SECTION II INTRODUCTION This "Major Casualty Contingency Manual" (MCCM) outlines the procedures which

should be followed when a Wallem Shipmanagement vessel is involved in an Incident In cases of any incident related to oil pollution, the procedures detailed in vessel's VRP/

NT VRP when vessel is in the waters of the United States. In all other areas of the world, the SOPEP is to be followed except in areas which have a local response manual(Panama canal, California etc).

The aim of the plan is to ensure the most timely response and that the response is

adequate in scope to meet the size and varied nature of such accidents and thereby, as quickly as possible, to remove any threat there may be of serious escalation of the situation.

The following personnel should review this Manual and be familiar with the procedures

and understand what may be required of them. • all Shipmanagement Superintendents, Managers and Directors • the Masters, Chief Engineers and Senior Officers of WSM vessels • all listed Owner’s Response Personnel • all other individuals who may become involved in the procedures outlined

herein. Although every marine incident situation is unique and should be evaluated individually,

it is expected that:

"In all cases where human life is in peril or where the vessel or cargo is threatened with damage or loss or risk of pollution, the Master must take all proper precautions immediately, without restraint, for the safety of the vessel and all personnel on board and to limit any damage to the environment to the minimum."

At sea, the responsibility for action rests with the Master and his operating management.

Where an incident occurs in territorial waters or port limits, the national authority and/or the port authority may be involved and the Master's and his operating management's freedom of action may be thereby constrained. This would be particularly so if the hazards relevant to the casualty could put third parties at risk. In these latter circumstances, incident response plans may need to be adapted quickly to take account of the requirements of the shore authorities. However, the basic considerations in these circumstances are still of the same nature as those when the ship is at sea.

When a ship is berthed alongside a cargo terminal, the responsibilities for action in the

event of an accident are more complex, as the terminal management must also be involved both in the protection of the terminal facilities and in the provision of any remedial action.

Incident response planning can only be based upon an understanding of:

• The type of accidents which may occur or have occurred.

• The possible consequences.

• The action that can practicably be taken.

• The requirements relating to a suitable location or locations in which to take that

action.

• The possible reaction of the media and other bodies to the casualty, its handling and its consequences.

The Various Manuals - Major Casualty Contingency Manual, Shipboard Management

Manual, Vessel Response Plan / Non Tanker Vessel Response Plan or Shipboard Oil Pollution Emergency Plan (SOPEP) and Safety Manual - available aboard each WSM vessel have advice and data to assist the Master and his Officers to take correct immediate action in the event of serious incident. Such advice includes information on:

• Reporting procedures.

• Engagement of Salvors - THE MASTER HAS THE AUTHORITY TO ACCEPT AND SIGN

LLOYDS STANDARD FORM OF SALVAGE AGREEMENT – LOF. (See Appendix 6)

• Guide for Masters (OCIMF) - Peril at Sea and Salvage.

• Damage Stability Data, including Emergency Response Services offered by Classification Societies.

• Action following Collision, Grounding or Fire.

Speed may be vital if escalation to a more serious situation is to be prevented and it is

essential that this plan is activated promptly when warranted. A Emergency response centre (ERC) team shall be organized in order to deal promptly

and effectively with incidents involving the Company's vessels. On receipt of information concerning an incident, the team will immediately be activated.

Notification of the incident will normally come through operational channels, but first information will come from virtually any communication medium.

The purpose of this document is to outline the steps that are to be taken to assemble the

team, to define team member responsibilities, to outline required facilities, to define initial procedures for acquiring information, to assess the seriousness of the event, to develop remedial procedures, to communicate details of the event to authorities, insurance interests, owners, charterers and cargo interests, ships' agents and the media as appropriate, to arrange for technical and salvage assistance and to make arrangements to record all actions and events in connection with the incident.

SECTION III Master’s Responsibility & Authority 3.1 MASTER’S RESPONSIBILITY In case of damage to the vessel, personal injury, pollution, the first line of responsibility for

all decisions with regard to corrective measures lies with the Master. In carrying out this function, he has to bear in mind the following points: -

• To take all proper precautions immediately without restraint for the safety of

personnel, vessel and the cargo. • To take all proper steps to obviate any escalation of pollution of the environment. • To make best use of assistance available. • To contact the Vessel Technical Superintendent or back up Technical superintendent

or Vessel Marine superintendent or Fleet Manager at the earliest opportunity with preliminary information as per First alert notification sheet

3.2 LOF - (LATEST EDITION) The Master has the authority to accept and sign Lloyd’s Standard Form of Salvage

Agreement when the ship is in Peril. If time permits, It is recommended that Master contact the Marine superintendent or Fleet

Manager or a member of the Management team prior signing the LOF as they would be able negotiate better terms. Contact Details for Management team in Appendix 8

3.3 Handling the Media Wallem does not seek media coverage in a crisis, however realises it is important to

establish and maintain a positive relationship with the media and the public. The crisis could involve safety or loss of life at sea or ashore, an oil spill, sabotage, terrorism act or piracy.

In the Initial stages of a high potential accident, the Master and the senior officers may be approached by journalists for information on the accident. The media may arrive on the scene prior to the arrival of the company’s response team. Any questions from Media to the Master should be responded with “We are busy dealing with the incident. Please call the ERC team at (number would be provided by ERC team) for information”.

3.6 BLANK 3.7 ALCOHOL TESTING

All vessels are provided with Alcohol testing kit to carry out post incident alcohol testing. All seafarers involves with an accident Category I or Category II have to be tested. A record of such testing must be maintained in the alcohol log.

Fleet Cell shall arrange post accident D & A testing by one of the service providers for all Major accident ( Cat I Incident). Testing by D & A provider for other accidents may be arranged on a case by case basis as decided by Management team.

Vessel’s have the Medscreen D & A sample collection kit to collect the urine samples when the D & A service provider cannot be arranged within the required time frame. In this case, the samples are collected in the sample kit and landed to the service provider at convenient time for testing.

If there are safety concerns to be met, then testing may be delayed until the safety concerns have been addressed and Master to inform Fleet cell accordingly

3.8 SHIP EMERGENCY RESPONSE SERVICES (SERS) SERS provides a rapid computer assisted analysis on damage, longitudinal strength in the

event of a accident to a ship and provides 24 hours coverage. Management team on board to refer to the Ship specific Emergency Response Booklet

(ERS) provided by service provider for the vessel, for complete details

The SERS casualty report part should be filled in at all times and kept ready for dispatch on the Communication computer along with the E-Mail address of the SERS. The completed form along with consumption since departure to be sent to SERS with copy to the VC address. On sailing from load ports, the ERS report shall be sent to [email protected] along with the stowage plan.

In case of collision or grounding, Master shall obtain advise from ERS before any cargo transfer. The ERC team shall be kept fully updated with the request to ERS and the response from the ERS.

4.3 RESPONSE TEAM CALL OUT

Fleet Manager would initiate an alert to all Team members and support teams as required. The Members would then report to their office with all speed. Response team shall be called out for all Cat I accidents and on a case by case basis for Cat II accidents as decided by the Fleet Manager. In case of doubt, the Fleet Manager can call any member of the Management team.

To expedite the call out, the Fleet manager may find it convenient to delegate to one or more of his early contacts the task of passing the alert to the remainder of the team.

4.6 MEETING POINT The designated room in each office shall be the meeting point for the ERC team.

4.8 INITIAL BRIEFING

On assembly, the team will be given a thorough up-date by the team leader. As additional information is received, it will be recorded. Recording Shall be on white board with photographs or on paper. Alternatively, the team can record on Skype business which allows active participation by offshore teams. Appendix 11 provides guidelines on action by ERC team.

4.9 ADVICE TO COMPANY OFFICERS

First Alert list includes all the company staff to be alerted.

ERC Activation + 1 Hour : Send First Alert

ERC Activation + 1 - 3 Hours: First alert would be sent to Media Consultants for preparing the draft message. Group communication officer or member of management team would contact Media consultants (MTI) as required ERC would contact a member of the Management team if a media watch is required to be kept by MTI. The Management team member would contact MTI.

4.10 ADVICE TO STAKEHOLDERS Prompt advice of the incident shall be given by the ERC team to to Ship Owners,

Underwriters (H & M or P & I as applicable), Charterers, Cargo interests, Classification Society and Ship's agents (as applicable). If salvage services are likely to be required, appropriate salvors may need to be contacted and if technical advice on ship damage stability is needed, the vessel's Classification Society should be alerted.

4.11 FIELD TEAM Members of Management team shall decide if a field team is required. A decision

regarding the dispatch of a team to the scene of incident will be made at the earliest possible moment.

While the field team is in transit, the ERC team will establish the best (under the

circumstances) means of communicating with the vessel/ seafarers and the most appropriate shore base in its vicinity. They will also arrange for the reception of the field team to enable the team's immediate contribution to the control of the casualty.

4.12 ASSISTANCE TO VESSEL An early assessment of the circumstances will indicate the requirements for assistance.

The ERC team will determine the assistance required including the need of Salvors in consultation with the Management team. In case lightering of cargo is required, enquiries would be initated for availability of ships and equipment for this purpose.

4.13 FAMILIES OF SERVING PERSONNEL

is likely that the families of personnel serving aboard will quickly learn of the incident from the news media or by word of mouth and naturally will be concerned. Whether or not injuries to personnel are reported, MHR Managers will make the earliest possible arrangements for the continual presence in the control centre of appropriate staff to provide information to next of kin where necessary, and to have available information for bona fide representatives calling on the telephone. Staff dealing with these enquiries will be kept briefed by Management team, regarding the proper content of information to be provided to such bona fide enquiries.

If the media or a member of the public contact any company executive or managed vessel, the following statement to be given : “ We recognise your concerns. Please call the ERC team at (number would be provided) for information”.
