    CIVIL AVIATION SECURITYThe Committee recommends $144,328,000 fo r civil aviation security, the same as the budget estimateand an increase of $5,686,000 (4.1 percent) above the fiscal year 2000 enacted level.The Co mmittee is extremely disappointed over management issues which continue to plague the civilaviation security program. Many of these issues have been unresolved for some time. For example:

    Although F A A h as paid for, an d assisted in, the deployment of advanced securitytechnologies such as explosive detection systems (EDS) and computer-based training aids,th e agency continues to allow industry to underutilize these systems with impunity. Eventhough Congress required air carriers to certify in fiscal year 1999 that usage rates werebeing increased, the IG found that the increases in that year were largel y insignificant, an dthat bu lk EDS systems are still taking a ful l day to screen as many bags as these machinesare capable of screening in an hou r. This low u tilization rate affects the proficiency ofscreeners, who continue to have high failure rates in FAA tests. I n response to Congressional and departmental criticism that EDS systems w ereunderutilized, F A A agreed in 1998 to conduct a study to determine the minimum utilizationrates needed to maintain operator proficiency. However, the study was never conducted.Although recommended by the Gore Commission and mandated by Congress in 1996,FA A has stil l not promulgated a rule requ iring the certification of baggage screeningcompanies. F A A has not modified its background investigation requirements for access to secureairport areas, even though access control has been a major problem at our nation's airports;and F A A has failed to dev elop a strategic plan for pu rsuit of its civil aviation securityprogram, even though the Inspector G eneral recommended such a plan in 1998.

    The Committee has provided substantial budgetary increases fo r F A A 's civil aviation security programover th e past fe w years, and is unsu re whether these additional resources are paying off in significantlyimproved security. The Comm ittee is relu ctant to redu ce these appropriations, bu t expects the F A A toaddress the recommendations of the Inspector G eneral and the General A ccounting Office expeditiously.

    Payments to Air Carriers(AIRPORT AND AIRW AY TRUST FUND)In addition to funds made available from any other sou rce to carry out the essential air serviceprogram under 49 U.S.C. 41731 through 41742, $52,100,000, to be derived from the Airport and

    Airway Trust Fund, to remain available until expended.TRANSPORTATION SECURITY ADMINISTRATIONAviation SecurityFor necessary expenses of the Transportation Security Administration related to providing civilaviation security services pursuant to Public Law 107-71, $4,516,300,000, to remain available untilexpended, of which $3,037,900,000 shall be available for screening activities and of which$1,478,400,000 shall be available for airport support and enforcement presence: Provided, That$144,000,000 shall be derived by reimbursement from "Federal Aviation Administration, Facilities andequipment," fo r explosives detection systems: Provided further, That security service fees authorized

    unde r 49 U.S.C. 44940 shall be credited to this appropriation as offsetting collections and used forproviding civil aviation secu rity services a uthorized b y that section: Provided further, That the sumherein appropriated from the General Fund shall be reduced on a dollar-for-dollar basis as suchoffsetting collections are received during fiscal year 2003, so as to result in a final fiscal yearappropriation from the General Fund estimated at not more than $1,866,300,000: Provided further, Thatany secu rity service fees collected in excess of the amount appropriated under this heading shall betreated as offsetting collections in fiscal year 2004: Provided further, That none of the funds in this Actshall be used to recruit or hire personne l into the Transportation Security Adm inistration w hich wou ldcause the agency to exceed a staffing level of 45,000 full-time permanent positions: Provided further,That of the total amount provided herein, $265,000,000 shall be available only for physical modificationof commercial service airports for the purpose of installing checked baggage explosive detectionsystems and $174,500,000 shall be available only for procurement of checked baggage explosivedetection systems, including explosive trace detection systems.
