2 OBJECTIVES

2.1 Overall Objective(s):

2.2 Project purpose:

To strengthen the capacity of the Ministry of Agriculture and Forestry (MAF) and its servicesto undertake the priorities for EU alignment and implement the reforms identified in the currentAccession Partnership and the National Programme for the Adoption of the Acquis (NPAA)and prepare for the Common Fisheries Policy (CFP).

2.3 Accession Partnership and NPAA priority

Accession Partnership

A short-term priority of the 1998 Accession Partnership is “Development of capacity toimplement and enforce the Common Fisheries Policy.”

A medium-term priority of the 1999 Accession Partnership is to “Develop the capacity toimplement and enforce the Common Fisheries Policy, particularly by providing the adequateinstitutional resources and equipment relating to inspection and controls; set up an adequatefleet registration system; promote quality standards.”

NPAA Priorities

Short-term priorities

• Preparing legal measures under the Fisheries and Aquaculture Act;

• Preparations for setting up a system and a unit under NAFA issuing fishing licenses andexercising control of fishing and fisheries/aquaculture;

• Preparations for setting up a system and a unit under the NAFA collecting, summarizingand disseminating information on catch data;

• Further provision of equipment for NAFA, its regional offices and research instituteslaboratories;

• Elaborating a system of operation of POs within the market structures of the sector;

• Provision of computer equipment and software to the NAFA and the POs;

• Setting up a system and a unit under the NAFA and the NVS exercising control on fishtrade;

Medium-term priorities

• Drafting and adoption of legal measures under the Fisheries and Aquaculture Act;

• Feasibility study of EU CFP mechanisms;

• Control of resource reproduction;

• Establishing a national statistical system of information in the sector;

• Introducing a system of fishing licensing;

• Preparations for setting up and funding POs in the sector and their inclusion in theNational Branch Statistical System;

• Preparations for the introduction of the principles of sustainable development of fishresources and aqua-cultures in water eco-systems;

• Setting up POs;

• Administrative capacity reinforcement of all structures and institutions involved in theimplementation of the acquis;

• Staff training.

2.4 Contribution to National Development Plan

The National Agriculture and Rural Development Plan (NARDP) includes two measures in thearea of fisheries eligible for financing under SAPARD:

• Improving the processing and the marketing of agricultural and fishery products;• Development and diversification of economic activities, provision for multiple activities

and alternative income.

A sector analysis will start in January 2001 for identification of the places and the capacity ofthe wholesale markets that will sell fish and fishery products. The analysis is included in the

framework of the Project Preparation Facility (PPF) for development of measures in the field ofagriculture and rural development to be financed under SAPARD.

The Phare project will not be financing activities that will be eligible for financing underSAPARD. The National Agency for Fisheries and Aquaculture will use the Phare assistance forapproximation of legislation in the area of marketing of fish and fishery products, andimprovement of the administrative capacity to implement this legislation, including training ofinspectors.

2.5 Cross Border Impact

3 DESCRIPTION

3.1 Background and justification

3.1.1 Background

On the 19th December 1994 the Council and the Commission of the European Communityapproved an Agreement between the Member States and Bulgaria (O.J. No L358/1,31.12.1994). In this Agreement Bulgaria commits itself to making its legislation progressivelycompatible with the community legislation. Animal and plant, fisheries and aquacultureprotection, as well as consumer and environment protection are duly mentioned as importantareas of legislation approximation.

By January 2000 about 85 % of the enterprises in the fisheries/aquaculture sector wereprivatized (compared to 0 % in 1990). More than 70 private, state and mixed ownershipcompanies are functioning in the sector. Over 7000 individuals are full-time occupied in fishingand/or fish farming in the Black Sea, the Danube river and the inland water basins. 100% of theopen-deck fishing boats and 95% of the fishing vessels are privately owned. In July 2000 thenumber of issued fishing licenses is as follows: for the Black Sea - 3260 (including fishingvessels, open-deck boats, trap and railing fishing nets, mussel farms); for the Danube river -1497 (open-deck boats). Bulgaria has excellent conditions for fish farming/aquaculture with 21large (above 500 ha), 54 medium size (over 100 ha), and 4686 small lake-dams.

NAFA, including its 6 RFIs, has lead responsibility for implementation of the EU legislationin the sector. From the beginning of 2001 the NAFA’s staff will increase from 48 to 160. Itis expected that by the end of the year the staff will be increased to a total of 210. The RFIshave been increased from 6 to 27, and cover all administrative regions in the country.

A draft Fisheries and Aquaculture Act (FAA) has been prepared by the working group"Fisheries and Aquaculture" at MAF. It provides the legal framework for implementation ofmore than 25 basic EU legal acts that cover all major aspects of the Common Fisheries Policy(CFP). The draft FAA is in partial conformity with the acquis, and full approximation of thelegislation will be achieved by adoption of secondary legislation. The draft FAA wassubmitted from the Council of Ministers to the Parliament on the 3rd of July 2000 andadoption is expected by the Parliament by the end of February 2001.

At present, NAFA is working on a medium term (5 years) strategy for its institutionaldevelopment and for the restructuring of the fisheries sector in Bulgaria. The strategy is in theprocess of consultation, and will be approved by the end of February 2001 This strategy can besupplied in request.

The proposed EU assistance is intended to help Bulgaria to speed up the harmonization of itslegislation as well as to strengthen the capacity of the institutions in fisheries/aquaculture toachieve sustainable development, protection, conservation, monitoring and exploitation ofliving aquatic resources.

A significant amount of secondary legislation for the implementation of the FAA will beadopted in the forthcoming years. The process of legislation approximation will be finalized bythe end of 2005.

3.1.2 Justification for Fisheries Control System

Ref: Investment Sub-projects A & B, Twinning Sub-project 1.

The conservation of fish resources is one of the pillars of the CFP and Bulgaria is a signatory toCITES (Convention on International Trade in Endangered Species). Both the CFP and CITESrequire Bulgaria to take action to preserve its fish stocks

Certain fish stocks are running dangerously low in the Black Sea largely due to illegal fishingi.e. quotas being exceeded, foreign vessels fishing illegally, transhipments of fish fromBulgarian to Turkish boats and use of illegal fishing methods.

NAFA lacks adequate equipment and trained personnel to effectively implement the EUrequirements related to the establishment of a control system applicable to the CFP.

The establishment of a Satellite-based Fishing Vessels Monitoring System (SFVMS) forfishing vessels of length 24m or more would assist with control. In recent negotiations with theEC, DG Fisheries have stated that such a system is obligatory for Bulgaria and recommendedthat NAFA seek assistance from Phare in order to introduce one. Further information about theSFVMS can be supplied on request.

There are however over 3,000 Bulgarian fishing vessels less than 24m in length that can not bemonitored by the SFVMS. The provision of the patrol boats listed in Annex 4 would enableNAFA to offer some protection to economically important fish stocks in the Black Sea(particularly turbot and sturgeon) from illegal fishing from these smaller boats. Such controlcan only be effectively exercised on the water and currently NAFA have no boats at all for thistask.

The same applies to the Danube river, which is why two boats are being requested to controlthese waters. The economically important sturgeon reproduces only in the Danube and thisspecies in particular is being threatened by illegal catches. The whole length of the river isimportant because different sub-species breed in different stretches of the river. Otherthreatened fish species are of local importance.

The twinning program will cover the Institution Building aspects relating to the “Improvementof the control system and sustainable development of fisheries and aquaculture in compliancewith the EC Common Fisheries Policy (CFP)”, with assistance in harmonising legislation,preparing plans, preparing tenders, training, etc.

3.1.3 Justification for National Information and Fisheries Statistics System (NIFSS)

Ref: Investment Sub-project C, Twinning Sub-project 2.

The establishment of the NIFSS for fisheries, compatible to EU requirements, is a prioritybecause the EU requires Bulgaria to provide statistical data (as from the end of 2003), whichcannot be supplied without such a system. At present, NAFA lacks the required equipment andtrained personnel to effectively implement the EU requirements. Sub-project 2 of the twinningprogram will cover the institution building aspects relating to the introduction of the NIFSS, i.e.assistance in design and training.

3.1.4 Justification – Laboratory Equipment

Ref: Investment Sub-project D.

The establishment of a laboratory on health status of fish and aquaculture (the CentralLaboratory for Fish Pathology) and the provision of the two mini-van laboratories will improvethe existing methods of laboratory diagnosis. It will reinforce the Bulgarian capacity for theimplementation of the requirements of Directive 93/53 on fish diseases and Directive 91/67 onthe health conditions on aquaculture, and will ultimately improve hygiene and health standards,which will help towards the lifting of the EU export ban.

The Laboratory “Genom and Populations” at the Fish Resources Institute in Varna should befurther equipped to perform genetic tests, and prepared for official accreditation. This willenable Bulgaria to meet its obligation under CITES for restocking of wild species and willassist exports by enabling genetic certification. Further information about the Laboratory can besupplied on request.

3.1.5 Justification – Twinning

Ref: Twinning Sub-projects 3,4, & 5

Classical twinning is required because there is a need for institution building in all parts of thesector. Much legislation needs to be harmonized and assistance and training is required to aidimplementation. Sub-projects 3, 4 and 5 of the twinning programme will assist respectivelywith the important areas of introducing Producers’ Organisation (to strengthen the sector), ofimproving licensing and registration of fishing and aquaculture activities, and of introducingHACCP into fish handling and processing enterprises.

A general overview of the fisheries sector can be supplied on request.

3.2 Linked activities:

There will be no overlapping activities with the following:

• the twinning project of the National Veterinary Service which includes measures forimprovement of hygienic requirements of aquaculture plants (through provision of trainingto veterinary inspectors);

• the SAPARD's measures for improvement of the marketing system for fish and fisheryproducts, and diversification activities;

• the SAPARD’s sector analysis for identification of the places and the capacity of thewholesale markets that will sell fish and fishery products;

• the Eastfish-FAO project for HACCP training in Bulgaria;• the Phare project for Agrostatistics of MAF (further details can be supplied on request)• the Phare 1997 Multi-country SPP project for the establishment of Fishing vessels

registers in the acceding countries (a report on the current situation with respect to theFVR can be supplied on request);

• the twinning Phare Project No BG98/IB-AG-03 of MAF providing advice, informationand training from the UK, German and Greek Ministries of Agriculture for legal andinstitutional alignment on a range of commodity areas, including fisheries.

3.3 Results:

• Harmonization of key legislation, described in greater detail under activities, andcorresponding to the requirements of the FAA and the Bulgarian Negotiating Position onChapter 8 “Fisheries”. (Twinning)

• Agreed priorities and plans for preserving bio-diversity in the area of fisheries andaquaculture. These priorities will be included in the National Program for Fisheries andAquaculture. (Twinning)

• Licensing and registration system for fishing and aquaculture activities established incompliance with the EU standards (Ref. to Regulations 3690/93, 1627/94, 2943/95);(Twinning)

• Α control and monitoring system of fishing activities meeting EU regulations (Ref. toRegulations 3760/92, 894/97, 2847/93, 2241/87, 3690/93, 1627/94);

• Establishment of the NIFSS; (Twinning and Supply contract)• A system for monitoring quality and safety of fishery products in compliance with EU

standards. The Central Laboratory for Fish Pathology fully complying with the EUrequirements (Directives 93/53 and 91/67), and covering all needs related to the healthstatus of fish. (Twinning and Supply contract)

• A system for monitoring environmental standards in fish farming and aquaculture in linewith EU requirements. The regional NAFA and NVS bodies fully operational to performon-site checks (using the mobile labs). (Twinning and Supply contract)

• The Genom and Populations Laboratory fully equipped to perform genetic tests; (Supplycontract)

• Legislative base established for the introduction of Producers’ Organisations in thefishing industry. (Twinning)

3.4 Activities

3.4.1 Twinning Project

A 1.5 year classical twinning project is planned, split in sub-projects to cover five areasdescribed below. Please note that the number of experts and the amount of time quoted below isa guideline only and is subject to negotiation.

Sub-project 1: Improvement of the control system and sustainable development of fisheriesand aquaculture in compliance with the EC Common Fisheries Policy (CFP):

- Preliminary assessment of the present legislation and development of a plan for furtherassistance;

- Fisheries environmental issues, including preparation of priorities and plans for preservingbio-diversity in the area of fisheries and aquaculture;

- Harmonization of legislation on elements of conservation of fishery resources andimprovement of control activities and technical measures, not covered by the other 4 sub-projects: Regulations No 3760/92, 894/97, 2847/93, 2241/87, 3690/93, 1627/94;

- Analysis of the current situation in the fisheries sector;- Assessment of the need for equipment and preparation of technical specifications and

tender documents for strengthening the General Monitoring and Control System of NAFA;

- Seminars and training of inspectors (including training in the implementation of theapproximated legislation in EU Member state on the operation of the system for satellitemonitoring of fishing vessels, after the provision of the equipment).

Sub-project 2: Establishment of the legislative base and introduction of the Information andStatistics System on fisheries;- preliminary assessment of the present legislation and review of the assistance provided to

date; assessment of further needs;- harmonization of legislation on collection and communication of information on fisheries:

Regulation No 3760/92, 2847/93, 2870/95, 1382/91, 2210/93, 2597/95, 2104/93, 3880/91,2018/93, 788/96, 1489/97;

- assistance in the design of the information system and training of the staff who will use thesoftware.

- one Bulgarian expert to become acquainted with a similar information system in a MemberState.

Sub-project 3: Establishment of the legislative base and introduction of producers’organizations and the common market organization (CMO) in fisheries:- preliminary assessment of the present legislation and development of a plan for further

assistance;- harmonization of legislation on CMO, including producers' organizations: Regulation No

104/2000, 2792/1999, 1886/2000, 1924/2000, 2939/94, 105/76, 2508/2000;- assistance for the establishment and recognition of producers’ organizations and the system

for collection of marketing information;- seminars with representatives of fishermen organizations and training of trainers in the area

of market organization.

Sub-project 4: Improvement of the legislative base for licensing and registration of fishing andaquaculture activities:- preliminary assessment of the present legislation and development of a plan for further

assistance;- harmonization of legislation on the licensing regime: Regulations No 3760/92, 2847/93,

3690/93, 2943/95, 1627/94, 2930/86;- seminars and training of NAFA’s staff operating the licensing system.

Sub-project 5: Taking account of general arrangements being introduced by the NationalVeterinary Service, identify specific measures needed to introduce HACCP systems for alltypes of fish handling and processing enterprises including fishery markets and on-boardgutting and processing of fish and aquaculture species;- development of a plan for further assistance (including medical treatment and

prophylactics);- seminars with representatives of fish processing establishments .

3.4.2 Investment component

Investment will be aimed at improving the General Monitoring and Control System, asfollows:

A. Establishment of mobile Fisheries Control System (FCS) on field (Annex 4 - A):

• 2 mobile labs to be used by NAFA - one for the southern and one for the northern part ofBulgaria . The labs will be responsible for control activities and on-site tests in all 6,000fresh-water basins used for fishing and fish farming;

• Patrol motor boats for: i) the Black Sea - 7 units - the two bigger control boats will be situated and used by the

RFIs in Varna and Bourgas, the smaller vessels will be provided to RFIs’ units alongthe Black Sea coast, with high concentration of fishing activities or existence ofprotected species. The names of the towns where the boats will be situated could besupplied upon request;

ii) the Danube river - 2 units - to be used by the RFIs in Vidin and Rousse;

B. Establishment of Satellite-based Fishing Vessels Monitoring System (SFVMS) (Annex 4 -B):

• Equipment for the Monitoring center of the SFVMS - to be used by the ExecutiveAgency “Maritime Administration” in the town of Varna, as arranged in the Agreementfor Cooperation (a copy of which can be supplied on request);

• Purchase and installment of special software for the Satellite Monitoring System9according to Regulation 2847/93);

• Inmarsat-C board installation units for the fishing vessels - to be provided to the ownersof the fishing vessels with length 24m or above.

C. Improvement of the Monitoring System (MS) and the National Information and FisheriesStatistics System (NIFSS) (Annex 4 - C):

• Equipment for NAFA (Sofia) - Server, Printer Server, Software;• Equipment for the 27 RFIs - PCs and periphery equipment. The 27 RFIs do not possess

the required equipment for the establishment of a computerised network for collection,processing and submission of information. The requested equipment will contribute forthe establishment of the information system.

D. Improvement of the Control Laboratories (stationary and mobile) for genetic tests andhealth status (Annex 4 - D):

• Laboratory equipment for genetic tests. The requested equipment will be used forimproving the capacity of the Laboratory “Genom and Populations” in the FishResources Institute (FRI) and for preparation for accreditation. Annex 4 lists the requiredequipment;

• Laboratory equipment for the new Central Laboratory for Fish Pathology where it will beused for testing the health status of fish and aquaculture farms and species, includingprophylactics. (In accordance with the Agreement for Cooperation between NAFA andthe NVS, NAFA has the responsibility to provide to the NVS equipment for a stationarylaboratory on fishery diseases. This laboratory will be established in Sofia, and will applyfor official accreditation. NAFA supports the efforts of the NVS to establish thislaboratory with a view of faster and durable lifting of the EU ban for export of fish andfishery products from Bulgaria. The laboratory will strengthen the Bulgarian capacity tomeet the high EU standards for food safety);

• Laboratory equipment for the 2 mobile labs - to be used by NAFA and RFIs.

The needs assessment for the equipment required was made by Bulgarian experts fromNAFA, the Fish Resources Institute and the National Veterinary Service. The assessment is infull correspondence to the requirements of the basic EU Regulations 3760/92 and 2847/93.NAFA is planning to receive official confirmation for the requested equipment from EUexperts making the Feasibility study on Fisheries under the MAF/IPD Twinning project(Phare 1999). Final confirmation of the equipment needs will be made under the twinningproject of NAFA (if the project is approved) before the start of the tendering procedures.

All running costs and the maintenance of the equipment listed in sub-projects A-D will beprovided by the Bulgarian authorities. NAFA will also provide 25% or more co-financing incash for the investment component of the project.

4 INSTITUTIONAL FRAMEWORK

The National Agency for Fisheries and Aquaculture within MAF

The Ministry of Agriculture and Forestry (MAF) has lead responsibility for administration ofthe fisheries sector. MAF has jurisdiction for controlling fisheries activities in the Black Sea,the Danube River and the inland water basins (waters for industrial and sports fishing/anglingand for fish breeding according to art. 3 of the existing Fish Husbandry Act 1982); the fishingregime and the licensing of the fishermen major activities (issuing licenses for industrial andpermits for sports fishing); control activities related to the fishing regime; veterinary andsanitary control of the quality of the production and its marketing are also under the legalauthority of the MAF. The MAF is also in charge for granting concessions for fishingfacilities in the Black Sea.

The MAF manages this sector through the National Agency of Fisheries and Aquaculture.NAFA is within the MAF structure, and according to the Fish Husbandry Act (FHA),(published in State Gazette vol. 91/1982) it carries out the above listed activities (except theveterinary ones) in all waters and in-land water basins, including the Danube River and theBlack Sea.

NAFA concluded a Cooperation Agreement with the Executive Agency “MaritimeAdministration” (EAMA) for mutual operation of the satellite-based Vessel MonitoringSystem (VMS). EAMA will provide office space for the monitoring center and the personnelto operate it. NAFA will provide the necessary equipment for operating the system.

The Regional Fisheries Inspectorates

At present, the operating RFIs are situated in the towns of Bourgas, Varna, Plovdiv, Pleven,Vidin and Rousse and the number of staff working in them is 38. They are responsible for theimplementation of the NAFA activities on regional level.

From 1 January 2001, the RFIs were increased to 27 (21 new ones), and they cover alladministrative regions in Bulgaria. The equipment and training received under this projectwill be used to improve their administrative capacity to implement the harmonized legislation.

The State Veterinary ServiceThe National Veterinary Service (NVS) is a specialised executive body of the Ministry ofAgriculture and Forestry for the organization, coordination, management and control of theveterinary activities.The NVS is a legal body with a Head Office in the town of Sofia and an operational structurethroughout the country.

NAFA and NVS signed a co-operation agreement on the 4 October 2000 for assistance in thearea of sanitary and hygienic requirements of fish (which can be supplied on request).

NAFA works in co-ordination with the following administrative institutions:

In respect of the Fishing Vessels Register (FVR) - the Executive Agency "Maritimeadministration" at the Ministry of Transport and Communications (MTC). NAFA isresponsible for the registration of fishing activities and equipment;

In respect of the Satellite Monitoring and Control System (SMCS) on fishing vessels -the Implementing Agency "Maritime administration" at the Ministry of Transport andCommunications;

In respect of fisheries statistics - the “Agristatistics” Department at the Ministry ofAgriculture and Forestry;

In respect of the sanitary and hygienic requirements - the National Veterinary Service.

In respect to the conservation and reproduction of fish resources - the Ministry ofEnvironment and Waters.

In respect to the genetic tests of fish – the Fish resources Institute in Varna.

All running costs and the maintenance of the equipment purchased under this project will beprovided by the Bulgarian authorities.

The Phare contribution for the equipment will be 75% of its cost, with a maximum of Pharecontribution of 1.2 MEuro. If the total cost of the equipment exceeds 1.6 MEuro, therecipient will provide additional co-financing from its own resources to finance the contract.

6 IMPLEMENTATION ARRANGEMENTS

6.1 Implementing Agency

The CFCU in the Ministry of Finance will be responsible for tendering and contracting of theproject. The monitoring and control of the project implementation will be done by PhareImplementing Agency of MAF.

6.2 Twinning

The project includes one twinning arrangement (for 1.5 years) in order to cover theinstitutional building part amounting to a total of 650,000 Euro.

In all twinning projects, success in delivering a guaranteed result will depend on thecoherence of a number of successive inputs, the continuity of those inputs, and steadyprogress. Every twinning project will therefore include a Member State Project Leader, whocontinues to work in his/her Member State administration but who devotes some of his/hertime to conceiving, supervising and coordinating the overall thrust of the project. S/he willalways be complemented by at least one full-time expert, known as a Pre-Accession Advisor(PAA), from a Member State to work on a day-to-day basis with the beneficiary in thecandidate country and accompany the implementation of the twinning project.

The PAA will be for 1 year, and 12 man/months for short-term EU experts are envisaged tobe necessary, excluding training and seminars. See Annex 5 for estimated financialbreakdown of the twinning project.

PAA Profile

1. Work experience – at least 7 years in one of the following areas:o Conservation (control and restocking) of fish resources;o International fisheries agreements;o Aquaculture;

(knowledge in more than one of these areas will be considered as advantage)2. Language proficiency:

Fluent in English;3. Education: Relevant education in the area of fisheries is required;

1.5 man/months EU expertise is required for preparation of detailed technical specifications.Two tenders are envisaged: one for selection of twinning partner and another open tender forsupply of equipment with 3 lots (Lot 1- boats, Lot 2 - IT equipment and software and Lot 3 -laboratory equipment).

12 CONDITIONALITY AND SEQUENCING

The project is dependent on the following:• An appropriate twinning partner being found. In case no satisfactory offers are received, the

twinning assistance component will be transformed into a TA project tendered according tothe procedures of the DIS manual.

• The FAA being adopted and entering into force before the start of the project (the FAApassed its first reading in Parliament on 11 January 2001).

• The new Central Laboratory for Fish Pathology being established and staffed by the NVS.The NVS has contracted to do so, the premises are ready and discussions are being held onthe number of staff required. The laboratory staff will number at least 12 and probablymore.

• Final confirmation of the equipment needs being made under the twinning project before thestart of tendering procedures.

• Projects to be implemented through twinning require the full commitment and participationof the senior management of the beneficiary institution. In addition to providing thetwinning partner with adequate staff and other resources to operate effectively, the seniormanagement must be whole-heartedly involved in the development and implementation ofthe policies and institutional change required to deliver the project results.
