Sunday May 12, 2019 8 STATE TIMES NEWS JAMMU: Congress on Sunday staged protest against the recent remarks of State Governor Satya Paul Malik against former Prime Minister Rajiv Gandhi and blamed the Prime Minister Narendra Modi and BJP Chief Amit Shah of vitiating the politi- cal discourse and demo- cratic culture in the coun- try by introducing politics of personal vendetta and hate for vested political interests. The demonstrators also demanded free and fair probe and stern action against BJP leadership involved in the bribery attempt to journalist in Leh which is serious elec- toral corrupt practice with consequences of disqualifi- cation on the party candi- date. The protestors burnt the effigy of Modi Government and BJP and raised slo- gans against BJP and Satya Paul Malik for vilifi- cation campaign against Gandhi family especially recent utterances against former Prime Minister Rajiv Gandhi, who mar- tyred for the nation 28 years ago and nothing could be proved against him in a long drawn inves- tigations and legal battles. A large number of Congress leaders and func- tionaries of PCC, DCC Urban and Rural, Frontal wings, Corporators of the party led by senior leaders including Vice President and former Minister Raman Bhalla, Mula Ram, Ravinder Sharma, Balwan Singh-Ex MLA, Kanta Bhan, Manmohan Singh, Rajnesh Sharma, Vikram Malhotra, Hari Singh Chib, Manjit Singh, Shabir Ahmed Khan, Shiv Dev Singh Ex-MLA, Indu Pawar Ex-MLA, Ashok Sharma Ex-MLA and other senior leaders. Addressing the protes- tors, senior Congress lead- ers lashed out at the PM Modi and Amit Shah for the lowest level of political discourse and personal attacks on Gandhi family, which has been followed by State Governor Satya Paul Malik. The Governor has to be non-partisan and apolit- ical but Malik has crossed all limits, they said. They blamed the present BJP leadership led by PM Modi and Amit Shah for vitiating the political cul- ture in the country and lev- eling false allegations against Gandhi family out of personal vendetta. They denounced this kind of pol- itics in the country which has a vibrant democracy for the last more than 70 years but never witnessed such kind cheep political discourse against political opponents. Congress protests remarks of Governor against Rajiv Gandhi STATE TIMES NEWS JAMMU: Tada Court on Saturday direct- ed counsel for the CBI to produce copy of order of High Court whereby High Court vacated the stay. The court direction came in a much publicised case of Dr. Rubaiya Sayeed and killing of Air Force personnel. Earlier, the Counsel for the CBI submit- ted that the High Court dismissed the petition filed by Yaseen Malik and others, and vacated the order of stay. Court directed counsel for the CBI to produce the copy and fixed May 21, 2019 for hearing. FIR bearing No. RC 07 (S)/ 1990/SIU.V/SC-II) was registered on the basis of complaint of SHO Police Station Saddar, Srinagar who earlier had lodged an FIR of case under 339 dated December 8, 1989 under Sections 364 and 368 of RPC, Section 3(1) Terrorist and Descriptive Activities (Prevention) Act and 25 Indian Arms Act in Police Station Saddar against unknown accused persons. In the FIR it was mentioned that Dr. Rubaiya Sayeed, daughter of Mufti Mohammad Sayeed, resident of Nowgam District Budgam while going in a Tata mini bus bearing registration No. JKF 697 from Lala-Ded Hospital Srinagar to her house at Nowgam was kidnapped and taken to some unknown place by some unknown terrorists travelling in the same mini bus who threatened to kill her in case their illegal demands were not met with and also created terror amongst all the passengers by showing gun and pistols and on September 18, 1990 the charge sheet in this case was filed by CBI under Section 120-B read with Sections 364, 368, 109 and 34 of RPC, Section 3(1) TADA and Section 27 of Arms Act in the court of 3rd Additional Session Judge (TADA cases Jammu) against the accused persons i.e. Petitioners. During the Course of trial a, petition dated October 25, 2008 in terms of SRO 168 dated May 1, 1990 read with SRO 70 dated February 5, 1991 for transfer of the afore stated criminal case to the designat- ed Court of TADA at Srinagar. Objections to the aforesaid application were filed by the CBI and after hearing both the parties the application was rejected vide order dated April 20, 2009 against the aforesaid order of Trial Court. Thereupon, the peti- tioners approached the High Court of Jammu and Kashmir at Srinagar by way of OWP No. 432 of 2009 dated April 30, 2009 and consequently the High Court stayed the proceedings of the Trial Court. In the killing of five Air Force personnel, an FIR bearing No. RC 01 (S)/ 1990/SIU.V/SC-II) was registered on the basis of complaint of Mohammad Din, Head Constable No. 364/S, Police Post Rawal Pora, Police Station -Saddar Srinagar who has lodged an FIR of case No. 22 dated January 25, 1990 under Sections 302 and 307 of RPC, 3(1) Terrorist and Descriptive Activities (Prevention) Act of 1987 and 3/25 Indian Arms Act in Police Station Saddar against the unknown accused persons. In the FIR, it was alleged that in the morning of Janaury 25, 1990 at about 7:30 A.M when the Air Force employees who were living as tenants in the private house at Rawal Pora had gathered and were wait- ing on the road at Sanat Nagar crossing for Air Force Vehicles to go to their Offices, some unknown terrorists fired with automatic weapons indiscriminately upon them with the criminal intention of killing them as a result of such firing about 40 Air Force employees including a woman were seriously injured while 2 of them died on the spot. The unknown terrorists escaped after firing and the injured were taken by Air Force employees to Badami Bagh Hospital Srinagar for treatment. That the charge sheet in this case was filed by CBJ on August 31, 1990 under sections 120-B read with section 302 of RPC, Sections 3 and 4 of TADA and Section 27 of Arms Act in the Court of 3rd Additional Session Judge (TADA cases Jammu). STATE TIMES NEWS JAMMU: To streamline entire educational system in the State, a deputation of J&K Private Schools Association (PSA) called on Anuradha Gupta, Director School Education Jammu and discussed various issues. The deputation apprised the Director about the difficulties being faced by the private schools while applying all orders and SROs practically in the schools functioning from Class 1st to 12th as there is no check by the gov- ernment in mushrooming of private schools and promotion of dummy classes by the tuto- rials. The members of deputation demanded to establish unifor- mity in the system of educa- tion by adopting similar mechanism for bringing all educational institutions under the ambit of all acts, SROs issued by Education Department, Labour Department, Fee Fixation Committee, etc. The members in the meet- ing demanded immediate ini- tiative by the government to bring equilibrium by granting recognition as per SROs 123 and 292 to all coaching cen- ters, tutorials, Pre -primary schools and play way schools which are left unbridled till date and which charge exorbi- tant fee. They also demanded full and final control to regulate the fee of all educational insti- tutions functioning in the State as per the order issued by the Fee Fixation Committee on January 28, 2019. STATE TIMES NEWS JAMMU: Giving a damn to the slogans of accountability and transparency, the J&K Bank has once again issued a list of qualifying candidates in the preliminary exams for POs in the most mischievous man- ner, said Harsh Dev Singh Chairman JKNPP and former Minister. "It's bizarre to note that dis- trict wise lists of candidates have been prepared for selec- tions to the posts of Probationary Officers, a novel mechanism so far unheard in the banking history of the State," he said. While all the list of officers in all the departments including J&K Bank are issued on State level, a unique phenomenon was adopted by the J&K Bank authorities in the ongoing selec- tion process of POs by resorting to District wise preparation of merit lists of officers, he observed. And intriguingly the names of the Districts were not mentioned, pointed Harsh. The only objective behind the highly scandalous proposition of District level merit lists of offi- cers was to subvert the State level merit list and to thereby confer benefits upon favourites and blue eyed candidates, he alleged. Urging upon the Vigilante organizations to take cogni- sance of the highly opprobrious and irregular practices having been adopted by the J&K Bank, Harsh threatened to launch a full throttle campaign against all malpractices com- mitted in the functioning of the aforesaid bank wherein the gov- ernment held 59 per cent share. He said the J&K Bank had been under a storms eye in the past as well for manipulations and fraudulent practices which however were disregarded due to the patronage of the helms- men. Harsh regretted that no enquiry was held and none made accountable despite the State Governor himself making a statement in the media about the violation of norms and huge backdoor appointments having been made by the said bank. He claimed that district wise lists of POs had been prepared only due to low merit of candidates in Kashmir division who could be brought within the consider- ation zone only by resorting to such gimmickry. The interests of Jammu youth shall not be allowed to be compromised at any cost, cautioned Harsh. Interests of Jammu youth can't be allowed to be compromised: Harsh STATE TIMES NEWS SRINAGAR: The Department of Wildlife Protection and Wetlands, Division Kashmir on Saturday organized a function here at World famous Ramsar Site of Kashmir (Hokersar Wetland Reserve) to celebrate the 'World Migratory Bird Day'. The function was organized in collaboration with the NGO "National Society for the Protection of Water Resources Wetlands and Forests". The aim of the function was to impart the importance of the migratory birds among the masses and the school going children. During the program main emphasis was given regarding the impact of plastic wastes in the Wetlands and the catastro- phe it inflicts in the killing of millions of migratory birds in seas and other water bodies world over. Besides, the partic- ipants were informed about the detrimental role of the plastic pollutants which chocked the in feeding chan- nels of the Wetlands and turned them invalid as an essential abode for the migra- tory birds. Various speakers on the occasion threw light on this year's theme "Protect Birds: Be the Solution to Plastic Pollution!" Stress was given to involve maximum youth on conserva- tion of migratory birds and the Wetlands so that they are con- served and the Wetlands are made plastic free areas. Reacting to the large scale resentment and protests by the aspirants questioning the crite- ria followed and adopted by the bank for a higher level post of Probationary Officer, Sharma said that apparently there appears justification in their protests as why merit alone is not the criteria when the selectees are transferable to any branch of the bank in the country. "These questions need to be answered and entire matter needs to be looked into more particularly when there are already instances of favoritism in the bank highlighted by the Governor himself and the bank authorities always discouraged all efforts to seek transparency in the system," he said. Sharma also questioned the delay in revoking the termina- tion orders of NHM officials and different yard sticks being applied to the similarly situat- ed employees in different dis- tricts of the state. He also questioned the pick and choose method being adopted in the matter when these employees had suspended their agitation on the intervention of the Governor. "They were seeking consider- ation of their genuine demands having served the government for several years since the launch of the NHM scheme in the year 2005. The govern- ment has acted in a very harsh and arbitrary manner and has adopted different yard sticks in each district in the matter of their reinstatement," he added. Congress urged the Governor's administration to remove injustice and ensure fairness in the matter. Court rejects bail of Gulati brothers STATE TIMES NEWS JAMMU: First Additional Sessions Judge Jammu Y P Kotwal on Saturday rejected the bail application of Gulati brothers allegedly involved in a fraud case. The Court after hearing Senior Advocate Sunil Sethi with Advocate Vishal Mahajan for the applicant whereas APP Ajay Singh Manhas with CPO Crime Jawaid Ahmed Khawaja for the Crime Branch and Advocate M.K Raina for the complainant observed that Court do not see any change in circumstances except filing of Challan, as such the application filed by the applicants is not maintain- able and dismissed the same. The Court rejected the bail plea of Sandeep Gulati and Shailendra Gulati booked in Rs 12.90 crore fraud case. Gulati brothers were arrest- ed on November 22, 2018 by the Crime Branch. Earlier, their bail plea was rejected by the High Court of J&K on December 31, 2019. After the filing of the charge- sheet by Crime Branch, the Gulati brothers again filed bail plea in the Court of Sub Judge Jammu and the same was rejected on February 21, 2019.

Rawal Pora, Police Station -SaddarSrinagar who has lodged an FIR of caseNo. 22 dated January 25, 1990 underSections 302 and 307 of RPC, 3(1)Terrorist and Descriptive Activities(Prevention) Act of 1987 and 3/25 IndianArms Act in Police Station Saddar againstthe unknown accused persons. In the FIR,it was alleged that in the morning ofJanaury 25, 1990 at about 7:30 A.Mwhen the Air Force employees who wereliving as tenants in the private house atRawal Pora had gathered and were wait-ing on the road at Sanat Nagar crossingfor Air Force Vehicles to go to theirOffices, some unknown terrorists firedwith automatic weapons indiscriminatelyupon them with the criminal intention ofkilling them as a result of such firingabout 40 Air Force employees including awoman were seriously injured while 2 ofthem died on the spot.

The unknown terrorists escaped afterfiring and the injured were taken by AirForce employees to Badami BaghHospital Srinagar for treatment. Thatthe charge sheet in this case was filed byCBJ on August 31, 1990 under sections120-B read with section 302 of RPC,Sections 3 and 4 of TADA and Section27 of Arms Act in the Court of 3rdAdditional Session Judge (TADA casesJammu).

Bank has once again issued a

list of qualifying candidates in

the preliminary exams for POs

in the most mischievous man-

ner, said Harsh Dev Singh

Chairman JKNPP and former

"It's bizarre to note that dis-

trict wise lists of candidates

have been prepared for selec-

tions to the posts of

Probationary Officers, a novel

mechanism so far unheard in

the banking history of the

State," he said.

While all the list of officers in

all the departments including

J&K Bank are issued on State

level, a unique phenomenon

was adopted by the J&K Bank

authorities in the ongoing selec-

tion process of POs by resorting

to District wise preparation of

merit lists of officers, he

observed. And intriguingly the

names of the Districts were not

mentioned, pointed Harsh. The

only objective behind the highly

scandalous proposition of

District level merit lists of offi-

cers was to subvert the State

level merit list and to thereby

confer benefits upon favourites

and blue eyed candidates, he

alleged.

Urging upon the Vigilante

organizations to take cogni-

sance of the highly opprobrious

and irregular practices having

been adopted by the J&K

Bank, Harsh threatened to

launch a full throttle campaign

against all malpractices com-

mitted in the functioning of the

aforesaid bank wherein the gov-

ernment held 59 per cent share.

He said the J&K Bank had

been under a storms eye in the

past as well for manipulations

and fraudulent practices which

however were disregarded due

to the patronage of the helms-

men.

Harsh regretted that no

enquiry was held and none

made accountable despite the

State Governor himself making

a statement in the media about

the violation of norms and huge

backdoor appointments having

been made by the said bank. He

claimed that district wise lists

of POs had been prepared only

due to low merit of candidates

in Kashmir division who could

be brought within the consider-

ation zone only by resorting to

such gimmickry. The interests

of Jammu youth shall not be

allowed to be compromised at

any cost, cautioned Harsh.

The function was organizedin collaboration with the NGO"National Society for theProtection of Water ResourcesWetlands and Forests".

The aim of the function wasto impart the importance ofthe migratory birds among themasses and the school goingchildren.

STATE TIMES NEWSJAMMU: JKPCC ChiefSpokesperson RavinderSharma expressed serious con-cern over the resentmentamongst the candidates follow-ing the declaration of theresults for the post ofProbationary Officer in J&KBank and urged the Governorto immediately look into thematter.

Reacting to the large scaleresentment and protests by theaspirants questioning the crite-ria followed and adopted by thebank for a higher level post ofProbationary Officer, Sharmasaid that apparently thereappears justification in theirprotests as why merit alone isnot the criteria when theselectees are transferable toany branch of the bank in thecountry.

"These questions need to beanswered and entire matterneeds to be looked into moreparticularly when there arealready instances of favoritismin the bank highlighted by theGovernor himself and the bankauthorities always discouragedall efforts to seek transparencyin the system," he said.

Sharma also questioned thedelay in revoking the termina-tion orders of NHM officials

and different yard sticks beingapplied to the similarly situat-ed employees in different dis-tricts of the state. He alsoquestioned the pick and choosemethod being adopted in thematter when these employeeshad suspended their agitationon the intervention of theGovernor.

"They were seeking consider-ation of their genuine demandshaving served the governmentfor several years since thelaunch of the NHM scheme inthe year 2005. The govern-ment has acted in a very harshand arbitrary manner and hasadopted different yard sticks ineach district in the matter oftheir reinstatement," he added.

JAMMU: First AdditionalSessions Judge Jammu Y PKotwal on Saturday rejectedthe bail application of Gulatibrothers allegedly involved ina fraud case.

The Court after hearingSenior Advocate Sunil Sethiwith Advocate Vishal Mahajanfor the applicant whereas APPAjay Singh Manhas with CPOCrime Jawaid AhmedKhawaja for the CrimeBranch and Advocate M.KRaina for the complainantobserved that Court do not seeany change in circumstancesexcept filing of Challan, assuch the application filed bythe applicants is not maintain-able and dismissed the same.The Court rejected the bailplea of Sandeep Gulati andShailendra Gulati booked inRs 12.90 crore fraud case.

Gulati brothers were arrest-ed on November 22, 2018 bythe Crime Branch.

Earlier, their bail plea wasrejected by the High Court ofJ&K on December 31, 2019.

After the filing of the charge-sheet by Crime Branch, theGulati brothers again filed bailplea in the Court of Sub JudgeJammu and the same wasrejected on February 21,2019.
