INSTRUCTIONSPlease note the following:1. Tenderers are advised to read the entire Government Tender Bulletin. No officer of any Procurement Activity

will be held responsible for loss of a potential opportunity to tender due to possible incorrect categorising of requirements.

2. Requests are categorised separately for tenders with estimated values of less than R75 000 and more than R75 000.

3. Tenders for the procurement of supplies, services and disposals are categorised as follows:

4.Tender documents are generally available in English only.5. The addresses at which tender documents may be obtained and to which tenders should be posted, appear in

Annexure 1.5.1 The address where a document is available from and where it must be submitted to may differ.5.2 Tenderers should read the Conditions of Tender issued by the different tender boards. Mostly tenders that are

submitted after the closing time will not be allowed for consideration.6. The financial category for construction related supplies and services are the following:

A: To R300 000B: R300 000 to R2 000 000C: R2 000 000 to R6 000 000D: Above R6 000 000

6.1 Where security is required particulars thereof are indicated in the tender documents. However, security is mostlynot required for services with an estimated value of less than R100 000.

7. Please note that all documents issued by the Department of Public Works will be sold as follows:

• R50,00 per set for all services with a pre-estimated value from above R100 000 to R300 000.

• R100,00 per set for all services with a pre-estimated value above R300 000 to R2 000 000.

• R200,00 per set for all services with a pre-estimated value above R2 000 000.These amounts will not be refunded. Only cash or postal orders will be accepted.

7.1 No documents will be exchanged.8. Tenders must be on the official tender forms which must be filled in and completed in all respects.9. Tenders must be submitted in sealed envelopes.10. Separate envelopes must be used for each tender invitation.11. The address, tender number and closing date must appear on the front of the envelope.12. The name and address of the tenderer must appear on the back of the envelope only.

13. Also consult at least the two previous issues in order to obtain full particulars of all current tender invitations.

TERMS OF REFERENCE FOR INDEPENDENT THIRD PARTY

IN CONNECTION WITH MARKETING-OF-PETROLEUM ACTIVITIES RETURN (MPAR)

1. Scope of Work:

These terms of reference are based on the Guidelines for the compilation of the MPAR.

The companies shall nominate an industry-agreed contact to act as the liaison between the companies, the IndependentThird Party and the Department.

MPAR’s are submitted to assist the Department of Minerals and Energy in the profit monitoring of the marketing-of-petroleum activities of the oil industry.

The Third Party will receive from each company covered by MPAR, within time guidelines laid down in MPAR, the schedules and explanatory notes including a certificate from its external auditors, as set out in paragraph 106 of MPAR.

The Third Party will, within two months of receiving all the items referred to above, submit a report to the Department, whichincludes:

Aggregated summary schedule : Return on assets.Aggregated schedule 1 : Allowance incomeAggregated schedule 1.4 : Allowance income adjustmentsAggregated schedule 2 : Allowance assetsAggregated schedule 2.3 : Allowance assets adjustments

The Third Party will take into account any ‘Industry adjustment’ the Department may notify him of (e.g. Slate, assets) butwill notify the industry representative of any such adjustment.

If, in the opinion of the Third Party any item in the certificate received from the external auditor (per schedule 4 of MPAR)requires notification to the Department, they will inform the Department without identifying the company involved. Such itemsmay include (but are not limited to):

• Incomplete certification in terms of the Guideline• Audit qualifications (relating to a company’s annual financial statements (AFS)]• Unusual accounting policies in the AFS• Changes in accounting policies in the AFS

If, in the opinion of the Third Party, any items included in the explanatory notes need to be notified to the Department, hewill inform the Department without identifying the company involved.

The Third Party will compare company’s information to that submitted the previous year. Any items, which in the opinion ofthe Third Party appears materially out of line, will be notified to the Department without identifying the company involved.

The Third Party will compare each company’s information to the information submitted by other companies in respect ofthat year. Any item which, in the opinion of the third Part appears materially out of line, given the past performance of that company relative to other companies, will be notified to the Department without identifying the company involved. The ThirdParty may bring to the attention of the Department any other items he feels appropriate.

If this does not relate to a specific company the industry representative will be notified prior to it being notified to theDepartment.

The Third Party will notify each company of any company specific item under 5, 7, 6 and 8 above prior to it being notifiedto the Department, unless in the opinion of the Third Party, disclosure of figures may result in competitive information relatingto other companies being disclosed in which case the figures may be edited out. A reasonable amount of time will be allowedfor discussion between the company of the Third Party on any items, which are to be notified to the Department.

The Third Party will discuss his report with the Department, and with the Industry. Details relating to the SUMMARYSCHEDULE will be disclosed to the industry representative at the same time as they are disclosed to the Department. TheDepartment or the Industry may request the Third Party to follow up on any matters but such matters will fall outside the scopeof these terms of reference.

The Third Party will calculate the margin adjustment that would be necessary to arrive at the target return disclosing to theDepartment and the industry representative the basis on which the calculations were made.

2. EVALUATION CRITERIA

Proposals for the investigation will be evaluated on the following criteria weighting:

QUALIFICATIONS, EXPERIENCE AND TRACK RECORD:

The Independent Third Party must be a Chartered Accountant (CA). The Independent Third Party must at least have twoyears of financial auditing conducted at large entities. A track record of all financial audits conducted must be submitted.

METHODOLOGY AND WORK PROGRAM:

The tenderer must give a detail description of the methodology it will utilise to successfully complete the Task Directive, aswell as a detailed work program.

3. EVALUATION METHODOLOGY

The following method of evaluation will be followed:

A panel of 4 officials of the Chief Directorate Hydrocarbons will evaluate the proposals of the tenderers.

The panel will each individually evaluate each of the proposals received against the criteria listed in the score sheetattached.

4. OUTPUT AND REPORTING

A report on the annual MPAR return (each for 2003 and 2004) of the oil industry and the margin increase, if necessary,required to achieve a 15% marker return.

5. DURATION

Three months per year.

6. QUOTATION

The price quotation should be in South African Rands on a fixed cost basis (Value Added Tax included).
