House Bill 1244—U.S. History Assessment

STAAR U.S. history assessment must include 10 questions randomly selected from the civics test administered by the U.S. Citizenship and Immigration Services as part of the naturalization process.

TEA must

• ensure that the questions included align with the Texas Essential Knowledge and Skills for the high school U.S. history course; and

• annually issue a report that:

• provides the included questions and answers

• details student performance on the questions, both statewide and disaggregated by district and campus

House Bill 1244—U.S. History Assessment

• Due to the amount of time necessary to implement this legislation, TEA is planning for this change to the STAAR U.S. History assessment to occur during the 2020–2021 school year.

• There are NO changes to the STAAR U.S. History assessed curriculum or blueprint as a result of this legislation for the 2019–2020 school year.

Senate Bill 213—Graduation Provisions

This bill extends the current expiration date for certain provisions from September 1, 2019, to September 1, 2023, effective immediately. This includes:

• using the TSI assessment as a substitute assessment,

• graduation based on the determination of an Individual Graduation Committee for students who have STAAR as a graduation requirement but have not met assessment graduation requirements, and

• alternate graduation requirements for students who entered ninth grade before the 2011–2012 school year but who have not met assessment graduation requirements.

House Bill 3906—First Instructional Day of the Week

• The SBOE shall ensure that STAAR assessments are not administered on the first instructional day of the week (i.e., Monday).

• This applies to STAAR grades 3–8 and EOC assessments.

• This does not apply to STAAR Alternate 2, TELPAS, or TELPAS Alternate.

House Bill 3906—First Instructional Day of the Week

• The 2019–2020 testing calendar was updated to reflect this new law.

• All STAAR assessments were adjusted to avoid testing on Monday.

• If a district is no longer in session during the June STAAR administration, the district may adjust the testing schedule to test on Monday.

House Bill 3906—Multi-Part Assessments

• STAAR assessments may be administered in multiple parts over more than one day.

• A STAAR assessment may not have more than three parts.

• A part of a STAAR assessment must be designed so that:

• if administered to students in grades 3 and 4, 85% of students will be able to complete that part within 60 minutes; and

• if administered to students in grades 5–8, 85% of students will be able to complete that part within 75 minutes.

House Bill 3906—Multi-Part Assessments

• The goal of multi-part assessments is to increase scheduling flexibility for districts.

• During the 2019–2020 school year, TEA will work with stakeholders to design options to best support districts and campuses while ensuring continued test security and validity.

• The multi-part assessment option will be available to districts during the 2020–2021 school year.

House Bill 3906—Multi-Part Assessments

• The SBOE by rule may designate sections of a STAAR mathematics assessment that:

• may be completed with the aid of technology and

• must be completed without the aid of technology.

• During the 2019–2020 school year, TEA will work with math educators and other stakeholders to design options to best support districts and campuses while ensuring strong alignment to the math TEKS.

• The rulemaking process for the SBOE typically takes 7 or more months; therefore, the implementation of calculator sections will be a few years away.

House Bill 3906—Multiple-Choice Questions

• Beginning with the 2022–2023 school year, STAAR assessments may not include more than 75% of the questions in a multiple-choice format.

• TEA began soliciting input from educators during summer 2019 to help identify non-multiple-choice formats that would best assess the TEKS.

• During the next few years, TEA will work with educators and other stakeholders to develop non-multiple-choice test questions for STAAR.

House Bill 3906—Stand-Alone Writing Tests

• Eliminates stand-alone writing tests for grades 4 and 7 beginning with the 2021–2022 school year.

• Writing skills will be assessed with reading skills in the future.

• There are NO changes to the STAAR grades 4 and 7 writing assessments for the 2019–2020 and 2020–2021 school years.

House Bill 3906—Electronic Administrations

• TEA, in consultation with the SBOE, shall develop a transition plan to administer assessments electronically beginning not later than the 2022–2023 school year.

• Not later than December 1, 2020, TEA shall submit to the legislature a report on the transition plan.

STAAR Substitute Assessments and Accountability

• Under ESEA, a state is required to administer the same academic assessments to measure the achievement of all public-school students and include these assessment results in the accountability system.

• Therefore, TEA is no longer able to use substitute assessments for purposes of accountability as indicated in a communication to districts dated June 20, 2019.

• Beginning with the December 2019 administration, substitute assessments will not be included in state or federal accountability calculations.

New Policy for STAAR Substitute Assessments

• To meet federal testing and accountability requirements, students will need to take STAAR EOC assessments at least once.

• For accountability purposes, taking a STAAR EOC assessment means receiving a score (i.e., score code “S”).

• If after taking the STAAR EOC assessment at least once and not meeting the passing requirement for graduation, a student may retake the EOC assessment or, if eligible, use a substitute assessment to satisfy the graduation requirement.

TAC 101.4002—STAAR Substitute Assessments

Texas Administrative Code (TAC) §101.4002, STAAR Substitute Assessments

• Being amended to require a student to take an EOC assessment at least once for the purpose of federal accountability.

• No recommended changes to the substitute assessments allowed or the required scores in the chart.

• Scheduled to be posted for public comment October 11–November 12, 2019.

• Proposed effective date is January 26, 2020.

New Policy for STAAR Substitute Assessments

• The recommended policy for the 2019–2020 school year is that a student takes an STAAR EOC assessment at least once prior to using a substitute assessment to fulfill testing graduation requirements.

• However, this new policy is not officially in effect until amendments to TAC §101.4002 are adopted.

Testing Requirements for Accelerated Students

• As indicated in a communication to districts dated August 22, 2019, there will be NO policy changes to the testing requirements for accelerated students for the 2019–2020 school year.

• Districts should continue to follow existing policies and guidance concerning testing accelerated students.

• Students in grades 3–8 take their enrolled grade-level assessment unless they are receiving instruction above-grade-level and taking an assessment that corresponds to that instruction.

• Students take EOC assessments as they are completing a high school course.

• No double-testing is required.

Testing Requirements for Accelerated Students

• TEA is working to implement new funding for SAT/ACT established under HB 3.

• This new funding will facilitate the implementation of federal testing requirements for students who have taken high school assessments prior to high school (i.e., accelerated students).

• TEA is also working with USDE to ensure the state’s testing policies meet all the requirements of ESEA.

Test security involves accounting for all secure materials before, during, and after each test administration. This includes:

Identifying who can handle secure materials• Individuals qualified to participate must:

Properly storing materials• Consider location• Limit access

Tracking the chain of custody• Document the transfer of materials through each stage

of an administration

Maintaining the integrity of tracking documentation• Store securely

Incidents resulting in a deviation from documented testing procedures are defined as testing irregularities. Test irregularities fall into one of two categories—serious or procedural.

Serious Irregularities Constitute severe violations of test security or confidentiality

Must be immediately investigated by the district testing coordinator

Must be reported to TEA as soon as the district testing coordinator is made aware of a possible or confirmed violation

Can result in the individual(s) responsible being referred to the TEA Educator Certification and Standards Division for consideration of disciplinary action

Serious Irregularities

Conduct that constitutes a serious testing irregularity may include, but is not limited to, the following:

directly or indirectly assisting students with responses to test questions

tampering with student responses

falsifying holistic ratings or student responses

viewing secure test content before, during, or after an administration unless specifically authorized by TEA or by the procedures outlined in the test administration manuals

discussing or disclosing secure test content or student responses

scoring student tests, either formally or informally

duplicating, recording, or electronically capturing confidential test content unless specifically authorized by TEA or by the procedures outlined in the test administration manuals

encouraging or assisting an individual to engage in the conduct described in the items listed above or in any other serious violation of security and confidentiality

failing to report to an appropriate authority that an individual has engaged or is suspected of engaging in conduct described in the items listed above or in any other serious violation of security and confidentiality

Violations of test security and confidentiality can result in the individual(s) responsible being referred to the TEA Educator Standards and Certification Legal Division for consideration of disciplinary action.

Any person who violates, assists in the violation of, or solicits another to violate or assist in the violation of test security or confidentiality, as well as any person who fails to report such a violation is subject to the following penalties:

placement of restrictions on the issuance, renewal, or holding of a Texas educator certificate, either indefinitely or for a set term

issuance of an inscribed or non-inscribed reprimand

suspension of a Texas educator certificate for a set term

revocation or cancellation of a Texas educator certificate without opportunity for reapplication for a set term or permanently

Imposition of any additional conditions or restrictions upon a certificate that the SBEC deems necessary to facilitate the rehabilitation and professional development of the educator

It is a Class C misdemeanor if: The person intentionally discloses the contents of any portion of a secure assessment

instrument developed or administered under TEC Section 39.0303, including the answer to any item in the assessment instrument, and

The disclosure affects or is likely to affect the individual performance of one or more students on the assessment instrument

What to do if you catch a student cheating Invalidate the student’s test by marking the score code “O” for “Other” on the student’s answer

document or in the online form

If a testing irregularity (such as inadequate monitoring) contributed to the cheating, an Incident Report must be filed

If a student photographs, duplicates, posts, or transmits secure test content or disseminates this information using an election device it is considered a serious violation – contact TEA immediately

Report any disciplinary action taken against the student using the Locally Determined Disciplinary Action (LDAA) form

Who can be a test administrator? Certified and noncertified paraprofessionals who are currently employed by the district and

routinely work with students in the classroom may serve as test administrators, monitors, or assistants only if they are trained in test administration procedures and sign an oath.

Paraprofessionals must be supervised, either directly or indirectly, by a certified professional on the same campus throughout the test administration.

Test Administrator Manuals must be provided to all test administrators Distribute manuals early enough to allow all test administrators sufficient time to thoroughly

read the material before training sessions. If you distribute manuals during training sessions, make sure your staff know when you will be

available for questions they come across while reading their manuals.

Remind staff that the oath they sign includes the confirmation that they will read their test administration manual before giving a state assessment.

Remind test administrators that manuals must be retained for use during the entire school year. You can also collect manuals and redistribute for the next administration if you prefer.

Students Who Become Sick During a Test

Make-up testing may also be used for a student who becomes sick and leaves campus during the test. If the student has not completed the assessment, he or she may complete the test within the scheduled administration dates.

Test administrators should keep track of the amount of time a student used on the first day so that the student is provided the remaining test time to complete the test on the make-up day.

Student must meet eligibility criteria throughout the whole testing window.

The district or charter school must review, verify, and maintain a copy of the medical documentation (e.g., licensed physician’s note).

To request a medical exclusion, the district testing coordinator must complete a Medical Exclusion Request form for each student who qualifies.

Eligibility Criteria

The student is unable to receive sufficient or consistent homebound services due to medical issues. (This means that the student is currently receiving homebound services; however, the homebound teacher is unable to provide services for the majority of the documented time due to the medical issues.)

The student is unable to respond to test questions due to a terminal or degenerative illness. (This means that the student's diagnosis is actively/currently affecting his or her daily activities such that no available accommodations can reasonably mitigate these factors.)

The student is receiving extensive short-term medical treatment due to a medical emergency or severe injury (e.g., coma, major head trauma, organ failure). Note: appendectomy, tonsillectomy, or broken arms/legs do not constitute a severe medical issue.

The student is unable to interact with peers or educators without the risk of infection or contamination to himself or herself or others (e.g., measles, respiratory illness, malaria). Note: colds and flu do not constitute a significant medical emergency.

Both paper and electronic dictionaries, including applications on a tablet, laptop, or desktop computer, are permitted. If electronic dictionaries are used by a student during testing, TEA guidelines on the use of this technology must be followed in order to maintain the security and validity of the assessment.

For a device or software to be considered appropriate for state assessment use, it must: be set in a mode that locks the user into a specific software program;

block the user from accessing functionality that may violate test security, such as

the ability to send secure test content (e.g., messages, captured images, videos);

the ability to send or receive any person-to-person communication about secure test content (e.g., chat, video); or

the ability to save secure test content.

STAAR Alternate 2 is an untimed assessment that can be given over multiple sessions.

Administer the assessment at a time that is most appropriate for a student;• Allowing breaks, as necessary;

• Administering the test over several days, one session each day.

Items are best tested with the entire four-item cluster intact, one cluster at a time. However, frequent breaks within the 4-item cluster may be required and necessary for some students.

Testing Environment

Test administrators must prepare the environment for the administration of STAAR Alternate 2.

STAAR Alternate 2 is administered to students in a one-on-one setting.

Test sessions• must be conducted under the best possible conditions with minimal

distractions• and in a setting that is arranged to maintain confidentiality of test material

and responses of individual students.

Districts with cameras in self-contained classrooms should use locally-developed policy which includes “penalties for prohibited conduct” in the event that a request is made to view video that was recorded during a test administration session

Entering Responses Online

Students taking the STAAR Alternate 2 administration communicate answers directly to the test administrator.

The test administrator records the student’s response on the STAAR Alternate 2 Scoring Document based on scoring information provided for each item.

The students’ responses are then entered into the Assessment Management System.

The district coordinator, campus coordinator, or other authorized personnel who have completed training and signed oath will enter scoring information into an online system.
