I. INFORMACIÓN GENERAL DEL CURSO
A. Descripción del curso
El curso estará dirigido a exponer al estudiante a una experiencia a través de la cual tendrá la
oportunidad de aprender y aplicar técnicas pertinentes a su importante rol como testigo forense
con la responsabilidad de aportar al esclarecimiento de los delitos. El estudiante aprenderá las
técnicas sobre la presentación de un testimonio en corte y la contestación a preguntas de la
defensa y la fiscalía. El estudiante también será expuesto a la aplicación de la teoría aprendida
durante un ensayo de juicio.
B. Objetivos de contenido del curso
Al finalizar el curso, el estudiante será capaz de:
1. Reconocer la importancia del rol del investigador forense como perito al resolver disputas
entre la defensa y la fiscalía.
2. Identificar las leyes aplicables y prácticas relacionadas con los procedimientos antes, durante
y luego del juicio.
3. Comprender la relevancia de su rol como investigador.
4. Aplicar destrezas en un escenario judicial.

C. Objetivos de lenguaje del curso
Al finalizar el curso, el estudiante será capaz de:
1. Comprender discursos orales a través de estímulos auditivos tales como presentaciones
audiovisuales, discusiones de clase y otras actividades interactivas en torno a las prácticas
y doctrinas relacionadas al peritaje forense en el contexto de un juicio.
2. Explicar utilizando el lenguaje técnico y académico apropiado, los principios aplicables al
peritaje forense en el contexto del juicio y sus hallazgos en torno a la ley y su aplicación en
la jurisprudencia reciente mediante las discusiones del curso.
3. Descifrar, mediante lectura de casos y otros materiales, la aplicación de las reglas de
peritaje forense en los tribunales y las diferencias en el manejo de la prueba pericial bajo la
esfera estatal y federal.
4. Analizar el contenido y las doctrinas relacionadas con la pericia forense en el contexto de
un ensayo de juicio, utilizando ortografía y gramática correcta, a través de su trabajo
escrito.

E. Reglas de administración del curso
Como requisitos específicos del curso, el estudiante
1. Repasará con el facilitador durante el Taller Uno las rúbricas de evaluación establecidas para
el curso. Dichas rúbricas han sido diseñadas específicamente para evaluar el 70 % de
contenido y 30 % de lenguaje de las actividades identificadas y realizadas a lo largo del
curso. Las mismas se encuentran al final del módulo.
2. Colocará semanalmente en el Digital Performance Portfolio, todos los trabajos que realizó y
que el facilitador evaluó, junto a sus respectivas rúbricas bajo la carpeta de la semana y la
actividad que corresponda. Esto incluye, pero no se limita a, los borradores originales de los
trabajos escritos, evidencia de la retroalimentación brindada por la herramienta NetTutor y
los escritos revisados. Recuerde que el Digital Performance Portfolio forma parte de los
criterios de evaluación del curso.
3. Deberá participar activamente en los foros temáticos creado por el facilitador en la
plataforma de Blackboard. En dichos foros, el estudiante deberá crear un tema de
conversación (new thread) y reaccionar a las aportaciones de al menos dos compañeros.
4. Deberá referirse a la Guía del curso para el estudiante que se encuentra en la sección de
Course Menu de Blackboard (al lado izquierdo de la pantalla) bajo el enlace llamado Course
Guide para obtener información adicional sobre las normas y políticas del curso.

I. GENERAL COURSE INFORMATION
A. Course Description
This course covers the theoretical and practical aspects of the role of the forensic expert
witness in court, as part of the investigator’s important role in helping to solve crime. The
student will learn and apply techniques about presenting expert witness testimony and how to
respond to questions posed by the defense and the prosecutor. The student will be exposed to
the application of the theory learned during a final court exercise.
B. Course Content Objectives
Upon completing this course, the student will be able to:
1. Recognize the important role of the forensic investigator as an expert witness in court
proceedings.
2. Identify the applicable laws and practices related to the proceedings prior to, during and
after the trial.
3. Understand the importance of his/her role as forensic investigator.
4. Apply skills during a final court exercise.
C. Course Language Objectives
Upon completing this course, the student will be able to:
1. Comprehend oral discussions based on auditory stimuli such as videos, audiovisual
presentations and other interactive activities related to the application of doctrines relevant
to the role of a forensic investigator as an expert witness in the context of a trial.

2. Explain, using appropriate core course terminology, the principles applicable to expert
forensics practice in the context of a trial and its findings around the law and its
application in recent jurisprudence through course discussions.
3. Decipher through the reading of case laws and other legal materials, how rules and
doctrine apply to the role of the forensic expert in court and the similarities and differences
between the applicable rules at the federal and state levels.
4. Analyze the content and doctrines related to forensic expertise in the context of a trial
using correct spelling and grammar through his or her written work.

E. Course Management Rules
The student will comply with the following specific requirements:
1. Review with the facilitator during Workshop One the evaluation rubrics established for the
course that appear at the end of the module. These rubrics have been specifically designed
to evaluate the 70% content and 30% language grading requirement for the activities
selected throughout the course.
2. Place all the evaluated activities of the course, with their respective rubrics (of language
and content), in the corresponding folder of the workshops of the Digital Performance
Portfolio. This includes, but not limited to, the original drafts of written works, evidence of
the feedback provided by the NetTutor tool, and the revised versions of said written work.
3. Actively participate in the thematic written discussion forums created by the facilitator in
the Blackboard platform. In these forums, the student must create a conversation topic (new
thread) and react to the contributions of at least two colleagues.
4. Refer to the Student’s Course Guide, which can be found under the Course Guide section to
the left side of the Course Menu in Blackboard for additional details regarding course

TALLER UNO
A. Objetivos de contenido
Durante el taller, el estudiante será capaz de:
1. Evaluar la importancia del rol de los testigos en un procedimiento judicial como parte de
una discusión oral.
2. Resumir en sus propias palabras el rol del testigo en casos civiles y criminales como parte
de una actividad oral.
3. Comparar las reglas aplicables a la prueba pericial en la esfera estatal y federal en un
organizador gráfico y en una actividad oral.
4. Analizar los principios evidenciarios aplicables a los testigos como parte del análisis de
un caso jurídico.
B. Objetivos de lenguaje
Durante el taller, el estudiante será capaz de:
1. Comprender el significado de conceptos importantes relacionados a los testigos y la
prueba testifical en procedimientos judiciales civiles y criminales, basado en los estímulos
auditivos del taller.
2. Destacar oralmente, con una pronunciación y volumen apropiada, las reglas sobre la
prueba pericial aplicables en la esfera estatal y federal utilizando un organizador gráfico.
3. Examinar, mediante la lectura de casos, los principios evidenciarios aplicables a la prueba
pericial en la esfera federal y estatal.
4. Redactar un análisis de casos relacionado a los principios evidenciarios aplicables a los
testigos, utilizando correctamente la gramática y vocabulario técnico del taller.

D. Actividades antes del taller
1. Acceda al curso utilizando su cuenta en la plataforma de Blackboard y preste
atención a los anuncios publicados por el facilitador acerca de las fechas de entrega
del análisis de estudios de casos jurídicos, el proyecto final, los exámenes parciales
y el portafolio digital. Además, lea cuidadosamente el módulo y sus apéndices, a
fin de familiarizarse con el contenido del curso y la manera que será evaluado
desde la perspectiva de su desempeño lingüístico y el dominio del contenido del
curso. Anote cualquier duda que pueda tener y llévelo al taller.
2. Utilice los enlaces electrónicos que aparecen en la sección de referencias
específicas del taller para leer y analizar las reglas de evidencia federales
(Fed.R.Civ.P. 701-706) y estatales (FL. Stat.90.701-90.706) relacionadas a los
testigos periciales. Tome apuntes acerca de las diferencias significativas y llegue
preparado al taller para aplicar el conocimiento adquirido.

federales y estatales que se desglosan a continuación:

Prepare un bosquejo de las definiciones de cada concepto que surja de su
investigación y cárguelo en el área de asignaciones en Blackboard. Además,
acceda al foro temático de discusión escrita creada por el facilitador en Blackboard
y destaque en sus propias palabras la importancia de cada concepto para un
investigador forense, cuya labor es ayudar al esclarecimiento de delitos.
E. Actividades de aplicación durante el taller
1. El facilitador proveerá a los estudiantes su información de contacto, se seleccionará el
representante estudiantil y se discutirá sus responsabilidades.
2. El facilitador y los alumnos participarán de una actividad de socialización
(rompehielos) titulado “¿Quién soy yo?”. Los estudiantes y el facilitador, redactarán un
párrafo de un minuto donde se presentarán anónimamente, aportando información
básica sobre sí mismo (sin proveer su nombre). Puede incluir su profesión u ocupación,
país de origen, metas profesionales, composición familiar o algún dato curioso de sus
vidas. El facilitador recopilará los párrafos y al azar repartirá los mismos al resto de la
clase. Guiados por el facilitador, los alumnos leerán en voz alta su párrafo y adivinarán
a quien pertenece.
3. El facilitador explicará detenidamente los objetivos de contenido y lenguaje del curso y
los recursos disponibles. Además, aclarará el propósito del portafolio digital y

aprovechará la ocasión para especificar las actividades, antes y durante el taller, que se
incluirán en el mismo, así como los recordatorios que dará semanalmente relacionada a
las fechas de entrega. Finalmente, discutirá los criterios de evaluación del curso y las
rúbricas de evaluación que se utilizarán para evaluar el dominio del material y
desarrollo lingüístico a través del curso; las mismas se encuentran al final del módulo.
4. Guiados por el facilitador, los estudiantes discutirán los puntos más relevantes
relacionados a los testigos contenidos en las reglas de evidencia federales y de la
Florida. Además, identificarán conceptos importantes relacionados a los testigos y la
prueba testifical en procedimientos judiciales civiles y criminales. Los estudiantes
podrán hacer referencia a sus apuntes obtenidos como parte de las actividades
completadas antes del taller.
5. Luego, divididos en subgrupos y basados en la discusión de la clase, los alumnos
diseñarán un T-chart (organizador gráfico) destacando las reglas sobre la prueba
pericial aplicables en la esfera estatal y federal. Cada grupo presentará y explicará
oralmente su organizador gráfico al resto de la clase. Entregarán su T-chart al
facilitador ya que la misma forma parte de la evaluación (Vea Apéndice II Rúbrica de
evaluación de presentaciones orales).
6. Individualmente, los alumnos leerán y analizarán un estudio de caso provisto por el
facilitador acerca de los principios evidenciarios que rigen el testimonio de los testigos
en juicio. Prepararán un análisis escrito de al menos tres párrafos que incluya los
siguientes componentes:
a. Resumen de los hechos presentados ante el tribunal
b. Identificación de la controversia legal presentada

c. Explicación de la decisión del tribunal y sus fundamentos
d. Extrapolación de la doctrina legal
Esta actividad forma parte de la evaluación (Vea Apéndice IV Rúbrica de evaluación de
análisis de jurisprudencia).
7. El facilitador explicará los detalles del proyecto de análisis de casos jurídicos que será
entregado durante el Taller Cuatro. Además, asignará al menos cuatro casos judiciales
(dos en inglés y dos en español) relacionados al derecho probatorio en los cuales se

E. Application Activities during the Workshop
1. Guided by the facilitator and in a round table discussion format, students will discuss the
legal doctrine that applies to the qualification of expert witnesses and how the process is
applied in the state and federal courts. The facilitator will provide specific feedback to
students during this activity and will clarify doubts regarding the ideas and concepts
discussed.
2. The facilitator will divide the class in two groups. Each group will read and summarize
either Frye v. U.S., 293 Fed. 1013 (1923) or Daubert v. Merrell Dow, 509 U.S. 579 (1993)
(Law Cornell, 1993) and develop a defense of the utilization of either the Frye or Daubert
test in the context of a given fact pattern. Each group will defend the utilization of their
assigned test and present their respective critiques in a debate exercise. This activity forms
part of the evaluation (See Appendix III Evaluation Rubric for Oral Presentations).
3. Guided by the facilitator, the class will carry out a group reading of Flanagan v. State, 625
So.2d 827 (Fla. 1993) (Court Listener, 1993). Each student will be asked to read a portion
of the case aloud to the class, while the rest of the class will summarize and synthesize the
facts, controversy and holding of the case regarding the admissibility of an expert witness’s
opinion as profile evidence.
4. The facilitator will play relevant portions of the audio file of the Supreme Court’s opinion
in Williams v. Illinois, 562 U.S. 50 (2012) (Oyez, 2012). Based on the opinion, students
will individually prepare a one-minute paper summarizing his or her understanding of what
constitutes the basis of testimony in forensic DNA evidence while using correctly

punctuation, spelling, and the core course terminology indicated for the workshop. Students
will share their summaries with the rest of the class in a class discussion. The facilitator will
collect the one-minute papers once the discussion has concluded. This activity forms part of

5. Each student will orally present to the class a summary of the news analysis completed
prior to the workshop and will listen and respond to questions from other students regarding
their findings and the use of forensic evidence presented by an expert witness in a legal
proceeding. The facilitator will pose thought-provoking questions to sustain a dynamic and
interactive discussion.
6. The facilitator will discuss and clarify questions about the assignments due prior to the next

6. El facilitador dividirá la clase en grupos pequeños para una actividad de dramatización de roles
sobre el concepto de prueba de referencia. A cada grupo de le asignará una situación de hechos
en torno a una de las siguientes excepciones a la prueba de referencia:

Cada grupo discutirá la situación de hechos y la excepción aplicable, y preparará un libreto para

demás se turnarán interrogándolo como abogado de fiscalía y abogado de defensa. Los
estudiantes deben aplicar lo aprendido sobre la admisibilidad del testimonio que se ofrece. El
facilitador asumirá el rol de juez y decidirá los planteamientos sobre la admisibilidad o

E. Application Activities during the Workshop
1. Guided by the facilitator, students will discuss the different types of forensic evidence
(documentary, testimonial, and scientific) that an investigator might be expected to testify
about as an expert witness in a trial. During the discussion, the facilitator will provide
feedback and clarify doubts as needed.
2. The facilitator will provide a paragraph to each student detailing a fact pattern. After
reading and discussing their assigned fact pattern, students will individually deliver a short
oral presentation explaining how they would provide an ultimate issue opinion testimony,
based on the facts. This activity forms part of the evaluation (See Appendix III Evaluation
Rubric for Oral Presentations).
3. In pairs, students will discuss the evidence retention laws at the federal and state level using
the concept map prepared before the workshop. Students will evaluate the importance of

proper crime scene preservation with their partner and share with the rest of the class their
conclusions on the matter.
4. The students will be divided in three groups. The facilitator will assign a piece of
documentary, scientific or testimonial evidence obtained at a crime scene to each group.
Based on their assigned type of forensic evidence, students will prepare and present a
flowchart that describes at least two evidentiary challenges and common objections that an
expert witness could expect to face at trial, as well as the response or justification that can
be offered to overcome the challenge and succeed in having the evidence admitted. This

5. The facilitator will answer questions about the legal case analysis project previously
submitted by students. Guided by the facilitator, students will exchange feedback regarding

investigador forense, preservó la cadena de evidencia de un objeto a ser presentado en
juicio como evidencia. Mediante la dramatización de roles, el estudiante/investigador
forense fungirá como testigo en un juicio para presentar dicho objeto como prueba de la

2. Application Activities in English
a. The students will watch one or more videos, as determined by the facilitator, from the
collection of CSI Effect Theory: That’s Television. This is a Courtroom (National Forensic
Science Technology Center, 2017). Students will react to the contents of the videos,
incorporating into the discussion their previous knowledge obtained from reading the article
The CSI Effect: The Truth about Forensic Science (Toobin, 2017).
b. Individually, students will read the article 8,000 Drug Convictions to be Dismissed after
Lab Expert Sonja Farak Consumes the Evidence (Rebello, 2017). Afterward, students will
compose a brief news analysis (maximum three paragraphs) which includes his or her
opinion about what ethical principles should guide the work of the forensic
investigator/expert witness in collaboration with the prosecutorial team. The facilitator will
collect the analyses. This activity forms part of the evaluation (See Appendix Evaluation
Rubric for Written Work).

c. Based on their research conducted before the workshop and the information obtained from
reading the article of Sonja Farak’s case, students will lead a round table discussion about
the ethical principles that should guide the work of the forensic investigator and the
prosecutorial team.
d. The facilitator will inform students the deadline to submit the digital portfolio following the
instructions stipulated in the Digital Performance Portfolio Assessment Manual. Students
are responsible for uploading all the required activities and rubrics indicated during the
course.
