A BILL To improve public safety through sensible reforms to

firearms regulations.

Be it enacted by the Senate and House of Representa-1

tives of the United States of America in Congress assembled, 2

SECTION 1. SHORT TITLE. 3

This Act may be cited as the ‘‘Safer America for Ev-4

eryone Right Now Act’’ or the ‘‘SAFER Now Act’’. 5

SEC. 2. DEFINITIONS. 6

Section 921(a) of title 18, United States Code, is 7

amended— 8

(1) by inserting after paragraph (29) the fol-9

lowing: 10

‘‘(30) The term ‘semiautomatic pistol’ means any re-1

peating pistol that— 2

‘‘(A) utilizes a portion of the energy of a firing 3

cartridge to extract the fired cartridge case and 4

chamber the next round; and 5

‘‘(B) requires a separate pull of the trigger to 6

fire each cartridge. 7

‘‘(31) The term ‘semiautomatic shotgun’ means any 8

repeating shotgun that— 9

‘‘(A) utilizes a portion of the energy of a firing 10

cartridge to extract the fired cartridge case and 11

chamber the next round; and 12

‘‘(B) requires a separate pull of the trigger to 13

fire each cartridge.’’; and 14

(2) by adding at the end the following: 15

‘‘(36) The term ‘semiautomatic assault weapon’ 16

means any of the following, regardless of country of manu-17

facture or caliber of ammunition accepted: 18

‘‘(A) A semiautomatic rifle that has the capac-19

ity to accept a detachable magazine and any one of 20

the following: 21

‘‘(i) A pistol grip. 22

‘‘(ii) A forward grip. 23

‘‘(iii) A folding, telescoping, or detachable 24

stock. 25

‘‘(iv) A grenade launcher or rocket launch-1

er. 2

‘‘(v) A barrel shroud. 3

‘‘(vi) A threaded barrel. 4

‘‘(B) A semiautomatic rifle that has a fixed 5

magazine with the capacity to accept more than 10 6

rounds, except for an attached tubular device de-7

signed to accept, and capable of operating only with, 8

.22 caliber rimfire ammunition. 9

‘‘(C) Any part, combination of parts, compo-10

nent, device, attachment, or accessory that is de-11

signed or functions to accelerate the rate of fire of 12

a semiautomatic rifle but not convert the semiauto-13

matic rifle into a machinegun. 14

‘‘(D) A semiautomatic pistol that has the ca-15

pacity to accept a detachable magazine and any one 16

of the following: 17

‘‘(i) A threaded barrel. 18

‘‘(ii) A second pistol grip. 19

‘‘(iii) A barrel shroud. 20

‘‘(iv) The capacity to accept a detachable 21

magazine at some location outside of the pistol 22

grip. 23

‘‘(v) A semiautomatic version of an auto-24

matic firearm. 25

‘‘(F) A semiautomatic shotgun that has any one 4

‘‘(i) A folding, telescoping, or detachable 6

‘‘(ii) A pistol grip. 8

‘‘(iii) A fixed magazine with the capacity to 9

accept more than 5 rounds. 10

‘‘(iv) The ability to accept a detachable 11

magazine. 12

‘‘(v) A forward grip. 13

‘‘(vi) A grenade launcher or rocket launch-14

er. 15

‘‘(G) Any shotgun with a revolving cylinder. 16

‘‘(H) All of the following rifles, copies, dupli-17

cates, variants, or altered facsimiles with the capa-18

bility of any such weapon thereof: 19

‘‘(i) All AK types, including the following: 20

‘‘(I) AK, AK47, AK47S, AK–74, 21

AKM, AKS, ARM, MAK90, MISR, 22

NHM90, NHM91, Rock River Arms LAR– 23

47, SA85, SA93, Vector Arms AK–47, 24

VEPR, WASR–10, and WUM. 25

‘‘(K) All belt-fed semiautomatic firearms, in-1

cluding TNW M2HB and FN M2495. 2

‘‘(L) Any combination of parts from which a 3

firearm described in subparagraphs (A) through (K) 4

can be assembled. 5

‘‘(M) The frame or receiver of a rifle or shot-6

gun described in subparagraph (A), (B), (C), (F), 7

(G), (H), (J), or (K). 8

‘‘(37) The term ‘large capacity ammunition feeding 9

device’— 10

‘‘(A) means a magazine, belt, drum, feed strip, 11

or similar device, including any such device joined or 12

coupled with another in any manner, that has an 13

overall capacity of, or that can be readily restored, 14

changed, or converted to accept, more than 10 15

rounds of ammunition; and 16

‘‘(B) does not include an attached tubular de-17

vice designed to accept, and capable of operating 18

only with, .22 caliber rimfire ammunition. 19

‘‘(38) The term ‘barrel shroud’— 20

‘‘(A) means a shroud that is attached to, or 21

partially or completely encircles, the barrel of a fire-22

arm so that the shroud protects the user of the fire-23

arm from heat generated by the barrel; and 24

‘‘(B) does not include— 25

‘‘(ii) an extension of the stock along the 3

bottom of the barrel which does not encircle or 4

substantially encircle the barrel. 5

‘‘(39) The term ‘detachable magazine’ means an am-6

munition feeding device that can be removed from a fire-7

arm without disassembly of the firearm action. 8

‘‘(40) The term ‘fixed magazine’ means an ammuni-9

tion feeding device that is permanently fixed to the firearm 10

in such a manner that it cannot be removed without dis-11

assembly of the firearm. 12

‘‘(41) The term ‘folding, telescoping, or detachable 13

stock’ means a stock that folds, telescopes, detaches or 14

otherwise operates to reduce the length, size, or any other 15

dimension, or otherwise enhances the concealability, of a 16

firearm. 17

‘‘(42) The term ‘forward grip’ means a grip located 18

forward of the trigger that functions as a pistol grip. 19

‘‘(43) The term ‘rocket’ means any simple or complex 20

tubelike device containing combustibles that on being ig-21

nited liberate gases whose action propels the tube through 22

the air and has a propellant charge of not more than 4 23

ounces. 24

‘‘(44) The term ‘grenade launcher or rocket launcher’ 1

means an attachment for use on a firearm that is designed 2

to propel a grenade, rocket, or other similar destructive 3

device. 4

‘‘(45) The term ‘permanently inoperable’ means a 5

firearm which is incapable of discharging a shot by means 6

of an explosive and incapable of being readily restored to 7

a firing condition. 8

‘‘(46) The term ‘pistol grip’ means a grip, a thumb-9

hole stock, or any other characteristic that can function 10

as a grip. 11

‘‘(47) The term ‘threaded barrel’ means a feature or 12

characteristic that is designed in such a manner to allow 13

for the attachment of a device such as a firearm silencer 14

or a flash suppressor. 15

‘‘(48) The term ‘qualified law enforcement officer’ 16

has the meaning given the term in section 926B. 17

‘‘(49) The term ‘grandfathered semiautomatic as-18

sault weapon’ means any semiautomatic assault weapon 19

the importation, possession, sale, or transfer of which 20

would be unlawful under section 922(v) but for the excep-21

tion under paragraph (2) of such section. 22

‘‘(50) The term ‘belt-fed semiautomatic firearm’ 23

means any repeating firearm that— 24

cartridge to extract the fired cartridge case and 2

chamber the next round; 3

‘‘(B) requires a separate pull of the trigger to 4

fire each cartridge; and 5

tion feeding device. 7

‘‘(51) GUN SHOW.—The term ‘gun show’— 8

‘‘(A) means any event at which 50 or more fire-9

arms are offered or exhibited for sale, exchange, or 10

transfer, if one or more of the firearms has been 11

shipped or transported in, or otherwise affects, inter-12

state or foreign commerce; 13

‘‘(B) does not include an offer or exhibit of fire-14

arms for sale, exchange, or transfer by an individual 15

from the personal collection of that individual, at the 16

private residence of that individual, if the individual 17

is not required to be licensed under section 923; and 18

‘‘(C) does not include an offer or exhibit of fire-19

arms for sale, exchange, or transfer at events— 20

‘‘(i) where not more than 100 firearms are 21

offered or exhibited for sale, exchange or trans-22

fer; 23

‘‘(ii) that are conducted by private, not-for- 24

profit organizations whose primary purpose is 25

purpose of hunting activities; and 2

‘‘(iii) that are attended only by permanent 3

or annual dues-paying members of the organi-4

zations, and the members of the immediate 5

families of the dues-paying members. 6

‘‘(52) GUN SHOW VENDOR.—The term ‘gun show 7

vendor’ means a person who is not licensed under section 8

923 and who exhibits, sells, offers for sale, transfers, or 9

exchanges a firearm at a gun show, regardless of whether 10

or not the person arranges with the gun show operator 11

for a fixed location from which to exhibit, sell, offer for 12

sale, transfer, or exchange the firearm.’’. 13

SEC. 3. PROHIBITION ON FIREARMS DEALERS SELLING A 14

FIREARM PRIOR TO THE COMPLETION OF A 15

SEC. 4. RESTRICTIONS ON ASSAULT WEAPONS AND LARGE 1

CAPACITY AMMUNITION FEEDING DEVICES. 2

(a) IN GENERAL.—Section 922 of title 18, United 3

States Code, is amended— 4

(1) by inserting after subsection (u) the fol-5

lowing: 6

‘‘(v)(1) It shall be unlawful for a person to import, 7

sell, manufacture, transfer, or possess, in or affecting 8

interstate or foreign commerce, a semiautomatic assault 9

weapon. 10

‘‘(2) Paragraph (1) shall not apply to the possession, 11

sale, or transfer of any semiautomatic assault weapon oth-12

erwise lawfully possessed under Federal law on the date 13

of enactment of the Safer America for Everyone Right 14

Now Act. 15

‘‘(3) Paragraph (1) shall not apply to any firearm 16

that— 17

‘‘(A) is manually operated by bolt, pump, lever, 18

or slide action; 19

‘‘(B) has been rendered permanently inoperable; 20

or 21

‘‘(C) is an antique firearm, as defined in section 22

921 of this title. 23

‘‘(4) Paragraph (1) shall not apply to— 24

‘‘(A) the importation for, manufacture for, sale 25

by a licensed manufacturer or licensed importer for 8

the purposes of testing or experimentation author-9

‘‘(5) For purposes of paragraph (4)(A), the term 11

‘campus law enforcement officer’ means an individual who 12

is— 13

‘‘(A) employed by a private institution of higher 14

education that is eligible for funding under title IV 15

of the Higher Education Act of 1965 (20 U.S.C. 16

1070 et seq.); 17

‘‘(B) responsible for the prevention or investiga-18

tion of crime involving injury to persons or property, 19

including apprehension or detention of persons for 20

such crimes; 21

‘‘(C) authorized by Federal, State, or local law 22

to carry a firearm, execute search warrants, and 23

make arrests; and 24

‘‘(D) recognized, commissioned, or certified by 1

a government entity as a law enforcement officer. 2

‘‘(6) The Attorney General shall establish and main-3

tain, in a timely manner, a record of the make, model, 4

and, if available, date of manufacture of any semiauto-5

matic assault weapon which the Attorney General is made 6

aware has been used in relation to a crime under Federal 7

or State law, and the nature and circumstances of the 8

crime involved, including the outcome of relevant criminal 9

investigations and proceedings. The Attorney General 10

shall annually submit a copy of the record established 11

under this paragraph to the Congress and make the record 12

available to the general public. 13

‘‘(w)(1) It shall be unlawful for a person to import, 14

sell, manufacture, transfer, or possess, in or affecting 15

interstate or foreign commerce, a large capacity ammuni-16

tion feeding device. 17

‘‘(2) Paragraph (1) shall not apply to the possession 18

of any large capacity ammunition feeding device otherwise 19

lawfully possessed on or before the date of enactment of 20

the Safer America for Everyone Right Now Act. 21

‘‘(3) Paragraph (1) shall not apply to— 22

‘‘(A) the importation for, manufacture for, sale 23

to, transfer to, or possession by the United States 24

or a department or agency of the United States or 25

other than a licensed importer, licensed manufacturer, or 8

licensed dealer, to store or keep under the dominion or 9

control of that person any grandfathered semiautomatic 10

assault weapon that the person knows, or has reasonable 11

cause to believe, will be accessible to an individual prohib-12

ited from receiving or possessing a firearm under sub-13

section (g), (n), or (x), or any provision of State law, un-14

less the grandfathered semiautomatic assault weapon is— 15

‘‘(1) carried on the person, or within such close 16

proximity that the person can readily retrieve and 17

use the grandfathered semiautomatic assault weapon 18

as if the grandfathered semiautomatic assault weap-19

on were carried on the person; or 20

‘‘(2) locked by a secure gun storage or safety 21

device that the prohibited individual has no ability to 22

access.’’. 23

(b) IDENTIFICATION MARKINGS FOR SEMIAUTO-24

MATIC ASSAULT WEAPONS.—Section 923(i) of title 18, 25

on the weapon, and such other identification as the Attor-7

ney General shall by regulations prescribe.’’. 8

(c) IDENTIFICATION MARKINGS FOR LARGE CAPAC-9

ITY AMMUNITION FEEDING DEVICES.—Section 923(i) of 10

title 18, United States Code, as amended by this Act, is 11

amended by adding at the end the following: ‘‘A large ca-12

pacity ammunition feeding device manufactured after the 13

date of enactment of the Safer America for Everyone 14

Right Now Act shall be identified by a serial number and 15

the date on which the device was manufactured or made, 16

legibly and conspicuously engraved or cast on the device, 17

and such other identification as the Attorney General shall 18

by regulations prescribe.’’. 19

(d) SEIZURE AND FORFEITURE OF LARGE CAPACITY 20

AMMUNITION FEEDING DEVICES.—Section 924(d) of title 21

18, United States Code, is amended— 22

(1) in paragraph (1)— 23

this Act, is amended— 23

subsection (s). Upon taking custody of the grandfathered 22

semiautomatic assault weapon, the licensee shall comply 23

with all requirements of this chapter as if the licensee were 24

transferring the grandfathered semiautomatic assault 25

weapon from the licensee’s inventory to the unlicensed 1

transferee. 2

‘‘(2) Paragraph (1) shall not apply to a temporary 3

transfer of possession for the purpose of participating in 4

target shooting in a licensed target facility or established 5

range if— 6

‘‘(A) the grandfathered semiautomatic assault 7

weapon is, at all times, kept within the premises of 8

the target facility or range; and 9

‘‘(B) the transferee is not known to be prohib-10

ited from possessing or receiving a grandfathered 11

semiautomatic assault weapon. 12

‘‘(3) For purposes of this subsection, the term ‘trans-13

fer’— 14

‘‘(A) shall include a sale, gift, or loan; and 15

‘‘(B) does not include temporary custody of the 16

grandfathered semiautomatic assault weapon for 17

purposes of examination or evaluation by a prospec-18

tive transferee. 19

‘‘(4)(A) Notwithstanding any other provision of this 20

chapter, the Attorney General may implement this sub-21

section with regulations. 22

‘‘(B) Regulations promulgated under this para-23

graph— 24

imum fee that may be charged by licensees for serv-2

ices provided in accordance with paragraph (1); and 3

accordance with paragraph (1).’’. 7

title 18, United States Code) by a person would violate 19

subsection (g) or (n) of section 922 of title 18, United 20

States Code, the System shall notify the law enforcement 21

agencies described in subsection (b), including in a case 22

where such a determination is made after 14 business days 23

have elapsed since the licensee contacted the System. 24

(a) REGULATION OF FIREARMS TRANSFERS AT GUN 5

SHOWS.— 6

(1) IN GENERAL.—Chapter 44 of such title is 7

amended by adding at the end the following: 8

‘‘§ 932. Regulation of firearms transfers at gun shows 9

‘‘(a) REGISTRATION OF GUN SHOW OPERATORS.— 10

It shall be unlawful for a person to operate a gun show, 11

unless— 12

‘‘(1) the person has attained 21 years of age; 13

‘‘(2) the person (and, if the person is a corpora-14

tion, partnership, or association, each individual pos-15

sessing, directly or indirectly, the power to direct or 16

cause the direction of the management and policies 17

of the corporation, partnership, or association) is not 18

prohibited by subsection (g) or (n) of section 922 19

from transporting, shipping, or receiving firearms or 20

ammunition in interstate or foreign commerce; 21

‘‘(3) the person has not willfully violated any 22

provision of this chapter or regulation issued under 23

this chapter; 24

ney General as a gun show operator, in accordance 2

with regulations promulgated by the Attorney Gen-3

eral, and as part of the registration— 4

‘‘(A) has provided the Attorney General 5

with a photograph and the fingerprints of the 6

person; and 7

‘‘(B) has certified that the person meets 8

the requirements of subparagraphs (A) through 9

(D) of section 923(d)(1); 10

‘‘(5) the person has not willfully failed to dis-11

close any material information required, and has not 12

made any false statement as to any material fact, in 13

connection with the registration; and 14

‘‘(6) the person has paid the Attorney General 15

a fee for the registration, in an amount determined 16

by the Attorney General. 17

‘‘(b) RESPONSIBILITIES OF GUN SHOW OPERA-18

TORS.— 19

‘‘(1) IN GENERAL.—It shall be unlawful for a 20

person to operate a gun show, unless the person— 21

commencement of the gun show, notifies the 23

Attorney General, in writing, of the date, time, 24

identity of each person who will be a gun show 1

vendor at the gun show; 2

‘‘(B) before commencement of the gun 3

show— 4

‘‘(i) verifies the identity of each indi-5

vidual who will be a gun show vendor at 6

the gun show by examining a valid identi-7

fication document (as defined in section 8

1028(d)(4)) of the individual containing a 9

photograph of the individual; and 10

‘‘(ii) requires each such individual to 11

sign— 12

‘‘(I) a ledger, and enter into the 13

ledger identifying information con-14

cerning the individual; and 15

‘‘(II) a notice which sets forth 16

the obligations of a gun show vendor 17

under this chapter; and 18

‘‘(C) notifies each person who attends the 19

gun show of the requirements of this chapter, 20

in accordance with such regulations as the At-21

torney General shall prescribe. 22

‘‘(2) RECORDKEEPING.—A person who oper-23

ates, or has operated, a gun show shall maintain 24

records demonstrating compliance with paragraph 25

in such form as the Attorney General shall require 2

by regulation, or transmit the records to the Attor-3

‘‘(c) BACKGROUND CHECK REQUIRED BEFORE 5

TRANSFER OF FIREARM BETWEEN UNLICENSED PER-6

SONS.—It shall be unlawful for a person who is not li-7

censed under this chapter to transfer possession of, or title 8

to, a firearm at, or on the curtilage of, a gun show, to 9

another person who is not so licensed, or for a person who 10

is not so licensed to receive possession of, or title to, a 11

firearm at, or on the curtilage of, a gun show from another 12

person who is not so licensed, unless a licensed importer, 13

licensed manufacturer, or licensed dealer— 14

‘‘(1) has entered into a separate bound record 15

the make, model, and serial number of the firearm, 16

and such other information about the transaction as 17

the Attorney General may require by regulation; and 18

‘‘(2) has notified the prospective transferor and 19

prospective transferee of the firearm that the na-20

tional instant criminal background check system es-21

tablished under section 103 of the Brady Handgun 22

Violence Prevention Act has provided the licensee 23

with a unique identification number, indicating that 24

receipt of the firearm by the prospective transferee 25

would not violate section 922 of this title or State 1

law. 2

‘‘(d) RECORDKEEPING REQUIREMENTS.— 3

‘‘(1) IN GENERAL.—A licensee who provides a 4

notice pursuant to subsection (c)(2) with respect to 5

the transfer of a firearm shall— 6

‘‘(A) not later than 10 days after the date 7

of the transfer, submit to the Attorney General 8

a report of the transfer, which report shall 9

specify the make, model, and serial number of 10

the firearm, and contain such other information 11

and be on such form, as the Attorney General 12

shall require by regulation, except that the re-13

port shall not include the name of or other 14

identifying information relating to any person 15

involved in the transfer who is not licensed 16

under this chapter; and 17

‘‘(B) retain a record of the transfer, in-18

cluding the same information as would be re-19

quired if the transfer were from the inventory 20

of the licensee, as part of the permanent busi-21

ness records of the licensee. 22

‘‘(2) LIMITATION.—The Attorney General may 23

not impose any recordkeeping requirement on any 24

gun show vendor by reason of this section.’’. 25

(2) PENALTIES.—Section 924(a) of such title is 1

amended by adding at the end the following: 2

‘‘(8)(A) Whoever knowingly violates subsection (a) or 3

(d) of section 932 shall be fined under this title, impris-4

oned not more than 5 years, or both. 5

‘‘(B) Whoever knowingly violates subsection (b) or (c) 6

of section 932, shall be— 7

‘‘(i) fined under this title, imprisoned not more 8

than 2 years, or both; and 9

‘‘(ii) in the case of a second or subsequent con-10

viction, fined under this title, imprisoned not more 11

than 5 years, or both. 12

‘‘(C) In addition to any other penalties imposed 13

under this paragraph, the Attorney General may, with re-14

spect to any person who knowingly violates any provision 15

of section 932— 16

‘‘(i) if the person is registered pursuant to sec-17

tion 932(a), after notice and opportunity for a hear-18

ing, suspend for not more than 6 months or revoke 19

the registration of that person under section 932(a); 20

and 21

‘‘(ii) impose a civil fine in an amount equal to 22

not more than $10,000.’’. 23

licensees conducting business at the gun show. The entry 12

and examination shall be conducted for the purposes of 13

determining compliance with this chapter by gun show op-14

erators and licensees conducting business at the gun show, 15

and shall not require a showing of reasonable cause or 16

a warrant.’’. 17

(c) REPORTS OF MULTIPLE SALES ASSISTED BY LI-18

CENSEES AT GUN SHOWS.—Section 923(g)(3)(A) of such 19

title is amended by inserting ‘‘or provides pursuant to sec-20

tion 932(c)(2) notice with respect to,’’ after ‘‘sells or oth-21

erwise disposes of,’’. 22

(d) INCREASED PENALTIES FOR SERIOUS RECORD-23

KEEPING VIOLATIONS BY LICENSEES.—Section 924(a)(3) 24

of such title is amended to read as follows: 25

quired by this chapter to be kept in the records of a person 5

licensed under this chapter, or violates section 922(m), 6

shall be fined under this title, imprisoned not more than 7

1 year, or both. 8

‘‘(B) If the violation described in subparagraph (A) 9

is in relation to an offense— 10

‘‘(i) under paragraph (1) or (3) of section 11

922(b), such person shall be fined under this title, 12

imprisoned not more than 5 years, or both; or 13

‘‘(ii) under subsection (a)(6) or (d) of section 14

922, such person shall be fined under this title, im-15

prisoned not more than 10 years, or both.’’. 16

(e) INCREASED PENALTIES FOR VIOLATIONS OF 17

CRIMINAL BACKGROUND CHECK REQUIREMENTS.— 18

(1) PENALTIES.—Section 924(a)(5) of such 19

title is amended— 20

(A) by striking ‘‘subsection (s) or (t) of 21

(2) ELIMINATION OF CERTAIN ELEMENTS OF 1

OFFENSE.—Section 922(s)(5) of such title, as so re-2

designated by the preceding provisions of this Act, 3

is amended by striking ‘‘and, at the time’’ and all 4

that follows through ‘‘State law’’. 5

(f) AUTHORITY TO HIRE PERSONNEL TO INSPECT 6

GUN SHOWS.—The Director of the Bureau of Alcohol, To-7

bacco, Firearms and Explosives may hire at least 40 addi-8

tional Industry Operations Investigators for the purpose 9

of carrying out inspections of gun shows (as defined in 10

section 921(a)(51) of title 18, United States Code). 11

(g) REPORT TO THE CONGRESS.—The Director of 12

the Bureau of Alcohol, Tobacco, Firearms and Explosives 13

shall submit biennial reports to the Congress on how fire-14

arms (as defined in section 921(a)(3) of title 18, United 15

States Code) are sold at gun shows (as defined in para-16

graph (51) of such section), how this section is being car-17

ried out, whether firearms are being sold without back-18

ground checks conducted by the national instant criminal 19

background check system established under section 103 20

of the Brady Handgun Violence Prevention Act, what re-21

sources are needed to carry out this section, and any rec-22

ommendations for improvements to ensure that firearms 23

are not sold without the background checks. 24

SEC. 9. FIREARMS TRAFFICKING. 4

(a) IN GENERAL.—Chapter 44 of title 18, United 5

States Code, as amended by the preceding provisions of 6

this Act, is amended by adding at the end the following: 7

‘‘§ 933. Trafficking in firearms 8

‘‘(a) OFFENSES.—Except as provided in subsection 9

(b), it shall be unlawful for any person, in or affecting 10

interstate commerce— 11

‘‘(1) to purchase, attempt to purchase, or trans-12

fer a firearm, with the intent to deliver the firearm 13

to another person who the transferor knows, or has 14

reasonable cause to believe, is prohibited by Federal 15

or State law from possessing a firearm; 16

‘‘(2) in purchasing, attempting to purchase, or 17

transferring a firearm, to intentionally provide false 18

or misleading material information on a Bureau of 19

Alcohol, Tobacco, Firearms and Explosives firearms 20

transaction record form; or 21

‘‘(3) to knowingly direct, promote, or facilitate 22

conduct that violates paragraph (1) or (2). 23

‘‘(b) GIFT EXCEPTIONS.—Subsection (a) shall not 24

apply to a firearm that is— 25

to another person not prohibited from possessing a 2

firearm under Federal or State law as a gift; or 3

‘‘(2) lawfully received or otherwise acquired by 4

a court-appointed trustee, receiver, or conservator 5

for, or on behalf of, an estate or creditor or by a 6

person to carry out a bequest, or an acquisition by 7

intestate succession under the laws of the State of 8

residence of the person. 9

‘‘(c) PENALTIES.— 10

‘‘(1) IN GENERAL.—Any person who violates 11

this section shall be fined under this title, impris-12

oned for not more than 20 years, or both. 13

‘‘(2) ORGANIZER ENHANCEMENT.—If a viola-14

tion of subsection (a) is committed by a person in 15

concert with 5 or more other persons with respect to 16

whom such person occupies a position of organizer, 17

a supervisory position, or any other position of man-18

agement, such person may be sentenced to an addi-19

tional term of imprisonment of not more than 5 con-20

secutive years. 21

‘‘(3) CONSPIRACY.—Any person who conspires 22

to commit an offense described in this section shall 23

be fined under this title, imprisoned for not more 24

than 10 years, or both.’’. 25

(b) TECHNICAL AND CONFORMING AMENDMENT.— 1

The table of sections for chapter 44 of title 18, United 2

States Code, as amended by the preceding provisions of 3

this Act, is amended by adding at the end the following: 4

‘‘933. Trafficking in firearms.’’.

(c) DIRECTIVE TO THE SENTENCING COMMISSION.— 5

(1) IN GENERAL.—Pursuant to its authority 6

under section 994(p) of title 28, United States Code, 7

the United States Sentencing Commission shall re-8

view and, if appropriate, amend the Federal sen-9

tencing guidelines and policy statements applicable 10

to persons convicted of offenses under section 933 of 11

title 18, United States Code (as added by subsection 12

(a)). 13

(2) REQUIREMENT.—In carrying out this sec-14

tion, the Commission shall review the penalty struc-15

ture that the guidelines currently provide based on 16

the number of firearms involved in the offense and 17

determine whether any changes to that penalty 18

structure are appropriate in order to reflect the in-19

tent of Congress that such penalties reflect the grav-20

ity of the offense. 21

SEC. 10. ADDITION OF DATING PARTNERS AND INDIVID-22

UALS SUBJECT TO RESTRAINING ORDERS. 23

(a) DEFINITION.—Section 921(a) of title 18, United 24

States Code, is amended— 25

‘‘(bb)(1) Except as provided in paragraph (2), on and 1

after the date that is 180 days after the date of enactment 2

of this subsection, it shall be unlawful for any person to 3

import, sell, manufacture, transfer, or possess, in or af-4

fecting interstate or foreign commerce, a trigger crank, 5

a bump-fire device, or any part, combination of parts, 6

component, device, attachment, or accessory that is de-7

signed or functions to accelerate the rate of fire of a semi-8

automatic rifle but not convert the semiautomatic rifle 9

into a machinegun. 10

‘‘(2) This subsection does not apply with respect to 11

the importation for, manufacture for, sale to, transfer to, 12

or possession by or under the authority of, the United 13

States or any department or agency thereof or a State, 14

or a department, agency, or political subdivision thereof.’’; 15

and 16

(2) in section 924(a)(2), by striking ‘‘, or (o)’’ 17

and inserting ‘‘(o), or (bb)’’. 18

SEC. 12. SEVERABILITY. 19

If any provision of this Act, an amendment made by 20

this Act, or the application of such provision or amend-21

ment to any person or circumstance is held to be unconsti-22

tutional, the remainder of this Act, the amendments made 23

by this Act, and the application of such provision or 24
