9:15 am - 10:30 am Redrawing of supply chains ‒ potential tax issues

The OECD’s BEPS initiatives have been a major driver of change in the region, affecting many MNE groups. Additionally, external pressures have resulted in manufacturers reconsidering their global manufacturing platforms. This session will provide an overview of the potential direct and indirect tax issues that MNE groups should consider prior to engaging in reorganization and restructuring activities in the region.

10:45 am – 11:45 am OECD Pillar One and Pillar Two ‒ updates

The global economy is rapidly becoming digitalized, and the current international tax framework developed at the turn of the last century is struggling to keep up. Negotiations are underway to achieve a consensus solution to tax challenges arising from the digital economy that would affect more than just digital companies. The OECD Secretariat recently released public consultation documents and held public consultation meetings for the “Unified Approach” proposal under Pillar One and the “Global Anti-Base Erosion” (GloBE) proposal under Pillar Two. This session will explore the key aspects of both proposals, interesting findings from the public comments received, and expected next steps. We will focus on the practical implications of the proposals, including the potential winners and losers under the proposals.

This session will focus on the unilateral direct tax and indirect tax measures that have been introduced by governments in the region. We will look not only at digital companies, but how the most recent developments may impact all MNE groups.

Asia-Pacific tax authorities are increasingly vigilant and have access to an unprecedented amount of information as a result of sharing information amongst one another. Consequently, there has been an increased volume of tax controversy in the region.

This session will focus on the latest trends emerging in tax disputes in the region and discuss prominent cases from various countries. We will also discuss practical strategies to manage risks and best defend your position if an audit occurs, and share some of our experience in negotiating settlements.

3:20 pm - 4:35 pm Transfer pricing ‒ current issues and potential solutions

This session looks at current transfer pricing issues affecting MNEs in the Asia-Pacific, and discusses practical strategies to address these issues, to the extent possible.

Reminders and conditions

Registration is open until Monday, 3 February. Seating is limited, thus registering early is recommended.

Registration conditions for non-TEI members:

1. To guarantee your place, registration fees must be received in full before Monday, 3 February. Payments will be managed by the Baker McKenzie Asia Tax Payments Team in Manila; they will contact you directly by email with the invoice 10 business days from submission of your registration. Please also allow 10 business days for your payment to be processed via cheque or bank transfer. The receipt will be sent by email to confirm your payment.

2. Cancellations received by 3 February will receive a full refund. Refunds cannot be made for cancellations received after 3 February; however, replacement delegates can be accepted in place of those who wish to cancel their attendance. Cancellation and replacement requests must be made through the online system.

3. In the event of cancellation or postponement of the event by Baker McKenzie, fees will be refunded promptly and in full. Baker McKenzie will not be held liable for circumstances beyond its control which lead to the cancellation or variation of the conference.

4. Baker McKenzie reserves the right to refuse entry to the conference. In the event of a registration not being accepted by Baker McKenzie, the total amount paid will be refunded.
