TEGoVA General Assembly – Marseille – 28 October 2017
Draft Minutes The meeting was declared open at 9h30 under the chairmanship of Krzysztof Grzesik (PFVA). Those present or represented at the General Assembly are indicated in Annexes I and II. Voting rights share-out chart in Annex III. Proxies from BDVI to BVS, ÖVI to ARE, IsIVI to ASSOVIB and CCA to PFVA.
The Assembly recognised itself as validly constituted and fit for deliberation. The General Assembly nominated Denis Pelouse (CEIF-FNAIM) and Cédric Perrière (CNEI) as Secretary and as Scrutineer, respectively. I. APPROVAL OF THE MINUTES OF THE LAST GENERAL ASSEMBLY The minutes submitted to the delegates under t17-16 of 14.06.2017 were approved without amendment.
II. TEGoVA FINANCES Budget for the 2018 Financial Year The Treasurer, Jean-François Drouets (AFREXIM), presented the financial situation of the current
year. The year will close with an important surplus. The annual subscriptions have been cashed with the
exception of one member and the expenses are respecting the budget.
Regarding 2018, Jean-François Drouets announced a healthy financial budget. An amount of € 300.000
is expected from the annual subscription fees and € 460.000 from the complementary subscription fees
originated by the REV, REVC and TRV programmes.
The budgeted and allocated expenditure of € 576.000 is presented in the annexed chart without Belgian
VAT to show the weight of the VAT in the budget which reaches almost € 100.000.
The Treasurer announced an estimated € 100.000 budgetary surplus which will increase the reserves of
TEGoVA.
The budget includes the balance of the one-off income and expenses coming from the REVASE project
financed by EU funds.
The 2018 income amounts to € 792.896 and the expenditure budget amounts to € 792.896. The budget
is therefore balanced.

The 2018 budget and the 2018 Members’ subscriptions were approved by unanimity (see Budget in
Annex IV).
Note from the Secretariat: Correction: The income chart and the expenditure chart of the 2018
budget presented in Marseille include a couple of wrong figures; the charts have been amended
accordingly for these Minutes.
Patrick Lotthé (CSN) asked whether, given these favourable finances, it would be envisageable to reduce membership subscriptions. Jean-François Drouets answered that TEGoVA needs the income to ensure its reserves and security needs. Krzysztof Grzesik pointed out that the level of subscriptions has been frozen for a decade, so in real terms it is falling. François Isnard (Managing Director) added that it would not make sense or be fair to ask the AMAs, C-AMAs and R-AMAs to shoulder a disproportionate amount of TEGoVA’s costs. TEGoVA works for everyone. III. REV 1. Audit reports regarding ANEVAR and BDVI
Roger Messenger (IRRV), Chairman of the Recognition Committee, reported. The Board had
considered the Recognition Committee’s favourable audit conclusions regarding ANEVAR and BDVI
and had decided to maintain their status as awarding bodies with the right to issue REV certificates of
recognition to individual valuer members, and to recommend ratification thereof by the General
Assembly.
The General Assembly unanimously ratified the Board’s approval of the Asociația Națională a Evaluatorilor
Autorizați din România (ANEVAR) and the Bund der Öffentlich bestellten Vermessungsingenieure e.V. (BDVI) to continue to issue REV certificates to individual valuer members.
2. Assessment report regarding NAVM, UABVS and USOA Roger Messenger reported. The Board had considered the Recognition Committee’s favourable
assessment conclusions regarding NAVM, UABVS and USOA and had decided to approve them as
awarding members of the Recognised European Valuer status (AMA), and to recommend ratification
thereof by the General Assembly.
The General Assembly unanimously ratified the Board’s previous approval of the National Association of
Valuers of Montenegro (NAVM), the Ukrainian Association of Bank Valuation Specialists (UABVS) and the
Ukrainian Society of Appraisers (USOA) for admittance by TEGoVA as awarding members of the
Recognised European Valuer (AMA) status.
To general applause, Krzysztof Grzesik handed over the TEGoVA/NAVM Agreement to Milan
Mirković, the TEGoVA/UABVS Agreement to Aleksey Kalapusha and the TEGoVA/USOA

Agreement to Valery Yakubovsky, respectively President and Members of the Board of the new awarding
member associations.
IV. REVC 1. Audit report regarding ATASA
Roger Messenger reported. The Board had considered the Recognition Committee’s favourable audit
conclusions regarding ATASA and had decided to maintain its status as awarding body with the right to
issue REVC certificates of recognition to valuation company members, and to recommend ratification
thereof by the General Assembly
The General Assembly unanimously ratified the Board’s approval of the Asociación Profesional de Sociedades
de Valoración (ATASA) to continue to issue REVC certificates to valuation company members.
2. AEV Roger Messenger reported. The Board considered the Recognition Committee Chairman’s requirements and favourable comments regarding AEV and decided to approve AEV as awarding body with the right to issue REVC certificates of recognition to valuation company members “subject to contract” (TEGoVA/AEV Agreement), and to recommend ratification thereof by the General Assembly. The General Assembly unanimously ratified the Board’s decision. V. TRV
1. Assessment reports regarding NVM, VastgoedPRO and VBO MAKELAAR Roger Messenger reported. The Board had considered the Recognition Committee’s favourable assessment conclusions regarding NVM, VastgoedPRO and VBO MAKELAAR and had decided to approve them as awarding members of the TEGoVA Residential Valuer status (R-AMA), and to recommend ratification thereof by the General Assembly. The General Assembly unanimously ratified the Board’s approval of the Nederlandse Vereniging van Makelaars en Taxateurs in Onroerende Goederen (NVM), VastgoedPRO and VBO MAKEMLAAR for admittance by TEGoVA as awarding members of the TEGoVA Residential Valuer (R-AMA) status. To general applause, Krzysztof Grzesik handed over the TEGoVA/NVM Agreement, the TEGoVA/VastgoedPRO Agreement and the VBO MAKELAAR Agreement, to Sebastiaan Roggeveen, Roland Knoester and Gijs de Jager, respectively Valuation Expert, Managing Director and Honorary Member of the Board of the new residential awarding member associations.

VI. AVMs 1. Dutch law allowing use of AVMs at initiation without valuer involvement for properties
serving as collateral for the mortgage loan – TEGoVA campaign to get the European Commission to investigate incorrect transposition of the Mortgage Credit Directive (MCD) and infringement of the Capital Requirements Regulation (CRR)
Michael MacBrien (Secretariat) reported on progress in the campaign. Never before had a political effort involved so many members of TEGoVA. A stunning proportion of TEGoVA’s EU membership had gotten one or more of their Members of the European Parliament to write to Commission Vice President Valdis Dombrovskis, Vice-President for the Euro and Social Dialogue, Financial Stability, Financial Services and Capital Markets Union (and therefore covering both the MCD and the CRR). Some of the MEPs had also put questions to the Commissioner in Parliament. As a result, when TEGoVA again approached the Commission, they immediately accepted to meet. On 18 September four Commission Officials met with Krzysztof Grzesik, Hans Van den Heuvel (VBO Makelaar), Jeroen Dewispelaere (& De Bandt, TEGoVA’s EU law firm), and Michael MacBrien. Almost no time was devoted to TEGoVA’s legal arguments as the officials were well prepared. Instead, the time was spent explaining what AVMs are and the major perils for consumer protection that arise when they are used to produce valuation reports without any involvement by a qualified valuer. A major talking point was the question of AVM accuracy. The point was made that for traditional AVM work such as bank audits or mass appraisal for local taxation, only averages matter, but that averages offer no comfort to home buyers seeking to know the real market value of their mortgage collateral, the most important purchase and debt of their existence. It was pointed out that there is one field in which European and U.S. AVM manufacturers are on the same page: their clear public warnings that their outputs are not valuations, usually accompanied by an encouragement to homeowners to supplement their information with a professional valuation. TEGoVA’s view was that consumers have a particular need for clarity on the value of their homes thanks to sound appraisals by qualified valuers. The Commission officials found the arguments convincing, and said would take them forward in their further talks with the Dutch government. Michael MacBrien warned that all this was still a long way from the Dutch government and Parliament deciding to amend their legislation, but at least TEGoVA finally had traction. 2. Adaptation of EVS to the regulatory challenges raised by AVMs Krzysztof Grzesik said that the least that TEGoVA can do in this situation is ensure that the Blue Book be a pillar of valuation by qualified, independent valuers as opposed to stand-alone machines. EVS 2016 needed immediate strengthening in this regard. He proposed to the General Assembly that it ratify the Board’s decision to make the draft EVS 6 – Lead writer Michael MacBrien – and EVGN 11 – Lead writer Danijela Ilić – an immediately operational part of EVS. He then opened the debate.

Wolfgang Kälberer (vdp) said that such an initiative was breaking with EVS philosophy by developing a standard for purely policy reasons. EVS and EVSB should be at a distance from policy. A more balanced text was needed. Sometimes AVMs are good, and their strengths must be recognised. Some AVMs are fed transaction prices and there is nothing more accurate than that. He further doubted that a standard would be the right instrument. Leandro Escobar (ATASA) said that he supported TEGoVA’s campaign, but nonetheless he fully supported Wolfgang Kälberer’s view, in particular that a standard is not an proper instrument for addressing the valuer/AVM relationship. Bernhard Bischoff (BVS) said that the standard as presented here wasn’t ready because there were too many mistakes concerning, inter alia, the treatment of AVMs and Market Value or the use of AVMs by the financial system. However, he said that he would be unable to provide any alternatives for some time and the discussions with Krzysztof Grzesik and others on the nature of these ‘mistakes’ did not lead to anyone agreeing with him. Patrick Davitt (IPAV) said that he had sought election to the Board of TEGoVA so as to represent his members. IPAV has 600 valuers. They make valuations. His members expect TEGoVA to defend them. A standard is the only adequate instrument because it is the only one that valuers are under obligation to comply with. There have to be strict rules for the use of AVMs. Marco Kreuger (NVM) said that TEGoVA and its Dutch members are not fighting technological progress or the Dutch government. Theirs is rather a campaign for accuracy in valuation. The Dutch law is a misinterpretation of what good standards are. What is needed is clarity via a Standard. TEGoVA needs EVS 6 not to battle with government but to fight for good standards. Hans Van den Heuvel (VBO Makelaar) said that this is not about politics but about the valuer. TEGoVA should react to the world around it. The ‘Five Tables of the Law’ need to respond to new AVM events. TEGoVA is reacting to market developments, not politics. Roger Messenger said that a standard is TEGoVA’s and the Blue Book’s most powerful tool and therefore well suited for this purpose. He saw no downside. Wolfgang Kälberer said that European Valuation Standards are supposed to be independent from fluctuations. Markets are volatile. They can change quickly. A Guidance Note is more appropriate as it serves to advise professionals on how to deal with professional tools. Krzysztof Grzesik said that the valuation profession had a chance, here today, not to oppose progress,
but to embrace it by integrating AVMs into its standards, and it should do so without fear of upsetting
the banking lobby which for its part pays little attention to the views of TEGoVA. He also noted that
the European Mortgage Federation has endorsed the use of AVMs in co-operation with the European
AVM Alliance. What is TEGoVA supposed to do? Stay quiet?
He put three matters to a vote:
1. Approval of EVS 6 unchanged to be an integral and immediately operational part of EVS 2. Approval of EVGN 11 unchanged to be an integral and immediately operational part of EVS 3. Immediate termination of the current EVIP 6 Automated Valuation Models (AVMs)

VII. EUROPEAN VALUATION STANDARDS BOARD (EVSB) Michael Reinberg (ARE) EVSB Chairman, reported on work in progress. He reviewed:
• Minimum Valuation Report for Residential Property
• Valuation Review
• New definition of ‘Market Value’ replacing ‘arm’s length transaction’ (which had wreaked havoc, not just with translations of EVS, but also with official EU versions of CRR) with an integrated, harmonised definition of what ‘arm’s length transaction’ really means.

• EVIP on Inalienable and Unassignable Property – Lead writer Jeremy Moody Angelos Simos (AVAG) presented the EVGN on Listed Residential Property. Michael Reinberg said that the EVSB considered its work on these topics to be completed and the TEGoVA Board had signed off, but he stressed that, unlike the AVM work, this work does not yet become operational and part of EVS. This will only happen when the General Assembly ratifies the complete package of the next edition of EVS, and all members are free to comment at any time between now and then. VIII. EUROPEAN VALUATION PRACTICE AND METHODOLOGY BOARD (EVPMB) Philippe Guillerm (AFREXIM), Chairman of the EVPMB, reported:
• MLV: The TEGoVA Board had decided that the EVPMB’s work should be put on hold pending
the Commission’s tabling of a Proposal for a Covered Bond Directive in February 2018. Given
that valuation as a whole will be covered by the Directive, with MLV for funding and for lending,
the TEGoVA Board had agreed that TEGoVA should not act independently from, and in
ignorance of, this.
• EVIP 5 – Valuation Methodology: The EVPMB will provide more detail on: the comparative method, the income approach, the cost approach and harmonising yields.
• EVIP 3 – Apportionment of Value between Land and Buildings: There is a split between land and buildings on primary cost-based valuations which is done for depreciation purposes and is signed off by the client. The apportionment is being increasingly challenged by accountants. The EVPMB will define a methodology for apportioning the split.
• Cost-based Valuations for Specialised Buildings: In some places valuers turn to cost-based valuation where it appears easier than MV, even if comparables are available. The EVPMB will establish a clear hierarchy of the different methods of valuation:

Valuer business streams for those involved in property taxation Roger Messenger asked members to inform the Secretariat of persons in their organisations in charge of property tax. The Chairman thanked Philippe Conté, Denis Pelouse and Emmanuelle Gauthier, respectively President, Deputy President and Member of the Board of FNAIM, the organisers of the event, and presented them with a silver plate to mark the occasion. The meeting ended at 15:15.
