Permit Descriptions CAFRA - A Coastal Area Facility Act permit is required to construct residential, commercial, public, transportation, utility and energy-related facilities in the coastal area as defined by the Act. Federal Consistency Activity: Certain federal permits, not limited to the U.S. Army Corps of Engineers Dredge and Fill Permits, require certification by the DEP prior to the issuance of the permit by the federal agency. Freshwater Wetlands: A Permit (Letters of Exemption, Letters of Interpretation, Statewide General Permit, Open Water Fill, Individual, Transition Area Waiver, Water Quality Certificate) is needed prior to engaging in a regulated activity in or around freshwater wetlands and associated transition areas. A Flood Hazard Area Permit, an U.S. Army Corps of Engineers Dredge and Fill Permit, and a Water Quality Certification may also be required. General Groundwater Petroleum Products Cleanup: This general permit authorizes the surface water discharge of treated groundwater previously contaminated with petroleum products. NJPDES permits: A permit is required for the discharge of pollutants to surface and groundwater, a discharge from an indirect user or the land application of municipal and/or industrial residuals. (A more comprehensive definition of activities, which require a permit, may be found at N.J.A.C. 7:14A-2.4) Solid Waste Facility: A permit is required to conduct or operate any solid waste facility as defined under the Solid Waste Management Act, N.J.S.A. 13:1E-1 et seq., and N.J.A.C. 7:26-1 et seq. Tidal Wetlands: A Coastal Wetlands Permit is needed to excavate, dredge, fill or erect structures on coastal wetlands. Treatment Works Approval: A TWA permit is required for the construction, modification or operation of a treatment works, including sanitary/industrial sewage pretreatment or treatment systems, sewage conveyance systems, sewer extensions and subsurface sewage disposal systems. Waterfront Development: A permit is required for any project involving the development of waterfront near or upon any tidal or navigable waterway in the State. Coastal Wetlands: A permit authorizing disturbances to Mapped Tidal Wetlands under the Wetlands Act of 1970, N.J.S.A. 13:9A”

General Information

The DEP Bulletin is an information service provided by the New Jersey Department of Environmental Protection. In compliance with the Rules and Regulations Governing 90 Day Construction Permits (NJAC 7:1C-1.1 et seq.) this semi-monthly publication contains a list of construction permit applications recently filed or acted upon by the DEP. Using the Application Milestone Codes located on the inside front cover, interested persons can determine the status of Coastal Area Facility Review Act (CAFRA) permits, Federal Consistency Activity permits, Freshwater Wetlands Individual and Statewide General permits, General Groundwater Petroleum Products Cleanup permits, Open Water Fill permits, Solid Waste Facility permits (SWF), Flood Hazard Area (FHA) permits, Tidal Wetlands permits, Waterfront Development permits and Treatment Works Approvals (TWA). In addition, a calendar of Events of Interest and a Schedule of Public Hearings is provided. The public hearings listed do not, however, constitute an official notice. Environmental Impact Statements acted upon during the period are also shown. Additional information concerning the permit applications can be obtained by calling the project manager at the appropriate office listed on the inside back cover. Public Hearings are held for the purpose of obtaining input and reaction to a proposed rule, regulation, or new program. Some hearings may be mandated by law. Generally their scope of impact is statewide or of broad general interest and open to the public. Contested Case Hearings are held between the State and a particular party involving an application, enforcement violation or an appeal. Interest in these hearings is generally limited to those directly involved. DEP Events of Public Interest include public hearings, council meetings, workshops, public information meetings, and exams.

NOTICE OF PUBLIC COMMENT PERIOD FOR RENEWAL OF A HAZARDOUS WASTE FACILITY PERMIT

The New Jersey Department of Environmental Protection, Solid and Hazardous Waste Management Program, hereby gives notice that it has tentatively approved a Hazardous Waste Facility Permit renewal application submitted by Merck & Co., Inc., located in the City of Rahway, Union County, for the continued operation of a non-commercial hazardous waste storage and treatment facility. This permit covers ongoing hazardous waste activities that are regulated by the Solid Waste Management Act (N.J.S.A. 13:1E-1 et seq.) on the State level and the Resource Conservation and Recovery Act (RCRA) on the Federal level. The facility’s address is 126 East Lincoln Avenue, Rahway, New Jersey 07065. The facility has an approved storage capacity of 98,800 gallons in nine (9) aboveground tanks, and 194,260 gallons in seven (7) container storage areas. The facility is also authorized to burn on-site generated spent solvents in two (2) industrial boilers for the purpose of energy recovery at the site. The public comment period on this tentative approval begins on June ??, 2008 and will close on July ??, 2008. REGARDING THE MODIFICATION OF A NJPDES-DGW PERMIT FOR A SOLID WASTE LANDFILL

Notice is hereby given that the Solid and Hazardous Waste Management Program of the New Jersey Department of Environmental Protection (Department) proposes to modify the New Jersey Pollutant Discharge Elimination System-Discharge to Groundwater (NJPDES-DGW) Permit for the groundwater monitoring wells at the Southern

Ocean Sanitary Landfill in Ocean County, New Jersey. Groundwater monitoring at the landfill is currently being conducted by the County of Ocean. This notice is being given to inform the public that the Department has prepared a PERMIT MODIFICATION for the SOUTHERN OCEAN LANDFILL for NEW JERSEY POLLUTANT DISCHARGE ELIMINATION SYSTEM – DISCHARGE TO GROUNDWATER PERMIT NJ0050482 in accordance with the provisions of the New Jersey Water Pollution Control Act (N.J.S.A. 58:10A-1 et seq.) and its implementing regulations (N.J.A.C. 7:14A-1 et seq.). Atlantic County Utilities Authority Wastewater Treatment Plant

The Federal Aviation Administration (FAA) William J. Hughes Technical Center is located in Pomona, New Jersey, adjacent to the Atlantic City International Airport. A variety of activities at this 5000 plus acre facility has resulted in at least 24 areas of potential and actual groundwater, surface water, and soil contamination. These areas have the potential to impact the Atlantic City Reservoir and nearby municipal supply wells. As a result, the site was placed on the CERCLA National Priority List (NPL). The applicant has requested an emergency permit to discharge treated ground water to Atlantic County Utilities Authority's wastewater treatment plant. Approximately 0.10 million gallons per day of ground water will be treated using a granular activated carbon filter and pH will be adjusted prior to discharge. This will be a temporary discharge. Once the remediation system is fully functional the treated groundwater will be discharged back to the groundwater under a Discharge to Ground Water Permit Equivalent issued on February 28, 2008. Village Square has submitted an application to renw their curent NJPDES-DGW permit. This facility consists of 39 homes that are serviced by an on-site sanitary treatment system. The maximum design capacity for this treatment and disposal system is 15,600gpd. Only sanitary effluent is to be accepted and processed by Village Square’s treatment system. Village Square is permitted to discharge a maximum flow of 15,600gpd of treated wastewater. Two disposal beds with a combined square footage of 39,295 feet will accommodate the treated effluent. Residuals generated in the treatment process are removed from the bioreactor and managed at an approved sludge management facility. The Department is granting a reduction in the number of parameters that must be reported on the annual residuals “production” Waste Characterization Report (WCR) at monitoring location SL1A, pursuant to N.J.A.C. 7:14C-1.13(c). The implementation of this change to the residuals “production” WCR is based upon the effective date of the permit renewal and will be activated at the beginning of the corresponding calendar year.

This is a NJPDES-DGW new permit action. The existing facility manufactures organic chemicals including cumene hydroperoxide and dicumyl peroxide under the Standard Industrial Classification (SIC) Code 2865. A portion of the site, between the manufacturing plant and the Delaware River, is the location of a former solid waste landfill. In August 1982, following a USEPA report completed by the Department, the Hercules Inc. site (former owner) was placed on the United States Environmental Protection Agency (USEPA) National Priorities List (NPL). An Administrative Consent Order (ACO) was executed on June 1991 between the Department and Hercules, Inc. to address findings of contamination during replacement of the DSN002A effluent weir. To date, approximately 500,000 gallons of stormwater has been impounded in the infiltration/percolation lagoon to prevent discharge from DSN002A. Potentially contaminated stormwater from non-production areas is collected in an infiltration/percolation lagoon and, if necessary, will discharge through outfall DSN002A to Clonmell Creek via an unlined ditch (Authorized under NJPDES Permit No. NJ0005134). No stormwater has been discharged through outfall DSN002A since October 1991. This permit authorizes the discharge of stormwater to ground water via the infiltration/percolation lagoon located onsite. Effluent and groundwater monitoring is required under this permit to ensure compliance with the Ground Water Quality Standards (GWQS).

The proposed new WAWA food store and 16 vehicle fueling station is applying for a NJPDES Discharge to Ground Water permit. The existing WAWA store, adjacent to the J&B Liquor store, is to be demolished as part of the proposed project. The J&B Liquor store is to remain until the expiration of their existing lease agreement in approximately 2016. At the expiration of J&B Liquor store’s lease the store is to be scheduled for demolition. The septic system servicing the liquor store will be removed from service and disposed of following NJDEP guide lines. The area the liquor store occupied will be graded and landscaped. The proposed WAWA food store and 16 pump refueling station will have a design flow of 2,743 gallons per day (GPD). WAWA will incorporate a treatment system (Keppel Seghers system) which will meet Ground Water Quality Standards prior to discharge. The treated effluent will be directed to a subsurface drip dispersion field. Residuals generated at this facility will be managed off-site at an approved residuals management operation.
