Legislation on refrigerants

“Ozone Layer Protection Act” (1988)

- Regulation on production and consumption of CFC and HCFC (abbr. OLP Act) - Maximum allowance of refrigerant consumption similar to Kigali agreement

“Act on Rational Use and Proper Management of Fluorocarbons” (revised in 2015)

- Regulation on emission of HFC/HCFC/CFC refrigerants (abbr. Fgas Act) - Target GWP and year for each product group

“High Pressure Gas Safety Act” (revised in 2016)

- Regulation on safety of flammable (toxic) gas - Method of safe use of products and refrigerants - A2L refrigerants are included as “particular inert gas”

“Global Warming Countermeasure Plan” (Cabinet Decision in 2016)

- Regulation on emission of energy origin CO2

3.Japanese regulation amendment trend

To secure of the “Montreal Protocol on Substances that Deplete the Ozone Layer”, Japan has made try to convert those “Ozone Depleting Substances" to “Alternative Refrigerants” according to the “Ozone Layer Protection Low".

Outline of current ozone layer protection law

Montreal Protocol ・Each member country is requested to reduce of production/consumption of ozone depleting substances step by step. ・It was adopted in 1987, Currently 196 countries and EU agreed.

Ozone layer protection law ・ METI and MOE determine the limit of the production/consumption of Ozone Depleting substances, which is based on the protocol, and announce them officially. ・Approval/permission of the METI are needed to manufacture/import the Ozone Depleting Substances.

Domestic security measures

・In October 2016, the Protocol was amended at Kigali in Rwanda, which impose to reduce production/consumption of alternative refrigerants considering highly global warming caused by greenhouse gases. Thus new domestic security measure are necessary. ・Kigali amendment has already been concluded by 28 countries as of March 2018,

which will almost issue on 1st January 2019 as it meets the requirements that 20 countries agree with the revision.

※Approval of amendment of the Protocol will be done on this ordinary Diet session.

Contents of amendment of Ozone Layer Protection Law

Major security measures

・METI and MOE determine the limit of the production/consumption of Alternative Refrigerants, which is based on the protocol, and announce them officially. ・Manufacturers should gain permission of METI. ・Importers should gain approval by METI related to the foreign exchange low. ※The primary use of Alternative Refrigerants in Japan is for refrigerant application (Approx 90%) The rest is for foaming, propellants for molding insulating material.

・According to the Kigali amendment, the total amount of Alternative Refrigerants production and consumption will be reduced after 2019 step by step. ・It offer a incentive to manufacturers that developed new-refrigerants with quite few greenhouse gases, which contributes to reduce alternative refrigerants in the whole county. ・We plan to promote the development/introduction of “New” Refrigerants and equipment with it to achieve the reduction target after 2029 that is getting more strict.
