When our client first felt a lump in her breast, she immediately requested a mammogram and ultrasound. After reviewing the images and identifying the lump, the defendant radiologist reported that the lump was “probably benign”. The radiologist did not recommend a biopsy. Instead, the recommendation was to return for a follow-up mammogram in six months. The second mammogram was performed six months later and reviewed by a different radiologist. Again, it was reported that the lesion was “probably benign.” Once again, only follow-up was suggested, with no recommendation for a biopsy. as the lesion had increased in size. The patient was diagnosed with breast cancer and had to undergo a lumpectomy to remove the tumor. Since the cancer had spread to her lymph nodes, she also had to undergo numerous courses of chemotherapy. After extensive litigation and discovery, Attorney Grimm was able to establish that both of the earlier mammograms were negligently misread by the radiologists, and that a proper review of the films revealed that the lesion should have been biopsied. Had our client underwent a biopsy at the time of her first mammogram, the cancer would have been diagnosed early enough so that the patient would not have had to undergo months of painful and debilitating chemotherapy treatment.
