    Article16.01Stand-byCompensation

    TheEmployerofferstoadjuststandbyrateasfollows:

    EffectiveOctober31,2014Increasestandbyrate(for8hoursorless)from$13.50

    to$16.21andfrom$27.00onaholidayto$32.40.

    Article18.04Ajointreviewofschedulingpracticesonholidayswillbeundertakenwith

    Unionparticipation.

    b)Notwithstanding32.24(ContractingOut),anemployeewhohaseight(8)years

    Article45.03MembersofthebargainingunitwhohaveresignedorretiredsinceOctober

    31,2011willhavethirty(30)daysfromthedateofsigningofthisagreementtoapplyin

    writingfortheretroactivewageincrease.

    MOA6SatelliteHemodialysisClinics

    Thepartiesagreetomeetandjointlyundertakeareviewoftheprovisionsofthis

    MOA.

    MOAHoursofWork

    Thepartiesagreethatwithin90daysfollowingdateofratification,ajointlabour

    managementcommitteewillbeestablishedinordertoreviewthehoursofworkofemployeesinthebargainingunitintheClassificationofAlliedHealthInstructor

    (article14.01(d)(i)),andthoseworkinginpositionthatwerepreviouslyincludedin

    thePublicHealthandDrugDependencyServicesbargainingunit(MOA#5(2)).

    MOA11RetentionIncentive

    Uponcompletionoftwenty-fiveyearsofservicewiththeEmployer,allpermanent

    employeeswillreceiveanadditionalsalaryincrementof3.5%greaterthanthe

    highestrateineffectfortheapplicableclassification.

    AllremainingEmployerproposalsarewithdrawn.

    AllremainingUnionproposalsarewithdrawn.

    ArbitrationAgreement

    NSGEUandCapitalHealthagreetosubmittheissueofincreasesintheratesofpaytofinal

    andbindingarbitrationbyaBoardofArbitration.

    NSGEUandCapitalHealthwillbothnameanomineetotheBoardofArbitrationandprovidetheotherpartywiththenamesofthreequalifiedpersonswhoareacceptableto

    serveasChairoftheBoardofArbitrationbyApril30,2012.

    TheChairoftheBoardofArbitrationshallbeapersonwhoisgenerallyacceptableasa

    labourarbitratorandwhoisavailabletoconductthearbitrationhearingbyJune3,2012

    andtorenderadecisionbyJune15,2012.

    NSGEUorCapitalHealthmaynotifytheotherpartybyMay1,2012thatoneofthepersons

    proposedbytheotherpartyisacceptabletoserveasChairoftheBoardofArbitrationand

    thatpersonshallbeappointedasChair.

    IfnoneofthepersonsproposedbyNSGEUandCapitalHealtharemutuallyacceptable,

    eitherpartymayrequesttheChairoftheNovaScotiaLabourBoardtoappointtheChairof

    theBoardofArbitration;eitherNSGEUorCapitalHealthmayexcludeoneofthepersons

    proposedbytheotherpartyfromconsiderationandtheChairoftheNovaScotiaLabour

    BoardshallselectoneoftheremainingfourpersonsasChairoftheBoardofArbitration.

    NSGEUandCapitalHealthshallprovidewrittensubmissionsanddocumentaryevidenceto

    theBoardofArbitrationatleastsevendaysbeforethehearingbytheBoard;thehearing

    shallbelimitedtooralsubmissionsfromtheparties.

    TheBoardofArbitrationshallissueanawardwhichdeterminestheratesofincreasesin

    payofallemployeesinthebargainingunitduringtherenewedCollectiveAgreementovera

    termofthreeyearsstartingonNov.1,2011;theratesofincreasesintheawardshallnotbe

    lessthanatotaluncompoundedpercentageincreaseof6.5percentnorgreaterthanatotal

    uncompoundedpercentageincreaseof9.05percent.
