Documentation The following documents need to be submitted by the bidder interested in participating in the e-Auction to Mjunction services limited prior to the date of the e-Auction. • Statement of Interest duly signed and stamped by bidder • Copy of CMS Pay In Slip duly receipted by HDFC ( for Security Deposit ) CMS Code : 0014030003583 • Each page of the Terms & Conditions to be signed and stamped by the buyer and to be submitted to Mjunction Services Limited. Bidders are requested to submit notarized copies of their SOI's before participating in the e-Auction.

Security Deposit: Non Interest bearing security deposit of Rs.50000 (Rupees Fifty thousand only) in the form of DD / PO in favor of “MJUNCTION SERVICES LIMITED” Payable at Kolkata.

BIDDING MODALITIES Price Bid Basis: In Indian rupees as per unit of Measurement as given in Material List.

Price to be quoted is Basic Ex- location exclusive of excise duty, Sales tax and any other statutory levies . Excise duty, Sales tax and any other Statutory levies as applicable at the time of lifting would be charged in addition. * Any change in Excise duty, taxes and levies applicable at the time of payment/lifting will be applicable.

The E-Auction would be only online sealed bid Online sealed bid tender would be conducted where in each bidder would be giving their best prices for the lot mentioned in Material Annexure. Bidders are advised to quote their best price.

PAYMENT TERMS Payments All payments in form of demand draft ONLY, payable in favour of “TATA STEEL LIMITED “payable at Chennai.

All payments are calculated from date of Lot Confirmation EMD EMD payment is to be made within the time limit as given in Letter of Confirmation. No extension will be provided for the same. EMD Amount: 10 % of Lot Value. EMD WILL BE ADJUSTED IN THE LAST INSTALLMENT.

EPA Sales office to ensure that EMD is not returned to the party , but adjusted only in the last

installment . (for eg :--i.e. if auction is for Oct-Dec, it will be adjusted in last installment of Dec’10) Payment with Interest: Installment payments with interest of 15 paise per Rs 100 per day will be accepted up to four (04) working days from due date

as mentioned in the confirmation letter. This is not applicable for EMD payment LIFTING TERMS Lifting: Lifting date is calculated from the next day of DO Release date. DOs will be handed over to authorized representatives of bidders on receipt of payment from the respective EPAs. Loading Charges AS APPLICABLE Lifting with Ground Rent:

Lifting along with ground rent will be allowed up to four (04) working days from the last date of lifting period. Ground Rent will be calculated on balance Unlifted quantity @ 15 paise per Rs 100 per day.

Forfeiture & Debarment for payment default as per stipulated schedule : The following penalties shall be applicable in the eventuality of a buyer defaulting in making the payment as per the stipulated schedule PER LOT.

1. In the first instance the Security Deposit of the customer shall be forfeited and the firm and the bidder & its sister concern’s shall be debarred for three (03) months.

2. In the second instance the Security Deposit of the customer shall be forfeited and the firm and the bidder & its sister concern’s shall be debarred for twelve (12) months.

3. In the third instance the Security Deposit of the customer shall be forfeited and the firm and the bidder & its sister concern’s shall be debarred permanently.

********** All the past defaults shall be taken into account for this purpose.

Forfeiture & Debarment for Dishonour of Cheques: The following penalties shall be applicable in the eventuality of a payment instrument deposited by a customer being dishonoured. A financial penalty of Rs.1000 per instrument, interest at the stipulated rate for the number of days beyond due date when the payment is made into the CMS Account as well as 2% of the dishonored amount shall be charged from the customer. In case of non-compliance by the bidder, the penalties as given in “Forfeiture & Debarment for payment default “shall be applicable.

LOT TRANSFER IS NOT ALLOWED MATERIAL PURCHASED SHOULD BE THE ONLY MATERIAL BEING LIFTED FROM THE DESIGNATED LOCATION. TATA STEEL HAS THE RIGHT TO CHECK ANY VEHICLE AT ANY MOMENT OF TIME. IF MATERIAL LIFTED DIFFERS FROM THE MATERIAL THAT IS PURCHASED BY THE BUYER, AND THEN THE BUYER WILL BE PERMANENTLY DEBARRED. ALSO TATA STEEL CAN TAKE ANY PENAL ACTION AGAINST THE BUYER. ALL THE MATERIAL LOADED IN THE VEHICLE IS TO BE COVERED IN ORDER TO FOLLOW THE SAFETY COMPLIANCE OF TATA STEEL WORKS. IF THE SAFETY COMPLIANCE IS NOT FOLLOWED THEN TATA STEEL CAN PENALIZE THE BUYER AS PER DEEM FIT. ANY DISPUTE ARISING OUT OF ANY CONTRACT SHALL BE DECIDED IN JAMSHEDPUR BY THE COURTS IN JAMSHEDPUR AND BY NO OTHER COURTS. THE COURTS IN JAMSHEDPUR SHALL HAVE EXCLUSIVE JURISDICTION TO ADJUDICATE UPON ANY SUCH DISPUTE.
