age or older) may inform the district of their desire that directory data, including photographs and videotapes not be used. The most recent form filed for a student shall remain in effect until a new form is filed. You do not need to file a new form each year. In accordance with state law, you have fourteen (14) days within which to complete this form and return it to school. Failure to complete and return this form to the school within fourteen (14) days will result in the district NOT WITHHOLDING directory data regarding your child. Directory data includes, but is not limited to: pupil’s name, address, telephone listing, date and place of birth, participation in officially recognized activities and sports, weight and height of members of athletic teams, dates of attendance, photographs (including video tapes and other reproductions), awards received, and the name of the school most recently previously attended by the pupil. Early Graduation Policy

Upon written parental request specifically describing the advantages, a student may graduate at the end of the 7th semester. The written request must be received by the student’s school counselor prior to the end of the sixth semester. It is understood that any approval of a January graduation is contingent upon the student satisfying all credit requirements. Students graduating early will be required to take final exams or their equivalent prior to their last school day. Rank in class will be based on eight semesters. Early graduates will be eligible for any scholarships awarded by the Elkhorn Area High School Scholarship Foundation and/or Committee. No formal diploma will be issued or commencement exercises held in January. Those January graduates will be permitted to return for regular June commencement activities if they so desire. School records will indicate completion of all graduation requirements for the purpose of employment or post­high school training. If the student chooses not to participate, the diploma will be issued following the commencement exercises. Individuals who graduate in January will not be permitted to take part in any organized activity (athletics, clubs, school dances, field trips, etc.), with the exception of Senior Honors Night and commencement activities. Education of Homeless Children & Youth Homeless children and youth have equal access to the same free, appropriate public education as provided to other children residing in the district. The school liaison for homeless children and youth is Mary Ellen Wright, District Social Worker. Please contact her at 723­3160 extension 1617. Exceptional Education Needs/Special Education The Elkhorn Area School District, offers special education services for students who have emotional, mental, speech/language, learning or physical disability via federal IDEA requirements and subsequent State of Wisconsin Statutory language for students with disabilities. Students must meet eligibility guidelines to qualify for special programming. The referral process involves testing and consultation with specialists in the area(s) of concern. The parent or guardian is an integral part of this process and children cannot be placed in special education programs without parental consent. The referral process may take up to 90 days to complete. Children may qualify for speech and early childhood services beginning at three years of age. All other special education programs serve school age children. If you believe that your child has a learning concern in one or more of the areas, please contact your child’s teacher or the school principal. Extra Credit and Bonus Points Extra Credit and Bonus Points will not be awarded. Fundraisers Soliciting contributions or collecting funds for any purpose on the school premises or at a school supervised activity without the permission of the principal or designee is forbidden. Group Grades All Group grades will be considered Practice only. After a class has participated in a group or cooperative learning experience, the teacher can assess the students on what they know individually and use that as a Performance Grade. Examples could include but are not limited to the following: multiple choice, essay, or class discussions. Projects that students work on together, but have individual parts to the project can be evaluated using Performance Grades as long as the grades are measuring individual learning/performance, and not the group. ID Cards Students should carry ID cards at all times. Students must have ID cards to attend school dances. ID cards are necessary for computer access, admittance to activities, and other uses deemed necessary by the principal or designee. There is a $5.00 replacement fee.

Laude System: Class of 2018 Please refer to the Course Guide for details. Lockers Students will be assigned a locker at the beginning of the year. Locker malfunctions should be reported to the office. Sharing a locker or using an unassigned locker is prohibited. Students may purchase a lock from the school store. School lockers are the property of the school. Lockers may be searched without the knowledge and consent of students. If a principal or designee needs to access a locker with a personal lock, it will be cut off. Missing or Late Work Grades will be entered as a zero until the assessment is completed to ensure students and parents know the effect of the missing grade.Behavior consequences may be assigned at the individual teacher’s discretion for incomplete Performance or Practice tasks. All incomplete grades on performance assessments must be completed prior to three days before the end of the 6­week term in which the assessment was given. Incomplete practice assessments will only be accepted until the performance assessment covering that material is given, or as part of a relearning plan. National Honor Society Scholarship requirements: Students must have a 3.5 cumulative grade point average at the conclusion of a Junior’s 5th semester or a Senior’s 7th semester. Service requirement: Students must complete a minimum of 20 service hours to the school and/or community by spring break of the current year. These hours must be completed during the current selection year. Upon fulfilling these requirements, the students’ names will be given to a faculty council consisting of five teachers. The council will decide if the students qualify based on their leadership and character qualities and vote on their selection or non­selection. Membership is a privilege earned through outstanding Scholarship, Service, Leadership, and Character. Members have the responsibility to continue to demonstrate these qualities and set high standards for themselves. Overdue Accounts Students who do not return all school property (library books, athletic equipment, textbooks, etc.) will be required to replace those items. Students will be required to pay all overdue accounts prior to purchasing tickets for dances , and Seniors must have rectified all outstanding fees prior to graduation. Parking Parking is a privilege and can be revoked by a principal or designee due to attendance or discipline. Students are expected to display the purchased parking pass. All license plates should be registered with our School Police Liaison. Personal Learning Time (PLT) Students are encouraged to take 7 out of 8 classes. During the extra period, students will be assigned to a PLT (study hall). Personal Learning Time (PLT) is a period that a student may be assigned to a teacher to receive specific interventions based on individual academic need. Students are expected to work on homework or study during this time. Rallies and Demonstrations Peaceful rallies or demonstrations without school sponsorship may be held on the school premises or at a school supervised activity according to the following procedure: ∙ Written permission must be obtained from a principal or designee.

∙ At least 48 hours prior to a rally or demonstration, the student who organizes it shall give notice in writing to a principal or designee. Notice shall contain the name of the demonstration, purpose thereof, time, and place to be held. ∙ A rally or demonstration shall not be held if the principal or designee reasonably forecasts that it will cause substantial disruption or materially interfere with the operation of the school or classroom. Redos and Retakes Redos will not occur during the final week of the term. Retakes must be completed within the six­week grading period. Assessments given during the last week of the term and at the end of the semester would be subject to teacher discretion for re­takes. The focus is on the relearning. Students and teachers will work together to develop and complete a relearning plan prior to re­doing or re­taking any assessment. School Telephone A phone is available in the front office to be used for school related purposes only. Students must obtain permission to use the phone. Student Records The federal Family Educational Rights and Privacy Act (FERPA) guarantees parents/guardians or adult students the right to inspect and review the student’s educational records. Administrative rule 347 in the Elkhorn Area School District outlines the guidelines for the maintenance and confidentiality of student records. An adult student or the parent/guardian of a minor student shall, upon request, be shown in the presence of a person qualified to explain and interpret the materials, the student’s records. If, upon inspection, the parents/guardians or adult student wishes to seek amendment to the student’s educational records, the parents/guardians can request a hearing with the school principal who will arrange such a meeting to include professional personnel qualified to interpret the records. A request for amendment not resolved at the school level will be brought to the attention of the District Administrator Jason Tadlock. If at this point the concern has not been satisfactorily settled, further appeal may be made to the Family Policy Compliance Office of the U.S. Department of Education alleging noncompliance with FERPA requirements. Student Records Request Wisconsin law allows a school district where a student is enrolled to request student records from a previous district without the parent/guardian or adult student’s consent because the receiving district has a legitimate educational interest in the records. Student Valuables Students are encouraged not to bring items of value to school. Items such as jewelry, expensive clothing, electronic equipment, and the like, are tempting targets for theft and extortion. The school is not be responsible for their safe­keeping and will not be liable for loss or damage to personal valuables. Items that were not secured will not be investigated by the principal or designee. Visitors Student visitors are permitted for educational purposes only and must receive administrative permission two days in advance. 1. All visitors must sign in following posted expectations, and wear a visitor lanyard . 2. The staff is expected to question people in the building whom they do not recognize and who are not wearing a visitor’s lanyard. 3. Students and staff are expected to immediately report to a teacher, principal or designee any suspicious behavior. 4. All outside doors are locked during the school day.

POSITIVE BEHAVIORAL INTERVENTION & SUPPORT (PBIS) The goal of PBIS is to reduce new cases of problem behavior and/or academic failure through a systems approach for establishing the social cultural and behavioral supports needed for a school to be an effective learning environment for all students. PBIS includes a broad range of proactive, systematic, and individualized strategies for achieving social and learning outcomes in a safe and effective environment while preventing problem behavior with all students (Sugai, 2007). Facets of PBIS include teaching school­wide expectations, taking a proactive approach to school­wide discipline, positively reinforcing preferred behaviors, effective instruction, and engaging parents. PBIS establishes a common purpose and approach to discipline, a clear set of positive expectations and behaviors, procedures for encouraging expected behavior and discouraging inappropriate behavior, and procedures for on­going monitoring and evaluation. Elk Expectations Consistent with our mission statement, EAHS is committed to teaching students our Elk Expectations:

Every adult at EAHS shares the responsibility of making sure all of our students understand these behavioral expectations. In a safe and positive manner, students are taught how to Be Respectful, Be Responsible, and Be Productive. To help teach and model the Elk Expectations, the EAHS school community uses the following PBIS practices:

RULES, RESPONSIBILITIES AND REGULATIONS

ATTENDANCE

Attendance Policy All Wisconsin children between 6 and 18 years of age must attend school full time until the end of the semester in which they become 18 years of age unless they have a legal excuse, fall under one of the exceptions in the State Statutes, or have graduated from high school. EAHS, in compliance with Wisconsin state attendance law allows students 10 absences per school year (5 each semester.) Students who exceed the number of allowable absences may be subject to disciplinary action. Absences A student absent from school for any length of time must have a parent email or call the Attendance Office at 723­4529 or 723­4920 x1609. Parents should do this before 10 am the day of the absence or before the next school day. Students who arrive to class up to 15 minutes late without a school issued pass are considered tardy. Students who are late to school should check in at the main office and receive a pass to class . Students who arrive to class more than 15 minutes into the period without a pass are considered absent. It is the student’s responsibility to see that absences are properly explained to the office. Unexplained absences are considered unexcused.

Excused absences are defined as:

A student may be excused by his or her parent or guardian before the absence for any or no reason, including illness without a doctor’s note. Parent excuse is not to exceed five (5) days per semester (WI Stat 118.15)

Documentation from professional agency (doctor, courts, etc. ­ not counted against the 5 per semester) Pre­arranged permission Emergencies (funerals, accidents, sudden illness in the family) Religious holidays

Students who are absent from class may receive revocation of pass privileges, detentions, truancy contracts, municipal citations or referrals for habitual truancy. Once at school, students will not be excused unless contact is made with a parent/guardian by the attendance office, nurse, principal or designee. Any student with an unexcused absence is barred from extracurricular activities taking place that day. According to Wisconsin Statutes, Section 118.16(1)c, truancy is defined as: ∙ A student is absent for part or all of one or more days from school during which the school attendance officer, principal or teacher has not been notified of the legal cause of such absence by the parent/guardian of the absent student. A half day is considered missing one to four periods and a full day is five or more periods. Truancy also means intermittent attendance carried on for the purpose of defeating the compulsory attendance law. ∙ A student is considered a habitual truant if absent from school without an acceptable excuse for part or all of five or more days on which school is held during a semester. Absences­Pre­Arranged It may be necessary for students to miss school for planned family trips or special circumstances. Students must secure a pre­arranged absence form from the Attendance Office and return it in advance of the absence. Juniors or seniors making college visits must comply with this procedure. Absences for School Functions Students who will be absent for a school function must check with all teachers prior to the absence. Students are responsible for completing the necessary work. Field trips are planned for many groups of students throughout the year. This type of activity enhances the total educational program. Regardless of age, students must have a parental signed field trip approval on file prior to the trip. Students must ride school­provided transportation and must accompany the group if they wish to participate. All school regulations are in effect on any field trip.

Leaving School Grounds Once at school, students may not leave the school grounds during instructional hours unless contact is made with a parent/guardian by the attendance office, nurse, principal or designee. Students are expected to sign out. Leaving without permission is considered truancy. Make­Up Work In accordance with State Law, all students will be provided reasonable time to make up work missed due to an absence, excused and/or unexcused, and shall be graded upon the quality of the product produced. It is the responsibility of the student to turn in major assignments, such as term papers, on time. Students with prearranged absences are to arrange for work prior to their scheduled absence.

Tardies Students who arrive to class up to 15 minutes late without a school issued pass are considered tardy. Teachers are responsible for working with students and families to correct the behavior, including parent contact and possible classroom consequences. Six or more tardies are considered chronic and may result in a discipline referral, a truancy contract, and/or privileges being revoked. Students who are late to school should check in at the main office and receive a pass to class. Truancy Contract The truancy contract is an agreement signed by a student with the School Police Liaison in lieu of a municipal truancy citation. By signing, the student pledges to have no unexcused absences or tardies during the stated time period. Failure to fulfill the contract results in the issuance of a citation.

STUDENT BEHAVIOR

Students at Elkhorn Area High School are expected to respect people with whom they come in contact at school and school events. They are to respect the property of the district and other people, and maintain an orderly learning environment. To that end, the following rules and procedures have been implemented. Academic Dishonesty Policy EAHS does not tolerate cheating (copying or photos of exams/answers) or plagiarism. Students will not earn an academic penalty; however, the work needs to be re­done. Students who cheat or plagiarize will receive behavior consequences which will remain in the student’s disciplinary file, parents will be contacted, and the student will serve detentions until the work is re­done. Acts of cheating or plagiarism may impact organizational memberships. Consequences may include but are not limited to the following:

Re­submit/complete alternative assignment Lunch detentions until turned in Parent contact Part of discipline record Wrap Around Meeting with parents and teachers Forfeit letters of recommendation from EAHS staff Pre­expulsion contract Expulsion

Cell Phones, iPods & Other Electronic Devices Unless directed by an instructor for use in a classroom activity, while in the classroom all electronic devices shall be off and stored by the student. These devices may be used before and after school, during lunch, and passing time. Violation will result in confiscation. Students will have their electronic device returned at the end of the day of their first offense. Any additional offenses will require a parent to pick up the electronic device. Computer Network Use Procedures The use of the EASD network is a privilege, not a right, which may be revoked at any time for abusive or inappropriate conduct. Such conduct includes, but is not limited to, the following: tampering with other student or teacher files, tampering with network operating system files, placing unlawful or inappropriate information on a system, using abusive or otherwise objectionable language in either public or private messages, malicious activity which causes downtime for any computer, or intentionally sending of viruses or other files that result in the loss of the recipient’s files or system software. Student use IDs and passwords are unique combination used to protect the user’s files and determine the software application for which that user has access rights. Students should use only the User ID and password assigned to them.

Do not give your ID and password to anyone else. You are responsible for any activity on the network with your name on it. As a user of the school district network, everyone is expected to abide by the generally accepted network rules. These include, but are not limited to, the following: 1. Unauthorized access to web sites is a violation of acceptable Internet use. The district has installed a hardware and software solution to protect students from inappropriate materials. Sites regarding sex, violence, pornography, nudity, gambling, games, shopping, and messaging are blocked. A screen that indicates to the student that an inappropriate site has been accessed blocks inappropriate sites. The student is required to back out of the site. No information on the site appears on the screen. Additional sites that teachers/staff determine inappropriate can be individually blocked. No attempts should be made to interfere with a blocked site. 2. There is a time when e­mail, chat rooms, or bulletin boards would be appropriate activities in a classroom. Use appropriate language for your correspondences. Note that e­mail is not guaranteed to be private. The mail system will be monitored. Messages relating to or in support of illegal activities must be reported by law to the authorities. 3. Students are not allowed to install or run any programs or applications for which the school does not have the license. 4. Students may not copy software off the EASD computers for use on their home computers. 5. All Federal Copyright Laws hold true in the use of EASD computers. 6. School computer equipment is to be used solely for educational purposes. Vandalism of equipment or network will result in the removal of a student’s network privileges. Students and their parents will be responsible for any damage, replacement parts, or technician time to correct that which has been altered or destroyed. (see page on vandalism) Computer Network Disciplinary Procedures Proper use of the Elkhorn Area School District computers is important to the successful learning environment in our school. In order to continue computer access for students, it is important to recognize some problem areas and identify disciplinary action which will occur if improper use is made of the network. Consequences for rule violations are as follows and will help to ensure proper use of the equipment and help safeguard students’ work and passwords. 1. Verbal warning for the first offense. 2. Formal written warning, copied to associate principals and distributed to all staff. 3. Out­of­school suspension for 1 day with parent readmit upon return to school. 4. Removal from the Elkhorn Area School District computer network and removal from the class where the violation takes place; which may result in multiple class failures in computer­based courses. Cyber bullying Use of the network to engage in “cyber bullying” is prohibited “Cyber bullying” involves the use of information and communication technologies such as email, cell phones, text messages, or social media sites to support or repeat, hostile behavior by an individual or group, that is intended to harm others. Cyber Bullying includes, but is not limited to the following:

1. Posting slurs or rumors or other disparaging remarks about a student or school staff members on a website 2. Sending or posting messages that are mean or threatening 3. Using a camera phone to take and send embarrassing photographs/ recordings of students or school staff

members or post these images on social media sites such as Facebook, You Tube, Twitter, etc. 4. Posting misleading or fake photographs of students or school staff members on social media

To the extent permitted by the First Amendment, instances of cyber bullying off school grounds that disrupt the school environment or interfere with the learning process will be considered violations of the Student Code of Conduct. Students shall not access social media for personal use from the district’s network but shall be permitted to access social l media for educational use in accordance with their teacher’s approved plan for such use.

Detention Detentions may be issued by administration or by teachers and may be issued before/after school or during lunch. Behavior warranting dismissal from or failure to serve a detention will result in other consequences. Athletic practice, work through the cooperative programs, or school functions do not excuse students from detention. Discipline The principal or designee will follow­up on discipline referrals. Disciplinary action will be decided on a case by case basis and imposed only after review of the facts and/or special circumstances of the situation. It is important to remember that the school’s rules apply at school, on school property, at school­sponsored events, and on school transportation. Dress and Grooming The School Board recognizes that student’s individual dress is primarily a parent/student responsibility, which should reflect concern for health and safety of the student, others, and school property. When the dress of an individual student constitutes a health problem, seems unsuitable for school wear, is a physical danger to any person, or when the student’s manner of dress or grooming causes a disruption or disturbance, the school staff shall take appropriate action to correct the situation. Students who violate the rules for school attire will be given the opportunity to correct the situation by changing, turning a shirt inside­out, covering up, or being sent home to change. Continuation of such violations may result in a parent conference. Repeated violations may constitute grounds for suspension. Students should consider the following questions when dressing for school:

Does my clothing expose too much? (no) Does my clothing advertise something that is prohibited to minors? (no) Are there obscene, profane, drug­related, gang­related, or inflammatory messages on my clothing? (no) Would I interview for a job in this outfit? (yes) Am I dressed appropriately for the weather? (yes) Do I feel comfortable with my appearance? (yes)

Specific rules governing student attire during the school year:

Hats/caps/bandanas may not be worn in the building. Hoods from hooded sweatshirts, hoodies, coats, etc., must be down at all times. Footwear must be worn in the building. Clothing or accessory that can damage school property is prohibited. (Chains, spikes, etc.) Apparel of inappropriate length, which distracts from the learning atmosphere, is not permitted. Overly revealing

shorts, skirts, pants, or shirts, are not permitted. Shirts must have a back and cover the midriff area. Strapless tops or dresses and tube tops are not permitted. Exposed undergarments are not permitted. Clothing which is normally identified with a gang or gang­related activity (inclusive of gang­related colors for

purposes of gang identification), or clothing / jewelry / backpacks that contains pictures and/or writing referring to alcoholic beverages, bars, strip clubs, tobacco products, sexual references, profanity, illegal drugs, bigoted

epithets, harassment/hate messages, or messages of hostility toward race, ethnicity, religion, or sexual orientation is not permitted. Visible displays of body markings (tattoos) that have gang implications are prohibited.

The school reserves the right to include other restrictions or prohibit other items of clothing not specifically mentioned above to provide a safe, positive learning environment.

If there is a disagreement between students and/or parents and the staff regarding the appropriateness of clothing, administration will make the final determination.

Students who are representing our school at an official function or public event may be required to follow specific dress requirements. Usually, this applies to athletic teams, cheerleaders, bands, and other such groups. Expulsion In order for a student to be successful, it is imperative that the Elkhorn Area School District provides an atmosphere that is free from intimidation, verbal and physical abuse, and any type of disruptive behavior that subverts the authority of school officials. The Board of Education may expel a student from school for refusal or neglect to obey the school rules or for any other reason authorized by law if the Board is satisfied that the interest of the school demands expulsion. A student possessing weapon(s), drugs and/or paraphernalia may result in an expulsion hearing. Gangs and Gang Related Activities Anti­social and/or criminal activities of gangs or gang­like groups threaten the school environment and interfere with the educational process. The District hereby bars all gangs, gang affiliations and gang­related activities from the school building, school buses, school related activities and school property at all times. Harassment/Bullying/Hazing The School Board supports an educational environment that is free of harassment, bullying, or hazing of any form. The Board’s authority is derived from Wisconsin Statutes that allow school boards to establish rules pertaining to the conduct of pupils to maintain a favorable academic atmosphere. It is therefore the policy of the district that it will not tolerate harassment, bullying, or hazing in any form and will take all necessary and appropriate actions to eliminate it, up to and including discipline of the offenders. “Harassment” means striking, shoving, kicking, throwing objects at, or otherwise subjecting another person to physical contact or attempting or threatening to do the same; name calling; or engaging in a course of conduct or repeatedly committing acts which intimidate, cause discomfort to, or humiliate another person or which interfere with the recipient’s academic performance. “Intimidate” means to make timid or fearful, to frighten, or to compel or deter by or as if by threats. Harassment includes verbal comments or other expressions which insult, degrade, or stereotype any person or group, which includes, but is not limited to sex, age, race, color, religion, national origin, ancestry, creed, handicap, pregnancy, marital or parental status, or physical, mental, emotional or learning disability, or sexual orientation, gender identity and gender expression. “Bullying” is a mean look, gesture, word, or action that is repeated over time by the same person or group of persons and that hurts a person physically, emotionally, socially, or damages their personal property. “Hazing” is a ritualistic test or task, which may constitute harassment, abuse or humiliation with requirements to perform physical or mental practices or tasks as a way of initiation into a social group, team or club. It is the responsibility of administrators, staff members, and all students to ensure that these prohibited activities do not occur. Students who believe they have been subjected to harassment, bullying, or hazing or any parents/guardians who believe their student has been subjected to harassment, bullying, or hazing should report the incident(s) to the building principal/designee. It is the intent of the Elkhorn Area School District to create an atmosphere where complaints will be treated fairly and promptly. If a student or parent is not comfortable with making a complaint to the principal/designee, the complaint may be made to a teacher, counselor, or social worker with the understanding that incidents must be reported to administration for review and action. The employee receiving the complaint shall report the complaint to the principal or other administrator and superintendent of schools. Third party witnesses are strongly encouraged to report observed incidents of harassment, bullying, or hazing to the administration. Every effort will be made when requested to maintain the confidentiality of witness identity unless the witness is requested to testify in a hearing.

The administration and staff will inform students that the Elkhorn Area School District does not tolerate harassment, bullying, or hazing in any form and will take all necessary and appropriate action to eliminate it, up to and including discipline of offenders. Students will be informed of this policy annually and the complaint procedure will be made available to any students or parent/guardian wishing to file a complaint. Lunch Room Rules

Freshmen students must remain on campus. Campus is defined as the sidewalk area in the front of the main entrance or the grass courtyard which is enclosed by the drop off area. Sophomores, juniors and seniors have the privilege of open campus. The principal or designee may revoke these privileges.

Students may not leave or return to school via vehicles unless school authorization has been given. Students leaving/returning to the building must use the front lobby doors. Backpacks are not allowed in the lunch line. Food, beverages, and school property (trays, utensils, etc.) must remain in the cafeteria. Students may only use designated areas open during lunch.

Responsibility of Students at School Events Elkhorn Area High School has a tradition of quality sportsmanship and respectful behavior. Student actions at home or away events continue this tradition. Every student shares the responsibility to maintain excellent sportsmanship with fellow students, faculty, alumni and the community. At school events students represent both the school and the community. School rules are in effect at all school­sponsored events. If a student’s behavior is an issue at a school event, that student will not be allowed to attend subsequent similar school events for a duration determined by a principal.

Restricted Movement / No Pass List No passes will be issued during the first 5 minutes or the last 5 minutes of class. Students who abuse their pass privileges will be placed on the No Pass List for a length of time determined by a principal or designee.

School Dances Policies for school dances are:

Dances are to be scheduled with a principal. A minimum of three chaperones is required. Organizations may consider hiring a police officer. Attending school dances is a privilege. In order to retain this privilege, students need to have positive academic

progress and attendance and comply with school rules and policies. The loss of this privilege will be administered by the principal or designee. Privileges can be revoked by event or by school year. All school fees are expected to be paid before being eligible to purchase a ticket.

EAHS students may bring guests to major dances with prior approval from a principal or designee. Guests must not be older than 19 years and must not have graduated high school earlier than the past school year and must provide identification.

Students must enter and exit through the main lobby doors. Students who leave for any reason will not be allowed to re­enter the dance and must leave school grounds.

The sponsoring organization is responsible to set up the dance and return the area to its normal condition. School property damage will be paid for by the guilty party or out of dance funds.

Dance Guidelines – Appropriate dancing includes; brief touching in a non sexual manner with hands placed appropriately. Students will receive one warning for inappropriate actions such as; explicit displays of affection, inappropriate touching and contact or other behavior deemed inappropriate by administration. Students receiving a second warning will be asked to leave the dance and parents will be contacted at that time.

Search and Seizure / Drug Testing Administration has the right to search and seize articles that are in violation of school rules without prior notice or permission. Searches may include, but are not limited to, a student’s locker, backpack, purse, and vehicle parked on school grounds. Alcohol, tobacco, e­cigarettes, prescription drugs, and weapons are not allowed on school campus. Administration has the right to request the services of law enforcement to search school property and/or students. Administration reserves the right to ask proper authorities to test students suspected of being under the influence of drugs/alcohol. Student Surveys The Elkhorn Area School Board respects the privacy rights of parents and their children. No student shall be required to participate in any survey associated with a school program or the District’s curriculum, or which is administered by a third party in the schools, if the survey includes one or more of the following items:

Political affiliations or beliefs of the student or the student’s parents; Mental and psychological problems of the student or the student’s family; Sex behavior or attitudes; Illegal, anti­social, self incriminating or demeaning behavior; Critical appraisals of other individuals with whom students have close family relationships; Legally recognized privileged or analogous relationships such as those of lawyers, physicians, and ministers; Religious practices, affiliations or beliefs of the student or the student’s parents; or Income, other than that required by law to determine eligibility for participation in a program or for receiving

financial assistance under such a program. The principal or designee shall notify parents/guardians at the beginning of each school year of the approximate dates during the school year when such survey activities are scheduled involving their children. Parents/guardians shall be given the opportunity to request that their child not participate in a survey containing the above information. If a survey containing any of the above information is funded in whole or in part by a program administered by the U.S. Department of Education, written consent shall be obtained from the student or, in the case of a minor student, the parent or guardian before the student participates in the survey. Parents/guardians may, upon request, inspect a survey containing any of the above information and any survey created by a third party before the survey is administered or distributed to a student. They may also request to inspect any instructional materials used in connection with the survey or any instructional materials used as part of the educational curriculum for the student. Requests to inspect a survey or instructional materials should be made to the principal or his/her designee. Survey inspection requests should be made before the date in which the survey is scheduled to be administered to students. The principal or designee shall respond to such requests without delay.

Suspension (Out of School) The purpose of school suspension is to place the responsibility for the student’s actions in the hands of the parents since the offense was serious enough to warrant removal from campus, or the student has demonstrated that other courses of action have been ineffective. The following procedures may be followed: ∙ The student will be informed and parent contact will be made as soon as possible. The student will be asked to leave school grounds. A suspension notice is mailed and a parent meeting is may be required for the student to be readmitted. ∙ The student is prohibited from campus, school events, and participation in school activities/events during suspension. ∙ A second suspension may result in a meeting between the student, parents, and principal or designee. ∙ Upon being suspended a third time the student and parents may be expected by a principal or designee to meet with the District Administrator prior to re­admittance. ∙ Students in violation of local, state or federal law could be subject to police referral. Use of Police Department Canine Units

In order to maintain a drug free school environment, specially trained dogs that have been trained to detect the odor of controlled substances may be used to search the building and grounds at the discretion of the district or building principal or designee. The dog will be used when:

There is a reasonable suspicion that controlled substances may be hidden in the building or in vehicles parked in/on school property.

There is belief that a random preventative search will be beneficial to the ongoing drug prevention effort.

Individuals will be subject to prosecution as well as action by the school administration if controlled substances or look­alikes are discovered. In accordance with state and local laws, students will be required to place bags, purses and backpacks in the hallways during the search. Noncompliant students will be taken to the office.

Weapons Weapons (including look­alikes) are not allowed on school property, in vehicles at school, or at school related activities. A weapon is defined as anything that is used or designated to cause bodily injury or property damage (knives, guns, etc.).

Law Enforcement

I. If the police take the child into physical custody, the administration shall immediately notify or attempt to notify the student’s parent/guardian. Police Liaison Officer Guidelines The Police School Liaison Officer, in the normal course of his/her duties, will come in contact and have conversation with numerous juvenile students. Parental permission does not need to be obtained to talk to a student in all cases. However, if a police school liaison officer is questioning a student about an incident in which that student is a suspect or becomes a suspect in the course of questioning, the police liaison officer will offer or attempt to contact the parents of the student and advise them of the situation.

Health Information

Enrollment Emergency Information All parents are required to fill out the (Online) enrollment emergency information annually for each child. Unlisted telephone numbers will be kept confidential. We need current information at all times. If emergency treatment is required, the information will be used by emergency medical services to contact you. Please update the enrollment information as needed throughout the school year. Please select a contact person who can act in your behalf if we are unable to reach you during an emergency. If you don’t have a telephone, please select a contact person that we can contact who can contact you.

School Exclusions: Wisconsin State Immunization Law

All students out of compliance with the Wisconsin State Immunization Law will be excluded from the Elkhorn Area School District on October 13, 2015.. A non­compliant student is one who is “behind schedule” for a required vaccine(s) or has no immunization record on file at school. It is the parent’s obligation to provide immunization records to the school. Immunizations can be obtained through your health care provider or the Walworth County Public Health Department. The State of Wisconsin has a Student Immunization Law (Chapter 252.04, Wis. Stats. and DHS 144 Wis. Admin. Code), which provides for religious, personal, or health exemptions to required immunizations.

During disease outbreaks, children who are not fully immunized may be excluded from school and all school­related activities until the outbreak is over, both for their own protection and for the protection of others. School Accidents ­ Minor First Aid The American Heart Association certifies a team of first responders which include the school secretaries who cover the health room, part­time health aides, physical education teachers and other teachers.) They will be the primary providers of first aid as delegated by the principal and the district nurse. Minor first aid conditions are those conditions in which the student is able to walk back to class and fully participate in school without distress such as: minor abrasions, minor bruises, minor cuts, minor headaches and stomachaches, bloody noses, minor head bumps, and non­sensitive bee sting. If the child is capable of independent verbalization, the school staff will not contact the parents to inform them that the child needed minor first aid care. In minor school accidents that limit the child’s ability to participate in school or if a child is unable to be consoled, parents will be contacted. Dental and Doctor Excuses for Physical Education: Wisconsin Stat. 118.16 (1) (c) states that students may be excused from physical education if a parent/guardian provides written evidence from a physician or licensed practitioners that the student is not in proper physical or mental condition, including concussions. Such excuses shall state the period of time for which it is valid but not to exceed 30 days. Physical education limits due to breaks or sprains require a doctor’s note to resume full activity. Those students unable to fully participate in physical education will also be limited in their participation in field trips as activity indicates. Students who require the use of slings, braces, crutches, or a wheelchair due to an injury or surgery must have a physician's order stating limitations and restrictions. The doctor’s order must specifically include the use of crutches or a wheelchair during school. A doctor’s note is required to resume full activity.

Concussion:

Wisconsin Stat.118.293(4)(a) states an athletic coach, or official involved in a youth athletic activity, or health care provider shall remove a person from the youth athletic activity if the coach, official, or health care provider determines that the person exhibits signs, symptoms, or behavior consistent with a concussion or head injury or the coach, official, or health care provider suspects the person has sustained a concussion or head injury.

A person who has been removed from a youth athletic activity under par.(a) may not participate in a youth athletic activity until he or she is evaluated by a health care provider and receives a written clearance to participate in the activity from the health care provider. Wisconsin Stat.118.293(4)(b). Note: A licensed athletic trainer can clear students/athletes from a concussion for athletic events. Following a concussion, parents must provide documentation of medical follow up every 30 days per Wisconsin Stat. 118.16 (1) (c)until student is able to fully participate in school academics and sports. Student must have a written release from a physician indicating they are able to fully participating in school academic activities prior to the student returning to physical education, recess, or extracurricular events. See EASD policies on Return to Academics and Return to Play following a concussion. Medication ­ administration in schools: is governed by Wis. Stat. sec. 118.29. Both nonprescription and prescription drugs must be recognized as drugs in the official U.S. Pharmacopoeia and national formulary or official Homeopathic Pharmacopoeia of the United States or any supplemental publication to these references.

2. U. S. Homeopathic Pharmacopoeia Medications ­ Parent provided non­prescription medication: Please attempt to give medication before or after school. Aspirin is not allowed. If a parent believes their child is unable to attend school without receiving a non­prescription medication during the 7 hour school day, the parent must comply with Wisconsin Act 160 of Administration of Drugs to Pupils Law. For a school to follow Wisconsin Law Wisconsin State Statute 118.29 Act 160 to safely give your child a non­prescription medication we must have:

1. The non­prescription medication must be supplied by a parent or guardian in the original manufacturer’s packaging (bottle or blister pack) with the list of active ingredients and recommended therapeutic dosage.

2. Written signature of parent or guardian. 3. Nonprescription drug products may only be administered in higher than recommended

dosage by written approval of the medical provider and parent or guardian. 4. By school district policy, the school is only able to give parent­provided acetaminophen,

ibuprofen, cough medicine, antacids or antihistamines. Aspirin is not allowed. Vitamins, supplements, and digestive aids require a physician’s order.

a. By Wisconsin Law Wisconsin State Statute 118.29 Act 160 to we CANNOT accept non­prescription medication in a baggy or in a container where the label is not clear even if the pills are identifiable to us.

b. We are not able to give “Homemade” medication, creams, drops, essential oils or homemade homeopathic mixtures.

5. By school district policy any nonprescription drug which is needed for more than three days needs a physician’s signature.

6. By school district policy any nonprescription drug requires informing the office staff of the condition for which the non­prescription medication is given and providing in writing: 1) dosage requested to be given, 2) time to be given, 3) when the last dose was given at home, 4) when the expiration date is, 5) provide a measuring device if the medication is liquid.

Medication Safety: Parents are encouraged to drop the medication off with office staff. Do not to send the medication to school on the bus. All medication stored at school is kept secure in a locked cabinet. Medication not picked up after 48 hours of non­use or discontinuation will be disposed of. Medication will not be sent home with students unless the student is 18 years old with the exception of inhalers. Medication ­ Physician Ordered Oral or Inhaled Medication By Wisconsin State Law (statute 118.29), NO medication, emergency or otherwise, will be given to a student unless it is prescribed by the student’s physician and both the parent and physician have filled out the proper forms. Please attempt to schedule medication before or after school. Medications that are ordered three times a day may be given before school, after school and at bedtime unless specified by the physician that they need to be given during the school day. Parents need to provide a measuring spoon or device if the medication is liquid. All tablets that need to be split need to be split by the parent. The school is only able to provide the service of dispensing physician ordered medication if the parent complies with Wisconsin Act 160 of Administration of Drugs to Pupils Law which states parents must:

1. Supply and deliver the medication to the school office in the original pharmacy­labeled package and the package must list the ingredients and recommended therapeutic dose in a legible format.

a. By Wisconsin Law Act 160 we CANNOT accept medication in a baggy or in a container where the label is not clear even if the pills are identifiable to us.

2. The pharmacy label package must specify: a. Name of the student

b. Name of the prescriber (physician/nurse practitioner/dentist) c. Name of the drug d. The dose of the drug e. The effective date f. And the directions in the legible format: such as the time to be taken and number of days to be taken.

3. A doctor’s order is presented to the school or the doctor signs the EASD prescription medication form.

4. The parent completes and signs the prescription medication permission form that states the reason for taking the medication

Narcotics: If your child requires a prescription pain medication that is known to reduce the function of the central nervous system, such as the narcotic pain medications Vicodin, Hydrocodone, Tylenol #3, Oxycontin, etc. we request you keep your child safe in your care until their pain can be controlled with a non­narcotic pain medication. Students are not allowed to have drugs or other substances that are considered controlled substance such as a narcotic pain medication on school property, even if there is a physician’s order for the medication. Chronic Health Concerns Parents of a student with a chronic health concern or that need nursing services during the school day must provide physician documentation of any school limitations or the need for accommodations each school year. It is suggested that the student wear a medical alert bracelet or necklace and the parent meet with the classroom teacher(s) at least annually to explain any special needs. Life Threatening Allergies and the Epipen Auto­Injector A physician and parent completed and signed Emergency Health Care Plan for Known Severe Allergic Reactions and a parent provided Epipen are required by the first day of school. It is suggested that the student wear a medical alert bracelet or necklace when at school and that the parents meet with the classroom teacher(s) to explain the life­threatening allergy. Parents are encouraged to attend field trips and classroom­school parties with their child. Child Abuse Laws Child abuse is any mistreatment of a child that results in harm or injury and that has no ''reasonable'' explanation. By Wis. State Statutes 48.981 (b) the definition of a "child" means any person under 18 years of age. Wisconsin State Statute (48.981) requires mandated reporters to immediately, upon having reasonable cause to believe there is neglect or physical or sexual abuse has occurred, to make a report to the designated authorities. Compliance with the reporting procedures is mandated for teachers, principals, designees, nurses, social workers, and counselors. These employees are subject to fines and/ or legal action for failure to report any suspected cases. Elkhorn Area Schools, in partnership with the community, are dedicated to providing an education that challenges every student to continually improve and to excel as a

I. Elkhorn Area High School Co­Curricular Philosophy The Elkhorn Area School District sponsors and encourages student participation in co­curricular activities. Supplemental activities are important to the educational process as they provide a framework for the development of tolerance of others, self­realization, self­confidence, personal responsibility and positive attitudes that will prepare students for adult life in our society. Participating in co­curricular activities is a privilege. Students who participate in co­curricular activities have responsibilities to their school, their peers, their community, their parents/guardians and to themselves. EAHS will strive to provide experiences for students to develop to their fullest potential, focusing on character, courage and integrity. Students who choose to follow this co­curricular code of conduct are exposed to the following opportunities: Development of positive relationships and goodwill Development of leadership skills Development of skills pertaining to social and group interactions including

conditioning II. Honorable Conduct Expectations

The honorable conduct expectations are designed to foster appropriate conduct from coaches, players, officials, cheerleaders, students, spectators, actors/actresses, backstage crew, and audience members. This is based on the belief that good conduct is essential to a successful high school extra curricular program, and it consists of the following fundamentals of conduct: Opponents should be treated as guests, and accorded with respect, tolerance, honesty, and generosity, which all human beings deserve. Officials are to be treated with respect, and should be recognized as impartial arbitrators who are trained to do their job. Good conduct implies the willingness to accept and abide by the decisions of the officials.

Self­control must always be maintained. A prerequisite of honorable conduct requires one to understand his/her own bias or prejudice and the ability to prevent the desire to win from overcoming rational behavior. A proper perspective must be maintained if the potential educational values of co­curricular activities are to be realized; honorable conduct is concerned with the behavior of all involved. Honorable conduct also means proper behavior at performances, musicals, and plays. This means as an audience member or backstage crew you show respect for the actors and actresses during a performance, musical, or play. This respect would include being quiet, turning off electronic devices, clapping when appropriate, and following the other proper performance etiquette.

III. WIAA (Wisconsin Interscholastic Athletic Association) Statement

Elkhorn Area High School, as a member of the WIAA, adheres to the regulations of that association which includes a year­round athletic code. Additional WIAA guidelines and regulation can be found at their web site: www.wiaawi.org

IV. Academics

Academic eligibility is determined by six­week grades as posted at the end of each of the six week grading period. Term grades are used for athletic eligibility.

Two conditions must be met for a student to be considered academically eligible: o Two conditions must be met for a student to be considered academically

eligible: * The student must receive a GPA of 1.65 or better. * The student has no more than 1 F.

Incompletes are considered failing until class work is completed and grades are submitted to the counseling office.

The date to determine eligibility is one day after the day that grades are posted to the counseling office.

If a student does not have eligible status, he/she may not participate in any athletic/co­curricular contests (scrimmages are not considered as contests) for a period of 15 scheduled school days. Athletes: Athletes are expected to practice, and accompany teams to games at the coach’s discretion. For athletes: The student may not dress in uniform for competition or participate in warm­ups or competition during the period of suspension. Uniform consists of any team shirts, pants, warm­ups, etc. Instead, students are expected to dress in appropriate casual dress attire which does not include jeans, sweat pants/suit, sweatshirts or t­shirts. Co­Curricular Participants: This period of ineligibility will include meetings. Category I participants may practice but may not participate in a performance or contest.

Fall sports—The minimum ineligibility period shall be the lesser of (1) 21 consecutive calendar days beginning with the date of earliest allowed competition, or (2) one­third of the maximum number of games/meets allowed in a sport (fractions are to be rounded up).

At the end of the 15 days of ineligibility, the athlete will take a current grade sheet around for each of his/her teachers to complete with current grades and signatures.

If minimum academic requirements are achieved, the student is then eligible for competition. However, if the minimum requirements are not met, the student remains ineligible until he/she can show that minimum academic eligibility has been achieved and will be prohibited from practice as well as competition.

An athlete may take a summer school class at Elkhorn or another accredited high school, or an acceptable online course, to offset the more than 1 F rule or the lower than 1.65 GPA. The summer school class must be related to the failed class(es). The additional grade(s) will be computed with the 6th term grade to determine their GPA.

The high school Principal reserves the authority to evaluate academic eligibility on a case­by­case basis due to extenuating circumstances.

V. WIAA Residency Regulations The WIAA has an extensive description of the many scenarios which can occur regarding residency and student transfers. Their policy is adhered to by Elkhorn Area High School.

VI. Physical Regulations

Each athlete must have on file, in his/her school, evidence of having passed a physical examination administered by a licensed physician or by an Advanced Practice Nurse Prescriber or Physician Assistant authorized by a licensed MD to perform the physical and a signed parental permission card.

The student/athlete is expected to report any injury, regardless of how minor, to his/her coach or Athletic Director (AD) immediately.

An athlete removed from participation due to injury and/or illness and seeks follow­up medical treatment from an MD, APNP or Physician Assistant must submit a written release from a provider before returning to participation.

For an injury that requires a claim, the parent/guardian must file with his/her insurance carrier first. The school provides secondary coverage through the purchase of each activity pass.

All information pertaining to an athlete’s physical condition will be confidential. Any student having a head injury or concussion must be cleared by a physician

before returning to practice or competition. VII. Attendance

To be eligible for any co­curricular competition, meeting, or practice, a student is required to meet the following: Attend his/her 1st hour class on time Be in attendance every period of the day

Exemptions include: doctor’s appointment, dentist appointment, funeral, driver’s licensing test, religious observations, accident, college visit, school­related function, emergency excuses approved through the administration.

It is the responsibility of the student/parent to see that his/her absences are properly explained to the attendance office or athletic office prior to participation.

Students who have medical excuse for release from physical education may not participate in practice or games/meets of the interscholastic program.

VIII. Training and Conduct The Elkhorn Area School District encourages each student to pursue excellence not only in academic and co­curricular areas, but also in the areas of conduct and behavior. The following actions and behaviors are unacceptable and shall result in suspension from competition: Selling, providing, possessing, transporting, consuming or using alcoholic

beverages, controlled substances or tobacco products. Use of E­cigarettes is also considered unacceptable and will be treated in the same manner as other violations.

A student who has a gathering at his/her home/property where alcohol or drugs are being used will be given a penalty at the next highest level above the level s/he would normally receive. Example: If a student hosts a party, provides illegal substances and it is the student’s first violation, since the party was at his/her home/property, the student would be given a violation as his/her second offense.

Commits/participates in acts of theft or vandalism toward the school, school district, district personnel or any affiliates of school districts with whom we compete.

Commits any act in violation of or subject to penalties of local ordinances and/or Wisconsin State Statutes with the exclusion of violations of the motor vehicle code.

Persistent disruptive behavior or any act or behavior in violation of or subject to penalties under the Elkhorn Area High School District policies.

Commits an act of hazing—as defined by Wisconsin’s Anti­Hazing Law 948.51­­ against another student where a student is coerced into committing an act that creates a substantial risk of harm to a student or other third party in order for the student to be admitted or initiated into, or affiliated with any school group, club, athletic team, grade level, activity or organization. This includes but is not limited to:

o Any actions involving behavior of a sexual nature or simulation of actions of a sexual nature.

o Any action that subjects a student to an unreasonable level of embarrassment, shame, or humiliation or which creates a hostile, abusive and intimidating environment for the student including through the use of

electronic media such as cell phones, text messaging, internet sites, or audio or video postings.

o Any activity involving any violation of federal, state or local law or any violation of school district policies and regulations]

Cyber Image Violations: Any identifiable image, language, photo, or video which implicates a participant to have been in possession or presence of drugs and/or alcohol or portrays actual use; or out of character behavior or crime, shall be confirmation of a violation of the code.

IX. Athletic Code Reporting and Investigation When an alleged violation of the co­curricular code is reported to an administrator

or athletic director, the allegation must be written and signed by the witness or accuser. An administrator/athletic director shall arrange a conference with the student to take place within 5 days or a reasonable amount of time after the allegation has been made. The student in question may continue to practice and compete until the initial conference is held.

The Principal/Designee shall have the discretion to modify the minimum penalty based on the nature of the offense.

**Upon receiving 1st, 2nd or 3rd violation related to substance abuse, students will be encouraged to seek an ATODA assessment and/or counseling.

When a suspension penalty cannot be completed within a sport season, including the WIAA tournament, that penalty will continue into the athlete’s next sport season. The total number of contests missed will be based on the first sport in which the violator participates.

Athletes must complete the season in good standing to satisfy the penalty requirements.

Because of questions relating to tournaments, doubleheaders, postponed games and multi­game events, the following interpretation will be used: Penalties will be in terms of games, not events. Therefore, an athlete could miss part of a day’s activities and be eligible to participate once the penalty is completed. When the suspension is part of a multi­event day, the penalty is invoked on the earliest scheduled games.

If an athlete is suspended for any reason, and that suspension includes a WIAA tournament, he/she is immediately disqualified for the remainder of the total tournament series in that sport.

A coach may not impose a penalty on an athlete which is more severe than the athletic code has outlined.

A student who violates an athletic team training rule during the athletic season would not be eligible for nomination of special awards or be a recipient of special awards at the conclusion of the season. (Letters, bars and certificates are not considered special awards.) In addition, a student who violates a training rule may not serve as a captain during the season of the violation. If the violation occurs after the season, but before that team’s awards celebration, special awards will not be given.

If a violation is committed while serving a suspension, the penalty for the second violation will be imposed at the conclusion of the first penalty.

An athletic code violation and an academic eligibility penalty may be served concurrently.

XI. Appeal Procedures

Discipline decisions regarding code violations taken against a student may be appealed by a parent/guardian and/or student to the High School Athletic Director. Questions regarding if an offense has occurred, extenuating circumstances or unjust sanctions imposed may be appealed. The Athletic Director must receive a written appeal no later than 5 days from

receipt of the student’s written infraction notification. The accused will be considered ineligible for competition during the appeal

process.

The Athletic Director will assemble an appeals committee. The appeals committee will consist of an Assistant Principal, two students, two teachers, and one varsity coach.

The accused may have parents and/or witnesses present. The appeals procedure will be conducted by the Athletic Director. Evidence of the

alleged violation will be presented. The accused may then present their argument as to their innocence or reasoning why the penalty should be lessened.

The committee may ask questions to assist them in determining guilt or non­guilt. These questions can also help in determining the penalty that would be assessed.

Upon completion of the appeal procedure and a decision has been made, the accused may appeal the committee’s decision to the Principal within two days of the committee’s decision. The Principal, after reviewing and/or investigating the committee’s record may modify the determination.

XII. Equipment

Students are responsible to turn in or pay replacement cost for all equipment issued to them for all activities/athletics. The student will not be allowed out for the next sport or activity until these responsibilities are met.

XIII. Travel

All students are required to use the mode of transportation provided by the school while involved in interscholastic athletics. Elkhorn Area High School will assume no responsibility for any student who misses his/her mode of transportation to a contest and attempts to travel to the contest site on his/her own. Special requests from parents must be directed to the Athletic Director or Administration.

XIV. Penalties for Violations—Co­curricular Activities Category I Activities: Activities in which students have the opportunity to compete or participate in competitions. First offense: The student will lose participation in the first chronological event in

which he/she is involved in at the time of or following his/her violation. Second offense: Dismissal for 90 school days from the time of violation in all

category I activities. Third offense: Dismissal from participation in all category I activities for one

calendar year from the time of violation.

Category II Activities: All elected and/or appointed positions. First Offense: Student will lose elected office and/or membership in organization

for remainder of the school year.

Category III Activities: Any activity other than Category I or II. First offense: Loss of membership privileges in all category III activities for 45

school days. Second offense: Loss of membership privileges in all category III activities for 90

school days.

Third offense: Loss of membership in all category III activities for one calendar year from the time of violation.
