I. The Financial AJviser (Works) pointed out that he had listed the following

Lahore".b) The Housing Foundation had to invite quotations in connection with the

printing of brochures for the Lahore Scheme.c) The Annual Profit was indicated as 16.3% in line-1 at page-1 0 of the said

minutes in Additional Agenda [tern :;0.1, whereas it was required to be

indicated J.S 16.5%.

i. The Committee ~cepted the clarifications made by the Director General, Housing

foondationand confirmed the ".:nutes of its 41 st meeting held on 13. 10.1994

The Director General, Housing Foundation briefed the Committee about the

positionof handing over of houses and communication of cost of completed houses to the

respectiveallottees. The committee was also informed that after the issuance of notice to the

allotteesthat thcir hOllses would be auctioned if they did not clear their dues by 15.12.1994, the

responsefrom the allottees towards clearance of dues and taking over of houses was quite

~tisfactory. However, after the filing of petition by some allottees in the Supreme Court of

Pakistanthat the possession of rhe houses should be given by the Housing Foundation to the

allotteesnn the basis of costs given in the brochure suhject to final settlement of accounts and

pendingadjudication of the petition and passing of the interim order by the Supreme Court in

ceaseon 11.12.1994, that the status quo be maintained till the matter is placed in Court, the

DCessof clearance of dues anJ handing over of houses had slowed dov,TI considerably. The

mmitteewas further informed that till date 823 houses had been handed over to the allottees.

donot clear their dues within the notice period, the above mentioned additional charges may be

leviedon them after the expiry of the notice period. In case of those allottees who failed to clear

made according to the schedule of paY:-:1ent based on different stages of progress of v;ork. The

payment were initially made in ter:ns of percentage of the accepted lump sum cost of each unit

as stipulated for various stages of progress of \vork.

13. The contractors in earlier stages of work expressed certain difficulties regarding

payments on the basis of the scr.e<:iule of p3yment as stipulated in the contract. The matter v,'as

reviewed by the Director GeneraL Hocsing found3tion, in consultation v:ith the Consultant and

the Contractors on 15,1.1992 and a re\'ised procedure for payments on detailed measurement basis

in respect of each item of the BOQ actually executed at site was agreed. The revised procedure

was notified to all the contractors by the Consultant on 16.1.1992. In practical terms, the nature

of the contract was changed from lump sum to item-wise detailed measurements. Since then all

the running payments had been made on the basis of detailed measurements of each item of work

as actually executed at site.

14. The Director General, Housing foundation drew attention of the Committee

towards certain contradictions in the \arious clauses of the Contract dealing with quantification

of the work done at site as per BOQ and variations/modifications desired by the allottees and

evaluation thereof. for example clause 14.1 of the General Conditions of Contract stipulates:-

"The Quantities set out in the Bill of Quantities are the estimated

quantities of the work but should there be variation in the actual

quantities of the works executed by the Contractor in fulfillment of

his obligations under the Contract, beyond five percent plus or

minus (=:5%), the difference in quantities shall be adjustable on the

accepted quoted rates."

Director General. EJusi:<g Foundation. further informed that the extent of\ariation

was applied in almost 47% of t:::e hOL:ses \\hich changed the concept of project from "repeated

nature of construction" to "indi'\icual construction catering for the indi\'idual needs/option" to a

large extent. Under the circumst2.l'lces if the lump sum nature of the contract was retained and

C:t5%) of the BOQ quantities adjL:Sted in the final bills of the contractors, the same may lead to

an anomolous situation as the cOIltractors had been paid on measurement basis in respect of the

quantities of \vork actually execu:ed at the work sites,

16.After detailed deliberations, it was decided that the issue may be considered by the

Technical Committee headed by the Director General, Pak PWD and 1'.1r. S. P. Chohan,

Managing Director, NeL, may also be co-opted as its member. The recommendations of the

Technical Committee would be put up for consideration of the Executive Committee in its next

meeting.

Agenda Item No.5:EXTENSION OF CONSliL TANCY AGREEMENT OF l\'1/S DEVELOPMENT

CONSULTANTS.

Director General, Housing Foundation, informed the Committee that an agreement

for full time site supervision of houses was initially made with MIs Development Consultants for17.

iv) Monitoring of punch list items by the Contractors and e\'aluation of theircost for rer.lnd to the allottees, if not attended within the sprcified notceperiod.

v) Proccessing of interim bills of the contractors.

Agenda Item NO.6:HOUSING SCHEME FOR :\I~AS, JCDGES, CIVIL SERVANTS A~D JOUNALISTSETC., IN SECTOR G-13, ISL~\IABAD (PHASE-III).

21. Director General, Housing Foundation, apprised the Committee of the progress

made so far in connection with la'.-:l1chingof Housing Scheme for ;\1NAs, Judges, Civil Servants

and Jounalists etc., in sector G-13, Islamabad (Phase-III). It was informed that Deputy

Commissioner, Islamabad, had since been approached to initiate action for acquisition of land in

sector G-13, Islamabad. The matTer had been pursued \vith the Assistant Commissioner! District

Collector, Islamabad, to prepare the follov.:ing documents required for the issuance of notification

under section-4 of Land Acquisition Act, 1894.

Agenda Item No.8:THE BUDGET ESTIMATES FOR THE YEAR 199.t-95 AND REVISED ESTIMATESFOR THE YEAR 1993-94.

Estimates of the Housing Foundation for the year 1994-95 \vere prepared in consultation with

Financial Adviser (Works). The Committee went through the Budgetary Estimates and approved

the same.

28. Director General, Housing Foundation, informed the Committee that the Buget

31. Mr. Jan Alam being a civilian employee of Ordnance Depot, Nov/shera was not

eligible to participate in Phase-I of the Housing Scheme. He did not formally apply in Phase-II

., when the civilian employees paid from Defence Estimates were made eligible to participate. He

was advised on 24,11.1993 and again on 13,12.1993 to take refund of his deposits but he did not

do so, He filed a complaint in the Wafaqi Mohtasib's Secretariat which recommended to place

the said case before the Executive Committee for its consideration, The Committee, after on

indepth examination of the case, did not agree to the plea of the applicant for allotment of a

category-III house/plot in Phase-II.

38. It was brought :0 :hc :-'lotice of the members that a similar proposal previously

date of birth of the applicant 'X2.S -+.1.1930 and his case as a retired applicant was not likely to

mature for allotment on the basis of age-wise seniority even if he had formally applied in Phase-

II. The Committee, therefore, G:d not agree to consider his request for allotment of a house in

preference to the fresh appl ic2...its 0 f Phase- 11.

39. Joint Secretary (Cabinet) pointed out that the sufficient notice period was not given

to the members to prepare themselves properly in view of heavy agenda for the meetings. The

Chairman, directed that in future the Agenda and 'Working Papers for the meeting may be

circulated among the members at least 7 days before the convening of the meeting.
