20-9-2010 Your Excellency Followings upon our previous reports and submitted statements concerning what has happened and continue to happen in the City of Fallujah, Iraq. We wish to draw your attention to the deteriorating situation. From the outset and at the start of the indiscriminate and merciless campaign of collective punishment and wilful destruction, undertaken by the occupational troops of the United States of America, and inflicted upon the innocent defenceless civilians in Fallujah Most of which commenced in 2003 and since., The inhumane siege and indiscriminate killing that occurred in the First Incursions of Fallujah,(4/4/2004 to 5/5/2004).The genocidal massacres commenced with sustained and targeted bombing campaign, aimed directly at the homes of defenceless civilians, resulting in the killing and maiming of dozens of them, all carried out, under the false pretext of “pursuing the leaders of the resistance”, they then, proceeded to prepare the media and political establishments, for a second massacre in September 2004 the operation, seized in November 2004, as in the first incursions, has again resulted in the deaths of thousands more innocent, defenceless civilian victims, killed, wounded, now missing, or were displaced At that time, peace proposals, were set out and outlined in an open letter, the proposals were drawn by the interim government of Mr. Iyad Allawi those proposals were then submitted to Mr. Kofi Annan, the former General Secretary of the United Nations, these were summarily dismissed and completely ignored, denying the chance and opportunity for a sustained peaceful resolution. As you are fully aware, no doubt, all these actions and acts, by the US, constitute deliberate war crimes and violations contrary with the charters and aims of the Geneva Conventions and in complete violation of International humanitarian laws. We have no wish or desire to reiterate the principles of international justice, upon which the Organization of the United Nations was established, or the common basis and objectives, that applies any time and place, the clear definitions and meanings of crimes and violations, remains the same and applies to the entire human race, including all human rights activists. We humbly ask you, through your offices and that of the Special Procedures for the Human Rights Council to examine the deliberate perpetrated violations and crimes, contained in the attached report and to apply same moral, legal obligations and responsibilities, that prompted the creation of the United Nations, and investigate the crimes using the same criteria as were applied to other countries, such as Rwanda and the Kosovo, they were just as heinous. To view all forms of injustices, as abhorrent acts, contrary to the aims and goals expected from the application of civilized universal justice that are contrary to what unites the human race as a civilized community, expected every human being mission‟s on earth, deserves to be afforded same degree of respect and in accordance with all heavenly religions, and international laws on which the United Nations was established, plead and implore you, state that the very least action that can you undertaken would be to express the respect for the memory of the defenceless victims, to investigate the crimes and violations contained, not only in this report, but all what has been inflicted upon Iraq, placing the country at the top of the world's daily list for deaths and the numbers of displaced persons, both internally and externally, not to mention the ensuing savage corruption, child molestation, rape, rampant kidnapping, all contrary to the noble goals and the foundations of your organisation In anticipation of your response, please accept my sincere thanks and appreciation, Dr. Muhamad Tareq Al-Darraji President of Conservation Centre of Environment and Reserves in Fallujah - CCERF Director of Monitoring net of human rights in Iraq – MHRI www.mhrinet.splinder.com , www.ccerf.splinder.com, [email protected] , [email protected]

The Fallujah city:
It‟s located to the west of the capital Baghdad and at a distance of 45 km. The city is home to more than 350000 inhabitants and is located on the edges of three rural areas with a population of 300000 inhabitants to be the overall administrative census fallujah 650000 people. The city is being conservative in nature to the religious traditions and social and tribal. There are indications that the region surrounding the city, it was inhabited since the time of the Babylonians. There are several theories on the origin of the naming of the city, one of these theories because the assets of the label to the Akkadian word (Blukato) or (Floqat), no studies indicate the historical accuracy and specifically on the history of the emergence of Fallujah or the settlement of her rights. In 1941, when Britain imposed its mandate on Iraq after its forces occupied in the aftermath of First World War and detached it from the Ottoman Empire, the British occupation forces tried to enter Fallujah, the resistance to discipline, there has faced fierce defense and defeated the people of the city. In 2003, Falluja was a quiet city after the fall of Capital Baghdad 2003 between hands of US-UK occupation, compared to other cities where there were no acts of looting that followed the fall of Baghdad, which is deployed in some areas in Iraq, particularly Baghdad. But the policy of the US - UK occupation approach killings and collective punishment of civilians in the city make the city to be one of the most areas in trying to defend itself, because violence begets violence and every action has a reaction paralleled in strength and opposite direction. Instead of the invading forces try to understand and respect the traditions and culture of a society of Fallujah, it has been the criminal driven policy that led to what we mention in this report. This report will stay as open file for updating or adding any new information or testimonies which complete all the sides of these crimes, till the international courts will accept looking to our case to give my people the real justice and protection.

Crime of comprehensive punishment policy in Fallujah city:
1.The killing of the participants of peaceful demonstrations: Violence made violence, this was the beginning story of occupation violence which converted later to be as strategy for mass punishment to anyone refused this occupation or their agenda in Iraq. The first crime was on April 23, 2003, which was launched by US forces directly a few days after entering Baghdad, when they opened fire indiscriminately on peaceful demonstrators in front of a Al-Kaed school in the Nazzal neighbourhood. Where these forces have taken this school as a military base start to their excesses on the traditions and conserved culture of civilians. The result of randomely firing was killing 13 civilian demonstrators as well to some families living beside the place, and wounded 75 others (6,19, 49) The shot of US soldiers involved even on the medical staff of ambulances that tried to rescue the injured. Among the dead were three children under the age of 11 years. Two days later returned with the same brutality, to open fire on a funeral peaceful death of first march, on April 30, 2003 US soldiers opened fire on mourners of the dead accident, and the result was killed again two civilians and wounding 14 others, among them normalize children (24, 44). U.S. forces have violated in this massacre, the principles relating to the protection of civilians in the Geneva Conventions, as well as basic principles in the Universal Declaration of Human Rights such as firstly : the freedom of expression and the right to peaceful assembly, and the second: the right to life, liberty and security

1. The crime of luring and killing Fallujah Protection Force and the police This crime was common among the spies of the private security company Blackwater and U.S. forces. On the night of 11.9.2003 BMW car (blue color) opened fire on the administration building of the city of Fallujah (Mayor office). And immediately the Fallujah Protection Force chased this car, and this pursuit supported by another two of Fallujah police patrols on the old road towards Baghdad, and at a distance of 3-4 km outside the city. The car entered to the U.S. camp, making the police force to go back towards Fallujah at time of 12 p.m., but was surprised by heavy gunfire and random of U.S. force placed on the side of the road. The distance of this US forces was on 50 m from the road and the fire focused directly on the wheel of a Fallujah protection force (This force was formally constituted by the mayor and have a people versed well in security to help the police to keep security). This crime led to attack directly this group and killed 8 people of the Fallujah protection force and wounded the two remaining of this force with wounding all the Fallujah police force. That the reason for targeting this force is the good reputation enjoyed by the control of the security situation in the city of Fallujah, and prevented the need for the use of U.S. troops and did not like the occupation forces, which dismantled all the security services and military, and allowed the thieves of theft and vandalism. Despite the fact that the Iraqi forces did not respond to the fire, but members of, the U.S. ambush advanced towards the victims who were calling loudly POLICE ... POLICE (which mean we are police), but the American soldiers insistence to kill them directly. And when our witnesses from police arrived with supplies of ambulance, U.S. troops firing fire towards them to prevent them from reaching the crimes place. Actually, members of the Iraqi side remained away to a distance of 300 meters at 3 a.m. until six o'clock in the morning, where sun shines and U.S. troops start the withdrawal of Iraqi destroyed trucks and put the dead and wounded victims above it for take them inside the military base. Where many of victim died because of the wounded and bleeding for 6 hours without allow for ambulance to give any help, that resulting eight have died and remained two of the wounded alive as they left because they expected that they are dead, but when the sun shone, and many people in the area seen that forced American soldiers to transport the injured and non-finishing kill normalize. Wissam Mohammad Ftikhan After the intervention of the Fallujah mayor, Mr. Taha Bedawy and frequent reviews by the officials of Fallujah, US military handover the eight bodies that have been left in an inhumane form on the back of crashed wheels as one above each other in sunny-warm day. Where the bodies were to receive at 4 p.m. of second day whereas the smell unpleasant irresistible. While it was the receipt of the wounded who found in the situation of very fear psychological and terror after witnessed the horrific massacre and the murders without real reason, and they were suffering from deep and dangerous wounds as well as to disintegrated psychological state after the U.S. soldiers treated with them as they were terrorists, making the injured collapsing nervously from the severity of what they have seen of the deliberate and traveled killing of their colleagues. After three months of the incident, the U.S. forces appalling that resolved Fallujah protection force and merged it with the Fallujah police, after this force led a major role and courageous in the protection of Fallujah and support the police and prevent the looting and theft of public property since the forming of this force in 11.06.2003 which prevent the need for U.S. troops that were not satisfied that the safety of the people of Fallujah are leading their own security. I was a member of the local council of the city (December 2003 - June 2004), which was elected by the people of Fallujah, where I attended myself one meetings with the U.S. side at the military base near Fallujah, and attended the meeting with Americans some people with muscles bodies and wearing civilian clothes and cover their heads with Iraqi Arab scarf (this meeting was at the beginning of February 2004). The Americans were not military presented as former CIA clients (Blackwater private security contractors) and the representive of Paul Brimer administration in Fallujah, and in this meeting Blackwater clients suggest idea about how to recruit agents for the protection of their forces from the armed attacks (There was up to 45 people from the FPS, the U.S. forces had decided to stop paying their salaries under the pretext of they did not need for their services, in order to force them to work as spies for them under the pressure of financial destitution.) . Me and my colleague in this meeting were rejected this proposition because the responsibility of U.S. forces, according to the Geneva Conventions forcing U.S. troops to maintain the safety of Iraqis and not vice versa, and then told them that the people of Fallujah do not need to protect of US forces if they supply all the needs the police equipment and adequate weapons to maintain security. Once outside the big tent where held the meeting, we saw a new cars from Iraqi civilian models and some kind were BMW riding by clients of Blackwater company, which assures us that the unknown car (which caused killing of Fallujah protection force and fled to the U.S. base) was of them !!! This prompts the question as to which reason they opened fire on the building of local administration of the city in the middle of the night to terrorize the city and its security forces, which had enjoyed quietly good compared to other cities as the capital which were seen looting?? Note that the U.S. side decided to replace the paratroopers stationed in

Fallujah, Marines troop before the killing of the four security contractors of Blackwater company, and this may indicate a premeditated intent and next targeting with change forces from this type. (Enclose you the depositions of some of the victims with an apology book of U.S. troops to the family of one of the killed victims and some pictures of the dead and we are ready for submission all these to any other international investigation committee). (We have it but I cannot attached now because these victims inside Fallujah and may will be under threaten of killing later, I send copy as PDF to UN and I can show you or present this in press conference)
3. Crimes of arbitrary arrests and torture The aggressive policy pursued by U.S military against many of the Iraqi people that refused the presence of U.S. occupation and in particular with the people of Fallujah demonstrate a deliberate policy on harm and destruction. This policy included of daily indiscriminate arrests of innocent people because of the malicious slander is a salient feature of dealing with people, which was born additional feeling of hatred on the presence of these forces, which flouted the simplest rules of human rights. The testimonies (53) of some of the victims were residents of the city, which we attached in the attachments below, that explicitly refer to the methods of systematic arbitrary and torture, far from the most basic rules of human rights. These testimonies of some victims of Fallujah is clear evidence of the policy of destroying human dignity of Iraq‟s to bring a sense of humility and acceptance of American protection and did not refuse their agenda, which has become absurd in the theft and destruction of Iraq. One of the main risks of silence of the international community about crimes of torture and arbitrary arrests of U.S. troops, the silence's effects has started now to show results are across the scandals of secret prisons and torture camps in the same informal style of the series and continuing violations in Iraq. This does not absolve the responsibility of U.S. troops and private security companies that trained and supervised on Iraqi officers doing it until recently, which continues a policy of torture and arrest compromised under the pretext of combating terrorism.
4. Crimes of the first battle assault in Fallujah, April 2004. (The first Iraqi intifada against the US-UK occupation) On 4/4/2004 I had with members of the Fallujah local council a planned meeting with the commander of U.S. marines forces in Fallujah. This was our second meeting with them after the killing of security contractors of Blackwater. We were surprised this morning to found that U.S. forces closed all ports of transitting vehicles and pedestrians that leading to and from the city which were approximately 14 crossing or road. We went to the main military check point closed the road to the U.S. camp and have told them that we have a meeting with the military leadership, they allowing us to pass them, accompanied by military vehicles. When we entered the tent of meeting and found the commander of the Marine Corps holds the card and asked us to inform the whole people of Fallujah that they intend to take military action against insurgents who killed four contractors. The paper was publication from U.S. forces, asking Fallujah people in accordance with the Geneva Conventions to does not go out of the city, and if necessary, the people raising the white flag in front of U.S. troops to seek food or medicine only. When the U.S. forces decided the siege, they did not specify any targets or people targeted, especially in the meeting with a delegation of the Fallujah Council on the morning of April 4,

2004, leaving the door open for operations punishment destruction of civilians. Although of falsehoods published their report intelligence (39), they admitted that insurgents were from Fallujah with simple weapons and there was no central leadership which confirmed that Fallujah‟s people were in defence state on their city. They already decided this siege to make the city as a big prison and prevent the entry of food and medicine on their way. This was the first violation from many of the Geneva Conventions, because of starvation of civilians and to prevent their exit from the areas of conflict is a war crime. In attempting to discuss the feasibility of this process and that he has no right to punish an entire city because he could capture the killing of four contractors, where his troops intervened daily and nightly to arrest whomever they want and do what you want, why this collective punishment?? The commander of the Marine Corps replied us that this orders from the Pentagon and Washington, and he has not feasibility to discuss it, but applied only. Our delegation returned to the city and decided to launch an urgent appeal by satellite channels to save the city from the desecration and destruction crime that lie ahead. Actually, what we were afraid that it may have occurred. The U.S. aircraft bombed most areas of Fallujah in a randomly and brutally ways, starting with using a smal and normal bombs and rockets in the first days, and then wrought with bombs, weighing 300-500 kg and internationally banned cluster bombs which have killed and wounded thousands of civilians and displacing others thousands, as well as to the destruction of homes and property. The other proof of murder and collective punishment were the orders that were given to U.S. military snipers targeting any moving things like civilians cars or ambulanc or persons. The result of these criminal acts was killing of innocent civilians, young and old, male and female (2, 49, 50, 51, and 52) American journalist Dahr Jamail and Rahul Mahajan were in Fallujah during the "ceasefire." and had heard all kinds of horrible things about what was going on. their reports say something like 500-600 people killed in Fallujah, including estimates of 200 women and over 100 children. Many of the men who were wounded also told us they were just going about their business when they got hit. Iraqi minister of health who confirmed that the Americans had fired upon ambulances in Fallujah and also in Sadr City in Baghdad (40). US marinse does not interested to record the civilians deaths or injured as their secret documents revealed by Wikileaks site (41). But the statistics from the general hospital revealed 731 people killed and 2847 wounded, althought the general hospital located out the city and there are countless numbers not among this data because were many victims transfered to the Baghdad hospitals which were fulled with Fallujans‟ victims during the US attacks (49). Also there was one of the most egregious crimes committed by U.S. forces which was violation of the Geneva Conventions, it is the cutting the bridge leading between the city and the general hospital of the city, which deprived of all city residents from access to treatment, and this was the intention of the deliberate mass killing, which is a war crime under international humanitarian law. The soccer stadium in the city was turned to be a burial place for victims (mass grave). Schools turned to be home for those who lost their houses (49). While I stayed in the city, I contributed to the transfer of many dead and wounded civilians who were attacked either by the cluster bombs or by snipers, and one of these crime I witnessed, is the house of a civilian in the Shurta district, who was near me, after that we heard the fall of the cluster bomb which is characterized by two long votes When its bomobed, I went to this house with an ambulance, and found chopped to pieces by cluster

bombs and injured one have leg amputated, while the U.S. reports admitted using weapons similar to the cluster bombs called WDU-4A/A contains about 2200 flechettes (46,39). Another US crimes happened was about the use of white phosphorus munitions against the population of Fallujah which documented by Americand journalist Darrin Mortenson and Hayne Palmour during reporting from Iraq, they writed: Cpl. Nicholas Bogert (22, of Morris, N.Y.) is a mortar team leader who directed his men to fire round after round of high explosives and white phosphorus charges into the city, never knowing what the targets were or what damage the resulting explosions caused. For the third straight day, American jets hurled 500-pound bombs at buildings. According to The Associated Press, the U.S. military's death toll from the week of fighting across the country stood at 47. The fighting has killed more than 500 Iraqis -- including more than 280 in Fallujah, a hospital official said (47). One of the killed civilians have burned as similar effect of white phosphor, medical staff in Fallujah showed it to Japanes journalist Toshikuni Doi (49). In the first five days of fighting alone, as many as 300 civilians died in block-to-block combat, according to doctors at Fallujah's main hospital. "It's 17th century tactics," says Staff Sergeant Michael Ventrone, a Marine inside Fallujah. "It's under siege." (47) One look at the website like YouTube that loader a lot of videos evidences (picture and sound) you will find all confirms of our words and attached testimonies of victims. One of the war atrocities in these reports i twas that the American aircraft Type F-16 when bombing group the families of more than 30 civilans had intended to escape to the outside of the city. The crime was that the American pilot had asked his ground control officer about dealing way with group of civilians, and the reply came from the ground control of U.S. military to bombing them and kill them all, although they have the white flag. Because of many risks and the security situation difficulties, so we could not take statements or affidavits for all victims in Fallujah, but some of the victims of this battle, which we present to the end of the report within a paragraph attachments and retain the original (in Arabic) if requested by any international investigate comittee. The US snipers continues shoting on civilians after the truce (49). One of the main outcomes that must be observed in the outcome of this battle and the victory achieved in Fallujah, is the eagerness among the sects of different Iraq's religious and unite them to support Fallujah, by money, food, blood donation, and most of this is the beautiful cohesion entry appears between the people of Fallujah and the Sadr movement of Moqtada al – Sadr, that began attacking US troops on 2 April and this added to the pressure to resolve the Fallujah‟s fight as quickly as possible (39).
In Fallujah neighborhood full of Kurds and many of them were killed during the fighting. The
humanitarian assistance came from various parts of Shiite, Sunni Arab and Kurdish for supportting the city to defend itself. This brotherhood and love that emerged was not acceptable to some occupation sides and Iraqi politics who returned to Iraq under the sectarian slogans to have a puplic base. This fraternity and national unity that emerged during the battle between the various sects of the Iraqi people were not curious, but was one of the most important characteristic of the power of the Iraqi people, the diversity of sects and their unity as one body when you feel the same danger and pain.
5. Political crime prevention peace opportunity before the massacre of the second battle This crime was happen in August 2004. After the end of the first battle of Fallujah that official beginning on May 2004, depending on the official agreement (between Fallujah‟s people and US government after dialogue with two delegations from Fallujah) was to establish a formal army (Iraqi Civil Defense Corps (ICDC) followed to the Baghdad government, from Fallujah people to protecting the city without allow of entery of U.S. forces into the city, except in specific cases, accompanied by security forces of the new army (23). Unfortunately, this agreement is completely free of any international guarantees to protect the city in a state of decline of U.S. troops on the agreement and allowing its feet on the city again, where U.S. forces have rejected that intervention of UN and prevented the UN presence as an intermediary guarantor to keep the agreement, reflecting the deliberate intention of going back to hit the city later. That what we were afraid from it has happened, and during the period between the two battles, which were supposed to be a period of peace. The U.S. forces under the pretext of

chasing insurgents was bombed an ongoing residential and industrial areas with huge weight bomb of 500 kg, and sometimes I was a witness to the shelling of cluster munitions. Therefore, it has serious dialoge started between a delegation from Fallujah under the chairmanship of Sheikh Khaled Hamoud Jumaili (and was a member of the negotiating team is Dr. Rafee Hiead Issawi, that currently a deputy of Prime Minister in Maliki's government) and a delegation from the Dr. Ayad Allawi government (Iraqi interim government), and this delegation is headed by Mr. Hazem Shaalan who was the Iraqi defense minister at that time. The dialoge continue for a period and was reached at the end for a peace agreement between the negotiating team of Fallujah with the transitional government in Baghdad. I have a taped recording with head of the Fallujah delegation, which shows the full details of the negotiations with the Iraqi defense minister and the most important points of peace agreement and integration with the transitional government. Iraqi Defense Minister Hazem Shaalan asked 3 days deadline from Fallujah delegation to discuss the Convention within the Iraqi Council of Ministers chaired by Dr. Iyad Allawi. But after just two days, Mr. Hazem Shaalan sent a quickly request to the negotiating team for Fallujah to an emergency meeting, Defence minister Mr. Hazim told Fallujah delegation that U.S. side rejected the peace agreement and their determination to strike and seize the city and Iraqi government could not do anything. In the meantime with see the events are going to a new a massacre, have a false headline is artificial disarmed by force because the people of Falluja reject peace. In a bid to bring down this lie after the destruction of the peace agreement with the government of Iyad Allawi by the Americans, I have arranged an urgent meeting between the delegation of Fallujah negotiators and representative of the General Secretary of the United Nations in Iraq, Mr. Ashraf Qazi. The delegation of Fallujah described in detail (It was speaking describtion in front of me, and I have person from UN are ready to confirm this and he is in high position now in UN, and its best you did with him interview before US kill him, as well as the letter from from Mr. Qazi to Mr. Kuffi have all these details but only official side or judge have right to asking it)on the U.S. refusal to a peace agreement with the Government Dr. Iyad Allawi, and the Fallujah delegation asked for a formal Mr. Ashraf Qazi to intervene to stop the carnage to come, and UN should be a party to the mediator and guarantor of any future talks because of our unconfidence in the promises of US military. Indeed, Mr. Ashraf Qazi has sent an urgent letter to New York requesting the General Secretary of the United Nations, Mr. Kofi Annan to intervene to give a chance for peaceful dialogue and avoid a military solution, which mainly hurt innocent civilians as happened in the first battle. For this, Mr. Kofi Annan sent an open letter announced in the media (BBC) in which he requests from the U.S., British and Iraqi governments to avoid a military solution in order to preserve the safety of civilians in Fallujah and allow the United Nations to intervene as a mediator in the talks between them and the people of Fallujah, and this is the real role must be conducted by this international organization in maintaining peace and promoting the logic of reason "and avoid any hurt of the innocent civilans. The peace message sent by Mr. Kofi Annan was rejected by the governments of U.S. and British occupation (7). But the most egregious was done by British Prime Ministers Mr. Tony Blair when he went to the Lord‟s council asking permission to allow the transfer of 5000 British soldiers from the area of Basra to the outskirts of Baghdad from the side of Fallujah, under the lie that Fallujah people refused to peace and the need for disarmament by force to justify support logistical support and participation in the massacre of the second battle. That these facts and with our proof of it, is a sign of conclusive determination of the criminal in the destruction of major city in Anbar province and to killing and wounding thousands of civilians, as well as the displacement of tens of other thousands. All these just for flimsy reasons behind them there other reasons such as breaking the reputation of the U.S. military

and its inability to enter the city at the first battle, with no admission of some politicians to the idea of liberal city has a possiblity to unite Iraq's Sunnis and Shiites after the great convergence between the people of Fallujah and the Sadr movement. Revealed the real strings behind this political crime which preventing the peace chance is the real way to know who killed the Iraqi people every day for sectarian reasons. Because of the action to hit the national unity among the people of Fallujah and the Sadr movement, and then encouraged the deployment of death squads and sectarian war led after the bombings of the holy shrines In Sammera 2005, is the same the criminal who killing the Iraqi people every day (32). This political crime in the prevention of opportunity for peace is the biggest crime than genocide itself, as evidence on politicans have a dangrous agenda of serious proportions and free from any respect for human rights, and thus helped to perpetuate the tragic situation of the Iraqi people so far.
6. Crimes of the US - UK troops in the second assault battle on Fallujah (September - November 2004)
The US report revealed by Wikileaks site referred to the mistakes of the Marines in the first
massacre on April 2004, which gave us a real reasons for many violations carried out during
the second massacre on November 2004 to prevent any information go out the city during this
huge crimes against the humanity. The report also makes clear that, in the military's opinion,
the Western press are part of the U.S.'s propaganda operation. This process was facilitated by
the embedding of Western reporters in U.S. military units (39).
In November 8, 2004 the US occupation forces invaded Fallujah again, but with logistical
support from British troops that relocated around Baghdad (From the south-east of Fallujah).
After 18 days, the Iraqi national security adviser said more than 2085 were killed, but the
BBC reported the Iraqi Red Crescent feared more than 6000 people could have died (49).
It is well known (21, 48 as well I have testimony from Aid workers in Red Crescent) that the
American forces prevented aid‟s agencies (IRCS, ICRC) from entering the city and the nearby
towns and villages, were hundreds thousand of Fallujans refugees, were also struggling to
survive without water, food, medicine and electricity, like some refugee camps in Habbanya
and Saqlawia areas, which stayed without receive any governmental food or medical
assistance for more than 3 months (48). This has created, according to the Iraqi Red Crescent
Society (IRCS) a humanitarian disaster in which innocent people were dying because
humanitarian help can‟t reach them. The (IRCS) asked the permission of the Americans
forces to go into the city with teams of doctors and relief experts but they weren‟t allowed.
The International Committee for the Red Cross was also trying to enter the city and the
refugee camps with humanitarian relief. It said on 10 November that there are thousands of
elderly and women and children who have had no food or water for days.
According to the IRCS branch in Al-Anbar, an additional 4,000 families have fled Falluja in
recent days and are currently struggling to survive, without water, food or medicines. The
large-scale offensive against Falluja by Iraqi and Multinational Forces began on 7 November,
displacing thousands of families, most of whom sought shelter with relatives or friends. But
many are living in makeshift conditions such as tents and abandoned homes. There are
approximately 250,000 people living in 12 camps in the area and between 30,000 to 50,000
are believed to have remained during the fighting (35, 43).

This situation was main reason pushed at 16 November 2004 the speakerman of the United
Nations High Commissioner for Human Rights Mrs. Louise Arbour to voiced deep concern
about the situation of civilians caught up in the ongoing fighting in Falluja, Iraq and called on
all concerned to protect them (34). Through her spokesman in Geneva, Louise Arbour cited
allegations that the rules of war designed to shield civilians and combatants had been broken
during the current confrontation. "All violations of international humanitarian law and human
rights law must be investigated and those responsible for breaches - including deliberate
targeting of civilians, indiscriminate and disproportionate attacks, the killing of injured
persons and the use of human shields - must be brought to justice, be they members of the
Multinational Force or insurgents," spokesman José Diaz told reporters. He also voiced the
High Commissioner's concern about poor access to humanitarian aid in Falluja and about the
lack of information regarding the number of civilian casualties.
American journalist Richard Lloyd Parry met with Refugees escaping Fallujah and described
a humanitarian crisis in the city, women and children killed by the US bombardment or dying
for lack of medical treatment, medicines and sanitation. The Red Crescent said that a woman
died after miscarrying in a refugee camp where no doctor was present. A boy died of a snake
bite because there was no antidote available. A clinic used as an emergency hospital was hit
by a bomb, killing many doctors, nurses and patients, medical staff said. A boy aged 9 hit by
shrapnel bled to death because he could not be taken to hospital (36). A hospital has been
razed to the ground in one of the heaviest US air raids in the Iraqi city of Falluja (38). and the
United States military and Iraqi government not just destroyed a civilian hospital in a massive
air raid, captured the main hospital, but also prohibited the use of ambulances in the besieged
city of Fallujah (45).
It was one of the most serious violations carried out by U.S. forces is to prevent a free press
from entering the city during the military operations to cover up their crimes. And lie about
free city from civilians before military operations has dropped. A lot of news agencies and
photographers as well as the testimony of U.S. marines soldier below, who confirmed the
existence and survival of civilians, especially the poor whom they are primarily in the
thousands of people from the city. Including the recognition of U.S. reporter (Dexter Filkins)
accompanying the marines as they entered Fallujah in mid-November 2004, on page 6 of his
book (8) and watching some kids researching food. While one of my relatives who went into
Fallujah after month of ending the fight (He is ready to give his testimony), he assured me
that he saw a particular bodies of civilians from the families of some of his neighbors who
were women and children and the elderly, and these ages were the main victim in this battle
were killed or wounded, or detained or, an unknown determination until now.
U.S. forces detained and arrested an approximately three thousand civilians (especially men
and youth) who remained in the city with their families. They put them in a very humiliating
cages, In flagrant violation of the principles of human rights, some of them were forced to
work cleaning up the city in order to erase evidence of the American crimes. U.S. shifted a
large number of arrested civilians to Abu Gharib and Basra (Boukah) prisons. while many of
them died due to the ill treatment in these two notorious prisons. Till now, there are hundreds
of missing persons from Fallujah like old man called Shaker Hamdan Abdullah Al-Faiad Al-
Kubaesy which missed in American prison in Basrah (9).
Civilian suffered in the second Fallujah assault and many civilians have fled Fallujah to seek
refuge in nearby camps, abandoned buildings, and with acquaintances elsewhere in Iraq.
However, thousands more have remained, often hiding in their homes and with many

enduring casualties, shortage of food and clean water, and woefully insufficient medical
services (37).
Many witnesses (1, 8, 20, 21, 27, 48) former US soldiers like Garret Reppenhagen admitted
that they were shouting on any moving body and he kills many civilans, as well as I have a
some testimonies also, confirmed the group killings of unarmed civilians inside their houses
and in mosques. Also many were shot to death after handcuffed and other blown up inside
their own homes. The civilians who stayed in the city during the American offensive have
gone through numerous tragic stories and inhuman treatment by the occupation forces and the
so - called Iraqi National Guards. The deliberate killing of the civilians was the daily practice
of the American forces. Many children had to watch their parents being shot to death in front
of them, or men who had to watch their children and their wives being killed. As example,
Hamid Abdulrazzak Sultan, a citizen from Fallujah, witnessed the killing of his pregnant wife
along with his 4 sons during an American attack on Nov 2004. Four members of the Fawzi
Hussein Salman al-Aisawi‟s family where butchered to death by the American forces in front
of their daughter, Huda. Almost every family who stayed in Fallujah has to bury a victim in
its garden.
Although there are no exact numbers of civilian causalities on record, there are thousands
(42). On 25th and 26th of December 2004, the emergency teams of Fallujah hospital had
removed 700 dead bodies from six residential quarters only. Fallujah is consisted of 28
residential quarters, and among those collected bodies were 504 of children and women (28),
and the remaining number belonged to old and middle-aged men, all these victims were
Iraqis. The American forces itself announced that they had more than 1200 bodies kept in
refrigerated stores beside Fallujah (which was used for potato storing). This is an indication of
the large-scale slaughter of civilians in Fallujah.
Eyewitnesses confirmed that some members of the Iraqi National Guards had robbed houses
and stores using their official cars, and openly sold the robbed items in surrounding areas of
Fallujah, and in different places at Baghdad. This was done with not only the knowledge and
approval of U.S. forces but also some US marines were looting and participate in it, as former
marines soldier (Ross Caputi) admitted in his attached testimony below.
The Continuation of devastating residential houses in the city. Eyewitnesses asserted that,
after the battle, numbers of returnees who living in al-Andalus residential area found their
houses intact, but when they left the city and returned back three days later; they found that
these houses were recently destroyed, without a clear reason. And this crimes confirmed by
US marines (Ross Caputi).
According to governmental reconstriction committee in Fallujah, they found the desrtruction
results were:
26000 houses partial destroyed, 3000 houses completely destroyed, 100% the destruction of
electricity power service, 50% the destruction of water system for human uses, 70% the
destruction in sewage system, 70 Mosques were destroyed, 50 Schools were destroyed.
I have entered myself into the city after the stop of fighting in January 2005, as assist and
accompanied of an Iraqi journalist called Dr. Ali Fadhil (48) who was working with the
Fourth British channel. As a result of continuing access to the journalist, we have raised more
than 25 hours recording inside and you can find it at the British TV station (27), that confirm
many of the violations have watched. Iraqi journalist was witness on some of the bodies were

beheaded and the subject of the rest of the body resembles the crucifixion of Christ. In light of
this newspaper report highlighted in the British TV station at the time, I have to hand over a
copy of the film and presented to the representative of the General Secretary of the United
Nations in Iraq, Mr. Ashraf Qazi and in this meeting held particularly in the WHO office in
Amman, as well as attaind with us a person from the Human Rights Office of the UNAMI. I
started to show the British movie, All were shocked from watching the reality of the city after
the battle, Mr. Ashraf instructed to his staff for writing two separate requests to the U.S.
forces, in order to allow the entry of two teams from the World Health Organization and the
Office of Human Rights of UNAMI, for investigate about what was in the British film. As
usually, the U.S. forces denied these requests under lie of security risk, to prevent any
investigation or a comprehensive scientific study of them can know the facts, while they were
allow for US politics to visit Fallujah from another side.
Therefore, the most important war crimes urge you to investigate about it, which took place
during this battle only are:
1. Investigation of killing of civilians, as was seen with kill the old wounded man in a
mosque, or through the use of methods of beating, the wanton destruction and the destruction
of houses over the heads of its owners, under the pretext of the possiblilty to presence of
armed men, not to mention the bodies which were signs of executions. As well as to the
looting and the theft of property houses and private things of civilian deaths and personal as
the spoils of war (as stated in the testimony of US marines soldier who fought in Fallujah
during this battle, he is called Ross Caputi).
2. Revealing the locations of mass graves where the bodies burnt by prohibited weapons or
executed one by slaughter his throat and that there were some photographs in the media or
referred to by U.S. journalists like Dexter Filkins, who confirmed in his book, watch some of
the bodies have been cutted head and let this head on the bodies, while the legs and hands
placed in similar to the crucifixion of Christ (peace be upon him). The beheaded corpses did
not know her whereabouts so far.
3. The use of many types of prohibited weapons and large quantities, higher than in the

Englehart) were recognized by using chemical weapons (WP) which termed MK-77 , while
the second one was sniper recognizing killing of civilians on the instructions orders issued by
the U.S. military. U.S. reporter of New York Times journal accompanying the US marines
during they entered Fallujah in mid-November 2004, he recognized and witnessed the using
of WP on page No. 6 of his book (The Forever War), which arrived even to American soldiers
due to huge use. US marines Ross Caputi witnessed also using WP, as well as most of my

people and I witnessed the using of cluster bombing (see the testimonies below of victims
attacked or killed by this mentions).
All these evidences confirmed that US-UK governments were violated chemical weapons
convension, which mean they are responsibile about any suffereing of civilinas caused by this
weapons. The use of incendiary weapons is prohibited for attacking civilians according to
Protocol III of the Convention on Certain Conventional Weapons. However, the United States
is not a signatory to Protocol III, so there is no international legal barricade to stop the United
States from continued use of the chemical, but UK government was signed it.

Testimony of former private US marines soldier (with others in

My name is Ross Caputi and I am a former Private of the United States Marine Corps.
I was in the 1st Battalion 8th Marine Regiment Alpha Company Headquarters Platoon
during the time of Operation Phantom Fury in Fallujah, Iraq, in November of 2004. I hope
that my testimony is useful in bringing attention to the human rights violations and war
crimes that we committed, and in giving at least some amount of justice to the people of
Fallujah.
My unit was inserted into Fallujah as part of the main effort of this operation, during
which I was the company commander‟s radio operator. Our company Commander‟s name
was Captain Cunningham. I have knowledge of certain war crimes and human rights
violations that he was aware of and allowed to continue. I also witnessed white
phosphorous being dropped on Fallujah during an air assault.
Before we were inserted into the center of Fallujah, my unit sat outside of the city in
fighting holes waiting for the air assault to finish. Ground troops had not yet entered the
city at this point. During that evening when it was dark, I witnessed white phosphorous
being dropped on Fallujah. I asked a nearby lieutenant if it was legal to use white
phosphorous, and he replied to me that it was because we were dropping it on the
periphery of the city and we were only using it as a smoke screen, rather than using it
offensively. From my position I could not see with any certainty whether the white
phosphorous was dropped on the city, on the periphery of the city, or on civilians who had
fled their homes and were camping in the periphery of the city; and that lieutenant could
not either. Because he seemed certain that we were using it as a smoke screen, without
being able to see where it had landed, I think he knew before hand that we were going to
use white phosphorous. That lieutenant was Lieutenant Malcom of 1st Battalion 8th
Marines Alpha Company Weapons Platoon, who was killed two days later from a gunshot
wound.
A few days later we were inserted into the mayor‟s complex in the center of the city. I
believe that this was around the 10th of November. From there we pushed forward going
house-to-house for several weeks until we reached the far end of the city. In each house
there were often possessions left behind from the families that had recently lived there.
Looting became very commonplace. The people around me were stealing anything that
seemed valuable – silverware, teapots, knives, and clothing. I stole a black winter sky
mask out of a home. Other people in my unit were searching the pockets of dead
resistance fighters for money. The platoon commanders and the company commander
were aware of what was happening, and they tolerated it for several days, until they
eventually issued an order that everyone had to stop looting.
During this period we began using a tactic called reconnaissance by fire.
Reconnaissance by fire is when you fire into an area or building to see if there are people
there. If you hear silence after your firing, then there are no people in this area or building.
If you hear otherwise, then there are either combatants or civilians there. Before the
operation began we were briefed that all civilians had left the city, but on November 10th
we encountered civilians in the center of Fallujah and we realized that this information

was untrue. Reconnaissance by fire is always indiscriminate, and we began using it
several days after we were inserted into the city, even after we learned that there were still
civilians in the city. The platoon commanders and the company commander were aware
that we were using reconnaissance by fire, they allowed it go on for several days, but
eventually they gave an order that we were no longer allowed to use reconnaissance by
fire. I should make it clear that I never witnessed reconnaissance by fire with my own
eyes. I only heard it being talked about on the radio, and I heard other Marines talking
about it. I was the company commander‟s radio operator, and radio transmissions about
reconnaissance by fire came over the radio when he was present, so I am certain that he
was aware that we were using reconnaissance by fire.
We also used bulldozers to clear houses. This tactic was used the entire time that we
were in Fallujah. If there were suspected resistance fighters in a house, then we would just
bulldoze it on top of them, rather than risking our lives by entering the house. Sometimes
if we were unsure whether or not there were resistance fighters in a house, then we would
bulldoze it just in case. In these instances this tactic becomes indiscriminate. I witnessed
the battalion that flanked us bulldozing an entire neighborhood so that they would not
have to send their men inside to clear those houses.
There was one incident when there were two resistance fighters and a young boy,
roughly ten years old, bunkered into a house. I am not sure if attempts were made to
negotiate or to save that young boy‟s life in some way, but we eventually started firing
grenades into the house with a mark-19 until the house collapsed on top of all three of
them. They were all killed. The lieutenant closest to this incident was Lieutenant Barns of
1st Battalion 8th Marines Alpha Company 3rd Platoon. I do not know what was done with
their bodies, or if any action was taken to identify the bodies and report this incident. My
entire chain of command was aware of this incident. It was filmed by reporters form the
BBC, one of which was Paul Woods. This video was available on youtube for a while, but
was eventually removed. In every instance that we killed either resistance fighters or
civilians, I am unaware of any action taken to report their deaths. We always just moved
on.
I have given all the information that I think might be helpful, and I would be willing to
testify further before any of the special procedures about any aspect of Operation Phantom
Fury, or any other incident that I witnessed in Iraq.

7. The crime of environmental pollution effect on health
issue, and threaten of the new generations.
The serious effects caused by the battles of Fallujah, the first and the second was disastrous to
the health of civilians in general, did not deliver any sex or age of the cancer or congenital
malformations, which was the dominant feature of a significant proportion of children born in
the last period. That the blockade imposed by U.S. forces for a long time, and prevent the
entry of persons other than the city could make the city live for a long time with its population
and as if a big prison. This has prevented the holding of any scientific study or research
Hakiqip equivalent to the volume of pollution. For this we have, in cooperation with the
Department of Fallujah hospital and throughout the years 2006/2007, collects the official
statistics of the disease, to launch the first scientific report of medical shows the fact that the
health status of the city, three years after the end of hostilities (25, Prohibited weapons cresis
in Fallujah. CCERF-MHRI, 2008). In the light of the spread of this report, the two members
of the U.S. Congress visited Fallujah in August 2008 not to know the truth about pollution,
but to check those who gave this information, and without allowing real action equivalent to
the pollution. It was our first in terms of numbers refers to the fact that there is a serious and
substantial increase in the proportion of congenital malformations and cancer diseases for
both sexes and various ages. The official medical reports to the Fallujah hospital and signed
by three senior doctors at the General Hospital refer to:
1. In 2006 showed 5928 cases of dangerous medical conditions were not previously known
among civilians or were rare.
2. In the first half of 2007, showed 2447 appeared seriously ill, mostly little-known medical
description, and the rate of 50% of them involving children, which means that threaten the
future of the city through injury of future generations seriously ill.
While there is a new study, done by the researchers (26), Chris Busby, and the owners of
Hamdan and the triumph of Abadi, and published on 07.06.2010 in the International Journal
of Environmental Studies and Public Health - (IJERPH) Basel - Switzerland in number 7
(page 2828-2837), about epidemics suffered by the residents of Fallujah, which showed an
increase in the rates of cancer, blood cancer, infant mortality, disturbances in normal
deliveries more damaging injuries, which announced to the survivors in Hiroshima and
Nagazaqi in 1945!!
The results of a field survey conducted in February 2010 and included 711 houses and over
4000 Quested in Fallujah, revealed that the five years following the terrorist attacks of 2004 to
the American forces on the city led to the doubling of all forms of cancer four times.
Interestingly, the type of cancer similar to than that of survivors in Hiroshima who were
exposed to ionizing radiation ionizing radiation resulting from the atomic bomb was dropped
from the air and dust generated by the uranium. Comparing a sample of the rates of infection
in Egypt, Jordan, the researchers found an increase in these conditions in Fallujah by 38 times
to leukemia (20 cases) and ten-fold increase in breast cancer for females (12 cases), and a
significant increase in lymphoma and brain tumors in adults.
Based on the sixteen cases of five-year period, it was noted, in particular, an increase in
cancer children (birth date - 14 years) by 12 times. Increase the incidence of cancer and

leukemia, which focused on young people. The number of infant mortality 80 deaths per
thousand births, compared with 19 deaths in Egypt and 17 in Jordan and 9.7 in Kuwait.
Important outcome was the proportion of gender sex-ratio. This percentage of the population
in normal situations is always 1050 males and 1000 females, the percentage declined sharply
between births in Fallujah and suddenly after 2005, 350 male-only, meaning the inability of
these children to life.
The frequency of birth defects in Fallujah, Iraq reached above 25% of births within the last 6
years. Congenital heart defects (CHD) has the highest incidence, followed by neural tube
defects (NTD), and skeletal anomalies. Similar birth defects were reported in populations
exposed to war contaminants. Metals, including heavy and radioactive metals like depleted
uranium (DU), are known to have teratogenic and mutagenic effects and induce damage
through epigenetic mechanisms. (Data under publication). The other group of researchers (29)
found that malformations are close to 11 times higher than normal rates, and rose to
unprecedented levels in the first half of this year – a period that had not been surveyed in
earlier reports. In May 2010, 15% of the 547 babies born had serious birth defects. In the
same period, 11% of babies were born at less than 30 weeks and 14% of foetuses
spontaneously aborted. ''We suspect that the population is chronically exposed to an
environmental agent,'' said one of the report's authors, Mozhgan Savabieasfahani, an
environmental toxicologist (30). The World Health Organization (WHO) is unlikely to
conduct any unbiased study (31)
One look to the internet pages will help to see a lot of press and media documented for many
diseases, congenital anomalies, cancer AK\ Falluja's doctors said the city had not before there,
as well as to the attachements. (4, 5, 11, 12, 13, 14, 16, 25, 26)
The recent risk now is not just in Fallujah, since the pollution elements entered the life cycle
and arrived to other places in Al-Anbar province like Ramadi city (Capital of province),
which is currently experiencing 73 birth defects cases each two months (during the period
from 1/11/2010 till 9/1/2011), that mean more than one case per day (33, with some Photos
below).
One of the organizations of MHRI net (Akhear Association of Human Rights- Fallujah)
was documented some cases (The security risks prevented to documentinh more cases) of
deformed children were born after the two assaults in Fallujah, which confirmed using
weapons type worest white phosphore weapons. The testimonies were as following :
1. Zahra Mohammed Majid Hamid was born in 2005 in the Al-Thobat district. Where
her mother confirmed she was pregnant with this baby during the fourth month of
pregnancy, when U.S. forces hit the city of Fallujah, the poison gas which led to the
birth defects (Zahra paralyzed legs).
2. Ammar Saleh Mahdi Saleh was born in 2006 (crippled's disease). Where his mother
confirmed that she was infected with HIV as a result of the fighting in Fallujah, but
after first pregnancy, and the child through the process of birth complications was hit
as a result of this distortion.
3. Omar Khaled Hilal Khalef, born 2006, and his family live in the neighborhood of
Andalus. Injured quadriplegic.
4. Rafat Al’aa Mahdi Saleh, born in 2005 and who was quadriplegic before his
brother's favor.

5. Ammar Mohamed Musharraf Sebti was born in 2004. he havea quadriplegic
because of prohibited weapons used by U.S. forces in Fallujah.
6. Abdulrahman Abdullah Hussein was born in 2006 and was quadriplegic due to
pollution, which affected the area of residence (District Al-Jullan) during the battles
of Fallujah.

Recommandations:
1. The inability of the Iraqi judiciary for trial and accounting crimes and violations of the U.S.
- British soldiers is evidence of the continuation of occupation effective, then completed by
the security agreement between U.S. government and the Iraqi government to confirm this
deficit. So it is our right to hold the international community now has the responsibility to
prosecute and hold accountable the perpetrators these crimes and was pushed through and
compensate the victims, including appropriate scale of suffering and pain throughout that
period until now.
2. That above mentioned crimes are war crimes and crimes against humanity according to the
characterization of international law experts both sides of the humanitarian and human rights,
can not be condoned no matter how long the crime will not time-barred in accordance with
the norms of customary international law.
3. The establishment of an international criminal court, or at least a fact-finding committee of
the neutral countries not involved occupying or helped in any way, is the first step in
eliminating injustice and redress for victims of innocent people.

the international community know the truth about the human rights situation in Iraq is

compensations equally to US civilian victim‟ compensation that took because they suffered
psychologically after they arrested in Iraqi presidential building during the war in 1991.
Based on the principle of equality among the victims, regardless of their nationality, and
because of the vulnerability of civilians in the city of Fallujah and the surrounding villages to
the crimes of genocide and collective punishment, it is our right to claim compensation ranges
between 9-10 trillions U.S. dollars

7. The collection of these facts during the last period and submitted to the international
community is the only way for us as civil society organizations provide transitional justice
real, which will bring security and the peace of our country. For this, we hold international
community and all its legal and political institutions full responsibility to investigate what
came in our report, with our readiness to provide all the testimony and evidence substantiating
all the information that came in, and any disregard for these crimes is not only evidence to
indirect involvement, but the block to bring the rule of law and protect to the Iraqi people,
which mean participating with continue daily killing of Iraqi innocent people.
8. We invite all the media and journalists have evidences and materials on crimes happen in
Fallujah, to give it to special procedure office of UN Human rights council. We are calling
especially the Arabian channels Al-Jazeera and Al-Arabia as well as to Wikileaks information
site, for helping the justice to Iraqi victims.

1. Montaser Sami Hammad Ali al-Alwani: (M) were killed by a random firing of US
troops on civilians in the district Nazzal on 7/6/2003. (Witness: his father, Sami Hammad
Ali Judaie Al-Alwani).
2. Ahmed Obaid M'hidi Saud Issawi: (M, age 33 years (1971) and an employee of the
Cement Fallujah factory) was killed in a shooting rampage by U.S. units stationed in the
Al-Siaheia triangle intersection on 27/10/2004 due to the exposure of these forces to fire
was unknown, and the reaction of U.S. forces opened gunfire indiscriminately at
everyone who was close to them, killing the victim when he was passing by on the way
near the scene of the accident. (Witness: his brother, Diaa Eddin Obeid M'hidi Saud al-
Issawi).
3. Ahmed Hassan Krhot Shaker: (M) killed on 06.01.2004 when he went to the outside
door of the house to find out the cause of bullets that were ringing out, surprised to hit a
missile towards his house to kill him with his wife, Siham Khalaf Ali immediately. After
this incident, the U.S. troops an apologized from the victim's family without any financial
compensation until now. The dead man had five children between ages 6 years to 7
months. (Witness: his father, Hassan Krhot Shaker).
4. Siham Khalaf Ali: (F) killed on 01/06/2004 while out with her husband, Ahmed
Hassan Krhot to the outside door of the house to find out the cause of bullets that were
ringing out, while she faced a U.S. missile strike to her house to kill her and her husband
Ahmed Hassan Krhot immediately. After this incident, the U.S. troops an apologized
from the victim's family without any financial compensation because the curb. The dead
women had a five children between ages 6 years to 7 months. (Witness: her husband's

5. Mohammed Annad Abboud Jassim al-Alwani:(M, aged 22 years old) was deliberate
on 28/4/2003 by U.S. forces stationed in a Al-Kaeed school which located in the
neighborhood of Nazzal, where he was going to visit relatives and while walking were
located nearby, a peaceful demonstration first against the presence of U.S. troops among

the civilian houses, prompting U.S. forces to shoot randomly and kill the victim from
among the dozens who died in this peace process between the killed and wounded.

area of the head which led to his death, during the first battle in April 2004 in the Jolan

4. Mohammed Saadoun Jassim Mohammed Owaid al-Jerisi: (M, Age 24 years and an
officer of the the former border police), was killed by the U.S. bombing while coming out to
shopping for his family in Street of Anbar„s School that took place on 11/4/2004. (Witness:
his relatives, Awad Ali Hussein Rahim Jerisi)
5. Hussein Ali Ahmed al-Alwani: killed by U.S. bombing the area of the Golan Heights
neighborhood on 8/4/2004 (witness: his brother, Mohammed Ali Ahmed al-Alwani). 6. The
kid called Moueid: killed by a fatal head injury as a result, U.S. aircraft bombed the
neighborhood Al-shohadda on 10/4/2004. (Witness: his mother, Amal Ibrahim Mohammadi

American planes on the Jolan neighborhood, while he was with his family to visit relatives in
the Jolan neighborhood in April 2004, and the injuries were fatal, including areas of the chest

8. Ibrahim Abd Ali Jerisi: killed as a result of cluster bombs strikes by U.S. warplanes

9. Faheq Salem Abd al-Jerisi: killed as a result of cluster bombs strikes by U.S. warplanes

U.S. aircraft on the area around Fallujah Nuaimiya on 8/4/2004, during the siege of the city

11. Fatah Saad Abbas al-Issawi: 8 years old, was killed as a result of U.S. bombing and
launching indiscriminate firearm by U.S. forces in the vicinity of Abdul Aziz al-Samarrai

12. Hisham Sttar Jubayr Farhan (M, children and the old year and a half): killed in a
bombing by U.S. aircraft on the Shuhada district on 16/4/2004, and the fatal injuries in
various parts of the body as a result of bullets and shrapnel. (Witness: his relatives, panic
Hamid).
13. Ali Obaid Araimt al-Mohammadi: (M) was killed by indiscriminate bombing by U.S.
aircraft on the area of the Golan Heights neighborhood on 14/04/2004 and using weapons
banned cluster (witness: his brother, Ahmed Obaid Araimt Mohammadi).
14. Hisham Jubayr Farhan: (M, aged 18 years old) was killed by U.S. gunfire and random
on 17/4/2004 area Aljughaifi district (where the victim lives), and the injuries were fatal in
different parts of the body. (Witness, and his mother Halima Abdul-biggest oil exporter).
15. Mohammed Qasim Mohammed Jumaili: (children and aged 4 years) was killed by
indiscriminate bombing by U.S. aircraft on the area live on the military 16/4/2004. (Witness:
his father, Qassim Mohammed Abdullah Jumaili)

16. Asaad Abdel-Hamid Shihab al-Ani: (M, engineer, aged 41 cents (1961) is married and
has three daughters and his wife is pregnant with a fourth in the time of the incident), was

17. Mohammad Adnan Allawi: (M) was killed in a shooting rampage by U.S. forces on the

17/4/2004 by a U.S. sniper when he was playing in front of his home in the Nazzal

chest. He was buried in the same grave with his brother, my right who was playing with him

killed on 17/4/2004 by a U.S. sniper when he was playing in front of his home in the Nazzal
