1 INTRODUCTION

1.1 Preamble

This Non-Technical Summary (NTS) is a summary of an Environmental Statement (ES) which accompanies an application by Ibstock Brick Leicester Limited (Ibstock) made to Leicestershire County Council (LCC) for the determination of conditions relating to the winning and working of minerals at Leicester Quarry under the requirements of Section 96, and Section 14 of the Environment Act 1995 (the Act). The procedure under which the application is made is known as a Review of Old Mineral Permissions (ROMP).

The ES presents the findings of the Environmental Impact Assessment (EIA) undertaken in relation to the proposed Scheme for the winning and working of minerals at Leicester Quarry and the restoration of the Quarry Area. The EIA has been prepared in accordance with the Town and Country Planning (Environmental Impact Assessment) Regulations 2011 (as amended).

The scope and preliminary details of the ES have been the subject of an EIA Scoping Opinion issued by LCC dated 3rd September 2014.

The aim of the ROMP procedure is to establish a modern set of operating planning conditions to govern future mineral development at Leicester Quarry. It does not constitute an application for planning permission as the basis of the mineral permission under review is not open to question.

1.2 The Site and Surroundings

Leicester Quarry and Brickworks are located to the immediate north east of Ibstock and to the west of Ellistown and approximately 1.5km south of Coalville (see Figure NTS 1).The Site is bounded to the north by Leicester Road and to the south by Pretoria Road. The western part of the Site is bounded by the village of Ibstock. The Quarry Area covers an area of 74.46 hectares (land within the ROMP boundary). The quarry extracts clays of the Mercia Mudstone Group for the manufacture of bricks in the Brickworks and at nearby Ellistown Brickworks.

Figure NTS 2 shows the Site and its surroundings.

The Site access onto Leicester Road is used to export bricks from the Brickworks and to serve the other on site operations. Clay excavated from the Quarry Area works is transported to the clay stockpiling areas to the west of the Quarry Area by internal haul road only for use at the Brickworks. Clay excavated in the Quarry Area is also transported to Ellistown Brickworks via the internal haul road to Whitehill Road.

The general topography can be described as a rolling and undulating landscape. Leicester Road, to the north of the quarry, lies on an area of higher land that runs between Ibstock and Ellistown at approximately 147m AOD when it leaves Ibstock and rises to a height of approximately 153m AOD at Ellistown. An area of higher land extends west and north west towards the site from Ellistown Farm, south of Ellistown, with levels over 155m AOD. There is little variation in topography and no localised high points in the immediate vicinity of the Site. The base of the quarry workings are presently around 100m AOD.

There are no ecological sites given statutory protection within the boundary of the Quarry Area or within 2km of the Quarry Area. The River Mease Special Area of Conservation (SAC) is located approximately 5.6km to the north west of the Quarry Area.

There are five non-statutory designated sites within 1km of the Quarry Area; two candidate Local Wildlife Sites located in the restored area to the west of the Brickworks that was formerly referred to as the ‘North Quarry’ and three Parish level ecological sites are within the Quarry Area, however two of these were associated with the old route of the (now) diverted Ibstock Brook and the pond into which it previously ran and therefore no longer exist.

1.3 Referencing

The following terms are used throughout the remainder of this NTS and the ES:

Site Comprises the area within the blue landownership line (see Figure NTS 2).

Quarry Area The Quarry Area comprises the area that is the subject of the ROMP application. The Quarry Area includes the area of land that was the subject of planning application 2001/0926/07 and that forms the private haul road between the quarry and Whitehill Road, Ellistown as well as the area of main quarry land that was the subject of planning application 1998/0261/07 (and consequently applications 2001/0929/07 and 2003/0090/07).The Quarry Area is shown as the area of land within the red line (see Figure NTS 2).

Brickworks The Brickworks are the Leicester Brickworks located to the west of the Quarry Area and encompass the brick factory and associated area (offices, stockyards etc.) plus the Forticrete Block plant to the north of the site (see Figure NTS 2)

Scheme The Scheme describes how Ibstock wishes to proceed with the implementation of the current mineral planning permissions.

Company The Company is Ibstock Brick Leicester Ltd.

Existing Conditions The conditions issued by LCC and attached to the aforementioned mineral planning permissions.

ROMP Conditions The conditions proposed by Ibstock in this review (see Appendix 1 of the Supporting Statement).

1.4 The Scheme in Brief

In summary, the Scheme seeks to enable continued extraction and related development in accordance with such amendments to the details approved under the existing mineral planning permissions as are necessary to ensure that environmental impacts are mitigated appropriately, and which improve the overall working method.

More specifically, and with reference to the ROMP conditions, the Scheme includes:

• soil stripping and storage of soils in discrete stockpiles for screening and storage prior to reuse in restoration of the Quarry Area;

• continued clay extraction from within the Quarry Area in Phases 2, 3 and 3a as identified on Figure NTS 3;

• mineral excavation to the base of the Mercia Mudstone Group (lying at a general level of about 98 metres Above Ordnance Datum (AOD) and estimated maximum depth of 94 metres AOD);

• minor amendments to the limit of extraction to take into account the diverted route of the

stream (Ibstock Brook) within the Quarry Area (see Figure NTS 3);

• an end date for mineral extraction of 2059 to take account of the reserve and resource availability in the ROMP area;

• continued export of clay from the Quarry Area to Ellistown Brickworks via the haul road (up to the approved limit of 40 HGV loads per day) (see Figure NTS 2);

• progressive backfilling of the factory process lagoon (L2) to the east of the clay stockpiles and its replacement by the formation of a smaller and shallower lagoon in the south western corner of the stockpiling area;

• phased restoration of areas of completed mineral working;

• restoration of the final worked out site (reproduced as Figure NTS 4);

• water pumping and other ancillary quarrying activities;

• for the avoidance of doubt the scheme excludes the use of blasting;

• continuation of good practice for the control of noise and dust;

• a scheme for archaeological investigation prior to soil stripping unworked areas; and

• the aftercare of restored areas.

1.5 Scoping and Methodology

LCCs Scoping Opinion dated 3rd September 2014 identified the key potential environmental impacts to be addressed in connection with the Scheme to be:

• Biodiversity and Ecology;

• Flood Risk; and

• Landscape and Visual.

The following topics have been dealt with in outline only:

• Transport;

• Noise;

• Air Quality;

• Water Environment (excluding Flood Risk);

• Historic Environment;

• Land; and

• Other issues (including amenity, socio-economic and cumulative and combined impacts)

The ES has been prepared in general accord with the EIA Scoping Opinion adopted by LCC.

The Scheme includes a range of measures designed to reduce or prevent significant adverse environmental effects arising (mitigation measures). The assessment of effects has taken into account all mitigation measures that form part of the Scheme and to which Ibstock is committed. These measures form part of the description of the Scheme provided in the ES.

2 ENVIRONMENTAL EFFECTS

Technical assessments have been prepared by environmental specialists in relation to those issues considered by LCC to be the key environmental issues, full reports are provided in the appendices of the ES Main Text (Volume 2). Each assessment includes a statement on the methodology employed, the environmental baseline relevant to the Scheme, an assessment of impacts, the mitigation employed or required and a concluding statement of the likely level of environmental effects of the Scheme, taking into account the mitigation proposed, and the proposed ROMP Conditions (see Appendix 1 of the Supporting Statement).

The severity or magnitude of environmental impacts are categorised as “Major/High/Substantial/Severe”, “Moderate/Medium”, “Minor/Low/Slight” or “Negligible”, dependent on the criteria set out in the individual topic chapters.

A short summary of the findings of these assessments is provided below:

2.1 Ecology

The ecological assessment includes a Phase 1 Habitat survey of the Quarry Area and a desk based review of local habitats and recorded species. Where the Phase 1 survey identified a requirement, further survey work was undertaken.

The Phase 1 survey found that the continued working of the Quarry Area will result in the loss of arable land, a small number of hedgerows and small areas of plantation woodland, scattered scrub and grassland.

The two trees that will be lost to quarrying within the next 6.5 years have both been surveyed and no signs of roosting bats were found. Testing of a flooded void within the Quarry Area identified that great crested newts do not represent a constraint to the continued working of the Quarry Area. Suitable habitat for reptiles and water vole occur along the Ibstock Brook and the three lagoons to the north west of the Quarry Area, however no reptiles or water voles were recorded during the walkover survey. The impact of the Scheme on Badgers and any mitigation measures to be undertaken is discussed in a Confidential Annex B6, Appendix B of the ES Main Text.

No statutory or non-statutory sites designated for nature conservation should be directly or indirectly affected as a result of the Scheme, with the exception of the Parish Site (to the north of the Ellistown clay stockpile) that will be lost as Phase 3 and Phase 3a is worked.

Mitigation measures recommended the adoption of best practice measures to avoid potential seasonal impacts on possible species and habitats, including:

• clearance of vegetation between September - end March to avoid possible nesting birds. Where this cannot be practised, prior to undertaking any work, a check would be made for nesting birds and if any are found, a stand-off established and the area left undisturbed until the chicks have fledged.

• should there be a need to disturb the habitat identified as suitable for reptiles; the area in question should be rendered unsuitable for reptiles by cutting the vegetation short a week or so before it is to be affected;

• should the felling of the trees that were inspected be delayed until after spring 2015, they should be re-checked before felling.

On the basis of the above measures the impact of the Scheme on protected and notable species and on habitats has been assessed as being Negligible. The progressive restoration

will provide replacement habitat for the loss of predominantly arable land with low conservation interest and will therefore result in a net biodiversity gain.

2.2 Landscape and Visual Impact

A detail Landscape and Visual Impact Assessment (LVIA) has been undertaken. Overall the Scheme will result in very localised, short duration, significant visual effects (moderate) for three locations on the site boundary during soil stripping (see Figure C1, Appendix C for viewpoint locations). Viewpoints 2, 3 and 4 are assessed as having a moderate / major visual effect during quarrying. Although visual effects during quarrying would be of significance for these locations the extent would be localised and primarily relate to obstruction of long views as a result of soils stores/screen planting. This is however unchanged from the situation as identified as part of the 1998 ES. At a site level there would be loss of existing landscape elements (trees/hedges/agricultural land) but the existing planting and screening already in place, the additional of soil screening / storage mounds as well as the progressive restoration of the Quarry Area will strengthen and extend characteristic landscape elements present in the wider landscape.

The distance of the Quarry Area from viewpoint 5 across the intervening fields and hedgerows reduces the visual impact of the quarry activity from a considerable number of properties along Whitehill Road to the east and Leicester Road to the north. Coupled with the distance, the maturing woodland on the north eastern side of the Ibstock Brook also offers screening.

Viewpoint 6 represents a worst case view at a break in the existing hedgerow. The majority of the length of footpath / bridleway N61 is screened by a mature hedgerow to the east of the Quarry Area which will be retained throughout the development. Viewpoints 7 – 10 are assessed has having a minor / neutral / negligible effect during soil stripping, quarry and post restoration.

Existing mitigation in the form of designed blocks of perimeter planting is now maturing such that it forms an effective screen and a contribution to the wooded character of the landscape, particularly on the northern boundary of the Quarry Area. Along the eastern side of the Quarry Area the existing mature hedgerow will be retained and will continue to provide the initial visual barrier to views along the length of N61.

Figures 4b and 4c of the ES show the continuation of a soil storage bund around the southern and eastern boundaries of the Quarry Area which will provide screening both from Pretoria Road to the south the footpath / bridleway N61 to the east. The mature hedge along the majority of the route of N61, supplemented by the soil screening landform, will provide significant visual screening.

The proposed Restoration Masterplan as shown on Figure 5 of the ES is designed to integrate the quarry workings into the landscape.

No significant effects on landscape character have been identified of the study area are identified at any stage providing that the existing screening is retained, the proposed screening is carried out and that the progressive restoration is achieved as detailed. In conclusion there is no over-riding landscape or visual reason, identified by this LVIA, to suggest that the development would cause significant harm to landscape or visual amenity.

2.3 Water Environment (Including Flood Risk)

A formal flood risk assessment has been undertaken in accordance with the requirements of the National Planning Policy Framework. The Quarry Area lies within the Environment Agency’s delineated Flood Zone 1 and is therefore at low risk of flooding from fluvial and tidal sources. The Scheme is classed as ‘Less Vulnerable’ (minerals working and processing (except for sand and gravel working)) and as there are no alternative sites to be considered no Sequential Test is required.

The flood risk assessment considers the existing flood risk posed to the site from all sources and the effect of the continued working of the quarry on flood risk, both to the Quarry Area itself and neighbouring areas. The impacts of climate change on flood risk over the lifetime of the quarry are also considered.

The existing flood risk from surface water flooding, groundwater sources and sewers is considered to be low and the Environment Agency risk of flooding from reservoir maps shows that the Quarry Area is not considered to be at risk from reservoirs or artificial water bodies. The existing flood risks from overland flow, groundwater sources and sewers are considered to be low.

The relocation of the factory process lagoon (L2) will not impact on its functionality and as this lagoon is not hydraulically connected to the other water features in the Quarry Area there will be no impacts on the water environment within the Quarry Area as a result of these changes. As Ibstock does not propose to alter the current methods of water management with regards to the quarry workings, is not considered likely to generate any new impacts on groundwater or surface waters.

The assessment of groundwater levels has previously determined the final restoration water level as shown on the currently approved restoration scheme and as shown on the proposed Restoration Masterplan (reproduced as Figure NTS 4).

No specific mitigation measures are considered necessary and the impact of the Scheme in relation to the water environment and flooding is considered to be Negligible.

2.4 Historic Environment

A review of the potential impacts on the historic environment (potential archaeological assets) associated with mineral extraction within the Quarry Area has been undertaken in outline only.

The Scheme includes areas that have not yet been soil stripped and which therefore have potential for archaeological finds. The archaeological survey undertaken and included in the ES accompanying planning application 1998/0261/07 established the baseline situation and this has not changed during the intervening period.

Although the assessment undertaken in 1998 did not include Phase 3a, it is relevant to note that this area is not the subject of any historic environment designations and there are no such designations in the immediate vicinity. It is therefore considered that a similar requirement to undertake a programme of archaeological works prior to any soils stripping in Phase 3a would be sufficient and that any requirement for a further archaeological assessment can be dealt with in this way.

An Archaeological Written Scheme of Investigation based on those previously submitted to and approved by LCC is included at Appendix F of the ES Main Text). It is proposed by the ROMP Conditions that a similar scheme detailing the same methodology would be submitted for approval prior to any works undertaken on any unworked land during the proposed lifetime of the Quarry Area.

No additional mitigation measures are proposed on the basis that the current controls are included in the ROMP Conditions as set out in Appendix 1 of the Supporting Statement (to relate to any further soil stripping to be undertaken within the Quarry Area). Overall it is assessed that the impact of the Scheme on the historic environment would be Negligible.

2.5 Land

A review of the existing situation with regards to land use and soils within the Quarry Area and the impact of the Scheme on land that is currently unworked has been undertaken.

Soil stripping will take place in Phases 2, 3 and Phase 3a and all soils will continue to be retained within the Quarry Area and will be reinstated as part of the restoration scheme. Provided the soils are handled and stored as set out in Appendix G of the ES Main Text and in accordance with the relevant ROMP Conditions as detailed in Appendix 1 of the Supporting Statement, it is considered that the Scheme will not impact on soil quality within the Quarry Area or impact on the use of the in-situ soils in the restoration of the Quarry Area.

No additional mitigation measures are proposed.

Overall it is assessed that the Scheme will not impact on the quality of soil in the Quarry Area, provided that the appropriate measures continue to be taken.

2.6 Air Quality

A review of air quality and dust impacts associated with continued mineral extraction and the subsequent restoration of the Quarry Area has been undertaken.

There are no local authority Air Quality Management Areas (AQMAs) in the vicinity of the Quarry Area (indicating that local air quality is good). A Dust Assessment was undertaken and included in a previous the ES at the Site. The assessment concluded that if the recommended mitigation measures were adopted, any dust occurrence event would be limited, of short duration and unlikely to occur and that the impact of the development would be minimal. No complaints due to dust or other air quality issues have been received by the company in recent years.

There will be a distance of approximately 500m between Phase 3a and the nearest property to the east of Quarry Area at Clay Lane and there should therefore be no impact from dust deposition at this location.

Specific measures to minimise adverse impacts from dust, both from the quarrying and from the use of the clay haul road include:

• internal haul roads (including the clay haul road) to be kept moist particularly in dry and/or windy conditions;

• watering of dry exposed areas and materials in dry windy conditions; and

• temporary suspension of activities in response to complaints from neighbouring residents.

The ROMP Conditions (see Appendix 1 of the Supporting Statement) include all of the same measures and therefore there are no changes proposed by the Scheme. No additional mitigation measures are therefore proposed and overall it is assessed that the impact of the Scheme would be Negligible for air quality and for dust.

2.7 Traffic and Highways

A review of the existing situation with regards to traffic associated with the Scheme and the impact of the Scheme in transport terms has been undertaken.

The proposed Scheme will not result in any changes to the current traffic generated and the ROMP Conditions (see Appendix 1 of the Supporting Statement) include all of the same traffic management measures and therefore there are no changes proposed by the Scheme.

On the basis of the extent and scope of the ROMP Conditions and the limitations imposed that do not propose any changes to the current situation, no further mitigation measures are proposed.

Overall it is assessed that the impact of the Scheme would be Negligible for traffic and highways.

2.8 Noise

A review of noise impacts associated with mineral extraction within the Quarry Area and the subsequent restoration of the Quarry Area has been undertaken in outline only.

There have been no noise related complaints received by the company in recent years.

Noise assessments have been undertaken in relation to previous planning applications at the quarry. The results of the assessments are those that informed the current noise limits set out in the existing conditions within which Ibstock operate.

The working of Phase 3a does reduce the distance between mineral excavation activities and the properties on Clay Lane located to the east of the Quarry Area by approximately 100m; however, this area is approved for surface stockpiling activities of clay and soils and Ibstock will continue to operate within the noise limits set out in the ROMP Conditions (see Appendix 1 of the Supporting Statement).

No further mitigation measures are proposed on the basis that the current controls enforced by the Existing Conditions are retained and included in the ROMP Conditions and that they are still relevant in the context of more recent mineral planning guidance.

Overall it is assessed that the impact of the Scheme will not result in noise levels in excess of the derived noise limits, provided that the appropriate measures continue to be taken.

2.9 Other Issues

2.9.1 Amenity and Public Rights of Way

The route of footpath / bridleway N61 within the Quarry Area will be retained for the duration of the Scheme, as will the permissive route that connects N61 with Leicester Road further to the west (see Figure NTS 2).

The Scheme will bring the excavation works closer to footpath / bridleway N61 (see Figure NTS 2) potentially impacting on the amenity use of the bridleway through an increase in disturbance to users. However the existing approved and retained proposed positioning of soil storage mounds/bunds along the eastern boundary of the Quarry Area will provide a screen between the footpath / bridleway and the excavation area.

The Restoration Masterplan (reproduced as Figure NTS 4) also includes for a further permissive (or formal) route connecting Q89 on Pretoria Road with other rights of way to the north of the Quarry Area creating fully circular route and offering addition connectivity to users.

2.10 Socio-economic

Around 300 full-time staff are directly employed at the Site - most of whom live locally. The company’s business also supports many other jobs in the local service sector and at local industries which are reliant on the products manufactured at the Brickworks.

Although the Scheme will not result in any changes to the number of employees at the Site it will result in clay efficient extraction taking place over a longer period of time resulting in greater security of supply of raw materials for the adjoining Brickworks – thereby generating ongoing employment and other economic benefits.

2.11 Cumulative and Combined Effects

The findings of the ES were considered to determine if there were any potential combined impacts arising from the proposed Scheme.

If the current controls in place continue to be adhered to and the proposed mitigation measures are put in place then the impacts of the Scheme are considered to be Negligible when compared to the baseline of the existing quarry. There are no combined impacts that would result in a significant impact as a result of the proposed Scheme.

In order to identify developments to be assessed in cumulative terms, a search has been undertaken using the LCC and North West Leicestershire District Council on-line planning search facility, and existing and emerging policy and background documents.

The online planning map search for planning applications made in the last six months to North West Leicestershire District Council did not identify anything that would give rise to cumulative impacts with the proposed Scheme.

No specific mitigation measures are therefore considered necessary risks associated with Combined and Cumulative effects are considered to be Negligible.

3 ALTERNATIVES

The ES includes a review of the alternatives considered in determining the Scheme and why the final options were adopted. The alternative issues considered, include the:

• extent of mineral excavation;

• relocation of factory process lagoon; and

• restoration.

No new alternatives not previously considered were identified.

4 CONCLUSIONS

This ES undertakes a comprehensive assessment of the environmental implications of the proposed Scheme, including the proposed ROMP Conditions of which this NTS only provides a summary. It includes assessments of a range of environmental issues and considers the effect of mitigation measures proposed within the context of the ROMP procedure.

Implementation of the mitigation measures defined therein will mean that residual effects should be minimised to an acceptable degree.
