NYS DEC against owner, 1984 through 1992; illegal fill, clearing, grading and bulk heading; found guilty and ordered to restore, remove and pay fine; no immediate action.

• NYS Supreme court in 1990 which was combined into the federal lawsuit.

United States District Court, Eastern District 1989 thru 2002. United States Court of Appeals January 13, 2002 upheld the

judgment of the Eastern District Court of 3/31/98 finding the defendants guilty of violating the Clean Water Act and ordered to restore filled areas; no immediate action

NYSDEC in 2008; guilty of dumping raw sewage • 2009, leases terminated, eviction/demolition; property assigned

to NYC DCAS

Broad Channel Civic Association led effort to have area deeded to NYC Parks.

Worked thru Councilman Ulrich’s office to have transferred to NYC Parks in 2009

BCCA passed unanimous resolution in February of 2010 endorsing wetlands restoration, upland forest, walking trails, boardwalk plan.

BCCA plan submitted to NYC PARKS RFEI—only plan submitted
