WHEREAS, the superintendence, direction and control of all elections to the Panchayats and Municipalities in theState are vested with the Tamil Nadu State Election Commission as per Article 243K and 243ZA of the Constitution ofIndia:-

WHEREAS, the Hon’ble Supreme Court of India in its Judgment, dated 13th September 2013 in WP (Civil) 121 of 2008issued the following directions:-

(i) The voter has the elementary right to know full particulars of a candidate who is to represent him in the Parliament/Assemblies and such right to get information is universally recognized. Thus, it is held that right to know about thecandidate is a natural right flowing from the concept of democracy and is an integral part of Article 19 (1) (a) of theConstitution.

(ii) The ultimate purpose of filing of affidavit along with the nomination paper is to effectuate the fundamental rightof the citizens under Article 19 (1) (a) of the Constitution of India. The citizens are supposed to have the necessaryinformation at the time of filing of nomination paper and for that purpose, the Returning Officer can very well compel acandidate to furnish the relevant information.

(iii) Filing of affidavit with blank particulars will render the affidavit nugatory.

(iv) It is the duty of the Returning Officer to check whether the information required is fully furnished at the timeof filing of affidavit with the nomination paper since such information is very vital for giving effect to the ‘right to know’of the citizens. If a candidate fails to fill the blanks even after the reminder by the Returning Officer, the nominationpaper is fit to be rejected. We do comprehend that the power of Returning Officer to reject the nomination paper mustbe exercised very sparingly but the bar should not be laid so high that the justice itself is prejudiced.

(v) We clarify to the extent that Para 73 of People’s Union for Civil Liberties case (supra) will not come in theway of the Returning Officer to reject the nomination paper when affidavit is filed with blank particulars.

(vi) The candidate must take the minimum effort to explicitly remark as ‘NIL’ or ‘Not Applicable’ or ‘Not known’in the columns and not to leave the particulars blank.

(vii) Filing of affidavit with blanks will be directly hit by Section 125A (i) of the RP Act However, as the nominationpaper itself is rejected by the Returning Officer, we find no reason why the candidate must be again penalized for thesame act by prosecuting him/her.

AND WHEREAS, in compliance with the aforesaid orders of Hon’ble Supreme Court and in the absence of suchprovisions in the laws governing election to the Panchayats and Municipalities, the Tamil Nadu State ElectionCommission felt duty bound to issue this Statutory Order in the interest of purity of elections to the Panchayats andMunicipalities till such amendments are made by the State Legislature in the laws governing election to the Panchayatsand Municipalities and since Articles 243K and 243ZA of the Constitution of India governing the elections to thePanchayats and Municipalities, being the institutions at the lower rungs of the democracy and stepping stones for bringingup the prospective leaders of the country, it is felt necessary by the Tamil Nadu State Election Commission, to have anin-built mechanism of ensuring purity, openness and transparency in the elections to the institutions at the grassroot level.Hence, this Order.

ORDER

NOW, THEREFORE, in exercise of the powers conferred by Articles 243K and 243ZA of the Constitution of Indiaread with relevant sections of Tamil Nadu Panchayat Act, 1994 (Tamil Nadu Act 21 of 1994) Madras City MunicipalCorporation Act, 1919 (Tamil Nadu Act IV of 1919) Madurai City Municipal Corporation Act, 1971 (Tamil Nadu Act XV of1971), Coimbatore City Municipal Corporation Act, 1981 (Tamil Nadu Act XXV of 1981), Tiruchirapalli City MunicipalCorporation Act, 1994 (Tamil Nadu Act 27 of 1994) Tirunelveli City Municipal Corporation Act, 1994 (Tamil Nadu Act 28of 1994) Salem City Municipal Corporation Act, 1994 (Tamil Nadu Act 29 of 1994), Tiruppur City Municipal CorporationAct, 2008 (Tamil Nadu Act 7 of 2008), Erode City Municipal Corporation Act, 2008 (Tamil Nadu Act 8 of 2008), VelloreCity Municipal Corporation Act, 2008 (Tamil Nadu Act 26 of 2008), Thoothukudi City Municipal Corporation Act, 2008(Tamil Nadu Act 27 of 2008), the Thanjavur City Municipal Corporation Act, 2013 (Tamil Nadu Act 24 of 2013), the DindigulCity Municipal Corporation Act, 2013 (Tamil Nadu Act 25 of 2013) and Tamil Nadu District Municipalities Act, 1920 (TamilNadu Act V of 1920) and all other powers enabling it in this behalf, and in supersession of the Tamil Nadu State ElectionCommission’s Notification No.147 published at pages 1 to 21 of Part VI-Section 2 No.VI(2)/171(a)/2014 of the Tamil NaduGovernment Extraordinary Gazette, dated 5.8.214 and Notification No.169 Published at pages 1 to 2 of Part VI-Section2 No.VI(2)/188(a-1)/2014 of the Tamil Nadu Government Extraordinary Gazette, dated 27.8.2014 the Tamil Nadu StateElection Commission hereby makes the following order:-

1. Every candidate at the time of filing his / her nomination paper for any election or casual election for electing aMember or Members or Chairperson or Chairpersons of any Panchayat or Municipality, shall furnish full and completeinformation in regard to all the seven matters referred in the preamble, in an Affidavit, as the case may be, in the revisedformat annexed hereto:-

“Provided that having regard to the difficulties in swearing an affidavit in a village, a candidate at the election to a WardMember of Village Panchayat under the Tamil Nadu Panchayats Act, 1994, shall, instead of filing an Affidavit, file beforethe Returning Officer, a declaration with the details found in the same affidavit - Annexure-I to this order:”

2. The said affidavit by each candidate shall be duly sworn before a Magistrate of the First Class or a Notary Publicor a Commissioner of Oaths appointed by the High Court of the State or before an officer competent for swearing an affidavit.The affidavit shall be prepared in a twenty Rupees (Rs. 20/-) Non judicial stamped paper.

3. Non-furnishing of the affidavit, as the case may be, by any candidate shall be considered to be violation of thisorder and the nomination of the candidate concerned shall be liable for rejection by the returning officer at the time ofscrutiny of nomination for such non-furnishing of the affidavit, as the case may be.

4. If more than one nomination has been filed by a candidate for an election the affidavit shall be annexed along withthe first nomination and no need to furnish the affidavit with the other nomination papers.

5. The information so furnished by each candidate in the aforesaid affidavit as the case may be, shall bedisseminated by the respective returning officers by displaying a copy of the affidavit on the notice board of his office andalso by making the copies thereof available to all other candidates on demand and to the representatives of the print andelectronic media.

6. If any rival candidate furnished information to the contrary, by means of a duly sworn affidavit, then such affidavitof the rival candidate shall also be disseminated along with the affidavit of the candidate concerned in the manner directedabove.

7. All the Returning Officers shall ensure that the copy of the affidavit, prescribed herein by the Tamil Nadu StateElection Commission in the Annexure shall be delivered to the candidates along with the forms of nomination papers aspart of the nomination papers.

8. In view of the penal provisions contained in Section 177 of Indian Penal Code (Procedure contemplated in Section195 of Code of Criminal procedure), the Returning Officer concerned may initiate action after providing reasonableopportunity to the party concerned in case of false information, if any, confirmed at a later date.

This order shall come into force with effect from the date of this Order.
