the Governor of West Bengal from Govt. approved (NABL Accredited) Drug Testing

working hours (11:00 a.m. to 2:00 p.m.) on all working days from 27/09/2010 to

06/10/2010 against a Cash Payment of Rs.1000/-( Rupees One Thousand only) for the

TERMS & CONDITIONS OF TENDER IN RESPECT OF TESTING OF DRUGS , CHEMICALS & LABORATORY CHEMICALS FOR THE YEAR 2010-2012 A.D.

1. Sealed tenders are invited from Government approved (NABL accredited) drug testing laboratories for testing of Drugs, Chemicals and Laboratory Chemicals appearing in the list of Annexure-‘A’ (Drugs and Chemicals) & Annexure ‘B’ (Laboratory Chemicals) provided with this tender form.

2. Tenders shall have to be addressed to the Governor of West Bengal and to be submitted at the above-

mentioned address in sealed cover super-scribed with ‘GENERAL TENDER FOR TESTING OF DRUGS, CHEMICALS AND LABORATORY CHEMICALS FOR THE YEARS 2010-2012’. The name, address and phone number/s of the tenderer shall have to be indicated on the cover in bold letters. Tenders shall have to be submitted in the form/s made from the copy appended herewith in our Website or gathered from C.M.S. on a cash payment of Rs.10/- (Rupees ten only) per piece. The rates are to cover the testing charges of those Drugs/Chemicals/Laboratory Chemicals whose names may be found in the lists (Annexure ‘A’ and ‘B’) provided herewith.

3. All tenders should be submitted at the C.M.S. by 2-00 p.m. of 08/10/2010 Tenders will be opened at 15:00

hrs. on 08/10/2010 in presence of the tenderers or their authorised representatives and shall be finalised in due course.

4. All the terms & conditions laid down herein shall have to be accepted by the tenderers and no representation

will be entertained for the modification of such terms and conditions.

5. Instructions about completion and submission of tender forms: - a. Rates are to be quoted (both in figures and words) for testing of items as per the list of Essential

Drugs, Chemicals and Laboratory Chemicals enclosed herewith (under Annexure-A & B). b. All rates should be quoted in duplicate. c. Rates should be quoted in whole number multiple of Rupee One in respect of a particular category of

Drug/Chemical/ Laboratory Chemical and should be inclusive of all charges including the charge of despatch of report to C.M.S.

d. Quoting of exorbitant high or low rates will not be accepted. Declaration of any price as exorbitant high or exorbitant low will be under the discretionary power of the Tender Selection Committee.

e. Number of test/s to be done for a particular item is to be mentioned and Tenderers shall have to submit a break-up of costs for different test/s related with that item. Rate quoted for testing of a particular item must have parity with the existing cost of the job.

f. Rates shall be taken as valid throughout the period to be covered by the contract (minimum two years from the last date to be allowed for the relevant agreement needed to be made with the tenderers) and the extended period (if any) as normally wished by the relevant authority.

g. Price quotations should be typed in double space. Interpolation, inscription, overwriting and erasure

will make the tender liable to be rejected. h. The tenderer shall have to sign all the pages forming the tender.

i. All sheets of papers submitted for the purpose of tender shall have to be numbered serially and the

total number of sheets in each cover should be cited in the covering letter. j. FAILURE TO COMPLY WITH THE ABOVE CONDITIONS OR FURNISHING ANY

INCORRECT OR INCOMPLETE INFORMATION WILL MAKE THE TENDER LIABLE TO BE REJECTED.

6. Earnest Money: Each tender, unless the tenderer is exempted under the existing orders of the West Bengal

Govt. must be accompanied with a Treasury Challan (Form No. 7 ) showing that an Earnest Money of Rs. 5000/- (Rupees Five thousand only) has been deposited in favour of the Dy. Director of Health Services (Accounts), Central Medical Stores, Directorate of Health Services, West Bengal under the Account Code 84430010300107 having detail head of Account as “8443-Civil Deposits –00-103 Security Deposits – 001-07-Earnest Money Deposit’’ The onus of proving that a tenderer is exempted from Earnest Money will be on the tenderer and must be proved by the submission of valid document/s. Govt. owned Laboratories are exempted from payment of Earnest Money.

7. Tenders are to be accompanied with the following documents in the following order: -

(i) Covering letter. (ii) Earnest Money Receipt (where applicable). (iii) Attested Xerox copies of all receipts of the relevant articles bought from C.M.S. (as the case may be). (iv) Relevant Bank Draft (for the cases where the Terms and Conditions or the Tender Form/s or both has /

have been gathered from the relevant Website) in favour of Deputy Director (Accounts), C.M.S., Directorate of Health Services, W.B. payable at Kolkata.

(v) Updated Sales Tax Clearance Certificate. A Tenderer located within or outside the State of West Bengal must submit the VAT number (where applicable) and up-to-date VAT/Sale Tax Clearance Certificate from the appropriate Authority of his home State. Such Tenderers having no direct business and/or sales office in West Bengal must submit an affidavit sworn before a First Class Magistrate of a court of law to that effect.

(vi) Trade License and its up-to-date return. (vii) License for testing of opted Drugs, Chemicals & Laboratory Chemicals mentioned in the relevant list

enclosed herewith. (viii) PAN and up-to-date Income Tax return. (ix) List of testing Machineries/Equipments (available in the Laboratory) along with the name of their maker/s. N.B. (a) It is to be noted by the Tenderer/s who download this copy of Terms & Conditions and / or the Tender Form/s from the Website, that, he/she/they has/have to pay Rupees One thousand only for the Terms & Conditions and Rupees Ten only for each Tender Form (primarily downloaded from the Website). This payment should be made in accordance with the method described in 7 (iv) above. (b) All documents mentioned above should preferably be submitted in English. In case a document is in any other language, a notarized translated copy in English is to be submitted alongwith the copy of the original document.

(c) All true copies or Xerox copies of relevant documents must be furnished with due attestation by the tenderer himself/herself. 8. Samples of drugs and chemicals & laboratory chemicals will be despatched by Central Medical Stores,

Kolkata to the approved testing laboratories and the report of testing should expeditiously be sent by those approved laboratories to Central Medical Store, Kolkata. Unnecessary delay to send report of testing within the stipulated time (Ten working days in case of Drugs, Chemicals & Laboratory Chemicals and twenty working days in case of injectables) from the date of receipt of the relevant sample by the concerned tenderer will lead to a penalty of 2 (two) percent of the allotted money (for that sample) being forfeited for each day’s lapse. If such delay occurs in case of ten different test reports of a concerned laboratory during the tender period, security deposit (of that laboratory) will be liable to be forfeited. This/These case/s will be settled after the completion of the Tender Period. The payment for drug testing as per order placed with the approved tenderer shall be made from Central Medical Stores, Kolkata as per approved rate of C.M.S. and as per G.O. No. H/TDE/391/5S-26/2003, dt. Kolkata 30th July 2003.

9. The Tendering authority reserves the right to withdraw any item from the tender at any stage. In such case

the selection of such item, if already made in favour of any tenderer, shall be treated as cancelled.

10 The tendering authority reserves the right to reject or accept any tender or part thereof at any stage or to split any tender without assigning any reason. Withdrawal of tender or any revision after submission of the tender by any tenderer will not be allowed.

11. The tendering authority reserves the right to accept or reject any tender.

12. In case of emergency like the right tenderer (i.e. the lowest bidder) failing to execute the job/s as ordered, the tendering authority reserves the right to get the tendered jobs done at the quoted rate from other tenderer or any outsider (Non-tenderer) during the Tender period. The loss incurred (by the Govt. of West Bengal) in such case will have to be borne by the defaulter.

13. On a tender being accepted, intimation of acceptance will be forwarded to the tenderer by the Dy. Director of Health Services (E & S), W.B. Such intimation may be forwarded either in one lot or in different lots. After communication of the same, the tenderer will have to execute agreement in the prescribed form (within the stipulated time-period, to be made known latter-on) with the Dy. Director of Health Services (E & S), W.B.

14. (i) Work orders for the testing of Drugs/Chemicals/ Laboratory Chemicals will be placed with the successful tenderers after the execution of the agreements.

(ii) The tenderer is to bear the contract period, be it wished to be extended upto three months (with the prior approval of the Director of Health Services, W.B.) and again upto another 6 (Six) months (with the prior approval of the Principal Secretary/Secretary, Health & F.W.Deptt., Govt. of West Bengal).

15. (i) The earnest money of the tenderer will be liable to be forfeited if the tenderer withdraws his tender as a whole or for any particular item at any stage after the opening of the tender, or fails/refuses to enter into written agreement (for any or all of the items of his/her accepted tenderer/s) after he/she being intimated to do so within the time to be specified latter on.

(ii) The Earnest Money will be refunded to the tenderers after finalization of tender against the prayer of refund by the Tenderer.

16. (a) Each successful tenderer (except State Govt. / State Govt. undertaking Laboratories) is to pay a Security Deposit of Rs.10, 000/- (Rupees Ten thousand only) under account code 84430010300107 having detail head of account as “8443-Civil Deposits-00-103-Security Deposits – 001-07-Earnest Money Deposit ’’ Such Security Deposit shall be liable to be forfeited for non-compliance with the terms and conditions of the tender. Tenderers will have to submit their bills claiming payment bi- monthly after completion of the tests of drugs etc. along with supportive documents.

(b) The Security Deposit to be furnished by successful tenderer will however be released, after the satisfactory completion of his/her service and after six months from the expiry of the contract period. Tender inviting authority will not take any responsibility if the Security Deposit is not claimed by the Tenderer within 3 (three) years following the expiry of Tender period.

17. The tenderers are to give an undertaking that all the statements submitted by him/her are true to the best of his/her knowledge and any information subsequently found incorrect or false will mean automatic cancellation of the tender and will make him/her liable for penal action as will be deemed fit.

18. All notice intended to be served on the tenderers/contractors will be deemed to have been duly served, if it

is sent under certificate of positing to the address mentioned by the tenderer or is displayed on the notice board of the C.M.S. for 3 (three) consecutive working days or more.

19. Any legal matter with respect to this tender will be under the jurisdiction of Kolkata’s legal zone.
