5) DISCUSSION/RECOMMENDATION: Request by Wayne Zakowski, 1880School Ln, for approval of a 2 lot Certified Survey Map, as prepared by TracyOndik, Soletski Surveying. Located on the north side of School Ln, 1/ 4 mile westof Velp Ave. Parcel SU -290. Zoned Residential SewerStaff Report:

The property is served by both sewer & water. In addition to the home' s

laterals, there is a single sewer lateral just to the west of lot 1 which could

serve lot 2. Water would require a tap and boring under School Ln forconnection.

Further use for lot 2 has not been discussed. The split is being requested toassist in the estate settlement process.

Lot one does include the home & all of the out -buildings. The number and

size of those is above what code allows, but as existing buildings they wouldbe considered grandfathered.

Staff did have a discussion with the surveyor about the size and configuration

of lot one and its impact on further division of lot 2 for future sewer

development. At this point lot one is required to be 2 acres in size. The

property is being divided as part of the estate requirements which grants thebuildings & 2 acres to one of the son' s.

6) DISCUSSION/RECOMMENDATION: Request by Michaels Custom Homes, for approval of a 4 lot Certified Survey Map on Riverside Dr, as prepared byDavid Chrouser, Mau & Associates. Located on the north side of Riverside Dr,

925ft east of Seafarer Way. Parcel SU -540- 3. Zoned Residential SewerStaff Report:

This property is served by sewer & water. Sewer laterals are in place for each

of the 4 lots. Water will require taps to serve the properties. The water is on

the north side of Riverside Dr so these should be simple taps.

The property has been filled to remove the front portion from the floodplain. Ifthe homes are constructed beyond the fill area all floodplain requirements

would be applied. Exposed basements would likely be an issue as well. All 4 lots appear to exceed code requirements for size and frontage.

The wetlands have been delineated and approved by the WDNR. Brown County will be requiring a 75ft ESA from the ordinary high watermark. Even with that set -back lot 4 will have enough buildable area.

Motion by Thomson to recommend approval of a 4 -lot Certified Survey Map forMichaels Custom Homes on Riverside Dr, as prepared by David Chrouser, Mau & Associates. 7) DISCUSSION/RECOMMENDATION: Request by the Village of Suamico torezone parcel SU -1069- 13 from Residential Sewer to Public Lands & Institutions.

Located on the west side of Velp Ave. adjacent to and north of 12787 Velp Ave. Staff Report:

The Village purchased this property in 2009 to incorporate it into the property thatwas being developed with the municipal center. The use of this property was notcompletely known at the time of purchase. There was some thought to removingthe barn and using it for a park. Shortly after purchase the HSHS approached theVillage with interest in restoring the barn and the house. The Village entered intoa long-term lease agreement with HSHS for that purpose. The lease agreementallows for the public use/display of the restored barn and house. HSHS has done agreat job restoring the barn and has begun to use it for different events. A recentevent, I believe the FFA club from Howard/Suamico school district, raised a few

concerns with the use of the barn. A committee has been formed to address those

concerns and better outline parameters for the use of the barn. As part of the

creation of the committee and initial discussions, staff realized this property wasnever rezoned to reflect its original purchase intended use and its current use. The

property was purchased after the main parcel had already been rezoned anddevelopment was well under way.

Thomson: What is the status of SU -1069- 14?

Dunks: Ann Rybak owns that property. We haven' t initiated any clean up on it. Nelson: Who did we purchase the property from? Dunks: Mike Rybak.

Nelson: We purchased it for fair market value?

Dunks: I believe so.

8) DISCUSSION/RECOMMENDATION: Request by the Village of Suamico tozone parcels SU -2814 & SU -2815 to Public Lands & Institutions. Located on the

east side of West Deerfield Ave. on both eastern corners of Riverside Dr.

Staff Report:

The Village acquired these parcels from the State of Wisconsin in 2015. It was

part of the Hwy 41 ROW prior to that. This property was acquired mainly forthe future fire station 1 location. The northern lot is intended to remain vacant

at this time.

I believe there is a deed restriction on both of these lots which require it to be

used for public purposes only.

Background

The property is being purchased by Mr. Sorrentino contingent upon the approvalof the conditional use to allow horses.

There is already an older barn on-site that could be used as the stable for thehorses. The plan is to fence off about 5 acres for pasture land and use the rest for

trail riding.

The property far exceeds code requirements of 2 acres per horse. There is about 3acres of open land with the remainder wooded property. Most of the surrounding properties are larger rural lots and the proposed useshould have little impact on those properties.

Staff believes this is an appropriate location for this use as further division of this

lot would be difficult with the placement of the home and possible wetlands on

the site.

Suggested Motion

To recommend approval of a conditional use to allow horses at 2472 St. Pats Dr, parcel

SU -655- 3- 1 with the following conditions; 1. An appropriate shelter & containment area shall be provided for the horses.

2. All waste shall be contained and disposed of in a manner that will not create

unsightly views or objectionable odors for surrounding properties. 3. Maximum of 2 horses.

4. The Village reserves the right to review the Conditional Use permit for violations

of the conditions of approval and rescind if necessary.

Background

The property is part of the Sunny Hill Farms operations. The property split isbeing proposed to allow a relative to that operation to construct a home on thatlot.

The proposed CSM is a one lot CSM because the remainder of the parent parcel is

above 10 acres in size thus does not need to be shown as a separate lot. The CSM

does appear to meet our code requirements. It is located in an area shown to be

future sewered residential. A 50,000sq ft lot is required, not the 2 acres. The proposed lot does not meet the acreage requirements of AG -FP requiring arezone.

6) Rezoning Land Out of a Farmland Preservation Zoning District. a) Except as provided in sub. ( 2), the Village may not rezone land out of

a farmland preservation zoning district unless the Village finds all of thefollowing in writing, after public hearing, as part of the official record of therezoning, before granting the rezone:

1. The rezoned land is better suited for a use not allowed in the farmland

preservation zoning district. A single family home as part of the farmingoperations is allowed but the fact that the lot does not meet our minimum

requirements means the rezone would be required.

2. The rezoning is consistent with any comprehensive plan, adopted bythe Village, which is in effect at the time of the rezoning. Our comp plan doesshow this as fixture residential

3. The rezoning is substantially consistent with the Brown CountyFarmland Preservation Plan, certified under ch. 91, Wis. Stats., which is in effect

at the time of the rezoning. The size ofthis rezoned lot would not substantiallyaffect any consistency with the County plan

4. The rezoning will not substantially impair or limit current or futureagricultural use of other protected farmland. The rezone will allow the current

owner to sell the remainder ofthe property to an individual that wishes tocontinue to have the land in agricultural use rather than it being soldforfirrtherdivision.

Fiscal Impact

Parkland Dedication fees of $300 will be due at the signing of the CSM

Suggested Motion

Two separate motions will be required

1. To recommend approval of a 1 - lot Certified Survey Map for Lee & Carolyn

Duchateau, as prepared by David Chrouser, Mau & Associates. Located on the

southeast corner of Oak Rd & Fairview Rd. Parcel SU -718; with the followingconditions;

a. Payment of Parkland Dedication fees of $300

b. Approval of a rezone from AG -FP to RR

c. Meet the requirements of all other applicable ordinances, regulations, and

reviewing agencies2. To recommend approval of a rezone of lot one of the approved CSM on parcel

SU -718 from AG -FP to RR
