This program will complement the Construction Engineering program and expand the number of graduates leaving the university ready to make a positive impact in the construction industry To talk about all the great news at SDSU, University President Dr. Adela de la Torre will be the keynote speaker at next week's Annual Meeting. New start time for AGC San Diego Chapter's 92nd Annual Meeting to be 10:30 a.m. on December 17. We welcome the President of SDSU, Dr. Adela de la Torre as Guest Speaker. Steve Friar, Hensel Phelps, AGC 2019 President We are pleased to have the President of SDSU, Dr. Adela de la Torre speak to us at the AGC Annual Meeting on Tuesday December 17 and invite all members to attend. To accommodate her busy schedule as President of SDSU, timing for the AGC Annual Meeting will change to 10:30 - 12:30. at the Hilton San Diego on Mission Bay (1775 East Mission Bay Drive, San Diego, CA 92109). Joining the campus in June 2018, Dr. de la Torre is the ninth permanent president of SDSU and the first woman to serve in that role. She brings with her 30 years of service in leadership roles within institutions of higher education, including the California State University system, the University of Arizona and the University of California, Davis. At the Annual Meeting "Active Members" have the important task of electing individuals to fill open seats on the Board of Directors. Year round, this elected AGC leadership makes decisions on your behalf that influence local infrastructure funding, industry practices, public policy, and politics. While Specialty and Affiliate members will not be able to vote, the Board is convinced that sharing the valuable information about the association with the entire membership is important.

EDUCATION CATALOG

In addition to the election of members to the Board of Directors, AGC San Diego CEO, Eddie Sprecco, will present the AGC's 2019 Annual Report, detailing the activities and finances of the AGC. This will include acknowledging our dedicated members who are the backbone of the San Diego chapter; our chairmen and chairwomen who head up the many AGC committees. "Active" members are defined in the Bylaws as General Contractors (Building and Engineering) and Contractor members. Contractor members are Subcontractors that participate in one of AGC's major programs (health, apprenticeship, pension, etc.), and pay local dues that are equal to the dues paid by the General Contractors. Your involvement is critical, and the 2019 Annual Report will detail how valuable member resources are working for you. We encourage all AGC firms to take a couple of hours out of your schedule on December 17 to attend this final meeting of the year.

Current Industry Issues in Washington D.C. Mike McManus, Director of Engineering Construction At the recent AGC Highway and Utility Contractors Conference in Tucson, a report by AGC staff was given to the attendees on current national issues being worked on in Washington D.C. A few of the bigger issues that could impact the construction industry are as follows. Protect the Right to Work (PRO) Act In the world of labor and employment policy, it is a well-known fact that organized labor has been hemorrhaging members for the past 65 years, and labor leaders have sought innumerable ways to reverse that trend as we have seen in San Diego. Since peaking at roughly 35% of the workforce in the 1950s, union membership has steadily declined. In 2018, it stood at just 10.5% of the workforce, with a mere 6.4% membership rate in the private sector. To address this decline, the unions have turned to their political allies hoping that a dramatic rewrite of the National Labor

Relations Act (NLRA) and other statutes will help. The latest legislation is called the Protecting the Right to Organize (PRO) Act, introduced earlier this year, by the new chair of the House Education and Labor Committee, Rep. Bobby Scott (D-VA), and in the Senate by Sen. Patty Murray (D-WA), ranking member of the Senate Committee on Health, Education, Labor, and Pensions. Despite its name, there is nothing positive about the bill. With over 200 co-sponsors in the House and 40 in the Senate as of today, the PRO Act would dramatically change the NLRA in ways that would be harmful to employers, and the economy. The PRO Act would obliterate many worker and employer protections that have been in the law for over 70 years. It would provide labor unions with numerous means to advance their organizing agenda, and it represents a significant threat to employers that must be taken seriously. Highway Funding Rescission Repeal State departments of transportation and construction industry groups have scored a major win, with the enactment of legislation that cancels a threatened $7.6-billion cut, called a rescission, in federal highway funds. AGC of America and other pro-infrastructure groups had been pushing for months for Congress to abolish the highway funding cut. This coalition had tried, without success, to attach anti-rescission language to various other bills, such as the budget agreement enacted earlier this year. The cutback in highway contract authority, mandated in the 2015 Fixing America's Surface Transportation (FAST) Act, was scheduled to take effect on July 1, 2020. When the FAST Act was passed, the rescission was viewed as a way to reduce that bill's overall price tag. Adding urgency to the rescission-repeal campaign, the Federal Highway Administration recently released figures showing that states had $5.4 billion in unobligated highway funds that would be rescinded next year. To fulfill the $7.6-billion cut, that meant that states would have lost another $2.2 billion that they already obligated to projects. Rehabilitation for Multi-employer Pensions Act of 2019 This bill would establish the Pension Rehabilitation Administration within the Department of the Treasury and a related trust fund to make loans to certain multi-employer defined benefit pension plans.

To receive a loan, a plan must be (1) in critical and declining status, including any plan with respect to which a suspension of benefits has been approved; (2) in critical status, having a modified funded percentage of less than 40%, and having a ratio of active to inactive participants which is less than two to five; or (3) insolvent, if the plan became insolvent after December 16, 2014, and has not been terminated. The bill allows the sponsor of a multi-employer pension plan that is applying for a loan under this bill to also apply to the Pension Benefit Guaranty Corporation (PBGC) for financial assistance if, after receiving the loan, the plan will still become (or remain) insolvent within the 30-year period beginning on the date of the loan.

AGC's PAC to Raise Funds at Shooting Contest on December 12 - Still Time to Register! Brad Barnum, Executive Vice President AGC's Political Action Committee (PAC) is taking aim at the 2020 elections, and a fundraiser for the PAC will be held on Thursday, December 12. A shooting contest is set at Poway Weapons & Gear from 3:30 p.m. to 6:30 p.m., and the gallery of AGC sponsors are: Alliant Insurance Services Casper Company Finch, Thornton & Baird, LLP Hensel Phelps Orion Construction Rowan Electric TC Construction Co. This will be a three-station shooting contest with hand guns and long rifles. The weapons and ammo will be provided, but you are more than welcome to bring your own. Refreshments and food will be provided, along with a raffle for prizes. The funds raised from the event and raffle will go a long way to help get AGC's endorsed candidates elected, and pass/defeat the various measures on the March and November ballots.
