Biotech Consortium India Limited (BCIL), New Delhi being the Management Cell of National Certification System for Tissue Culture Plants (NCS-TCP), invites sealed tender under two bids system (Technical and Financial bid) from the reputed Manufacturers /Dealers for supply of ELISA Kits for virus indexing of banana, sugarcane, potato, apple, bamboo and gerbera as per quantity specified in the Chapter III of tender document. It may be noted that it will be the sole discretion of NCS-TCP Management Cell whether to procure these items or not.

SCHEDULE OF TENDER
NATIONAL CERTIFICATION SYSTEM FOR TISSUE CULTURE RASIED PLANTS
(NCS-TCP)
National Certification System for Tissue Culture Raised Plants (NCS-TCP) has been established
by the Department of Biotechnology (DBT), Govt. of India as per the Gazette of India
Notification under the Seeds Act, 1966. The major objective of NCS-TCP is to facilitate
production and distribution of disease free and genetically true to type/ uniform planting
materials. To achieve these objectives, tissue culture companies are recognized under the
system on the basis of infrastructure and implementation of quality management system. Apart
from recognition of tissue culture companies, test laboratories have also been accredited under
the system. After recognition, tissue culture companies become eligible to get their mother
plants tested and tissue culture raised plants certified by these Accredited Test Laboratories
(ATLs). Two Referral Centers have also been established for testing of disputed samples,
training, validation of diagnostic kits/ reagents prior to supply to ATLs. Biotech Consortium
India Ltd. (BCIL) is responsible for management of NCS-TCP as the NCS-TCP Management Cell.
1. BCIL as the NCS-TCP Management Cell invites sealed tender under two bid system
(Technical and Financial bid) from the reputed Manufacturers /Dealers for supply of ELISA
Kits for virus indexing of banana, sugarcane, potato, apple, bamboo and gerbera as per the
quantity specified in the Chapter III of the tender document. It may be noted that it will be
the discretion of NCS-TCP Management Cell whether to procure these items or not. 2. THIS TENDER ENQUIRY HAS THE FOLLOWING CHAPTERS AND ANNEXURES:

3. Bidders are advised to carefully go through all the conditions and documents attached with
this tender enquiry, before filling in the tender. All tender documents attached with the
tender are sacrosanct for considering any offer as a complete offer. All tender documents
must be duly completed, signed by authorized signatory on each page and returned with the
offer.

Chapter-I
Instructions to Bidders 1. Name of Tenderer: NCS-TCP Management Cell established at BCIL

3. Process of submission and last date: The interested manufactures/ dealers are required to submit the technical and financial bid separately (two bid system). The bids in Sealed Cover-I containing “Technical Bid” and Sealed Cover-II containing “Financial Bid” should be placed in a third sealed cover superscripted “Tender For ELISA Kit and should reach to NCS-TCP Management Cell on or before 5.00 pm on August 22, 2016. The bid received after due date and time will not be considered whatsoever may be the reason. In the event of any of the above mentioned date being declared as a holiday / closed day, the date of submission will be next working day.
3 A: First Cover -Technical Bids: The first cover should contain the following:
i Tender document duly completed and signed but without indicating the rate quoted.
ii Technical details of the proposed items to be supplied along with supporting technical literature, leaflets, brochures etc.
iii Copy of Permanent Account Number (PAN). iv Certificate of Incorporation. v Client satisfaction report (at least two). vi Financial Statements including statement of profit and loss account for previous
three years. vii Letter in favor of NCS-TCP Management Cell accepting terms and conditions of
this tender along with copy of chapter II. viii Power of attorney/authorization in favor of the person signing the bid
document. 3 B: Second Cover - Financial Bid:
i Details of the rate, taxes, duties, discount, if any, quoted by the bidders ii Any document in support of price bid
The tender document contains technical bid form, financial bid form, technical description/specification & item and terms/ conditions. Any future clarification and/or corrigendum(s) shall be issued by “NCS-TCP Management Cell at Biotech Consortium India Limited, 5th Floor, Anuvrat Bhawan, 210 Deendayal Upadhaya Marg, New Delhi-110002” and will also be available at the official website of NCS-TCP: www.dbtncstcp.nic.in, and BCIL: www.bcil.nic.in
4. Offer validity: Minimum six months from date of opening of technical bid
In the absence of any indication in the tender documents submitted, of the date up to which the offer has been kept valid, it will be taken that the offer will remain open for acceptance for the period specified above i.e. six months.

5. Eligibility criteria for bidders
i. Bidder should be a registered company (herein referred as bidder) registered under “The Indian Companies Act” with minimum 51% Indian ownership.
ii. The bidder should be a manufacturer or authorized dealer and have experience in supply of ELISA kits for a minimum period of at least three years from the last date of closing of Tender.
iii. Minimum turn over of bidder should be 50.0 lakhs INR per annum during the previous three years.
iv. Bidder may submit proposal for supply of kits for all the listed plant species at Chapter III or may also submit proposal for only one plant species but proposal must include kits for all the listed viruses for specified plant species.
v. Bidder should have experience in supplying kits to National/International Research Institutions on regular basis. A satisfactory report from at least two such reputed research institutes to be submitted.
6. Opening of tender:
Bidders/their representatives are required to be present at the time of opening of technical bid, testing of kits and opening of financial bid. The representative must bring with him/her a letter of authority from the bidder to be present at the opening of tender.
7. Assessment of bid/Proposal:
(i) Stage 1: Technical Evaluation:
a. Evaluation of technical bid/proposal: Technical bid will be evaluated on the basis of eligibility criteria and parameters laid down in tender document Bidders must ensure that they enclose all technical literature as provided at section 3A and detailed documentary proof against each specified parameters of the technical bid format in Chapter IV. Application meeting with the requirements will be declared qualified for submission of samples for technical evaluation.
In case, it is not possible to verify compliance with specified parameters due to lack of adequate information/supporting documents, the bid will not be considered further and treated as cancelled.
b. Technical evaluation of samples: Bidders who will be declared technically qualified
based on the submitted documents will be required to submit samples in sealed cover of quoted items within a week of communication of short listing at the designated Referral Centre. Seal will be opened by the Referral Centre before testing in the presence of representative of bidder. Testing of samples of ELISA kits will also be done by referral center of NCS-TCP in the presence of representatives of qualified bidders within two weeks. Bidder will be given prior intimation by email at least one week advance.

(ii) Stage 2: Financial Evaluation:
Financial bid of only technically qualified bidders (based on evaluation of bids and testing of samples as specified above) will be opened and evaluated.
8. Performance Security:
The successful bidder will be required to submit refundable non interest bearing security deposit of 10% of approved cost of items to be supplied during first six month in the form of crossed demand draft/pay order/Bank Guarantee from a commercial bank in favor of the Biotech Consortium India Limited, New Delhi. Security deposit will be returned to bidder within two months from successful delivery of items and receipt of satisfactory report from Accredited Test Laboratory.
9. Payment:
Payment will be made within 15 working days of receipt of validation report from referral center.
10. Penalty:
i. Successful bidder (Vendor) shall supply the specified item to the required destination on the priority basis within a period of 15 days from the date of receipt of validation report. If the supply is not made within prescribed time frame of placing order, late delivery charges @5% will be imposed on the total amount of supply order up to delay of 15 days and thereafter @10% for another 15 days after which supply order will be deemed cancelled and vendor will be black-listed for future.
ii. If the items supplied are declared as “NOT OF STANDARD QUALITY” by project coordinator of Referral Centre (RC), the entire consignment shall be deemed to have been rejected and replaced with fresh. Replacement should be made within 15 days from the date of intimation, failing which contract will be cancelled and 50 % amount of the Security Deposit will be adjusted as penalty.
11. Validation of supplied item:
Samples for validation of kits/ reagents to be sent to Referral Centre established at Division of
Plant Pathology, ICAR-Indian Agricultural Research Institute (IARI), Pusa Campus, New Delhi-
110012 within 15 days on receipt of purchase order from NCS-TCP Management Cell. Above
institute will provide the validation report for supplied items.
11.1 Validation parameters:
Components of the kits should be provided as per the list
Quality of ingredients should be as per claim
Correct results should be obtained using positive and negative controls
11.2: Validation time:
Referral Centre will provide validation report within 15 working days from the receipt of samples

12. Quantity of Supply:
ELISA kits will be purchased on six monthly basis i. e half of the quantity specified in the chapter III. Quantity of supply may vary depending upon the actual requirement/requisitions received from ATLs.
13. Place of delivery:
All items are required to be delivered at Referral Centre established at Division of Plant Pathology, ICAR-Indian Agricultural Research Institute (IARI), Pusa Campus, New Delhi - 110012. On receipt of delivery of items, Referral Centre will draw samples for validation. Referral centre will provide validation report
14. Validity of quoted rate in Tender:
The quoted rates shall be valid for the period not less than 2 years (24 months) from the date of award of contract.
15. Disputes and Jurisdiction:
In the event of any dispute arising out of the terms and conditions of the tender, such disputes would be resolved by the Chairman, Procurement Committee of NCS-TCP. If dispute is not resolved under the NCS-TCP, it shall be subject to the jurisdiction of Indian law & courts at New Delhi.

CHAPTER-II
CONDITIONS OF TENDER/CONTRACT
A. General terms/conditions:
1. NCS-TCP Management Cell reserves the right to cancel/reject any or all the tenders without assigning any reason and may increase or decrease the quantity of the items tendered.
2. Any tender, which is not in the proper form or received after due date will not be considered. All annexure, attached with the Tender should be duly filled in and supported with requisite documents for considering any offer as a complete offer.
3. In-complete or conditional offers incorporating price variation will not be considered.
4. Every page of the tender must be numbered and signed by the authorized signatory giving his/her name and
designation below the signature.
5. The bidder must authorize a contact person and provide his/her e-mail ID/ mobile and landline telephone numbers, so that he/ she may be contacted for any query, throughout the tendering exercise.
6. The bill must contain full nomenclature and batch number of the supplied product otherwise the material will
not be accepted and order will be cancelled. 7. The material will be accepted after the complete inspection by representative/Competent person by the user
i.e. Accredited Test Laboratories under NCS-TCP.
8. The material will be supplied strictly as per approved specifications and no substitute will be accepted.
9. The kits will have to be provided strictly from the batches approved by referral centres and will conform to the requisite specifications.
10. Any loss in service/ during shipment/ supply will be the sole responsibility of bidder only. These supplies will
be treated as non-availability and recovery will be made from security deposit.
11. Quoted rate will include door delivery destination, packaging charges, forwarding charges, taxes (@ prevailing rate) etc. The VAT would be paid as applicable. The VAT should be clearly mentioned in the Performa Invoice/Invoices; otherwise no extra Tax/Levies/Charges would be paid.
12. All ELISA kits must indicate the Date of Manufacturing and Expiry. All above items must arrive at Accredited
Test Laboratories within a remaining shelf life of minimum 12 months (twelve months) of the total stipulated shelf life of the product. In case, the product supplied is less than 12 months shelf life, it will not be accepted.
13. On receipt of purchase order, bidder will provide samples from same batch of production/ manufacturing to
referral center for validation (cost of sample will borne by selected vendor). On receipt of satisfactory validation report, bidder will be directed to supply items to the Accredited Test Laboratories (ATLs).
14. Referral Centre reserves the right to test each item of the consignment received either at the time of receiving the goods or at any time during the warranty period, test and analysis.

B. Termination of contract:
The contract executed between supplier and Biotech Consortium India Limited will be valid for one year. The contract for supply of item will be deferred in case:
i. If supplier fails to provide the desired quantity within pre-confirmed timeline on three times consecutively ii. If supplier supply substandard item on two times consecutively
iii. If supplier fails to obtain satisfactory validation report on two times consecutively
C. Penalty for use of undue influence:-
The bidder should undertake that he has not given, offered or promised to give directly or indirectly any gift,
consideration, reward, commission, fees brokerage of inducement to any person in service of the Purchaser or
otherwise in procuring, the contract or forbearing to do or for having done or for borne to do any act in relation or
execution of the contract or any other contracts with the Biotech Consortium India Limited for showing or for
bearing to show favour or disfavour to any person in relation to the contract. Any breach of the aforesaid undertaking
by the bidder or any one employed by him or acting on his behalf whether with or without the knowledge the seller
or the commission of any offers by the seller or any one employed or acting on his behalf, as defined in Chapter-IX of
the IPC, 1860 or the Prevention of Corruption Act, 1947 or any other Act enacted for the Prevention of Corruption
shall entitle the purchaser to cancel this contract and all or any other contract with seller and recover from the seller,
the amount of any loss arising from such cancellation. A decision of the purchaser or his nominee to the effect that a
breach of the undertaking had been committed shall be final and binding on the seller.
E. LAWS GOVERNING THE CONTRACTS: - The contracts shall be governed by the laws of India for the time being
in force. The contract shall be interpreted in accordance with these laws. F. Jurisdiction of Court: - The court of the New Delhi shall have a Jurisdiction to decide any dispute arising out of or in respect of contract.
G. Force Majeure Clause: - The Supplier shall not be liable for forfeiture of its performance security, liquidated
damages or termination for default, if and to the extent that, it’s delay in performance or other failure to perform its
obligations under the Contract is the result of an event of Force Majeure. For purposes of this Clause, “Force Majeure”
means an event beyond the control of the Supplier and not involving the Supplier’s fault or negligence and not
foreseeable. Such event may include, but are not limited to, acts of the Purchaser either in its sovereign or contractual
capacity, wars or revolutions, fires, floods. Epidemics, quarantine restrictions, strikes, lockout or any act of war.
Notice of the happening of any such event is given by either party to the other within 15 days from the date of
occurring thereof. However either party at its discretion can terminate the contract in such cases.

Specifications of the ELISA Kit:
1. The kit should include all the required reagents for ELISA Test. The para-nitro-phenyl phosphate (PNPP) should be provided in tablet form.
2. Positive control of the target virus and negative control of the target host plant should be provided
in the kit.
3. The kit should also indicate minimum detection limit of the target virus. 4. The kit should be based on '8' well microplate strips. Each kit should have 12 strips of '8'wells each. 5. Information giving details of all the components used in the kit and specifying direction for use of
the kit and its storage condition should be provided in each kit.
6. The kit should be user friendly. The kit label should have the date of manufacture, expiry date which should be at least one year from the date of supply
