    Ambassador George L. Argyros was sworn in as U.S. Ambassador to Spain and Andorraon November 21, 2001 andpresented hiscredentials to King Juan Carlos I on December13, 2001.Until his appointment, Ambassador Argyros was Chairman and Chief Executive Officer ofArnel & Affiliates, a prominent US West Coast diversified investment company, withcorporate offices located in Costa Mesa, California. He was also a General Partner inWestar Capital, a private investment company. From 1981-1987, he was co-owner ofAirCal and from 1981-1989 he was owner of the Seattle Mariners Baseball Club of theAmerican League for nine full seasons.Prior to his appointment, Mr. Argyros was a member of the Board of Directors forRockwell International Corporation (NYSE); First American Corporation (NYSE); DSTSystems, Inc. (NYSE); The Newhall Land and Farming Company (NYSE); Tecstar;Doskocil Manufacturing Company, Harper Leather Goods, Inc., and Verteq, Inc.Ambassador Argyros formerly served as a member of the Advisory Committee for TradePolicy and Negotiations for the U.S. Trade Ambassador, resigning that position in 1990,when President Bush appointed him to the board of the Federal Home Loan MortgageCorporation (FreddieMac). He completed his term on the FreddieMac Board in March1993.From 1976 to 2001 he served as Chairman of the Board of Trustees of ChapmanUniversity, one of the West's finest private universities.     Bob Kerrey, Baltasar Garzon, human rightsand justice

    Blanca GarzaPut Bob Kerrey and Baltasar Garzon side by sideand the concept of justice looks almost absurd.In fact, the two stood side by side when NewYork's New School President Bob Kerrey handedout an honorary degree to Garzon in August2002. Indeed the Vietnam veteran and formerDemocratic senator for Nebraska, Bob Kerrey,and the former Spanish Secretary of State forsecurity affairs and Interior Ministry official,magistrate Baltasar Garzon, have a lot incommon. Both were politicians who claim to havea personal interest in global justice and theprotection of human rights. Both were decoratedfor serving their country. Bob Kerrey wasawarded Bronze Star and the CongressionalMedal of Honor for his service in Vietnam. Garzonreceived the Silver Cross to Police Merit from theSpanish Interior Ministry. Both lovers of justicehave skeletons in the closets that have beenuncovered but now reburied as they cash in onthe "war against terror".In April 2002,Bob Kerrey wasthe singlespeaker on"Terrorism" at the'InternationalJustice, WarCrimes andTerrorismConference' inNew Yorkorganized by Dr. Arien Mack, Editor of SocialResearch journal, and sponsored by the NewSchool University. "We are defining terrorism asacts of violence against innocent civilians, whichmay or may not be part of an officially declaredwar," said Dr. Mack, Marrow Professor ofPsychology at the Graduate Faculty and director

Gerhard Klann, the mostexperienced of his squad, asserts that their teamrounded up the vict ims and shot them down incold blood. Klann said that after they firedcontinuously for a time, the SEALs stopped,heard a baby crying in the mass of bodies, andunleashed another lengthy fusillade. When Kerreyand his troops first approa ched the vi l lage, theycame across a nother hut occupied by five people--a n elderly man and wo man and three childrenand murdered them al l by stabbing themrepeatedly and cutting their throats.Bo b Kerrey bam boozled his 'fellow Americans' -he still does - representing himself as havingbecome an opponent of the Vietnam w ar . Reed- to point out that Bob Kerrey "was awa rded theBronze Star for his role in that war, and thecitat ion justifying his meda l credits him withhaving ki lled twe nty-one Viet Co ng. He neitherrejected nor returned the medal; nor did hecorrect the lie about whom he had killed.     recruited b y Felipe Go nza lez, the form er SocialistPresident.Baltasar Garzon was Secretary of State fo rsecurity affairs, and junior Interior Minister withthe Socialist government that organized, fundedand directed the death squads known as GAL--which murdered at least 28 people and woundedmore than 100 between 1983-94 in a Dirty Waron the B asque ETA and the liberation movem ent.Garzon told the Mad rid daily El Pais in a 2001interview: "The only thing I demanded [fromFelipe Go nzalez] was to be number tw o" in theSocialist party's Madrid list for the 1993 nationallegislative elections. Ga rzon cam e in second invotes, behind only Gonzalez and served in theSpanish Cortes, the legislature's lower house.Garzon denies that Felipe Gonzalez promised himthe newly set up Interior and Justice M inistry. Butafter the 1993 legislative elections, whenGonzalez named another judge, Juan AlbertoBelloch, bi-Minister of Interior and Justice andpu t Garzon in charge of anti-drug projects,Garzon quit to return to the National Court. Therehe brought criminal charges agains t a number ofgovernment officials, close associates ofGonzalez, and reopened his old GAL case, whichhe himself had left hidden in his very owndrawers at the court.Baltasar Garzon says that he didn't know theSocialist government or his former boss FelipeGonzalez were behind the GAL death squadswhen he was a member of Gonzalez's team. ButGarzon had met and he admitted it withformer senior Spanish policemen MichelDominguez before he chose to run for electionswith the Socialists in 1993. Dominguez ha d toldGarzon (El Pais, 29 July 2001) that thegovernment of Felipe Gonzalez was behind theGA L death squads and that he and Amedo ha dbeen paid from the Interior Ministry's secret fundto secure their silence. This was found to be truewhen twelve men, among them tw o seniorgovernment Ministry officials and 10 senior policeofficers were convicted in 1999 for involvementin GAL, planning a murder, kidnapping, andmisuse of millions of dollars in secret governmentfunds used to pay mercenaries, bribe the Frenchpolice or buy silence from witnesses.Moreover, in 1988, when Garzon wasinvestigating the GAL case, he wrote a "bottom-up" hierarchical diagram of GAL and placed an X

    at the top. It was a "public secret" that caused amedia frenzy: the X was President FelipeGonzalez. The Spanish police and paramilitaryCivil Guard involved in GAL received orders fromthe Interior Ministry. The Spanish secret serviceagents and the military officers involved in GALreported to the Defense Ministry. It is difficult toimagine that the two ministries that directed theGAL would do it without the knowledge, let aloneapproval, of their chief, President FelipeGonzalez.Journalist Maria Antonia Iglesias, in her El Paisintervjew of 2001, asked Baltasar Garzon toughquestions. She asked him directly "are you stillconvinced that Felipe Gonzalez was, in one wayor another, the X of GAL?" . Garzon responded bydenying that he knew who the X was when hewrote the diagram in 1988. However, in thatsame interview Garzon said that in 1995 (oneyear after he had quit the Socialist party) heasked the Supreme Court to question Gonzalezon the GALdeath squads. Garzon told Iglesiasthat Felipe Gonzalez lied when he told theSupreme Court that he and Garzon had discussedthe GALwhen Garzon was a member of his team.And so, before you knew it, the former memberof Gonzalez's team was a "superjudge" for hiscourage pursuing corrupt politicians - exceptGonzalez -, drug lords and arms dealers.Garzon's diagram, along with his past politicalhistory, slipped down the same memory hole.Garzon's fame went worldwide with his moves tobring to justice Chile's ex-dictator AugustoPinochet and other South American tyrants. InSeptember 1996, Garzon turned his attention to320 unsolved murders and disappearances ofSpanish citizens during the dirty war in Argentinafrom 1976-83.So, we need to forget, too, that it is safe forGarzon to investigate foreign criminals but unsafeto investigate domestic killers and genocide. Thisis the case of Franco's disappeared which Spanishjudges, including Garzon, and the Spanishgovernment have failed to investigate.In August 2002, the same month in which Garzonwas awarded an honorary degree by the NewSchool, relatives of the disappeared after beingarrested by Francisco Franco's fascist forces tooktheir case to the United Nations. Theirgovernment, and Spanish judges, had refused to

    start the search for the bodies of more than30,000 people believed to have been summarilyexecuted by Franco's followers and buried inmass graves.Why hadn't Baltasar G arzon investigate Franco'sdisappeared? W hat happened to the fam ousjudge on his supposedly worldwide mission toinvestigate war crimes a nd genocide? That hehad made no effort to investigate Franco'sdisappeared and kept silent about it is deeplydisturbing."This is like the victims of Pinochet in Chile orthose of Videla in Argentina," Santiago Macias ofthe Association for the Recovery of HistoricMemory said. The campaigners say that thesuccessive Spanish governments havedeliberately ignored the problem of thosedisappeared, despite the pleas of relatives whowant to give their loved ones a decent burial. Incontrast, they say, the government of PrimeMinister Jose Maria Azna r earlier this year madeavailable millions to exhume and repatriate fromRussia the corpses of several Spanish volunteersfrom the Division Azul (Blue Division)-a militarygroup that was sent by Franco as a token of hisfriendship for Adolph Hitler and to support Nazitroops during the S econd W orld W ar.The graves are dotted all over the S panish stateand their existence ha s been known to Spanishpeople for over 60 years. They are reported tocontain the remains of more than 30,000republican soldiers, militants and otheropponents of Franco like the Basques (in residualNavarre alone, more than 3,000 people wereexecuted) and the Ca talans. The victims wereeither captured or detained during the Spanishcivil war and executed later, or were summarilyexecuted by Falangists or Francoist troops in thedays and months immediately after the war.Their bodies were flung into hurriedly dug gravesby the roadside, at the bottom of cliffs or in themiddle of fields. Some were grabbed; otherswere persuaded to give themselves up afterbeing assured that nothing would happen tothem if they did so.Garzon made a big issue of the Chileandisappeared at the time military dictator AugustoPinochet was charged and arrested while he wasin London. But it is difficult to imagine that he didno t know of the existence of these graves in hisow n country, as a leading member of the

    judiciary and the Socialist government of 1982-96. For this is the proof that Garzon is notmorally worthy of prosecuting foreign criminals.Last but not least, Garzon would like us to forgethis notion that in Spain's conflict with theBasques only Spanish lives and suffering count.In his dramatic speech at the New School,Garzon said he had come to New York with abroken heart "also because my country, Spain,has been suffering for the last 30 years theconsequences of an especially cruel form ofterrorism that has destroyed thousands ofhouseholds and families."But only a heart of stone could not respond tothe testimonies of hundreds of Basque detaineesheld incommunicado that have denounced torturein front of National Court magistrate BaltasarGarzon. Instead, Garzon, as well as otherNational Court magistrates, have chosen not tocall for investigations about those allegationsand, instead, have remained deathly silent.Fo r Garzon's sake, it is essential to forget this fortwo reasons. Firstly, because this conspiracy ofsilence has been broken by human rightsorganizations in and out of Spain. In June 2000,AI published a report urging the Spanishauthorities "to revoke immediately the lawsunder which ET A suspects can be heldincommunicado for up to five days with accessonly to officially appointed lawyers, subject tospecial restrictions". It also recommendedabandoning the practice of incommunicadodetention and that of blindfolding and hoodingdetainees. In January 2001, AI stated, "TheSpanish government must put an end to thefavorable treatment handed out to those who killan d torture on behalf of the state. Anything lessmakes a mockery of Spanish law".Secondly, because in the Spanish judicial systemBasques are guilty until proven innocent. Garzontold the New School audience that "No crime, nomatter how terrible its consequences may be,ca n justify the implementation -or of dubitablelegality- policies that violate the perpetrators'human right". Obviously he was not referring toSpain's anti-terrorism legislation or his ownjudicial orders.When the Popular Party came to power in 1996,Garzon became a valuable collaborator of the

    government of Jose Maria Az nar against theBasque ETA and the liberation movem ent. Ga rzonshut down the Basque newspaper Egin and itssister radio station Egin irratia, Ardi Beltzama gazine, banned grassroots groups and jailedjournalists and members of civil rights groups.On August 26 , 2002, Garzon suspended theactivities of the pro-Basque independence partyBatasuna fo r three years (which can be extendedto f ive) saying it had committed "crimes againsthumanity" along with ETA.Javier Perez Royo, a professor of ConstitutionalLaw at Universidad de Seville, in one of theboldest statements in recent Spanish academia,wrote (El Pais, 29 August 2002) that "Thedivision of powers of the Constitution is beingignored in persecuting Batasuna. Everything isval id against Batasuna; the legislat ive measuresof doubtful legality and judicial orders seem morelike the writings of an Interior Ministry officialrather than the decisions taken by anindependent branch of government".Professor Perez Royo rightly says that Garzon'sorder closing Batasuna is "the world upsidedown". Garzon "investigates th e criminalactivities of a group of citizens who do not holdany positions in the Batasuna party. He requestsand receives a report from the Civil Guard withno reference whatsoever to the citizens he isinvestigating, but in which [the police] state thatBatasuna is ETA. Based on this report, he madethe decision to close Ba tasuna , independently ofthe penal responsibility its leadership may have.And then he proceeds to ask that the UCI shoulddetermine who are and have been the membersof the party's national board and which of themhave parl iamentary immunity so that he maybring charges against them."There is more at stake here than either BobKerrey's atrocit ies in Vietnam or Baltasa rGarzon's role in Spa in's state terrorism. The U.S'and Spain's imperialist wars persist. The US waraga inst a total populat ion persists in Am ericanforeign policy, as the Gulf War and inhumanesact ions against Iraq demonstrate all too clearly.Spain's oppression of the Basques persists sinceNavarre, a former Basque state, was invaded,occupied, and pacified, again and again, byCastile, and turned into a n addit ional Spanishprovince in 1842.Long- t ime peace activist an d found ing m e m b e r of
