QUESTION: Do you swear to tell the truth in this investigation?ANSWER : Yes ma’am.

Q.01: Before we proceed, kindly state your name, age and other personal circumstances?Ans : I am LEONIDA TAMBLING y BASIBAS, 51 years old, married, farmer, high school as to my highest educational attainment and a resident of Modayan, Loo, Buguias, Benguet.

Q.02: Why are you here at this ward of this hospital?Ans : I am here to be cured of my sustained injury ma’am.

Q.03: Who inflict said injury on your person?Ans : My husband OSIAS TAMBULING ma’am.

Q.04: When and where did your husband OSIAS inflict injury to you?Ans : At around 6:00 in the evening of 12 November 2013 inside our house thereat Modayan, Loo, Buguias, Benguet ma’am.

Q.05: What was the reason did he inflict injury to you?Ans : Because I scolded him for being drunk for almost a week. Instead on heeding on what I’m he get mad ma’am.

Q.06: By the way, how did he inflict your injury to you?Ans : He threw to me the pot cover ma’am.

Q.06: Will you narrate briefly?Ans : While on a heated argument because of scolding him for continuously drunk, I noticed him already clinch his fist prompting me to go out. When I was about to leave the premises, he got the pot cover and threw to me hitting me on my head.

Q.07: After you were hit, what happened next?Ans : I noticed my younger sister came to my rescue and brought me at this hospital ma’am.

Q.08: Was this the only time your husband injured you?Ans : No ma’am, he always inflicts injury on me every time his drunk.

Q.09: Did you report to anybody the previous injury you he inflicts on you?Ans : No ma’am not even to my relatives.

Q.10: Why did you not report the incident?Ans : Because I’m thinking he will repent soon ma’am.

Q.11: Can you recall the times when your husband inflicts you injury?Ans : Yes ma’am, on the eve of 11 November 2011, he nearly stabbed me but I was able to run. On the other occasions I can’t recall because since the year of our marriage on 1999, he is already physically abusing me.

Q.13: By the way, is any one present when he injures you this last occasion?Ans : Our 12 year old son ma’am.

Q.12: Meantime I have more questions to ask, do you want to add more?Ans : Want to add that on the latter year while on a heated argument, he utters hurting words to me to quote; “ Engay nabakes ka yan inasawa nika pylng. Unina koma no mistiza ka” and he insist that we will separate.

JOINT-AFFIDAVIT

WE, the undersigned Police Officers, all of legal ages, married, bonafide members of the Philippine National Police assigned with the Buguias Municipal Police Station, Buguias, Benguet after having been duly sworn to in accordance with Law, hereby say the following to wit; THAT:

1. While on official duty, ZENAIDA GUIMAWA y BASIBAS, 42 years old, married, government employee and a resident of Loo, Buguias, Benguet reported this office that her elder sister, LEONIDA TAMBULING, was physically abused by her husband and was rushed at the Lutheran Hospital, Abatan, Buguias, Benguet;

2. Reporter further averred that she feared as to something else to happened because her younger brother were so mad upon knowing the incident and that they might harm their brother-in-law;

3. With the information received, personnel this station led by SP01 JOSEPH AGUSDAN in the company of the reporter proceeded at the place of incident to invite the victim;

4. Upon reaching the area, responding personnel, led by the reporter, entered the residence wherein suspect was seen in the living of room of their residence;

5. I, affiant HONORIO LAMPACAN, immediately apprised the suspect of his constitutional rights and explain the nature why he is being invited for investigation;

6. Suspect was then identified as OSIAS TAMBULING y CAYAT, 42 years old, a native of Sayangan, Atok, Benguet;

7. After which, he was brought at the Buguias Municipal Police Station and a case of Violation of RA 9262 was being readied for filing against him;

That we are executing this affidavit to attest to the truthfulness of the foregoing and to support the complaint of LEONIDA TAMBULING y BASIBAS against her husband, OSIAS TAMBULING y CAYAT that may arise within the premises.
