Background and Disclaimer: The purpose of an environmental site assessment is to identify actual or potential “recognized environmental conditions” that may result in liability or land use restrictions. The ASTM Phase I Environmental Site Assessment E 1527 – 05 is the minimum standard for environmental due diligence in the commercial real estate industry and meets the standard for All Appropriate Inquiry under the Small Business Liability Relief and Brownfield Revitalization Act of 2002. A diligent effort in accordance with generally accepted good commercial and customary standards and practices was undertaken to identify the “recognized environmental conditions” that might affect the redevelopment project. However, the identification of old hazardous waste sites is an evolving process; therefore, the Oklahoma Department of Environmental Quality (DEQ) cannot state with absolute certainty that no other potential hazardous waste sites are located in the area. In no event shall the DEQ or its employees be liable for any damages, injury, loss, cost or expense whatsoever arising in connection with the use or reliance on the information contained in this report, except as otherwise provided by law.

1.0 Executive Summary

On June 21, 2011, Alisha Grayson and Rachel Franks of the DEQ preformed a site reconnaissance of the former Alva armory located at the southwest corner of Thunderbird Road and South 11th Street in Alva, Oklahoma. All other research on the Targeted Brownfield Assessment (TBA) was performed by Alisha Grayson with the DEQ. The subject property is located just outside the City of Alva’s municipal boundary and is bordered mostly by Northwestern Oklahoma State University to the north and a forested canyon to the south. This Phase I Targeted Brownfield Assessment of the Alva Armory was performed in accordance with the ASTM E 1527-05, a guide for conducting Environmental Site Assessments. Alisha Grayson of (DEQ) performed the site reconnaissance on June 21, 2011.

The site legal description is the tract of land located wholly within the north one-half of the southeast quarter of Section 26, township 27, North Range 14, WIM, the City of Alva in Woods County, Oklahoma. See Section 3.1 for complete legal description. A cursory summary of findings is provided below. However, details were not included or fully developed in this section, and the report must be read in its entirety for a comprehensive understanding of the items contained herein.

April 29, 2004 C.H. Guernsey & Company collected several wipe samples inside the Indoor Firing Range (IFR) that contained high levels of lead contamination. The results from the Indoor Firing Range Lead Issues Report and restricted entry into the IFR suggest that additional investigation and remediation of lead inside the IFR be conducted. The IFR constitutes a recognized environmental condition (REC) based on the lead concentrations. (Ref. Appendix J)

The IFR sand trap remains on site. Past sampling of sand traps of Indoor Firing Ranges result in high concentrations of lead thus will require removal and remediation. The remaining sand trap in the IFR constitutes a REC based on the lead concentrations. DEQ sampled the IFR sand, but the laboratory results have not yet been received.

One 5,000-gallon underground storage tank (UST) was removed from the Armory

property May 14, 1998. The UST was listed in excellent condition when removed, and was destroyed on site. The Oklahoma Corporation Commission (OCC) listed one UST as being located at the subject property in its UST database.

Suspect asbestos containing material (ACM) was found throughout the Armory. The Drill

Floor appeared to have ACM ceiling tiles. The IFR appeared to have ACM tiles on the walls and ceiling. Additionally, several rooms throughout the Armory appeared to have utility pipe wrapping which is suspect of containing ACM.

Numerous fluorescent light bulbs and fixtures were found throughout the Armory

building. All fluorescent light bulbs contain mercury and the light fixtures may contain Polychlorinated biphenyls (PCBs). Some of fluorescent light bulbs had green tips and other fluorescent light bulbs did not have green tips. Fluorescent light bulbs with green

tips are nonhazardous whereas other fluorescent light bulbs are hazardous. Mercury contained in green tipped fluorescent light bulbs is not leachable through toxicity characteristic leaching procedure (TCLP) analysis, which makes them nonhazardous.

The original paint in the armory may have been painted over in many areas of the

building. Due to the timeframe the building was constructed, lead based paint may have been used in original construction.

No National Priorities List (NPL) or delisted NPL sites, active Comprehensive

Environmental Response, Compensation, and Liability Information System (CERCLIS) site listings, Resource Conservation and Recovery Act (RCRA) Corrective Action (CORRACTS) and non-CORRACTS Treatment, Storage, or Disposal (TSD) listings, Emergency Response Notification System (ERNS) list, State-equivalent NPL or CERCLIS lists, or State landfills and/or solid waste disposal sites were found on the subject property or within the ASTM minimum search radii. No archived CERCLIS site listings, RCRA generators, or Voluntary Cleanup Program (VCP) sites were found on the subject property or the minimum search radii. No Brownfield sites were found on the subject property and the minimum search radii either.

The site is not on any Federal or State Institutional Control (IC)/Engineering Control

(EC) Registries. Sergeant Chad Easton, the Alva Armory representative of the subject property, was not aware of any ICs or ECs on the property.

The subject property is on the DEQ’s Site Cleanup Assistance Program list for

environmental cleanup of lead and asbestos.

2.0 INTRODUCTION DEQ under a Brownfield Assistance Agreement (No. RP96681001-0) (Ref.1) with the U.S. Environmental Protection Agency (EPA) conducted a Targeted Brownfield Assessment of the City of Alva, Oklahoma National Guard Armory. The property is located on the southeast corner of South 11th Street and Thunderbird Road (995 Thunderbird Road Alva, Oklahoma). The property is to be deeded to Northwestern Oklahoma State University in the future. 2.1 Purpose

The purpose of this assessment is to look at the environmental conditions within the target area and provide this information to Northwestern Oklahoma State University. This assessment will then assist in its revitalization planning as well as meet the All Appropriate Inquiry requirement of the landowner liability protections under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) (Ref.2), better known as Superfund, as provided in the Small Business Relief and Brownfield Revitalization Act of 2002 (Public Law 107-118, Subtitle B) (Ref.3). The purpose of a Phase I Environmental Site Assessment is to identify, to the extent feasible, recognized environmental conditions in connection with the target property through a systematic review of readily available information sources and a site reconnaissance. The Phase I will also be used to guide DEQ’s cleanup efforts at the Armory. DEQ is providing technical assistance to the project by evaluating the environmental condition of the property prior to Northwestern Oklahoma State University acquiring the property. Funding for this assessment has been provided by the U.S. EPA.

2.2 Detailed Scope-of-Services

DEQ examined the current use of the property and then identified the historical uses of the property to determine if recognized environmental conditions exist. The DEQ examined historical documents, governmental databases, oil and gas records, aerial photographs, Sanborn Fire Insurance Maps, conducted interviews, and a site reconnaissance of the area. A good faith effort was made to identify possible environmental conditions that might affect the revitalization of the property.

2.3 Significant Assumptions

The term “recognized environmental condition” as defined by ASTM E 1527-05 Standards, is “the presence or likely presence of any hazardous substances or petroleum products on a property under conditions that indicate an existing release, or a material threat of a release of any hazardous substances or petroleum products into structures on the property or into the ground, groundwater, or surface water of the property. The term includes hazardous substances or petroleum products even under conditions in compliance with laws. The term is not intended to include de minimis conditions that generally do not present a material risk of harm to public health or the environment and that generally would not be the subject of an enforcement action if brought to the

attention of appropriate governmental agencies. Conditions determined to be de minimis are not recognized environmental conditions.

2.4 Limitations and Exceptions

The purpose of an environmental site assessment is to identify actual or potential “recognized environmental conditions” that may result in liability, land use restrictions, or cause delays in revitalization. The ASTM Phase I Environmental Site Assessment E 1527 – 05 (Ref.4) is the minimum standard for environmental due diligence in the commercial real estate industry and meets the standard for All Appropriate Inquiry under the Small Business Liability Relief and the Brownfield Revitalization Act of 2002. A diligent effort in accordance with generally accepted good commercial and customary standards and practices was undertaken to identify the “recognized environmental conditions” that might affect the revitalization project. However, the identification of old hazardous waste sites is an evolving process; therefore, DEQ cannot state with absolute certainty that no other potential hazardous waste sites are located in the area. This assessment was conducted under constraints of time, cost, and scope and reflects a limited investigation and evaluation. It reflects the normal degree of care and skill that is ordinarily exercised by environmental professionals conducting business in this or similar localities. In no event shall the DEQ or its employees be liable for any damages, injury, loss, cost or expense whatsoever arising in connection with the use or reliance on the information contained in this report, except as otherwise provided by law.

The information in this report is based on a review of governmental records, interviews with knowledgeable residents in the community, information provided by the City of Alva, the Oklahoma Military Department, and observations of the environmental professional. The result of this assessment, as written in this report, is valid as of the date of the report. The assessment does not include sampling of soil, groundwater, surface water, or air.

2.5 Special Terms and Conditions This assessment report has been prepared for Northwestern Oklahoma State University by the DEQ using EPA funding. Information about this report will be provided to the EPA for its files. This report and the working file are public record and subject to the Oklahoma Open Records Act and the federal Freedom of Information Act. Certain conditions are beyond the scope of ASTM Phase I Environmental Site Assessments and are therefore outside the scope of this assessment, unless specifically addressed in this report. Those conditions include but are not limited to:

3.0 SITE CHARACTERIZATION AND HISTORY 3.1 Location and Legal Description

The subject property is located wholly within the north one-half of the southeast quarter of Section 26, township 27, North range 14, WIM, Woods County, Oklahoma, more particularly described as follows

Beginning at the northwest corner of the southeast quarter of Section 26, Township 27, North Range 14, WIM, and proceeding thence south along the west line of the above southeast quarter of Section 26, a distance of 527.0 feet, thence S. 76º -56’ E. a distance of 325.4 feet, thence S. 2º -14’ W. a distance of 154.4 feet, thence east parallel to the north line of the above southeast quarter of section 26, a distance of 488.8 feet to a point that is located 800.0 feet east of the above west line of the southeast quarter of Section 26, thence north parallel to the above west line of the southeast of section 26, a distance of 755.0 feet to the above north line of the southeast quarter of Section 26, thence west along the above north line of the southeast quarter of Section 26 a distance of 800.0 feet to the point of beginning, together with all the improvements thereon and the appurtenance thereunto belonging. EXCEPT a strip of land fifty feet (50.0’) wide adjoining and abutting upon the north 527.0 feet of the west side of the above described tract which strip of land is hereby reserved for and dedicated to Public for street purposes, and also EXCEPT a strip of land fifty feet (50.0’) wide adjoining and abutting upon the north side of the above described tract which strip of land is hereby reserved for and dedicated to the Public for street purposes. The above described tract contains a total of 12.48 acres, more or less, inclusive of the two above exceptions.

Records at the Alva County Clerk’s office were searched to determine ownership and the operational history of the subject property. See Appendix B for copies of these documents.

3.2 Site and Vicinity Characterization

The armory sits on North Street facing north. To the north of the site, across North Street, sits Rangers Stadium of Northwestern Oklahoma State University, which was built in 1967. The land was purchased by Northwestern Oklahoma State University in 1967 from the Charles Morton Trust. The armory is bordered on the south and east by a forested canyon that is also owned by the Charles Morton Trust; this area is unbuildable and has never been developed. To the west of the armory, a cross South 11th Street, Northwestern Technology Center is located. A review of the topographical map indicated that the surface elevation of the subject property is approximately 1460-1470 feet above mean sea level, sloping from west to the east. It appears as if the subject property’s runoff is collecting to the east in a low lying area within the canyon. A topographical map is located in Appendix A.

3.3 Description of Structures, Roads, and Other Improvements The Armory’s overall structure is in good condition but a few foundation cracks are present. The roof throughout the Armory is in excellent condition with only a few areas where water entry is apparent. Roads surrounding the Armory are in good condition. All roads are constructed of asphalt pavement. Adjacent properties are well maintained and in good condition.

3.4 Owner, Property Manager, and Occupant Information

The subject property is currently being deeded to Northwestern Oklahoma State University. The DEQ Site Cleanup Assistance Program (SCAP) is in charge of identifying environmental hazards and conducting the cleanup of the Armory.

3.5 Information Reported by User Regarding Environmental Lien or Specialized Knowledge or Experience

Former Alva Armory National Guard, Sergeant Chad Allen Eastin, reported no environmental liens on the subject property. No environmental liens or use limitations were reported for the subject property. Sergeant Chad Allen Eastin did have specialized knowledge regarding environmental conditions at the subject property. Sergeant Chad Allen Eastin noted that one 5,000-

Gallon Steel UST (Underground Storage Tank) was removed from the west side of the building on May 14, 1998.

3.6 Commonly Known or Reasonably Ascertainable Information

Sergeant Chad Allen Eastin, representative of the Armory, did not have any commonly known or reasonably ascertainable information within the local community about possible environmental conditions on the property. It is commonly known within the community that the subject property housed the former Alva Armory.

3.7 Valuation Reduction for Environmental Issues

Valuation of the subject property is outside the scope of this assessment. A professional appraiser should be consulted to place a value on the property.

3.8 Current Use of the Property

At the time of the site visit, 21st day of June, Sergeant Chad Allen Eastin was moving all remaining equipment out of the Armory preparing for a final walk through on the 29th of June. The Oklahoma Military Department will transfer the title to the Alva Armory to Northwestern Oklahoma State University for public purpose use August 11, 2011.

The Memorandum of Agreement can be found in Appendix I of this report. 3.9 Past Use of the Property

3.9.1 Review of Aerial Photographs Historic aerial photographs were searched to view the changes to the subject property over time. Aerial photographs from 1942, 1959, 1995, 2003, 2008 and 2010 were obtained. The earliest aerial photograph on record for the subject property was taken in 1942. This photograph was obtained from the Oklahoma Department of Libraries. The 1959 aerial photograph was obtained from DEQ’s central records department. The 1995, 2003, 2008, and 2010 aerial photographs were obtained from the DEQ Data Viewer. The following represents a summary of what was found at the subject property from each photograph. All aerial photographs are located in Appendix C.

1942 aerial photograph The Alva Armory was constructed in 1979, thus it is not present in the 1942 aerial photograph. The adjacent property to the north of the armory site is a vacant property owned by the Charles Morton Trust. The property is bordered on the south and east by a forested canyon that was, and continues to be, owned by the

Charles Morton Trust. The property to the west, thru observation, is pasture (potentially used for agriculture), owned by Wade and Erma Lion.

1959 aerial photograph No changes in land use appear between 1942 and 1959.

1995 aerial photograph To the North, the 1995 aerial photograph shows Rangers Stadium, built in 1969. Northwestern Technology Center, established in 1976 is present to the west. No other apparent changes are seen on adjacent properties.

2003 aerial photograph No changes in land use appear between 1995 and 2003.

2008 aerial photograph No changes appear between the 2003 and 2008 aerial photographs. 2010 aerial photograph No changes appear between the 2008 and 2010 aerial photographs. 3.9.2 Fire Insurance Maps Sanborn Fire Insurance maps are not available for this property.

3.10 Current and Past Uses of Adjoining Properties

The adjoining property to the north was open pasture (possibly agricultural) and owned by the Charles Morton Trust until 1967. In 1967, Northwestern University bought 29.5 acres from the Charles Morton Trust and built Ranger Stadium in 1969 which continues to occupy the property. To the east and south the armory is surrounded by a forested canyon, which continues to be owned by the Charles Morton Trust. According to a review of historic aerial photos this area has never been developed. To the west is an open pasture, owned by Northwestern Technology Center. This area, 7.8 acres, was sold to Northwestern Technology Center prior to 1976 from Wade and Erma Lion.

3.11 Environmental (Physical) Setting

The DEQ reviewed several sources to obtain information on the physical setting of the subject property and its surrounding areas. These sources include: The United States Department of Agriculture Garvin County Soil Survey, United States and Oklahoma Geological Survey, and the Federal Emergency Management Association. Review of the physical setting of the area is to evaluate the sensitivity of the hydrogeology to potential contamination from sources either on or near the site.

3.11.1 Surface Water Characteristics

The elevation at the Alva Armory is approximately 1475 feet sloping to the southeast. According to the USGS quadrangle topographical map of Alva found in Appendix A, the subject property drains to the south southeast collecting in the low lying area to the east.

3.11.2 Subsurface Geological Characterization

Soils According to the Soil Survey of Woods County, Oklahoma, the site consists of the Burford silt loam with 5 to 15 percent slopes. This deep, well-drained soil has a high available water capacity. Permeability is moderate, and subsurface runoff is slow. This soil is rarely flooded. The surface layer is a dark brown silt loam and is approximately 9 inches deep. The preceding layer is a reddish brown silty clay loam and is approximately 25 inches deep.

The subsoil is red clay that extends to a depth of 42 inches. The underlying material is paralithic bedrock to a depth of more than 80 inches. Most properties of this soil are favorable for building sites although this soil is subject to rare flooding. National Resources Conservation Soil Survey information is located in

Appendix D. Geology According to the Oklahoma Geologic Survey (Hydrologic Atlas 8 of the Woodward Quadrangle in Northwestern Oklahoma), the subject property is located on lenticular and interfingering deposits of light-tan to gray gravel, sand, silt, clay and volcanic ash. Sand dunes are common in many places. Thickness ranges up to 150 feet and averages about 60 feet. The property is part of the greater Woodward Quadrangle in the Central Lowland of the Great Plains provinces of the Interior Plains and is part of the Arkansas River drainage basin. Except for scattered, small outliers of rocks from the Cretaceous age, the area is underlain by Permian bedrock with reported dips ranging from 4 to 30 feet per mile and averaging 17 feet per mile south-southwest. Deposits of the Tertiary and Quaternary age and nearly horizontal. No significant structural anomalies are known; however, sinkhole development caused by ground water dissolving and removing bedded salt or gypsum, has resulted in minor localized folding in most rocks.

3.11.3 Ground Water Characteristics

Availability of Ground Water According to the Oklahoma Geologic Survey (Hydrologic Atlas 8 of the Woodward Quadrangle in Northwestern Oklahoma) and the State of Oklahoma Water Resource Board, water in this area is derived from the Cimarron River Aquifer which is mostly comprised of alluvial and terrace deposits. The El Reno Minor Ground Water Basin also provides water to this area which is a bedrock basin. This area is reported to yield is 150-300 gpm (gallons per minute). The State of Oklahoma Water Resources Board information is located in

Appendix E.

Chemical Quality of Ground Water The chemical quality of the water is generally good. This area is underlain by alluvium and terrace deposits along the El Reno Group and the Marlow Formation of the Whitehorse Group.

3.11.4 Air Characteristics

No air emissions were noticed at the subject property or the adjoining properties. No significant odors were noticed at the subject property during the site visit. There may be the potential for mold growth due to the age of the Armory.

4.0 RECORDS REVIEW A regulatory database search was conducted by the DEQ. This search included, at a minimum, those records and distances from the site dictated as appropriate in the ASTM standard. The DEQ performed a review of available federal and state databases to assess whether the subject property or proximate properties were listed as having environmental concerns, which could have an adverse impact on the subject property. The following provides a summary of the databases reviewed.

4.1 Federal National Priorities List (NPL)

The EPA database was searched for NPL sites near the subject property within the ASTM’s recommended search radius of one mile. The subject property is not a listed NPL site. There are no NPL sites reported within a one-mile radius of the subject property. There is also an EPA database for delisted NPL sites, which ASTM requires to be reported within ½ mile of the subject property. No delisted NPL sites are within the ½ mile search radius.

4.2 Federal CERCLIS List

The EPA database for Comprehensive Environmental Response, Compensation and Liability Act Information System (CERCLIS) was searched for active and archived CERCLIS sites on and near the subject property. The ASTM’s recommended search radius around the subject, property for both active and archived CERCLIS sites, is ½ mile. No active CERCLIS sites were found within ½ mile of the subject property. No archived CERCLIS sites were found within ½ mile of the subject property. 4.3 Federal RCRA CORRACTs List The EPA database for Resource Conservation and Recovery Act (RCRA) facilities subject to corrective action was searched within the ASTM’s required minimum distance of one mile of the subject property. There are no RCRA CORRACT facilities within the one-mile radius of the subject property. 4.4 Federal RCRA non-CORRACTS TSD List The EPA database for RCRA facilities not subject to corrective action was searched within the ASTM’s required minimum distance of ½ mile of the subject property. No RCRA non-CORRACT Treatment, Storage and Disposal (TSD) sites are within the ½ mile radius of the subject property. 4.5 Federal RCRA Generators List The EPA RCRA Notifiers database was searched for RCRA generators within the ASTM’s required minimum search distance of the subject property. The minimum distance is the property and adjoining properties. The subject property did not have any RCRA Notifiers or generators. There are no RCRA Notifier facilities on any of the adjacent properties.

4.6 Federal ERNS List The Emergency Response Notification system (ERNS) maintained by the National Response Center was searched for any hazardous substance releases or spills within the subject property. ASTM requires a minimum search distance of the property only when identifying ERNS cases. No ERNS sites were reported within the property or the adjoining properties.

4.7 Federal Institutional Control/Engineering Control Registries There are no known Institutional Controls/Engineering Controls on the subject property according to the representatives of the subject property.

4.8 State-Equivalent NPL The DEQ does not have a State-equivalent NPL database. Oklahoma does not have a State Superfund law to establish a State-equivalent NPL database.

4.9 State-Equivalent CERCLIS The DEQ does not have a State-equivalent CERCLIS database. 4.10 State Landfill and / or Solid Waste Disposal Sites The DEQ regulates landfills and solid waste disposal sites across the State of Oklahoma. State landfills and solid waste disposal facilities were searched in the DEQ database within the ASTM required minimum distance ½ mile from the subject property. No permitted landfills or solid waste disposal facilities are located within the search distance of the subject property.

4.11 State Leaking UST List The Oklahoma Water Resources Board’s Custom Map Viewer and The Oklahoma Corporation Commission (OCC) data base was searched to locate any known leaking underground storage tanks (LUSTs) sites located within the ASTM’s minimum search distance of a ½ mile of the subject property. Two LUST are listed within the ½ mile radius.

Mr. Jim Detgen, who was the Physical Plant Manager of the site, contacted AGES, Inc on May 27, 1997, to conduct the work necessary to meet OCC requirements associated with

and alleged confirmed release from the underground storage tank (UST) system at the site. The facility is located on the campus of Northwestern Oklahoma State University, Alva, Woods County, Oklahoma. The legal description is NE, SW, NE, Section 27, T27N, R14W. The facility is bounded on the south by a building and on the west by a parking lot, and on the north by a vacant lot. No other active UST’s are located within 500 feet of the site. The UST’s elevation is approximately 1420-1430 feet. This location is 20-30 feet below that of the subject property’s topographical elevation. Underground storage facilities at the site before removal, included two UST’s. One was a 1000 gallon gasoline tank and the other a 550 gallon emergency backup tank. The tanks had suction piping and were installed at an unknown date. The tanks are no longer in service but were registered with the OCC. Tank tightness tests were performed annually, and the tanks tested tight. When the tanks were removed on May 7, 1997 ground water was not encountered. The required soil samples were acquired and sent to a state certified laboratory for chemical analyses. The lab results taken from under Tank #2 showed 2.22 ppm benzene, 10.6 ppm Toluene, 2.22 ppm Ethylbenzene, 8.40 ppm Xylene, and 473 ppm TPH. The Benzene and TPH levels were above action levels and were reported to the OCC by phone on May 14, 1997. The tank pit was over excavated and then back filled with clean soil. A sample of the stock piled, over excavated soil was sent to the lab and shown to contain acceptable levels of contamination so it was spread on site. The owner preformed a visual inspection and detected on surface evidence of a release. The inventory records were checked, but the recent record did not substantiate the magnitude of the release. An AGES representative visited the site on May 29, 1997, to perform Site Check and determine if abatement measures were required. Since the loss of fuel appeared to be minor and the tanks had been removed, further contamination from the release was mitigated. A Site Check by AGES confirmed that there was no free product or exposed contaminated soil which would require remediation. A Report on Investigation and Confirmation of a release was submitted on June 3, 1997. Results on the initial site investigation preformed on June 25, 1997 indicated contamination of the native soil and ground water was not above action levels and it was requested that the case be nullified.

4.12 State Registered UST Sites The Oklahoma Corporation Commission UST Notification Database was searched to locate registered USTs located within the ASTM’s minimum search distance of the subject property and its adjoining properties. The Alva Armory owned and operated one 5,000 gallon steel underground storage tank which was installed in 1980. The UST, Identification number of 2505778, was located west of the armory building. On May 14, 1998, the UST was removed and destroyed on site by Caldwell Environmental Associates, Inc. Upon removal of the UST, it was determined that the UST was in excellent condition. A review of soil testing reports dated May 27, 1998, indicates the facility does not exceed the action levels established by the Oklahoma Corporation Commission. The laboratory duplicate sample showed Benzene 13.5 ug/kg, Ethylbenzene 22.95 ug/kg, Toluene 16.67, and Xylene (total) 61.73 ug/kg. The UST was taken to Yaffe Iron and Metal in Muskogee for recycling.

The Closure report for the Underground Storage Tank is provided in Appendix G of this report.

4.13 State Institutional Control/Engineering Control Registries There are no known Institutional Control/Engineering Controls in effect for this property.

4.14 State Voluntary Cleanup Sites The DEQ Voluntary Cleanup Program (VCP) database was searched for VCP sites within the required ASTM search distance of ½ mile of the subject property. No VCP sites are located on or within ½ mile of the Alva Armory. 4.15 State Brownfield Sites

The DEQ Brownfield database was searched for Brownfield sites within the required ASTM search distance of ½ mile of the subject property. No Brownfield sites are located on or within ½ mile of the Alva Armory.

4.16 Oil and Gas Records

DEQ performed a search of oil and gas records from the Oklahoma Corporation Commission’s oil and gas records database. The database did not have any oil and/or gas well records for Section 26, Township 27, North Range 14 West Indian Meridian, Woods County, where the subject property is located.

5.0 SITE RECONNAISSANCE AND INTERVIEWS

5.1 Methodology and Limiting Conditions

A site reconnaissance of the subject property, located at 995 Thunderbird Road, was performed on June 21, 2011. Alisha Grayson of the DEQ met Sergeant Chad Eastin, a member of the National Guard, at the Armory. Sergeant Eastin gave Ms. Grayson a tour of the building and the perimeter of the site answering questions to the best of his knowledge. All areas on the subject property were assessable except for the weapons room. Sergeant Eastin completed a site interview questionnaire on the subject property on previous to the visit on May 24, 2011.

A copy of the completed questionnaire can be found in Appendix H of this report. 5.2 General Site conditions The Alva Armory was built 1979. The following are general site conditions that were investigated on the property.

Aboveground Storage Tanks (ASTs) No ASTs are on the subject property or adjacent properties.

Landfills and/or Dumping No landfills, dumping, or disturbed soil was found on the property.

Impoundments No impoundments are on the subject property and the adjacent properties. Monitoring Wells No monitoring wells are present on the subject property or adjacent properties.

Disturbed and Stained Soils No disturbed and/or stained soils were observed at the subject property. There was no stressed vegetation of concern either.

Seeps The remaining IFR may have the potential for water seepage into the underlying and surrounding soil. Chemical Spills No chemical spills were observed at the subject property. Sergeant Chad Eastin was not aware of any chemical spill occurring at the facility. Farm Waste No farm waste was observed at the subject property.

Known Pesticide Misapplication No evidence of pesticide misapplications were detected during the site visit.

Discharges and Runoff from Adjacent Property Affecting the Site No discharges and/or runoff were observed from any of the adjacent properties that would affect the subject property.

Petroleum Products

No petroleum products are located inside the Armory or on the premises of the property.

Asbestos Since many of the State armories were built before the 1970s, there is a high potential of finding ACM in the armory buildings. The U.S. began banning the use of asbestos in most building products in the 1970s due to studies confirming the harmful health effects caused by exposure to airborne asbestos. ACM may be found in the insulation wrapping of the heating pipes and/or heaters, roofing materials, ceiling tiles, window putty, mastic, and floor tiles.

Lead-Based Paint Lead-based paint was commonly used until 1978, when its use in residential paints was restricted in the United States. It is unknown if the paint inside the building contains lead. However, due to past investigations by DEQ and its contractors, armories built at this time often contain lead-based paint on metal painted surfaces and wooden doors. Lead Dust C.H. Guernsey & Company (GUERNSEY) surveyed the IFR at the Alva Armory on March 18, 2005. Based on the information supplied to GUERNESY, Oklahoma Military Department (OMD) personnel collected wipe samples from the IFR on April 29, 2004. Concentrations within the IFR were 29,160 µg/ft² near the former bullet trap, 69,950 µg/ft² in the middle of the IFR, 784 µg/ft² near the ventilation fan, and 119 µg/ft² at the door leading to the rest of the armory. Mercury The Armory contained several fluorescent light bulbs, which contain small amounts of mercury. Some bulbs had green tips at the ends whereas some did not. The bulbs with green tips have been shown by analysis not to leach mercury and therefore may be thrown in the municipal trash. Exit signs were also observed on the subject property. Due to the age of the armory the exit signs most likely mercury or tritium.

Transformers/PCB Equipment A transformer is located on the adjacent property to the north. PCBs are mixtures of chemicals that form clear to yellow, oily liquids, or mixtures that form white, crystalline

(sand-like) solids and hard resins. They were used in electrical equipment until their regulation in 1977. The fluorescent lighting ballasts may potentially contain PCBs. 5.3 External Observations

The external observations showed no RECs. The outside of the Armory is in good condition. The IFR vent is located on the roof on the south side of the building so no stressed vegetation was found around the vent. No stressed vegetation or stained soils were found on the subject property. Photographs of the external view of the site can be found in Appendix K.

5.4 Internal Observations At the time of the site visit, 21st day of June, Sergeant Chad Allen Eastin was moving all remaining equipment out of the Armory preparing for a final walk through on the 29th of June. According to Sergeant Chad Allen Eastin, all remaining military equipment will be removed before or on the 29th of June. The Oklahoma Military Department will transfer the title to the Alva Armory to Northwestern Oklahoma State University for public purpose use August 11, 2011.

The Armory consists of a Drill Floor, Indoor Firing Range, Restrooms Rooms, Classrooms/Offices, Weapons Room, Kitchen, Mechanical Room, and a hallway in the center of the building, all of which are in good condition.

The Drill floor has a cement floor with 2x4’ ceiling tiles. The ceiling tiles are suspect for asbestos with one area where water entry is apparent.

The Indoor Firing Range (IFR) sand trap remains on site and is a recognized environmental condition (REC) based on lead concentrations. Additionally the tiles on the walls are suspect of asbestos and should be investigated.

The restrooms have 1x1” tiles throughout and are in good condition. The classrooms and offices are in good condition with a few areas where water entry is apparent in the ceiling and a few foundation cracks.

The classrooms and offices have a few obvious foundation cracks in the walls. Additionally a few places have damaged floor tile. Overall these rooms are in good condition.

Access was not permitted into the weapons room. The kitchen is in good condition. The military said that the major appliances will

remain on the subject property once vacated. The mechanical room was in good condition. The pipe wrap is suspected to

contain asbestos. The hallway connects the entire armory and is in good condition.

The building was fairly empty with miscellaneous equipment still remaining. The National Guard was in the process of moving the remaining military equipment for the final walk through on the 29th. There are several recognized environmental conditions (REC) inside the building that need additional investigation. The potential asbestos containing materials (insulated piping) and areas that potentially contain lead-based paint

(walls throughout the armory) warrant further investigation. The indoor firing range will require further investigation and remedial efforts.

5.5 Interviews Sergeant Chad Eastin, a National Guard of the Alva Armory, completed the owner/operator interview questionnaire May 24, 2011. Below is the information obtained from Mr. Eastin.

Sand for the indoor firing range was used and still present on the subject property.

There is no knowledge of environmental concerns on adjacent properties.

One 5000-gallon UST was successfully removed from the subject property. All confirmation sample detections were below the Oklahoma Corporation Commission action levels.

To his knowledge there were no chemical spills on the property. The only

chemicals used at the facility were for housekeeping purposes. These include solvents for cleaning weapons, spray paints for marking, cleaning products and vehicle maintenance fluids.

6.0 FINDINGS Summarized below are the major findings from this Targeted Brownfield Assessment and DEQ’s recommendations. The major findings of the highest environmental concern are presented first.

On March 18, 2005 C.H. Guernsey & Company collected several wipe samples collected inside the IFR contained high levels of lead contamination. The results from the Indoor Firing Range Lead Issues Report and restricted entry into the IFR suggest that additional investigation and remediation of lead inside the IFR be conducted. The IFR constitutes a REC based on the lead concentrations.

One 5000-gallon UST was removed from the west side the Armory property. The OCC

listed one UST as being located at the subject property in its UST database. A former member stationed at the Armory, Jimmy Mitchell, said that one 5000-gallon UST was removed. A review of the soil testing reports dated May 27, 1998, indicates that the facility does not exceed the action levels established by the Oklahoma Corporation Commission. The UST’s elevation is approximately 1420-1430 feet. This location is 20-30 feet below that of the subject properties topographical elevation.

The Oklahoma Water Resources Board’s Custom Map Viewer and The Oklahoma

Corporation Commission data base was searched to locate any known leaking underground storage tanks (LUSTs) sites located within the ASTM’s minimum search distance of a ½ mile of the subject property. Two LUSTs, are listed within the ½ mile radius. Both are located on Northwestern Oklahoma State University property, Facility number 7602048.

Fluorescent light bulbs were found in the light fixtures throughout the Armory building.

The bulbs contain mercury and the light fixtures may contain PCBs. Fluorescent light bulbs with green tips are nonhazardous whereas other fluorescent light bulbs are hazardous. Mercury contained in green tipped fluorescent light bulbs is not leachable through TCLP analysis, which makes them nonhazardous.

Since the Alva Armory was built in 1979 all painted walls inside the Armory building were painted after the lead-based paint restrictions went into effect in 1978. Therefore, there may not be a lead-based paint issue inside the Armory. However, past investigations by DEQ and its contractors at armories built during this time often show lead-based paint on metal-painted surfaces and wooden doors.

There may be a potential for mold growth due to the age of the Armory, and visible water

damage.

No National Priorities List NPL or delisted NPL sites, active Comprehensive Environmental Response, CERCLIS site listings, RCRA CORRACTS and non-CORRACTS TSD listings, ERNS list, State-equivalent NPL or CERCLIS lists, or State landfills and/or solid waste disposal sites were found on the subject property or within the ASTM minimum search radii. No archived CERCLIS site listings, RCRA generators, or VCP sites were found on the subject property or the minimum search radii. No Brownfield sites were found on the subject property or within the minimum search radii either.

The site is not on any Federal or State IC/EC Registries. The Alva Armory

representatives of the property were not aware of any ICs or ECs on the property.

The subject property is on the DEQ’s Site Cleanup Assistance Program list for environmental cleanup.

7.0 OPINION AND RECOMMENDATIONS Based on the findings of this assessment, The DEQ recommends that additional investigation be conducted to evaluate areas of the property that may need future clean-up and remediation.

The IFR needs additional evaluation and remediation efforts.

The building was painted after 1978 when lead-based paint was restricted for use therefore there may not be an issue with the paint in the building. A DEQ contractor will perform a lead survey in the future.

The wall tiles in the indoor firing range and the ceiling tiles in the drill floor are suspect for asbestos containing materials and require investigation. A DEQ contractor will perform an asbestos inspection in the future.

Fluorescent light bulbs were found in the light fixtures throughout the Armory building. The bulbs contain mercury and the light fixtures may contain PCBs therefore will require proper collection and disposal.

8.0 DATA GAPS Section 3.2.20 (ASTM 1527-05) defines a data gap as “a lack or inability to obtain information required by the practice despite good faith efforts of the environmental professional to gather such information.” No data gaps found. No tribal information was obtained for this assessment. No tax records, city directories, or zoning records were reviewed for this report. However, this did not affect the ability of the DEQ to make a recommendation on the subject property. No site limitations were encountered during the site visit. 9.0 CONCLUSIONS The DEQ has performed a Phase I Environmental Site Assessment in conformance with the scope and limitations of ASTM Practice E 1527-05 of property located [995 Thunderbird Road Alva, Oklahoma 73717]. Any exceptions to, or deletions from, this practice are described in Section [10.0] of this report. This assessment has revealed no evidence of recognized environmental conditions in connection with the property except for the following: indoor firing range (IFR); asbestos containing material; florescent light bulbs and fixtures; and the UST removal on the west side of the Armory property. The information provided in this assessment is to assist Northwestern Oklahoma State University in its revitalization planning as well as meet the All Appropriate Inquiry requirement of the landowner liability protections under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA, better known as Superfund – Ref. 2), as provided in the Small Business Relief and Brownfield Revitalization Act of 2002 (Public Law 107-118, Subtitle B – Ref. 3).

Qualifications of Environmental Professionals

Heather Mallory holds a Bachelors and Masters Degree in Environmental Science from the University of Oklahoma. Mrs. Mallory has nine years experience in environmental sampling and remediation. She is and Environmental Programs Specialist with the Land Protections Division of the Department of Environmental Quality. Her responsibilities include: project management of various Voluntary Cleanup sites across the state, NEPA coordinator for the Tar Creek voluntary buyout of residents, conduction and reviewing Targeted Brownfield Assessments, serving on agency-wide GIS policy making committee, and training DEQ Land Protection Division staff on GPS receivers.

Alisha Grayson holds a Bachelors Degree in Landscape Architecture from Oklahoma State University and a Masters Degree in Regional and City Planning from the University of Oklahoma. Ms. Grayson has over five years of field and site programming experience both nationally and internationally from her previous work at EDSA, Fort Lauderdale and TBG Partners, Austin Texas. Currently Ms. Grayson is an Environmental Intern for the Brownfields Unit within the Land Protections Division of the Oklahoma Department of Environmental Quality. Her responsibilities include performing Targeted Brownfield Assessments, GIS applications, and assisting with field work and sampling efforts.
