NOTICE OF TIMBER SALE Sylvia Adcock Tract Lee County, NC 115 +- Timbered Acres Tract Description: The Sylvia Adcock Tract, located in Lee County, NC, is a fantastic up-and-coming stand of timber with significant volumes. An array of wood products, from pulpwood, hew wood, chip-n-saw, & other small saw timber products will need to be extracted to once again improve stand growth rates. Great access is provided by way of the Adcock Farm off of Garner Rd. At least one loading deck from the previous 1 st thinning will be available for use during the harvest. Due to terrain and topography limitations, the use of firebreak will be limited to specific areas to be discussed and agreed upon prior to the commencement of logging activities. Solid access to the primary deck site has been mechanically improved in recent days. Any secondary deck sites and use of firebreak must be approved beforehand. Any approved areas will be inspected prior to the completion of logging to ensure they have been left in as good or better shape than before logging began. In some areas trees have been painted orange for harvest. No Hardwood Trees are to be harvested. Type of Harvest: Stand Improvement-Operator Select 2 nd Thinning to a more desirable basal area of 80. Due care should be taken to remove inferior, damaged, or dying wood products. Special Considerations – Routine Inspections will occur at random to ensure that the basal area is kept at or above the specified mark of 80. Cameras will be installed to record ingress, egress, and logging activities. A log book must kept up to date on site with each load of wood products classified before leaving the deck and subsequently verified by the ticket from the respective mill as such. In the event that we feel the stand is being depleted or degraded , logging will be stopped immediately and the performance bond and timber contract can and will be terminated, if after a period of mediation, it is deemed necessary to preserve the integrity of the landscape and the residual stand of timber. Sale Type: Per Ton/Per Unit Sealed Bid - An earnest money deposit will be required of the successful high bidder. A $1,000.00 performance bond will be required along with a pre-harvest meeting to discuss logging and harvest requirements. Performance Bond will be held by American Timber Services, LLC in an escrow account. The landowners reserve the right to reject any and all bids.

Tract Description:

Tuesday, August 5th at 12:00 PM - Sealed bids will be opened on the Adcock Farm at the access point off

of Garner Road, illustrated on the provided map. Call-in bids or faxes will be accepted until 11:00AM on the day of the sale. Faxes should be sent to (910) 245-2554 with a follow up call to Jim Pruett @ (910) 783 - 6277 Call-in bids should be directed to James Hunsucker @ (910) 690-9848.

Time Limit of Cutting Contract:

18 months from the date of sale will be allowed to harvest said trees and timber. Due consideration will be granted to companies who can begin the harvest process immediately. American Timber Services, LLC reserves the right to halt all logging activities due to wet weather with high soil rutting, which will be determined by the Seller(s) and/or American Timber Services, LLC. An extension of the contract would be granted under these restrictions.

CONDITIONS OF THE SALE: A. The Buyer Agrees to the Following:

1. Maintain all logging activities within the sale boundaries. Property lines, “out” areas, streamside management zones, and other areas of significance throughout the forest have been flagged with high visibility flagging and/or painted.

2. Forestry Best Management Practices (BMPs) and Forest Practices Guidelines (FPGs) must be implemented while logging. Road construction must be approved by the Seller(s) and/or its American Timber Services, LLC. Amassed soil from road construction or wet weather skimming must be returned to roads when harvest process is complete. Buyer is responsible for all construction, gravel, erosion control, water bars, and straw and grass application on SMZ crossings and erodible areas within the tract.

3. SMZ crossing must be approved by Seller(s) and/or American Timber Services, LLC and must be debris free, grassed and covered with straw at harvest completion. Again, buyer is responsible for all state compliance under BMPs and FPGs.

4. “Trucks Entering Highway” signs are required in both directions from the tract access point(s). NO EXCEPTIONS!

5. All timber and cutting rights will revert back to the landowners when timber harvesting is complete regardless of Timber Deed contract period.

6. Any reserved tree cut or severely damaged will be charged to Buyer at triple the stumpage value, but not less than $100.00 per tree.

7. All trash and litter must be kept within containment holders and removed on a weekly basis with all materials removed at end of harvest.

B. The Seller Agrees to the Following: 1. Guaranteed title to the forest products covered within this notice and to warrant the title against all claims at their

expense. 2. To grant ingress and egress to said lands for the Buyer and their agents or assigns.

C. Any Published Volumes are meant as a guide only and are not guaranteed in any fashion. Bidders are responsible for their own cruises and bid volumes. Again, the sellers reserve the right to reject any and all bids.
